En las otras llaves, los Rayados del Monterrey como subcampeón del Apertura 2017 en el balompié azteca, se medirá al Alianza de El Salvador, mientras que los Diablos Rojos del Toluca (Subcampeón del Clausura 2018 en la Liga MX) chocarán ante el Sporting Kansas City de la MLS.

Los Tigres UANL como Campeón del Apertura 2017 en México, se las verán en un bravo partido ante el Deportivo Saprissa de Costa Rica, en tanto que el Toronto FC chocará frente al Club Atlético Independiente de Panamá.

El Atlanta United FC del "Tata" Martino irá ante los ticos del Herediano. El New York Red Bulls o Portland Timbers de Estados Unidos, tendrá como rival a al Atlético Pantoja de República Dominicana, y el Club Deportivo Guastatoya de Guatemala, se las verá con el Houston Dynamo.

Los ganadores de las series 1, 3, 5 y 7, recibirán los partidos de vuelta de los cuartos de final y enfrentarán a los ganadores de los enfrentamientos 2, 4, 6 y 8 respectivamente.

Para las semifinales, los enfrentamientos originales determinarán los emparejamientos. Adicionalmente, los clubes serán clasificados de acuerdo a su desempeño en los octavos y cuartos de final, utilizando el procedimiento de desempate del campeonato.

El club mejor clasificado en cada serie de semifinales será sede del partido de vuelta. El mismo procedimiento de desempate se aplicará para determinar quién será sede del partido de vuelta de las finales.

Quedaron definidos los octavos de final de la Concacaf Liga de Campeones en el sorteo que se celebró en Miami.

Los octavos iniciarán en el mes de febrero del 2019. A security guard has been arrested one day after a body was found outside an Airbnb villa where missing Florida woman Carla Stefaniak was staying.

La XXIII edición del Festival Internacional del Cuento de Los Silos comienza oficialmente este miércoles, 5 de diciembre. Hasta el sábado, día 8, el municipio se convierte un año más en la capital de la narración oral del mundo hispanohablante.

Narradores, escritores, músicos e ilustradores de Europa, América y Asia pasarán por Los Silos para celebrar la fiesta de la palabra, que, en esta edición, tiene al aire como protagonista. Tras haber dedicado el festival de 2017 al agua, el evento sigue su periplo por los cuatro elementos.

El acto oficial de inauguración comenzará a las 18.00 en la sala Pérez Enríquez del antiguo convento de San Sebastián, con la intervención del director, Ernesto Rodríguez Abad, y la ponencia del escritor invitado, el americano Antonio Orlando Rodríguez. Rodríguez estudió Periodismo en la Universidad de La Habana, aunque reside desde 1999 en Estados Unidos, tras vivir en Costa Rica y Colombia. Ha ganado el Premio Alfaguara de Novela con su obra Chiquita y es fundador y director, junto a Sergio Andricaín (invitado al festival en la edición anterior), de la Fundación Cuatrogatos. Ha publicado obras para adultos pero, sobre todo, para el público infantil. Con el relato histórico Conoce a José Martí ganó el Premio Campoy-Ada de Literatura Infantil 2018, otorgado por la Academia Nacional de la Lengua Española de Estados Unidos.

La inauguración estará presentada por alumnos del IES Daute-Los Silos y, durante el acto, se recordará a Xabier Puente Docampo, narrador gallego invitado al festival en sus inicios y fallecido en junio de este año.

Antes, a las 16.00, el salón de actos del centro de salud acoge una nueva edición de Palabras prisioneras, donde algunos internos del centro penitenciario Tenerife II expondrán sus creaciones literarias, fruto de los talleres realizados en semanas previas.

A las 19.00 se inaugurará la tradicional feria del libro, que este año cambia de ubicación. Estará durante todo el festival en la calle Doctor Jordán, en el emblemático local de Confecciones Sister. A la misma hora, la compañía del Festival Teatrosilos estrenará en la plaza de la Luz el espectáculo El vendedor de palabras.

Otro de los actos más significativos de la tarde llegará a las 19.30 con el homenaje a Pedro Cerrillo y la inauguración de la exposición en su recuerdo, donde destaca una colección del cuento Caperucita roja y el trabajo sobre la censura en la literatura juvenil. Cerrillo, fallecido este año, fue director del Centro de Estudios de Promoción de la Lectura y la Literatura Infantil (CEPLI) de la Universidad de Castilla-La Mancha y un defensor acérrimo del Festival del Cuento de Los Silos. Una quincena de personas, entre familias y amigos venidos de Cuenca, estarán presentes durante el festival en el municipio. Será en la casa del festival de la calle Doctor Jordán.

Los actos de esta primera jornada contemplan también las sesiones oficiales de cuentos a las 20.30 con la irlandesa Kate Corkery y su función Los invisibles en el Centro de Salud, y con el tinerfeño Pedro Ángel Martín y sus Muñecas Rusas, en el salón de plenos del Ayuntamiento.

A las 22.00, el verseador grancanario Yeray Rodríguez actuará en el patio del exconvento de San Sebastián, mientras que Teatrosilos comenzará con el afamado Arteterror a las 22.30 y 24.00 en el complejo de las piscinas municipales.

La propuesta del miércoles se completa con una de las grandes novedades de esta edición, la Guagua de escritores en el espacio TITSA, en la trasera del exconvento. La empresa pública de transportes ha cedido una de las primeras guaguas de la compañía para acoger sesiones de cuentos y encuentros literarios que comenzarán este día a partir de las 23.00 con Pedro Ángel Martín.

At the end of November, American Carla Stefaniak went missing while on vacation. The 36-year-old woman from Florida was in Costa Rica celebrating her birthday. 

Carla was with her sister-in-law, April, for most of the trip. However, April headed back to Florida two days before Carla was scheduled to return. The two were staying at an Airbnb in the San Jose suburb.

After dropping off April at the airport, Carla reportedly went and explored the city and then returned to her Airbnb. She sent texts to her friends on November 27 that the power had gone out and that it was "pretty sketchy" outside. 

The following day, no one heard from Carla. On the 29th when she was supposed to board her flight, she was nowhere to be found. On Tuesday, December 4, a body was found near the Airbnb.

After an autopsy was performed, local authorities confirmed that the body belonged to Carla. According to reports, she was killed by a blunt force trauma to the head. 

Prior to the discovery of the body, the Airbnb host and the local security guard claimed that Carla had gotten into a car on the morning of the 29th with her luggage. However, her family never bought that story. 

Now, the security guard has reportedly been arrested in connection with the murder. The 32-year-old guard, Bismark Espinoza Martínez, was taken into custody at around 11 p.m. Monday night for initial questioning.

According to ABC, the security guard was staying in the apartment next to Carla's. They reported that Martinez has been living illegally in Costa Rica since June 2018.

          Disturbing Update Released About American Woman Who Went Missing on Bday Vacation      Cache   Translate Page      

At the end of November, extremely troubling news was reported about an American on vacation. 36-year-old Carla Stefaniak disappeared in Costa Rica while on a vacation to celebrate her birthday. 

According to BBC, Stefaniak was with her sister-in-law, April Burton, in the San Jose suburb of Escazu. On November 27, Carla brought April to the airport as she was heading back to Florida a day early.

April knew that her sister-in-law was taking an Uber to go sightseeing before returning to her Airbnb. Throughout the day, Carla was in communication with her friends back home. 

Carla said that it had been raining throughout the day. At around 9 p.m. local time, she text a friend saying that the power in her Airbnb had gone out and that it was "pretty sketchy" outside.

The following day, on November 28, several friends messaged Carla for her birthday but received no response. The following day, Carla failed to board her flight home. 

Now, a week after her disappearance, the Costa Rican police have found a dead body wrapped in plastic near the Airbnb that Carla was staying at. As of 2:45 p.m. EST, police had not confirmed whether or not it is Carla. 

According to Radar, the body is "extremely decayed" and therefore no confirmations can be made until an autopsy is performed. However, the Airbnb owner and local security guards are still sticking to their story.

They say that Carla left the rental home at around 5:00 a.m. on November 28 with her luggage. Still, Carla's family does not believe that story.

Enchentes de proporções e consequências inéditas, pontes e viadutos que desabam ou ameaçam desabar, perda notória da qualidade dos serviços públicos na área da saúde, congestionamentos nos portos, rodovias mal conservadas e mal sinalizadas que fazem crescer o número de acidentes e de vítimas. Esses fatos, cada vez mais frequentes na vida dos brasileiros, são as consequências mais dramáticas e gritantes de uma grave deficiência da administração pública que só se agravou nos últimos anos, e para a qual a solução parece sempre distante: a falta de investimentos nas áreas que estão sob responsabilidade do poder público.

O Brasil sempre ocupou posição desconfortável em relação a outros países em desenvolvimento no que se refere a investimentos públicos em serviços essenciais para o bem-estar da população e para o apoio à atividade econômica. Neste século, sua posição piorou muito, como mostra estudo recém-concluído pela Fundação Getúlio Vargas (FGV). Numa lista de 42 países analisados, o Brasil é o penúltimo em investimentos. Mesmo países desenvolvidos, que já dispõem de serviços públicos de qualidade e de ampla cobertura, têm investido proporcionalmente mais que o Brasil. Pior ainda, como mostrou o comportamento criminoso de políticos e funcionários públicos ao longo das gestões lulopetistas, parte do pouco que se investiu foi desviada para bolsos privados, comprometendo ainda mais a qualidade e a extensão dos serviços públicos. A grave crise fiscal deixada por essas gestões no mínimo retardará, por um bom tempo, a recuperação da capacidade de investimentos do setor público.

O investimento está na base do desenvolvimento. Mas, nos últimos anos, houve uma evidente deterioração do estoque de capital público, como mostra o estudo Investimento Público – Comparações Internacionais, do economista Manoel Pires, coordenador do Observatório de Política Fiscal do Instituto Brasileiro de Economia da Fundação Getúlio Vargas.

Na média dos países examinados pelo estudo, os investimentos públicos sempre estiveram acima de 3% do Produto Interno Bruto (PIB) desses países. Em alguns anos, superaram 4%. Um dos exemplos mais expressivos e longevos da capacidade de investimentos públicos é o da Coreia do Sul. Nos anos 1980, a Coreia do Sul era considerada um dos tigres asiáticos, países ainda em desenvolvimento que apresentavam alto ritmo de crescimento, que os empurrava cada vez mais para cima na lista das nações mais bem-sucedidas do planeta. Mesmo tendo alcançado índices econômicos e sociais invejáveis, a Coreia do Sul continua a dispor de investimentos públicos anuais que superaram 5% do PIB, na média do período de 2000 a 2017.

Já o Brasil apresentou, nesse período, investimentos públicos equivalentes a 1,92% do PIB, maior apenas do que a média da Costa Rica, entre todos os países analisados. Economias desenvolvidas, como as do Reino Unido, Suíça, Dinamarca, Japão e França, investem proporcionalmente bem mais que o Brasil, o que as faz se distanciar ainda mais de nós.

Há outro aspecto preocupante na comparação dos investimentos públicos no Brasil com os dos demais países. A crise mundial iniciada em 2008 afetou a capacidade de investimentos de praticamente todos os governos. No Brasil, à crise mundial o governo petista, sobretudo depois da posse de Dilma Rousseff (em 2011), acrescentou uma descomunal incompetência que jogou a economia na recessão e fez os investimentos públicos caírem para 1,16% em 2017, o menor nível desde 1947, quando esse índice passou a ser calculado.

Da fatia cada vez menor do PIB que o setor público consegue destinar para investimentos, as gestões petistas trataram de desviar uma parte para enriquecer criminosamente partidos, políticos, funcionários e grupos empresariais.

A crise fiscal também legada pelo lulopetismo torna ainda mais difícil restaurar a capacidade de investimento do setor público. O que ele investe não basta nem para repor a depreciação do estoque de capital, diz a FGV. Isso cria oportunidade para novas tragédias.

          Centroamérica cuenta en Guadalajara - El Nuevo Diario      Cache   Translate Page      

Acerca de la creación, publicación y gestión cultural en la región hablaron autores consagrados y emergentes  en el espacio Nombrar a Centroamérica porque Centroamérica Cuenta, organizado en la Feria Internacional del Libro (FIL Guadalajara) en coordinación con este festival.

A través de una nota de prensa la organización señaló que este es el tercer año que la FIL Guadalajara desarrolla este espacio en coordinación con Centroamérica Cuenta, para dialogar sobre diversos temas alrededor de la realidad y cultura centroamericana.

Por su parte, Sergio Ramírez, Premio Cervantes 2017 y presidente del Festival Centroamérica Cuenta, agradeció el “apoyo reiterado de la FIL para realizar este proyecto centroamericano. La literatura centroamericana sigue siendo una especie de tierra incógnita, a pesar de ser una literatura rica y diversa”. 

Este año junto a Ramírez participaron Gioconda Belli, escritora y miembro del consejo consultivo de Centroamérica Cuenta; Claudia Neira directora del festival y los autores Catalina Murillo de Costa Rica; Alejandro Córdova de El Salvador; Rodrigo Fuentes y Vania Vargas de Guatemala; Marcel Jaentschke y Fátima Villalta de Nicaragua.

En la FIL también se entregó el VI premio Centroamericano Carátula de Cuento Breve al salvadoreño Alejandro Córdova, quien recibió una escultura del poeta Ernesto Cardenal y tendrá una residencia de escritor de un mes en Monterrey, Nuevo León, como huésped de la UANL.

La presencia de Centroamérica Cuenta dentro de la FIL contribuye a la consolidación de un foro para la internacionalización de los escritores de la región. Actualmente el Festival que proyecta y difunde la narrativa de la región para hacer de la literatura regional una “marca país” se prepara para su sexta edición del 13 al 17 de mayo 2019 a realizarse en San José, el marco de la Feria Internacional del Libro Costa Rica.

El Festival Centroamérica Cuenta se celebra desde 2013 y a la fecha ha convocado a casi 500 escritores, periodistas y editores de España, América Latina, Estados Unidos, Francia, Alemania, Italia y los Países Bajos. 

Este festival literario es convocado por la Fundación Luisa Mercado, revista literaria Carátula y Ministerio de Cultura y Juventud de Costa Rica. 

El consejo consultivo está conformado por reconocidos escritores, periodistas y artistas de Hispanoamérica: Sergio Ramírez (presidente), Nicaragua; Héctor Abad Faciolince, Colombia; Gioconda Belli, Nicaragua; Horacio Castellanos Moya, El Salvador; Gabriela Poma, entre otros.

Los ingresos por las exportaciones a Venezuela, Cuba y Bolivia representan el 0.83% del valor de las ventas totales del país al exterior.

La exportación de bienes nicaragüenses a esas tres naciones generaron US$18.6 millones en el período de enero a octubre de este año, según el Centro de Trámites de las Exportaciones (Cetrex).

Venezuela importó productos nicaragüenses por el orden de los US$17.8 millones, Cuba por US$200,000 y Bolivia por US$620,000.

Mientras tanto, los ingresos que generaron las exportaciones a EE. UU. en ese mismo lapso fueron de US$903.4 millones, representando el 40% del valor de las exportaciones totales de Nicaragua, confirmando que es el principal socio comercial de este país centroamericano.

Al juntar las divisas que le generan a Nicaragua los tres países de la Alianza Bolivariana de las Américas (ALBA), por comercio, equivalen el 2.07% del total percibido por las exportaciones a EE. UU.

Las exportaciones totales de Nicaragua, sin incluir zonas francas, ascendieron a US$2,261.9 millones en los primeros 10 meses del año.

En riesgo

Azucena Castillo, diputada liberal y exgerente de la Asociación de Productores y Exportadores de Nicaragua (APEN), opinó que el Gobierno debe hacer todo lo posible por preservar el mercado estadounidense y no ponerlo en riesgo.

Castillo explicó que EE. UU. es un mercado natural con el que Nicaragua tiene un tratado de libre comercio, el DR-Cafta.

Sin embargo, advirtió que “todas las negociaciones que se hicieron con EE. UU. a través del DR-Cafta podrían estar en peligro”, desde el momento en que ese país ha catalogado a Nicaragua como una amenaza.

“Ese mercado, que ahorita representa el 40% de las exportaciones contra menos del 1% (que representan Venezuela, Cuba y Bolivia), podría salir afectado por esa orden ejecutiva del presidente (Donald Trump)” contra el Gobierno de Nicaragua, indicó.

Esa orden ejecutiva, es la emitida el 27 de noviembre por el presidente estadounidense, quien catalogó la situación de Nicaragua comENDo “una extraordinaria e inusual amenaza para la seguridad nacional y la política exterior de Estados Unidos”.

Castillo, quien también fue ministra de Fomento, Industria y Comercio en el año 2005, cuando se negociaba el DR-Cafta, dijo que “con las exportaciones no se debería jugar” porque “son la columna vertebral de la economía de un país”.

De las exportaciones “dependen la inversión, la generación de divisas, la creación de empleos; con una apertura comercial, el pueblo se beneficia de tener los mejores productos, calidad de productos, precios competitivos, pero no nos podemos cerrar como país, porque ni China es autosostenible”, comentó la experta en mercados internacionales.

Los destinos

Según el Banco Central de Nicaragua (BCN), entre enero y septiembre de este año Nicaragua le vendió a EE. UU. oro, café, carne, azúcar, queso, pescado, langosta, camarón, frijol, maní, puros y tabaco.

En ese mismo período, a Venezuela exportó carne y azúcar, entre otros productos que no especifican las estadísticas oficiales.

EE. UU. es el principal socio comercial de Nicaragua, seguido por el mercado centroamericano, que en el período de enero a septiembre de este año le generó US$468.3 millones.

De Costa Rica, Nicaragua recibió divisas por el orden de los US$106.6 millones, en concepto de exportaciones; de El Salvador, US$203.7 millones; de Guatemala, US$93.2 millones; y de Honduras, US$64.8 millones.

Flora Sapio (Comments on the "Zero-Draft"), and I (Making Sausages?: Preliminary Thoughts on the "Zero-Draft") have been considering the challenges posed by the Zero Draft.  But we wanted to dig deeper.  To that end we wanted to avoid the altogether too easy exercise of textual exegesis to suggest the challenges that this draft might construct for itself.

Rather than consider text, or text in light of the various mandates and principles purportedly manifested in the language used to build the Zero Draft, we thought it might be useful to consider text within the context of the initial commentary it might generate among Zero Draft stakeholders motivated enough to make them. These, then, might usefully inform the reading of text, and sharpen analysis of its structure and consequences. 

To that end, and in this and subsequent posts, Flora Sapio  presents summaries of discussions on each article of the Zero Draft, based on the written submissions available on the website of the OEIGWG.  These, then, will be woven together first to develop both a critique of the Zero Draft, and thereafter to suggest the value of an alternative, framework, model for such a project.

This Part 7 focuses on Article 11 of the Zero Draft (Mutual Legal Assistance).

Article 11 (Mutual Legal Assistance)

On 14 July 2014, the Human Rights Council created an Open-Ended Intergovernmental Working Group (OEIGWG) on Transnational Corporations and Other Business Enterprises with respect to human rights (OEIGWG). According to Resolution 26/9, the Working Group has the mandate to: “elaborate an international legally binding instrument to regulate, in international human rights law, the activities of transnational corporations and other business enterprises.”

By “Other business enterprises” the Human Rights Council referred to all business enterprises having a transnational character in their operational activities. This designation does not apply to local businesses.

In establishing the OEIGWG, the Human Rights Council also decided that the first two sessions of the OEIGWG would be dedicated to conducting constructive deliberations on the content, scope, nature, and form of the future Treaty. Following deliberations, the Chairperson would prepare elements for the draft Treaty. Substantive negotiations on the Treaty would be held during the third session of the Working Group, based on the discussions held during the first two sessions.

The OEIGWG held its first session from 6 to 10 July 2015. A second session took place from 24 to 28 October 2016. Based on discussions held during the first two sessions, a third session was convened from 23 to 27 October 2017. During this session, the elements for the draft Treaty were discussed. Also, the OEIGWG requested the Chair-Rapporteur to complement the ongoing bilateral consultations with states and non-state stakeholders with informal consultations.

Following the third session, a Zero Draft of a Legally Binding Instrument (LBI) on Transnational Corporations (TNCs) and Other Business Enterprises (OBEs) was prepared by Ecuador. In July 2018 the Ministry of Corporate Affairs of India released the draft for public comments.

The Zero Draft of the Legally Binding Instrument (and a zero draft of an optional protocol to the binding instrument) formed the basis for a first round of substantive negotiations, held in Geneva from 15 to 19 October 2018. According to the program of work adopted by the OEIGWG, substantive negotiations saw experts, representatives of national states, transnational organizations, and NGOs comment on the Zero Draft.

In this and in following posts, I will be presenting summaries of discussions on each article of the Zero Draft, based on the written submissions available on the website of the OEIGWG.

Article 11 (Mutual Legal Assistance)
 
1. States Parties shall cooperate in good faith to enable the implementation of commitments under this Convention and the fulfillment of the purposes of this Convention.

2. States Parties shall afford one another the widest measure of mutual legal assistance in initiating and carrying out investigations, prosecutions and judicial proceedings in relation to the cases covered by this Convention, including access to information and supply of all evidence at their disposal and necessary for the proceedings in order to allow effective, prompt, thorough and impartial investigations covered under this Convention. The requested Party shall inform the requesting Party, as soon as possible, of any additional information or documents needed to support the request for assistance and, where requested, of the status and outcome of the request for assistance. The requesting State Party may require that the requested State Party keep confidential the fact and substance of the request, except to the extent necessary to execute the request.

3. Mutual legal assistance under this Convention is understood to include, but is not limited to:

a. Taking evidence or statements from persons;
b. Effecting service of judicial documents;
c. Executing searches and seizures;
d. Examining objects and sites;
e. Providing information, evidentiary items and expert evaluations;
f. Providing originals or certified copies of relevant documents and records, including government, bank, financial, corporate or business records;
g. Identifying or tracing proceeds of crime, property, instrumentalities or other things for evidentiary purposes;
h. Facilitating the voluntary appearance of persons in the requesting State Party;
i. Facilitating the freezing and recovery of assets;
j. Assistance to, and protection of, victims, their families, representatives and witnesses, consistent with international human rights legal standards and subject to international legal requirements including those relating to the prohibition of torture and other forms of cruel, inhuman or degrading treatment or punishment;
k. Assistance in regard to application and interpretation of human rights law;
l. Any other type of assistance that is not contrary to the domestic law of the requested State Party.

4. Without prejudice to domestic law, the competent authorities of a State Party may, without prior request, transmit information relating to criminal matters covered under this Convention to a competent authority in another State Party where they believe that such information could assist the authority in undertaking or successfully concluding inquiries and criminal proceedings or could result in a request formulated by the latter State Party pursuant to this Convention. The transmission of information shall be without prejudice to inquiries and criminal proceedings in the State of the competent authorities providing the information.

5. States Parties shall consider concluding bilateral or multilateral agreements or arrangements whereby, in relation to matters that are subject of investigations, prosecutions or judicial proceedings under this Convention, the competent authorities concerned may establish joint investigative bodies. In the absence of such agreements or arrangements, joint investigations may be undertaken by agreement on a case-by-case basis. The States Parties involved shall ensure that the sovereignty of the State Party in whose territory such investigation is to take place, is fully respected.

6. States Parties shall carry out their obligations under the previous Article in conformity with any treaties or other arrangements on mutual legal assistance that may exist between them. In the absence of such treaties or arrangements, States Parties shall afford one another assistance in a way not contrary to domestic law.

7. In accordance with domestic systems, each State Party shall designate a central authority that shall have the responsibility and power to receive requests for mutual legal assistance and either to execute them or to transmit them to the competent authorities for execution.

8. State Parties shall provide judicial assistance and other forms of cooperation in the pursuit of access to remedy for victims of human rights violations covered under this Convention.

9. Any judgement of a court having jurisdiction in accordance with this Convention which is enforceable in the State of origin of the judgement and is no longer subject to ordinary forms of review shall be recognized and enforced in any Party as soon as the formalities required in that Party have been completed, whereby formalities should not be more onerous and fees and charges should not be higher than those required for the enforcement of domestic judgments and shall not permit the re-opening of the merits of the case.

10. Recognition and enforcement may be refused, at the request of the defendant, only if that party furnishes to the competent authority where the recognition and enforcement is sought, proof that (a) the defendant was not given reasonable notice and a fair opportunity to present his or her case; (b) where the judgement is irreconcilable with an earlier judgement validly pronounced in another Party with regard to the same cause of action and the same parties; or (c) where the judgement is contrary to the public policy of the Party in which its recognition is sought.

11. Mutual legal assistance under this article may be refused by a State Party if the violation to which the request relates is not covered by this Convention or if it would be contrary to the legal system of the requested State Party.

12. A Party shall not decline to render mutual legal assistance for criminal matters within the scope of this Convention on the ground of bank secrecy.


Article 11 of the Legally Binding Instrument on Transnational Corporations and Other Business Enterprises was scheduled for discussion on 17 October 2018, from 10  AM to 13 PM, together with articles 10 (Legal Liability) and 12 (International Cooperation).

Comments by Experts

Surya Deva, UN Working Group on Business and Human Rights: mutual legal assistance among states is critical to provide access to effective remedy, especially in transnational cases. The June 2017 report of the Working Group found makes a series of recommendations on how to improve the effectiveness of cross-border cooperation between States with respect to law enforcement on the issue of business and human rights.
The text of Article 11 should be based on existing frameworks and good practices that have proved to be workable. For example, if multiple courts having jurisdiction over certain business-related human rights abuses give conflicting judgments, it is unclear how Article 11(9) would deal with recognition and enforcement of such judgments.

Comments by States

China: we note this article adopts a general approach based on existing international treaties and national practices. We will make recommendations when we discuss specific wording in the future. At present one problem is mutual legal assistance in criminal cases, at least when the request involves mandatory measures. The precondition is dual criminality, that is the relevant act must constitute a crime both in the requesting party and the requested party. We suggest considering adding this provision.

Costa Rica: the right to prompt justice and to compensation is a basic principle of the doctrine of human rights. The guarantee of this right is essential in situations that require the search of resources in foreign courts. National courts face the challenges of having to make judgments according to the legal principles of foreign jurisdictions, differences in ruling between countries, the gathering of evidence and witnesses abroad, and legal uncertainty for companies and victims. In this regard, Costa Rica respectfully asks what technical instances are foreseen in this Instrument to address these challenges? In Costa Rica, administrative bodies in charge of protecting and supervising human rights in labor law do not have the legal power to share data, since data is confidential and known only to the parties. The exchange of such information is governed by the principles of legality contained in the Political Constitution and in the General Law of Public Administration.

Egypt: Article 11.11 requires states to include provisions on universal jurisdiction in their legislation. This will have the effect of admending the domestic legislation of states if there is a controversy over the application of the terms at the international level.

Article 11.12 may contravene national laws on bank secrecy.

India: we believe both Articles 10 and 11 need more clarity as certain elements have the potential to infringe upon the sovereignty of states. We believe terms like ‘universal jurisdiction’ need more clarity. We are also the view that additional grounds for refusal of legal assistance which are already provided in the United Nations Conventions against Corruption and Transnational Organized Crimes should also be part of this article as they factor in the sovereign rights of states.

Mexico: our delegation is worried about Article 11.3(k), because it leaves to the discretion of states the interpretation of the content and scope of human rights, which would be contrary to international law and would result in the relativization of the norms of human rights and legal insecurity. Article 11.3(k) could be reformulated by eliminating the reference to the interpretation of international law of human rights, and including a reference to domestic legislation: “assistance in regard to the application of domestic law.”

With reference to Article 11.6 we think it is important to include the concept of international law, and draft the article as “State Parties shall afford one another assistance in a way not contrary to domestic [and international] law.”
Namibia: articles 11 & 12 are clear and is clearly based on other international instruments, which provides for MLA and International Cooperation, and which have been implemented with great successes.

Peru: we understand that providing reparation to victims for abuses that take place in more than one jurisdiction requires a complex legal scaffolding that requires mutual legal assistance. However, the provision of the current article detail a series of cooperation responsibilities for states, that would entail enormous efforts for their application. Once again, the burden would be excessive for developing countries.

Russian Federation: with regard to article 11, in our opinion, the obligation of states provided in its paragraph 2 to provide each other with legal assistance, including access to information and evidence, does not correlate with the obligation to ensure the procedural rights of those in respect of whom such actions are taken. As a result, the struggle for the rights of some may end up violating the rights of others.

Comments by NGOs

International Association of Democratic Lawyers: mutual legal assistance should not be totally dependent on future agreement between states. More restrictive criteria for the possibility of alleging forum non conveniens should be present.

Thank you Mr. Chair,
I speak on behalf of the Brazilian AIDS Interdisciplinary Association. We coordinate a group of 17 NGOs in Brazil working to remove patent barriers to the access to health. We are also part of the Global Campaign to Dismantle Corporate Power, which comprises more than 600 organizations, movements and networks, at national, regional and global levels.
Currently in the world, billions of people don’t have access to life saving treatment, because of high medicines prices. Pharmaceutical companies charge those prices because they have patent monopolies over those drugs. The result is that State cannot implement public health policies, consumers cannot purchase the medicines in private pharmacies. The pharmaceutical companies – US and EU-based – and their CEOs have left people to die in name of profits and in name of greed. Therefore, it is fundamental that the binding instrument regulates the obligations of TNCs in respect to human rights, as clearly state in the resolution 26/9.
In this sense, the obligations of states and TNCs must be addressed in separate topics. We suggest that the following phrases are included: (a) TNCs are liable civilly, administratively and criminally for all obligations listed in this Convention that are; (b) States Parties must establish administrative, civil and criminal liability for TNCs and their managers. It must not matter if States and TNCs operate as perpetrators or accomplices of violations. We believe the Convention must make clearer the relation between the main company and its subsidiaries, licensees, subcontractors and so forth. In addition, States parties must provide for sanctions, including the dissolution of the TNC, and oblige the TNC to pay the fees.
We also suggest to exclude the references to “domestic law”, since some states do not have provisions of such kind and it may put in jeopardy the scope of this Convention.

El director del Organismo de Investigación Judicial de Costa Rica (OIJ), Walter Espinoza, informó hoy del hallazgo de un cuerpo al que le harán exámenes para determinar si corresponde o no al de la turista estadounidense de origen venezolano Carla Stefaniak, reportada como desaparecida.

"En este momento no podemos señalar de manera precisa y contundente que corresponda al cuerpo de Carla Stefaniak.

Necesitamos realizar la autopsia, someter el cuerpo a reconocimiento y hacer todas las diligencias correspondientes", dijo Espinoza en una declaración distribuida a los medios.

<amp-instagram data-shortcode="BqoMpy2FhEa" width="1" height="1" layout="responsive"></amp-instagram>El funcionario explicó que la desaparición de Stefaniak se investiga desde el 28 de noviembre pasado, cuando su familia en Estados Unidos la reportó como desaparecida en Costa Rica, a donde había viajado a disfrutar sus vacaciones.

"Hoy realizábamos varias diligencias en el lugar donde fue observada en última instancia.

El apartamento donde pernoctó lo revisamos con equipo especializado y canes adiestrados y esa diligencia nos permitió ubicar fluidos biológicos que son compatibles con sangre y que van a ser sometidos a revisión y comparación", explicó Espinoza.

"Una vez que tengamos los resultados de la autopsia del cuerpo podríamos brinda más detalles sobre la identidad", afirmó Espinoza.

Stefaniak, de 36 años, llegó a Costa Rica el pasado 22 de noviembre junto con una familiar para pasar unos días de vacaciones, y tenía previsto regresar a Florida, Estados Unidos, el 28 de noviembre, según han informado las autoridades.

Los familiares de Stefaniak la esperaban en Estados Unidos, sin embargo, al ver que no llegó a su destino la reportaron como desaparecida e iniciaron una campaña para recolectar fondos que ayuden en la búsqueda.

A vitima : Ezequiel de 26 anos , levou duas facadas na região do pescoço e uma no hemitórax, ele foi levado em estado grave para o Hospital Regional.

Após atenderem a vitima no local, o Siate se deslocou de encontro ao médico do Samu, as equipes realizaram o encontro na rotatória do Campus da UEPG.

A vitima após ser estabilizada foi encaminhada para o Hospital Regional.

Panamá (EFE)-. Un Tribunal de Panamá reprogramó para el 22 de abril de 2019 el juicio oral contra el dominicano Gilberto Ventura Ceballos, condenado a 50 años por secuestro y homicidio de cinco personas, y de seis panameños que presuntamente le ayudaron a fugarse de una cárcel en 2016.

"El 22 de abril de 2019 se realizará la audiencia de juicio a Gilberto Ventura Ceballos, por el delito de evasión del penal La Joyita, condenado (en julio pasado) por el delito de homicidio a cinco jóvenes de origen asiático en La Chorrera", este de la capital, confirmó hoy en Twitter el Ministerio Público (MP).

El juicio oral contra los seis panameños y Ventura Ceballos por los delitos contra la fe pública (evasión) y asociación ilícita para delinquir comenzó este lunes.

En el primer día del acto judicial, uno de los imputados logró un acuerdo de pena por tres años de prisión, pero finalmente no se lo concedió el Tribunal, al igual que otro acuerdo solicitado hoy por otro implicado que fue denegado, según versiones de la prensa local.

El fiscal David Mendoza dijo a los periodistas que Ventura Ceballos no compareció hoy alegando problemas de salud y tampoco asistió su abogado, por lo cual, indicó, se le designó un defensor de oficio.

El Tribunal de Juicio Oral se encuentra formado por los jueces María Lourdes Ortiz, Raúl Vergara y Mirna Palma.

Ventura Ceballos escapó del Centro Penitenciario La Joyita, en las afueras de la capital panameña, el 28 de diciembre de 2016, cuando eludió los controles de seguridad del penal en el momento que fue visitado por un abogado.

El 29 de septiembre de 2017 un tribunal de Panamá abrió ese nuevo caso por el delito de evasión contra Ventura Ceballos, capturado el 22 de ese mismo mes en Costa Rica.

En una audiencia, el fiscal contra el Crimen Organizado, David Mendoza, acusó a Ventura Ceballos de escaparse con la presunta colaboración de funcionarios del penal y de particulares, según se estableció con entrevistas a testigos y análisis de llamadas.

El imputado señaló que aceptaba los cargos por evasión pero no por asociación ilícita para delinquir ya que, según alegó, no recibió colaboración de nadie para cometer ese delito, y añadió que podría llegar a un acuerdo de pena con la Fiscalía.

Ventura Ceballos y el dominicano Alcibiades Méndez fueron condenados el pasado 9 de julio a 50 años de prisión cada uno por el homicidio y secuestro de cinco jóvenes panameños, un caso ocurrido entre 2010 y 2011 y que conmocionó al país centroamericano.

En 2004, Ventura Ceballos huyó de una cárcel de República Dominicana donde estaba encarcelado por el secuestro de un comerciante chino.

Flora Sapio (Comments on the "Zero-Draft"), and I (Making Sausages?: Preliminary Thoughts on the "Zero-Draft") have been considering the challenges posed by the Zero Draft.  But we wanted to dig deeper.  To that end we wanted to avoid the altogether too easy exercise of textual exegesis to suggest the challenges that this draft might construct for itself.

Rather than consider text, or text in light of the various mandates and principles purportedly manifested in the language used to build the Zero Draft, we thought it might be useful to consider text within the context of the initial commentary it might generate among Zero Draft stakeholders motivated enough to make them. These, then, might usefully inform the reading of text, and sharpen analysis of its structure and consequences. 

To that end, and in this and subsequent posts, Flora Sapio  presents summaries of discussions on each article of the Zero Draft, based on the written submissions available on the website of the OEIGWG.  These, then, will be woven together first to develop both a critique of the Zero Draft, and thereafter to suggest the value of an alternative, framework, model for such a project.

This Part 8 focuses on Article 12 of the Zero Draft (International Cooperation).

Article 12 (International Cooperation)

On 14 July 2014, the Human Rights Council created an Open-Ended Intergovernmental Working Group (OEIGWG) on Transnational Corporations and Other Business Enterprises with respect to human rights (OEIGWG). According to Resolution 26/9, the Working Group has the mandate to: “elaborate an international legally binding instrument to regulate, in international human rights law, the activities of transnational corporations and other business enterprises.”

By “Other business enterprises” the Human Rights Council referred to all business enterprises having a transnational character in their operational activities. This designation does not apply to local businesses.

In establishing the OEIGWG, the Human Rights Council also decided that the first two sessions of the OEIGWG would be dedicated to conducting constructive deliberations on the content, scope, nature, and form of the future Treaty. Following deliberations, the Chairperson would prepare elements for the draft Treaty. Substantive negotiations on the Treaty would be held during the third session of the Working Group, based on the discussions held during the first two sessions.

The OEIGWG held its first session from 6 to 10 July 2015. A second session took place from 24 to 28 October 2016. Based on discussions held during the first two sessions, a third session was convened from 23 to 27 October 2017. During this session, the elements for the draft Treaty were discussed. Also, the OEIGWG requested the Chair-Rapporteur to complement the ongoing bilateral consultations with states and non-state stakeholders with informal consultations.

Following the third session, a Zero Draft of a Legally Binding Instrument (LBI) on Transnational Corporations (TNCs) and Other Business Enterprises (OBEs) was prepared by Ecuador. In July 2018 the Ministry of Corporate Affairs of India released the draft for public comments.

The Zero Draft of the Legally Binding Instrument (and a zero draft of an optional protocol to the binding instrument) formed the basis for a first round of substantive negotiations, held in Geneva from 15 to 19 October 2018. According to the program of work adopted by the OEIGWG, substantive negotiations saw experts, representatives of national states, transnational organizations, and NGOs comment on the Zero Draft.

In this and in following posts, I will be presenting summaries of discussions on each article of the Zero Draft, based on the written submissions available on the website of the OEIGWG.

Article12 (International Cooperation)



1. State Parties recognize the importance of international cooperation and its promotion for the realization of the purpose of the present Convention and will undertake appropriate and effective measures in this regard, between and among States and, as appropriate, in partnership with relevant international and regional organizations and civil society. Such measures could include, but are not limited to:

a. promote effective technical cooperation and capacity-building among policy makers, operators and users of domestic, regional and international remedial mechanism,
b. Sharing experiences, good practices, challenges, information and training programs on the implementation of the present convention,
c. Facilitating cooperation in research and studies on the best practices and experiences for preventing violations of human rights in the context of business activities of transitional character.


Article 12 of the Legally Binding Instrument on Transnational Corporations and Other Business Enterprises  was scheduled for discussion on 17 October 2018, from 10  AM to 13 PM, together with articles 10 (Legal Liability) and 11 (Mutual Legal Assistance).

Comments by Experts

Surya Deva, UN Working Group on Business and Human Rights: article 12 contemplates partnership not only among States but also between States and civil society to raise awareness, build capacity, share good practices, and conduct research to promote business respect for human rights. We would suggest that NHRIs should also be part of such collaborative partnerships. To appreciate better the concerns of diverse rights holders, it would also be critical to engage civil society actors who work specifically on the rights of women, children, indigenous peoples, migrant workers, and persons with disabilities.

Comments by States

Costa Rica: Costa Rica recognizes the importance of promoting the international framework for human rights at the national and international levels, and cooperation plays a key role. My country considers it important to be inspired by the Guiding Principles, to promote effective international cooperation schemes and share the best practices on the subject at hand.

Capacity-building and awareness-raising initiatives can play a decisive role in helping all States to to fulfill its duty of protection. Costa Rica agrees that collective action through multilateral institutions can help the States to level the situation with respect to the observance of human rights by companies in different States and this must be achieved by raising the level of States lagging behind. A very important challenge is to work in a cooperative scheme where TNCs are not included.

Egypt: article 12 is one of the important elements of the draft document and we propose strengthening it by including references to transnational corporations and enterprises so that awareness programs are organized on the principles and standards of human rights and the obligations of the host State and the mother country to ensure compliance with those obligations.

Namibia: articles 11 & 12 are clear and is clearly based on other international instruments, which provides for MLA and International Cooperation, and which have been implemented with great successes.

Comments by NGOs

International Association of Democratic Lawyers: international cooperation is strategic to guarantee the effectiveness of the Treaty, therefore the State obligation to facilitate homologation and compliance with foreign judgment must be guaranteed, despite arguments about sovereignty and national security, which do not contribute to the consolidation of a global community of norms of protection of human dignity.

International Organization of Employers: many provisions in the Zero Draft Treaty focus on imposing sanctions on companies on the one hand, while strengthening international cooperation and mutual legal assistance between States on the other hand. With its focus on transnational corporations and not domestic enterprises, the Zero Draft Treaty does not adequately consider how such State-to-State action will improve the situation for victims of any business-related harm in the jurisdiction where the adverse impact occurred and not just lead to a two-tiered system of compliance. The Zero Draft Treaty does not propose any "sticks" to accompany the "carrots" for States or other measures to increase peer pressure between States to ensure they meet their human rights duties at the national level. Improving State performance on human rights, such as by achieving policy coherence between existing standards and national laws, is a long-standing challenge. It is not clear that this Treaty would succeed where other similar instruments have not.

"Life finds a Way"


This film continues three years after the closure of the theme park on Isla Nublar, located somewhere in Costa Rica. Naturally since the lab-developed dinosaurs ran amok and ate a lot of visitors which was elaborately explored in the remake of Jurassic Park trilogy named Jurassic World 2015.

Present day, Owen (Chris Pratt) and Claire (Bryce Dallas Howard) are 'reunited' and back on the abandoned island which is now threatened by the fury of an exploding volcano. They want to save and rescue as many dinosaurs as humanly and humanely possible. A deed made possible through the generosity of the Lockwood Estate which created a sanctuary where these animals can roam around freely without cages, with no tourists and no distractions. Even though the government itself decided it is best to leave them on the island - for the very reason that they should never have been 'created' in the first place.

But evil and green surfaces in the form of Ellis Mills (Rafe Spall) an underling working for the now aging and frail Benjamin Lockwood (James Cromwell). Mills thinks it is a great idea to auction off these dinosaurs to the highest bidders, who can use them for industrial, agricultural purposes but mainly turn them as 'weapons' of mass destruction. These species are transported to the Lockwood estate where representatives of several nations congregate for the auction. Both Owen and Claire were tricked into believing the dinosaurs will be airlifted to a safe haven. 

The main attraction at the auction is this humongous dinosaur that was bred using the DNA of  several really fierce dinosaurs so you can be utterly sure, the Indoraptor is as deadly as it comes. But surely, anywhere and anytime these massive creatures are present you can be sure, the situation will turn really ugly as they escape from their supposedly iron clad enclosures and eat any one that moves. Heh!

This really flimsy premise basically runs wild in Jurassic World: Fallen Kingdom. Another dangerous mission for Owen and Claire - they being the good guys trying their best to contain the situation which has gone awry in the very worst possible way. Plus some entirely crazy and silly subplot involving Lockwood's 'granddaughter, thrown in to just add confusion to an already murky plot.

The cinematography though is quite vibrant - the scene with numerous dinosaurs running, rushing down the jungle and trumping their way towards the sea as hot molten lava pour down from the imposing volcano is excellently shot. The pressure to escape quite palpable as you can almost feel the ground shaking from the massive exodus. One, if not the only memorable scene in this film.

The second half grinds down to a slower pace during the auction part, then picks up a bit with chaotic scenes of people trying to flee from the escaping dinosaurs, which were being sold off to bidders. And rightly so, the conclusion does leave us with a sense that the third installment will entail dinosaurs in the city streets. Something we have to wait for it until 2021!

So while the film could use some depth to the story line, there is a valid message it wants to impart - there was a rational reason dinosaurs were extinct and wiped out eons ago - these are very dangerous creatures and tend to eat people.
