Bail procedures in Arizona are generally the same as found in the rest of the country but unlike many states, bail amounts are typically the same anywhere across the state. So for example, bail for a DUI in Tuscon would be about the same as if it were in Winslow. Of course, additional factors may weigh into determining the bail such as prior arrests.

In Arizona, the state regulates the legal rates for bail bonds and the legal fee is 10%. Under certain circumstances some surety companies have been approved to write bonds for only 8% of the bond, but these are not the standard. So for example, if the bail is set at $1,000, the premium/cost the bondsman would charge you would be $100. Some Arizona bond agents also charge an adminstration fee of $100-$150 on top of the bond premium.

Bail bond agents in Arizona are regulated and licensed by the Department of Insurance. The DOI requires bail agents to be fingerprinted, clear background checks, and it audits bail agents regularly.

Bail in Arizona is usually quick outside of the Phoenix area. The Phoenix/Maricopa area is completely different. I have heard of Phoenix jails taking as long as 12 hours to release a defendant AFTER bail is posted. When you also consider that over 2,000 inmates are held outside in tents, you realize that this is not a fun place for your loved one to be spending any more time in than is necessary. In the Phoenix area, it is important to start the process as soon as possible.

The Durango Jail was built in 1976 as a minimum security jail. The Durango Jail houses approximately 1,500 inmates in nine housing units and two barracks buildings. Each housing unit contains four “pods,” and each pod contains a general-purpose day room area with metal tables and stools, and a bathroom area with toilets and showers. There are three large outside areas for recreation.

The Durango Jail houses adult “general population” male inmates. The jail also has a fully staffed and equipped medical clinic, non-denomination chapel and three education classrooms where inmates can attend scheduled religious and educational programs throughout the day.

The Fourth Avenue Jail opened in April 2005. This state of the art facility is considered to be one of the most secure and technologically advanced facilities in the nation. This facility was part of the largest county jail expansion project in the history of the nation, supported overwhelmingly by the taxpayers of Maricopa County

Fourth Avenue has a capacity of 2,064 beds of which 288 are specifically designed to house the highest security level inmate in the system.

The Lower Buckeye Jail was opened in April 2005 and is the largest detention facility in Arizona. Its design is based on aSheriff Joe Arpaio’s “no frills” philosophy, and provides safety and security for staff and inmates. The Facility currently houses all classifications of inmates, and includes separate housing for juvenile inmates (who are remanded on adult charges) and various types of special management inmates.

The housing units were designed to minimize inmate movement by providing needs (such as medical, education, visitation, religious services and various rehabilitation programs) within the inmate’s assigned housing unit, thus practically eliminating routine inmate movement. Along with safety and security, employee needs were also a priority in the design. Conference and training rooms were added to provide quality training. Break-room areas and an exercise facility with male and female locker rooms are available for employee use. Many innovative tools were designed and utilized to make operations more streamlined, staff friendly, and to increase security. A few of these tools include Video Visitation, Nice Vision Recording, Touch Screen Controls, and the Iris Scan.

The Tents Jail was begun in 1993 when Sheriff Joe Arpaio was able to obtain some surplus military tents. These tents were set up in an area adjacent to one of the existing Maricopa County Jails in Phoenix, Arizona. Sheriff Arpaio had previously decided that he would not release any inmates due to jail overcrowding, and housing sentenced inmates in the tents seemed a good solution. Funding for the project was minimal, and included the cost for cement necessary for base pads, secure fencing, and electric costs for heating, cooling and lights.

The Tents Jail can currently hold up to 2,000 inmates.

Sheriff Arpaio has added a few improvements at the Tents Jail, including two Sky Watch Towers for security, stun fences around the perimeter, and facial recognition computer software for inmate identification. K-9 units and patrol deputies have been added for additional security. The Classification Unit conducts background checks on inmates before they are housed in the tents, so that dangerous or predatory individuals are not placed there.

Los Angeles County Bail Bonds

The county of Los Angeles has the largest jail system and houses more inmates than any other county in California and perhaps the nation. WARNING: depending on crowding and other things, defendants may be transferred around to other facilities. Often from smaller facilities to County Jail or the Twin Towers. Women are usually transferred to Century Station Jail in Lynwood. Unfortunately, Los Angeles County jails have earned a reputation for taking unusually long periods for releasing the defendant after having posted bail. I have heard of release taking as long as 10-12 hours or more AFTER posting bail so it is important to get the bail posted as soon as possible.

For jails in Las Vegas, defendants arrested in the general Las Vegas area are usually detained at the Clark County Detention Center.

You can post bail yourself, but we strongly recommend that you first email a Las Vegas bail bondsman. Las Vegas bail bondsmen can give you tips and guidance to help you navigate the system BEFORE you make mistakes, often for free. It never hurts to email and ask because it can be a tricky and unpleasant process. Not to mention that Nevada is a state that allows bounty hunters to track down defendants that misunderstand and do not show up for hearings.

To post bail for inmates detained in the Clark County Detention Center without the use of a Las Vegas bail bondsman, you can go in person to the Justice Court Pre-Trial Services Office located on the first floor at 200 Lewis Street, Las Vegas, Nevada, 89155. While the hours used to be 24 hours a day, because of budget issues they have been getting cut back in the last couple years. As of this writing, they were open 8 A.M. to Midnight, 7 days a week. They have also stopped releasing bailed out inmates between midnight and 4:00 a.m. because of staffing cut backs and a hiring freeze which means the defendant may have to spend a little more time in jail than before. The cut backs have also made a quick release on bail almost impossible. There have been cases where it has taken 24 hours or more to be released after posting bail. The role of a bounty hunter

When a person get arrested, they can usually get a bail bonds agent to post bail. The bail is to guarantee that if the defendant is released they will make all court appearances. Should the defendant not show up for a court appearance, called skipping bail, then the bail bond agent risks losing all their money that was posted for the bail.

The bounty hunter tracks down the defendant, now a fugitive, and brings them back to trial so the bail bonds agent can recover some or all of their money.

Why be a bounty hunter?

Unlike the wild west days, bounty hunting has become a respected profession in the law enforcement field.  Often called Fugitive Recovery Agents or Bail/Bond Enforcement Agents, they provide a needed service and in many cases bail bond agents and law enforcement rely on them to bring fugitives to justice.

While the income varies by state, the bounty hunter can earn a very good living.  Sometimes a bounty hunter is paid a set fee, usually about 10% of the bail, but in some cases we have heard of  bounty hunters getting as much as 75% of the bail amount for bringing the fugitive in.   If you track down a few fugitives who had bail of $100,000 or more, you can see how profitable it can be.  The famous bounty hunter Duane “Dog” Chapman, received 10% of a million dollar bail for bringing in the heir to the Max Factor fortune, Andrew Luster.  Your income is based on the number of fugitives you bring in so it can be very lucrative.

How to become a bounty hunter

Most countries outside of the United States do not allow bounty hunting and currently there are seven states that limit it.  In the USA it is legally recognized by the 1872 Supreme Court case Taylor v. Taintor.  So you will need to operate in the USA.  However, even though it is legal in the USA it is still regulated on a state by state basis.

Every state has its own requirements and the authority of the bounty hunter varies by state as well.  So for instance, you may be allowed to carry a concealed weapon in some states but not others.  Bounty hunters also need to know the rules for bounty hunting in neighboring states and countries as well since fleeing fugitives will often leave the area.

In general, a state will require:

• An application accompanied by an application fee
• A background check and fingerprint.  Each state is different in how strict they are with this.  For instance, some states have licensed felons and others with criminal records
• You generally do not need a formal education
• Must be 18 years old
• In some cases, will require you to have a license to carry a firearm

Information For Arrests and Bail Bonds Within Richmond Virginia City Limits

In Richmond, once you have been arrested, you will be evaluated by the Division of Adult Pretrial Services. This office advises the courts regarding if bail should be given and how much it should be set at. They will first review the police records, called a screening process, and then interview the defendant at the Richmond City Jail Annex, also known as Lock Up. These people are very powerful and will determine your bail status largely based on this interview. Based on the police records and the interview they will create a Risk Assessment report and their recommendations for bail. We cannot express how important it is that the defendant be on their best behavior and put on a good impressions during this interview. They can recommend that you stay locked up, but they can also recommend that you be released on your own recognizance with no bail required at all.

If you get bail, the Adult Pretrial Services staff will stay in close contact with the defendant. In thr Richmond jurisdiction it is very common for them to require the defendant get screened for substance abuse. The Richmond test is capable of looking for up to 51 different substances.

They may also do random testing for alcohol use.

If the defendant is released on bail with restrictions on where they can go or how late they can be out, the Richmond Adult Pretrial Services will use an electronic monitoring device to keep track of them. WARNING: We strongly advise that you cooporate fully with this department. They have the authority to ask the court to order you to return to jail and they will use it.

Most arrests that take place within Richmond City limits end up at the Richmond City Jail while awaiting bail.

Information For Arrests and Bail Bonds in Henrico County but Outside Richmond VA City Limits

When arrested in Henrico County, the defendant will be evaluated and interviewed by the Henrico County Community Corrections Program. This department is referred to in various ways including CCP, Community Diversion Incentive, CDI, Community Corrections Resources Board, CCRB, and Pretrial Services Program.

This department will try to determine if the defendant is a risk to others in the community and if they are a risk to skip bail and flee. It is important to show them that you are not a risk to either of these in order to obtain bail. Getting a bail bond in Louisiana is a simple and easy process since Louisiana has strict licensing requirements for bail bonds agents, often called Commercial Sureties in this state, and are monitored by the Louisiana Department of Insurance. To be an agent in Louisiana, by law they must first be an apprentice for a full six months under a licensed bail bonds producer. They must also take a pre-licensing course, pass an examination and a background check. Many reputable Louisiana bail bonds agents are also members of the Association of Louisiana Bail Underwriters.

In Louisiana bail bonds fees are usually 12% except in Orleans Parish which is 13% or Jefferson Parish which is 12.5%. We have found that the best and fastest way is to just start emailing bail bond agents and ask for advice.  The fact is that these are the people who will be paying you and are very knowledgeable about the process (and helpful!).  You can get the email addresses off their websites.  Look for websites that have “bail”, “bond”, “bondsman”, or “surety” in the name or description.

What happens when you are arrested in Texas and how does it affect your bail?

According to the Texas State Bar Association and other references:

-The officer takes you to a police station, jail or other detention facility. The police do not file the charges, they only provide information to the prosecutor who decides what to file if anything.

-Just after arriving at the jail, you are allowed to contact an attorney or bail bond agent.

-You may be required to participate in a lineup, present a sample of your handwriting, speak phrases associated with the crime charged, wear certain clothes and give samples of your hair, blood, etc. You may be fingerprinted or photographed.

-In terms of bail, the most important event for you is the arraignment, in Texas this is sometimes called first appearance and sometimes called the bail hearing. You appear before a magistrate (court official) who will inform you of the charges against you and your rights. At this time, you may find out if you qualify for bail and if so, how much it will be. Your actions at this time can have a major affect on your bail. The magistrate has wide descretion regsrding bail and will make the decision based upon a number of factors including your risk of flight and your danger to the community. How you behave will influence how he looks at those factors. You may be released on your own recognizance without requiring bail, you may have bail set from a small amount up to millions of dollars, or you may not qualify for bail at all. It is important that at this arraignment that you make a good presentation.

Be professional, speak clearly, answer the questions honestly, when asked about the criminal activity you engaged in to end up there, give solid reasons and do not make excuses. Speak postively about your job, your family, your participation in the community. All these things can help your bail situation. Of course, doing the opposite can result in no bail being set and you may end up with a long stay in jail waiting for your case to be resolved.

-If it is a felony offense you will have to appear at a Preliminary Hearing to review probable cause. Once a Judge determines that there is probable cause, that is, there is enough evidence to support the charges against you, he moves the case to Superior Court for trial. At this point additional charges can be added as well as readjusting the bail amount. This is a critical time to get your bail lowered.

-Once moved to Superior Court, the prosecutor will file a charging document called an Information. The Information is the list of charges against you and you will be asked to plead innocent or guilty.

-After the trial, bail will be refunded if you made all scheduled appearances.

How to find a bail bondsman in Texas

Texas is a little different than most other states which regulate bondsman. In most states bondsmen are licensed by the state itself but in Texas, counties have bail bond boards that are responsible for licensing and regulating bail bondsmen in each county in accordance with Chapter 17.04 of the Texas Occupations Code. The bondsman is issues an identification number and this number must be present in the bond itself. Therefore, the laws and rules regarding bail will vary by county. Because it is a county by county affair, the offices for the bondsmen are usually located very close to the couthouses. So Brownsville may be different from El Paso, for example.

We strongly suggest that you visit a bondsman’s website. They always have their email prominently displayed. Email the name of the defendant and the location the defendant is being held, if you know. Ask them how much they charge, including ALL fees. Email the same questions to three bondsmen. You can then make an intelligent decision regarding which one to go with. The email provides a written record of what they charge, you don’t want hidden fees added on later after all. also since you probably don’t know much about bail and your mind may not be focused anyway, you won’t have to worry about forgetting everything you have been told. The bondsmen work 24 hours so it will also be helpful to see who responds quickest. Since you want someone that will get your loved one out sooner rather than when they get around to it.

If you have a valid email address, you can start a conversation with a bail bondsman. Look for a website of a bail bondsman, their email addresses are always prominently displayed on their home page. Send them an email and ask what the process is in your situation. Most of them read their email 24 hours a day, so they should get back to you quickly.

If you do not have a valid email account or you have one but the jail internet settings do not allow you to access it, you still have options. Most bail bond websites have communication tools that do not require email. For instance, some have chat rooms so you can interact live with an agent. Most have contact forms that you can fill in and submit. It is important that you provide as much information as possible on this form. Your name, birth date, the charges against you, and where you are being held are necessary to start with. If you have the ability to pay for their bond fees (for instance the jail is holding your credit card but you can’t access it), you should also let them know. Since they can’t contact you back, you will need to provide as much information to them as possible so they can come down to your facility to talk to you.

TIP: a prison official gave me this interesting tip, which even I had not heard of. If you can’t get a bond agent to come to you, some jails allow bond agencies to use 3rd party pick up. The jail will allow an authorized transportation company to take you from the holding facility to the bail bond agency for the purpose of getting bail. You may want to let the bond agent know that you are willing to do this and ask about this in your email to them.
