Short answer: YES.
You can still privately sell or transfer an AR-15 in Colorado — but the rules changed on August 1, 2026.
If your AR-15 qualifies as a Specified Semiautomatic Firearm (SSF) under SB25-003, the buyer generally must satisfy Colorado’s new SSF requirements before receiving it.
But there may be another option..
Colorado law specifically excludes firearms with a permanently fixed magazine that cannot accept more than 15 rounds, including semiautomatic firearms that have been converted to that configuration.
That means Damage Factory may be able to convert a qualifying AR-15 to a permanently fixed-magazine configuration before the private transfer, potentially taking the firearm outside the SSF classification and avoiding the additional SSF process for the buyer.
For some private sales, this may be the fastest and least expensive path — while the normal background-check and private-transfer requirements still apply.

CAN I STILL SELL MY AR-15 TO MY FRIEND OR A PRIVATE BUYER IN COLORADO?

Short answer: YES — but if your AR-15 qualifies as a Specified Semiautomatic Firearm, Colorado’s new SB25-003 requirements can apply to the buyer, or you must apply a certain modification to your AR-15.
One of the most common questions we’re hearing at Damage Factory since Colorado’s new semiautomatic firearm law took effect is:
“I already own my AR-15. Can I sell it to my friend?”
Yes, Colorado law still provides a legal path for private firearm transfers.
But you generally cannot simply take the money and hand the buyer the rifle.
Colorado already required most private firearm transfers to involve a federally licensed firearms dealer (FFL) for the required background check. And beginning August 1, 2026, SB25-003 added additional requirements when the firearm being transferred qualifies as a Specified Semiautomatic Firearm (SSF).
Here’s what Colorado gun owners need to know.
PRIVATE FIREARM SALES ALREADY REQUIRED A BACKGROUND CHECK
This part isn’t new.
Colorado has generally required background checks for private firearm transfers since July 1, 2013.
Colorado Revised Statutes §18-12-112 states that, subject to statutory exceptions, before an unlicensed person transfers possession of a firearm, a background check must be conducted on the prospective transferee and the transfer must receive approval from the Colorado Bureau of Investigation.
In practical terms, a typical private firearm transaction looks like this:
SELLER → LICENSED FFL → BACKGROUND CHECK → BUYER
The FFL processes the transfer and performs the required background check before the buyer takes possession.
So even before SB25-003, simply meeting someone in a parking lot, accepting cash and handing over your AR-15 generally was not the proper way to conduct a Colorado private firearm sale.
There are statutory exceptions to Colorado’s private-transfer requirements, so particular family, temporary-transfer and other situations should be evaluated separately.

WHAT CHANGED AUGUST 1, 2026?
This is where SB25-003 comes in.
Colorado’s new law created a category called a:
SPECIFIED SEMIAUTOMATIC FIREARM — “SSF”
The law generally includes certain semiautomatic rifles and shotguns with detachable magazines, as well as certain gas-operated semiautomatic handguns with detachable magazines, subject to definitions and exclusions contained in the statute.
Many conventional detachable-magazine AR-15 configurations therefore fall within the SSF definition.
And the law doesn’t only talk about buying a brand-new firearm from a gun store.
It also regulates TRANSFERS.
Colorado Parks & Wildlife states:
“This law only affects those who will purchase and/or transfer SSFs on or after August 1, 2026.”
That distinction matters.
Buying your buddy’s used AR-15 doesn’t automatically avoid SB25-003 simply because the firearm isn’t new.
SO CAN I SELL MY AR-15 TO MY FRIEND?
YES — assuming the transaction and buyer satisfy the applicable Colorado and federal requirements.
For a typical private transfer, you should expect the transaction to involve a licensed FFL.
If the AR-15 qualifies as an SSF, SB25-003 also matters.
The enacted law specifically allows a person to transfer an SSF to a federally licensed firearms dealer, and it establishes circumstances under which an eligible person may receive or purchase an SSF.
So don’t think of it as:
YOU → CASH → FRIEND → DONE
Think of it as a regulated firearm transfer in which the FFL handles the transfer process and determines what documentation and approvals are required before releasing the firearm.
DOES MY FRIEND NEED THE NEW SSF ELIGIBILITY REQUIREMENTS?
If the firearm qualifies as a Specified Semiautomatic Firearm and no statutory exception applies, the buyer/recipient must satisfy the applicable SB25-003 requirements before receiving or purchasing the firearm.
Colorado Parks & Wildlife’s current guidance directs customers through its Firearms Safety System and Sheriff’s Office process and requires the applicable firearms safety training.
The key point is simple:
BUYING USED DOESN’T AUTOMATICALLY GET AROUND SB25-003.
A private-party transfer is still a transfer.
WHAT IF I ALREADY OWN AN AR-15? CAN DAMAGE FACTORY INSTALL A FIXED MAGAZINE?
Potentially — and for some owners, this may be the fastest and least expensive path to a private transfer without putting the buyer through the additional SSF process.
This is one of the most interesting provisions in SB25-003.
Colorado didn’t just exclude firearms originally manufactured with qualifying fixed magazines.
The law specifically addresses firearms that have been converted.
The actual statute excludes:
“A firearm that has a permanently fixed magazine that cannot accept more than fifteen rounds of ammunition, including a semiautomatic firearm that has been converted to have a permanently fixed magazine that cannot accept more than fifteen rounds of ammunition.”

THAT MEANS YOUR EXISTING AR-15 MAY HAVE ANOTHER OPTION.
Suppose you own a conventional AR-15 with a detachable magazine and want to privately sell it to another Colorado resident.
Instead of requiring the buyer to complete the additional process applicable to a Specified Semiautomatic Firearm, Damage Factory may be able to convert the firearm to a qualifying permanently fixed-magazine configuration before the transfer. In most cases, it costs less than $90 to do so.
If the completed configuration satisfies Colorado’s statutory requirements, the firearm is excluded from the definition of a Specified Semiautomatic Firearm (SSF).
WHY WOULD SOMEONE DO THIS?
For a buyer who hasn’t completed Colorado’s SSF requirements, this may provide a much simpler option:
Bring the AR-15 to Damage Factory
↓
Have Damage Factory evaluate the firearm
↓
Convert it to a qualifying permanently fixed magazine of 15 rounds or fewer, where appropriate
↓
Process the normal private-party firearm transfer and background check
↓
Buyer takes possession after all applicable transfer requirements are satisfied
For the right firearm and transaction, this could be substantially faster and less expensive than having a buyer start the entire SSF eligibility and training process solely to purchase one used AR-15.
IMPORTANT: “FIXED MAGAZINE” DOESN’T MEAN ANY MAG-LOCK DEVICE
This distinction is important.
SB25-003 doesn’t simply say “fixed magazine.”
It says:
PERMANENTLY FIXED MAGAZINE.
So don’t buy a random “California compliant” part online, install it yourself and assume you’re automatically exempt from Colorado’s SSF law.
California compliance and Colorado compliance are not necessarily the same thing.
The firearm’s final configuration must satisfy Colorado’s definition.

It does not eliminate other applicable state or federal transfer requirements, including Colorado’s private-transfer/background-check requirements. WHAT IF MY FRIEND ALREADY OWNED AN AR-15 BEFORE AUGUST 1?
Owning an AR-15 before August 1 and acquiring another AR-15 after August 1 are two different questions.
SB25-003’s new purchase/transfer provisions concern transactions occurring on or after August 1, 2026.
The fact that your friend already owns another AR-15 does not, by itself, mean a new transfer is exempt.
WHAT IF I GIVE HIM THE AR-15 INSTEAD OF SELLING IT?
Don’t assume changing the word “sale” to “gift” makes the rules disappear.
Colorado’s existing private-transfer statute regulates transfers of possession, not simply commercial sales.
There are specific exceptions within Colorado law for certain transfers and circumstances, but whether an exception applies depends on the actual facts.
If you’re unsure, ask an FFL before transferring possession.
WHAT IF THE AR-15 HAS A FIXED MAGAZINE?
Now it gets interesting.
Not every semiautomatic AR-style firearm necessarily falls within Colorado’s SSF definition.
SB25-003 contains exclusions, including an exclusion involving firearms with a permanently fixed magazine that cannot accept more than 15 rounds.
That means the exact configuration of the firearm matters.
However:
DO NOT ASSUME A “CALIFORNIA-COMPLIANT” DEVICE AUTOMATICALLY SATISFIES COLORADO LAW.
Colorado uses specific statutory language, including “permanently fixed.”
A firearm falling outside the SSF definition may not be subject to the additional SSF requirements, but Colorado’s ordinary private-transfer/background-check requirements can still apply.
If you’re unsure how your firearm is classified, have it evaluated before attempting the transfer.

Can I privately sell an AR-15 in Colorado in 2026?
Yes, Colorado law still provides a way to privately sell or transfer an AR-15. Most private firearm transfers are subject to Colorado’s background-check/FFL requirements. If the AR-15 qualifies as a Specified Semiautomatic Firearm under SB25-003, additional requirements may apply to the recipient.
Can I sell my AR-15 directly to my friend in Colorado?
You generally should not simply exchange the firearm directly for cash without going through the required transfer process. Colorado has required background checks for most private firearm transfers since 2013. A licensed firearm dealer can process the private-party transfer.
Does SB25-003 apply to private firearm sales?
Yes, it can. Colorado Parks & Wildlife expressly states that the law affects people who purchase and/or transfer Specified Semiautomatic Firearms on or after August 1, 2026.
Does my friend need an eligibility card to buy my used AR-15?
If your AR-15 qualifies as an SSF and no exception applies, the recipient must satisfy the applicable SB25-003 requirements. The fact that the firearm is used or privately owned does not by itself exempt the transaction.
Are used AR-15s exempt from SB25-003?
No general exemption exists merely because a firearm is used. The important questions are the firearm’s classification, the date and nature of the transfer, the recipient’s eligibility and whether a statutory exception applies.
Can I give my AR-15 to someone instead of selling it?
Calling the transaction a gift does not automatically exempt it from Colorado firearm-transfer laws. Colorado law contains specific exceptions for certain transfers, so the relationship between the parties and circumstances of the transfer matter.
Do private firearm sales require a background check in Colorado?
Generally, yes. Colorado has required background checks for most private firearm transfers since July 1, 2013, subject to statutory exceptions.
Do I need an FFL to sell my AR-15 to another Colorado resident?
For a typical private-party transaction, a licensed firearm dealer is used to conduct the required background check and process the transfer. Specific statutory exceptions can apply in limited circumstances.
Can I sell an AR-15 that I owned before SB25-003?
Prior ownership does not automatically prohibit you from transferring the firearm. However, a new sale or transfer occurring on or after August 1, 2026 can be subject to the new law if the firearm qualifies as an SSF.
Can someone who already owns an AR-15 buy another one privately?
Already owning an AR-15 does not itself exempt a person from the requirements applicable to a new purchase or transfer occurring after August 1, 2026.
Does a fixed-magazine AR-15 require the Colorado SSF process?
Potentially not. SB25-003 excludes certain firearms with a permanently fixed magazine that cannot accept more than 15 rounds from the SSF definition. The exact firearm configuration matters, and a product advertised as a “fixed magazine” or “California compliant” device should not automatically be assumed to satisfy Colorado’s definition.

THE COURTS HAVE BEEN BUSY
Here’s what happened while everyone was trying to figure out which new form they’re supposed to fill out:
1. COLORADO SB25-003 — THE FIGHT IS ON
Del Toro v. Polis is asking a federal judge to hit Colorado’s new semi-auto permit system with a preliminary injunction. Translation: Judge needs to shut it down while we fight about whether it’s constitutional.” No ruling expected for weeks.
2. COLORADO’S 3-DAY WAIT IS BACK IN THE HOT SEAT
A federal judge heard arguments Aug. 24. This got a lot more interesting after the 10th Circuit came down against New Mexico’s 7-day waiting period. Colorado says its law is different. The judge gets the next word – Stay tune!
3. THE NFA JUST GOT WEIRDER
A Texas federal injunction involving suppressors, SBRs and SBSs took effect Aug. 13 for certain covered plaintiffs, members and customers.
Before anyone starts celebrating: this is NOT a nationwide “NFA is gone” ruling. And Colorado has its own dangerous-weapons law lurking in the bushes with a clipboard.
4. “GHOST GUN” RULE TAKES A HIT
A federal judge ruled against ATF’s Frame or Receiver Rule on Second Amendment and due-process grounds. This could become a very important case regarding your right to personally manufacture a firearm. (Defense Distributed v. Blanche)
5. DOJ vs. DENVER — STILL COOKING
Denver wants the DOJ lawsuit against its semi-auto rifle and 15+ round magazine ban dismissed. DOJ says commonly owned AR-style rifles are protected arms. Nobody has flipped the table yet. Stay tuned.
6. NEW YORK DECIDED GLOCKS NEEDED MORE LAWYERS
New York’s new “convertible pistol” restrictions targeting Glock and similar pistols have been challenged in federal court. Plaintiffs basically argue: You can’t ban one of America’s most commonly owned handguns because criminals illegally modify some of them.

THE COUNTDOWN HAS STARTED: AUGUST 1 IS ALMOST HERE.
Colorado’s new Specified Semiautomatic Firearms law takes effect August 1, and if you’ve been thinking about purchasing an AR-15, AK platform, PCC, or many other magazine-fed semiautomatic firearms, now is the time to act.
DON’T WAIT UNTIL THE LAST MINUTE
While Colorado has a mandatory 3-day waiting period, that’s only the minimum. Your firearm cannot be transferred until CBI issues a “Proceed.” With background checks becoming increasingly backed up, waiting until the final days of July could mean your transfer isn’t completed before the new law takes effect.
Our recommendation: Complete your purchase by Tuesday, July 28, to give yourself the best opportunity to take possession before August 1. This is a practical recommendation based on current processing times—not a guarantee—as individual background check delays can vary.
IMPORTANT NOTICE FOR TRANSFERS
We are currently experiencing an unusually high volume of incoming firearm transfers.
Please allow approximately 24–48 hours after your firearm is delivered to Damage Factory before it is entered into our system and ready for pickup paperwork.
Our staff is working hard to process transfers as quickly as possible, and our goal is to have all currently received shipments processed by this Friday.

Arapahoe County is now accepting Firearm Safety Eligibility Card applications, adding another option for local applicants.

Weld County currently appears to be the lowest-cost option announced so far, charging only the statewide $52 fee with no additional county processing fee. Policies and fees may change, so always verify with the sheriff’s office before applying.
