TUCSON ai??i?? The owner of a Tucson gun store where former U.S. Rep. Gabrielle Giffords’ husband purchased a semi-automatic rifle has canceled the transaction.

Doug MacKinlay said Monday that a full refund was sent to Mark Kelly via express mail because the former astronaut didn’t plan to keep the AR-15-style rifle for his personal use.

Kelly bought the gun March 5 at Diamondback Police Supply, saying he wanted to show how easy it is to buy an assault weapon. He planned to turn it in to Tucson police.

MacKinlay tells the Arizona Daily Star that he terminated the transaction Thursday before Kelly could take possession of the firearm.

Giffords was among 13 people wounded in a January 2011 shooting outside a Tucson supermarket that left six others dead.var More than 50 gun rights activists rallied at the state Capitol on Friday, sporting high-powered firearms while protesting federal proposals to tighten gun regulations.

And although they were wary that Congress and President Obama will try to ban or confiscate their weapons, gun enthusiasts agreed that Arizona has fair gun laws and lawmakers are mostly on their side.

Second Amendment aficionados like Keith Dale – who showed up with his AR-15 with three 30-round clips in his pocket plus an empty one in the gun, and his 9mm handgun in his side clip – said that while he perceives a threat that the federal government may start impounding high powered guns, he expects state lawmakers to push back against any type of gun grab and defend his rights.

“Our state is really good, really pro gun, one of the best in the country. And it’s great to live in a state that recognizes and honors the Second Amendment,” Dale said.

Although the state has done much to deregulate gun laws in recent years, gun supporters said there is still more lawmakers can do to protect and further the Second Amendment right to bear arms.

For example, Dale said he wants lawmakers to pass SB1112 sponsored by Republican Sen. Kelli Ward of Lake Havasu City, which would prohibit enforcement of any new federal gun laws in Arizona. The measure is stuck in the Rules Committee because lawyers are concerns that the bill is unconstitutional.

Lawmakers should also abolish the gun free zones at schools, Dale said, although he noted it may be politically difficult in the wake of the Sandy Hook shooting.

“I understand the tragedy of the school shooting, I have kids in school and I’m a human being, but honestly, criminals don’t follow the law,” he said. “The only thing a gun free zone does is stop legal gun owners from going in with guns. Anybody who has bad intent, like ‘I’m going to go in a shoot up a school. Oh guns aren’t allowed? Nevermind.’ Yeah right.”

Dale said if lawmakers are serious about protecting children in schools, the state should allow teachers to carry a concealed weapon in the classroom, give them good training to use their guns and potentially even pay armed teachers more.

“I’d feel a lot safer (about my children),” he said. “At Sandy Hook, a lot of those teachers tried to protect the kids by hiding them, if they were armed and knew how to use their weapons, it would have been a lot less of a tragedy.”

Other gun activists said that although Arizona has some of the most relaxed gun regulations in the nation, now is not the time to become complacent and allow restrictions to slip through the process.

Lee Raimo carried a concealed 9mm handgun on his side, between his Captain America t-shirt and his leather jacket.

As a responsible gun owner and Marine Corps veteran and who is involved in a local gun-owners club, Raimo said he wouldn’t sell his guns to anyone who he thought might have a criminal background or was unstable.

But he condemned the push by Rep. Chad Campbell of Phoenix, the House Democratic leader, to require background checks for gun purchases at gun shows – closing the so-called “gun show loophole” –  because he said it could lead to the government having a database of gun owners.

“If they start keeping track of every single person who buys a gun, then they can make a list, and the government does (bad) things with lists, just look through history,” he said. “It’s a principle.”

Raimo is a lifelong Democrat but he said he is considering leaving the party because Democrats nationwide are having a knee-jerk reaction to a few tragic incidents.

“What I would say (to Campbell) is take a couple steps back, because I can’t believe Democrats are now against guns and want that much gun regulation,” he said.

Campbell’s proposal also calls for re-instituting the mandatory concealed carry permit. Lawmakers eliminated the requirement that citizens obtain a permit to carry a concealed weapon in 2010, and most Second Amendment supporters at the Capitol praised the change.

Dave Nerlove, who carried both an AR 15 and a Glock 17 to the Capitol, was one of the few to support Campbell’s plan to revive the concealed carry permit requirement. Nerlove is a National Rifle Association certified instructor and said that, unfortunately, most gun owners get their training from television or movies, and in order to be a responsible gun owner, it takes more training than that.

“It’s always better to have training,” he said. “Should it be mandatory? I would say to be a fully responsible gun owner, yes.”
