On August 27, 2024, the Department of Planning and Investment under the People’s Committee of Hanoi (hereinafter referred to as the “Department”) issued Notification No. 1730/TB-KH&DT regarding the creation of accounts for investors after receiving their initial investment registration certificate. This is an important website for investors and enterprises engaged in foreign direct investment (hereinafter referred to as “FDI”) and outward foreign investment (hereinafter referred to as “OFDI”).
For local FDI management agencies such as the Department of Planning and Investment, the system allows for convenient updating of data regarding registration, issuance/amendment/revocation of investment certificates or equivalent legal documents. It enables the reception and management of various reports and the convenient updating of data into the database, allowing for easy retrieval of all information related to investment projects under their management. At the same time, it allows FDI management agencies to compile, analyze, and generate reports as required, including both standard and specific report formats for projects within their jurisdiction.
This reporting is extremely necessary, especially during the process of submitting applications for investment certificates and the issuance/amendment/revocation of investment certificates or equivalent legal documents. Creating an account will help investors avoid fines for not reporting as required or facing inspections when making adjustments or revocations of investment certificates or equivalent legal documents. Companies that do not update investment monitoring and evaluation reports on the National Information Portal will be penalized according to Article 10 of Decree 122/2021/ND-CP .

]]>Law on Natural Disaster Prevention and Control 2013 (Amended and supplemented by Law on Natural Disaster Prevention and Control and the Levee Law 2020) stipulates the natural disaster prevention and control fund, including the following provisions:
“Financial sources of a provincial natural disaster management fund include assistance and voluntary contributions of domestic organizations and individuals; compulsory contributions of domestic and foreign business entities within the province, Vietnamese citizens from at least 18 years of age to retirement age in normal working conditions in accordance with labor regulations; are extracted from the central natural disaster management fund, other provincial natural disaster management funds and other lawful sources”
(The Law on Natural Disaster Prevention and Control 2013 (amended and supplemented by the Law on Natural Disaster Prevention and Control and Law on Dikes 2020) )
On August 1, 2021, the Government issued Decree No. 78/2021/ND-CP, effective from September 15, 2021, on the establishment and management of the Natural Disaster Prevention and Control Fund, which stipulates the contribution to the natural disaster prevention and control fund of domestic and foreign economic organizations in Vietnam. Specifically as follows:
1. On Mandatory Contribution Levels
According to Clause 1, Article 12 of Decree 78/2021/ND-CP, the regulation states:
“The mandatory contribution from domestic and foreign economic organizations within the locality in one year is 0.02% of the total value of current assets as per the financial report prepared on December 31 annually, that submitted to the Tax authority. However, the minimum contribution is 500,000 VND, and the maximum is 100 million VND, and it is accounted into the operating costs of the organization’s production and business.”
2. On Mandatory Payment Deadlines
In Article 15 Decree 78/2021/ND-CP, the regulation states:
“The deadline for payment to the provincial fund: For individuals, payment is made once before July 31 annually; for domestic and foreign economic organizations within the locality, at least 50% of the required amount must be paid before July 31, with the remainder paid before November 30 annually. In cases of prolonged natural disasters or epidemics affecting a large scope, the Chairman of the Provincial People’s Committee may consider adjusting the payment deadline or decide to exempt
or reduce the contribution to the provincial fund as appropriate.”

In addition to the fine, for the above violations, organizations are also required to remediate the consequences as per Clause 3, Article 17 of Decree 03/2022/ND-CP: “Be compelled to make payment to the disaster management fund”.
4. Regarding prescriptive time limits for imposing penalties
According to Point a, Clause 1, Article 5 of Decree 03/2022/ND-CP, the statute of limitations for administrative sanctions in the field of disaster prevention and water resources is 1 year.
The starting point for calculating the statute of limitations is stipulated as follows: “Regarding natural disaster management and irrigation, the prescriptive time limit shall be 01 year.” In which:
・“The administrative violations specified in Articles 16, 17, and 36 of this Decree” are “administrative violations that have ended” (Clause 4.b, Article 5 of Decree 03/2022/ND-CP)
・“The time when the violation specified in Article 17 of this Decree ends” is “the day the deadline for Fund contributions ends or the day the deferment period for Fund contributions ends as stipulated in Decree 78/2021/ND-CP dated August 1, 2021, on the establishment and management of the Disaster Prevention Fund” (Clause 4.b, Article 5 of Decree 03/2022/ND-CP).
Accordingly, the statute of limitations for administrative sanctions regarding the violations specified in Article 17 of Decree 03/2022/ND-CP is 1 year, calculated from the deadline for Fund contributions or the end of the deferment period as per Decree 78/2021/ND-CP dated August 1, 2021, on the establishment and management of the Disaster Prevention Fund.

A pilot labour inspection campaign in the apparel industry uncovered 1,786 violations at 152 businesses in 12 cities and provinces across the country, according to the Ministry of Labour, Invalids and Social Affairs (MoLISA).
The inspections were conducted from May to September this year by MoLISA inspectors in co-ordination with the International Labour Organisation (ILO), the Vietnam General Confederation of Labour, and the Vietnam Chamber of Commerce and Industry.
MoLISA Deputy Minister Huynh Van Ty said the apparel industry was chosen for the test inspections because it had been a key foreign currency earner for Vietnam in recent years, bringing in 13.6 percent of the country’s export revenue and 10.5 percent of total gross domestic product. The sector posted an annual growth rate of 14.5 percent between 2008 and 2013.
About 6,000 apparel enterprises operate in Vietnam. They employ more than 2.5 million workers, accounting for about 25 percent of the industrial workforce. Most employees were manual labourers with limited professional skills, Ty said.
The most common violation was overtime hours exceeding the stipulated excess time, MoLISA Deputy Chief Inspector Nguyen Tien Tung said, adding that 60 companies committed the violation.
Seventeen firms did not provide sufficient overtime or night shift pay, while salaries in 11 businesses were lower than the region-based minimum wage levels set by the State.
He said that a number of enterprises did not have safety and instructional signs, and didn’t disseminate information on how to escape in an emergency. They also didn’t post the regulations and escape route maps in visible areas.
A shortage of personal protective gear was also common, and numerous labourers did not use the equipment correctly. About 90 businesses did not have sufficient occupational safety training.
MoLISA will propose similar inspections to be conducted in the construction industry next year, which has seen numerous work accidents in 2015
