Citizens of Aceh to register a Citizen Law Suit against Minister of Home Affairs on Aceh Spatial Plan

 

Citizens of Aceh Province on the island of Sumatra will be registering a class action law suit against the Minister of Home Affairs for failing to uphold its authority to include the Leuser Ecosystem in currently illegal Aceh Provincial Spatial. This plan is deemed destructive and threatens the lives and livelihoods of millions of people living in Aceh.

 

Gerakan Rakyat Aceh Menggugat (GeRAM) is an alliance of concerned citizens who have been fighting nearly 2 years since the Aceh Government legalised a new Spatial Land Use Plan that would effectively dissolve protection of much of Aceh’s remaining tropical rainforests, whitewashing crimes of the past, and paving the way for a new wave of catastrophic ecological destruction”, said one of the plaintiffs, Farwiza Farhan. 

 

Nine plaintiffs from across Aceh traveled to Jakarta to register the case against Minister of Home Affairs for failing to act on its jurisdiction to cancel Aceh spatial plan as stated in Ministry of Home Affairs decree 650-441 year 2014. These plaintiffs are Effendi from Aceh Besar, Juarsyah from Bener Meriah, Abu Kari from Gayo Lues, Dahlan M. Isa from Lhokseumawe, Kamal Faisal from Aceh Tamiang, Muhammad Ansari Sidik from Aceh Tenggara, Sarbunis from Aceh Selatan, Najaruddin from Nagan Raya, and Farwiza from Banda Aceh.

 

Millions of people depend upon Aceh’s forests, in particular the Leuser Ecosystem, whose protection is required under several National Laws and is the last place on earth where critically endangered orangutans, rhinos, elephants and tigers can be found living together in the wild. This forest was recently ranked by the World Conservation Union (IUCN) as one of the ‘World’s Most Irreplaceable Protected Areas’ in an article in the journal Science. 

 

“The countless ecosystem services the Leuser Ecosystem provides serve as an irreplaceable life-support system for the people of Aceh and North Sumatra, providing clean water supplies for people, agriculture, fisheries and other industries in addition to water regulation, preventing environmental catastrophes such as flash floods and landslides that already kill people, devastate crops and infrastructure, and destroy livelihoods all too often in Aceh.” Dahlan M.Isa, the plaintiff from Aceh Utara added.

 

“Our government has lost the ancestral wisdom of how to manage lands, forests and water. Unfortunately the implication of this means one person signing a piece of paper could sacrifice life and livelihood of many” said Abu Kari, the plaintiff from Gayo Lues.

 

“The government’s proposed Aceh spatial plan makes no mention whatsoever of the existence of the Leuser Ecosystem as a National Strategic Area for its environmental protection function, and effectively legalizes numerous new roads, many of which have already been cut and constructed illegally through vast areas of the forests, fragmenting this sensitive ecosystem and opening up new pathways for destruction. Sustainable development for Aceh is impossible if its forests are destroyed,” Farwiza continued.

 

"The Aceh Government cannot contest the inclusion of the Leuser Ecosystem into its spatial plan because it exists as a protected area in three legal regulations:  Law No.  11 / 2006 on Aceh Governance, Law No. 26 / 2007 on Spatial Planning, and its derivative, Government Regulation 26 / 2008 on the National Spatial Plan.  It would be wise for the Aceh Government to immediately work together with relevant parties, especially Aceh's indigenous communities, to conduct a thorough and comprehensive revision of the Aceh Spatial Plan so that this prolonged debate can finally be ended!" the lawyer representing the case, Nurul Ikhsan stated.

 

The Indonesian National Government’s Ministry of Home Affairs has reviewed the Aceh spatial plan and found numerous legal infringements that needed to be resolved before it could be accepted. Under Indonesian law, the Aceh government is required to revise the regulation and in the absence of revisions, the Minister of Home Affairs is required to formally reject the provincial law known as Qanun 19/2013 on the Aceh Spatial Plan, as stated in Ministry of Home Affairs Decree 650-441 year 2014 

 

“This case is clear cut, all we asked for is the Minister of Home Affairs to uphold its own legal authority to cancel Aceh Spatial Plan as stated in Ministry of Home Affairs decree 650-441 year 2014, and for Aceh Government and Aceh Parliament to revise the spatial plan by including protection of the Leuser Ecosystem” said Nurul Ikhsan, the lawyer representing the case.

 

“If the Minister of Home Affairs, the Governor of Aceh and the Aceh Parliament do not do this, they are clearly acting unlawfully.” Nurul Ikhsan concluded. 

 

The nine plaintiffs, who represent many communities from across Aceh, have submitted legal notification of the litigation case to the Ministry of Home Affairs, to Aceh’s  Governor, and to the Aceh Parliament, as well as to the public on . Despite passing the 60 days mark of legal notification there has been no response from any of the defendants and therefore case will be registered in Jakarta State Court on 21st January 2016.

Warga Aceh Gugat Mendagri Terkait RTRW

 

Jakarta, Sejumlah warga Aceh menggugat Menteri Dalam Negeri (Mendagri) ke pengadilan agar membatalkan qanun 19 tahun 2013 dan peraturan daerah yang mengatur rencana tata ruang wilayah (RTRW) di provinsi itu.

 

Gugatan secara resmi didaftarkan oleh kuasa hukum para penggugat tergabung dalam Gerakan Rakyat Aceh Menggugat (GERAM) ke Pengadilan Negeri Jakarta Pusat, Kamis (20/1).

 

Selain Mendagri, para penggugat juga menggugat Gubernur Aceh dan Dewan Perwakilan Rakyat Aceh (DPRA) untuk segera menyempurnakan Qanun Aceh Nomor 19 Tahun 2013 tentang RTRW sesuai dengan Keputusan Menteri Dalam Negeri RI Nomor 650-441 Tahun 2014 tertanggal 14 Februari 2014 tentang evaluasi rancangan qanun RTRW Aceh 2013-2034.

 

Para penggugat, Efendi, warga Aceh Besar, Juarsyah, warga Bener Meriah, Abu Kari, warga Gayo Lues, Dahlan, warga Lhokseumawe, Kamal Faisal, warga Aceh Tamiang. Kemudian, Muhammad Ansari Sidik, warga Aceh Tenggara, Sarbunis, warga Aceh Selatan, Najaruddin, warga Nagan Raya, dan Farwiza, warga Kota Banda Aceh.

 

Gugatan dikuasakan kepada Evi Susanti SH MH, Syahminan Zakaria SHI MH, dan Nurul Ikhsan SH. Semua kuasa hukum penggugat merupakan advokat atau pengacara dan konsultan hukum pada kantor Evi Susanti & Co (ESCo), beralamat di Darul Imarah, Aceh Besar.

 

Sebelum mendaftarkan gugatan ke Pengadilan Negeri Jakarta Pusat, para penggugat sudah menyampaikan notifikasi dan pemberitahuan terbuka. Notifikasi disampaikan dalam jangka waktu 60 hari kerja. Namun, notifikasi tidak diindahkan Mendagri, Gubernur Aceh, dan Ketua DPR Aceh. Gugatan tersebut didaftarkan ke Pengadilan Negeri Jakarta Pusat dalam bentuk citizen lawsuit atau gugatan warga negara.

 

Adapun materi gugatan, yakni RTRW Aceh yang dituangkan dalam Qanun Nomor 19 Tahun 2013 tentang RTRW tidak memasukkan beberapa substansi penting dalam RTRW Nasional.

 

Di antaranya adalah tidak dimasukkannya Kawasan Ekosistem Leuser (KEL) sebagai salah satu dari lima Kawasan Strategis Nasional yang berada di Aceh. Hal ini mengabaikan amanat Undang-Undang RI Nomor 26 Tahun 2007 Tentang Penataan Ruang, Undang-Undang RI Nomor 11 Tahun 2006 Tentang Pemerintahan Aceh.

 

Kemudian juga melawan Peraturan Pemerintah Nomor  26 Tahun 2008 Tentang Rencana Tata Ruang Nasional, SK Menteri Kehutanan RI Nomor 227/Kpts-II/1995, Keputusan Presiden Nomor 33 Tahun 1998, dan SK Menteri Kehutanan Nomor 190/Kpts-II/2001

 

Pengabaian amanat dari ketentuan peraturan-peraturan hukum tersebut merupakan perbuatan melawan hukum yang dilakukan oleh penyelenggara negara, dalam hal ini Gubernur Aceh dan DPR Aceh.

 

Pengabaian Kawasan Ekosistem Leuser sebagai bentang alam yang terintegrasi (eco-region) akan mengancam keunikan keanekaragaman hayati dan ekologi yang dimiliki, sehingga pada akhirnya akan meningkatkan risiko intensitas bencana di Aceh, dan berdampak drastis terhadap kehidupan dan keamanan masyarakat sekitarnya.  

 

Selain itu, tidak diakui Kawasan Rawa Gambut Tripa sebagai bagian dari Kawasan Strategis Nasional, dan tidak diakomodirnya jalur evakuasi bencana dalam qanun tersebut.

 

Qanun 19 juga tidak mencantumkan wilayah kelola Mukim sebagai wilayah asal usul masyarakat adat Aceh dalam qanun tersebut. Padahal keberadaan wilayah mukim diakui secara nasional maupun internasional. 

 

Perbuatan penyelenggara negara, dalam hal ini Gubernur Aceh dan DPR Aceh, adalah melanggar Pasal 65 ayat (1) dan ayat (2) huruf b dan huruf c Undang-Undang RI Nomor 26 Tahun 2007 Tentang Penataan Ruang.

 

Pasal tersebut mengatur penyelenggaraan penataan ruang dilakukan oleh pemerintah dengan melibatkan peran masyarakat, dilakukan antaranya melalui; partisipasi dalam penyusunan rencana tata ruang;  partisipasi dalam pemanfaatan ruang; dan partisipasi dalam pengendalian pemanfaatan ruang. 

 

Proses pembentukan Qanun Nomor 19 Tahun 2013 tentang Rencana Tata Ruang Wilayah Aceh (RTRWA) yang ditetapkan di Banda Aceh pada  31 Desember 2013 dan diundangkan di Banda Aceh pada 3 Maret 2014, juga tanpa terlebih dahulu menindaklanjuti hasil evaluasi Menteri Dalam Negeri RI, melalui Keputusan Menteri Dalam Negeri RI Nomor 650-441 Tahun 2014 tertanggal 14 Februari 2014 tentang evaluasi rancangan qanun RTRW Aceh 2013-2034. 

 

Perbuatan tidak menindaklanjuti hasil evaluasi Menteri Dalam Negeri RI oleh Gubernur Aceh dan DPR Aceh merupakan pelanggaran terhadap ketentuan Pasal 14 ayat (4) Peraturan Menteri Dalam Negeri Nomor 28 Tahun 2008 tentang Tata Cara Evaluasi Rancangan Peraturan Daerah  Tentang Rencana Tata Ruang Daerah.

 

Bunyi pasal tersebut yakni “Gubernur menindaklanjuti hasil evaluasi sebagaimana dimaksud pada ayat (3) dan melaporkan hasilnya kepada Menteri Dalam Negeri paling lambat  tujuh hari kerja terhitung sejak diterimanya Keputusan Menteri Dalam Negeri.

 

Menteri Dalam Negeri RI lalai menerbitkan dan menyampaikan hasil evaluasinya terhadap Rancangan Qanun Tentang RTRW Aceh Tahun 2013-2033, di mana Gubernur Aceh menyampaikan Rancangan Qanun RTRW Aceh Tahun 2013-2033 pada 18 Desember 2013, melalui surat  Nomor  180/78150, perihal Evaluasi Rancangan Qanun tentang RTRW Aceh Tahun 2013-2033, beserta lampirannya. 

 

Surat ini diterima Kementerian Dalam Negeri pada 20 Desember 2013. Menteri Dalam Negeri RI menyampaikan hasil evaluasi pada 20 Februari 2014. 

 

Dengan demikian batas waktu 15 hari kerja dihitung sejak diterimanya Rancangan Qanun Tentang RTRW Aceh Tahun 2013-2033 tersebut  terlampaui, sehingga kelalaian ini telah melanggar ketentuan sebagaimana diatur dalam  Pasal 14 ayat (3) Peraturan Menteri Dalam Negeri Nomor 28 Tahun 2008 tentang Tata Cara Evaluasi Rancangan Peraturan Daerah  Tentang Rencana Tata Ruang Daerah.

 

Bunyi pasal tersebut yakni “Hasil evaluasi dituangkan dalam Keputusan Menteri Dalam Negeri dan disampaikan kepada Gubernur paling lambat 15 (lima belas) hari kerja terhitung sejak diterimanya rancangan perda dimaksud”

 

Menteri Dalam Negeri RI selaku penyelenggara negara juga telah melakukan pembiaran atas perbuatan melawan hukum yang dilakukan Gubernur Aceh dan DPR Aceh yang menetapkan dan mengesahkan Rancangan Qanun Tentang RTRW Aceh Tahun 2013-2033 menjadi Qanun Nomor 19 Tahun 2013 tanpa terlebih dahulu menindaklanjuti hasil evaluasi.

 

Sampai saat ini Menteri Dalam Negeri RI tidak melaksanakan/mengabaikan kewenangannya untuk membatalkan Qanun Nomor 19 Tahun 2013 sebagaimana yang diperintahkan oleh Pasal 15 ayat (1) Peraturan Menteri Dalam Negeri Nomor 28 Tahun 2008 tentang Tata Cara Evaluasi Rancangan Peraturan Daerah Tentang Rencana Tata Ruang Daerah .

 

Bunyi pasalnya, “Apabila hasil evaluasi sebagaimana dimaksud dalam Pasal 14 ayat (3) tidak ditindaklanjuti oleh Gubernur dan DPRD, dan Gubernur tetap menetapkan rancangan perda tentang RTRWP dan rancangan perda tentang RTR Kawasan Strategis Provinsi menjadi perda, Menteri Dalam Negeri membatalkan perda dimaksud” .

 

Sebagai penyelenggara negara, Menteri Dalam Negeri RI, Gubernur Aceh dan DPR Aceh nyata-nyata telah melakukan perbuatan melawan hukum dengan tidak mematuhi aturan-aturan hukum berkaitan dengan penataan ruang dan wilayah Aceh.

 

Serta gagal  memenuhi tanggung jawabnya untuk menjamin hak, kewajiban dan peran  masyarakat dalam penyelenggaraan penataan ruang,  khususnya dalam proses pembentukan dan pemberlakuan Qanun Aceh Nomor 19 Tahun 2013 Tentang Rencana Tata Ruang Wilayah Aceh Tahun 2013-2033.

[Banda Aceh / Indonesia] After a 3 year campaign to bring the company to justice, Indonesia’s supreme court in Jakarta finally brought an end to the historic case against palm oil company PT Kallista Alam by rejecting its appeal. The rejection upholds an earlier decision by the National Court in Meulaboh, Aceh, on 8th January 2014, in a case brought against the company by Indonesia’s then Ministry of the Environment, ordering the company to pay IDR 366 billion (approximately USD26 million) for illegally burning forests within the Tripa Peat Swamps, part of the protected Leuser Ecosystem in Sumatra, Indonesia

On 27th November 2012, PT Kallista Alam was first charged by the Ministry of the Environment in the National Court in Meulaboh, Aceh, with illegally burning forests within the Tripa Peat Swamps. The judge found the company guilty in January 2014 and ordered the company to pay IDR 114.3 billion as compensation to the state and to spend IDR 251.7 billion on fully restoring the affected forests back to their original condition. According to the Senior Judge in Meulaboh, Rahmawati SH, PT Kallista Alam was found in breach of National Law No 32/2009 on Environmental Protection and Management, for illegal use of fire to clear forests. The court also confiscated 57 km2 of PT Kallista Alam concession land in Tripa in lieu of payment and for each day payment is not forthcoming ordered the company to pay an additional Rp. 5,000,000 (approx. USD 400).

Appeals rejected.

The Meulaboh court’s decision was appealed by the company at the High Court in the provincial capital of Banda Aceh (appeal lodged May 14th 2014), but that appeal was rejected on 15th August 2014, prompting the company to lodge a second and final appeal on 6th October 2014 with Indonesia’s Supreme Court in Jakarta. Finally, on 28th August the supreme court rejected the appeal, ordering PT Kallista Alam to now face the penalty imposed by the earlier ruling.

The rejection of the appeal effectively brings to an end the lengthy civil legal case first lodged on 27th November 2012 in Meulaboh, but it has additional ramifications too. In parallel criminal cases against the company’s Director and Development Manager, prison terms were handed out on 15th July 2014 of 8 months and 3-years respectively, as well as additional fines. Implementation of these sentences is believed to have been pending the appeal of the civil case with the Supreme Court, and presumably must now be enforced with the recent rejection of that appeal.

International outcry

PT Kallista Alam, first came to international attention in August 2011, when the former Governor of Aceh Province, Irwandi Yusuf, issued a new 1,605ha oil palm concession permit to the company in the Tripa peat swamp forests within the legally protected Leuser Ecosystem, sparking an international outcry. Acehnese environmentalists immediately sued the Governor and the company over the illegal permit, finally achieving its cancellation on 27thSeptember 2012. In the meantime, huge fires ravaged Tripa’s peat swamp forests, within plantation concessions held not only by PT Kallista Alam but also a number of other companies too. As a result of these fires, Tripa was once again thrust into the international spotlight and a number of new legal cases were brought against the companies by Indonesia’s Ministry of Environment.

Tripa is part of the 2.6 million ha protected Leuser Ecosystem, the only place in the world were Sumatran orangutans, tigers, elephants and rhinos can be found living side by side. The Leuser Ecosystem was also listed by the World Conservation Union (IUCN) in November 2013 as one of the ‘World’s Most Irreplaceable Protected Areas’ in an article in the journal Science. Tripa is especially important for its orangutans, since it harbours among the highest orangutan densities in the world. The peat swamps also sequester huge amounts of carbon, which is released into the atmosphere when the forests and peat are cleared and burned, fuelling global climate change.

Due to the global significance of the area concerned, over 1.5 million people signed online petitions calling for greater protection of Aceh’s unique and extremely important forests. These petitions were further supported by some of the world’s leading scientists and conservation experts, who wrote to Aceh’s current Governor, Zaini Abdullah, urging him to nominate the Leuser Ecosystem as a World Heritage Site, due to its unique and irreplaceable biodiversity.

Rudi Putra, a leading Acehnese conservationist and Founder of the Leuser Conservation Forum (FKL) explained, “The campaign behind this successful case has involved multiple NGOs and communities working together and never letting up the pressure over 3 years. This win would never have been possible without the national and international public support the case has had from people who wouldn’t accept this heinous destruction, who have monitored the legal process from the start and who have kept up the pressure for a just and transparent result. We want to thank everyone who made this positive and extremely welcome final decision possible.”

Mr T.M Zulfikar, who brought the first legal challenge against Kallista Alam’s illegal permit and now represents the Indonesian NGO Yayasan Ekosistem Lestari noted, “It has taken 3 long years but we are overjoyed to finally see PT Kallista Alam held to account for its wanton destruction of the Tripa Peat Swamp forests. No financial penalty can ever make up for the devastation and terrible loss of biodiversity caused by the company but we applaud the supreme court for holding it accountable for its actions. The initial ruling in Meulaboh, and now the supreme court’s rejection of the appeal, should send a strong warning to other companies that illegal clearing of forests in the protected Leuser Ecosystem will not be tolerated. We will also be monitoring closely what happens next to ensure the fines and reparations are indeed paid and carried out in full, including the restoration of the affected concession to its former condition.”

Kamaruddin, a lawyer working with communities in the Tripa region reiterated, “This decision should serve as a wake up call to any company thinking of investing within the Leuser Ecosystem, a National Strategic Area, that they could suffer the same fate as PT Kallista Alam. It should be a reminder to others as well, who deliberately burn forests or allow forest burning within their concessions, that they could also be prosecuted, regardless of whether or not they are working inside the Leuser Ecosystem’s boundaries. The Judge’s decision in this case clearly illustrates a move towards improved law enforcement against environmental offenders in the region”, he added.

Dr Ian Singleton, Director of the Sumatran Orangutan Conservation Programme, highlighted the critical importance of the area, “Tripa is one of only 3 remaining peat swamp forests left containing orangutans in Sumatra and it’s impossible to overstate the importance of protecting every last hectare of each of them. Orangutan densities can reach as high as 8 per square kilometer in these areas, compared to an average of around only 1 or 2 per square kilometer in dryland forests. These peat swamps have justifiably been referred to as the ‘orangutan capital of the world’. The Leuser Ecosystem too, offers the only real hope of survival for Sumatra’s other key iconic megafauna, the Sumatran tiger, rhino and elephant, as well as its orangutans. Yesterday’s ruling is of course extremely welcome, but the level of interest in Tripa and the Leuser Ecosystem worldwide shows clearly just how seriously concerned the international community is right now about the fate of these forests and their globally important biodiversity”, he emphasised.

Farwiza Farhan of Forest, Nature and Environment Aceh (HAkA) stressed, “Whilst of course we welcome this historic ruling we need to remain extremely vigilant. Aceh’s unique forests and the globally important Leuser Ecosystem are still under immense threat due to the province’s spatial land use plan, which even more than 18 months after it was ratified by Aceh’s Provincial Government, is still rejected by Indonesia’s National Government due to numerous legal infringements. The plan makes no mention whatsoever of the existence of the Leuser Ecosystem National Strategic Area, it effectively legalizes numerous illegal roads, many of which have already been cut through the forests, and it opens up vast areas for potential new, timber, mining and plantation concessions. Despite the win against PT Kallista Alam in Tripa, we still have a much more desperate and urgent fight ahead of us to protect Aceh’s forests and people from another, major, and totally avoidable emerging disaster.”

[Banda Aceh / Indonesia] Setting a landmark new precedent, Indonesian courts yesterday found palm oil company PT Kallista Alam guilty of illegally burning forests within the Tripa Peat Swamps, part of the  protected Leuser Ecosystem, resulting in a fine of 114 billion Rupiah, approximately 9 million US dollars.  

“This is a clear message to companies working in Aceh who think they can destroy protected forests and get away with it” said Muhammad Nur, Chairman of WALHI Aceh (Friends of the Earth Indonesia).

According to Senior Judge, Rahmawati SH, PT Kallista Alam was found in breach of National Law No 32/2009 on Environmental Protection and Management, for illegal use of fire to clear forests, and ordered to pay Rupiah 114.3 billion (approx. USD 9.5 million) as compensation and Rupiah 251.7 billion (almost 21 USD million) for restoration of the affected forests.

Kamaruddin, a lawyer working with communities in the Tripa region reiterated, “This decision should serve as a wake up call to any company thinking of investing within the Leuser Ecosystem, a National Strategic Area, that they could suffer the same fate as PT Kallista Alam. It should also be a reminder to others who deliberately burn forests or allow forest burning within their concessions, regardless of whether or not they are working inside the Ecosystem’s boundaries, that they could also be prosecuted. The Judge’s decision in this case clearly illustrates a move towards improved law enforcement against environmental offenders in the region.” He added.

The company, PT Kallista Alam, first came to international attention in August 2011, when former Governor of Aceh Province, Irwandi Yusuf, issued a new 1,605 ha oil palm concession permit within the legally protected Leuser Ecosystem, an area renowned for hosting the highest densities of orangutans found anywhere on earth, sparking an international outcry.

Subsequently, over 1.5 million people signed online petitions calling for greater protection of Aceh’s Forests, currently under enormous threat due to a controversial new spatial planning law issued by Aceh’s Parliament on December 27th. These petitions are further supported by some of the world’s leading scientists and conservation experts, who have written to Aceh’s present Governor, Zaini Abdullah, urging him to nominate the Leuser Ecosystem as a World Heritage Site, due to its unique and irreplaceable biodiversity. The Leuser Ecosystem is the only place on earth where tigers, elephants, rhinos and orangutans can be found living together in the wild and was listed by the World Conservation Union (IUCN) as one of the ‘World’s Most Irreplaceable Protected Areas’ in an article in the journal Science, in November 2013.

Dr Ian Singleton, Director of the Sumatran Orangutran Conservation Programme, highlighted the critical importance of the area. “Tripa is one of only 3 remaining peat swamp forests left containing orangutans in Sumatra and its impossible to overstate the importance of protecting every last hectare of each of them. Orangutan densities can reach as high as 8 per square kilometer in these areas, compared to an average of around only 1 or 2 per square kilometer in dryland forests. These peat swamps have justifiably been referred to as the ‘orangutan capital of the world’. The Leuser Ecosystem too, offers the only real hope of survival for Sumatra’s other key iconic megafauna, the Sumatran tiger, rhino and elephant, as well as its orangutans. Yesterday’s ruling is of course extremely welcome, but the level of interest in Tripa and the Leuser Ecosystem worldwide shows clearly just how seriously concerned the international community is right now about  the fate of these forests and their globally important biodiversity”, he emphasised.

“The Leuser Ecosystem provides countless locally and globally important environmental services too”, explained Graham Usher, Landscape Protection Specialist with the Swiss based PanEco Foundation. “For Aceh alone these have been valued in excess of 400 million dollars per year, and the region’s contribution to mitigating climate change, through its carbon sequestration function probably stretches into billions of dollars. It is very encouraging that companies and decision makers destroying these services in Indonesia are finally being held accountable for the economic damage their illegal activities cause, and all credit is due to the Ministry of the Environment for their efforts in prosecuting this case. The court’s decision is indeed a huge victory, and represents one significant step in the right direction. But I think many more such steps are needed before we will really see a change in the behaviour of companies and officials.” added Usher.

“Aceh’s Parliament is right now pushing a new spatial land use plan which they recently legalised with a new Provincial Government Regulation, known locally as the Qanun RTRW Aceh”. Explained Muhammad Nur. “The Qanun completely ignores the protected status of the Leuser Ecosystem, simply so they can open up large areas of protected forests for road building, mining, palm oil and timber concessions. This will, in effect, end Aceh’s chances for long-term sustainable development, as it will cause further destruction of critical watersheds, leading to ever more frequent flash floods, landslides, and other environmental disasters. The companies lobbying for this new plan, and the Aceh Government themselves, should be held accountable for all the damage that will ensue. We hope yesterday’s result will serve as a strong warning that if you destroy our forests, we are not afraid to fight back” he stressed. “We thank the judge for delivering a just and fair verdict in this case, and all the people around the world who have been calling for enforcement of National Laws protecting the Leuser Ecosystem. This will be a long battle, but it is one we simply cannot afford to lose, no matter what the cost.” He concluded.   

Yesterday’s groundbreaking verdict is the result of just one of several civil and criminal prosecutions underway against PT Kallista Alam and four other oil palm companies with concessions in Tripa, namely  PT. Surya Panen Subur II, PT. Dua Perkasa Lestari, PT. Gelora Sawita Makmur and PT. Cemerlang Abadi. Each faces the possibility of serious financial consequences as a result of their illegal clearance, burning and drainage of Tripa’s unique peat swamp ecosystem. Some of the company Directors and senior management also face the prospect of prison terms in cases against them for their actions on the ground.

"SOCP angered by betrayal of justice by Aceh Judges" | 09 April

Having studied the outcome of the Judge's ruling at the National Administrative Court in Banda Aceh, the staff of the Sumatran Orangutan Conservation Programme (SOCP) hereby express our anger at the court's lack of a ruling on the case challenging the legality of a plantation permit in Aceh's Tripa peat swamp forests, given to the palm oil company PT Kallista Alam by the former Governor of Aceh province in contravention of National Spatial Planning Law (No. 26/2007). The case had run for 5 months before the judges simply decided that they were not qualified to judge it, thus attempting to brush the case under the carpet. This decision would be laughable, were it not such a tragic betrayal of the Indonesian public, the environment, and the very principles of justice.

We fully support the plan of the Coalition to Save the Tripa Peat Swamps and WALHI/Friends of the Earth Indonesia to appeal this non-­‐decision, and will play an active role in supporting their efforts.

Trapped orangutan rescued from snare in Indonesian rainforest | 13 April

An orangutan trapped in a snare for ten days was rescued by International Animal Rescue (IAR). The rescue team sedated the young male, freed him from the snare and gave him fluids for sever dehydration before transporting him back to IAR's clinic in Ketapang, West Kalimantan, Indonesia.

Your support has made our previous petition a historical success!

But with Tripa still being burned, cleared, destroyed and the Sumatran Orangutan still being pushed closer to extinction, we need to urgently double our efforts and keep up the pressure and action! 

The Governor of Aceh has made history by finally revoked the license of one of the illegally operating companies thanks to the pressure generated by our first petitions. But with 5 more companies still destroying protected area inside Tripa, the fight has only just begun! 

There are still companies with breaking the law in Tripa continuing to dig illegal drainage canals, clear protected forests and driving the local Sumatran Orangutan population closer to extinction. Urgent action is still required to save Tripa. 

The national police needs to investigate and prosecute law-breakers, namely those who are breaking National Spatial Planning law 26/2007 Government Regulation 26/2008 which protects the 2.7 million hectare Leuser Ecosystem, home to critically endangered Orangutans, and also Sumatran Tigers, Elephants, Rhinos and countless other iconic species. 

Community members filed a police report in November, now with the legal precedent of the first permit being revoked, it's the perfect time for the National Police to take action and bring this next case to the courts. 

Together, we can take this next step, demand the police uphold Indonesian National Spatial Planning law 26/2007 & 26/2008, save Tripa, and set a huge precedent for the protection of ALL of Indonesian forests.
