Directly across from the Cathedral of Saint Paul is a flagpole with a small plaque commemorating an under-celebrated but still important event: the site of the first guided school crossing.

Crossing guards are ubiquitous within the United States and beyond, shepherding backpack-bearing kids across busy roads. But that wasn’t always the case.

Kids used to make their way to school unchaperoned. But as car travel became more common in the early 20th century, school officials became aware of the dangers of pedestrian travel. While adults typically looked both ways before crossing a busy street, kids tended to be a bit less cautious, putting them at serious risk.

Sister Carmela Hanggi, the principal of the school near the Cathedral of Saint Paul, organized a group of volunteer eighth-grade boys to help the younger students safely cross the street. On February 17, 1921, the guards she appointed helped students cross the street to the cathedral in the country’s first monitored school crossing. School patrols and crossing guards have been helping kids get across the street ever since.

Est-il légitime de payer des impôts ? Il semble immoral et égoïste de chercher à échapper à l'impôt et d'en faire porter le poids aux autres. Interrogé à ce sujet, Jésus lui-même n'a-t-il pas répondu de rendre à César ce qui est à César et à Dieu ce qui est à Dieu (Mt 22, 21) ? Saint Paul également a appelé les premiers chrétiens à respecter l'autorité politique et à rendre à chacun ce qui lui est dû: " à qui l'impôt, l'impôt ; à qui les taxes, les taxes " (Rm 13, 7). La messe est dite. Rendre à César ce qui est à César La situation n'est cependant pas si simple. Jésus a refusé d'être un chef politique. Lors de son procès, il affirma clairement " mon royaume n'est pas de ce monde " (Jn 18, 36). La célèbre phrase de Jésus, demandant de rendre à César ce qui est à César, rapportée dans les trois évangiles synoptiques, est à relire dans son contexte. Le Christ ne donnait pas un cours d'économie, ni de philosophie politique, il déjouait le piège que lui tendait des Pharisiens hypocrites, en vue de le perdre (Mt 22, 18). Si le Christ a demandé de rendre à César ce qui est à César et à Dieu ce qui est à Dieu, il laisse ouverte la question de savoir ce qui revient à chacun. Ailleurs, le Christ avait demandé de chercher le Royaume de Dieu, avant les considérations matérielles, auxquelles Dieu pourvoira (Mt 6, 33). Il est un devoir civique pour les citoyens de respecter le pouvoir politique, dans le sens où toute autorité vient de Dieu. Saint Paul l'exprimait déjà aux Romains (Rm 13, 1-7). Cependant, cette soumission au pouvoir politique n'est pas absolue. Seul Dieu peut tout exiger de l'homme. " Le citoyen n'est pas obligé en conscience de suivre les prescriptions des autorités civiles si elles sont contraires aux exigences de l'ordre moral, aux droits fondamentaux des personnes ou aux enseignements de l'Evangile " (Catéchisme de l'Eglise Catholique, 2242). Lorsqu'ils sont placés devant des actions moralement mauvaises, les citoyens ont même " l'obligation de s'y refuser " (Jean-Paul II, Evangelium vitae, 73). L'Etat trouve sa légitimité dans la recherche du bien commun, qui consiste à assurer les conditions permettant aux personnes de s'accomplir. Pour ce faire, l'Etat a naturellement besoin de lever des rentrées fiscales. Le système fiscal actuel respecte-t-il un ordre moral ? Les impôts respectent-ils les droits fondamentaux des personnes et les enseignements évangéliques ? La doctrine sociale de l'Eglise est claire, " l'action de l'Etat et des autres pouvoirs publics doit se conformer au principe de subsidiarité et créer des situations favorables au libre exercice de l'activité économique " (Compendium de la doctrine sociale de l'Eglise, 351). De plus, " Le devoir fondamental de l'Etat en matière économique est de définir un cadre juridique capable de régler les rapports économiques, afin de "sauvegarder (...) les conditions premières d'une économie libre" " (Compendium de la doctrine sociale de l'Eglise, 352). Si l'Etat a besoin d'impôts pour assumer ses fonctions, il ne doit pas s'opposer au libre exercice de l'activité économique et remettre en cause les fondements d'une économie libre, qui rend possible le développement économique et le recul de la pauvreté. Le montant des recettes fiscales en France n'a cessé de progresser, passant de 33% du PIB en 1965 à 45% en 2016[1], soit le taux le plus élevé au monde après le Danemark. C'est-à-dire que presque la moitié des richesses créées en France sont prélevées par l'Etat. A la différence de l'échange de biens et services sur le marché libre, l'impôt, comme l'étymologie l'indique, est imposé (placé sur). Alors que l'échange libre respecte par définition le libre consentement de l'acheteur et du vendeur, qui trouvent un intérêt mutuel à échanger, la légitimité de l'impôt est moralement plus fragile, puisqu'il n'y a pas d'échange réciproque de consentements, mais une inégalité juridique et de moyens entre l'Etat et le citoyen. Un gouvernement peut décider arbitrairement et unilatéralement d'un changement de fiscalité, auquel le citoyen ne peut que se soumettre. Dans le droit privé, un des contractants ne peut pas décider arbitrairement de changer les conditions du contrat sans l'accord de l'autre partie. Cette distorsion et cette absence de réciprocité laisse entrevoir la tentation pour les responsables politiques de pratiquer une fiscalité abusive, sans pouvoir de contestation des citoyens, sauf par l'exil. Le Concile Vatican II a décrit la propriété privée " comme un prolongement de la liberté humaine "[2]. Pour respecter les conditions d'une économie libre, l'Etat doit garantir le respect des propriétés privées et la liberté des échanges. Juridiquement, l'essentiel des propriétés en France sont privées, mais la fiscalité réduit considérablement la nature de la propriété. Par exemple pour le simple fait de posséder un bien immobilier - sans revenu associé, comme un loyer - le propriétaire est soumis à une taxe foncière. En d'autres termes, le propriétaire doit payer un impôt pour le simple fait d'être propriétaire. Il serait plus juste de dire que l'Etat est le propriétaire en dernier ressort et que le " propriétaire juridique " n'est qu'un bailleur, propriétaire de ce que l'Etat consent - temporairement - à ne pas lui prendre. Il est d'ailleurs possible d'assurer un bien immobilier contre divers risques (vols, incendie, intempéries) pour lesquels les assurances sont en compétition, mais aucun assureur ne propose une assurance contre le changement de fiscalité. De grandes disparités dans les recettes fiscales Le montant des recettes fiscales de 45% en 2016 en France, déjà considérable dans l'absolu, cache de grandes disparités. 45% est une moyenne. Pour un salarié du secteur privé en France, le total des charges sociales salariales et patronales est égal à 82 % de son salaire net. Ce qui signifie que lorsqu'une entreprise verse 100 euros, 45 euros sont prélevés sous forme de cotisations - sans qu'ils ne soient jamais versés aux salariés - et 55 euros sont versés aux salariés sous forme de salaire net. Le salaire net porte mal son nom puisqu'une partie de celui-ci est ensuite ponctionnée par l'impôt sur le revenu, dépendant du montant des revenus et de la composition du foyer. Un célibataire sans enfant avec 32 000 euros de revenus nets doit payer 3 893 euros d'impôts sur le revenu, soit un taux d'imposition de 12,2%[3]. A ces impôts s'en ajoutent bien d'autres, entre autres la taxe d'habitation, la taxe foncière, les impôts sur les plus-values, les taxes sur les donations et successions et le premier impôt de France, payé à chaque achat : la TVA, dont le taux normal est de 20%[4]. L'accumulation de ces impôts peut représenter pour des salariés plus de 70% de la valeur ajoutée qu'ils créent. La fiscalité française est telle que les impôts peuvent représenter plus de 100% des revenus nets réels, notamment dans le cas de revenus financiers, lorsque les plus-values sont inférieures au montant de l'inflation[5]. Qu'un Etat ait besoin de recettes fiscales pour fonctionner est une chose, que des ménages se fassent ponctionner la grande majorité, voire la totalité de leurs revenus par l'Etat remet en cause le droit de propriété et les conditions d'une économie libre. Des charges fiscales excessives sont nuisibles à plusieurs titres. Elles brident les citoyens dans leur libre initiative économique. Si un citoyen se fait prélever 70% de la richesse qu'il crée, il n'a plus de liberté que pour gérer les 30% restants. Sa capacité d'entreprendre, de prendre des risques, d'investir, de transmettre un patrimoine à ses enfants est nettement limitée. La fiscalité peut faire baisser la richesse globale. La fiscalité transfère des biens de leurs propriétaires légitimes vers d'autres finalités. Or si la valeur des biens et services créés par l'Etat est inférieure aux impôts prélevés, il y a une destruction de richesses. Transférer des sommes considérables à une administration pléthorique (5,45 millions de personnes travaillant dans la fonction publique en France, au 31 décembre 2015) entraîne des comportements bureaucratiques où la défense des positions acquises et la recherche de gratifications personnelles peuvent l'emporter sur le service des citoyens et la recherche du bien commun. Centraliser une grande partie des richesses créées entre les mains de l'Etat génère également des situations d'aléa moral, puisque des particuliers, comme des dirigeants d'entreprises, sont incités à solliciter l'Etat pour récupérer une partie de ces recettes, plus qu'à travailler. En France, deux célibataires vivant de minima sociaux versés par l'Etat vivent mieux qu'une personne seule se levant tous les matins pour travailler à temps plein en gagnant le salaire minimum. Aux Etats-Unis les montants dépensés par certaines entreprises pour du lobbying politique peut représenter plusieurs millions de dollars par an[6]. Ces pratiques détournent des ressources rares d'autres finalités plus productives. Il est " plus rentable " pour certains dirigeants d'entreprises de consacrer une partie de leur temps à faire de l'influence politique plutôt qu'à réaliser leur tâche principale : comprendre, anticiper et répondre aux besoins de clients potentiels. Tel ne serait pas le cas si les Etats ne créaient pas des " cagnottes fiscales " à disposition d'intérêts constitués. La fiscalité, quelque soit la nature des impôts, leur montant et leur mode de collecte, n'est jamais neutre pour l'économie. Taxer un secteur plus qu'un autre, avoir une fiscalité progressive au-delà de certains taux, accorder des niches fiscales à certains investissements modifient les préférences et les comportements des individus. Ainsi une fiscalité et des réglementations lourdes sur l'immobilier ont détourné des investisseurs de ce secteur. Afin de palier à une pénurie de logements et de faire revenir des investisseurs, l'Etat doit régulièrement accorder des avantages fiscaux, pour réorienter l'épargne vers l'immobilier. Enfin et surtout les impôts accaparés par l'Etat ont détourné d'autres finalités que leurs propriétaires légitimes leur auraient données : épargne, investissement, consommation. Il est dans la nature humaine de porter plus de soin à ce qui nous appartient en propre, qu'à ce qui appartient à la collectivité, Aristote l'avait déjà relevé. Il n'est de véritable entrepreneur, que celui qui par ses efforts personnels prend des risques pour répondre mieux que d'autres aux besoins des consommateurs. Même avec les meilleures intentions et les meilleures compétences au monde, des personnes placées à la tête de monopoles publics ne disposent pas de la stimulation et d'un processus de découverte procurés par la concurrence, pas plus que des sanctions positives ou négatives du marché, pour savoir si une décision répond de la meilleure manière aux besoins des consommateurs. Le pape Léon XIII écrivait dans Rerum novarum que " la propriété [pouvait être] épuisée par un excès de charges et d'impôts[7] ". Il semble difficile de contester que la France se trouve dans cette situation. Dieu seul sait quelle serait aujourd'hui la richesse des Français et leur niveau de vie si l'Etat laissait les citoyens propriétaires d'une plus grande part des fruits de leur travail, comme aux Etats-Unis, la Suisse ou en Irlande, où la fiscalité ne pèse pas plus d'1/4 du PIB. Sortir de la situation actuelle n'est pas aisé. Un pays fortement fiscalisé s'engouffre dans un cercle vicieux, car il fait fuir les entrepreneurs qui réussissent et décourage les investisseurs potentiels, tandis que les importantes dépenses sociales attirent des étrangers peu qualifiés, qui seront peu fiscalisés et chercheront à s'octroyer une part de la cagnotte fiscale. L'impôt de solidarité sur la fortune autrefois, comme le nouvel impôt sur la fortune immobilière, sont nuisibles car ils font fuir des citoyens hors de France, ainsi que le flux d'impôts qu'ils généraient pour l'Etat. La conséquence la plus difficile à évaluer de cet exil fiscal et peut être la plus délétère à terme, est l'exil de capital humain, c'est-à-dire les connaissances, les savoir-faire et l'esprit d'entreprise qui quittent la France, pour aller se développer ailleurs. Tout développement économique implique une accumulation de capital, qui permet de produire de manière plus efficace et d'obtenir des gains de productivité. Ces gains de productivité sont indispensables à terme à l'amélioration des conditions de vie. La croissance des charges fiscales en France a été essentiellement tirée par les dépenses de protection sociale, notamment la santé et les retraites. Les dépenses de protection sociale représentaient déjà 20,2% du PIB en 1980. Elles s'élevaient à 31.5% en 2016[8]. L'allongement de l'espérance de vie et l'arrivée massive à la retraite de personnes comptant toucher des pensions par répartition étatique pèsent lourd sur les perspectives de croissance économique. Sans remise en cause radicale de l'Etat providence, le développement des dépenses de prestation sociale, notamment des retraites, va imposer le maintien d'une fiscalité lourde. Ces sommes accaparées pour des dépenses sociales seront autant de capacités d'investissement en moins, qui manqueront pour réaliser des gains de productivité, indispensables à terme pour améliorer le niveau de vie des personnes. La France a déjà observé une forte baisse de sa productivité horaire. Elle était de +1,49% par an de 2001 à 2007 et seulement de +0,43% de 2007 à 2013[9]. L'Etat a laissé se développer une fiscalité dont le poids entrave les libertés économiques fondamentales et pèse sur le fonctionnement et la moralité de la société. Il est important que la fiscalité soit respectueuse des droits de propriété et laisse les entrepreneurs libres d'agir pour répondre au mieux aux besoins des personnes. Les engagements de l'Etat vis-à-vis des dépenses sociales nécessitent des réformes drastiques, notamment vis-à-vis des pensions de retraite, si l'on ne veut pas sacrifier égoïstement l'amélioration des conditions de vie futures au profit des dépenses courantes du moment. La quête du bien commun exige de baisser la pression fiscale pour encourager les personnes à travailler, à entreprendre, à créer des conditions propices au développement économique et à la création d'emplois. La lutte contre la pauvreté et le souci des générations futures passent par une baisse des impôts.
