Below is how CIDCA’s vice-chairman Zhou Lijun 周柳军 responded to this question, posed at a press conference by Bloomberg, in October 2021 (original article here):

China is currently not a member of the Paris Club, but we have participated in a part of Paris Club activities as a non-member country, and our communication with Paris Club members has been very smooth.

Moving forward, China will adhere to principles of “joint actions, fair burden sharing, a case-by-case approach and multilateral consensus” for multilateral debt treatment, strengthen communication and cooperation with all parties, and work with other parties to help African countries address their debt issues. Moreover, we will work with the African side to speed up the implementation of the outcomes of the FOCAC Beijing Summit, accelerate the implementation of cooperation projects that meet the African countries’ urgent need for development and further strengthen the internal driving forces of African economies. At the same time, we call on developed countries, multilateral financial institutions and private creditors to mate their words with deeds and do more things that benefit developing countries in Africa and elsewhere. We should work together and complement each other’s strengths to sincerely support developing countries, including African countries, to achieve sustainable development and bring tangible benefits to their people.

While Zhou Lijun doesn’t answer the question directly, the implied answer is clearly: no. The answer is an expression of China’s belief that the Paris Club principles do not match the development financing needs of developing countries and are not suited to bring “tangible benefits” to their people. Something, the answer implies, that Chinese development finance does.

But to understand what the numbers mean, one sometimes must search different documents.

All the budget items of the Chinese government are listed in the yearly “Central Level General Public Budget Expenditure” (中央本级支出出算表) of the Ministry of Finance (MOF), published on its website.

Taking a look at the most recent 2022 document, “foreign aid” (对外援助) is listed under the section “diplomatic expenses” (外交支出). This illustrated that China views aid as part of its foreign policy. In addition to aid, “diplomatic expenses” include:
– embassies and consulates (驻机构)
– international organisations (国际组织)
– external cooperation and exchanges (对外合作与交流)
– international development cooperation (国际发展合作)

Notably, “foreign aid” and “international development cooperation” are separate budget items. In fact, “international development cooperation “refers to funds used to run China’s International Development Cooperation Agency CIDCA – CIDCA’s staff, public expenditures and administrative items. This is not explained in the MOF document but in CIDCA’s budget, available on CIDCA’s website.

According to MOF’s report, in 2022, China spent 21.05bn RMB on “foreign aid” and 49 million RMB on “international development cooperation”. In CIDCA’s 2022 budget, the number for “international development cooperation” is the same as in MOF’s, but the number for “foreign aid” is much lower: 35.13mn RMB. Btw., in 2022, CIDCA overspent by 31.05% on “international development cooperation” and underspent 22.5% on “foreign aid”. In 2021, it underspent by 47.5.%.

CIDCA’s minuscule share of the foreign aid budget is explained by the fact that it does not implement foreign aid projects by itself and doe not host the relevant funds. The main aid-implementing body is still the Ministry of Commerce (MOFCOM). MOFCOM’s 2022 budget lists 17.45bn RMB for “foreign aid”.

This means that of the total “foreign aid” budget, 21.05bn RMB, listed in the MOF budget document, 35.13mn RMB are attributable to CIDCA, and 17.45bn RMB to MOFCOM, which is in charge of the execution of aid projects. The remaining part probably belongs to other ministries involved in foreign aid, e.g. the Ministry of Health that sends Medical Teams (医疗队) to Africa, or to the Ministry of Agriculture, or to one of the other institutions.

The figures from the budget documents indicate that Chinese foreign aid spending remained stable over the past four years. Moreover, the numbers are much lower than the international estimates. For 2019, for example, Kitano and Miyabayashi (2020) estimated US$ 5.9bn, while the AidData project estimated US$8.5 bn – compared to US$3.15 bn stated by the Chinese government.

This suggests that activities that could be classified as ODA-related or comparable from the DAC perspective are not defined as such by the Chinese government – with corresponding implications.

The document will become effective on 1 October 2021 and replaces the 2014 “(Experimental) Measures for the Administration of Foreign Aid” (对外援助管理办法 (试行)) of the Ministry of Commerce. It operationales the new foreign aid and international development cooperation policy under Xi Jinping which was charted in the new White Paper on “China’s International Development Cooperation in the New Era” of January 2021.
The new Measures have been long in the making. A draft with a request for public comments (such drafts are a typical steps in China’s legislation) had been published by China’s International Development Cooperation Agency CIDCA already in November 2018. The changes to the draft and the time passed could be signs of a lengthy process of bureaucratic negotiation between the main actors of China’s foreign aid system.

Before we turn to the translation, here are some comments on the main points and changes to be taken from the document (if you’re just looking for the translation, scroll down): 

1. Key actors and distribution of responsibilities. The Measures are issued not by CIDCA alone (CIDCA issued the draft Measures) but jointly by CIDCA, the MFA and MOFCOM, which implies that all three will play a central role in China’s foreign aid system – with divided responsibilities. However, the Measures do not have the status of law (法律) but are departmental regulations, which means that they apply only to the issuing institution and do not regulate the responsibilities of other actors in China’s foreign aid system. 

  • CIDCA is in charge of drafting aid policies and strategic guidelines (Art. 6, 9), managing the scope and use foreign aid funds (Art. 6), drafting country-specific aid policies (Art. 5, 10) and annual plans (Art. 10), selection of foreign aid projects (Art. 6, 14), signing of foreign aid agreements with recipients (Art. 15), and the oversight and evaluation of project implementation. It is also in charge of international exchanges and cooperation on foreign aid. However, CIDCA cannot decide independently on all issues, but must submit proposals to the State Council for approval.
  • MOFCOM has now the status of an “aid implementing department” (援外执行部), similarly to other Ministries in charge of the implementation of foreign aid projects (e.g. Ministry of Agriculture for agricultural projects or the National Health Commission for medical teams and health aid projects). According to the measures, MOFCOM’s responsibilities now cover technical negotiations with recipient countries, selection of entities for the implementation of foreign aid projects (in practice, these have so far mainly been state-owned enterprises) or deployment of development workers (mainly trainers). MOFCOM and other aid implementing departments have the right to submit proposals to the State Council on specific foreign aid matters.
  • MFA‘s role is to ensure that foreign aid is consistent with China’s foreign policy objectives (that has not changed). Accordingly, Chinese embassies and consulates shall serve as focal points for recipient country governments and oversee the implementation of foreign aid projects. In the past, this task has been undertaken by MOFCOM’s Economic and Commercial Councilors Office (ECCOs), which are part of Chinese embassies but are in MOFCOM’s line of command. However, now, the supervision by embassies is mentioned in the MFA paragraph and not in the MOFCOM paragraph. This may indicate either that local responsibility has been shifted from MOFCOM to the MFA or that the ECCOs, which acted relatively independently of the embassies in the past, are becoming more integrated into the embassy structure. 

The overall management system has not changed. Like in the past, the coordination between different ministries is supposed to happen through an “inter-ministerial coordination mechanism” (部际协调机制) (Art. 8), meaning that there is no one actor with directive authority (except, of course, for the State Council).

2. New purpose, new foreign aid modes and new project types. Sustainable development added as the purpose of foreign aid. Both the 2014 MOFCOM Measures and the 2018 CIDCA, in the purposes of foreign aid (Art. 4) spoke of “enhancing the recipients’ capacity for independent development” (增强受援方自主发展能力); in the new 2021 Measures, it is “enhancing the recipients’ capacity for independent and sustainable development” (增强受援方自主可持续发展能力). “Sustainable” was apparently only added recently, during the revision of the 2018 draft. Technical assistance can now include policy advice (政策咨询) to realise policy or management objectives (Art. 19 (3)). South-South Cooperation Assistance Fund (SSCAF) projects have been added as a new aid mode: funds can be used to support projects implemented by international organisations, social organisations or think tanks (Art. 19 (8)). Furthermore, aid projects no longer have to be implemented by a Chinese entity (Art.20): They can also be implemented in joint collaboration by China and the recipient or by the recipient alone. Most notably, China can now also cooperate with international organisations and NGOs on aid projects.

3. Project oversight and evaluation. While Art. 6 stipulates that CIDCA is in charge of oversight and evaluation of project implementation, a corresponding oversight and monitoring/evaluation system is yet to be established (Art. 43). CIDCA is also yet to develop criteria for project evaluation (Art. 44), a project information management and reporting system (Art. 44), and a foreign aid statistical system (Art. 47). The objective of setting up a statistical system had already been included in the 2014 MOFCOM Measures, and it is not clear how much progress there has been since then. But, all the points mentioned here could present an interesting collaboration space between CIDCA and DAC donors.

Chinese embassies and consulates (missions) co-ordinate the management of foreign aid work in the countries (international organisations) where they are based. They shall assist in handling foreign aid affairs, communicate with recipients about their aid needs and conduct policy reviews, and be responsible for on-the-ground supervision and administration of the execution of foreign aid projects.

Art. 14 CIDCA shall establish a foreign aid project reserve system, collect, review and identify country-specific foreign aid reserve projects, and implement dynamic management of reserve projects.

  第三章 对外援助方式 Chapter 3: Foreign Aid Modes

第十六条 对外援助资金主要包括无偿援助、无息贷款和优惠贷款三种类型。 Art. 16 Foreign aid funds shall mainly include the three types, grant aid, interest-free loans and concessional loans.
  援助主要用于受援方在减贫、减灾、民生、社会福利、公共服务、人道主义等方面的援助需求。 Grant aid shall be mainly used for aid recipients’ needs in areas such as poverty reduction, disaster relief, livelihood, social welfare, public services and humanitarian issues.
  无息贷款主要用于受援方在公共基础设施、工农业生产等方面的援助需求。 Interest-free loans shall be mainly used for aid recipients’ needs in areas such as public infrastructure or industrial and agricultural production.
  优惠贷款主要用于支持受援方在具有经济效益的生产型项目、资源能源开发项目、较大规模的基础设施建设项目等方面的援助需求。 Concessional loans shall be mainly used for supporting the recipients’ needs in areas such as economically productive projects, resource and energy exploration projects or large-scale infrastructure construction.
  第十七条 国际发展合作署通过南南合作基金等方式创新对外援助形式。 Art. 17 CIDCA shall innovate the forms of foreign aid through the South-South Cooperation Assistance Fund and similar funds.

第十八条 对外援助以项目援助为主。
在人道主义援助等紧急或者特殊情况下,可以向受援方提供现汇援助。
Art. 18 Foreign aid is provided mainly in form of project aid.
Humanitarian aid or [aid] in other exceptional circumstances may be provided as cash assistance.
15 第十九条 对外援助项目主要包括以下类型: Art. 19 Foreign-aid projects shall be mainly provided in the following forms:
  (一)成套项目,即通过组织或指导施工、安装和试生产全过程或其中部分阶段,向受援方提供生产生活、公共服务等成套设备和工程设施,并提供长效质量保证和配套技术服务的项目; (1) Complete projects, i.e, through organizing and guiding a complete process or parts of the process of construction, installation and trial production, providing aid recipients with complete equipment and project facilities for areas such as production and living, or public services, as well as providing long-term quality assurance and technical service support;
  (二)物资项目,即向受援方提供一般生产生活物资、技术性产品或者单项设备,并承担必要配套技术服务的项目; (2) Material projects, i.e. providing aid recipients with ordinary materials for production and living, technical products or single equipment, and undertaking of necessary supporting technical services;
(*) (三)技术援助项目,即综合采用选派专家、技术工人或者提供策和技术咨询、设备等手段帮助受援方实现某一特定政策、管理或者技术目标的项目; (3) Technical assistance projects, i.e. comprehensively employing such means as selecting experts or technicians and providing policy and technical advice and equipment to assist the aid recipients in realizing specific policy, management or technical objectives;
  (四)人力资源开发合作项目,即为受援方人员提供各种形式的学历学位教育、研修培训、人员交流以及高级专家服务的项目; (4) Human resource development and cooperation projects, i.e. providing aid recipients with various forms of academic and degree education, advanced studies and training, personnel exchange and senior expert service;
  (五) 志愿服务项目,即选派志愿者到受援方从事公益性服务的项目; (5) Volunteer programs, i.e. selection of volunteers to provide public services in aid recipient countries;
  (六) 援外医疗队项目,即选派医务服务人员,并无偿提供部分医疗设备和药品,在受援方进行定点或者巡回医疗服务的项目; (6) Foreign aid medical team projects, i.e. sending medical service personnel and providing part of the medical equipment and drugs free of charge, to carry out on-site or mobile medical services in recipient countries;
  (七) 紧急人道主义援助项目,即在有关国家遭受人道主义灾难的情况下,通过提供紧急救援物资、现汇或者派出救援人员等实施救助的项目; (7) Emergency humanitarian assistance projects, i.e. projects for countries affected by humanitarian disasters to provide relief through the provision of emergency supplies, cash remittances or sending rescue workers;
(*) (八) 南南合作援助基金项目,即使用南南合作援助基金,支持国际组织、社会组织、智库等实施的项目。 (8) South-South Cooperation Assistance Fund Projects, i.e. the use of the South-South Cooperation Assistance Fund to support projects implemented by international organizations, social organizations, think tanks, etc.

第二十条 对外援助项目一般通过政府间援助方式实施,主要有以下方式: Art. 20 Foreign aid projects are generally implemented through intergovernmental aid, mainly in the following ways:
  (一)中方负责实施; (1) Implementation by the Chinese side;
(*) (二)中方与受援方按商定分工合作实施; (2) Implementation by the Chinese side and recipient side in joint cooperation based on an agreed devision of labour;
(*) (三)在落实中方外部监督的前提下由受援方自主实施; (3) Independent implementation by the recipient side under the external supervision of the Chinese side;
(*) (四)中方也可以同其他国家、国际组织、非政府组织等合作实施。 (4) The Chinese side may also cooperate with other countries, international organisations, NGOs etc. for implementation.
  第二十一条 加强对外援助资金管理、援外优惠贷款管理,有关规定另行制定。 Art. 21 Provisions for strenghening the administration of foreign aid funds and the administration of foreign aid concessional loans will be formulated separately.
  第四章 对外援助项目立项
Chapter 4: Initiation of Foreign Aid Projects
(*) 第二十二条 受援方有援助需求时,应当将项目建议通过驻外使领馆(团)向中方提出,驻外使领馆(团)对受援方提出的项目建议进行国别政策审核并形成明确意见后报外交部和国际发展合作署,并抄报援外执行部门。 Art. 22 When a recepient has a need for assistance, it shall submit its project proposal to the Chinese side through the Chinese embassy or consulate (mission). The embassy or consulate (mission) shall conduct a country policy review of the submitted project proposal, formulate a definitive opinion and then report it to the Ministry of Foreign Affairs and CIDCA, with a copy to the foreign aid implementation department(s).
  援外执行部门可以根据工作需要向国际发展合作署提出项目建议。 Foreign aid implementing departments can submit project proposals according to their specific work needs.
(*) 第二十三条 对外援助项目在立项前应当经过可行性研究。 
中方可以要求受援方提供拟立项项目的相关资料,作为进行可行性研究的前提。
Art. 23 Foreign aid project shall undergo feasibility studies before they are initiatiated.
The Chinese side may request the recipient to provide relevant information on the proposed project as a prerequisite for feasibility study.
  第二十四条 国际发展合作署组织项目前期论证,根据可行性研究结果确定项目,并按照程序批准立项。 Art. 24 CIDCA shall organise early-stage project demonstration, decide upon projects based on feasiblity studies, and ratify project initiation in accordance with procedures.

第二十五条 对外援助项目立项后,国际发展合作署一般应当与受援方商签政府间立项协议,明确协议各方的权利和义务,主要包括项目内容、资金安排、实施配套条件、相关税收减免、安全保障等。 Art. 25 After a Foreign aid project is approved, CIDCA shall generally sign an intergovernmental project establishment agreement with the aid recipient. It shall clarify the rights and obligations of the parties to the agreement, in particular the project content, funding arrangements, implementation support conditions, relevant tax exemptions, security guarantees, etc.
20 第二十六条 对外援助项目实施过程中涉及立项协议内容重大调整的,国际发展合作署按照程序报批后可以进行调整并与外方签订补充立项协议。 Art. 26 If it becomes apparent during project implementation that major adjustments to the original implementation agreement are necessary, CIDCA shall submit a request for approval of adjustments to its higher authority [State Council] according to the procedures, and upon approval may execute adjustments and sign a supplement to the implementation agreement with the recepient.
  援外执行部门可以向国际发展合作署提出调整的建议。 Foreign aid implementing departments may make recommendations for adjustment to CIDCA.

21 第二十八条 优惠贷款项下的对外援助项目,国际发展合作署应当在承办金融机构出具评审意见后按照程序,并与受援方签署优惠贷款框架协议。 Art. 28 For Foreign aid projects under concessional loans, CIDCA shall decide on approval on the project approval according to the procedures following the assessment opinion of the implementing financial institution and sign the concessional loan framework agreement with the recepient.
  第二十九条 人道主义灾难发生后,国际发展合作署会同有关部门拟订紧急援助方案,并办理立项。 Art. 29 In the aftermath of humanitarian disasters, CIDCA shall work with relevant departments to formulate and approve emergency assistance programmes.
  第五章 对外援助实施管理 Chapter 5: Implementation Management of Foreign Aid Projects
  第三十条 国际发展合作署根据现行部门分工统筹安排援外执行部门组织实施项目。
 
Art. 30 CIDCA shall organise the implementation of projects through foreign aid implementing departments in accordance with the existing division of labour. 
 22 援外执行部门依据立项批准内容组织实施对外援助项目,对对外援助项目的安全、质量、进度、投资控制等负责,可以委托有关机构组织实施管理。 Foreign aid implementing departments shall organize the implementation of aid projects according to the approved project description, and are responsbile for the safety, quality, progress, investment controlling of foreign aid projects. They can entrust relevant agencies to organize and implement project management.
  第三十一条 国际发展合作署会同有关部门推动重大项目实施,协调解决项目实施中的问题。 Art. 31 CIDCA shall work with relevant department to promote the implementation of major projects and coordinate the resolution of problems that arise during project implementation.
25 第三十二条 国际发展合作署和商务部按照职责分工对对外援助项目实施主体资格进行管理,制定有关管理制度。 Art. 32 CIDCA and MOFCOM shall, according to their respective functions and responsibilities, administer the qualifications of the parties implementing foreign aid projects and establish appropriate management systems.

33 第三十七条 因外交、国家安全或者承担的国际义务等原因,或者因不可抗力导致对外援助项目无法实施时,国际发展合作署按照程序报批后可以中断或者终止对外援助项目。 Art. 37 If a foreign aid project cannot be implemented due to reasons such as diplomacy, national security or international obligations, or due to force majeure, CIDCA may suspend or terminate the foreign aid project after submitting an application for approval in accordance with procedures.
  援外执行部门可以向国际发展合作署提出中断或者终止对外援助项目的建议。 Foreign aid implementing departments may recommend to CIDCA to suspend or terminate  foreign aid projects.
  第三十八条 对外援助项目执行完毕后,中方一般应当与受援方办理政府间交接手续,商签政府间交接证书。 Art. 38 Upon completion of a foreign aid project, the Chinese side shall, in general, go through the intergovernmental handover procedures with the recipient and negotiate and sign an intergovernmental handover certificate.
30 第三十九条 国际发展合作署、援外执行部门会同有关部门建立对外援助出口物资口岸验放机制。 Art. 39 CIDCA and foreign aid implementing departments shall, in conjunction with relevant departments under the State Council, establish a mechanism for customs inspection and release of export materials for foreign aid.

除涉及国家实施出口管制的货物、技术、服务等物项外,对外援助物资出口不纳入配额和许可证管理。 Except for goods, technologies, services and other items subject to export control by the state, the export of foreign aid materials shall not be included in quota and licensing administration.
34 第四十条对外援助资金应当专款专用、单独核算,任何单位和个人不得挪作他用。 Art. 40 Foreign aid funds shall be used for designated purposes only, and be subject to separate accounting. No entity or individual shall misappropriate the funds.
38, 39, 40 第四十一条 对外援助人员是指政府或者对外援助项目实施主体派遣执行对外援助任务的人员。对外援助人员在外执行对外援助任务期间享有国家规定的待遇保障。对外援助人员在受援方当地执行对外援助任务期间应当遵守中国和受援方的法律法规,尊重受援方的风俗习惯。 Art. 41 Foreign aid personnel refers to personnel sent by the government or the implementing party of a foreign aid project to carry out foreign aid tasks. Foreign aid personnel are entitled to the treatment and protection stipulated by the state during their foreign aid missions. Foreign aid personnel shall abide by the laws and regulations of China and the recipient country, and respect the customs and practices of the recipient country during the execution of foreign aid missions in the recipient country.
42 对外援助项目实施主体应当加强对对外援助人员的管理和监督,按照有关规定保证其派遣的对外援助人员在外执行对外援助任务期间享有相应的工作和生活待遇及人身意外伤害保障。 The implementing party of a foreign aid project shall have a strong management and supervision of foreign aid personnel, and ensure that the foreign aid personnel they dispatch enjoy appropriate work and living allowances and personal accident injury protection during their foreign aid missions in accordance with relevant regulations.
44 对外援助人员在执行对外援助任务期间作出突出贡献的,国际发展合作署和援外执行部门可以依法给予表彰。在执行对外援助任务期间牺牲的国际发展合作署和援外执行部门可以依法报请有关部门评定为烈士。 CIDCA and foreign aid implementing departments may, in accordance with the law, commend foreign aid personnel who have made outstanding contributions during the execution of foreign aid missions. If a foreign aid worker dies while carrying out a foreign aid mission, CIDCA and the foreign aid implementing department may, in accordance with the law, report to the relevant authorities so that they may classify them as a fallen hero.
36 第四十二条 对于对外援助项目实施主体的违法违规行为,任何单位和个人可以依法向国际发展合作署和援外执行部门投诉或者举报。 Art. 42 Any unit or individual may file a complaint or report to CIDCA and the foreign aid implementation department for any violation of law or regulation by implementing party of a foreign aid project.
  第六章 对外援助监督和评估 Chapter 6: Foreign Aid Supervision and Evaluation
(*) 第四十三条 国际发展合作署会同援外执行部门建立对外援助项目监督制度,对对外援助项目的实施情况进行监督。 Art. 43 CIDCA, in conjunction with foreign aid implementation departments, shall establish an oversight system for the implementation of foreign aid projects and monitor the implementation of foreign aid projects.

第四十四条 国际发展合作署会同援外执行部门建立对外援助项目评估制度,制定对外援助项目实施情况评估标准组织开展评估。 Art. 44 CIDCA, in conjunction with foreign aid implementation departments, shall establish a system for the evaluation of foreign aid projects, develop criterea for evaluating the implementation of foreign aid projects, and organize evaluations [i.e. CIDCA likely does not carry out evaluation itself].

 (*) 第四十六条 国际发展合作署会同援外执行部门建立对外援助项目信息报送制度。 Art. 46 CIDCA, in conjunction with foreign aid implementation departments, shall establish a foreign aid project intformation reporting system.
  援外执行部门向国际发展合作署报送对外援助项目组织实施情况,以及项目组织实施过程中出现的质量、安全、进度和投资控制等重大问题。 Foreign aid implementing departments shall report to CIDCA on the organisation and implementation of foreign aid projects, as well as major issues such as safety, quality, progress, investment controlling that arise during the organisation and implementation of the projects.
  驻外使领馆(团)向国际发展合作署、外交部和援外执行部门报送对外援助项目境外监管中发现的质量、安全、进度和投资控制等重大问题。 Embassies and consulates (missions) shall report to CIDCA, the MFA and foreign aid implementing departments on major issues of quality, safety, progress and investment controlling identified during the on-the-ground supervision of foreign aid projects.

  第七章 法律责任 Chapter 7: Legal Liability

第四十八条 对外援助项目实施主体有下列行为之一的,国际发展合作署、援外执行部门依职权给予警告或者通报批评,可以并处人民币3万元以下罚款,并依法公开处罚决定: Art. 48 If an implementing party of a foreign aid project commits any of the following conduct, CIDCA or a foreign aid implementing department shall, in accordance with its functions and powers, issue a warning or a notice of criticism and impose a fine of not more than 30,000 yuan, and make the penalty decision public in accordance with law:
  (一)将所承担的对外援助项目任务转包或者违法分包的; (1) if the responsibility for a foreign aid project is transferred or illegally subcontracted;
  (二)未按对外援助项目实施合同履行义务或者迟延履行义务,影响项目正常实施,造成严重不良影响的; (2) if there is a failure to fulfill obligations according to the foreign aid project implementation contract or if there are delays in the fulfillment of obligations, which affect the normal implementation of the project and cause serious adverse effects;
  (三)挪用对外援助资金的; (3) if foreign aid funds are misappropriated;
  (四)未按规定保证外派对外援助人员工作和生活待遇,未提供人身意外伤害保障的。 (4) if the work and living allowances of foreign aid personnel sent abroad, or personal accident injury protection are not provided according to regulations.
  对外援助项目实施主体违反相关法律、行政法规规定的,依照规定给予行政处罚;构成犯罪的,依法追究刑事责任。 If an implementing party of a foreign aid project violates any relevant law or administrative regulation, it shall be sibject to an administrative penalty in accordance with the provisions; if the violation constitues a crime, it shall be subject to criminal liability in accordance with law.

第四十九条 国际发展合作署、援外执行部门和驻外使领馆(团)的工作人员在对外援助管理中有下列行为之一的,视情节轻重给予相应处分;构成犯罪的,依法追究刑事责任: Art. 49 If a staff member of CIDCA, a foreign aid implemeting department or a Chinese embassy or consulate (mission) engages in any of the following conduct during foreign aid administration, s/he shall receive corresponding penalty 7 to the seriousness of the circumstances. If the case constitutes a crime, the criminal liability shall be investigated according to law:
  (一)利用职务便利索取他人财物,或者非法收受他人财物为他人谋取利益的; (1) Taking advantage of one’s position to extort profit, or illegally accepting the money or for the benefit of other people;
  (二)滥用职权、玩忽职守或者徇私舞弊,致使国家利益遭受损失的; (2) Misuse of authority, neglect of duty or favoritism, and causing losses to state interests;
  (三)泄露国家秘密的。 (3) Divulging state secrets.
  第八章
Chapter 8: Supplementary Provisions
49 第五十条 对外军事援助,按照国家和军队有关规定执行。 Art. 50 Foreign military assistance shall be carried out in accordance with the relevant national and military regulations.
  第五十一条 本办法自2021年10月1日起施行。商务部《对外援助管理办法(试行)》(商务部令2014年第5号)同时废止。 Art. 51 These Measures shall come into force on 1 October 2021. The Measures for the Administration of Foreign Aid (for Trial Implementation) of the Ministry of Commerce (Order No. 5 of 2014 of the Ministry of Commerce) shall be repealed simultaneously.

Two more final observations:

On the nature of the document itself. In contrast to the 2014 MOFCOM Aid Measures, the 2021 Aid Measures are no longer “experimental/for trial implementation” (试行). Policy experimentation is a distinct mode of reform governance in China, and one of its central features are provisional regulations, or “quasi-law”, which are marked as “provisional” (暂行) or “experimental” (试行) in their titles, signifying that they are open for policy modification and will be finalised only after obtaining sufficient experience during the trial period. Nearly two-thirds of all legal provisions on China’s foreign aid issued after 1995 were provisional, which means that since then Chinese aid system has been in policy experimentation mode. It seems that (for now at least) this phase has ended, and the Chinese government expects the set-up introduced in the new Aid Measures to stay. However, this does not mean that foreign aid reforms are over: The Measures stipulate that CIDCA shall work on further reforming China’s foreign aid system (Art. 12) and on foreign aid legislation (Art. 13), whose absence, Chinese scholars frequently argue, is one of the causes of the fragmentation and lack of transparency in China’s foreign aid system.

On newly added basic principles of foreign aid. The description of basic principles of China’s foreign aid in the 2014 Measures (as well as in the 2011 and 2014 Foreign Aid White Papers) consisted of the “Eight Principles of China’s Economic and Technical Aid” spelt out by Zhou Enlai in 1964 during an Africa tour, and the “Four Principles of Economic and Technical Cooperation” of 1984, spelt out by Zhao Ziyang, also during an Africa tour. This canon has now been expanded to include Xi Jinping thought (Art .5), namely “adhering to the correct approach to justice and interests” (坚持正确义利观). According to an essay by CIDCA’s new director Luo Zhaohui 罗照辉, published in the People’s Daily (人民日报) to commemorate the 70th anniversary of Chinese aid, Xi’s “correct approach to justice and interests” is as important a contribution to Chinese foreign aid as Zhou’s Eight Principles. The “correct approach to justice and interests” means “upholding justice while pursuing shared interests with giving priority to justice” (义利并举、以义为先). Official translations also sometimes translate 义 as “righteousness” and 利 as “benefit”. The concept was first brought up by Xi Jinping during his visit to Africa in March 2013 and is now named as a core principle of Xi’s thought on diplomacy. Official sources define it as: showing more consideration for the interests of poor countries; seeking mutual benefits rather than zero-sum games (which Chinese diplomats often accuse the US of); providing aid at the expense of their own interests when needed, and not shading their interests to China’s advantage.

In 2021, China is officially celebrating the 70th anniversary of its foreign assistance. On 5 July, the People’s Daily (人民日报) published an essay by CIDCA’s new director Luo Zhaohui 罗照辉, with the expressive title “Seven Decades of Foreign Aid. Braving Wind and Rain on Five Continents” (七十年援外路 五大洲风雨情). In there, Luo presents the new official narrative on the past and the future of Chinese aid. Before you read the translation below, here are 5 takeaways (and a bonus).

1. (Re)periodisation: Periodisation is an essential tool of Chinese official history writing. How something is periodised and judged, what is mentioned and not, says a lot about the current political line. In Luo’s essay, we see a new periodisation, which is quite different from the periodisation of the Hu/Wen era. Luo divides the history of Chinese foreign aid into three phases, which in a nutshell can be summarised as Mao-era, Xi-era and the rest. It goes:  

  • 1950-1978: From the founding of New China to the Reform and Opening-up foreign aid focused on political effects (政治效应) and culminated with the PRC assuming the China seat at the UN
  • 1978-2012: From Reform and Opening-up to the 18th Party Congress, foreign aid focused on economic effects and was constantly undergoing reform
  • Post-2012/18th Party Congress: In the New Era under Xi Jinping characterised by Xi’s ideas and guidance, innovation, continuous institutional improvement, expansion and proposing Chinese solutions to global challenges.

Though the “New Era” is so far the shortest, the respective section is longer than the others, implying that Xi’s contributions overweight what came before him. For comparison, previously, the periodisation in official documents (e.g. in the 2011 Chinese Foreign Aid White Paper (中国的对外援助. 白皮书)) or in academic and policy articles that discussed the official line (e.g. in Zhou Hong’s 周弘 2017 volume China’s Foreign Aid. 60 Years in Retrospect) was as following:

  • 1950-1978: The same as in Luo’s essay
  • 1978-the 1990s: From Reform and Opening-up on transition from politically motivated economic aid of the Mao Era to multi-form mutually beneficial cooperation
  • the 1990s-2004: From the market-oriented reforms of the 1990s to the beginning of the Hu/Wen era, which is the period when the “Grand Strategy of Industry and Trade” reforms under Minister of Trade Mme. Wu Yi 吴仪 in the mid-1990s started to link aid with trade and investment. The reforms were characterised by setting up foreign aid joint-ventures, the establishment of the Exim Bank, and the introduction of concessional loans as the main form of foreign aid (issued by the Exim Bank) – which they are till today.
  • foreign aid in the 21st Century/since 2004: A period of rapid development, with scale expansion (especially to Africa through the Forum on China-Africa Cooperation FOCAC), a rapid increase of foreign aid volumes, new focus on “people-centred” assistance (social projects and humanitarian aid) and institutional reforms.

Except for the Mao era, Luo’s essay merges everything else into one period. What could be the reason? See next point.

2.  The main characteristic of foreign aid in the New Era means “the political and the economic benefit each other” (政经相长). Luo writes that

During the Mao era, foreign aid had been under the personal oversight of Zhou Enlai, who was both the Premier the top diplomat. With the onset of the Reform and Opening-up period, foreign aid was transferred to the Department of Foreign Aid (对外援助司) within 1982 newly established Ministry of Foreign Economic Relations and Trade (对外经济贸易部) headed by Zhou’s protegée, Mme. Chen Muhua 陈慕华. Chen was an aid veteran; she had been in charge of Chinese aid Africa since 1961 and reporting directly to Zhou. Since then, foreign aid has always been under the roof of Chinese ministries in charge of foreign trade and since its establishment in 2003 under the Ministry of Commerce (MOFCOM 商务部). Their main line of thought was how to best use aid to support China’s own economic development, particularly the internationalisation of Chinese companies. For long, the Ministry of Foreign Affairs (MFA, 外交部) wanted to gain more control of foreign aid, which has also always been a strategic foreign policy tool.
Up to the Xi era, MOFCOM was on the winning side, in particular, because its ministers were promoted to the State Council and ranked higher than those held by former MFA ministers. This changed under Xi, giving MFA more power than it had ever before. In the foreign aid reform of 2018, MOFCOM lost the coordination of foreign aid. The new vice-ministry level China International Development Cooperation Agency CIDCA (国家国际发展合作署) incorporated MOFCOM’s Department of Foreign Aid took over all the aid coordination responsibilities from MOFCOM. The reform moved aid much closer to foreign policy. CIDCA reports to the State Council, and in there to Wang Yi 王毅, who also happens to be the Foreign Minister. Luo Zhaohui, who was appointed as CIDCA’s new director in April 2021, was previously the Vice-Minister of Foreign Affairs. He may have a new post, but he is still reporting to his old boss. Given all that, it is not surprising that in the new periodisation, the reforms put on track by trade and commerce ministers, including the introduction of concessional loans that remain the main form of Chinese aid till today, are kind of swept under the rug.
The New Era characteristic that “the political and the economic benefit each other” implies: first, that from MFA’s point of view, under the MOFCOM-led aid system, foreign aid benefit primarily the economic and not the political; and second, that foreign policy has won this round and now has a much stronger say in foreign aid than it had ever before. Nevertheless, the question remains how much influence the MFA has on the actual implementation. After all, the responsibility for implementing projects has remained with MOFCOM, which still sees it as its task to support the “going global” of Chinese companies.

3. There is a strong focus on the CCP: The Party visibly occupies a very central position in the text. The word “party” 党 alone is mentioned 21 times, and the essay is full of references between foreign aid and the Party:

We have always adhered to the centralised and unified leadership of the Party over foreign aid work.  Foreign aid work is the responsibility of the central government and a state act, therefore we must firmly uphold the centralised and unified leadership of the Party. Since its inception, China’s foreign aid has been carried out under the direct leadership of the Party. The Party’s leadership of foreign aid work has remained rock-solid despite several adjustments to the institutional mechanism. The new round of institutional reform of foreign aid embodies the Party’s centralised and unified leadership in the core of the foreign aid system

China’s foreign aid has inherited the essence of Chinese excellent traditional culture and has manifested the Chinese Communist Party’s global vision.
我国对外援助传承了中华优秀传统文化精髓, 彰显了中国共产党的世界情怀。

For comparison, the Party is not mentioned once in the 2011 Chinese Foreign Aid White Paper, and neither in the 2014 White Paper.

4. There is a strong focus on Xi Jinping:  The argumentative structure of Luo’s essay elevates Xi to the level of Mao Zedong in terms of ideological leadership and to Zhou Enlai in terms of contributions to foreign aid. The equation with Mao is clear from the re-periodisation discussion in point 1; Xi’s contributions in the New Era are described as following:

General Secretary Xi Jinping has put forward the idea of building a Community of Shared Future for Mankind and the “Belt and Road” Initiative, as well as such important concepts as the correct approach to justice and interests, and principles of sincerity, real results, affinity, and good faith [for developing relations with other developing countries] and the principles of amity, sincerity, mutual benefit, and inclusiveness [for expanding relations with neighbouring countries] to provide strategic guidance for foreign aid work in the new era.
习近平总书记胸怀天下、心系苍生,提出构建人类命运共同体思想、共建“一带一路”重大倡议,以及正确义利观、真实亲诚、亲诚惠容等重要理念,为新时代对外援助工作提供战略引领。

Xi’s equation with Zhou Enlai is clear from this passage:

In the 1960s, Premier Zhou Enlai announced the Eight Principles of Economic and Technical Foreign Aid, centring on equality and mutual benefit with no conditions attached. General Secretary Xi Jinping has put forward the correct approach to justice and interests.
上世纪60年代,周恩来总理宣布了以平等互利、绝不附带任何条件为核心的对外经济技术援助八项原则。习近平总书记提出正确义利观。

Zhou Enlai can be legitimately described as the father of Chinese foreign aid. His “Eight Principles of Economic and Technical Foreign Aid” (对外经济技术援助八项原则) have been the guiding principles of Chinese foreign aid since their proclamation during his Africa tour in 1964. It can be deduced from Luo’s essay, that according to the official line, Xi’s “correct approach to justice and interests” (正确义利观) is as important a contribution to Chinese foreign aid as Zhou’s Eight Principles. The “correct approach to justice and interests” means 义利并举、以义为先, upholding justice while pursuing shared interests with giving priority to justice. (Official translations also sometimes translate 义 as “righteousness” and 利 as “benefit”.) The concept was first brought up by Xi Jinping during his visit to Africa in March 2013 and is now named as a core principle of Xi’s thought on diplomacy. Official sources define it as: showing more consideration for the interests of poor countries; seeking mutual benefits rather than zero-sum games (which Chinese diplomats often accuse the US of); providing aid at the expense of their own interests when needed, and not shading their interests to China’s advantage.

5. Aid now, per definition, promotes “stability” (稳定): This point is probably noticeable only to someone who has read enough official texts to notice small differences. This one was like a stumbling block. In fact, Luo mentions “stability” only twice:

Our Party put the Marxist ideas of internationalism and humanitarianism into practice by using foreign aid to support economic development, social stability, and the improvement of the people’s living standards in recipient countries.

Foreign aid has contributed enormously to developing countries’ economic and social development and the world’s prosperity and stability.
援外极大促进了发展中国家经济社会发展和世界繁荣稳定

But, this line of foreign aid contributing to (social) stability in developing countries has not been in earlier White Papers or any important foreign aid texts. (If it was somewhere, and I missed it, please let me know.) Judging from more recent texts, stability in this context is clearly linked to regime stability or the absence of social unrest. I recommend reading Jerker Hellström’s entry on “Peace” in the Decoding China Dictionary for more context. Though not specifically part of foreign aid, China is exporting surveillance technologies through Huawei’s “Safe City” and ZTE’s “Smart City” projects, and there is a significant worry that the flipside of “stability” is negative repercussions for civil liberties

Bonus – There is what they call in cinema an Easter Egg: Despite the strong reorientation towards Xi Jinping and “the new era” (新时代), the past is still present in Chinese aid and in Luo’s article. Luo starts off with a Mao quote:

When the New China was just founded, comrade Mao Zedong proposed that “China should make a greater contribution to mankind.
新中国成立伊始,毛泽东同志就提出:“中国应当对于人类有较大的贡献。

What he does not mention is that Mao is referring here to the first president of the Republic of China, Sun Yat-sen, whom both the CCP and the Guomindang regard as the father of modern China. This quote originates from an essay written by Mao in 1956 to commemorate Sun Yatsen and is often used in the aid discourse to explain the philosophical roots of Chinese aid and China’s relations with developing countries. The whole passage goes:

In memory of the great revolutionary forerunner Dr. Sun Yat-sen!
To commemorate his great achievement in developing the “Three Principles of the People” […]
He left us a lot of useful things in political and ideological aspects.
[…] Being a country with 9.6 million square kilometres of land and 600 million people, China should make a greater contribution to mankind. In the past, we have contributed too little, and it makes us ashamed.
纪念伟大的革命先行者孙中山先生!
他在政治思想方面留给我们许多有益的东西。
[…] 中国是一个具有九百六十万平方公里土地和六万万人口的国家,中国应当对于人类有较大的贡献。而这种贡献,在过去一个长时期内,则是太少了。这使我们感到惭愧。

But why Sun Yat-sen? Because Sun’s 1918 book The International Development of China (which was only later translated into China as 实业计划) was, in the words of William Easterly, “the world’s first development plan”. China would receive international development assistance for its economic and industrial revolution in exchange for access to its natural resources. Sun failed to get support for his plan at the League of Nations at the 1919 Paris Peace Conference, but his ideas of mutually beneficial aid and technocratic development are still the core of Chinese aid thinking.


Seven Decades of Foreign Aid – Braving Wind and Rain on Five Continents (People’s Daily, 5 July 2021, p. 12)

China’s foreign aid is a concrete embodiment of the sinicization of Marxist internationalist ideology, a great practice of the CCP’s original aspiration and founding mission in the cause of human progress, and the epochal interpretation of the traditional Chinese culture’s concepts of great harmony of everything under heaven. When the New China was just founded, comrade Mao Zedong proposed that “China should make a greater contribution to mankind.” General Secretary Xi Jinping stressed, “The CCP is a political party that strives for the happiness of the Chinese people and fights for the cause of human progress.”

China’s foreign aid has gone through a glorious history of more than 70 years and is an important chapter in the CCP’s century-long glory. Especially since the 18th Party Congress, China’s foreign aid has ushered in a new era and has assumed a new role.

Presently, the COVID-19 epidemic is still raging, virus mutations are accelerating, the vaccine gap is growing, the global economy is struggling to recover, and economic inequality is widening. More than ever, the world needs to support each other to jointly respond to these challenges.

China has bravely stepped up the challenge. Under the personal command and deployment of General Secretary Xi Jinping, China has taken the lead both in the fight against the epidemic and in economic recovery, while at the same time carrying out emergency humanitarian operations in the shortest time and in the broadest scope since the founding of New China.

This operation can be divided into two halves. Last year, China provided 150 countries and 13 international organisations with large quantities of equipment to fight the COVID-19 pandemic such as masks, protective clothing and respirators, and sent 37 teams of medical experts to 34 countries, organising nearly 1,000 sessions of technical guidance and sharing China’s experience in fighting the pandemic. This is the first half of our assistance, which focuses on the provision of materials and the exchange of experience in fighting the pandemic. This year, we have resolutely implemented General Secretary Xi Jinping’s commitment to make vaccines a global public good, and have started the second half of the operation, which focuses on vaccine assistance. Despite its own huge demand and a tight supply of vaccines, China has, to the best of its ability, supplied more than 480 million vaccine doses to nearly 100 countries and many international organisations, making China the largest supplier of vaccines in the world. Since the end of April, the epidemic in South Asia has once again become an emergency. China promptly launched the “Emergency Support Plan for South Asia against the Pandemic”, making use of both “halves” of its approach and providing both equipment and vaccines.

This large-scale aid to combat the epidemic is still ongoing. By putting the idea of a Global Community of Health for All into practice, China has demonstrated the unique advantages of the socialist system with Chinese characteristics, in sharp contrast to the cold response of some Western countries to the evolving crisis in other countries.

Looking back at history, even when we were not well-off, we provided a lot of aid. To date, we have provided all kinds of assistance to more than 160 developing countries, implemented thousands of turn-key and material assistance projects, carried out tens of thousands of technical cooperation and human resources development cooperation projects, and trained more than 400,000 people. 70 years of foreign aid can be roughly divided into three periods.

From the founding of New China to the Reform and Opening-up period (1950-1978), foreign aid started quickly and with great investment, focusing on political effects. The New China started to give foreign aid shortly after its founding, first to neighbouring socialist countries such as Vietnam and North Korea, and gradually expanding to support national liberation movements in many countries in Asia, Africa and Latin America. The forms of aid ranged from the provision of goods to the construction of productive projects; all used to support the development of the national economies of the recipient countries. The Tanzania-Zambia Railway and the Karakorum Highway have become iconic symbols of Chinese aid. In the wake of the profound adjustment of the Sino-American-Soviet triangle,  Comrade Mao Zedong put forth the “Three Worlds” theory, and the investment in foreign aid reached a new high, particularly in 1971 when the African brothers helped China recover its rightful seat in the United Nations. Our Party put the Marxist ideas of internationalism and humanitarianism into practice by using foreign aid to support economic development, social stability, and the improvement of the people’s living standards in recipient countries. At the same time, foreign aid also helped China break the Western blockade, expand its circle of friends and raise its international influence and status.

During the period from Reform and Opening-up to the 18th Party Congress (1978-2012), foreign aid underwent substantive reforms focused on economic effects. Our Party correctly determined that peace and development were the themes of the times, and the core mission of the Party and the State shifted to economic construction. Foreign aid work underwent major adjustments and shifted from the assistance to the construction of productive projects towards constructing landmark buildings such as stadiums and parliament buildings. Later, optimisation and adjustment were continued with a focus on the long-term effectiveness of projects and the diversification of project types, forms of financing and means of assistance, all while placing greater emphasis on equality and mutual benefit and using aid to facilitate trade. During this period, foreign aid has contributed enormously to developing countries’ economic and social development and the world’s prosperity and stability. At the same time, foreign aid created a strong impetus for Chinese enterprises to go global, playing a profound role in China’s reform and opening-up process, and deepened China’s political and economic cooperation with other developing countries.

Since the 18th Party Congress, foreign aid work has entered a new era. Top-level design and strategic planning have been strengthened so that the political and the economic benefit each other, domestic and external goals benefit, and bilateral and multilateral initiatives are developed simultaneously. In terms of concepts, there has been constant innovation: Keeping the whole world in his mind and the common people in his heart, General Secretary Xi Jinping put forward the idea of building a Community of Shared Future for Mankind and the “Belt and Road” Initiative, as well as such important concepts as the correct approach to justice and interests, and principles of sincerity, real results, affinity, and good faith [for developing relations with other developing countries] and the principles of amity, sincerity, mutual benefit, and inclusiveness [for expanding relations with neighbouring countries] to provide strategic guidance for foreign aid work in the new era. In terms of institutional mechanisms, there has been a continuous improvement: Particularly, the establishment of the China Agency for International Development Cooperation (CIDCA) in 2018, as an agency directly under the State Council, has further strengthened the unified management and coordination of foreign aid work, providing important institutional safeguards to promote the quality and upgrading of international development cooperation. In terms of dimensions, there has been constant expansion: While focusing on serving head-of-state diplomacy, complementing major foreign policy strategies and the BRI, and promoting bilateral aid, foreign aid work has held high the banner of multilateralism and accelerated the transformation to international development cooperation. At several UN summits and other multilateral occasions, General Secretary Xi Jinping announced a number of major initiatives, including establishing the South-South Cooperation Assistance Fund and the Academy for South-South Cooperation and Development. China has proposed Chinese solutions and contributed Chinese strength to promote the implementation of the UN 2030 Agenda for Sustainable Development and solve global development challenges.

Foreign aid has made significant achievements and accumulated valuable experience over the past 70 years.

First, we have always adhered to the centralised and unified leadership of the Party over foreign aid work. Foreign aid work is the responsibility of the central government and a state act, therefore we must firmly uphold the centralised and unified leadership of the Party. Since its inception, China’s foreign aid has been carried out under the direct leadership of the Party. The Party’s leadership of foreign aid work has remained rock-solid despite several adjustments to the institutional mechanism. The new round of institutional reform of foreign aid embodies the Party’s centralised and unified leadership in the core of the foreign aid system and mechanism, and runs through the whole chain of foreign aid management, providing a strong political guarantee for foreign aid work in the new era.

Second, we have always adhered to the core mission of serving the Party and the State. At different stages of history, foreign aid work has always been subordinated to the Party and the State’s overall external strategy and has always fought on the front line of external relations. Foreign aid work has been unceasingly practised, explored, and innovated according to the changes in the domestic and external situation. From focusing on politics, stressing the economy, and the political and the economic benefitting each other, we have timely adjusted the investment of resources and continuously optimised the approach to foreign aid. It has played an irreplaceable and important role in the smooth progress of the core work of the Party and the State.

Third, we have always adhered to the path of foreign aid with Chinese characteristics. China’s foreign aid has inherited the essence of Chinese excellent traditional culture and has manifested the Chinese Communist Party’s global vision. In the 1960s, Premier Zhou Enlai announced the Eight Principles of Economic and Technical Foreign Aid, centring on equality and mutual benefit with no conditions attached. General Secretary Xi Jinping has put forward the correct approach to justice and interests. We uphold both justice and interests but give priority to justice. What we show are friendship and trust, and what we seek are cooperation and mutual benefit.

Fourth, we have always adhered to the concept of people-centred development. We have prioritised the people’s livelihood, putting the eradication of hunger and poverty at the top of our agenda, and putting great effort into increasing the sense of gain among ordinary people [literally: people at the grass-roots level] in recipient countries. Our foreign aid is a mutual help among friends. It not only actively promotes the improvement of people’s livelihood and economic development in recipient countries but also creates a favourable external environment for our development and people’s happiness, which also reflects the saying that “Giving roses to others leaves a fragrance in your hand”.

Seventy years of being combed by the wind and washed by the rain, seventy years of forging ahead. Looking back at history, we feel deeply proud. Looking ahead, we remain true to our original aspirations. In the next step, we will devote ourselves to promoting South-South cooperation. Taking the people’s livelihood as the priority, [our aid] will closely align with our position as a developing country. We will adhere to the character of South-South Cooperation, focusing on development, “teaching people how to fish”, joining hands to respond to global challenges, embodying great power responsibility and manners, keeping our promises, and doing the best we can within our means. We will devote our efforts to building a Global Community of Health for All. Taking health as a priority, we will fully support international cooperation against COVID-19, we will continue to provide assistance with equipment needed to fight the pandemic and vaccines. We will help affected countries improve their public health systems through assistance in building infrastructure, providing medical equipment and strengthening personnel training. We will devote our efforts to building a Community of Life for Man and Nature. We will focus on green [development], help developing countries build hydropower, photovoltaic and other clean energy projects, share our experience in green development, build the “Green Silk Road”, and help recipient countries build resource-saving and environment-friendly societies. We are committed to improving global governance in the field of development. We will firmly uphold the international system with the United Nations at its core, actively participate in the reform and construction of the global governance system, be open and inclusive, engage in exchanges and mutual learning, and work with others to help developing countries strengthen their weak links and remove bottlenecks in their development.

In his important speech at a ceremony marking the centenary of the Chinese Communist Party, General Secretary Xi Jinping emphasised that we must continuously push for the construction of a Community of Shared Future for Mankind and put forward that China’s new development will provide new opportunities for the world. In the new era, China’s foreign aid and international development cooperation will inherit its fine traditions. We will be bold and innovative, be bold and innovative and unite the fundamental interests of the Chinese people with the long-term interests of human society. We will achieve common development through positive interactions between China and the rest of the world, make new contributions to promoting the building of a Community of Shared Future for Mankind and realising the great renaissance of the Chinese nation.

中国对外援助是马克思国际主义思想中国化的具体体现,是中国共产党初心使命在人类进步事业中的伟大实践,是中国传统文化天下大同理念的时代诠释。新中国成立伊始,毛泽东同志就提出:“中国应当对于人类有较大的贡献。” 习近平总书记强调:“中国共产党是为中国人民谋幸福的政党,也是为人类进步事业而奋斗的政党。”

中国对外援助已走过70多年光辉历程,是中国共产党百年辉煌的重要篇章。特别是党的十 八大以来,中国对外援助迎来新气象,展现新作为。

当前,新冠肺炎疫情仍在肆虐,病毒变异加快,疫苗鸿沟加剧,全球经济复苏步履维艰, 贫富差距进一步拉大。世界比任何时候都需要相互扶持,共克时艰。

中国挺身而出。在习近平总书记亲自指挥、亲自部署下,我国取得抗疫斗争和经济恢复双 领先,同时开展了新中国成立以来援助时间最集中、涉及范围最广的紧急人道主义行动。

这次行动可分两个“半场”。去年,我国先后向150个国家和13个国际组织提供口罩、防护 服、呼吸机等大批防疫物资,向34个国家派出37支医疗专家组,组织开展近千场技术指导,分享我国抗疫经验。这是以抗疫物资和经验交流为主的援助“上半场”。今年以来,我们坚决落实习近平总书记关于将疫苗作为全球公共产品的承诺,开启了以疫苗援助为主的“下半场”。我国在自身需求巨大、疫苗供应紧张的情况下,尽己所能迄今向近100个国家和多个国际组织供应 4.8亿余剂疫苗,是世界上对外提供疫苗最多的国家。多国政要出席交接仪式并带头接种,媒体 广泛报道,形象地将中国疫苗称为“及时雨”。4月底以来,南亚疫情再度告急。我国及时启动 “南亚抗疫紧急支持计划”,上下“半场”并进,物资和疫苗同援。

此次大规模抗疫援助仍在进行中。我国以行动践行人类卫生健康共同体理念,彰显了中国特色社会主义制度的独特优势,与某些西方国家冷对他国危难形成鲜明对比。

回望历史,在我们还不富裕的时候,同样对外提供了大量援助。迄今我们共向160多个发展中国家提供各类援助,实施了数千个成套和物资援助项目,开展了上万个技术合作和人力资源开发合作项目,培训各类人员40多万人次。70年对外援助大致分为三个阶段。

新中国成立至改革开放阶段(1950—1978年),援外起步快,投入大,聚焦政治效应。新中国成立伊始,即同步开展对外援助,首先从越南、朝鲜等周边社会主义国家起步,逐步拓展至支持亚非拉等多国民族解放运动。援助方式从提供物资,到援建生产性项目,支持受援国发展民族经济。坦赞铁路、喀喇昆仑公路已成为中国援助的标志性符号。随着中美苏大三角关系深刻调整,毛泽东同志提出“三个世界”理论,特别是1971年非洲兄弟力助我国恢复联合国合法 席位,援外投入达到新高。我们党践行马克思国际主义和人道主义思想,以援外支持受援国经济发展,社会稳定,人民生活水平提高,同时也助力我国打破西方封锁,扩大朋友圈,提升国际影响力和地位。改革开放至党的十八大阶段(1978—2012年),援外改革力度大,注重经济效应。我们党准确判断和平与发展是时代主题,党和国家中心工作转向经济建设。援外工作作出重大调整, 从援建生产性项目,转向建设体育馆、议会大厦等标志性建筑。之后持续优化调整,注重项目长远效果,丰富项目类型、资金手段、援助方式,同时更加注重平等互利,以援促贸。此期援外极大促进了发展中国家经济社会发展和世界繁荣稳定,同时有力带动了我国企业走出去,深度参与了我国改革开放进程,深化了我国同广大发展中国家的政经合作。

党的十八大以来,援外工作进入新时代,加大顶层设计和战略谋划,政经相长,内外兼济,双多边并举。理念上持续创新,习近平总书记胸怀天下、心系苍生,提出构建人类命运共同体思想、共建“一带一路”重大倡议,以及正确义利观、真实亲诚、亲诚惠容等重要理念,为新时代对外援助工作提供战略引领;机制上日臻完善,特别是2018年国家国际发展合作署组建成立,作为国务院直属机构,进一步加强援外工作的统一管理和统筹协调,为促进国际发展合作提质升级提供了重要机制保障;维度上不断拓展,在聚焦服务元首外交、配合重大对外战略及共建“一带一路”、推进双边援助的同时,援外工作高举多边主义旗帜,加快向国际发展合作转型。习近平总书记在联合国系列峰会等多边场合,宣布一系列重大举措,包括设立南南合作援助基金,成立南南合作与发展学院,为推动落实联合国2030年可持续发展议程,破解全球发 展难题,提出中国方案、注入中国力量。

对外援助70年取得重大成就,积累了宝贵经验。

一是始终坚持党对援外工作的集中统一领导。援外工作是中央事权、国家行为,必须坚决维护党的集中统一领导。我国对外援助从诞生之日起,就在党的直接领导下开展。援外体制机制几经调整,党对援外工作的领导坚如磐石。新一轮援外机构改革,将党的集中统一领导体现于援外体制机制的核心环节,贯穿于援外管理的全链条全过程,为新时代援外工作提供了坚强 政治保障。

二是始终坚持服务党和国家的中心工作。在不同历史阶段,援外工作始终服从服务于党和 国家对外战略全局,坚持战斗在对外工作第一线。援外工作根据国内外形势变化,不断实践、 探索、创新,从聚焦政治,到突出经济,再到政经相长,及时调整资源投向,持续优化援外方式,为党和国家中心工作的顺利推进,发挥了不可替代的重要作用。

三是始终坚持走中国特色的对外援助之路。我国对外援助传承了中华优秀传统文化精髓, 彰显了中国共产党的世界情怀。上世纪60年代,周恩来总理宣布了以平等互利、绝不附带任何条件为核心的对外经济技术援助八项原则。习近平总书记提出正确义利观。我们秉持义利并举、以义为先,展示的是友谊与信任,谋求的是合作与共赢。

四是始终坚持以人民为中心的发展理念。我们坚持民生优先,把消除饥饿和贫困放在首位,着力提升受援国基层民众的获得感。我国对外援助是朋友之间的相互帮助,既积极促进受援国民生改善、经济发展,也为我国发展、人民幸福创造了良好的外部环境,这也体现了“赠人玫瑰、手留余香”。

70年栉风沐雨,70年砥砺前行。追忆历史,我们深感自豪。展望未来,我们初心不改。下 一步,我们将致力于推进南南合作。以民生为要旨,紧扣发展中国家定位,坚持南南合作属性,聚焦发展,授人以渔,携手应对全球性挑战,体现大国责任和风范,重信守诺,量力而行,尽力而为;我们将致力于打造人类卫生健康共同体。以健康为优先,全力支持抗疫国际合作,继续提供抗疫物资援助和疫苗援助,通过援建基础设施、提供诊疗设备、加强人员培训等手段,帮助有关国家完善公共卫生治理体系建设;我们将致力于构建人与自然生命共同体。以绿色为重点,帮助发展中国家建设水电、光伏等清洁能源项目,分享绿色发展经验,共建“绿色丝绸之路”,帮助受援国建立资源节约型和环境友好型社会;我们将致力于完善发展领域全球治理。坚定维护以联合国为核心的国际体系,积极参与全球治理体系改革与建设,开放包容,交流互鉴,共同帮助发展中国家补齐发展短板、破除发展瓶颈。

They will replace the 2016 Measures issued by the Ministry of Commerce.

The new Measures clearly indicate that the Chinese government wants to increase the visibility of Chinese aid projects. Compared to 2016, the use range of use of the foreign aid logo was expanded and will now include medical equipment and medical teams, South-South Cooperation Fund funded projects and projects funded through concessional loans:

Therefore, it’s worth to take a closer look at what he said.

The new era puts forward new requirements, and foreign needs to take on new responsibilities. Under the guidance of the diplomatic thought of Xi Jinping, CIDCA will serve great power diplomacy with Chinese characteristics (中国特色大国外交)  and the construction of “Belt and Road” (“一带一路”建设). It will carry on the glorious tradition of China’s foreign aid to show the Chinese people’s sense of justice and compassion to the international community. We will also work together with other countries and international organizations to implement the UN 2030 Agenda for Sustainable Development and to actively contribute to building a community of shared future for mankind.

At the same time, we have to bear in mind that China is still a developing country. There are development gaps between urban and rural areas. We still have a long way to go in developing and improving the people’s livelihoods. Therefore, we have always emphasized that China’s foreign aid still falls under South-South Cooperation. Therefore, we have always upheld the important principles of giving aid according to our abilities and doing the best we can.  Therefore, please be assured that we’re calculating very carefully and work with a strict budget, making sure that every fen is spent well (确保花好每一分钱).

新时代提出新要求,援外工作要有新担当、新作为,我们将以习近平外交思想为指导,服务好中国特色大国外交和“一带一路”建设,继承中国对外援助的光荣传统,把中国人民的正义感和同情心展示给国际社会,把中国人民雪中送炭、扶危济困的形象展示给国际社会。我们也将和世界各国、和国际组织共同努力,为落实联合国2030年可持续发展议程,构建人类命运共同体做出积极贡献。

What can we learn from this interview?

First, Wang clearly puts foreign aid into a foreign policy context. Under Xi Jinping, aid shall serve China’s great power diplomacy and the construction of “Belt and Road”. After 1978, political motives lost importance in China’s foreign aid policy as compared to economic motives. Question is, are we seeing things reverse now?  While this is yet difficult to say, it is noteworthy that on the sub-page “Leader’s activities” (领导人活动) on CIDCA’S homepage, the person that is mentioned most often after President Xi Jinping is the State Councilor and Foreign Minister Wang Yi 王毅 – followed by Yang Jiechi 杨洁篪 who is the director of the Office of the Foreign Affairs Commission of the CPC Central Committee (中央外事工作委员会办公室).

Second, Wang expresses CIDCA’s willingness, to work together (共同努力) with other countries and international organizations to achieve SDGs. But, what could “work together” mean practically? This is an important question to ask because so far, the institutional mandate for cooperation with international organizations and bilateral donor agencies has still remained with the Ministry of Commerce (MOFCOM) – that was in charge of aid management before establishment of CIDCA. Nevertheless, for those who are thinking of joint projects with CIDCA, SDGs could be a docking point.

Third, Wang emphasizes that China is still being a developing country and Chinese aid a form of South-South Cooperation. This is a signal to all those who were wondering whether CIDCA’s establishment could be interpreted as a step towards OECD DAC standards or even China joining the DAC. The answer is clearly no. There may be several reasons to this renewed rejection. On the one hand, giving up the status of a “developing country” would weaken China’s political position globally, since China describes itself as the “largest developing country” and therefore the leading voice of “developing countries”. On the other hand, complying to international standards would make Chinese aid and development finance, particularly in the infrastructure sector, more expensive. But there may be a third, equally practical reason: the Chinese aid bureaucracy still lack the necessary amount of qualified aid professionals who could ensure that standards are maintained. While CIDCA pooled the aid staff from MOFCOM and MFA, there has been no significant increase in staff numbers. 

The last point of Wang’s interview is about aid funds. His quote, “Chinese aid will make sure that every fen is spent well” (中国对外援助要确保花好每一分钱), has been used as a headline by some media outlets who reported about the interview. How to interpret it? Clearly, here Wang addresses the Chinese public that is largely critical of China’s aid spending. It is rather common to read in Chinese online fora statements like “Why are we wasting money in Africa on shiny infrastructure projects when we have so much poverty at home?”

What is CIDCA’s mandate compared to MOFCOM’s previous mandate?
CIDCA’s mandate goes beyond MOFCOM mandate. In contrast to MOFCOM previously, it will be also in charge of developing aid strategies, drafting aid laws and doing aid related research (though it is no clear whether this will be done by CIDCA itself or whether it will be subcontracted). Another major difference is that CIDCA will be in charge of drafting country strategies, aid project evaluation and policy reviews.

2. Are CIDCA’s draft “Administrative Measures for Foreign Aid” the new aid law?
No, they aren’t. As the name says, these are Measures (banfa 办法) and not a Law (falü 法律). Measures are departmental regulations. This means that they will govern CIDCA’s internal operations, but they won’t apply to the work of other ministries. However, the draft Measures stipulate that CIDCA will be in charge of drafting a new aid law.

3. What about a new system for aid statistics?
According to Art. 38 of the draft measures, CIDCA “shall set up fully-covered statistical rules for foreign aid, and collect, summarize and prepare statistical data on foreign aid.” But this, in fact, is not a new development. MOFCOM previously had the same task, it was stipulated in MOFCOM’s 2014 Aid Measures in Art. 6. It’s not clear how successful MOFCOM actually was in implementing this task.

3. Will CIDCA be also responsible for the South-South Cooperation Fund?
As of now, the information is that China International Center For Economic And Technical Exchanges (CICETE) will be in charge of screening the proposals for the South-South Cooperation Fund. Some analysts say that CICETE will be taking over more tasks for CIDCA in the future.

4. Where can I get information on the priority sectors and geographical distribution of Chinese aid?
The most recent official Chinese figures are provided in China’s Foreign Aid White Paper from 2014, and cover the years 2010-2012. Earlier Chinese figures can be found in the 2011 White Paper. A new White Paper is expected for 2019. For figures up-till 2014 and also for more dis-aggregated numbers, you can consult the Aiddata project’s Global Chinese Development Finance Dataset. It’s based on data mining from openly available sources and is a highly valuable resource in light of absence of transparent official numbers from the Chinese government.

5. How much of Chinese aid is comparable to ODA according to OECD DAC standards?
About one third. One a small proportion of Chinese aid are grants. The majority are interest free and concessional loans. But only around one third of concessional loans meet DAC ODA criteria (>= 25% grant element). The rest is still below market rate but doesn’t meet DAC ODA criteria.

6. Do CIDCA’s Aid Measures say anything about aid standards? Is there any sign of China looking into adapting international aid standards?
The Measures don’t mention aid standards. In reality, China works simultaneously with two sets of systems. China-led multilateral institutions such as AIIB work on the basis on international standards (in AIIB, this was the prerequisite for European partners to join). China’s bilateral development cooperation works on the basis of partner/recipient country standards.

7. Will CIDCA be also responsible for multilateral development finance?
There are no indications of that. Ministry of Finance has been traditionally responsible for cooperation with IMF, World Bank and other multilateral banks and it doesn’t look like this is going to change.

8. According to Art. 4, China’s aid shall usher in a new type of international relations featuring win-win cooperation, 5 and promote the building of a community of common destiny.  What is the “new type of international relations”?
The concept of “new type of international relations” and “win-win cooperation” are not aid specific, but have been successively introduced by Xi Jinping as pillars of China’s foreign policy (though “win-win” has been a guiding principle of Chinese aid since mid 1950s). Like many political concepts in China they are not clearly defined. An official explanation by China’s foreign minister Wang Yi can be found here. But what this does say, is that China’s government sees aid as a foreign policy tool and something to be used to promote China’s international agenda (though this is not unique to China).

Art. 5 Foreign aid shall be put under centralized management of China’s Agency for Development and International Cooperation (hereinafter referred to as CIDCA). [CIDCA] shall be responsible for drafting of foreign aid strategies, plans and policies; drafting foreign aid laws and regulations, and departmental rules; planning and coordinating major foreign aid questions and giving suggestions; planning and coordinating foreign aid and humanitarian emergency assistance; researching and advancing reform of foreign aid modes, researching measured for reform measures promoting their implementation; compiling foreign aid programs and plans, compiling annual budgets and final accounts for foreign aid projects; ensuring implementation of foreign aid projects, as well as supervising and evaluating foreign aid projects; organizing the carrying out of international exchange and cooperation on foreign aid.
各相关部门(以下统称各援外执行部门)按分工承担对外援助的具体执行工作。 All relevant departments (hereinafter referred to as “aid implementing departments”) shall undertake the concrete execution of foreign aid work on the basis of divided responsibilities.
驻外使领馆(团)协助国际发展合作署办理与对外援助有关的政府事务,与受援方沟通援助需求并进行政策审核,负责援外项目实施的境外监督管理。 Chinese embassies and consulates shall assist CIDCA in handling foreign aid related intergovernmental affairs, communicate with recipients about their aid needs and conduct policy reviews, and be responsible for on-the-ground supervision and administration of the execution of foreign aid projects.
第六条 国际发展合作署会同有关部门建立对外援助部际协调机制,统筹协调对外援助重大问题。 Art. 6 CIDCA shall, in conjunction with relevant departments, establish an interdepartmental aid coordination mechanism in order to plan and coordinate major foreign aid issues.
第七条 国际发展合作署制定统一的对外援助标识,负责标识使用的监督管理。 Art. 7 CIDCA shall establish a unified foreign aid logo, and shall be responsible for the supervision and administration of its use.
第二章 对外援助政策规划 Chapter II Planning of Foreign Aid Policies
第八条 国际发展合作署负责对外援助的顶层设计,拟订对外援助的战略方针,经批准后执行。 Art. 8 CIDCA shall be responsible for the top-level design of foreign aid, drafting of foreign aid strategies, and implement them upon approval.
8 第九条 国际发展合作署负责制定对外援助中长期政策规划,经批准后执行。 Art. 9 CIDCA shall be responsible for preparing medium and long-term foreign aid policy plans, and execute them upon approval.
第十条 国际发展合作署会同有关部门制定分国别援助政策,作为对外提供援助的主要政策依据。 Art. 10 CIDCA shall, in conjunction with relevant departments, formulate country-specific aid policies, that shall serve as the main policy basis for foreign aid provision.
第十一条 国际发展合作署拟订对外援助年度计划和总体方案,经批准后实施。 Art. 11 CIDCA shall draft foreign aid annual plans and overall programs, and implement them upon approval.
第十二条 国际发展合作署研究对外援助方式的改革措施,并推动改革措施落实。 Art. 12 CIDCA shall conduct research on steps for the reform of foreign aid modes, and drive the practical implementation of those report steps.
第十三条 国际发展合作署制定统一的对外援助管理制度。 Art. 13 CIDCA shall draw up a unified foreign aid management system.
第十四条 国际发展合作署负责拟订对外援助协议,与受援方进行谈判,以中国政府名义签署提供援助的协议。 Art. 14 CIDCA shall be responsible for drawing up foreign aid agreements, conduct negotiations with recipient countries, and sign agreements in the name of the Chinese government.
第十五条 国际发展合作署制定对外援助国际交流合作政策,与其他国家或国际组织开展援助交流合作,代表中国政府参与发展领域的政策对话和沟通。 Art. 15 CIDCA shall formulate a policy for international exchange and cooperation on foreign aid, conduct aid exchange and cooperation with other countries and international organizations, and participate in development policy dialogues and communicate on behalf of the Chinese government.
第三章 对外援助资金管理 Chapter 3: Management of Foreign Aid Funds
第十六条 国际发展合作署归口管理对外援助资金规模和使用方向。 Art. 16 The management of foreign aid funds scope and use shall be put under centralized management of CIDCA.
12 第十七条 对外援助资金主要包括无偿援助、无息贷款和优惠贷款三种类型。 Art. 17 Foreign aid funds shall mainly include the three types, grant aid, interest-free loans and concessional loans.
无偿援助主要用于受援方在减贫、民生、社会福利、公共服务以及人道主义等方面的援助需求。 Grant aid shall be mainly used for aid recipients’ needs in areas such as poverty reduction, livelihood, social welfare, public services and humanitarian issues.
无息贷款主要用于受援方在公共基础设施和工农业生产等方面的援助需求。 Interest-free loans shall be mainly used for aid recipients’ needs in areas such as public infrastructure or industrial and agricultural production.
优惠贷款主要用于支持受援方有经济效益的生产型项目、资源能源开发项目、较大规模的基础设施建设、提供大宗机电产品和成套设备。 Concessional loans shall be mainly used for supporting aid recipients’ economically efficient productive projects, resource and energy exploration projects, large-scale infrastructure construction, and for provision of large quantities quantity of mechanical and electrical products and complete equipment.
第十八条 国际发展合作署会同有关部门和机构设立南南合作基金等具有援助性质的基金,并负责管理和使用基金。 Art. 18 CIDCA shall, in conjunction with relevant departments and agencies, set up South-South Cooperation and similar funds with aid characteristics; and shall be responsible for the management and the use of funds.
第十九条 国际发展合作署负责统筹编制对外援助项目年度预决算,会同财政部按照财政预算相关规定制定援外项目预算管理制度。 Art. 19 CIDCA shall be responsible for planning and compilation of the annual budget and final accounts of foreign aid projects; and shall, in conjunction with Ministry of Finance, set up a foreign aid project budget management system in accordance with relevant budget regulations.
国际发展合作署和各援外执行部门负责管理本部门对外援助资金,编制本部门执行对外援助项目的年度预决算。 CIDCA and all aid executing departments shall be responsible for the management of their foreign aid funds, and prepare annual budgets and final accounts for foreign aid projects executed by those departments.
34 第二十条 援外资金应当专款专用、单独核算,任何单位和个人不得挪作他用。 Art. 20 Foreign aid funds shall be used for designated purposes only, and be subject to separate accounting. No entity or individual shall misappropriate the funds.
第四章 对外援助实施管理 Chapter 3: Implementation Management of Foreign Aid Projects
14 第二十一条 对外援助以项目援助实施为主。 Art. 21 Foreign aid shall mainly be implemented in form of project aid.
在对外紧急人道主义援助等特殊情况下,可向受援方提供现汇援助。 Humanitarian aid or [aid] in other exceptional circumstances may be provided as cash assistance.
15 第二十二条 援外项目主要包括以下类型: Art. 22 Foreign-aid projects shall be mainly provided in the following forms:
(一)成套项目,即通过组织或指导施工、安装和试生产全过程或其中部分阶段,向受援方提供生产生活、公共服务等成套设备和工程设施,并提供建成长效质量保证和配套技术服务的项目; (1) Complete projects, i.e, through organizing and guiding a complete process or parts of the process of construction, installation and trial production, providing aid recipients with complete equipment and project facilities for areas such as production and living, or public services, as well as providing long-term quality assurance and technical service support.
(二)物资项目,即向受援方提供一般生产生活物资、技术性产品或单项设备,并承担必要配套技术服务的项目; (2) Material projects, i.e. providing aid recipients with ordinary materials for production and living, technical products or single equipment, and undertaking of necessary supporting technical services.
(三)技术援助项目,即综合采用选派专家、技术工人或提供设备等手段帮助受援方实现某一特定技术目标的项目; (3) Technical assistance projects, i.e. comprehensively employing such means as selecting experts and technicians and providing equipment to assist the aid recipient in realizing certain technical objectives.
(四)人力资源开发合作项目,即为受援方人员提供各种形式的学历学位教育、研修培训、人员交流、高级专家服务,以及选派志愿人员到受授方从事公益性服务等项目。 (4) Human resource development and cooperation projects, i.e. providing aid recipients with various forms of academic and degree education, advanced studies and training, personnel exchange and senior expert service; as well as selection of volunteers to provide public services in aid recipient countries.
第二十三条 国际发展合作署制定对外援助项目立项管理办法。对外援助项目应当按办法确定,并按程序批准立项。 Art. 23 CIDCA shall formulate measures for the administration of approval and initiation of aid projects. Decision on foreign aid project shall be made on the basis of the measures, and initiation of projects shall be approved and initiated according to procedures.
19 第二十四条 援外项目立项后,国际发展合作署一般应与受援方商签政府间立项协议。 Art. 24 After a Foreign aid project is approved, CIDCA shall generally sign an intergovernmental project establishment agreement with the aid recipient.
22 第二十五条 各援外执行部门依据立项批准内容组织实施援外项目,对援外项目的安全、质量、功能、进度、资金使用等方面进行监管。 Art. 25 All aid executing departments shall organize the implementation of aid projects according to the approved project description, and supervise the aid projects’ safety, quality, functions, process, fund use etc.
第二十六条 对于地方具有区位、人文、人脉、产业优势的援外项目,国际发展合作署可与地方人民政府合作实施。 Art. 26 On the implementation of aid projects which possess geographical, cultural, people or industrial advantage, CIDCA can cooperate with local people’s governments.
23 第二十七条 援外项目可以由中方负责实施、可以由中方与受援方合作实施,也可以由受援方自主实施。 Art. 27 Foreign aid projects can be implemented by the Chinese party, or by Chinese party and recipient party in joint cooperation, or independently by the recipient party.[6]
26 第二十八条 援外项目由中方负责实施的,各援外执行部门负责依法通过竞争性方式选定具体项目实施主体。 Art. 28 If the Chinese side bears the responsibility for the implementation of a foreign aid project, all aid executing departments shall be responsible for selecting the specific party to implement the project according to the law and through competitive bidding.
27 第二十九条 援外项目中方实施主体不得将所承担的任务转包或违法分包。 Art. 29 Chinese parties implementing foreign aid projects may not assign or illegally subcontract its responsibilities.
28 第三十条 对于无偿援助和无息贷款项下的援助项目,各援外执行部门一般应与受援方商签援外项目实施协议,明确规定援外项目实施的具体事宜和双方权利义务。 Art. 30 If the aid project is classified as grant aid or interest free loan, generally each aid executing department shall sign a foreign aid project implementation agreement with the aid recipient. [The agreement] shall specify detailed arrangements for the implementation of the foreign aid project as well as rights and obligation of both sides.
29 第三十一条 对于无偿援助和无息贷款项下的援助项目,各援外执行部门一般应与实施主体商签援外项目实施合同,明确规定援外项目组织实施的具体事宜和双方权利义务。 Art. 31 If the aid project is classified as grant aid or interest free loan, generally each aid executing department shall sign a foreign aid project implementation contract with the implementing body. [The contract] shall specify detailed arrangements for the organization and implementation of the foreign aid project as well as rights and obligation of both sides.
30 第三十二条 国际发展合作署会同国务院有关部门建立对外援助出口物资口岸验放机制 Art. 32 CIDCA shall, in conjunction with relevant departments under the State Council, establish a mechanism for port inspection and release of export materials for foreign aid.
31 除涉及两用物项和技术出口管制的物资外,对外援助物资出口不纳入配额和许可证管理。 Except for the administration of dual-use items and technologies subject to export control, the export of foreign aid materials shall not be included in quota and licensing administration.
43 第三十三条 国际发展合作署配合国务院有关部门制定对外援助人员在外执行援外项目任务期间的基本待遇标准,并建立相应的人身意外伤害保险和救助制度。 Art. 33 CIDCA shall, in conjunction with relevant departments under the State Council, establish basic standards for treatment of foreign aid personnel for the period of execution of foreign aid project duties on the ground, and establish the corresponding personal accident insurance and relief rules.
第五章 对外援助监督和评估 Chapter 5: Foreign Aid Supervision and Evaluation
第三十四条 国际发展合作署负责对各援外执行部门组织实施援外项目的情况,以及驻外使领馆(团)履行援外项目境外监管职责情况进行监督和检查。 Art. 34 CIDCA shall bear the responsibility for organizing the implementation of foreign aid projects by respective aid executing departments, as well as for supervising and inspecting how the embassies and consulates fulfill their oversight duties vis-à-vis foreign aid projects on the ground.
第三十五条 国际发展合作署会同有关部门建立重大项目的监督检查机制,对重大项目的实施情况进行监督。 Art. 35 CIDCA shall, in conjunction with relevant departments, establish supervision and inspection mechanisms for major projects, and implement supervision of the state of their implementation.
35 第三十六条 国际发展合作署建立援外项目评估制度,组织开展常规评估、专项评估和综合评估。 Art. 36 CIDCA shall establish an evaluation system for foreign aid projects, and organize the carrying out of routine evaluations, special evaluations and comprehensive evaluations.
各援外执行部门组织援外项目自检评价,配合国际发展合作署开展评估工作。 Each foreign aid executing department shall organize self-inspection and evaluation of foreign aid project, and carry out the evaluation work in coordination with CIDCA.
37 第三十七条 国际发展合作署建立对外援助项目实施主体诚信评价体系,对实施主体参与援外项目过程中的行为进行信用评价。 Art. 37 CIDCA shall establish a credit rating system for the parties implementing foreign aid projects, and assess the conduct of such parties in the course of foreign aid projects.
6 第三十八条 国际发展合作署建立全口径对外援助统计制度,收集、汇总和编制对外援助统计资料。 Art. 38 CIDCA shall set up fully-covered statistical rules for foreign aid, and collect, summarize and prepare statistical data on foreign aid.
各援外执行部门、地方各省级人民政府、各有关企事业单位应按照对外援助统计制度,定期向国际发展合作署报告统计数据及相关信息。 All aid executing departments, all provincial government, all relevant enterprises and public institutions should, in accordance with the foreign aid statistical system, regularly report statistical data and related information.
第六章 法律 Chapter 6: Legal Liability
46 第三十九条 援外项目中方实施主体有下列行为之一的,国际发展合作署和各援外执行部门给予警告,可以并处3万元人民币以下罚款,并可以依法公布处罚决定;违反相关法律、行政法规规定的,依照法律、行政法规的规定给予行政处罚;构成犯罪的,依法追究刑事责任: Art. 39: If a Chinese implementing party of a foreign aid project commits any of the following conduct, CIDCA and each aid executing department shall issue a warning and may impose a fine of less than 30,000 yuan, and publicize the penalty decision in accordance with law. The Chinese party that violates any relevant law or administrative regulation shall be given an administrative penalty in accordance with the provisions of relevant laws and administrative regulations; and if any crime is constituted, it shall be subject to criminal liability in accordance with law.
(一)将所承担的援外项目任务转包或违法分包的; (1) if the responsibility for a foreign aid project is transferred or illegally subcontracted;
(二)未按援外项目实施合同履行义务或迟延履行义务,影响项目正常实施,造成严重不良影响的;

(2) if there is a failure to fulfill obligations according to the foreign aid project implementation contract or if there are delays in the fulfillment of obligations, which affect the normal implementation of the project and cause serious adverse effects.
(三)挪用援外资金的; (3) if foreign aid funds are misappropriated;

(四)未按规定保证外派援外人员工作和生活待遇及人身意外伤害保障的。 (4) if the work and living allowances of foreign aid personnel sent abroad, or personal accident injury protection are not provided according to regulations.
46 援外项目中方实施主体违反本条规定受到行政、刑事处罚的,自处罚生效之日起二至六年内,不选定其参与援外项目。 If a Chinese implementing party of a foreign aid project is given an administrative or criminal penalty, it shall not be selected to participate in foreign aid projects for two to six years from the date the penalty takes effect.
47 第四十条 国际发展合作署和各援外执行部门的工作人员在对外援助管理中有下列行为之一的,视情节轻重给予相应处分;构成犯罪的,依法追究刑事责任: Art. 40 If a staff member of CIDCA or a aid executing departments engages in any of the following conduct during foreign aid administration, s/he shall receive corresponding penalty according to the seriousness of the circumstances. If the case constitutes a crime, the criminal liability shall be investigated according to law:
(一)利用职务便利索取他人财物,或非法收受他人财物为他人谋取利益的; (1) Taking advantage of one’s position to extort profit, or illegally accepting the money or for the benefit of other people;
(二)滥用职权、玩忽职守或徇私舞弊,致使国家利益遭受损失的; (2) Misuse of authority, neglect of duty or favoritism, and causing losses to state interests;
(三)泄露国家秘密的。 (3) Divulging state secrets.
第七章 Chapter 7
50 第四十一条 本办法由国际发展合作署负责解释。 Art. 41 These Measures shall be subject to interpretation by CIDCA.
51 第四十二条 本办法自 年 月 日起施行。 Art. 42 These Measures shall come into force on…

Complete (or “turnkey”) foreign aid projects 成套项目 are implemented by Chinese companies who have to apply to tenders 招投标 by the Chinese Ministry of Commerce (MOFCOM) 商务部 or subordinate provincial Departments of Commerce (DOFCOMs) 商务厅. In order to participate in tenders, companies need an accreditation in accordance with the MOFCOM’s “Measures for the Qualifications Accreditation of Foreign Aid Project Implementation Enterprises” 对外援助项目实施企业资格认定办法 (2015).

Shunjiang Group and three other Zhenjiang companies (Jiaogong Group 交工集团, Geshan Construction 歌山建设 and Shunjiang Group 舜江集团) have recently obtained the accreditation. On 14 December 2017, Shunjiang hosted a discussion with the Zhejiang Department of Commerce and the three other companies on how to make use of foreign aid in order to promote the “going global” 走出去 of the accredited companies.

Asking the Department of Commerce for support, Shunjiang’s Chief Executive Li Biao 李标 expressed that

developing overseas markets plays a vital part in transformation and upgrading of construction companies. Implementing foreign aid construction projects is a shortcut to entering overseas markets. Now that Wujiang has already obtained the accreditation as a Foreign Aid Project Implementation Enterprise, and with the national “One Belt One Road” overall strategic plan being thoroughly implemented, the company’s determination and confidence to expand into overseas markets is even stronger.

拓展海外市场是建筑企业转型升级的努力方向,而承建援外项目是企业较快开辟海外市场的捷径。目前,舜江已具备对外援助成套项目总承包资格,加上国家“一带一路”总体战略规划的深入实施,更加坚定了企业拓展海外市场的决心与信心。

(It’s noteworthy that while the Chinese Communist Party leadership has issued internal instruction on the “Belt and Road” initiative, banning words like “project” (because the word connotes a goal and timeline, Beijing prefers the looser term “initiative”). Inside China and withing the Chinese language debate that doesn’t seem to have too much of an effect.)

The director of the responsible foreign economic cooperation division 外经处 withing Zhejiang DOFCOM Chen Guorong 陈国荣 cautioned the companies that foreign aid construction projects are the face of China’ engineering and construction.

Every engineering project represents China’s honor. There are extremely vigorous political and relatively high quality requirements…

Those who have followed China’s domestic debate about foreign aid in the past years are aware that the Chinese government is concerned about the reputation damage created by various aspects of not-up-to-standard conduct by Chinese companies abroad.

Therefore, Chen Guoring instructed the four companies: despite their accreditation they still needed to increase the level of their knowledge and awareness, and train their personnel for overseas activities and the participation in tenders.

But he also admitted that foreign aid is a shortcut for Chinese companies to enter overseas markets:

Foreign aid projects can not only increase the general level of openness and reputation of [Chinese] companies, it can also drive their “going global”. Particularly now under the conditions of “One Belt One Road” there will be more and more foreign aid projects. Companies accredited for the construction of foreign aid projects should grab the opportunity […]

Shunjiang’s report sheds light on the disconnect between China’s central level foreign aid policies and the implementation of Chinese aid on the ground in recipient countries. It is striking that the stated objectives of Chinese aid, namely “reduce poverty and improve the livelihood” 减少贫困、改善民生 are not mentioned, neither by Shunjiang’s CEO nor by the provincial representative of the Ministry of Commerce. The latter does talk about China’s image, but not about developmental impacts. Shunjiang’s vision of its potential engagement in foreign aid projects seems to be based on purely commercial motives, namely being a successful company in entering overseas markets. This vision is in return supported by the Department of Commerce who urges the companies to “grab the opportunity.” If measurable positive development outcomes for the recipient countries are not an explicit objective, provincial companies operate on purely commercial incentives – and believe this is what their (Chinese) government requires. Then it is not surprising, if in the end it’s only them who primarily benefit from foreign aid; even if the Chinese central government win-win policy wants it otherwise.

At the press conference, a Xinhua News 新华社 representative asked MOFCOM’s spokesperson Gao Feng 高峰 to comment on an Associated Press news release about the recently published “Global Chinese Official Finance Dataset” by the research group AidData.

Xinhua: We have noticed that in November [2017] Associated Press reported that the research organization AidData at the US College of William and Mary has issued a report. According [to this report], between 2000 and 2014 China had provided to Africa a total of 354.4 billion US-Dollar in aid and loans. For the same period, loans by the United States amounted to 394.6 billion US-Dollar. The report also stated that the total amount of Chinese government aid and loans to developing countries is getting close to that of the US, but that its primary purpose seems to be the promotion of Chinese exports and China’s own interests. The benefits for recipient countries are not that many. Does MOFCOM have any comment on that?

新华社记者:关注到美联社11月报道称美国威廉玛丽学院的一援助数据这个研究机构发布了一份报告称,2000年到2014年期间中国向非洲等地提供的援助级贷款总计3544亿美元,同期美国的贷款总数是3946亿美元,这份报告还称,中国向发展中国家提供的政府援助和贷款方向,总体的总数正在接近美国,但是大部分好像是为了在促进中国出口的信贷以及服务于中国的自身利益,而对受援国的好处并没有那么多,商务部对此有何评论?

The comment provided by MOFCOM’s spokesperson Gao Feng was to a large extent a recitation of tifa 提法, “formalized (correct) political expressions” (or watchwords) used deliberately by the Chinese Communist Party to articulate politically sensitive topics.

Gao Feng: Since a long time, China has provided aid in accordance with its own capabilities in the framework of South-South Cooperation, it is mutual assistance between developing countries, it is mutually beneficial, does not impose any political conditions and follows the principle of non-interference in the domestic politics of recipient countries. As for numbers, the report probably has confused Chinese foreign aid funds with all kinds of other funds, including commercial funds. Chinese foreign aid should primarily serve the urgent needs of recipient countries and is targeted to areas that improve people’s livelihood such as agriculture, health, education and infrastructure development. Aid should serve local economic and social development, improve the self-development capacities of recipient countries, and promote local social progress.

高峰:长期以来,中国在南南合作框架下对外提供力所能及的援助,是发展中国家的相互帮助,遵循平等互利,不附带任何的政治条件,不干涉受援国内政的原则。研究报告的数据可能混淆了中国对外援助的资金和其他性质的各类资金,包括商业性的资金。中国对外援助主要是应受援国的急需,使用在农业、卫生、教育、基础设施等民生领域,服务于当地经济和社会的发展,提高受援国自身经济发展的造血能力,促进当地的社会进步。

How to understand this comment? The first sentence is basically a summary of The Eight Principles of Foreign Aid (full title: Eight Principles for Economic Aid and Technical Assistance to Other Countries 对外经济技术援助八项原则) which were announced by Chinese Premier Zhou Enlai 周恩来 during his visit to Africa in 1964 and which, according to China’s Foreign Aid White Paper, are till today the guiding principles of Chinese aid. The last two sentences list the current priority areas of Chinese foreign aid from the perspective of MOFCOM. Here, it’s worth  paying attention to which state actor mentions what and when (for example, Xi Jinping frequently talks about assistance in the area of environment, but that’s not mentioned here). Most interesting however, is the statement that AidData “probably has confused” 可能混淆了 commercial and official number. Mr. Gao did not say that the estimates were wrong, nor did he provide alternative numbers. Which could mean that maybe MOFCOM really doesn’t have the complete picture due to the highly fragmented nature of the Chinese aid system.
