The Library Gallery presents El Sueño Americano / The American Dream, an exhibition of works by Arizona-based artist Tom Kiefer featuring 59 photographs of everyday objects carried by migrants across the United States border with Mexico that were subsequently confiscated or forfeited at a Customs and Border Control facility in southern Arizona. Considered non-essential and thus discarded, these personal belongings — from gloves to rosaries and wallets to water bottles — were valued by their owners for their utilitarian, personal, or sentimental value. In Kiefer’s graphically striking photographs, these personal items serve as traces of individual human stories. “My intent,” says the artist, “is to explore the humanity of the migrants who risk their lives crossing through the desert and to create a personal connection for the viewer to a migrant and their hope for a better life.”

Born in Wichita, Kansas, fine art photographer Tom Kiefer was raised primarily in the Seattle area and worked in Los Angeles as a graphic designer. Kiefer moved to Ajo, Arizona in December 2001 to fully develop and concentrate his efforts in studying and photographing the urban and rural landscape and the cultural infrastructure. In 2015, Kiefer was included in LensCulture‘s top 50 emerging photographers and Photolucida‘s top 50 Critical Mass. His ongoing photographic series El Sueño Americano (The American Dream) has been featured in news publications nationally and internationally.

Drawn from UMBC’s collections, Migration Stories features twenty photographs that address human migration from a variety of perspectives. The installation explores the role of photography in shaping the public image of this issue and in conveying individual narratives of translocation and displacement.

Both exhibitions will be on display in the Library Gallery through May 23.

The presentation of this exhibition is supported by an arts program grant from the Maryland State Arts Council, an agency funded by the State of Maryland and the National Endowment for the Arts. Additional support comes from the Libby Kuhn Endowment Fund, as well as individual contributions.

NCAA great, 12-year NBA veteran and 1988 All-Star, Xavier McDaniel.

The X-Man joins the show for a wide-ranging discussion about his life in basketball. Few players in NBA history were as physical as McDaniel. However, there's much more to Xavier's bow than simply being an enforcer. He was the first-ever player (1985) to lead the NCAA [Division I] in scoring and rebounding in the same season. His name is littered throughout the record books at Wichita State, where he played four seasons with the Shockers. As a senior, he was named First-team All-American.

The Seattle SuperSonics drafted Xavier with the fourth pick in the 1985 NBA Draft. He played all 82 games as a rookie and was second to (future teammate and great friend) Patrick Ewing in Rookie of the Year voting.

Xavier talks about his six seasons in Seattle. He discusses the impact that Maurice Lucas had on his game, speaks candidly about his role in the 1988 NBA All-Star Game and talks fondly of (would-be) future stars, Shawn Kemp and Gary Payton. We discuss his trade to Phoenix (15 games into the 1991 season) and how he became a member of the New York Knicks.

Though he played the one season with the Knicks, his addition to the team made New York instant contenders for the NBA title. In 1992, the Knicks extended the Chicago Bulls to seven games in the second round of the Eastern Conference Playoffs. We discuss the series in-depth and Xavier expresses his thoughts on the series as only he can.

McDaniel joined the Boston Celtics in the wake of Larry Bird's retirement. He played for three seasons in Boston. We discuss his memories of that time, how the Celtics tried to adjust to life without Bird, the soon-to-be retirement of Kevin McHale and the tragic loss of Reggie Lewis.

Xavier headed overseas to play a season in Greece (1996), before returning to the NBA to close out his career as a member of the New Jersey Nets. He talks about his retirement from basketball, some of the great honors he's received and much more, in a conversation that clearly demonstrates Xavier McDaniel's passion for basketball. This is without doubt, one of the most-enjoyable conversations I've had to date.

The IPKat is delighted to receive and publish the following reflections by Katfriend Andrea Rossi on a recent news item concerning drunk cart drivers, Pringles, art ... and potential infringements.

Here's what Andrea writes: 

"In the morning of January the 8th, 2019, the Wichita Falls (Texas, USA) police received a call relating to a drunk woman, riding an electric shopping cart in the Walmart parking lot, while drinking wine from a Pringles can. The woman ended being banned from entering Walmart grounds (see the full story here, here and here). 

Now, I know that the first question that occurred to all of you (or “y´all” as they would say in Texas), is not: “What is a drunk woman doing at 6.30 a.m. in the Walmart park lot riding an electric cart?”, but, rather: “Why have I never thought of drinking wine out of a Pringles can?”. This actually seems to properly function as a wine 'dispenser', as it is water resistant, provided of a plastic lid that prevents any spillage, and shaped to hold it comfortably (here you can find further details on the testimony of drinking wine from a Pringles can). I must admit I tried myself to drink from it, but the smell of the sour sauce and onion chips put me off. Maybe, next time.

Unsurprisingly this event happened to become one of the most popular pieces of news in the US over the past few weeks. As a result, an artist called Celeste Powers created and marketed the “20oz Skinny tumbler” Pringles cans, selling them at approx $30 each on platform Etsy.com

Pringles LLC Ltd owns various registered trade marks in the USA, including the word mark ‘Pringles’ and the well-known figurative mark resembling a chip with moustaches (see USPTO database here):
                                                              
As displayed in the image below, it seems that Powers marketed her successful products using Pringles´ registered trade marks:

                                               

Thus, albeit the trade mark owner has not (yet) taken action against the artist, could it enforce its trade marks successfully

The artist stated
When the Pringles/Wine article ran, I couldn't help but laugh. You really can see and experience it all at Walmart.
Accordingly, would she be able to avoid being sued for trade mark infringement by relying on the fair use/parody defence? Or does this use create likelihood of confusion and dilute Pringles's reputation? 

US trade mark law and parody 

The Pringles trade mark is undoubtedly famous. 15 U.S. Code § 1125 (c)(3) states that it: 
(…) shall not be actionable as dilution by blurring or dilution by tarnishment under this subsection: 
(A) Any fair use [...] of a famous mark by another person other than as a designation of source for the person’s own goods or services, including use in connection with— 
(ii) identifying and parodying, criticizing, or commenting upon the famous mark owner or the goods or services of the famous mark owner. 
According to the U.S. Code it could be argued that Powers is actually entitled to use the Pringles mark without any fear of legal repercussions. However, in light of the most recent case law, this does not necessary appear an entirely straightforward issue. 

In Louis Vuitton Malletier, S.A. v. My Other Bag, Inc. it was held that the defendant, by using the Louis Vuitton trade mark on canvas bags, created a successful parody of the luxurious brand(s) by indicating that My Other Bag products are purchased by those who cannot afford expensive accessories. Further, My Other Bag did not cause any likelihood of confusion or harm to the repute of the French label. In its decision, the court referred to the earlier case Louis Vuitton Malletier S.A. v. Haute Diggity Dog, LLC where the plaintiff´s goods (dog toys bearing the Vuitton trade mark), were found to make fun of the plaintiff’s trade mark’s luxurious aura, without confusing the consumers on the source of origin or damaging Louis Vuitton's image. 

At the same time, it appears that not all the alleged humorous trade mark uses are allowed by US courts. In, DC Comics v. Mad Engine, Inc. the defendant marketed t-shirts designed with the word ‘DAD’ in the famous DC Superman logo. Mad Engine argued that the “DAD Image is an obvious parody of Superman […]. Whereas Superman proudly bears the Shield on his chest as he flies around saving people in a fantasy world, “DAD” lacks any superpowers, but is a real-world hero to his kids”. The court held that (differently from cases such as Diggity Dog's toys (above), the 'Lardashe' jeans and the Sears’s 'Bagzilla' garbage bags), the defendant used the DC Comics´ trade mark “somewhat humorously to promote [its] own product and services, which is not a permitted trademark parody use” (as stated in Harley Davidson, Inc. v. Grottanelli, 2d Cir. 1999). 

Worth of consideration is also the dispute arisen between The North Face Company and Mr Winkelmann when the latter started selling clothing with the ‘THE SOUTH BUTT’ mark resembling the famous trade mark “to mock his classmates wrapped in North Face fleece “ (full story here, here and here). The well-known sport brand, after lengthy litigation, obtained an order to shut down the defendant´s business. Nevertheless, Mr Winkelmann gained a considerable amount of money from the marketing of his humorous merchandise. 

Conclusion 

Coming to the Powers case, it is necessary to assess whether: 1) the artist is using the Pringles mark in a humorous fashion, 2) such use creates confusion on the source of origin, and 3) this use dilutes Pringles’s reputation. Let's review these aspects more in detail:
  1. According to Powers´s statement, one can do anything but laugh when hearing about a drunk woman, riding an electric shopping cart and drinking wine from a Pringles can. However, the humrous aspect in this case is the story itself more than the use of the Pringles mark. Powers does not make a parodic use of the mark, neither does she raise awareness or criticise the famous brand.
  2. Concerning likelihood of confusion, the goods resemble in all the details a real Pringles can (I myself, at first, had the impression that Pringles had created a wine line). Thus, it may be argued that Powers is trying to pass her goods off as if they were produced by Pringles. However, after further examination of the pictures shown by the artist on Etsy.com, it was evident that she was selling hand crafted products. In any case, regardless of the fact that the market channels are different, it must be borne in mind that “joking uses of trademarks are deserving of less protection when the object of the joke is the mark of a directly competing product” (Deere & Co. v. MTD Products. Inc.). 
  3. Kitten shouldn't drink wine!
  4. In relation to dilution, it could be argued that consumers may have a negative experience when drinking wine from a Pringles can, and, accordingly, negatively associate the brand with all the marketed goods. However, realistically, Powers´s sales numbers are not so high as to actually dilute Pringles´s reputation. 
In light of these considerations, it seems quite immediate that Celeste Powers is using Pringles´ likeness to market her own goods, and that she is doing it in a way that may create confusion in the consumers´ mind (are those who are willing to buy wine canned in a Pringles tube likely to understand that Pringles actually is not the manufacturer?). 

Additionally, Powers is not parodying, criticising, or commenting the Pringles brand in any way. Thus, I would believe that Pringles alone should be able to take action in the aftermath of all the “publicity” deriving from this story. In this likely event, it will not be a laughing matter!"

  • 1857 - UT Jim Keenan was born in New Haven, Connecticut. He spent 10 years in the show with an 1882 stop with the Alleghenys, hitting .219 as a bench catcher and outfielder (he played every position but 2B during his career). Jim was one of the better catchers of the 1880s, spent mostly with the Cincinnati Red Stockings. He caught barehanded (ouch!) and is also noted as being one of the few players of that rowdy era to kick the booze habit during his playing days. Keenan caught the first Pittsburgh Alleghenys game (by extension, the first game in Pirates franchise history), a 10-9 win over his future mates, the Red Stockings, played on May 2nd, 1882 at Cincinnati's Bank Street Grounds. 
  • 1893 - RHP Bill Evans was born in Reidsville, NC. He spent his entire three-year MLB stint with the Bucs (1916-17, 1919) as a fringe hurler, going 2-13 with a 3.85 ERA. Evans went into the military and missed all of the 1918 campaign. He worked seven games for Pittsburgh in 1919, then spent the next decade toiling in the minors. 
Cotton Tierney 1922 American Caramel
  • 1894 - 2B James “Cotton” (because of his light blond hair) Tierney was born in Kansas City, KS. He started his pro career in Pittsburgh (1920-23), mainly as a second baseman but also seeing time in the outfield and at the hot corner. He hit .315 for Pittsburgh and was the main piece in the 1923 trade for P Lee Meadows. Cotton was remembered when in 2005, his great-great-nephew Jeff Euston created the popular website Cot's Baseball Contracts, named after his MLB uncle. 
  • 1900 - SS “Country Jake” Stephens was born in Pleasantville (or nearby York), Pennsylvania. Jake played in the Negro leagues for 17 years, with stops with the Homestead Grays (1929-31) and Pittsburgh Crawfords (1932). The SS wasn’t much of a batsman - the curve befuddled him - but he was a fast and acrobatic fielder with a rifle arm. As loaded with bats as the legendary local clubs were, carrying a glove at shortstop was a no-brainer. His leather earned him spots in Pittsburgh and York sports halls of fame. 
  • 1920 - The spitball, shineball, and emeryball were outlawed by the AL/NL Joint Rules Committee. Seventeen pitchers, including off-and-on Pirate Burleigh Grimes, were grandfathered so they could continue to toss a wet one. Grimes, who finished his career in 1934 with Pittsburgh, was the last man to legally throw a spitter. 
  • 1932 - RHP Billy “Digger” O’Dell was born in Whitmire, South Carolina. He closed out his 13-year career (twice an All-Star) with the Pirates in 1966-67, going 8-8-4/4.44. Digger retired and left baseball, coaching Legion ball and earning a spot in the South Carolina Sports Hall of Fame. He got his nickname from the radio/TV show “The Life of Riley” that featured a character named Digby “Digger” O’Dell - an undertaker. 
Bob Klinger 1941 Double Play
  • 1939 - RHP Bob Klinger exhibited his flipper to Pittsburgh Press beat writer Les Biederman and told him that “You are now looking at the arm that belongs to the fellow who is going to win 20 games...this year.” Klinger had gone 12-5/2.99 in 1938 with a gimpy arm, then underwent off season treatment for neuritis. He did get 33 starts, but finished 14-17/4.36 and 0-1 as a prognosticator. Apparently his arm remained chronically cranky. The Pirates switched him to spot starter/reliever in 1940, and he didn’t rejoin the rotation full-time again until 1943. He was in the Navy from 1944-45, then went to the Boston Red Sox at age 38 and was their closer from 1946-47 as part of the Bosox 1946 World Series club. 
  • 1947 - RHP Jim Bagby Jr. was purchased from the Boston Red Sox for a little more than the $10,000 waiver fee. Bagby had been a two-time All-Star for Cleveland in 1942-43, but the 30-year-old was on his last legs in Pittsburgh, going 5-4/4.67 in ‘47 in 38 games (six starts), which proved to be his final season after 10 years in MLB. His father blazed a similar path, ending his big league days as a Bucco in 1923 after a nine-year tour of duty. 
  • 1954 - LHP Larry McWilliams was born in Wichita, Kansas. The sixth overall pick of the 1974 draft by the Braves, he worked for the Pirates from 1982-86. Larry had three strong years as a starter, then faded and was shipped back to his original club, the Braves. His line with the Bucs was 43-44-2 with a 3.86 ERA. Per Wikipedia, he was nicknamed Spaghetti by Tony Pena. "That's what I call him. Take a look at his legs. They look like spaghetti...” his battery mate said.

The League 42 youth baseball organization in Wichita is holding an equipment drive Saturday to recoup supplies lost in recent burglaries. League executive director and founder Bob Lutz says thieves stole about 200 baseball bats, sound equipment and athletic bags from a storage facility on East 17th Street in the past few weeks. He says it is a tough loss to face just weeks before the start of practices for the new season. “One of the things we do is that we supply the equipment to our kids, and that’s something we take great pride in,” Lutz says. League 42 is a nonprofit that offers a low-cost baseball league for kids ages 5-14. About 600 players are signed up for the upcoming season. Lutz says once word of the thefts spread, businesses, corporations and individuals reached out to help. “What we’re realizing — and we already knew — is that there are certainly more good people that believe in League 42 than there are bad people who want to take from League 42,” Lutz says. Rise Up For Youth will receive $125,000 from a national philanthropic group. The high school mentoring program in Wichita helps students escape generational poverty. Mentors focus on academic achievement and building students' self-esteem and character. Students are encouraged to lead their peers while being accountable for the decisions they make. Ariel Rodriguez, the program's director, said the grant money will be used for the 2019-20 academic year. It will allow Rise Up for Youth to hire three new full-time mentors. Rodriguez said the funding from the national group Stand Together will allow his program to mentor 600 students, double the current number. Rise Up for Youth mentors currently serve five Wichita schools. Rodriguez said he plans to use the grant money to begin serving a sixth school in the fall of 2019. “We know our youth are facing barriers, and so we want to make sure our student who have adult-like responsibilities just have a good group of support," he said. Wichita Festivals has unveiled the artwork for Riverfest 2019. “Downtown Get Down” by Wichita artist Jay Walter will be featured on Riverfest posters, buttons and other merchandise. Walter said this was the first time he had entered the Riverfest Poster & Button Artwork Contest. He won $4,000 for his winning design. The 48th annual Riverfest is May 31 through June 8 in downtown Wichita. The nine-day event is expected to draw more than 400,000 people.
