Stevens Visiting Assistant Professor at Cardozo School of Law, where she teaches Evidence Law.</p> <p>&nbsp;</p> <p>Professor Sheehy’s research focuses on evidence, critical legal theory, criminal law, and anti-discrimination law. Her work aims to unveil the immense power of evidence law, and its impacts on marginalized litigants. She is completing her doctoral studies at Osgoode Hall Law School where she examines the operationalization of evidence law in race-based discrimination cases at the Human Rights Tribunal of Ontario. Her doctoral research was generously supported by the Harry W. Arthurs Fellowship and an Ontario Graduate Scholarship.</p> <p>&nbsp;</p> <p>Professor Sheehy is a bilingual Canadian lawyer. She completed her Master in Laws in Legal Theory at New York University and clerked at the Superior Court of Justice in Ontario. She received her J.D. and her Bachelor of Social Sciences in Sociology from the University of Ottawa.</p> <p>&nbsp;</p> <p>As part of her doctoral studies Professor Sheehy taught at York University in Toronto. Short is an Assistant Professor of Clinical Law at Benjamin N. Cardozo School of Law where he co-directs the Civil Rights Clinic. The clinic focuses on the intersection of civil rights and criminal justice and provides representation to individuals and groups whose civil rights have been violated by law enforcement officials. The clinic primarily litigates cases involving police misconduct and the constitutional and statutory rights of prisoners and detainees in federal court.</p> <p>&nbsp;</p> <p>Professor Short joined Cardozo from the National Center for Law and Economic Justice (NCLEJ), where he served as Special Counsel for Disability Justice Projects, leading the Center’s efforts to protect and advance the rights of people with disabilities impacted by carceral systems. Prior to his work at NCLEJ, Short held leadership roles at Worth Rises and the Prisoners’ Rights Project of The Legal Aid Society, and served as a Staff Attorney at Disability Rights New York. Professor Short has also taught in an adjunct capacity at the City University of New York School of Law and the Elisabeth Haub School of Law at Pace University. His scholarship and research focuses on carceral ableism and anti-Blackness, the successes and failures of carceral reform movements, and carceral abolition. Prior to joining the NYCLU in 2009, Bodde worked as a legal educator in Cambodia for communities in provincial areas focusing on the legal and extralegal remedies for violations of women’s rights and citizens’ land rights. This work combined her background as a New York City teacher and her commitment to fighting violence and poverty by empowering women.</p> <p>&nbsp;</p> <p>Bodde has also worked at the Office of the United Nations High Commissioner for Refugees and, as a volunteer immigration attorney, has assisted in securing asylum status for recent refugees. She currently teaches a course at Cardozo Law School on Reproductive Rights Law and Justice and is the former Chair of the Sex and Law Committee at the New York City Bar Association. Attendees will receive practical guidance for assisting parties in consummating resolution of their disputes while adhering to ethical canons of particular relevance in mediation and avoiding common pitfalls that can derail settlement.</p> <p>&nbsp;</p> <p>Through a series of practical and ethical scenarios, the panelists will explore how mediators should respond when a party asks what the settlement number should be; whether and when to use tools such as bracketing, decision trees, reframing of issues, or mediator opinions; and whether it is appropriate to speak with a party’s counsel outside the client’s presence, or with a party outside counsel’s presence. The discussion will also address difficult moments in the mediation process, including how to respond when a party directs the mediator to tell the other side that it is not negotiating in good faith, or when a party privately states, toward the end of a frustrating day, that it selected the mediator because it expected the mediator to expose the other party’s weaknesses.</p> <p>&nbsp;</p> <p>Once the parties reach a settlement in principle, additional issues may arise.
