Amendments and addenda to the Patent Regulations under the EAPC https://ars-patent.com/amendments-and-addenda-to-the-patent-regulations-under-the-eapc/ Fri, 12 Jan 2024 08:45:32 +0000 https://ars-patent.com/?p=2626 As of January 1, 2024, amendments and addenda to Part I «Inventions» and Part II «Industrial Designs» of the Patent Regulations to the Eurasian Patent Convention came into force.

The term for submission of claims is established. In accordance with the new Rule 21¹(6¹) of the Patent Regulations, the term for submission of claims when such a document is missing among the application materials (including divisional applications) received by the EAPO, is two months from the date of receipt of a Eurasian application by the EAPO. If the claims are not submitted within the above mentioned term, the Eurasian application shall be considered withdrawn. The extension of this term is not provided by the Patent Regulations; however, if the applicant misses this term, he may apply for the procedure of continuation of the prosecution provided by Rule 37(3) of the Patent Regulations.

The procedure of continuation of the prosecution has also become available in respect of Eurasian divisional applications in cases when the applicant misses a two-month term for submitting the requested claims, which comply with the requirements according to Rule 49(6) of the Patent Regulations.

The term for filing oppositions has been increased. Opposition procedures against the grant of Eurasian patents for inventions and industrial designs may now be initiated within three years from the publication date of grant of a Eurasian patent for invention or industrial design.

Industrial designs. Amendments to the provisions on the examination of Eurasian industrial design applications have been introduced. The option of mediation of a dispute in case of identity or confusing similarity of an industrial design with trademarks with an earlier priority has become available.

New Russian Patent Requirements to simplify the process of getting legal protection abroad https://ars-patent.com/new-russian-patent-requirements-to-simplify-the-process-of-getting-legal-protection-abroad/ Fri, 12 May 2023 09:14:29 +0000 https://ars-patent.com/?p=2565 New Russian Patent Requirements have come into force as of April 29, 2023. Compared to the previous version of the Requirements, several amendments were introduced to improve Russian legislation and harmonize the provisions with the approaches applicable in foreign patent systems such as PCT, European and Eurasian patent conventions.

Firstly, this concerns the implemented two-step check of unity of invention (before and after the information search for an application is carried out) and new requirements for grouping of inventions. These amendments will considerably simplify the process of getting legal protection abroad.

Also, the list of documents related to an application was updated, and the list of situations for introducing amendments to the application materials was extended.

Amendments and addenda to the Patent Regulations to the EAPC https://ars-patent.com/amendments-and-addenda-to-the-patent-regulations-to-the-eapc/ Thu, 03 Nov 2022 11:39:17 +0000 https://ars-patent.com/?p=2529 As of November 1, 2022, amendments and addenda to Part I «Inventions» and Part II «Industrial Designs» of the Patent Regulations to the Eurasian Patent Convention came into force.

The most significant change in the Patent Regulations is the opportunity to file digital three-dimensional models (3D models) in relation to Eurasian applications for inventions and Eurasian applications for industrial designs, available for applicants from November 1, 2022.

The time limits for filing an opposition to a Eurasian patent for invention and an opposition to a Eurasian industrial design are extended. The time limit for filing a notice of opposition will be nine months from the date of publication of information of the grant of a respective Eurasian patent.

Amendments to the claims, in accordance with the new wording of Rule 49(3) of the Patent Regulations, are allowed before the notice of readiness to grant a Eurasian patent is sent to the applicant.

The addenda made to Part II “Industrial Designs” of the Patent Regulations expand the list of checks carried out in relation to industrial designs at the substantive examination stage, as well as expand the ways to exclude elements of the appearance of the product, for which the applicant does not request legal protection. It also eliminates the need for the applicant to submit a paper copy of the earlier application if such application is available to the EAPO via Digital Access Service of WIPO (WIPO DAS).
