Residential rents and lower quartile selling prices for three bedroom houses both moved higher in the six months to the end of September, but investors' returns remained about the same overall, according to interest.co.nz's Rental Yield Indicator.

The indicator tracks the REINZ's lower quartile selling price for three bedroom houses in 56 locations around the country where there is a high level of rental activity and compares that with the median weekly rent for three bedroom houses in the same locations, derived from bond data collected by Tenancy Services.

Those figures are then used to provide an indicative rental yield figure for three bedroom houses in each location, which can be tracked over time.

The price trend was generally up, with the REINZ lower quartile price moving higher in the six months to September compared to the six months to June in 41 locations, while it declined in 14 and stayed the same in one.

Rents were also mostly up, with rises in 36 locations, declines in eight, with 12 locations where rents stayed the same.

Those combinations produced 20 locations where the rental yields increased, 23 where they declined and 13 where they stayed the same.

Overall, the figures suggest the returns investors could expect to achieve probably haven't changed much in the last three months, with movement in prices mostly being matched by movements in rents, keeping yields around the same.

Yields remain at very low levels in Auckland

In Auckland, the country's largest rental property market by far, the REINZ's lower quartile prices rose in eight of the 10 locations monitored, declined in two (Avondale and Papakura/Drury), while rents rose in four locations and declined in one ((Highland Park).

That saw rental yields rise in Torbay, Glen Eden, Avondale, and Papakura Drury, decline in Orewa/Whangaparaoa, Massey/Royal Heights, Highland Park and Pukekohe/Tuakau, and remain unchanged in Beachhaven/Birkdale and Henderson.

But yields remain at very low levels in Auckland, ranging from 3.3% in Highland Park to 4.5% in Pukekohe/Tuakau.

That suggests investors could still struggle to find family-sized rental properties in Auckland that would provide adequate returns at current prices and rents.

Other areas with particularly low yields were Tasman, Vogeltown/Berhampore/Newtown in Wellington and Queenstown/Frankton, which all had gross indicative yields of 4.3%.

In other popular rental locations the indicative yields were mostly unchanged in the 4.7% to 5.1% range in Hamilton, were unchanged in Upper Hutt, but down in Lower Hutt, and unchanged in Wellington City. They were a mixed bag in Christchurch.

In Dunedin there was an interesting trend with prices up in all three of the suburbs monitored, while rents were up in one but down in two.

That saw the yields decline in all three suburbs.

That may be a sign that the increased investor activity that's occurred in Dunedin over the last few years could be causing an easing in rents.

Although Dunedin's indicative yields are still in the 5.5% to 6.8% range they are falling, and investors will need to keep an eye on vacancy rates to ensure the influx of investors into the city is not creating an oversupply of rental stock.

The chart below tracks the Indicative Yields in all 56 locations monitored, from September 2014 to September 2018.

It's early to make a firm prediction, but with 31 percent of the vote, Supreme Court Justice Courtney Goodson is leading David Sterling in the race to keep her seat with 258,840 votes to his 198,418.

A victory for Goodson would be a repudiation of two things — Sterling's attempt to brand himself as a Republican in a nonpartisan race and the spending of $1.2 million by a Republican special interest group to beat Goodson. She only raised around $150,000 herself. Sterling is a lawyer in the Hutchinson administration who lost a race for attorney general two years ago despite dark money support.

Republican branding is a plus in races for state offices. They hold wide leads in every case, including the open race for secretary of state and land commissioner. Gov. Asa Hutchinson is leading Democrat Jared Henderson with 61 percent of the vote.

Voters' concerns about their health care could help decide some of New York's most competitive races for the U.S. House of Representatives today.

Voters already have a sense of how incumbent officials would vote on the repeal and replacement of the Affordable Care Act. New York Republicans helped the House approve the American Health Care Act in 2017. Of the state's nine Republican House members, seven voted for the party's American Health Care Act—Lee Zeldin, Peter King, John Faso, Elise Stefanik, Claudia Tenney, Tom Reed and Chris Collins—while Dan Donovan and John Katko voted against it.

The two most competitive House races statewide, according to polls compiled by the website FiveThirtyEight, involve Faso and Tenney, who voted for the House bill.

Democrats need 23 seats to win a majority in the House.

Delgado led 43% to 42% and Tenney led 46% to 45% “It’s hard to get much closer,” Siena College pollster Steven Greenberg said.

The American Health Care Act would have replaced the ACA's system of income-based tax credits to buy insurance with ones based on age and eliminated requirements for individuals to buy insurance and larger companies to provide affordable coverage. It also would have allowed states to waive rules that force insurers to cover essential health benefits. The effort to replace the ACA ultimately failed in the Senate.

"The politics of health care have changed fundamentally. The Democrats were playing defense two years ago to defend against the repeal of the ACA," said Michael Sparer, chair and professor of health policy and management at Columbia University's Mailman School of Public Health. "A relatively unpopular bill across much of the country has become more popular. Many of them, if not regretting the vote, are regretting the political byproduct of the vote."

In New York's 19th district, which includes all or part of 11 counties in the Hudson Valley and Catskills, Faso is facing a challenge from attorney Antonio Delgado. The Democratic Congressional Campaign Committee seized on Faso's vote in an ad opposing him, spotlighting his failure to protect people with pre-existing conditions. Delgado also has pointed to the age-based subsidy system of the AHCA as evidence that Faso supports charging older New Yorkers more to buy private insurance. Delgado supports a public option for people to buy into Medicare, which Faso has characterized as a government takeover of insurance.

A Monmouth University it's the right solution at the federal level. The state single-payer law has never reached a vote in the state Senate.

"Whether or not a couple of Republican seats like Claudia Tenney or John Faso [flip] is certainly part of the story nationally as to whether or not the Democrats could take over the House," Sparer said. "If Delgado and Brindisi both lost, that would be bad news for Democrats." —Jonathan LaMantia

 

Union ratifies new contract at Palisades Medical Center


About 860 Hackensack Meridian Health employees at Palisades Medical Center, represented by the Health Professionals and Allied Employees union, have ratified a new contract, the health system said Monday.

The new contract, ratified on Nov. 2, will enable the hospital to continue delivering safe and high-quality care to patients as well as sustainable and competitive wages for team members, Hackensack Meridian said in a statement.

The union said that 28 jobs will be added at the hospital over the next six months and wage increases will range from 8% to 10% over the three-year term of the contracts. Employees covered by the union include nurses and other health professionals.

"This contract preserves our rights to have a voice in patient safety and changes in our workplace," said Mickie Miquiabas, President of HPAE Local 5030, in a statement. "We fought back against an aggressive anti-union campaign and now we have a commitment that the hospital will hire more staff and continue to work with us to improve staffing levels and patient safety standards in our hospital."

In September, Meridian Health employees at long-term care facility The Harborage and HPAE ratified a three-year labor contract, the hospital and union said. Negotiations are continuing on the labor contract of about 1,200 nurses at Jersey Shore University Medical Center and about 290 nurses at Southern Ocean Medical Center. —Jennifer Henderson

 

Hunter College shares $13.5M grant for cancer disparities research


Hunter College has teamed up with Temple University to receive a five-year, $13.5 million National Cancer Institute grant to identify ways cancer prevention and treatment can be improved for Americans of African, Hispanic and Asian-Pacific descent.

Hunter, part of the City University of New York system, will create a Regional Comprehensive Cancer Health Disparities Partnership, and Temple's Lewis Katz School of Medicine will found the Fox Chase Cancer Center with the funds.

The partnership will work with communities in New York, New Jersey and Pennsylvania to limit disparities in cancer cases and deaths across different demographic groups. It will focus on liver, lung and colorectal cancers.

Investigators aim to attract minority students to cancer research at the undergraduate, graduate, post-doctoral and faculty levels. The initiative will also include community-based research projects that aid in the prevention and early detection of cancer. For instance, it will study the prevalence of liver cancer in Asian-Americans, a group eight to 13 times more likely to develop the disease than others, mostly because of high rates of chronic hepatitis B, the Centers for Disease Control and Prevention said in 2016.

Researchers across multiple disciplines will look at how genetics, socioeconomic factors, access to care and cultural barriers affect cancer rates, said Dr. Olorunseun Ogunwobi, the principal investigator at Hunter College and the director of its Center for Health Disparities Research.

“It’s known that there is an interplay of multiple factors at multiple levels,” he said. “What’s less clear is the details of those interactions and opportunities for intervention.” —J.L.

 

City chooses new jobs services contractors for people with health barriers


Fedcap, a Manhattan-based nonprofit, will no longer administer the city's WeCare program as of Jan. 31, but the program will continue with a trio of new providers. WeCare provides employment and self-sufficiency services to individuals facing medical and mental health barriers.

Fedcap assumed management of 100% of the project back in April 2015, after fellow nonprofit and former WeCare provider Federation Employment & Guidance Service filed for bankruptcy. The program's contracts totaled $65 million.

Since 2012, 17,500 New Yorkers have been placed in jobs through the program, said Grant Collins, president of Fedcap, who oversees the WeCare contracts. "Fedcap Inc. is working with the new contractors to ensure that there is no interruption in these services," he said.

The new contractors are Bronx-based University Behavioral Associates; Louisville, Ky.–based ResCare in Brooklyn, Manhattan and Staten Island; and Reston, Va.–based Maximus in Queens.

"Fedcap's involvement will continue. All three of the bid winners will be using Fedcap's proprietary case-management software, which has helped make this program a success," Collins said. Fedcap also will serve as a subcontractor providing job-placement and other services in Queens.

HENNEPIN — While it was expected Public Defender Roger Bolin would file motions Tuesday afternoon in Putnam County Court for the upcoming bench trial of Richard A. Henderson for the murder of 16-year-old Diamond Bradley, the plea deal sentencing Henderson to 53 years was a surprise.

"The talk of negotiations really picked up last night, but we didn't know until today whether he'd take the deal or not," Putnam County State's Attorney Christina Judd-Mennie said after the hearing.

Henderson, 26, of Standard, pleaded guilty to one count of first-degree murder, a Class M felony. The state dropped the remaining charges.

Mennie said the state would have sought a motion stating the crime was "brutal and heinous," which would have had Henderson facing a sentence of 20 years to natural life in the Illinois Department of Corrections if the case had gone to trial and Henderson had been convicted.

Judge Stephen A. Kouri, before discussing the terms of the deal, asked Henderson about his education. Henderson told Kouri he has a 10th-grade education and no GED, but that he understood he would have to serve 100 percent of his sentence followed by a mandatory 3 years of supervised release. He will get credit for the 275 days served in pre-trial custody.

Diamond Bradley, 16, of Spring Valley was last seen by her family on Jan. 23. She was reported missing the next day and was found stabbed to death alongside a rural Putnam County road on Jan. 27.

Henderson was taken into custody on Feb. 5 after investigators linked him to Bradley through interviews, surveillance footage, and cell phone data.

Mennie previously said the prosecution was well prepared for a trial and that there was "an abundance of evidence." Both sides expected a trial to last only three to four days.

Following the acceptance of the plea agreement, Mennie said if there had been a trial, a Putnam County sheriff's deputy would have testified Henderson had picked up Diamond Bradley on or about Jan. 24, 2018 and taken her to the road where her body was later found.

The prosecution would have also entered video evidence taken from surveillance cameras linking Henderson to Bradley and their route together; cell phone evidence from the FBI linking their cell phone locations on Jan. 24; as well as a knife, the murder weapon Henderson used to stab Bradley several times. He then hid the weapon in an ash pit at the commercial greenhouse where he worked in Granville.

Though Henderson was initially charged with concealment of a homicidal death, a Class 3 felony with a sentencing range of 2 to 5 years, Bolin successfully got that charge dropped during a Sept. 6 hearing.

Bolin argued the 120-day limit of the Speedy Trial Act has been exceeded, and Judd-Mennie agreed to drop the charge to focus on the murder charges.

The additional three first-degree murder charges were entered on Aug. 30, and each carried concurrent $1 million bonds. Henderson had previously entered pleas of not guilty on all counts.

Diamond Bradley's mother, Doris Bradley, spoke on the stand to share the impact the killing of her daughter has had on her family. She said she had initially moved to the Illinois Valley for a better life for her children, but now that dream was gone, and that her family no longer wanted to be here because of the painful memories of Diamond.

"I have two other children, 14 and 11, and they can't sleep at night. I can't work the way I used to, and we're all just trying to get through this so we can get on with our lives. Diamond was my everything. My house is so quiet, she was everything to us, and now it's all been taken away from us. I brought my children here for a better life, not something like this. I don't want to be here anymore, but we're going to make it through this and go on," she said, tearfully.

Mennie said it was the family's decision to allow Henderson the negotiated deal and that they had been deeply involved through the entire legal process.

"This was their decision, and they really needed the closure. I can't imagine being in their place," she said.

Mennie credited the many local law enforcement agencies who, she said, worked seamlessly together and "really nailed the case down for us."

Bolin said Henderson gave no indication why he became interested last week in a potential plea deal, adding "This was his decision."

A victory for Goodson is a repudiation of two things — Sterling's attempt to brand himself as a Republican in a nonpartisan race and the spending of $1.2 million by a Republican special interest group to beat Goodson. She only raised around $150,000 herself. Sterling is a lawyer in the Hutchinson administration who lost a race for attorney general two years ago despite dark money support.

          Louisiana Just Made a Major Stride in Ending Jim Crow in the State      Cache   Translate Page      
A referendum to end conviction by non-unanimous juries in Louisiana is gaining support in the lead-up to next week's election.

UPDATE (11/06/2018)Amendment 2 passes, ending the Jim Crow-era practice of allowing felony convictions without a unanimous jury. Louisiana was one of the last two states in the country to require only 10 of 12 jurors to convict in felony cases. More than 40 percent of all those who have been recently exonerated of crimes in Louisiana were found guilty by non-unanimous juries.

As the crowd began descending on the packed pavilion in Congo Square in the Treme neighborhood of New Orleans, it was hard to ignore the expressions of hope and enthusiasm on each of the participants’ faces as they gathered on Saturday before heading to the polls to kick off early voting in Louisiana.

At the front of the line of about 100 marchers stood Norris Henderson, the co-founder and executive director of the grassroots group Voices of the Experienced, proudly holding a sign that read “Vote Yes on 2.”

Norris spent 27 years in Angola State Prison for a crime he did not commit. He was convicted by a non-unanimous jury. He was there on Saturday to help Louisiana liberate itself from its century-old racist jury system, which has deep roots in Jim Crow, by encouraging the community to vote. His life’s work has been fighting the injustices of the criminal justice system and he has been on the frontlines ushering in many of the reforms the state has adopted in the last couple of years. “There is no reform more important or more impactful to attack mass incarceration in this state than Amendment 2!” he proclaimed to the crowd.

Louisiana is one of only two states (the other being Oregon) that does not require a unanimous jury of 12 members to deprive someone of their freedom in felony cases. That means that two jurors can believe that a person is innocent and yet that person will still go to prison in direct contradiction of the standard burden of proof in all criminal cases — beyond a reasonable doubt. Even worse, Louisiana is the only state in the country where someone can be sentenced to life without the possibility of parole without a unanimous jury. 

This law has its roots in slavery and took its current form during the Jim Crow era, when white supremacists wanted to increase the supply of free prison labor and nullify the voting power of black jurors. It has led to numerous wrongful convictions and has put pressure on many people, especially African Americans, to take plea deals in the hopes of getting more lenient sentences than they would get if they went to trial and were convicted of a felony by a jury that does not look them.

More than 40 percent of all those who have been recently exonerated of crimes in Louisiana were found guilty by non-unanimous juries.

But now, for the first time in over a century, Louisianans have the opportunity to change this archaic law next Tuesday and ensure that residents have the same protection of right that exists in 48 other states and federal courts. Voting Yes on Amendment 2 would require all 12 jurors to agree on a person’s guilt in order to convict.

The crowd out on the streets on Saturday was palpably excited about the possibility of Louisiana shedding its roots from this Jim Crow-era jury system. It included people of all ages, races, and walks of life, chanting phrases of change and hope. They created their own renditions of "When the Saints Go Marching In," replacing “saints” with “juries.”

This level of enthusiasm and support tracks with what we’re seeing statewide, and it has been led by individuals like Norris Henderson who have been directly impacted by the criminal justice system and are now helping lead the movement to transform it.

Since passing through the State Legislature last spring to secure its place on the ballot, Amendment 2 has garnered significant bipartisan support. It has received endorsements from both major state political parties; social, civil rights, and faith organizations; prominent law enforcement officials; district attorneys across the state; public defender associations; and, most importantly, the general public.

The community is the driving force behind this movement to end this Jim Crow-era law. If you walk down any major street in New Orleans, you would be hard pressed to go a mile without seeing a Yes on 2 yard sign in someone’s yard or business. Yes on 2 has been spearheaded by State Senator JP Morrell and the Unanimous Jury Coalition, consisting of champions of justice like the ACLU-LA, VOTE, SPLC and many others. 

The coalition has offices in New Orleans, Baton Rouge, and Shreveport. Because of the hard work of faithful volunteers, the coalition continues to exceed its weekly goals of educating the community and turning out voters.

Amendment 2 is also getting national attention. Recently, celebrities such as New Orleans Saints’ Linebacker Demario Davis and Grammy-winning singer, songwriter and producer John Legend joined the fight to require unanimous juries.

Louisiana has made great strides in the last couple of years to fix its criminal justice system and reduce the prison population. Passing Amendment 2 would aid that goal. Unanimous juries should matter to all Louisianans. When the voice of every juror counts, it strengthens our judicial branch and provides checks and balances for a fair criminal justice system.

The Roy Hargrove Factor

If the brothers Marsalis were the poster boys for a reemergence of jazz in the mainstream thirty years ago, trumpeter Roy Hargrove was the standard bearer for the flank of “Young Lions” that blew open the door that Wynton and Branford found. Hargrove, who passed away recently at age 49, was the clear star of a group of musicians that included bassist Christian McBride, pianist Benny Green, guitarist Mark Whitfield, fellow trumpeter Marlon Jordan, saxophonist Antonio Hart and Marc Anthony Cary.  Ever the restless spirit, Hargrove found fellow travelers at the other end of the radio dial, among a loose collective of musicians straddling the worlds of hip-hop, R&B and Jazz, including Erykah Badu and D’Angelo. In a career the began when he was 17, Hargrove recorded close to twenty albums as a leader, and earned two Grammy Awards.

"Music has always been at the center of my life," Hargrove told the Los Angeles Timesin a 1994 profile. Like many of the post-Soulgeneration, Hargrove was immersed in the sounds of top-Pop 40, telling Bill Kohlhaase that he listened to “everything there was to be heard on the radio: hip-hop, reggae, basically every style that I could relate to, that I liked, that I could feel. It wasn't until I was 15 that I began to hear about people like Clifford Brown, Fats Navarro, Lee Morgan and Freddie Hubbard."

The Dallas raised Hargrove recalled in an interview with Dr. Billy Taylor that he was introduced to improvisation as a 4th grader by a grade school music teacher. By the time he was in arts school as a teenager, there was a buzz about Hargrove.  It was, in part, that buzz that got Hargrove an invitation to sit in with Wynton Marsalis – arguably Jazz brightest star  at the time, and only eight years Hargrove’s senior. Marsalis is reported to have remarked, "Man, I heard this little kid today that's gonna be a bitch. No, that's wrong, that kid's a bitch today."  

Hargrove was already deep in the archive of his instrument, telling New York Timescritic Jon Pareles, "I haven't really been the same since I heard Clifford Brown," Mr. Hargrove said. "I found it hard to believe a trumpet player like that, because he had covered so much of the horn technically, but the sound was so warm and not brassy. Then the next trumpet player I heard was Freddie Hubbard, and that really turned my head around." Hargrove spent a year at the Berklee School of Music in Boston, but by 1990 was living in New York City, signed to RCA/Novus, where he released three studio albums Diamond in the Rough (1990), Public Eye (1991), The Vibe (1992), and the live Of Kindred Spirits (1993), before making the move to Verve in 1994 with With the Tenors of Our Time, which surrounded Hargrove with some titans of the instrument  including legends like Joe Henderson, Stanley Turrentine, and Johnny Griffin, and his contemporaries Branford Marsalis and Joshua Redmond.

There is a warmness that you hear on those early Hargrove albums, like his  treatment of James Williams’ classic “Alter Ego” or “Of Kindred Souls.” But what you also heard in Hargrove’s sound, on tracks like his fire and brimstone cover of Miles Davis’ “Milestones” and “Homelife Revisited” is a swagger, befitting a young musician who likely heard Run-DMC’s “Rock Box” or Eric B and Rakim’s “Check Out My Melody” at house parties in Dallas. As David M. Yaffe wrote in his Village Voice profile of Hargrove during a stint at the Village Vanguard in 1996,  “what really distinguishes Roy from earlier trumpeters is his understanding of funk: Originals like ‘Roy Allan’ written for his father-reveal a musical palette not only formed by Dizzy, Fats, and Clifford, but by Parliament, the Ohio Players, and Stevie Wonder. Such distinctions between Roy and his influences are crucial.”

Hargrove’s forays into R&B and Hip-Hop would have to wait; his detour was in the arena of Latin Jazz, where his 1997 album Habana would earn him his first Grammy in the category of Best Latin Jazz Performance (1998). Hargrove would win a second Grammy five years later for a live album, co-led with Herbie Hancock and Michael Brecker.  Moment to Moment (2000), an album of ballads with strings, highlighted Hargrove’s aesthetic range and diverse taste.

But it was Hargrove’s ability to channel the cross-genre sensibilities of fellow trumpeters Quincy Jones, Freddie Hubbard and Donald Byrd that earned his new audiences at the beginning of the new century. Hargrove’s contributions on Erykah Badu’s Mama’s Gun, D’Angelo’s Voodoo, and Common’s Like Water for Chocolate – all released in 2000 – are nuanced, but they had a major impact on the musicality of all three projects. It was in this period Hargrove also contributed, along with the Soulquarian collective and Nile Rodgers, to the Red, Hot & Riot tribute to Fela Kuti.  

As Hargrove told the Daily News in 2003, "People been blasting me in the ear for the longest...They were saying, 'You're the only cat who could do it right.' " Doing it right meant the RH Factor, Hargroves’  jazz-funk collective, which produced two albums and an EP between 2003-2006. Standouts on those RH Factor albums are D’Angelo’s mournful cover of Funkadelic’s “I’ll Stay” and “Kwah/Home”, which featured a then relatively unknown Anthony Hamilton. Famously, Hargrove dropped the RH Factor’s Distractions and his own Nothing Serious on the same day in 2006.

Personal challenges kept Hargrove out of the studio for much of the last decade of his career, though Earfood(2008), and the big band recording Emergence (2009) rate, along with Habana, as his finest moments. Hargrove’s closer on Earfood, Sam Cooke’s “Bring It On Home to Me”, might be the most soulful recording of his career.

Perhaps summing up Roy Hargrove’s career, the late music critic and author Rashod Ollison wrote in the Baltimore Sun in 2006, “No matter what the trumpeter dives into it – pop, hard bop, hip- hop, blues, R&B, Cuban jazz, jazz standards – the native Texan charges the material with soul. It's that essential, transcendental feeling that invigorates and electrifies music, giving it life.”

Democrats captured a majority in the state Senate Tuesday night.  The party's control of both houses of the Legislature offers a potential path to pass the New York Health Act, which calls for a single-payer health plan.

But the reticence of Gov. Andrew Cuomo, who was elected to his third term, and opposition from the Trump administration could stall efforts to enact such a system.

The win for Democrats will likely make Andrea Stewart-Cousins the state Senate majority leader, giving her the power to name the senators who will lead committees. State Sen. Kemp Hannon, the Republican chair of the health committee who has held his seat since 1989, trailed attorney Kevin Thomas by about 1,300 votes after all precincts had reported in his Nassau County district Tuesday night. Hannon is known for his health care expertise and had received financial contributions from trade groups representing hospitals and doctors. He had opposed the single-payer plan. 

In Hannon's absence, the chairmanship could shift to Sen. Gustavo Rivera, the Bronx Democrat who has sponsored the New York Health Act in the Senate. Rivera is currently the ranking Democrat on the committee.

The shift in power could move the Senate toward a vote on the bill. The legislation has passed in the Assembly five times, including the past four years. Rivera

Assemblyman Richard Gottfried, who has championed the bill since 1992, said he doesn't believe Democrats in the Senate will retreat on the issue. He reelected without an opponent on Tuesday.

"When people have been so public on an issue that has had so much public discussion, I think that creates real momentum," Gottfried said. "It becomes very hard for an elected official to say 'I've been a co-sponsor of this bill, but I didn't really mean it.'"

The New York Health Act would lead to slightly lower health spending but require an additional $139 billion in tax revenue in 2022 to finance the program. That would represent a 156% increase over projected tax revenue, according to an

Democrats pick up House seats


Several New York Republican officials who backed the American Health Care Act lost their seats on Tuesday night, as Democrats took control of the U.S. House of Representatives. 

Democrats picked up three seats in the House. Republican John Faso, who represented parts of the Hudson Valley and Catskills, lost to attorney Antonio Delgado, and Claudia Tenney, a Republican representing central New York, fell to Assemblyman Anthony Brindisi.

RapidSOS raises $30M for faster emergency response


RapidSOS, a Manhattan-based company that provides 911 call centers with additional data, has raised $30 million in a Series B financing round to incorporate caller data from other devices into its platform and expand internationally.

To date it has raised about $65 million from investors, said said Michael Martin, the company's CEO.

The company's platform can send location data from smartphones and health data from wearable devices to 911 centers. RapidSOS is also expanding the number of home sensors that are connected to its platform. It can currently connect to the devices to measure information, such as smoke density and temperature readings. And it's working with carmakers to send data, such as the number of occupants or crash severity, from a car's sensors.

"When you provide a suite of additional data for 911 responders, you get a faster and more effective emergency response," Martin said.

The company generates revenue from health and life-insurance companies, which can allow their members to input health information into the platform, equipping first-responders with more information and potentially saving insurers money.

The company has partnerships with Apple, Google, Uber and Microsoft to transmit data from smartphones and apps. This year Apple worked with RapidSOS to deliver more accurate information about callers' locations on devices running iOS 12 and later versions.

The round was led by Palo Alto–based venture fund Playground Capital, with funding from Highland Capital Partners, Microsoft venture arm M12, Two Sigma Ventures, Forte Ventures, The Westly Group, CSAA Insurance Group and high-net-worth individuals, including three former Federal Communications Commission chairmen. —J.L.

 

Mount Sinai, Valley Health open new cancer center in New Jersey


Valley and Mount Sinai health systems, strategic partners since 2014, have launched the Valley-Mount Sinai Head and Neck Institute at Valley-Mount Sinai Comprehensive Cancer Care in Paramus, N.J. The new institute will treat cancers of the mouth, throat, head and neck. 

"What really is the driver here is to be able to offer clinical trials and some of the new innovations to patients who live in New Jersey and don’t want to travel and shouldn’t have to travel outside the area," said Dr. Ephraim Casper, chief medical officer of Valley-Mount Sinai Comprehensive Cancer Care.

While cancers of the head and neck traditionally have been linked to smoking, a link to human papillomavirus also has been found, he said. The institute expects to see less than 100  patients a year who require highly specialized and ongoing care.

Mount Sinai’s head and neck cancer team consists of 35 specialists from 12 disciplines. It has experience using less-invasive robotic surgery and organ-preserving therapeutics to treat head and neck cancers and preserve quality of life.

Valley patients also will have access to clinical trials through Mount Sinai’s head and neck research program in areas such as vaccinations, immunotherapy, chemotherapy and radiation, Casper said.

State offers $16.4M for tobacco-control efforts


The state Department of Health is seeking proposals to improve tobacco-dependence treatment programs. In total, New York will award up to $16.4 million during a five-year period to winning bidders from nonprofits, governmental entities and tribal organizations, according to the request for applications posted online Monday.

The Health Department plans to award a total of $15 million to 10 health system contractors and about $1.4 million to one statewide Center for Health Systems Improvement, which also may be one of the contractors. The center will be responsible for providing statewide expertise on systems and policy change related to tobacco-dependence treatment. It also will coordinate with the 10 selected contractors and other state-level organizations to institute interventions in systems such as community health centers and federally qualified health centers that service low-income patients and those with low educational attainment and mental illness.

In particular, efforts should focus on systems and policy change consistent with guidance from the Centers for Disease Control and Prevention that tobacco-control programs should focus on population-level efforts such as incorporating cessation intervention as a routine part of care systemwide, according to the Health Department.

Health care related to smoking costs the state $10.4 billion annually, including $3.3 billion in Medicaid expenses, according to the Health Department.
The CDC funds tobacco-control programs across the U.S. Last year New York received $3.1 million for related activities. The deadline to apply is 4 p.m. Dec. 19. —J.H.

          Making room for Africa's urban billion      Cache   Translate Page      

By 2050, more than a billion people will be living in African cities and towns. As more and more of the continent’s population – 60 percent of whom live in the countryside – move to urban areas, pressures on land can only intensify. How should we make room for this massive urban expansion? How will city structures have to change to accommodate Africa’s urban billion? And could well-directed policy help spring African cities out of the low-development trap? These questions were at the core of discussions at the World Bank’s 5th  Urbanisation and Poverty Reduction research conference on September 6th 2018.

Cities on the brink
 
Rapid urbanisation is pushing countless African cities to their limits – many are simply running out of space. As infrastructure struggles to keep apace of a mushrooming populace, policymakers will have to rethink their approach to the use and distribution of land. Lagos is but one of the latest cities undergoing an ambitious redesign of its urban environment. In 2017, the city launched the Eko-Atlantic regeneration project. With aims to reclaim a land mass the size of Manhattan off the coast, the new planned city hopes to house more than 200,000 new residents and 150,000 workers, reflecting the government’s vaulting ambitions to manage relentless urban growth.
 
Such radical changes are part and parcel of a wider ongoing phenomenon in African cities – the lack of controlled densification and the prevalence of urban sprawl. It’s now expected that even with density levels remaining the same, by 2050, urban land cover in Africa will be four times higher than it was in 2000. Should density levels decline, Africa’s total urban area could increase by more than a factor of 12, placing tremendous strains on the continent’s economic, social, political, and environmental health.  
 
When the city loses its walls, the city ceases to be
 
Economists tend to advocate compact living and the containment of urban sprawl, but why does density and the spatial organisation of cities really matter? The answer is that how cities shape and sprawl closely affects how we live. How we access jobs and economic markets, how we communicate and interact with one another, how much time we spend commuting, and how much we pollute. When cities are well planned and compactly organised, it’s much easier to seize the positive agglomeration aspects of urbanisation whilst also lowering the costs of providing essential infrastructure and services.
 
When we think about the spatial development of Western countries, the efficient cities are those characterised by high-density developments, that are close to the city center, and anchored by strong transportation networks and formal property markets. These are the foundations for highly attractive and productive spaces where people can live, work, and think together.
 
On the other hand, many African cities are spatially dispersed, with neighborhoods that are undermined by a combination of weak infrastructure and dysfunctional and markets, leaving vast populations isolated from social and economic life. Recent evidence suggests that the average African city is 20% more fragmented than cities in Asia, 29% more expensive, and with 37% less exposure to people and jobs. These challenges are often a symptom of wider land policy failures, both past and present, which lock cities into informality and a low-development trap.
 
Two features of Africa’s urbanisation challenge: Low-density and leapfrog development
 
At the conference, Jan Brueckner presented on Backyarding, a semi-formal means of densification that has proliferated through much of South Africa in response to planning regulations set up during the apartheid era (paper). Across major cities, millions of homeowners – mostly those living in government subsidized properties – are choosing to rent out portions of their yards to occupants living there in self-constructed or formally built dwellings.
 
Since past government housing was done at extremely low-density, residents have seized the opportunity for infill development on their surplus lot space, generating new housing outside standard planning regulations. According to Statistics South Africa, the number of households living in either formal or informal dwellings in backyards has increased from 1.135 million in 2011 (7.3% of the country total), to 1.835 million in 2016 (12.5% of the total).
 
A key question is whether town and planning regulations will eventually recognise these market driven means of densification. In Los Angeles, for instance, government officials are encouraging residents to use Backyarding as a tool to house the homeless in so-called “granny flats”. As part of the program, homeowners could be awarded $75,000 to build a granny flat on their land, or $50,000 for renovations of existing units.  One major advantage of course, is that by sharing external services, such as water and sanitation facilities, access to services is significantly better than in alternative options like slums. 
 
In another session, Vernon Henderson showed the distorting effects that colonial hangovers have had on the structure of African cities (paper). Studying the differences between cities under Anglophone rule versus Francophone, he showed that Anglophone cities have more leapfrog development at the city margin as well as less intense land use and more irregular layouts in the colonial portions of the city.

The figure below compares the road layout of colonial sections of Accra versus Bamako both in the 1960s and today. Both cities have very similar layouts today as they did nearly 70 years ago, but Bamako appears to have denser, grid-like structures with sections of the city well-connected to arterial roads, while Accra has a much lower degree of rectangularity and much fewer lineal connecting roads. Note that for the same map scale, we see much more of the city in Bamako than in sprawling Accra. Henderson shows that this is a feature of Anglophone cities, which tend to sprawl compared to Francophone ones largely because under British rule, colonial and native sections were left to develop without an overall plan and coordination. Whereas, integrated city planning and land allocation mechanisms were a key feature of French colonial rule.



New plans for African cities
 
Land use regulations, building standards, and zoning are all tools with tremendous power to bring people into cities or keep them out instead. Too often in African cities, developers and everyday citizens are side-lined to the outskirts where looser restrictions coupled with ambiguities over jurisdictional responsibilities, make development much easier and affordable.
 
One question is whether African cities can and should aspire to a western model of spatial development, or whether they should work towards incremental changes, developing existing strengths and moving towards some means of semi-formal development that encourages greater density. Land policy and spatial planning have a critical role to play in this process, ultimately determining how cities will densify and expand as they grow.
 
In the city centers, land policy needs to be adaptable and consistently readjusted to provide guiding principles on urban renewal and regeneration that promote suitable means of densification. At the outskirts, where we see concerning trends of urban sprawl and encroachment into peri-urban and rural lands, local communities should also have a strong role to play to ensure expansion is sustainable and land is clearly defined and demarcated to support the growth of the local community.

The McCracken County Mustangs used a 36-point 2nd quarter to capture a 50-12 win over (3-8) Jeffersontown Friday night.

Franklin Hayes led the way for McCracken County with three rushing touchdowns, including the first two scores of the game. Hayes ran it in from 24 yards out to give the Mustangs an 7-0 lead with 7:37 left in the opening quarter.

Hayes picked up the scoring early in the 2nd, this time he ran it in from 50 yards out to make it 15-0 with 11:04 in the 2nd.

The Mustangs would score four more times in the half to give McCracken County a 43-0 halftime lead.

McCracken County (8-3) advances to the 2nd round of the Class 6A Playoffs to host Louisville Ballard next Friday night at Marquette Stadium.

 

Paducah Tilghman scored early and often to blitz their way into the 2nd round of the Class 3A Playoffs with a 50-7 win over Hart County.

Makel Askew used a 125 yard 1st half performance to propel the offense early. His first touchdown of the night came on a 3-yard run to make it 7-0 Blue Tornado halfway through the first.

Tay Shawn Carruthers extended the lead later in the quarter on a 35 yard run to make it 15-0. Then Malachi Kirby would dial up a run from 35 yards out to make it 22-0 Tilghman late in the opening quarter.

Paducah Tilghman will be looking for their 10th win of the season next Friday in the 2nd round of the playoffs at McRight Field.

 

Q Daryius McHenry carried the ball 33 times for 342 yards and six touchdowns as Grayson County  outscored Graves County 54-35 at Eagle Field.

Ryan Mathis threw five touchdown passes, two to Race Richards, two to Nelson Browning and one to Drew Cooper as the Eagles season came to a close at 5-6.

The Cougars (8-3) advance to the second round of the Class 5A Playoffs next Friday, where they will travel to South Warren.

People are tired." ​Nowhere was the frustration more palpable in Georgia, where Democrat Stacey Adams was running to be the country’s first female black governor against Republican Brian Kemp, the secretary of state whose oversight of elections was a central campaign issue. Voters reported showing up only to find that their names were not on active voter registration rolls. Others said they’d been denied provisional ballots, Sara Henderson, executive director Common Cause of Georgia, told VOA.  After numerous reports of long lines, malfunctioning equipment and other issues, Common Cause got two local judges to extend voting hours at several precincts.  But Henderson said the results in close contests may not be known for several days or longer. That is because voters who cast provisional ballots would have to return to their election boards within three days to have their ballots validated.  "I think we’re in for a few days of trying to figure all this out," Henderson said. Well before Tuesday’s vote, Georgia’s electoral system had drawn the scrutiny of voting rights advocates. Last month, Common Cause petitioned a court to block a state law requiring voter registration forms to exactly match data on file with state agencies. The law had potentially barred more than 53,000 Georgians from registering to vote.  Many of those affected by the ruling were later allowed to register after a court issued an injunction temporarily suspending the match rules.  Elsewhere, reports of broken ballot scanners surfaced at several polling places in New York City, the Associated Press reported. Turnout was so heavy at one packed precinct on Manhattan's Upper West Side that the line to scan ballots stretched around a junior high school gym. Voters arriving at two separate polling stations discovered that most scanners had broken down, forcing some people to drop their ballots in "emergency ballot boxes" or vote with an affidavit ballot. "There are broken scanners everywhere in Brooklyn," Stefan Ringel, spokesman for Brooklyn Borough President Eric Adams, said. ​In Phoenix, a polling site was foreclosed on overnight. The owners of the property locked the doors, taking election officials by surprise. Voters had been sent to another precinct nearby, but Maricopa County Recorder Adrian Fontes said the location in Chandler was up and running shortly after 7 a.m. Tuesday. For about an hour after polls opened Tuesday morning, a Sarasota County, Florida, precinct had to tell voters to come back later because their ballots were not available. Computer problems snarled voting for hours in Indiana, where a judge ordered 12 polling places in one northwestern county to stay open late after voting didn't start on time. In Texas, home of a narrowly contested U.S. Senate race, delays were reported in Houston after apparent issues with registration check-in machines. The U.S. Border Patrol also canceled a "crowd control exercise" that was scheduled for Tuesday in El Paso after criticism from civil liberties groups that it was too close to a polling center and could scare voters away. ​Federal officials said there were no signs of any foreign cyberattacks on critical election systems, although social media trolls targeted some voters with misinformation. Several hours before polls closed, Homeland Security Secretary Kirstjen Nielsen cautioned that the Russians "have a full court press through many means." Still, officials insisted that two years of preparations are paying off as intrusion sensors had found no evidence of hacked systems.  There were "no tie-backs to any foreign actors that we’ve seen," said Chris Krebs, undersecretary for the Department of Homeland Security’s protection directorate.  WATCH: No foreign meddling ​Social media companies acted swiftly to take down what appeared to be deliberate misinformation, Krebs said. Several incidents were referred to law enforcement for investigation.  Nearly 100 million Americans were expected to take to the polls in an election that was widely seen as a referendum on the presidency of Donald Trump.   If you care about the standards Nashville sets for swapping, selling, or renting your public park land for private, profit-making purposes, please follow this matter closely and share with fellow lovers of parks. If you were interested or engaged in the Fort Negley/Greer Stadium/Cloud Hill debate, you should be engaged in this matter too.

Ask yourself what has been the catalyst for these two recent contentious conversations about our parks? 
#1.  A developer has an idea/desire and goes to the Mayor’s Office where the developer finds a willing ear and a pride and penchant for deal making. The developer and the Mayor’s Office compile a complex package with several community benefits, which obfuscate the deal’s core flaws and make it appealing to a variety of constituencies. After everything has been worked out to the maximum benefit of the developer, they trot the deal out for some token “community engagement.” As I said regarding the Cloud Hill proposal, this approach to community planning is top-down and backwards. Smoke and mirrors. Again. 

The recent Plan to Play Master Plan calls for MORE park space and pocket parks in the downtown core. Swapping this lone park, ideally located right across from our beautiful downtown library, for an awkward parcel on James Robertson Parkway with high traffic volume, high speeds, next to a traffic island and a parking garage, one building away from the bus station, at a major intersection and immediately adjacent to the already sizable and successful Public Square Park, is NOT a gain or even a balanced swap. It is a loss for Church Street, the core of downtown, which is already lacking green space, and for Nashville’s future.

Church Street Park has several problems and challenges today. A group of homeless persons spend the majority of their day in the park and thus in the absence of intention, vision and planning, the park has been allowed to languish rather than being elevated into the gem that it can and should be for everyone who lives and works nearby. Every major city has homeless persons, and every major city has pocket parks. We are not unique. If we truly want to make this a great park, we can. Not saying it’s easy, but it’s the right thing to do.

With the passage of the proposal before the Parks Board, Church Street Park will cease to exist and become another Giarratana high-rise tower. To soften this blow, it is proposed that he would contribute funds and design for the adjacent street to become an enhanced, park-like streetscape. I’m sure that would be lovely, but we don’t have to swap the park to create that. Just like we don’t have to swap the park to design and build supportive housing for the homeless on 2nd Avenue North that the city already owns.

This “swap” is a bad deal. I urge you to speak up to the Parks Board to oppose it, if you agree. Don’t hesitate to contact me, if you’d like to discuss or learn more. Please follow the provided link to read deal-related documents and be sure to send an email asap to metroparks@nashville.gov and councilmembers@nashville.gov. The developer’s team has already set up an automated email to encourage support of the land swap. It is important that you lend your voice as well.

The public hearing on Oct 22 at 6:00 PM is specially called, and the Parks Board will deliberate and vote on the matter at their regular noon meeting on November 6. Don’t delay! Your participation is needed to #SaveChurchStreetPark. Please share this post!

Rod's Comment: I support saving Church Street Park.  As Councilman Henderson points out, the reason behind this proposed swap is that the Church Street Park has been taken over by the homeless. The park is not a pleasant place to sit and enjoy the outdoors.  If not for the homeless takeover, it could be.  If you are not familiar with the park, it is directly across the street from the stately downtown public library. It has a nice fountain and the back wall of the park features a large interesting mural.  

I don't know the limits of policing authority to curtail the homeless residency in the park but surely

there is something that can be done to reclaim the park for public use. It seems to me that the park could restrict homeless use by prohibiting overnight sleeping in the park, perhaps closing the park from  12 AM to 6 AM and posting and enforcing a "Keep Off the Grass" rule.  Rules against alcohol consumption and other violations could be enforced. In any event, it should not be the policy of the city to close a park and develop the land, just because it is being used by the homeless. There has to be a better solution.  Cities in which people live need green space. 


Also, we cannot just surrender public places to the homeless.  The grand public library is frequented by the homeless who sit in the reading room and who use the public restroom.  Should we close the library? 

Ms Henderson is also right about the deal.  Even if the city deemed it a good policy to close the park, it should be closed and the site developed in an open transparent process not by means of a backroom sweetheart deal. 


Since Ms Henderson posted the above to her Facebook page, the Metro Parks board's acquisition committee, in a tie vote, voted 3-3 on recommending approval of the Church Street land swap deal. Mayor Briley appeared before the Committee speaking in favor of the deal as did the district Councilman Freddie O'Connell.  Councilman Angie Henderson spoke against it. This coming Tuesday, the full seven-member Park Board will take up the issue. The Committee's vote will not be binding but would carry considerable weight with members of the Metro Council who ultimately will decide the issue.

To learn more about the issue and the details of the land swap, read the Tennessean's coverage at this link.  If anyone is inclined to appear at the Park Board meeting, the board meets at 12:00 p.m., on the first Tuesday of each month at the Parks Headquarters, 2565 Park Plaza. The next meeting at which time the Board is taking up this issue is November 6th. There is not a public hearing on the issue but sometimes the presence of members of the public at an event can impact a body's decision. I have not seen any public call for supporters of the Park to attend the Board meeting.

  • Men’s basketball: Tops Can't Sustain Lead in 73-55 Loss to Washington: WKU Hilltopper Basketball led No. 25/24 Washington by nine points at halftime Tuesday, but couldn't sustain the lead on the road in a 73-55 loss to open the season. 1st District Magistrate winner Keith Berry said he was nervous all day awaiting the election results. Berry faced off against Republican JR Stanley for the seat with final numbers being 1,684 to 1,542.

CITY HENDERSON POLICE 300HENDERSON, Ky. (11/6/18) — A man was taken to the hospital following a two-vehicle accident Monday evening in Henderson.

Henderson Police Department reported officers responded 5:40 p.m. to the intersection of Audubon and South Green streets.

Rebecca Sutton, 46 of Henderson, was driving south on Green, when Dion McGuire, 52 of Henderson, turned left from Audubon Street, according to the report. Sutton told police she was unable to stop before striking McGuire’s vehicle.

McGuire was taken to Methodist Hospital for treatment of minor injuries.

          HCHS Archery Team to Hold First Practice/Parent Meeting      Cache   Translate Page      

HCHS ColonelsHENDERSON, Ky. (11/5/18) — The Henderson County High School archery team will host its first practice and a parent meeting in the archery building from 5-6 p.m. on Thursday, Nov. 8.

Student-athletes attending the practice should bring their sports physicals, archery forms and the $25 shooter fee. Forms will be available for anyone who needs them.

High school archery teams across the state are preparing for the 2018-19 season.

Legendary Texas Lawman In 1930 Sweeten was appointed deputy constable at Trinidad, Texas, and the following year was promoted to deputy sheriff. In 1932 he ran successfully for the Henderson County sheriff's office, becoming the youngest sheriff in Texas, and served for the next twenty-two years. The six-foot-four, 225-pound Sweeten gained a reputation as a hard-nosed investigator and a crack shot. During his tenure he shot nine men, killing three, including Gerald Johnson, the so-called "Dallas Kid" whom Sweeten gunned down after a high-speed car chase through Athens. He also solved numerous high profile crimes, including the murders of the McGeehee family and Mr. and Mrs. W._T._German, both of which attracted the attention of the national media. In one instance, he reportedly interviewed a suspect in a kidnapping case for sixteen days and nights without letup. Not surprisingly, Sweeten's tough methods elicited both praise and criticism. In the 1960s in the wake of civil rights reforms he once said: "I broke 21 murder cases and sent three to the electric chair....But if I had to work under the conditions I'd have to work under today, I doubt if I could have broken all those cases." If you questioned a suspect like that now, he continued, "the Supreme Court would have put the sheriff in jail." An expert marksman, he conducted shooting exhibitions for schools and civic clubs throughout his career. In 1969 Sweeten was elected mayor of Athens, serving until June 1970, when he resigned due to business commitments. What kind of difference will four weeks make? It seems like a month since the Tigers have taken the field at the Liberty Bowl. (Because it's been a month since the Tigers took the field at the Liberty Bowl.) At kickoff on October 13th (against UCF), the Tigers were clinging to hope in their effort to repeat as American Athletic Conference West Division champs. But the 31-30 loss to the Knights gave Memphis three league losses and all but extinguished those hopes. The Tigers absorbed a drubbing at Missouri the following week, followed by a bye and finally a road win — their first — last Saturday at East Carolina.

The Tigers will host Tulsa (2-7) four days after Penny Hardaway's Tigers tipped off their much-anticipated season and a day after the Memphis women's soccer team hosts Wisconsin in a first-round NCAA tournament game at Mike Rose Soccer Complex. Yes, the case could be made that Saturday's football game is the week's third-most significant event involving blue-clad Tigers. And, once more, a weak sister on the other sideline. Add the Golden Hurricane's record to those of the four FBS teams Memphis has beaten and you have a combined mark of 9-35. But it's a Catch 22 this season. The Tiger defense isn't fit to beat prime competition, so a happy exit from the Liberty Bowl for local fans seems to require bottom-feeding competition. It will be interesting to see not just the attendance figure Saturday morning (kickoff is 11 a.m.), but the mood of those in the stands.

The Darrell Henderson story continues to thrill. Henderson ran for 132 yards and scored three touchdowns last week at East Carolina, but it actually didn't feel like a Darrell Henderson game. Perhaps this is because only one of his scores covered more than 50 yards (the others were merely 20 yards and 39 yards). This is how skewed our perspective — or at least my perspective — has become in the season's ongoing highlight reel. Henderson's 1,280 yards are the most in Memphis history (single season) by a man not named DeAngelo Williams. His career total of 2,916 is second only to Williams' 6,026. (Read that latter figure again, in case you've forgotten just how great a college player Williams was.) Henderson has scored 18 touchdowns (tied for tops in the country) and two more trips to the end zone will tie him with Anthony Miller on the Tigers' career chart with 40 (second to Williams's 60). He actually has a chance to break one of Williams's records: 23 touchdowns in a single season (2004).

Henderson is third in the country with 44 plays of at least 10 yards (behind two wide receivers). He's had 15 plays go at least 30 yards and nine at least 50. The numbers are as silly as they seem. Enjoy every Henderson carry (or catch) the rest of the season. He may be playing on Sundays a year from now.

 How soft has the Tiger defense become? Well, the numbers (and rankings) are ugly. Out of 130 FBS programs, Memphis ranks 95th in scoring defense, allowing 31.6 points per game. The Tigers are 86th in total defense (417.2 yards per game) and 80th in opponents' third-down conversions (40.4 percent). Memphis has allowed 132 plays of at least 10 yards, also 80th in the country.

The good news? The Tigers are on track to score 500 points for the fourth year in a row, thus the 5-4 record to date. But the U of M requires a significant transformation on the defensive side of the ball before we return to a discussion of Top 25 possibilities.

A shortboard and a windfoiling session for me yesterday. During the last one, taking advantage of the presence of Jimmie Hepp, I got this shot at Lanes that made me wonder how many other windfoilers in the world are riding waves (I sure don't see many in Maui!). I love the wave windfoiling videos and I also find the freestyle one pretty crazy.

Difficult readings to interpret at the buoys today, as the periods are all over the place. I'm going to focus on Pauwela and state that, IMO, the 11s energy is what is left of the swell we had the past couple of days, while the 15s one is from a new swell that is predicted to pick up today. Similar situation at Waimea. The NW101 buoy didn't register the longer periods, but went up again in the 12s range. Most likely the waves will be pretty small (but finally clean!) in the morning at Hookipa and only increase in the afternoon. Quali sono gli effetti e le conseguenze delle elezioni di medio termine che si sono tenute ieri in Usa? La curiosità attorno all'evento più calde delle ultime settimane è stata una costante nella sessione di oggi dei mercati. Anche Nick Watson, Janus Henderson multi-asset team, ha commentato le elezioni di mid term USA e ha evidenziato le principali implicazioni legate all’esito elettorale. Secondo l'analista tre sono i principali ambiti di effetto delle votazioni americane 2018:  Con il controllo del Senato, eventuali incarichi esecutivi o giudiziari saranno confermati. Tuttavia la realizzazione di qualsiasi punto in agenda diventerà impegnativa, ad esempio la costruzione del muro sul confine con il Messico. Inoltre difficilmente verranno messi in campo ulteriori incentivi e tagli fiscali. L’esito delle elezioni dà anche spazio ai democratici nel tener sotto controllo la condotta dell'amministrazione Trump. L'impeachment, per il momento, è da escludersi. Per quello che invece riguarda i mercati, Nick Watson ritiene chela capacità di Trump di fornire all'economia e ai mercati statunitensi ulteriori stimoli sarà probabilmente limitata nei prossimi due anni. Le sue scelte in politica economica, che oltre a una riduzione delle imposte hanno previsto un'espansione fiscale pro-ciclica, hanno sicuramente stimolato la crescita spingendo al rialzo anche i mercati. Tuttavia, la spaccatura tra il Senato e la Camera e la contrapposizione tra l’agenda dei repubblicani e quella dei democratici rendono altamente improbabile qualsiasi accordo su ulteriori politiche espansive. Il passaggio dai picchi raggiunti dal presidente Trump (tra cui predominano l’ottima performance registrata dall’indice S&P 500 e il miglioramento dei dati economici) a uno scenario più convenzionale, probabilmente, sarà ulteriormente enfatizzato dal ritmo di rialzi della FED; un inasprimento della politica monetaria non è irragionevole con l'inflazione vicina al target prestabilito e la disoccupazione al 3,7%. Sospetto che Trump muoverà nuove critiche nei confronti dell’Istituto centrale da qui in avanti, soprattutto perché (attualmente) non può interferire con la politica monetaria! Guardando alle elezioni presidenziali nel 2020, l'esperto ritiene che Trump non sarà in grado di favorire un’accelerazione dell'attività economica, oltre che una rinnovata spinta al rialzo della fiducia delle imprese o dei mercati, al fine di aumentare il sostegno per la sua campagna di ri-elezione. Pertanto, potrebbe invece puntare sull’espansione delle aree che può controllare senza il contributo del Senato e del Congresso – tra cui ad esempio la politica estera, il commercio e il livello di antagonismo dall'account Twitter. In conclusione, quindi, i risultati elettorali delle elezioni di mid term Usa sembrano essersi rivelate un “non-evento”. Ieri l'indice S&P ha chiuso lievemente al rialzo, mentre il rendimento dei Treasury decennali USA è sceso leggermente al di sotto del livello del 3,2%. I mercati torneranno presto a focalizzare la loro attenzione sulla guerra commerciale tra Stati Uniti e Cina, in vista dell'incontro tra Xi Jinping e Trump che si terrà verso la fine di questo mese al G20, in Argentina. La perdita dei Repubblicani alla Camera non implica un rallentamento economico o una correzione del mercato. Sfortunatamente, è più che altro probabile che andremo incontro a una maggiore volatilità, ma, allo stesso tempo, a una maggiore attenzione alla valutazione, ai fondamentali e alla diversificazione; uno scenario che dovrebbe presuporre un contesto migliore per i selezionatori di titoli e gli asset allocator. Louisiana passes amendment ending split jury verdicts

NEW ORLEANS (AP) - Supporters of a constitutional amendment ending split jury verdicts are celebrating their victory.

The amendment passed Tuesday. It ends 10-2 or 11-1 verdicts in felony cases. The amendment was supported by a wide range of groups and individuals across the political spectrum.

Americans for Prosperity cheered the amendment's passage, saying it protects the rights of the accused and ensures verdicts are beyond a reasonable doubt.

The conservative organization is the main political advocacy group for billionaire Charles Koch, who has supported criminal justice overhauls in several states, including Louisiana. Norris Henderson, state director of the Unanimous Jury Coalition, says the passage shows the nation that people can come together for the "common cause of freedom."

Abstract
Brain-machine interfaces (BMIs) that decode movement intentions should ignore neural modulation sources distinct from the intended command. However, neurophysiology and control theory suggest that motor cortex reflects the motor effector's position, which could be a nuisance variable. We investigated motor cortical correlates of BMI cursor position with or without concurrent arm movement. We show in two monkeys that subtracting away estimated neural correlates of position improves online BMI performance only if the animals were allowed to move their arm. To understand why, we compared the neural variance attributable to cursor position when the same task was performed using arm reaching, versus arms-restrained BMI use. Firing rates correlated with both BMI cursor and hand positions, but hand positional effects were greater. To examine whether BMI position influences decoding in people with paralysis, we analyzed data from two intracortical BMI clinical trial participants and performed an online decoder comparison in one participant. We found only small motor cortical correlates, which did not affect performance. These results suggest that arm movement and proprioception are the major contributors to position-related motor cortical correlates. Cursor position visual feedback is therefore unlikely to affect the performance of BMI-driven prosthetic systems being developed for people with paralysis.

Larry Franklin Tiner 57, of Labelle, Fl. passed away at home Monday November 5, 2018. He was a lifelong resident of SWFL. He worked for many years as a Supervisor for Sunnygrove Landscaping. He enjoyed the outdoors and the woods. He loved his granddaughter and she was his pride and joy. 
He was predeceased by his father Franklin B. Tiner. Surviving are: his son Ben Ross (Erin) Tiner; a daughter Kailah Tiner; his mother Marie; granddaughter Kalee Tiner; brothers Adam and David Tiner of Samson, AL; significant other Terri Skinner, and several aunts, uncles, and cousins.

Lawrence "Larry" D. Spencer died peacefully surrounded by his family. after a three-year battle with MDS/Leukemia, on November 3rd, 2018 at the age of 84, nine days shy of his 85th birthday.
Larry was born in Big Beaver, MI on November 12th, 1933. He was drafted in the Navy in 1952 during the Korean War and was stationed at Moffett Naval Air Station in Sunnyvale, California where he worked as a tool and die maker. In the early 1970s, he moved to LaBelle Florida and had a successful career in Real Estate for many years. He has lived there with his family ever since.
Larry was an accomplished realtor and a professional horse trainer. A very family oriented man, he coached his children's sports teams for many years as they grew up. Larry was a history buff who loved reading books, completing puzzles and watching Jeopardy. He loved all sports, but he most especially loved cheering for his favorite football team, the Miami Dolphins.
Larry will be lovingly remembered by his wife of 40 years, Frances White Spencer and his children, Barbara (Rafael) Mateo, Michael Spencer, Denny (Courtney) Spencer, Bret (Carina) Spencer and Breanna Spencer. Larry will also be fondly remembered by his grandchildren, Rachel, Ella, Denise, Tiffany, Leyton, Koby, Tanner, Gracie and Justin; by his siblings Doralee (Bernie) Torgler, Norman (Margi) Spencer, Pat (John) Finch and Tim (Margaret) Spencer; by his mother-in-law Evelyn Crosby White; by his sisters-in-law Louise Rimes, Trudy (Mark) Henderson; and by his brother-in-law, Bobby (Debbie) White.
Larry was predeceased by his parents, Orville and Dorothy; his daughters, Sharon and Debra; and grandsons John Paul Burchard and Scott Smith.
A memorial service is scheduled for 2:30 PM on Thursday, November 8th, 2018 at Community Harvest Worship Center located at 55 Orange Ave, LaBelle, Florida. Please join his family in remembering and celebrating someone who gave so much to the community, his friends, and most especially his family!

The tender for a site in Kai Tak has been awarded on a 50-year land grant at a premium of $8.33 billion, the Lands Department announced today.

 

New Kowloon Inland Lot No. 6574 at Kai Tak Area 4B Site 3 was awarded to a syndicate formed by companies including Wheelock Properties, New World Development and Henderson Land Development.

 

It has a site area of about 9,706 sq m and is designated for private residential purposes.

 

The minimum and maximum gross floor areas are 32,030 sq m and 53,383 sq m.

Liverpool will look to firm their grip on top spot in Group C when they travel to Serbia for their UEFA Champions League clash with Red Star Belgrade on Tuesday.

Jurgen Klopp's side hold a one-point lead over Napoli at the midway point of the group stage, with two wins and one defeat from their opening three games.

The Reds kicked off their European adventure with a dramatic 3-2 victory over Paris Saint-Germain on matchday one, before being beaten 1-0 by the Azzurri a fortnight later.

They ran out convincing 4-0 victors over Zvezda at Anfield last time out, but will face a tricky return tie in the Serbian capital.

The champions of Serbia are bottom of the pool, having picked up just one point in three matches and shipping 10 goals in their last two outings.

Vladan Milojevic's troops made a good enough start after holding the Naples outfit to a goalless draw, but heavy defeats to PSG (6-1) and the Merseysiders have left their Champions League hopes in tatters.

In team news, Klopp welcomes back Naby Keita, who missed the last four games with a hamstring injury he sustained on international duty with Guinea.

ELBURN - Elburn American Legion Post 630 will celebrate Veterans Day with a dedication of a memorial that honors local veterans who served in World War I and World War II. 

The public is invited to attend the ceremony at 11 a.m. on Sun. Nov. 11. The new memorial is located in the newly named Veterans Memorial Park, 301 E. North St. American Legion members recently installed two bronze plaques that have hung in the American Legion Post for several years on newly built brick walls in the park. One of the plaques features the names of eight soldiers who died during World War I and World War II, while the other includes the names of the Elburn veterans who served in either war. The Legion has also installed five permanent flagpoles to fly the five service flags on holidays and special occasions. Both the memorial plaques and the flagpoles will be lighted. The ceremony will include remarks by keynote speaker Paul Gardner, past Department of Illinois American Legion Commander, and a rifle volley performed by the Elburn American Legion Post Honor Guard. 

Elburn resident and World War II veteran Claude Henderson, whose name is on one of the plaques, will be at the ceremony with his wife Doris, as will a niece and nephew of World War II veteran Robert Motz. Legion Post Chaplain Jim Elgar will offer the opening and closing prayers and American Bank & Trust Elburn Branch Manager Katherine Bettinghaus will sing the national anthem.  Gary Moore of the Blackberry Masonic Lodge 359 will place a cornerstone on one of the memorial walls.
