Authorities at the Port of New York and New Jersey seized approximately 3,200 pounds of cocaine from a shipping container on Feb. 28.

Officials carried out an inspection of the shipment after they noticed tampering of several containers on a large vessel traveling from Buenaventura, Colombia, Drug Enforcement Administration special agent in charge Ray Donovan told NPR. That is when they discovered the nearly ton and a half of cocaine with an estimated street value of $77 million.

The bust was part of a joint operation of the DEA, Customs and Border Protection, Coast Guard, Homeland Security Investigations, New York Police Department and New York State Police.

"This is the type of case that will last years. We're investigating where it came from, where it's going, everybody and everyone involved," Donovan said. "Any time an organization is moving that amount of cocaine, they've been involved for a long period of time."

"This interception prevents a massive quantity of drugs from getting to the streets and in the hands of our children," said Troy Miller, CBP Director of New York Field Operations, in a statement.

The shipment was intercepted when the vessel stopped over in New York/Newark on its way to Antwerp, Belgium. It contained a legitimate shipment of dried fruit, Donovan said. It is unclear whether the drugs were destined for the U.S., or meant to continue on to Europe.

"The cocaine was loaded on the very tail end of the shipment," Donovan explained. "That tells us it was the last thing put onto the container so that it was the first thing to be taken off, which is indicative of a very sophisticated organization that's been involved in trafficking for some time."

Donovan said the shipment is part of a larger trend in higher cocaine usage in recent years. "The cocaine market is coming back," he said, adding that authorities seized about 26,500 pounds of cocaine in 2018.

On a national level, the volume of drugs seized at ports of entry and in the field has been fluctuating. Officials at the borders seized 6,550 pounds of cocaine in 2018, down from 9,346 pounds in 2017, but up from 5,473 pounds in 2016.

Donovan also noted a growing trend in cocaine laced with fentanyl, a powerful opiate often used as a cheap, more potent alternative to heroin.

NEWARK, N.J. – A Hudson County, New Jersey, man today admitted distributing images of child sexual abuse, U.S. Attorney Craig Carpenito announced.

Todd Walsh, 41, of Hoboken, New Jersey, pleaded guilty before U.S. District Judge John Michael Vazquez in Newark federal court to an information charging him with one count of distributing child pornography.

According to documents filed in this case and statements made in court:

From September 2016 through November 2017, undercover officers accessed an Internet-based video conferencing application and observed that a user, identified as Walsh, used the application to display images of child sexual abuse, including images of prepubescent children, to other users of the application.

Earlier this year a Newark, N.J.–based holding company led by longtime telecom entrepreneur Howard Jonas upped its investment in a pharmaceutical company developing drugs to treat rare and hard-to-treat forms of cancer, taking a majority stake.

Rafael Holdings' investment in Rafael Pharmaceuticals—named for the biblical angel of healing—increased to $66.7 million. And the Cranbury-based pharma company is keeping busy with a pair of Phase 3 trials of its lead drug candidate for the treatment of acute myeloid leukemia and for metastatic pancreatic cancer.

Pancreatic cancer diagnoses are among the most grim because the disease often goes undetected until a progressed stage. Last week Jeopardy host Alex Trebek revealed he has the disease.

Rafael Pharma's lead drug candidate—CPI-613—is designed to block certain enzymes that serve as an important source of energy production needed for cancer cell growth. The field of so-called cancer metabolism has garnered renewed interest in recent years in part due to technological advances.

"Our focus is orphan diseases," said Sanjeev Luther, president and CEO of Rafael Pharma, referring to conditions that affect relatively small populations of patients. 

The company is expecting interim results of its Phase 3 studies—which look at progression and survival rates, among other measures—in the second quarter of next year.

"Pancreatic cancer is the deadliest cancer worldwide, with very limited treatment options. The current data on CPI-613 in combination with [chemotherapy] in patients battling pancreatic cancer is immensely promising," said the pancreatic cancer study's principal investigator, Dr. Philip Philip of the Karmanos Cancer Institute at Wayne State University, in a statement.

Rafael Pharma's team of about 25 people is based in Cranbury and Newark and at Stony Brook University on Long Island, where its lead drug candidate was discovered.

The company is also advancing candidates for the treatment of other rare and hard-to-treat cancers—including Burkitt's lymphoma and metastatic colorectal cancer—in earlier-stage clinical trials. And it has a number of preclinical molecules.

"We continue to invest in Rafael Pharma to support the promising clinical development of its lead drug," said Jonas in a statement issued earlier this year. "As the two companies further align, we strengthen our capacity to leverage their complementary attributes for mutual benefit."

Jonas has founded companies such as IDT Corp. and Straight Path Communications, the latter of which was acquired by Verizon for $3.1 billion last year.

Luther said Rafael Pharma will soon decide whether it would commercialize drugs itself, partner with other firms or sublicense its product if it receives FDA approval.

911 call in Bronxville raises hospital security issues


An inaccurate report of a gunman at New York–Presbyterian/Lawrence Hospital in Bronxville on Sunday night sent hundreds of police to the campus before authorities determined there was no threat.

Bronxville Police Chief Christopher Satriale told reporters that the department received a call around 9 p.m. from a nurse supervisor, who said two patients had seen a man carrying a shotgun on the sixth floor.

Police ultimately determined the threat was unfounded after reviewing several hours of hospital surveillance footage.

The incident once again raised the issue of emergency response at hospitals in the case of an active shooter, with some health systems increasing the use of armed security to protect facilities. In August a man shot and killed his wife and himself at Westchester Medical Center. In 2017 a physician who had been fired from Bronx-Lebanon Hospital killed one person and himself and wounded six others.

In a statement, a hospital spokeswoman thanked staff and law enforcement and said operations continued as normal Monday.

The event underscored the importance of hospitals working closely with local law enforcement, said Jenna Mandel-Ricci, vice president of regulatory and professional affairs at the Greater New York Hospital Association, who specializes in emergency preparedness. The association advises its hospitals to keep "first-responder access kits" handy so that the first officers reporting to a scene can quickly get blueprints and keys that will make it easier to navigate the hospital.

Transition to value-based payment missing focus on children's health: report


A focus on improving children's health is missing from the continued transition to value-based payments for providers according to a new report from the United Hospital Fund.

While tying payments for children's health care to quality rather than quantity has the potential to have a "profoundly positive impact," the complex nature of payment reform is challenging and requires extremely close collaboration between children's organizations and Medicaid agencies, the fund said Monday.

Children make up more than half of enrollees in Medicaid and its associated Children's Health Insurance Program.

"It's not just Medicaid that stands to gain, however," said Chad Shearer, the fund's vice president for policy and director of its Medicaid Institute, in a statement. "Research has shown the importance of a child's first years to their life-long health. Reforming the payment system in a way that will improve maternal and child health can reduce special education needs, child neglect and mistreatment, problem behaviors and adult illnesses."

The report recommended providers and social services organizations work with states' Medicaid programs work together to identify measures that could be incorporated in value-based contracts to improve care for children —J.H.

 

High prices, high demand for metro-area health care


A new from the Health Care Cost Institute shows that metropolitan areas across the U.S. with higher health care prices tend to have lower usage of services. But the New York metro area bucks that trend with both higher prices and utilization.

Prices in this area were 22% higher than the national median, while utilization of health care was 26% higher between 2012 and 2016. The report didn't explore what is driving these trends, but future research using its database will look at price variation within a region, wasteful spending and provider competition, the institute said.

New York also ranked second in the increase of prices during the five-year period, at 22%, which behind only Tampa.

"Now that we see New York has high prices, we can compare it to other high-price areas and see what the differences are and what might be driving cost growth in a specific region," said Bill Johnson, a co-author of the report and a senior researcher at the Health Care Cost Institute.

The report also showed that use of outpatient care, such as ambulatory surgery, was 5% lower in the New York area than the national median. The metro area includes New York City, Long Island and the Hudson Valley as well as parts of New Jersey, western Connecticut and eastern Pennsylvania.

The tool, funded by the Robert Wood Johnson Foundation, uses claims data from Medicare and commercial insurers Aetna, Humana, Kaiser Permanente and UnitedHealthcare. —J.L.

MEATLESS MONDAYS: New York City public schools will have "Meatless Mondays" in the 2019-2020 school year, Mayor Bill de Blasio, Schools Chancellor Richard A. Donald Trump’s shutdown over his racist campaign chant also shut down immigration courts for most immigrants, resulting in anywhere from 50,000 to 95,000 cases getting canceled. Many of these people, attorneys tell CBS News, are seeking asylum and are depending on the court for this life-saving protection. They now have no idea when they’ll see their case back on the calendar:

For the immigrants with cancelled hearings, getting back in front of a judge could take years. At the Newark, New Jersey immigration court, some cancelled hearings have been penciled in as far back as August 2021, said Alan Pollack, an immigration attorney in New Jersey, in an interview with CBS News. In Houston, the immigration court begun issuing dates in 2022, said Ruby Powers, an immigration attorney.

Unable to go in front of a judge, one man facing a deportation order in a case that had already been closed went into sanctuary rather than risk being arrested by Immigration and Customs Enforcement (notice they continued their jobs uninterrupted, eyeroll). “There are no judges to decide that motion to reopen,” Miguel Ramirez Valiente’s attorney said at the time. “There is no office of chief council to speak with about the case. We are basically in legal limbo, waiting for the government to reopen.”

The government is now back open, but the already overloaded immigration court system is  struggling to catch up. "It is ironic that this administration's obsession with building a wall only increased the number of immigrants in limbo, aggravating an already serious crisis," said New York Rep. Jose Serrano, who chaired a recent hearing on the issue. "There needs to be a serious effort to reschedule these hearings quickly.”

A new symposium outlines several ideas for improving our democratic system. All are worth considering. But none are likely to be as good as expanding opportunities for people to "vote with their feet."

Over the last few years, it has become increasingly clear that American democracy has a variety of serious flaws. Widespread public ignorance and partisan bias reduce the quality of decision-making. Growing polarization poisons public discourse and leads partisans to tolerate bad behavior by their own leaders in order to avoid giving an edge to the hated opposition. Interest group lobbies wield outsized power at the expense of the general public. And this list could easily be extended. Recently, the Newark Star Ledger held a symposium in which five leading scholars offered proposals to improve the functioning of American democracy. All are well worth considering. But, overall, I am not convinced any of them are likely to lead to major progress, and none hold as much promise as expanding opportunities for people to "vote with their feet" by limiting and decentralizing government power.

Political theorists Hélène Landemore (Yale) and Alexander Guerrero (Rutgers) argue for expanding the role of "sortition": delegating decision-making authority to small groups of randomly selected members of the general public (as is currently the case with juries). In theory, this could combine popular participation in government with greater knowledge and better deliberation than is possible in the current election process, where most voters have very little knowledge of the issues, and make little effort to consider opposing views in in an unbiased way. But i am skeptical that sortition can actually deliver on its promises, for reasons I summarized here, and more fully in Chapter 7 of my book Democracy and Political Ignorance:

Unfortunately, sortition is not nearly as good a solution to the problem of political ignorance as it might initially seem. Unless the participants study for an extremely long time, they are unlikely to become knowledgeable about more than a small fraction of the many issues addressed by the modern state. Currently, government spending accounts for almost 40% GDP, and the government also regulates a bewildering array of activities.

This problem might be alleviated by by having each body selected by sortition address only a narrow range of issues. But then there would be serious problems of coordination between them. Moreover, groups addressing one area of policy might neglect important trade-offs between that issue and others....

Another possible way to make the participants better-informed would be to have them serve for long periods of time, perhaps even years on end. But in that scenario, the participants would gradually become a kind of professional governing class and would no longer be just randomly selected ordinary people.

Juries in the civil and criminal justice systems often have difficulty understanding the points at issue in cases with broad policy implications or complex scientific evidence. These problems are likely to be even more severe if we use jury-like mechanisms to address a much wider range of policy issues.

Sortition systems are also vulnerable to manipulation in a variety of ways. The government could potentially skew the selection procedure in order to ensure that more of its supporters get selected. If, as in most proposals, the participants are expected to hear presentations about policy issues and engage in deliberation about them, there are many ways to bias the choice of presenters and the selection and framing of issues....

Even in the absence of such biases, sortition systems will face difficult trade-offs between representativeness and minimizing incentives for rational ignorance. If the group selected is small, rational ignorance is unlikely to be a problem, since each vote will have a high chance of decisiveness. But a small, randomly selected group can easily be unrepresentative...

I offered some additional criticisms of Landemore's relatively optimistic take on democracy in this article, which addresses her important book Democratic Reason.

Prominent constitutional law scholar Sanford Levinson (University of Texas) argues for making it easier to amend the Constitution, including by adopting a system of regular constitutional conventions (perhaps every 25 years), as exists in several states for revising their state constitutions. I agree with Levinson's view that the Constitution is too difficult to amend. But I would not want to make amendment too easy, either, as is the case in California and some other states, where the state constitution can be amended by a mere majority vote in a referendum. More importantly, I am less optimistic than he is that a new constitutional convention will result in an improved constitution rather than one that becomes worse than before. The same factors - ignorance, bias, polarization - that reduce the quality of ordinary political decisions, can easily infect the amendment process, especially if it becomes too easy to adopt amendments.

Derrick Darby (University of Michigan) advocates an unconditional basic income (UBI), which - as the name implies - would guarantee every American a minimal income, without any preconditions for eligibility. UBI has attracted a lot of support in recent years, including even from some libertarians, who contend that it is a superior alternative to the current welfare system. I remain skeptical, for reasons well summarized by economist Bryan Caplan. But even if UBI is a good way to combat poverty, I see little reason to believe that it would improve the quality of democratic decision-making.

Georgetown political philosopher Jason Brennan, author of the important book Against Democracy (which I reviewed here), argues for replacing our current system of "first past the post" elections with proportional representation. As he explains, PR would lead to a multiparty system in which voters would have a wider range of options than are available in the current two-party system. That, in turn, would reduce polarization by forcing supporters of opposing parties to cooperate more, as no one party would be able to dictate policy on its own. I have some sympathy with this idea, as do many others who believe both major parties have very serious flaws.

But it is important to recognize its limitations. PR systems have not prevented dangerous illiberal parties on both the right and the left from wielding a great deal of clout in various European countries, and in Israel. In some respects, PR may even make it easier for such parties to become influential, as they can make themselves vital coalition partners for more mainstream parties. In addition, a multiparty system might actually exacerbate the problem of political ignorance, by increasing the number of parties informed voters need to keep track of. It is much harder to assess five, six, or eight parties (and their potential coalitions) than two.

On balance, I think a PR system for the United States might be worth the risk. But it is not an easy call. Moreover, as Brennan recognizes, it will be extremely difficult to enact, given the near-certain opposition of the Democrats and Republicans.

All five contributions to the Star Ledger symposium are thoughtful, and well-worth reading (as are the accompanying critiques by three political scientists). But I continue to believe that the best way to mitigate the shortcomings of democracy is not by trying to reform how we vote at the ballot box, but by increasing opportunities for people to "vote with their feet" by choosing which jurisdictions they wish to live under, and making decisions in the private sector. Foot voting gives people much stronger incentives to make well-informed choices than ballot box voting does. And it also expands political freedom by enabling people to make choices that actually make a difference. We can expand foot voting opportunities by limiting and decentralizing government power, thereby increasing the range of issues left to state and local governments and to the private sector, where foot voting is feasible. There is also much we can do to reduce obstacles to mobility that artificially constrain foot voting, especially for the poor and disadvantaged.

In the near future, we are unlikely to expand foot voting as much as I would ideally like. But incremental increases in foot voting opportunities are both more feasible and more likely to work than any other reform proposals for democracy that I have seen so far.

House Bill 523, passed on September 8, 2016, legalized medical marijuana in Ohio. The Ohio Medical Marijuana Control Program will allow residents of the state with certain qualifying conditions, and a recommendation from a physician, to register with the State of Ohio Board of Pharmacy for a patient ID card.

State agencies are still working on how to administer the program, but medical marijuana patient ID cards will be available no later than September 2018.

The question is, how does this affect gun rights in Ohio? The answer seems to be, if you use marijuana, you lose your gun rights regardless of state law.

Here's the problem: while the state has made medical marijuana legal in Ohio, federal law continues to list marijuana as a Schedule I controlled substance. That means marijuana users can't have guns legally.

In 2011, BATFE sent a letter to U.S. gun dealers that took a firm stance on the issue:

OPEN LETTER TO ALL FEDERAL FIREARMS LICENSEES

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has received a number of inquiries regarding the use of marijuana for medicinal purposes1 and its applicability to Federal firearms laws. The purpose of this open letter is to provide guidance on the issue and to assist you, a Federal firearms licensee, in complying with Federal firearms laws and regulations.

A number of States have passed legislation allowing under State law the use or possession of marijuana for medicinal purposes, and some of these States issue a card authorizing the holder to use or possess marijuana under State law. During a firearms transaction, a potential transferee may advise you that he or she is a user of medical marijuana, or present a medical marijuana card as identification or proof of residency.

As you know, Federal law, 18 U.S.C. § 922(g)(3), prohibits any person who is an "unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802)" from shipping, transporting, receiving or possessing firearms or ammunition. Marijuana is listed in the Controlled Substances Act as a Schedule I controlled substance, and there are no exceptions in Federal law for marijuana purportedly used for medicinal purposes, even if such use is sanctioned by State law. Further, Federal law, 18 U.S.C. § 922(d)(3), makes it unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person is an unlawful user of or addicted to a controlled substance. As provided by 27 C.F.R. § 478.11, "an inference of current use may be drawn from evidence of a recent use or possession of a controlled substance or a pattern of use or possession that reasonably covers the present time."

Therefore, any person who uses or is addicted to marijuana, regardless of whether his or her State has passed legislation authorizing marijuana use for medicinal purposes, is an unlawful user of or addicted to a controlled substance, and is prohibited by Federal law from possessing firearms or ammunition. Such persons should answer "yes" to question 11.e. on ATF Form 4473 (August 2008), Firearms Transaction Record, and you may not transfer firearms or ammunition to them. Further, if you are aware that the potential transferee is in possession of a card authorizing the possession and use of marijuana under State law, then you have "reasonable cause to believe" that the person is an unlawful user of a controlled substance. As such, you may not transfer firearms or ammunition to the person, even if the person answered "no" to question 11.e. on ATF Form 4473.

While this seems clear to those who pay close attention to such legal technicalities, it probably won't be clear to many casual gun owners. Most will only know that marijuana is legal in Ohio, and it will never occur to them that they are violating federal law if they choose to participate in the medical marijuana program.

For example, the letter above mentions question 11.e. on ATF Form 4473. This is the form you fill out when you purchase a firearm and it is used to conduct a background check. It asks:

Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?

You may think that since Ohio has made marijuana legal, you can answer "no." And if you're like me, and you fill out this form frequently, you may just quickly check "no" on all the legal questions without reading them. Which means you'll probably miss the warning that was added to this question earlier this year:

Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.

From long experience, I know that people don't read carefully, and a certain number of gun owners are going to provide false information on this form and unknowingly become felons. This exposes you to felony charges under federal law, punishable with prison time and/or a hefty fine.

It's difficult to predict how the medical marijuana vs. guns issue will play out. In some states, such as Hawaii, enforcement may be strict. According to the Miami Herald, The Honolulu Police Department has been sending letters to legal users of medicinal weed, telling them to surrender their guns within 30 days. However, other states, such as Ohio, may take a softer approach. According to Ohio Board of Pharmacy spokesman Cameron McNamee, only qualified doctors will have access to the Ohio medical marijuana patient registry. Dayton Daily News is reporting that the National Instant Criminal Background Check System (NICS) won’t include this data.

Regardless, with 29 states and the District of Columbia legalizing medical marijuana, there is bound to be confusion over the issue. And no matter how you may feel about it, the fact remains that Ohio law and federal law conflict. At this time, guns and pot are like oil and water. Legally, they don't mix.

Dayton Daily News is reporting that the National Instant Criminal Background Check System (NICS) won’t include this data.

Regardless, with 29 states and the District of Columbia legalizing medical marijuana, there is bound to be confusion over the issue. And no matter how you may feel about it, the fact remains that Ohio law and federal law conflict. At this time, guns and pot are like oil and water. Legally, they don't mix.

The seas, lakes and oceans are now pluming deadly hydrogen sulfide and suffocating methane. Hydrogen sulfide is a highly toxic water-soluble heavier-than-air gas and will accumulate in low-lying areas. The seas, lakes and oceans are now pluming deadly hydrogen sulfide and suffocating methane. Hydrogen sulfide is a highly toxic water-soluble heavier-than-air gas and will accumulate in low-lying areas. Methane is slightly more buoyant than normal air and so will be all around, but will tend to contaminate our atmosphere from the top down.   • The United States joined Europe and others in grounding all Boeing 737 Max  airplanes on Wednesday. 
  • Around the world, hundreds of flights have been canceled after the plane was involved in second deadly crash on Sunday in Ethiopia. 
  • Southwest, American, and United Airlines operate the plane in the United States. 

President Trump announced Wednesday that the United States would join Europe and many other countries in grounding all Boeing 737 Max airplanes after the model was involved in a second deadly crash on Sunday.

At the time of Trump’s announcement, dozens of the planes — operated by American, Southwest and United — were still airborne. The FAA confirmed that it was ordering the temporary grounding of Boeing 737 Max aircraft "operated by US airlines or in US territory."

American Airlines said in a statement to Business Insider that it had 24 aircraft affected by the directive and was "working to rebook customers as quickly as possible."

At least six American flights were canceled between New York’s LaGuardia Airport and Miami. It’s possible that the so-called red-eye cross-country flights Wednesday evening could also be affected.

Southwest Airlines, which earlier on Wednesday had said it had waived change fee and was working with passengers who wanted to avoid flying on the aircraft in question, said it was "seeking confirmation and additional guidance from the FAA."

Southwest has the largest exposure to the aircraft, with 34 of the planes.

United Airlines, which operates 14 737 Max 9’s, said it would have to cancel 40 flights per day.

"We do not anticipate a significant operational impact as a result of this order," a spokesperson told Business Insider. "We will continue to work with our customers to help minimize any disruption to their travel."

Boeing’s chief executive Dennis Muilenburg said in a statement that the company had consulted federal authorities and recommend the temporary restriction to the FAA "out of an abundance of caution."

"We are supporting this proactive step out of an abundance of caution," the statement read. "Safety is a core value at Boeing for as long as we have been building airplanes; and it always will be. There is no greater priority for our company and our industry. We are doing everything we can to understand the cause of the accidents in partnership with the investigators, deploy safety enhancements and help ensure this does not happen again."
