Propiedades en el paraíso del golfista

En primer lugar están las propiedades llamadas golf villas en el Complejo Turístico Nacional de la PGA. Estas residencias (no unifamiliares) oscilan entre los $185.000 y los $275.000. Pueden alquilarse a buen precio en temporada alta o de forma anual. También tienen un buen valor de reventa. Por ejemplo, un realtor de Palm Beach recibió recientemente cinco ofertas por la golf villa de un cliente y la vendió el mismo día en que fue anunciada en el mercado. También se pueden alquilar en forma diaria, semanal o mensual.

Las club cottages, casas de campo o chalets en el Complejo de la PGA, oscilan entre los $200.000 y los $265.000. Su alquiler en temporada es de aproximadamente $5.000 por mes. (Con la membresía del golf, el alquiler ronda los $6.500 por mes). Fuera de temporada, ronda los $ 2.000 mensuales. El alquiler anual es de aproximadamente $1.800 mensuales.
Los precios de estas propiedades varían según su ubicacion y el estado de las mismas. Se trata de residencias en dúplex, no de unidades independientes. Las propiedades golf villas obtienen ingresos por alquiler similares a los club cottages.

Estas son las subdivisiones dentro del Complejo Nacional de la PGA que son fáciles de alquilar y comprar y con potencial para que los inversores puedan usufructuarlas en temporada baja (verano del hemisferio norte) y alquilarlas en temporada alta (invierno del hemisferio norte), obteniendo una muy buena renta.

OTROS BENEFICIOS

Más allá de los beneficios inmediatos de invertir en una comunidad con un sólido crecimiento, un reciente artículo del Sun Sentinel del condado de Broward habla favorablemente de Palm Beach en relación al cambio climático y en detrimento del condado de Miami-Dade. Por estar Palm Beach en tierras más altas, sobrevivirá a la crecida de los mares que está provocando el calentamiento global.

Very Good Real Estate Income in Palm Beach County

WHY INVEST IN PALM BEACH

The point of this newsletter is we heartily recommend investing in single-family-homes, not in apartment buildings with rules forbidding multiple renters, as is the case in much of the Miami realty investment market.Palm Beach County is replete with affordable single-family-homes, and with a solid workforce with a need for rentals. Furthermore, the millennial trend is to rent, not to buy, so the demand to rent continues.

These homes are not far from the Atlantic Ocean, important golf courses, and polo.

ONE REASON WHY PALM BEACH COUNTY HAS A SOLID ECONOMY

One reason Palm Beach is so strong is the Business Development Board of Palm Beach County works strategically to attract new business. From hedge funds to agribusiness, the county seeks to bring in new commerce, especially from the Tri-State region surrounding New York City.

Wellington is located 20 kilometers from Lake Worth and 22 kilometers from Palm Beach Gardens  and is in the center of international horse country.  The homes are desirable as rentals, and mostly are within developments. Some are luxurious.

Golf Property

The Club Cottages – located in the Professional Golfers Association of the Americas (PGA) Palm Beach Gardens – sell for between $200,000 and $265,000, and rent during “the season” for approximately $5,000 per month. (With golf membership, they rent for about $6,500 per month.) Out of season they rent for about $2,000, and annual rent approximates $1,800 monthly.

Presentamos aquí dos temas importantes. Uno es la reciente regulación de IRS: The Foreign Account Tax Compliance Act (FATCA), la cual afecta a las cuentas fuera del país de ciudadanos residentes en Estados Unidos. Aquí tenemos un análisis del banquero Matthew Beem, un MBA de Stanford y actual presidente de Chartered Financial Planners de Miami, acerca de cómo esta regulación de EE.UU. afecta a propietarios estadounidenses de inmuebles en Argentina.

Segundo, como la mayoría de los compradores extranjeros de propiedades en EE.UU. desde Sudamérica compran en Miami, hemos dedicado un tiempo sobre el terreno en Miami y otros lugares, tales como Palm Beach Island, indagando sobre los riesgos de daños por huracanes y los seguros. Esencialmente, de aquí en adelante son buenas noticias. Sin embargo el mercado inmobiliario argentino todavía es difícil de entender para algunos compradores extranjeros. Por eso, para personas no argentinas interesadas en comprar inmuebles en Argentina, por favor revisen el segundo artículo de nuestro anterior newsletter / Otoño (Argentina) 2014 N°3 / por Julián Monti, para conocer algunas cosas sobre cómo traer dinero a la Argentina para comprar propiedades.

1 – FATCA – PROMULGADA EN JULIO – UN RESUMEN DEL IMPACTO SOBRE LOS PROPIETARIOS ESTADOUNIDENSES DE INMUEBLES EN ARGENTINA – Matthew Beem

Como resultado de los numerosos y notorios casos de evasión de impuestos que tuvieron como protagonistas a ciudadanos estadounidenses con fondos no declarados depositados en instituciones financieras extranjeras, el gobierno de los Estados Unidos ha implementado recientemente la Foreign Account Tax Compliance Act o FATCA. El principal objetivo de la FATCA es asegurarse de que todas las personas de Estados Unidos (esto es, ciudadanos estadounidenses o residentes permanentes) que tengan activos financieros fuera de los Estados Unidos paguen todos los impuestos estadounidenses que les correspondan. La carga del cumplimiento corresponde a la institución financiera extranjera (Foreign Financial Institution – FFI) quienes son obligados a llegar a un acuerdo con el Tesoro estadounidense o cumplir con reglas pertenecientes a acuerdos intergubernamentales. Esencialmente, las FFI están obligadas a identificar cuentas en poder de personas estadounidenses o cuentas que estén económicamente controladas por personas estadounidenses (por ejemplo: fideicomisos, corporaciones, etc.) y notificar anualmente sobre estas cuentas al IRS. Hay muchas facetas importantes de la ley que un inversor internacional tiene que tener en cuenta, pero el principal punto en el que se centra este breve artículo es en tratar el impacto de la FATCA sobre los ciudadanos estadounidenses que tienen propiedades en Argentina.

Es importante destacar que la FATCA aplica sobre cuentas financieras por lo tanto en términos de personas que tienen propiedades en Argentina no hay obligación de reportarse, ni personalmente ni por una FFI (mayormente porque el activo no está en poder de una FFI). No obstante, si la persona estadounidense tiene una cuenta bancaria en Argentina que se ha creado para recibir dinero de alquileres u otro ingreso pasivo, y si esa cuenta en algún punto en el tiempo alcanza un balance de más de $50,000, entonces la FFI argentina donde la cuenta se encuentra tendrá que cumplir con FATCA y notificar acerca de esa cuenta a las autoridades estadounidenses. Si la cuenta nunca alcanza esa suma la FFI no tiene obligación de notificar sobre ella. Es más, si la cuenta alcanza un balance de más de $10,000 el dueño de la cuenta debe informar a través de FBAR (Report of Foreign Bank and Financial Accounts). Si el dueño de la cuenta no informa está sujeto a importantes multas. En otras palabras, si una cuenta en el extranjero de una persona estadounidense tiene un balance de más de $10,000 hay algún tipo de obligación de informar sobre ella ya sea que lo haga el mismo dueño de la cuenta o la FFI. Si éste no es el caso no hay obligaciones de informe.

Sin duda, FATCA es un desarrollo importante en el cumplimiento de pago de los impuestos estadounidenses y siempre recomendamos consultar con un asesor fiscal en casos especiales.

Matthew Beem tiene más de diez años de experiencia en el sector financiero y ha ocupado diferentes puestos en administración de bienes, consultoría en inversiones y estrategias en asignación de activos.

Matthew comenzó su carrera en Buenos Aires, Argentina, en el laboratorio de ideas “Fundación Mediterránea” fundada por el ex ministro de economía Domingo Cavallo. Durante su participación de dos años en dicha institución se dedicó a estudiar la economía brasilera y formó parte de un equipo encargado por el Banco Mundial para comparar la devaluación de la moneda brasilera en 1999 con la crisis argentina de 2002 y escribió un análisis de la transición presidencial de Brasil en 2002 para publicaciones estadounidenses y sudamericanas. También ha ocupado varios puestos en bancos privados en Miami, incluyendo el Citi Private Bank donde trabajó en asignación de activos para una cartera de clientes de alto patrimonio.

Matthew habla español y portugués, es Analista Financiero Certificado (Chartered Financial Analyst, CFA), tiene títulos de las universidades Trinity y Stanford. En este momento es presidente de CFA Miami.

2 – “CITIZENS PROPERTY INSURANCE” EN EL ESTADO DE FLORIDA

Al emprender nuestra investigación sobre varios ángulos de la cobertura por tormenta en Florida vimos al principio que había indicios de que existieran serios escollos para los inversores ya que hemos oído de profesionales de seguros en Florida que Citizens Property Insurance (CPI) ha estado intentado suprimir ciertas pólizas. Hemos tomado ésto como una señal de alerta y por consiguiente, como una situación potencialmente peligrosa para los inversores en el mercado inmobiliario de Florida.

Sin embargo, luego de dialogar con agentes inmobiliarios y especialistas en seguros en Florida hemos llegado a la siguiente conclusión: aún cuando esto va en contra de la regla fundamental de inversión de nunca poner todos los huevos en una sola canasta (por ejemplo, los inversores sudamericanos tienen un apego especial por las propiedades en Florida), el hecho parece ser que el estado de Florida tiene un sistema similar en sus efectos a un bono de responsabilidad general (a State General Obligation Municipal Bond) el cual, por consiguiente, parece proteger razonablemente al dueño de la propiedad asegurada por riesgo de desastres naturales, ya que el riesgo de tormenta parece estar esencialmente compartido a nivel estado.

Vemos aquí que el principal riesgo es gubernamental o políticamente sistémico. Esto significa que podría ocurrir que se atrasen pagos por parte de CPI a los titulares de las pólizas en casos de catástrofes descomunales. Vemos que es posible que exista un riesgo en el plazo de pago debido a la presión política sobre agencias y políticos desde zonas del estado menos afectadas por las tormentas (por ejemplo, quienes residen en lugares en el interior del estado que no están afectados directamente por las tormentas provenientes del océano estarían obligados a pagar por daños causados a la propiedad de sus vecinos “adinerados” que pueden costear casas frente al mar).

En un escenario desigual como este y en el cual CPI estaría utilizado al máximo, podrían haber legisladores tratando de ganar puntos políticos entre electores de lugares que son afectados en menor grado por las catástrofes haciendo movimientos para cambiar la ley actual o tratar de hacer algo para impedir los pagos por propiedad. Asimismo, siempre existe la posibilidad de que algún burócrata del gobierno retrase un pago, por cualquier razón, y la inercia de este tipo también podría ser perjudicial.

En resumen pensamos que el peor de los casos sería que los poseedores de pólizas CPI experimenten retrasos a causa de maniobras políticas o por alguna complicación relacionada con el gobierno o inercia pero eso, como Bill Beckham de JM Private Insurance en Miami dice “al momento las alternativas a Citizens Insurance son muy limitadas” y pensamos que el sistema, como está establecido por el Estado de Florida en este momento es bueno, tanto así que podría ser reproducido en otros estados dentro de los Estados Unidos.

Two salient issues are presented here. One is the recent IRS regulation, Foreign Account Tax Compliance Act (FATCA), which concerns US resident-citizen overseas accounts. Here we have an analysis by banker Matthew Beem, Stanford MBA and current president of the Chartered Financial Planners of Miami, about this US regulation as it affects US holders of real property in Argentina.

Second, as the majority of foreign buyers of US property from South America purchase in Miami, we spent time on the ground in Miami, and elsewhere, such as Palm Beach Island, delving into the risks of hurricane damage and insurance. We were pleased, for buyers, what we discovered in Florida.

Essentially, below is all good news. However, the Argentine real estate market is still difficult for some foreign buyers to understand. Therefore, for non-Argentines interested in purchasing real estate in Argentina, please review the second article of our just-prior newsletter / Autumn (Argentina) 2014 N°3 / by Julian Monti, to learn something about bringing money into Argentina to buy property.

1. FATCA and US RESIDENT PROPERTY OWNERSHIP IN ARGENTINA – Matthew Beem

As a result of recent numerous high-profile tax evasion cases that involved US citizens with undeclared funds deposited with foreign financial institutions, the US government has recently implemented the Foreign Account Tax Compliance Act, or FATCA. The main objective of FATCA is to ensure all US persons (i.e. US citizens or permanent residents) holding financial assets outside the United States pay all applicable US taxes. The burden of compliance is placed on the foreign financial institution (FFI), which are required to enter into an agreement with the US Treasury or to comply with Intergovernmental agreement rules. In essence, the FFI’s are required to identify accounts held by US persons or accounts economically controlled by US persons (i.e. trusts, corporations, etc.) and to report annually these accounts to the IRS. There are many facets of the law that are important for an international investor to be aware of, but the main focus of this brief article is to discuss FATCA’s impact on US citizens who are landowners in Argentina.

It is important to note FATCA applies to financial accounts, so in terms of US persons holding real state in Argentina, there is no reporting requirement, either self-reporting or by an FFI (primarily because the asset is not held by an FFI). However, if the US person has a bank account in Argentina which is created to receive rents or other passive income, and that account at any point in time has a balance more than $50,000, then the Argentine FFI where the account is held is then required to comply with FATCA and report that account to US authorities. If the account never reaches that amount, then there is no reporting requirements from the FFI. Furthermore, if the account has at any point a balance greater than $10,000, then the account holder is required to self-report via FBAR (Report of Foreign Bank and Financial Accounts). If the account holder does not self-report, then the holder is subject to heavy fines. In other words, if at any point a foreign account held by a US person has a balance over $10,000, there is some sort of reporting requirement, either by the holder or by the FFI. If this is not the case, there are no further reporting obligations required.

Without a doubt, FATCA is an important development in US tax compliance, and we always recommend consulting a tax advisor for specific circumstances.

Matthew Beem has extensive experience in the financial sector, holding a wide array of positions throughout wealth management, investment advisory, and asset allocation strategies.

He began his career in Buenos Aires, Argentina at the think tank “Fundacion Mediterranea”, founded by the former Argentine finance minister Domingo Cavallo. During his two-year stint there, he covered the Brazilian economy, was on a team commissioned by the World Bank to compare the Brazilian devaluation of 1999 with the Argentine crisis of 2002, and wrote analysis of the Brazilian presidential transition of 2002 for both South American and US-based publications.

He has also previously held several positions in Miami-based private banks, including Citi Private Bank, where he made asset allocation decisions for HNW portfolios.

Matthew is fluent in Spanish and Portuguese, a CFA charterholder (Chartered Financial Analyst), holds degrees from Trinity University and Stanford University. He also currently serves as the president of CFA Miami.

2. CITIZENS PROPERTY INSURANCE, THE STATE OF FLORIDA

As we embarked on learning about the various angles of storm coverage insurance in Florida, the research we did on the ground there, in Florida, at first indicated there might have been very serious, potentially vicious pitfalls for investors, as we heard from Florida insurance professionals that Citizens Property Insurance had been attempting to unload certain policies, and so we took this as a warning signal, and therefore a potentially hazardous situation for investors in Florida real estate.

However, after discussions with realtors and insurance specialists in Florida, we have the following conclusion: Although it absolutely goes against the fundamental investment rule, dictating one should never have all of one’s eggs in one basket (Ie. South American investors who have a particularly strong appetite for Florida real estate), the fact seems to be the State of Florida has a system similar in-effect to a general obligation bond, which thereby seems to adequately protect insured property owners from catastrophic risk, since storm-risk seems to be essentially shared state-wide.

We see the primary risk, therefore, given what we’ve been told, as political and/or governmentally systemic. This means delayed payout by Citizens to policy holders could occur for some policy holders in case of a mammoth catastrophe. We see possible payout-delay risk due to political pressure on politicians/agencies from zones of the state less-affected by a storm (Ie. inland portions of the state, where residents are less-affected by ocean-born storms, would be obligated to pay for damage caused to the property of their “wealthier,” ocean-front neighbors). An imbalanced scenario such as this, and in which Citizens Property Insurance would be tapped to the hilt, could see legislators try to win political points among less-catastrophe-affected constituents by making moves to change existing law, or to try to do something else impeding property payouts. Similarly, there’s always the potential that a government bureaucrat could be slow in paying, for whatever the reason, and inertia of this type would hurt.

In sum, we think worst-case scenario would be Citizens policy holders might experience delays due to political gamesmanship, a government-related snafu, or inertia, but that, as Bill Beckham of JM Private Insurance in Miami states “the current alternatives to Citizens Insurance are very limited” and we think the system, as set up by the State of Florida currently, is a good one, and one most likely to be replicated in other US states.

Compras de inmuebles en el exterior por residentes argentinos – Julián Monti

El ahorrista medio argentino generalmente considera que es complicado comprar inmuebles en el exterior, sobre todo en lo relativo a temas impositivos. “Me van a cobrar un montón de dinero en impuestos, me va a venir la AFIP encima, es muy complicado”, son justificaciones que frecuentemente se hace una persona que analiza la compra en el exterior.

Ahora bien, cuando se conoce el sistema, se podría llegar a la conclusión que dentro de las cuestiones relativas a la compra en sí, la cuestión impositiva pasaría a ser una de las más simples. Y las cuestiones de rentabilidad proyectada, ubicación, mantenimiento y como ejecutar la compra son más complejas y delicadas.

Primero que nada, es necesario entender como se pagan los impuestos relacionados con bienes o ingresos en el exterior. Hoy por hoy, de acuerdo a los artículos 5 y 127 de la Ley de Impuesto a las Ganancias, la Argentina se rige por el concepto de “renta mundial”, es decir que un residente argentino abona sus impuestos por sus ingresos y bienes en el país, como así también por sus bienes en el exterior. Para evitar la doble imposición, la ley del impuesto, en sus artículos 168 a 179, permite a un contribuyente computar como pago a cuenta del impuesto, el gravamen que se haya abonado en el exterior por la misma operación. Es decir, que si pago el impuesto en el país de origen, lo computo a cuenta del impuesto que deba abonar en la Argentina, y termino pagando solamente un equivalente al país que más tasa tenga. Se dice extraoficialmente que existe un Convenio para evitar la doble imposición con los Estados Unidos, pero a la fecha ese convenio no figura aprobado por la AFIP.

En el plano impositivo, lo más importante es como mover el dinero y como tengo estructuradas mis presentaciones impositivas. Debemos separar esta cuestión en dos alternativas, ya sea teniendo los fondos en el exterior, o tener que transferirlos desde el país.

Si una persona tiene sus papeles en orden, podrá apreciar que teniendo las cuentas bancarias foráneas exteriorizadas en sus declaraciones del impuesto a los bienes personales, hacer la compra es muy simple y la misma tiene un efecto neutro en el impuesto. Considerando el tema del pago, uno simplemente puede hacer una transferencia desde su cuenta en el exterior, a la cuenta del vendedor, y el asunto queda concluido. En materia impositiva, esos fondos declarados abonan el impuesto a los bienes personales, por lo cual uno está cambiando un bien por otro, con lo cual, el contribuyente sigue pagando el mismo impuesto.

Cuando nos detenemos a analizar la opción con transferencia desde el país, nos encontramos con las regulaciones cambiarias del Banco Central, que hoy en día no autorizan la salida de divisas para compras de inmuebles en el exterior. Sin embargo, teniendo pesos en el país, uno tiene la alternativa de girar esos pesos con el famoso “contado con liquidación”, afrontando una tasa de cambio más alta que la oficial.

¿Cómo funciona este sistema? Uno compra bonos nacionales en el país en pesos, y los vende en el mercado externo a través de una sociedad de bolsa, depositando el producido de esa venta en dólares estadounidenses en una cuenta bancaria del exterior. Si miramos el aspecto impositivo, verá que los pesos declarados en el país, que ya abonan el impuesto, se transforman en dólares en el exterior, y en consecuencia en el inmueble.

Una vez realizada la compra y su declaración, sólo queda analizar el impuesto a las ganancias en dos esquemas: la renta y el resultado por la venta.

En lo referente a la renta por alquileres, se deben declarar esos ingresos y adicionarlos a la declaración jurada, pagando el impuesto que resulte de la aplicación de la tabla general del impuesto a las ganancias. Como gastos deducibles se pueden computar la amortización del bien y los gastos asociados a esos alquileres.

En el caso de una posterior venta del inmueble la operación se encuentra exenta del impuesto de acuerdo a lo dispuesto por el artículo 2 la Ley 20.628, puesto que la misma deja fuera del gravamen las operaciones no habituales que una persona realice. Por lo tanto, mientras la persona no se dedique a la compraventa de propiedades, estas operaciones quedarían exentas.

Un tema que deberá analizarse si corresponde o no, es la declaración del valor locativo, que es la ganancia presunta por bienes destinados a veraneo o que sean cedidos gratuitamente a familiares, pero este análisis dependerá de las características y ubicación del inmueble.

Como podrá apreciarse es muy importante estar muy bien asesorado y analizar bien cada operación a los efectos de poder determinar la mejor forma de formalizar las operaciones.

Compras de inmuebles en el país por no residentes – Julián Monti

Una de las grandes dudas que tiene un extranjero al momento de intentar invertir en el país, son las cuestiones operativas e impositivas relacionadas con dicha compra.

El primer tema está asociado a la transferencia de los fondos necesarios para esa compra, ya que la cuestión del control de cambios impuesto por el gobierno ha complicado un poco la cuestión para la inversión extranjera.

Hoy por hoy, un extranjero puede hacer el pago de 3 formas: mediante una transferencia en el exterior a una cuenta fuera del país del vendedor, una transferencia al país mediante un “contado con liquidación inverso” (es decir, la compra de bonos argentinos en dólares en el exterior y su venta en pesos en la plaza local), o una transferencia mediante el mercado local de cambios a una cuenta en el país.

Cualquiera de las tres alternativas es viable desde el punto de vista legal, pero solamente la tercera (la más perjudicial económicamente para el comprador por las tasas de cambio) no tiene consecuencias futuras.

Las dos primeras opciones tienen una consecuencia. Existe una disposición del Banco Central que establece que si un inversor del exterior compra una propiedad en el país y no abona mediante el mercado local de cambios (tercera opción) en el momento de una futura venta en el país, deberá pedir autorización al Banco Central para que lo dejen repatriar las divisas en su país. Es una cuestión muy importante a tener en cuenta al momento de pensar qué es lo que el inversor tiene previsto hacer con su inversión en el mediano plazo.

Entre las cuestiones impositivas, el inversor del exterior debe contar con un CDI que puede conseguir en cualquier agencia, aunque para el pago de los impuestos por su cuenta deberá contar con un responsable sustituto.

Este responsable sustituto deberá ser un residente en el país y contar con CUIT y clave fiscal. Tendrá que empadronarse en registros del fisco y será el responsable de presentar y pagar todos los impuestos por cuenta del inversor del exterior.

Los impuestos a cargo del contribuyente del exterior, serán el impuesto a las ganancias por los alquileres que obtenga, y el impuesto a los bienes personales por la tenencia del bien a una tasa del 1,25% anual.

Si el inversor deseara vender su propiedad, siguiendo la línea del artículo 2 de la Ley 20.628, la misma está exenta del impuesto a las ganancias, pero sujeta al ITI (impuesto a las transacciones inmobiliarias) a una tasa del 1,5%. Para tener ese beneficio de no pagar el impuesto a las ganancias y pagar el ITI, debe hacerse una presentación en la AFIP solicitando el trámite, en base a las Resolución 2139.

Although we hoped with this third edition of our newsletter (see others on Argentico.com – “newsletter” tab ) to give information on new real estate developments in Argentina, and how one, as a foreigner, might best take advantage of this tantalizing market, we are humbled to say we can not provide this, yet.

However, as our friends at the accounting firm Miguel A. Monti Associates like to say, quoting from Charles Darwin, “It is not the strongest or the most intelligent who will survive but those who can best manage change.” With this in mind, we provide you from them two things: Information related to properties overseas and their tax consquences for Argentines; and, a tid bit, or hors d’oeuvres, on how to bring foreign money into Argentina for real estate investing.

We hope by Argentine Spring/US Fall, to serve a newsletter which may better make accessible the Argentine real estate market for foreign investors.

PROPERTY PURCHASES ABROAD BY ARGENTINE RESIDENTS – Julián Monti

The average Argentine investor thinks of buying property abroad as something extremely complicated, especially pertaining to taxes and the Argentine government – AFIP (Federal Administration of Public Income). “I will be charged a lot of money in taxes, AFIP will come after me, it is very complicated’, are justifications made.

However, when one becomes acquainted with the Argentine tax system, one might conclude, with respect to matters related to the purchase itself, of a property abroad, the issue of taxes might be the simplest of them all; and issues such as projected profitability, location, maintenance and how to execute the purchase are more complex and delicate.

First, one must understand how taxes related to assets and/or income abroad are tabulated for the Argentine resident. Currently, according to Sections 5 and 127 of Argentine Income Tax Law, AFIP operates under the concept of “world income.” This means an Argentine resident pays taxes on income and assets in Argentina, as well as taxes for assets abroad. To avoid double-taxation, Articles 168 to 169 of the Tax Law allow taxpayers to deduct from their local tax the amount of tax paid abroad. Therefore, one may deduct the tax paid abroad from one’s Argentina tax and only pay the equivalent rate to the country with the higher rate. (It is said unoffically there is an agreement for the avoidance of double-taxation with the United States, but there is currently no such agreement between the United States and Argentina.)

Most important with respect to taxes is how to move money and structure tax presentations. This must be divided into two alternatives: Either the funds are already abroad, or they are to be transferred to another country. This is the difference between having the source of the funds in an account in Argentina, or having the source in a foreign account.

If the investor’s “papers are in order,” and therefore the investor’s bank accounts are declared on the investor’s tax returns, the purchase is very simple, and the purchase’ effect on the investor’s taxes will be neutral. When it comes time to payment, the purchaser can simply make a transfer from the investor’s account abroad to the seller’s account, and the matter is finished. These declared funds pay the tax on personal property, therefore the investor is changing one good for another so the taxpayer continues to pay the same tax.

When one considers the option of a funds transfer abroad, we find the exchange regulations of the Central Bank currently do not allow the outflow of currency to buy property abroad. However, having pesos in Argentina, one has the option to send those funds with the famous “*contado con liquidacion,” but one faces a higher exchange rate. (*”Contado con liquidacion” is an Argentine term, with no easy translation, other than “contado” means when one pays cash; so essentially it might mean “cash with bond liquidation.”)

How does this system work? One buys national Argentine bonds in Argentina, and sells them in the foreign market through a broker, depositing the proceeds of the sale in U.S. dollars in a bank account abroad. If one looks at the tax-side of this, one sees the funds reported in Argentina, with taxes already paid on them, which are then tranformed into dollars abroad, and consequently can be used to buy property. Again, these funds are declared in the investor’s statements, the Personal Asset Tax (“Bienes Personales”), have already been paid, so when the money is changed for property, then the same tax which was paid on the money, is no longer to be paid on the funds but for the property.

Once the purchase and tax statements on assets are made, the only item left to study is the income derived from the property, and to do this in two schemes: Any rent and/or capital gain at future sale.

With respect to rental income, this must be declared and added to the local, Argentine, income statement, by paying the tax due based on the general table of income tax. It is important to know Section 84 states that property depreciation and fees paid to maintain on property are deductible expenses from income tax.

In the event of a subsequent sale of the property, the transaction is exempt from tax according to provisions of Section 2 of Law 20,628 since it leaves out operations that are not habitual for the person. Therefore, as long as the person does not engage “habitually” in the sale of properties, these transactions would be exempt.

Another matter to determine as applicable, or not, is the statement of rental value as it may pertain to property for summer or vacation, or property transferred without charge to family members. This matter depends on the property’s characteristics and location.

Obviously, it is important to be well-advised with respect to these matters.

PURCHASE OF ARGENTINE PROPERTY BY NON-RESIDENTS – Julián Monti

Among the main questions for foreign buyers of Argentine property derive from tax issues at purchase.

The first issue is the transfer of the funds for the purchase, since the exchange controls imposed by the government complicate the issue for foreign investors.

Today, a foreigner may make payment in three ways: By transferring abroad to a seller’s account outside the country, a transfer to the country through a “contado con liquidacion inverso” (See asterisked note above for a partial, informal explanation of this term), or a transfer through the local exchange market in Argentina.

Any of the three alternatives is feasible from a legal point of view, but only the third (the most economically unattractive to the purchaser due to unfavorable-to-investor exchange rates) has no future consequences.

The first two options have consequences. There is a provision of the Central Bank which states that if a foreign investor purchases a property in Argentina without paying through the local exchange market (option 3) at the time of a future sale of said property in Argentina, the investor must request authorization from the Central Bank to repatriate foreign currency to his native country. This is an important issue to consider when thinking about what the investor intends to do with his investment medium term.

Among the tax issues, the foreign investor must have a CDI, which can be obtained at any AFIP agency, but for paying taxes the investor must have a tax representative, or tax substitute. The tax substitute is the fiscal representative for a foreigner to pay Argentine taxes.

The tax substitute must be an Argentine citizen, and have a CUIT and tax code “clave fiscal,” which is the registration number a tax payer needs to function in the system. The substitute will need to register with the AFIP and be responsible for filing and paying all taxes due from the investor.

Taxes paid by the taxpayer will consist in income tax for the rent and the tax on personal property at a rate of 1.25% per annum.

If the investor wishes to sell, according to Section 2 of Law 20.628, the property is exempt from income tax but subject to ITI (tax on real estate transactions) at a rate of 1.5%. To not have to pay any income tax and to register for the the ITI in order to sell, the investor must run an AFIP process request (Resolution 2139).

Again, it is important for foreigners to be well-advised with respect to these matters, to best determine how to formalize operations.

OPERACIONES INMOBILIARIAS EN LA ARGENTINA – Enrique Maschwitz (h)

Las actuales medidas económicas en Argentina han producido un retraimiento del mercado inmobiliario, ya sea porque los vendedores no pueden recibir en pago divisa estadounidense por el cepo cambiario, o porque los compradores no pueden contar con dicha divisa o justificar su procedencia.
Estas circunstancias han hecho que en los últimos dos años las operaciones realizadas sean cada vez más escasas; consecuentemente, los valores de venta se han mantenido estables o disminuido en muchos casos, especialmente los inmuebles para capas medias de la población.
Distinta es la situación respecto de inmuebles de valor superior o de lujo; es un mercado que suele manejarse con valores en dólares estadounidenses pagados en el exterior por transferencia bancaria. Por acuerdo de ambas partes se transfiere a la cuenta del vendedor el importe del precio y éste declara en su patrimonio el ingreso de los valores recibidos. Es común encontrar clientes que acepten operaciones bajo estas condiciones.

OPERACIONES BANCARIAS EN ESTADOS UNIDOS – Matthew Beem

Cómo Abrir Una Cuenta en EE.UU.

Aunque parece difícil, para un extranjero no es tan complicado abrir una cuenta (tanto una cuenta bancaria como una de corretaje). En primer lugar, hay que elegir entre varios bancos y casas de bolsa el nivel de servicio y los costos que se desea. Los grandes bancos en EE.UU. (Citibank, JP Morgan, Wells Fargo, etc.) tienen sucursales que se dedican exclusivamente al mercado latinoamericano y cuyos ejecutivos hablan español. Pero también existen bancos más chicos y hasta bancos/casas de bolsa “online” que son más competitivos en cuanto a los costos/montos mínimos para abrir una cuenta. También hay bancos/casas de bolsa que no aceptan clientes extranjeros y otros que requieren montos mínimos para abrir cuentas, por lo que es importante investigar sobre el banco antes de proceder con el proceso de apertura.

Una vez que se haya elegido dónde abrir la cuenta, para cumplir con las regulaciones bancarias se necesita comprobar tanto la identidad como el domicilio legal del titular (o titulares) de la cuenta. Para comprobar la identidad, normalmente se exige una fotocopia del pasaporte (que debe estar vigente) si el titular no es residente americano. A su vez, para comprobar el domicilio, normalmente se exigen dos facturas, una de gas, luz, teléfono, etc. y otra de una entidad financiera (banco local, tarjeta de crédito local, etc.).

El segundo paso es la justificación de los bienes que se depositarán. Para cumplir con las regulaciones AML (anti-lavado de dinero), el banco/ejecutivo de cuenta está obligado a verificar la fuente de los fondos. Si vendió una propiedad o una empresa, o si el dinero proviene de honorarios o salarios que Ud. ganó, lo tiene que declarar al banco, pero esto no quiere decir que el banco comparta la información con un tercero (ni siquiera el gobierno). Esto se hace a través de un cuestionario que hay que llenar, y es relativamente fácil.

Una vez abierta la cuenta, también es importante avisar al banco si se va a girar un monto importante y justificarlo de antemano, porque si hay irregularidades sin aviso previo, se puede incluso cerrar la cuenta. Si el titular trabaja con la sucursal internacional de un banco estadounidense, se le puede avisar al ejecutivo de cuenta que se vendió una casa de tal monto y que se espera un giro.

Por último, es muy conveniente firmar un formulario llamado W-8. Este formulario es para el extranjero que carece de número de seguridad social (social security number) y es para evitar impuestos sobre los intereses (no sobre los dividendos). Si se abre una cuenta de corretaje, los cupones de bonos, por ejemplo, no están sujetos a retención de impuestos en Estados Unidos si se firmó un “W-8”.

Nuestro primer paso fue contactar al Departamento de Vivienda y Desarrollo Urbano de EE.UU. (HUD, su sigla en inglés). También nos hemos comunicado con los directores de la División de gestión de bienes unifamiliares de HUD, importantes inmobiliarias de Detroit, la oficina del intendente de la ciudad de Detroit y la oficina del Gobernador de Michigan, incluyendo la Michigan Economic Development Corporation (Corporación de desarrollo económico de Michigan). Además, hemos iniciado un seguimiento con la Detroit Economic Growth Corporation (Corporación de crecimiento económico de Detroit). El sistema está especialmente orientado a compradores que se proponen habitar la vivienda que compren por lo cual hay un “tiempo de espera” para que los inversionistas puedan ofertar. Así, el inversionista puede ofertar luego de que hayan ofertado quienes compran para habitar (de hecho, el mismo día en que se escribieron estas líneas, el tiempo de espera cambió de un período de 30 días a uno de 15 días para los inversores. Esto es bueno para ‘nuestros’ compradores. (A saber, Noticias de HUD, 2 de diciembre: “Buenas tardes. A partir de hoy entran en vigor algunos cambios que se han hecho en el Programa de Disposición de Ventas de HUD. Se detallan a continuación: El período exclusivo para propiedades aseguradas (IN/IE) es ahora de 15 días – previamente era de 30 días. Además los procedimientos para la apertura de ofertas realizadas los viernes, sábados, domingos o feriados nacionales serán examinadas simultáneamente el día hábil posterior”).

Comience por escribir el código postal de su interés y examine con detenimiento el sitio. Al principio, los inversores sólo pueden ofertar en propiedades “UI” (no asegurables) y no pueden ofertar en propiedades “IN” (asegurables).

Adicionalmente, los futuros inversores no pueden ofertar sin un agente inmobiliario. Nota: HUD paga la comisión del agente inmobiliario de ambas partes (comprador y vendedor) en las transacciones.

Para ofertar, hay que tener pruebas de tener fondos suficientes. Esto incluye poseer un extracto de cuenta bancaria, de menos de 30 días de expedido con una cantidad que como mínimo iguale a la suma de la oferta. Éste extracto no necesita la firma de un escribano y usted puede borrar su número de cuenta y ocultar información privada. Sólo precisa tener el nombre del comprador y la suma pertinente.

Además, se necesitará un número de identificación para ofertar, el cual es usualmente el número de seguro social, y en el caso de un extranjero puede hacerlo con una identificación con fotografía.

El dinero para hacer un depósito en garantía debe estar inmediatamente disponible. Las sumas requeridas son de 500 dólares si la oferta es por debajo de los 50.000 o de 1.000 dólares si la oferta sobrepasa los 50.000. Este dinero debe ser en cheques de cajero u órdenes de pago. No se aceptarán cheques personales o efectivo. Este dinero es requerido sólo si la persona resulta ser el oferente ganador. Si la oferta es aceptada, se le otorgan dos días hábiles para hacer el depósito en la cuenta de garantía del agente inmobiliario.

A propósito, cuando se hace una oferta hay una opción que su agente puede realizar, la de una oferta “de seguridad” (“back-up”) en caso de que otra oferta fracasare, por cualquier razón.

Si la oferta es exitosa, el ofertante será notificado dentro de las 24 horas posteriores. Si no ha sido notificado en ese lapso, significa que no fue exitosa. También, si no hubo ganadores, la propiedad seguirá estando en el sitio web hudhomestore y, es de suponer que la oferta se podrá ajustar a una suma más alta.

Además, si un ofertante resulta ganador, tendrá cinco días hábiles para hacer una inspección personal de la propiedad. Si el comprador potencial no está conforme al hacer dicha inspección tiene cinco días para reclamar su depósito en garantía. La persona debe notificar a HUD que desea recuperar su depósito mediante el agente inmobiliario.

HUD no hará reparaciones o reducirá el precio luego de la inspección. Los hogares HUD se venden “como están”. Este mensaje está entre las primeras palabras en el website de HUD.

La venta de la propiedad debe “cerrar” dentro de los cuarenta y cinco días luego de aceptada la oferta.

Como comprador, la persona elige la compañía de títulos de propiedad, verifica si la propiedad tiene gravámenes, etc.

Si el título está en orden la compañía de títulos de propiedad notifica a HUD y al futuro dueño para que establezcan una fecha de cierre. HUD necesita siete días para cerrar. La compañía de títulos de propiedad debe estar en contacto con todas las partes para hacer el cierre en algún lugar de Michigan, en caso de que la propiedad HUD haya estado a la venta en Detroit. (Se sugiere cambiar las cerraduras inmediatamente luego de comprada la propiedad).

ACERCA DE DETROIT EN GENERAL:

Este es un buen momento para invertir en Detroit. Basta una búsqueda rápida en Google para comprobar que, dentro de la fuerte inversión extranjera en Detroit, hay una cantidad considerable de inversiones de capitales chinos y también australianos, entre otros. Un presidente de una gran firma inmobiliaria de los Estados Unidos, sin actividad principal en Detroit, dijo: “…habiendo hecho recientemente un tour por Detroit, pienso que es uno de los MEJORES lugares para invertir ahora. Formidable oportunidad por delante!”

No obstante, uno no debe esperar hacer dinero rápido en una renovación (comprar una casa deteriorada y arreglarla) en Detroit.

Los precios promedio de las viviendas HUD rondan los 30.000 dólares y los alquileres pueden alcanzar, según nos dicen, entre 500 y 800 dólares por mes.

MÁS ALLÁ DE HUD:

Sin HUD, y con un buen agente inmobiliario hay también otras áreas para buscar oportunidades en y alrededor de Detroit, por propiedades en las que un banco ha iniciado una ejecución hipotecaria.

Por ejemplo: una zona en Detroit con casas espectaculares y patrimonio interesante, donde uno puede comprar una atractiva casa de ladrillos por 80.000 o 100.000 dólares, o menos, es la zona Boston-Edison.

Nótese en el video que la casa que se dice es la más grande en el área, la casa del ex-presidente de Fisher Auto Body, Charles T. Fisher, de alrededor de 1.000 metros cuadrados, al parecer se vendió (de acuerdo con el video) por 600.000 en 2008. (En realidad, se vendió por 625.000, cuando la crisis no era tan pronunciada). Hoy día, percibimos que podría venderse por 300.000 pero podría tener ocupantes ilegales. El precio podría ser incluso más bajo que 300 mil si le han sustraído elementos importantes como cobre y calderas.

No obstante, nos han dicho, que el ingreso por alquiler podría llegar a los 2.000 dólares por mes.

Entendemos que todas estas propiedades pueden ser buenas para alquilar y las inmobiliarias de la región tienen equipos de administración de propiedades que pueden ayudar en estos temas. Generalmente cobran hasta un 20% por mes. (Argentico SRL puede dar detalles).

INVESTIGACION EN CURSO:

Como se mencionó en el primer párrafo, hemos comenzado a abrir puertas para los compradores latinoamericanos, a través del espectro municipal, desde el gobierno de los Estados Unidos y por medio de la Detroit Economic Growth Corporation – con diferentes resultados. Es más, y tal vez de manera interesante, el señor Norman S. Jezzeny (especialista en programas/políticas de vivienda de la División de Administración y Enajenación de Bienes Inmuebles de HUD) nos ha dicho en varias ocasiones que otro representante, a cargo de vender propiedades HUD al por mayor, estaría muy interesado en tener una continuidad con nosotros. (Aún no hemos recibido noticias de ésta persona).

Dentro de todos los contactos gubernamentales, estamos especialmente satisfechos de informar que la Detroit Economic Growth Corporation (DEGC), una organización privada sin fines de lucro que opera como la agencia líder en desarrollo económico en nombre de la ciudad de Detroit y la cual se especializa en la reconstrucción comercial e industrial, desarrollo de proyectos comerciales e iniciativas a gran escala de urbanización diversificada, ha enviado enlaces web para su disposición. REAL ESTATE OPERATIONS IN ARGENTINA – Enrique Maschwitz, Jr.

Argentina’s current economic measures have caused a contraction in its real estate market. The main reason is that sellers cannot get paid in U.S. dollars because of currency exchange restrictions, while buyers cannot get access to dollars or are unable to justify the origin of the funds.

Over the past two years, these circumstances have led to an ever-dwindling number of real estate transactions; therefore, sale prices have remained stable or -in many cases- decreased, especially for middle-class housing.

High-end or luxury properties are a different matter. This market usually operates in U.S. dollars, which are paid overseas via a wire transfer. Both parties agree to transfer the amount of the transaction to the seller’s account and the latter declares the income as part of his/her assets. It is common to find clients who are willing to operate under these conditions.

Enrique Maschwitz, Jr. is a distinguished Argentine notary. He is partner of the firm Escribania Maschwitz – del Campo, founded in the City of Buenos Aires approximately sixty years ago.

BANKING IN THE UNITED STATES – Matthew Beem

“How to Open an Account”

Although it might seem daunting, opening an account (at either a bank or brokerage) is not so difficult. First of all, you have to decide on the bank/brokerage and the level of service (and hence costs) you wish to have. The large US-based banks (Citibank, JP Morgan, Wells Fargo, etc.) have established branches that are specifically dedicated to the Latin American market and have Spanish-speaking account managers. But they aren’t the only option – there are also smaller banks and even online banks/brokerages that charge much less in fees and have lower account balance minimums to open an account. On the other hand, there are also banks/brokerages that do not even accept foreign clients and others that require minimum balances to open the account, so it is very important to find out which bank suits your needs before beginning the account opening process.

Once you have chosen where to open your account, you must provide information (Know Your Client) to the bank so that they can comply with government regulations. This information includes proof of ID and residence of all account holders. For a foreigner, you must normally present a copy of a valid passport, while for proof of residence, you must provide two separate bills – one from a utility and the other a bank statement (from a local bank, local credit card, etc.).

The next step is to justify the funds that you will deposit after the account has been opened. In order to comply with Anti-Money Laundering (AML) laws, the bank and account manager are required to verify the source of the funds deposited into the account. Whether you sold real estate or a business or it is earned income, you must declare this to the bank, but it does not mean that the bank shares this information with third parties (including the government). This is done via a questionnaire that you must fill out, and it is relatively easy.

Once the account is opened, it is also worth noting that if you are going to wire transfer or otherwise deposit a significant amount of money, you should make the bank aware of such and justify the transaction before the fact, because if the bank detects irregularities in the account without prior notification, the bank could even close the account without warning. If the account holder is working with an international branch of a US-based bank, you can do this by telling the account manager, for example, that you sold your house for X amount of dollars and to expect a wire.

Lastly, it is very advantageous to have a signed form called a W-8 on file. This form is used for foreigners without a social security number and allows them to avoid withholding taxes on capital gains and interest (not on dividends). If a foreigner opens a brokerage account, withholding taxes on bond coupon payments, for example, are exempt in the US if there is a signed W-8 on file.

In trying to make good on our promise to begin investigating westward in the United States for potential buyers, we have begun contacting the US Government’s office of Housing and Urban Development (HUD), including preliminary communication with directors of HUD’s Single Family Asset Management division, top Detroit real estate agents, the office of the Mayor of the City of Detroit, and the office of the Governor of Michigan, including the Michigan Economic Development Corporation, and have begun to follow-up with the Detroit Economic Growth Corporation. All of these could help buyers become seasoned in the market up there — as they keep in touch.

Although any realtor can sell a HUD home, Mr. Ralph Newkirk (Real Estate One in Detroit) has been especially helpful. He has been able to give us information from his special position as a “HUD-approved listing agent”; as has Ms Pandra Richie SCRP, SGMS.T l President of Long & Foster Corporate Real Estate Services, headquartered in Virginia (near Washington, D.C.), been very helpful in offering initial guidance for this undertaking. However, neither of them, nor can anyone else mentioned above, or below, be held-responsible for what is written here.

TO BUY, VIA HUD:

To purchase a HUD home, in Detroit, or elsewhere, as an investment (not to live in as an “Owner Occupant”), here are some of the steps to take.

First, go to hudhomestore.com. The system is geared especially for buyers who intend to ‘owner-occupy’, so there is a ‘waiting period’ for investor-buyers to bid, after owner-occupant buyers. (As a matter of fact, the same day this sentence was written, the waiting time changed from a 30-day waiting term, to a 15-day waiting term, for buyer-investors. This is good for ‘our buyers’. ( Ie. NEWS FROM HUD ON DEC 2: “Good Afternoon, Effective today there has been some changes made on the HUD Sales Disposition Program. They are as follows: The exclusive bid period for Insured Properties (IN/IE) is now 15 days- Previously it was 30 days. Also, bid opening procedures for bids on Friday, Saturday, Sunday, or Federal Holidays will be reviewed simultaneously on the next business day. )

Begin by inserting the zip code of interest and peruse the site. Owner-investors can only bid on “UI” (uninsurable) and can not bid on “IN”(insurable) properties, initially.

Additionally, prospective investors can not bid without a realtor. Note: HUD pays the commission for the realtor – on both the sale’s and buyer’s sides of the transactions.

To bid, one must have have proof of available cash. This would include demonstrating a bank statement, less than 30-days-old, with an amount at least equal to the bid. This bank statement does not need to be notarized, and one can cross-out account numbers, and withold private information. It only needs one’s name and the relevant amount.

Also, an identification number is needed to bid; which usually is the Social Security number, and in the case of a non-US citizen could be a picture ID.

Earnest Money must be available to make a deposit. The amounts required are 500 dollars if the bid amount is under 50,000, or 1,000 if the bid is over 50,000. This money needs to be in cashier’s check or money order. No personal checks or cash will be accepted. This money is required only if one is the winning bidder. If the bid is accepted, two business days are given to get the Earnest Money to the listing agent’s escrow account.

Incidentally, when placing a bid, there’s an option one’s broker can make to be a ‘Back-Up” bid, should another bid fall-through, for whatever reason.

If the bidder is the winning bidder, the successful bidder is notified within 24 hours. If not notified by then, one didn’t win. Also, if nobody won the bid, the property will still be on the hudhomestore website, and the bid can be adjusted to a higher amount, presumably.

Also, if one is the winning bidder, there are five business days to do a personal property inspection. If the potential purchaser is not satisfied with the personal property inspection there are five days to get the Earnest Money back. One notifies HUD of this intention via the buyer’s agent.

HUD will not make any repairs or reduce the price due to the inspection. HUD homes are sold “As Is”. These are among HUD’s first words on the HUD website.

The property must “close” within forty-five days within the date of the accepted bid.

As buyer, one chooses the title company, to check liens, etc.

If the title is clear, the title company notifies HUD and the prospective owner to set a closing-date. HUD needs seven days to close. The title company should be in contact with everyone to make a closing somewhere in Michigan, in the case of HUD-owned homes for sale in Detroit. (It is suggested one changes the locks immediately after purchase of the property.)

ABOUT DETROIT, GENERALLY:

One can Google and see among the foreign money investing heavily in Detroit, there is substantial Chinese investment. There are also Australians, among others, investing in Detroit. One president of a very large US real estate firm, without core business in Detroit, said: “…having recently been able to get a tour of Detroit, I think it is one of the BEST places to invest in right now. Tremendous opportunity going forward!” (Emphasis in original).

However, one should not expect to make quick money on turnover – buying a wreck and fixing-it-up – in Detroit.

Average prices for HUD homes are about 30,000, and rentals can fetch, we are told, between 500-800 per month.

BEYOND HUD:

Without HUD, by using a realtor, there are also other areas to search for opportunity in and around Detroit, for property in bank-foreclosure.

For example: We are told of one zone in Detroit with stunning houses, and interesting heritage, where one can buy an attractive brick home, for 80 or 100,000 dollars, or less, is the Boston-Edison zone.

Note, on the video that the said-to-be largest residence in the area, the home of former Fisher Auto Body president, Charles T. Fisher, with about 1,000 sq meters, is said to have sold – according to the video — for 600,000 in 2008. (Actually, it was sold for 625,000, when the crisis was less-pronounced.) Today, we understand, it might bring about 300,000, but may have squatters living inside it. The price could be even lower, than 300k, if it’s been stripped of important items, such as copper and furnace(s). Nevertheless, we are told, the rental income could approximate 2,000 a month.

We understand all of these properties can be good for renting, and real estate firms in the region have property management teams to help with this. Generally, they charge up-to 20% per month. (Argentico SRL can provide details.)

ONGOING RESEARCH:

As mentioned in the first paragraph, we have begun opening the doors for Latin American buyers, across the municipal spectrum, from the US government, to the Detroit Economic Growth Corporation – with varying results. Furthermore, and maybe very interestingly, we have been told several times, by Mr. Norman S. Jezzeny, a Housing Program Policy Specialist in the Housing Office of Asset Managment and Disposition Division, that another representative from HUD, in-charge of selling HUD homes in bulk, should be very interested to follow-up with us. (We have not yet heard from this person about whom Mr. Jezzeny spoke.)

Among all the government links we have made, we are especially satisfied to report the Detroit Economic Growth Corporation (DEGC), a private non-profit organization that operates as the lead economic development agency on behalf of the City of Detroit, and which specializes in commercial and industrial redevelopment, business development projects and large scale mixed-use development initiatives, has sent web-links for your use. They told us they can provide customized assistance to businesses interested in expansion in the City of Detroit.

The DEGC is especially interested in holistic redevelopment for Detroit, with an eye toward social responsibility; and they would like to see properties which are sold to investors ultimately add value, and promote responsible redevelopment across the whole City.

IMPUESTOS – Alejandro Molieri

A la hora de adquirir propiedades inmobiliarias en los Estados Unidos, las personas que no son ciudadanas de los EE.UU. deben tomar en cuenta el impacto de los impuestos a la renta y a la herencia a los que están sujetas. Un no ciudadano puede adquirir propiedades inmobiliarias en los Estados Unidos de manera directa o a través de alguna estructura corporativa. En términos generales, la adquisición directa ofrece un tratamiento impositivo favorable en cuanto a las ganancias de capital (20% si la propiedad se mantiene en poder del adquiriente por más de un año), pero puede perjudicar al extranjero al exponerlo al impuesto a la herencia (40% sobre el valor de la propiedad inmobiliaria, con una exención de US$60,000). ASUNTOS MIGRATORIOS – Gina M. Polo

En los últimos años Estados Unidos ha visto un aumento en la inversión extranjera en el mercado de bienes raíces. Los extranjeros que desean invertir en los Estados Unidos deben ser conscientes y estar informados sobre las consecuencias de sus inversiones en términos migratorios. FIRPTA –  Israel Sands

There is much discussion as to FIRPTA, which is the law requiring that 10% of the sale price of any real estate be withheld at closing if the seller is not a US resident. This is not a penalty against foreigners, it is not even a tax – it is only a way to make sure that the US government will be able to tax the profit realized on the sale. This is required from foreigners because it is feared that the foreigner, once they collect 100% of the price, may just return to their home country without paying the tax on their profit. Once tax on the profit is paid, a certificate is obtained which allows the release of the 10% withheld.

ELEMENTS OF RISK MANAGMENT & INVESTMENT DIVERSIFICATION

As we are approaching hurricane season in Southern Florida, and many of our Latin American potential buyers already own property there, we want to assure you we have begun investigating options for premium and assorted plans for storm coverage there, and will continue to do so, as part of our service.

Additionally, we keep abreast of the markets for real estate up and down the East Coast of the United States, from Massachusetts – through New York – Up the Hudson River – to Washington DC, Charlottesville, Virginia and other points in Virginia and Maryland, Atlanta, all the way to South Florida, and have begun to expand research westward, to Chicago and Detroit.

TAXATION – Alejandro Molieri, Associate Director of International Tax Services, Berkowitz Pollack Brant, Miami, FL

A non-US individual should consider income tax and estate taxes when purchasing U.S. real property. A non-US individual can purchase the US real property outright or may purchase it through a corporate structure. Generally speaking, purchasing the US real property outright provides for long term capital gain treatment (20% if held for longer than a year) but may leave the non-US individual exposed to the estate tax (40% on value of the US real property with a 60K exemption). On the other hand, purchasing the US real property via a corporate structure will avoid the estate tax issue but will subject any gain to an effective tax rate of approximately 39%. There are structures which will avoid the estate tax while providing for the lower tax rate of 20% (in some cases zero).

In the last several years the US has seen an increase in foreign investment in the real estate market. Foreigners looking to invest in the US should be aware and informed about the immigration implications of their investment. The guidance of an immigration attorney is absolutely essential in this process, as there are many pitfalls that can arise, and not every investment, no matter how large, can serve as the basis of a visa or permanent residence.   

Investors should consider whether they wish to temporarily visit the US or permanently reside. This can mean the difference between applying for a B-1 visa, commonly referred to as the “business or visitor visa” or visas such as the E-2 visa for treaty investors. There is also the EB-5 program, which includes investment in regional centers, that permit permanent residence. The application process for these visas and residence can be very complicated and not everyone qualifies specifically in the case of E-2 visas where the foreign national must be from a country that has a qualifying treaty with the US.
