In the first two phases of the rezoning process, property owners, developers, and project teams work to determine whether a property’s zoning designation supports its intended use. Once rezoning approval is secured, the focus shifts to obtaining the approvals necessary to begin construction.

This final stage of the development entitlement process involves detailed project reviews, coordination with local agencies, and in some cases, additional community engagement. Understanding these requirements can help keep your project moving forward while avoiding unnecessary delays.

What Happens After Rezoning Approval?

After rezoning is approved through the local planning process and public hearings, the project moves into the development review phase. At this point, local governments evaluate the project’s technical details to ensure compliance with zoning regulations, land development codes, infrastructure requirements, and long-term planning goals.

Depending on the jurisdiction, additional review may be required if the project involves a newly created zoning district or special land-use considerations.

Development Review Committee (DRC) Review

One of the first steps in the post-rezoning process is appearing before the Development Review Committee (DRC).

The DRC evaluates how the proposed development will function within the community and whether it meets applicable engineering, transportation, utility, environmental, and planning requirements. Committee members may ask questions about site access, stormwater management, traffic impacts, infrastructure capacity, and other technical considerations.

In Orlando, the DRC meets at the Public Works Department and reviews development proposals on a regular schedule.

The purpose of this review is not to revisit the rezoning decision, but rather to confirm that the proposed development can be constructed in accordance with local regulations and adopted planning standards.

Board of County Commissioners Review

Following DRC review, many projects proceed to the Board of County Commissioners (BCC) for final consideration.

The BCC evaluates recommendations from staff and advisory boards while considering the broader public interest. Questions raised during this meeting often build upon issues already discussed during planning board and DRC reviews.

In Orange County, the Mayor serves as Chair of the Board of County Commissioners, alongside six elected district representatives. Meetings are conducted publicly and are typically televised, allowing residents and stakeholders to follow the decision-making process.

Because both the DRC and BCC generally meet on scheduled cycles, project timelines should account for potential waiting periods between hearings and reviews.

When Is a Community Meeting Required?

In some cases, local officials may request a community meeting before granting final approvals.

These meetings provide an opportunity for nearby residents, homeowner associations (HOAs), and other stakeholders to learn more about the project and share feedback. Unlike formal public hearings, community meetings are generally informal discussions focused on communication and problem-solving.

Project teams can use these meetings to explain:

  • The purpose of the development
  • Expected benefits to the surrounding community
  • Site design and landscaping plans
  • Traffic and infrastructure improvements
  • Measures to minimize impacts on neighboring properties

Community feedback may influence design decisions, although project teams are not necessarily required to implement every requested change.

For example, neighboring residents may express concerns about privacy, aesthetics, or property values. In many cases, solutions such as enhanced landscaping, fencing, buffers, or site layout modifications can address these concerns while still meeting project goals.

Preapplication Meeting for Rezoning a Parcel of Land for Development

The biggest question on your mind when you’re about to buy land or just after you’ve purchased is: How much money can I make from this project? In most cases, you’ve purchased agricultural land and are looking to rezone that agricultural land to increase density. You might be looking to rezone to residential, commercial, or a mix of both. Here’s what you need to know to make the most of your land.

How Do I Start the Rezoning Process?

Once you’ve committed to the project but before the official rezoning process kicks off, you or your engineering team have to collect preplanning data in order to answer all the questions that you’ll be asked later. To define the basic scope of the project, you need to gather planning data.

  • Rainwater and wastewater plans
  • Environmental impact, showing the project’s impact on the land’s flora and fauna
  • Geotech survey to know the soil content
  • Land survey to delineate boundaries as well as show easements, cross-access agreement or any other limitations on the land
  • Traffic report may be required if current traffic patterns will be significantly altered

If a land survey or environmental impact study has been completed already for your land, it will need to be updated. Otherwise, at this stage, you or your civil engineering firm is working with various contractors to gather only what data your specific project needs from the above list.

Determining Which Rules of Land Use Apply for Your Land

Every piece of land is part of a district. The delineation of districts is an overlay on top of on city maps. Every district has its own rules regarding setbacks, zoning and in general, what you can and cannot do. At this stage, you’ll need a development regional impact study, or DRI to ensure your development won’t negatively impact or overwhelm the existing infrastructure. Check out this set of rules as an example from Southeast Orlando. 

If your land is not currently part of a district, you get to make one–and decide what the rules are. Typically, most new districts choose to copy the regulations of the neighboring districts.

If you’re designing the district from scratch, you’re going to create a district that’s compatible with the neighbors. The only way you know if it’s compatible is to talk to the neighbors in a courtroom or other regulated space.

Orlando’s Vision 2050 Growth and Management Plan Refresh

At the time of writing, Orange County is developing the Vision 2050 Growth Management Plan Refresh detailing the newest rules for the districts. Once Orlando’s 2050 Growth and Management Plan Refresh document is completed, the plans won’t typically change again any time soon. However, developers aren’t limited to the land use zoning regulations spelled out in that document. There are ways to change future land use maps and rezoning regulations. It can require more work, but that’s where civil engineering firms can step in and help. By hiring a firm that’s familiar with this document, you save time and money ensuring that you are working to meet the most updated ordinance pertaining to your property.

What Happens at a Pre-Application Meeting?

After the civil engineering firm has gathered the land survey and other planning data for your property, next up is the pre-application meeting with the Authority Having Jurisdiction (AHJ). Your engineering team shares their proposed plan, and explains how much density they think the project will receive in the various areas. They’ll also detail what will be built in each phase of development.

The AHJ you’re interacting with has many departments that your team will be speaking to:

  • Water
  • Sewage
  • Traffic
  • Stormwater

This review process occurs in two parts: the planning department and the zoning department. The zoning department is looking at the past and what zoning regulations have already been established. The planning department is considering future use, and can make adjustments to their future and land use maps (FLUMs), which differ from zoning maps. These FLUMs for Orlando need to match the city’s Vision 2050 plan.

Do I Need A Lawyer to Rezone my Property?

The most efficient use of lawyers is to bring them onboard once the proposed rezoning plan has been approved, which is typically toward the end of the rezoning process steps. After this round of public hearings have been completed, and you and your team understand what everybody needs, then the lawyer works to write these changes into law. If the result of the public hearings is that a specific buffer needs to be created between your project and existing development, then the lawyers write into law that both parties agree this buffer cannot be changed unless there is a different hearing to do so.

Initial Plan Review

After pre-application, the civil engineering firm submits the site plan, along with half of the construction plan. At this point, the grading work at your site is completed, and the utilities and stormwater systems have been completed halfway. Your team now has enough detail to answer the next round of questions moving forward. The review planning committee can provide further details to each specific departments that will need to review your plans and the work completed thus far. They can determine if you’re ready to go to public hearings.

Public hearings can last six to nine months– sometimes up to a year to obtain all the paperwork and approval letters. The timing varies greatly because, if the public asks for changes, your team needs to amend the site plans, resubmit them and then get another public hearing. This is a prime example of where experience pays. A civil engineering firm is more likely than a land owner to submit changes that will be accepted after the first round of resubmitting.

Construction Review and Possible Sale of Project

By this stage, you’ve already passed through the first part of the rezoning process. Most of the questions from the review board have been answered.

From here, it can take another six to nine months to start the construction process and finish the rezoning process. It often takes two years in total to complete all necessary permitting to rezone a piece of land from agricultural use to residential.

Construction can now begin.

However, at this stage, many developers choose to sell the land at this stage to maximize profits relevant to time invested.

The concept of rezoning is simple: Developers rezone when the land they bought doesn’t match the intended use. However, the process itself can be anything but. First you have to understand the property–its limitations, the surrounding developments (current and future) and what all the possible options are, given the city or county’s past rezoning rulings. This is where a civil engineering firm comes in. A firm with decades of experience can not only give you answers about what’s possible, they can facilitate the rezoning process, making it as fast and cost-effective as possible.

Rezoning Basics

A big part of the rezoning process is making moves that are not only permissible by the governing entities, but accepted by the local community, be it farmers, HOAs or the like. These surrounding communities are typically less excited if lower income businesses, such as convenience stores, come in first. However, if these types of businesses do well, then the door is open for further, higher-income development. 

Everything happens in phases.

Let’s say you’re developing 200 acres and that land is surrounded on all sides by agriculture, and you want to change the zoning of your land to residential. Development at this stage doesn’t start with condos. Instead, you’ll likely be approved for a low-density residential project, such as one house per acre. Once there are some subdivisions in place with one home per acre, then the next developments come in, building two homes per acre. The allowable density keeps doubling the closer you get to the city center, until you reach 16 units per acre, which is average for condo and apartment developments.

In addition to density requirements, considerations have to be made regarding property value. If what is being developed is considered less attractive to the current community, a concession of some sort typically needs to be part of the plan.

One of the most cost-effective solutions when rezoning is to design a buffer, such as a greenspace or fence, to further separate existing residential or other development from your project, in the event that your project is residential and will have a higher density rate than the existing areas.

In the example of Orlando, once a freeway like the 429 has been built, that changes the rules. Now the outlying agricultural areas have a FDOT highway intersecting them. Because of that increase in traffic, now the city doesn’t want low-density housing built. Now they will want commercial use and higher-density housing.

If the land is agricultural but surrounded by industrially zoned land, the development will need to be industrial. You couldn’t rezone to residential. At best, could rezone to commercial. For example, when you see Amazon warehouses next to highways, the surrounding lands couldn’t be zoned residential. The industrial warehouses produce excessive noise. At best, you’d need a 100-foot buffer, but even then, you may not be able to zone the land residential.

Know Your Neighbors

The rezoning process steps can get very political. One key thing is to know who your neighbors are. In other words, if a senator, city commissioner, other government official, CEO of a large company or anyone else with significant community pull lives in this adjacent community, that’s something you want to know ideally before committing to the development project.

If you find out this information after the project has started, it can be helpful to hire lawyers in some cases to serve as the go-between to help keep the discussion civil. In many development projects, people can be the most complicated and unpredictable part of a project. The more experience your team has in handling community concerns, the greater your odds of success.

How Civil Engineers Help with Rezoning

In the above example of a buyer purchasing 200 acres, let’s say they don’t have a set plan as to how to develop it to achieve maximum profits. The plan will show the development in phases, and can be designed based on what amounts of money you need to make right away.

Civil engineers can help show you the big picture. They provide comps for your finished development project, letting you know what your projected profits might look like. Because they work with builders as well, they can provide cost estimations for the build to further help you dial in your numbers.

Most of all, with the right civil engineering firm, anything can work. We can get you 90% of what you want. The other 10% is dictated by the neighbors. If the neighbors either don’t show up or don’t care, then that 10% is decided by the jurisdiction, and you simply have to match your neighbors. But, if that last piece is decided by the neighbors, it helps to have experience on your side. Ideally, you and the team representing you approach the community with understanding–both of the community’s needs and what might work to meet those needs, as well as your budget and bottom line. In many cases, it comes down to finesse.

Timing for Rezoning

The amount of time you need to budget for the rezoning process steps is up to you. Every project consists of a lot of moving pieces. A civil engineering firm can help you as much or as little as you need, based on your budget and experience level. More seasoned developers may simply need a sounding board for a complex project. Other developers may want the engineering firm to handle all the land rezoning requirements for them. Chances are, you don’t want to go it alone. If you do, you may get bogged down in the details and miss crucial details and deadlines.

Working with an AHJ

Throughout the process, you or your civil engineering firm will be answering to and working with just one AHJ, or authority having jurisdiction over the zoning ordinances, aka the local laws governing how land can be used in whichever jurisdiction you’re in

If the land lies within city limits, then the city is the AHJ. If the land falls in an unincorporated area, then you’re dealing with the county. The AHJ may also be the state, Bureau of Land Management, U.S. Forest Service or a handful of others.

A civil engineering firm can kick off the process by confirming which AHJ oversees your land. In most cases, we are familiar with their code already, which streamlines the review process, helping you reach a finished product sooner.

It’s a win-win when stormwater design can take advantage of the latest green infrastructure practices, supporting local ecosystems and potentially reducing the square footage of your project set aside for stormwater management. 

Burkett Engineering stays on top of these innovative green technologies to give you more options when planning your next development project. The following trends and advancements might be worth incorporating into your next build.

Permeable Pavements

Porous asphalt, concrete and pavers allow more rainwater to be absorbed into the earth, reducing stormwater runoff. These materials also filter metals, oil, fertilizers and pollutants while absorbing nutrients, such as nitrogen and phosphorus.

Permeable pavements reduce overall flooding. Rainwater has to go somewhere, and the more that your site can absorb, the less run-off that needs to be addressed in the site plan. For example, if you build a large permeable parking lot, your site will require a smaller stormwater pond.

The initial materials and installation costs may be higher, but this investment typically pays off over time. Permeable pavements require less maintenance, cleaning and repairs. In some cases, the use of these materials eliminates the need for separate drainage systems. Moreover, these environmentally friendly materials typically have a much longer lifespan. A regular concrete parking lot may last 30 to 40 years, whereas permeable concrete can last for 60.

Bioretention Systems

Bioretention systems act much like stormwater ponds, but are designed with plants to mimic nature-made ponds.

One example is a bioswale, a shallow, gently sloping landform that directs rainwater to a drainage system. A rain garden also serves the same function. The surrounding landscape around these man-made ponds is strategically sloped to funnel water here to be absorbed. Smaller versions can also be included within the design of your parking lot. With all designs, the benefits are many.

Water Quality

     Pollutant Removal
Plants will absorb additional nutrients and run-off, reducing the amount of wastewater. These will also help absorb the fertilizer run-off from lawns, which would otherwise feed the algae in any downstream waters.

     Groundwater Recharge
By acting like a natural pond, this system filters stormwater, allowing it to percolate back into the ground where it will, over time, rejoin the groundwater supply.

     Peak Stormwater Flow Reduction
These systems will also reduce and deter the maximum amount of water that might surge through a site during a hurricane or other storm.

     Runoff Reduction

     Reduction of Heat Generation
Cities, with their masses of paved areas, are known for generating and trapping in heat in what’s called the Urban Heat Island Effect. By adding green spaces, we help break up this problem. Plants and ponds evaporate water and help cool the surrounding areas — of utmost importance in Central Florida.

     Additional Greenspace
These ponds and systems provide areas that are aesthetically pleasing, and can be designed to allow for employee or public use, when appropriate.

Biofiltration Systems

Stormwater ponds can only provide so much stormwater treatment. The next line of defense is a biofiltration system. Rather than allowing the water to soak back into the ground, these systems rely on filters such as sand or superior materials to polish and clean the water, allowing it to reach purification levels great enough that it can be discharged back into the environment.

With filtration systems, developers can make the runoff water as clean as they want. This typically means choosing different filter media. Biologically-activated media, or BAM, can break down pollutants on the microbial level. These porous materials allow microorganisms to colonize and aid in the filtration work. BAM choices are superior to sand and include granular activated carbon, or GAC, as well as activated filter media, or AFM.

This is an increasingly popular option due to Florida’s new, more stringent criteria required of water quality enhancement areas (WQEAs) as per House Bill 965, now Chapter 2022-215, Laws of Florida. Under this new legislation, WQEAs generate credits based on the extent to which they filter pollutants, and these credits can be sold to government entities. It’s one more reason that it’s worth taking the time to explore green infrastructure solutions while you’re still in the nascent stages of project planning.

DESCRIPTION

The South Orange Medical Complex, located at 2130 S. Orange Avenue in Orlando, Florida, is a newly developed Class A medical office and retail space. Completed in early 2025, this three-story, 53,048-square-foot facility is situated on a 1.52-acre site in the heart of Orlando’s SODO district, the complex provides convenient access to Orlando Health Orlando Regional Medical Center and other medical facilities.

With 308 parking spaces, the complex ensures ample parking for both tenants and visitors.

Proper site assessment sets a project up for success. It guarantees that the land a client is buying or will buy matches their plans and intended use.

Does Your Site Need a Land Development Site Evaluation?

A completed site assessment report serves several uses. It: 

  • Helps you determine if your project makes financial sense. 
  • Gives you an outline of next steps to help your build stay on schedule. 
  • Serves as your guide for the project. 
  • Serves as a guide that subcontractors can refer to to help avoid later constraints or issues.

Every client’s need for due diligence varies. If you’re borrowing money for the build, you’ll need due diligence to assure the bank that is lending you the money. If the project comes with risk, whether slight or significant, it helps to have more data before breaking ground. 

However, if it’s a clean piece of land and you have ample experience building, you may not need a thorough site assessment.

Considerations for Land Development Site Analysis

During civil engineering site analysis, all environmental assessments are completed. 

This determines all previous uses of the land, including whether it was ever used as a farm, gas station, dumping grounds, diesel storage site or something similar that would require remediation or similar type of clean-up work.

This phase starts with the basics, including:

  •     Address
  •     Parcel ID
  •     Ownership

With these pieces, we also determine zoning uses and limitations, as well as allowable future land uses. In some cases, the municipality’s zoning requirements may require you to undergo a rezoning process to alter the land’s use to match your needs. Building subdivisions will require a platting of the land, and may require rezoning, depending on the previous use of the land.

Phase Two is the more comprehensive study, which includes a deep dive into environmental site assessment. This phase utilizes aerial maps, FEMA flood plans as well as our own on-site examinations. Here is what is considered during this phase.

Stormwater

When we are gathering info about stormwater, we consult a soils map to determine your land’s drainage criteria. With this info, you’re better equipped to move forward with your plans, knowing how much land is buildable and how much needs to be designated for drainage.

In most cases, your plot must set aside 20% as unbuildable land delegated to stormwater runoff. For example, if you purchase 100 acres, and 50 of those acres can be developed, then a minimum of 20% of your 50 acres (10 acres) will be set aside as stormwater use only. 

It’s crucial during the planning stages to not underestimate stormwater allotment.

Soil Testing

Soils also need to be evaluated. The better the soil composition, then the greater the site’s availability to store water underground rather than require additional water diversion and retention measures to be constructed.

Impaired Waters

Depending on its location, the build site may also need to take extra precautions to restore and protect impaired waters, whether it’s the Wekiva River Basin or The Butler Chain of Lakes. If the site’s water runoff connects to Lake Apopka or Lake Okeechobee, builders face additional water quality treatment requirements – all of which come at additional costs. Environmental Impact

A key piece of this phase is the overall evaluation of the environmental impact. 

For example, if the land is near to or impacts wetlands, a plan must be made to avoid impact or to minimize impact. This can be achieved by purchasing wetlands mitigation credits to mitigate impact, but again, this is another budget line item in the build.

For larger projects, it might make financial sense to go ahead and mitigate to gain the additional square footage, allowing the most use from your land. For smaller projects, paying for mitigation might not make sense. 

Another factor is the classification code of the wetlands; for example, impacting a Class 1 wetlands incurs a greater cost. But if the area is simply a low-lying area and not classified as an official wetlands, the fee is nominal.

Threatened and Endangered Species

Also included in our environmental site assessment is consideration of any possible threatened and endangered species associated with your land. In Central Florida, the species of note include skinks, gopher tortoises and bald eagles. As with water concerns, any threats to animal species will be calculated in terms of severity and financial impact.

Next Steps After Site Assessment Completion

At the end of our due diligence process, we provide a narrative report of our findings. We explain what the codes require in terms of setbacks, building heights, and other code requirements. 

We walk you through what those requirements are and how they match your building plans. In some cases, we also provide a conceptual plan to show how many lots can be configured on your land, or how much square footage is usable based on the criteria we assess.

At this stage, we can also offer suggestions to better determine what may need to happen before you break ground. Suggestions may address:

  •     Utilities
  •     Stormwater
  •     Permitting
  •     Department of Transportation build requirements
  •     Army corps of engineers build requirements 

After due diligence is completed, then the next step is to ensure all plans and permits are ready and approved. Next, it’s time for site preparation for construction. This includes all clearing, grading, excavating work, erosion control and infrastructure work.

It has become paramount for land development engineers to learn and master a suite of software tools from Computer-Aided Design (CAD) to industry-specific tools like StormWise. 

As with any profession, understanding the nature of the task and the mastery of one’s craft sets a great engineer apart from the layman. 

 

In this blog, we’ll break down the key tools used by land development engineers and the utility of each software.

CAD Software

Computer-aided design (CAD) software enables most engineering tasks in land development. The software allows civil engineers to design complex site layouts, road alignments, grading plans, and drainage systems with precision.

Civil 3D

Civil 3D by Autodesk is the most useful tool for land development engineers. Civil 3D can model changes required for land development, including the placement of structures. 

Its geolocation capabilities incorporate real-world mapping of features like elevation to ensure designs align with actual site conditions. It provides a realistic view of:

  • Alignments
  • Vertical surfaces with corridors
  • Grading groups, and 
  • Feature lines 

 

Being able to visualize these elements allows for precise site grading. 

Within Civil 3D, there are several useful plugins. Vehicle Tracking provides accurate information from municipalities to create models for vehicles, mainly firetrucks, ensuring essential emergency vehicles can easily navigate a development.

BIM Software

Building Information Modeling (BIM) software has transformed processes for land development engineers by enabling the creation of models that replicate physical locations in 3D. 

InfraWorks is a BIM software by Autodesk designed for civil engineers that allows users to create, analyze, and visualize infrastructure projects using 3D models that integrate physical and functional characteristics of real-world objects.

GIS Software

Geographic information systems (GIS) allow users to visualize and interpret geographical data visually, helping them understand and problem-solve relationships, patterns, and trends. 

Software like Google Earth Pro gives engineers access to integrated geographical data and street views, helping them better understand the location for land planning, environmental impact studies, and zoning.

Hydrology and Stormwater Management Software

There are several different tools required for tasks in hydrology and stormwater management. Stormwater events need to be modeled over time, and multiple factors dictate which calculations are required for pressurized piping and sizing wet and dry ponds.

EPANET 2.0

Epanet 2.0 models water pressure in pipes, which are typically connected to fire hydrants and buildings. The main reason for modeling pressure within these pipes is to ensure sufficient pressure, measured in Gallons per Day (GPD), even if hydrants and structures use the maximum amount of water in a given event.

Hydraflow

Hydraflow is a tool within Civil 3D that aids users with an analysis of stormwater routes from a high point to a low point to ensure the water reaches the output, usually based on a 10-year event. This analysis is critical to understanding the maximum stormwater likely to impact a drainage area and avoid overflow (HGL) going above structures. Software like Hydraflow aids land development engineers with critical decisions when flow rates are predicted to push a drainage system past its limit. This problem can often be solved by raising or lowering structures or increasing pipe size.

PONDS 

The PONDS 3.3 Application Suite is stormwater drainage calculation software designed for civil engineers in the state of Florida to design, analyze, and create permit-level support documentation for wet and dry retention or detention ponds and to size water quality treatment ponds according to Florida Department of Environmental Protection (FDEP) stormwater rules. In short, software like PONDS 3.3 allows land development engineers to calculate and create supporting documentation for sizing wet or dry ponds.

Document and Calculation Tools

Land development engineers also utilize tools for document creation and cost estimation. 

Excel

Excel is integral for land development engineers, enabling accurate cost estimates and calculations for reports. It efficiently handles large datasets for specific scenarios like pond modeling. Data can be shared between AutoDesk’s CAD software and Excel using DataLink so that changes made on one software are reflected in the other.

Word

As with any other business, Microsoft Word is required for land development engineers. Word is mainly used for communication between clients, contractors, and municipalities. It is most often utilized for Respond to Comment (RTC) letters, transmittal letters, and client coordination.

Bluebeam

Bluebeam is design software that helps engineers gain actionable data insights and standardize communication across the project lifecycle. 

The software is used for markups and plan reviews in PDF format. Bluebeam offers specific tools to set a uniform scale to be applied across a document or plan and enhanced zoom features that maintain resolution.
