'Go Be a N----- Somewhere Else': ACLU Files Lawsuit Citing San Francisco Police's Documented History of Vile Racism      Cache   Translate Page
The city by the bay has been a hotbed of illegal race-based policing. This is just the latest example.

San Francisco's Tenderloin is a heavily populated, racially mixed neighborhood in the heart of one of America's iconic progressive cities. Yet when the San Francisco Police Department and the DEA targeted the neighborhood to crack down on drug dealing between 2013 and 2015 as part of "Operation Safe Schools," the only people they managed to roll up were black.

When 37 black defendants—and no defendants of any other race—got hauled away, nobody noticed. That is until the defendants started showing up looking for federal public defenders. The federal public defenders noticed, and they began making noise about racial disparities and selective enforcement of the drug laws.

Their charges only grew louder with the posting in 2015 of undercover police surveillance video to YouTube revealing a police officer muttering "fucking BMs," police code for black males, as he monitored a group of young men on the street. The video also apparently showed an undercover informant turning down drugs being offered by an Asian woman to instead buy drugs from a black woman.

In January 2017, 12 of those charged in the operation won a discovery motion from a judge who found there was "substantial evidence suggestive of racially selective enforcement" in their arrests. Instead of allowing the proceedings to continue so a full accounting of police conduct could occur, prosecutors instead dropped the charges.

At the time, the presiding judge, U.S. District Court Judge Edward Chen, made clear that while he was granting the dismissals because they were in the best interest of the defendants, he was concerned that doing so would prevent the allegations of police bias from being aired.

"These are serious issues, serious allegations regarding claims of discriminatory enforcement patterns," Chen said. "I think the defendants in this case have raised a very substantial prima facie case that, at the very least, raises some serious questions that would warrant a response and a full airing of the issues."

Now, a year and a half later, the ACLU of Northern California on Thursday filed a federal civil lawsuit on behalf of six of those rolled up in the busts. The lawsuit alleges the plaintiffs were targeted because of their race and cites a survey of Tenderloin drug users to bolster its case. That survey found racial diversity among Tenderloin drug sellers. About half were black, but 20 percent were Latino and 17 percent were white.

The lawsuit is "an opportunity to hold the actors in the San Francisco Police Department and the city itself accountable for the police department’s longstanding practices of engaging in racially discriminatory law enforcement," said ACLU attorney Novella Coleman, who is representing the plaintiffs.

It's also about financial relief for the plaintiffs, Coleman allowed. "The court will determine how to monetize that," she said.

Not an Anomaly

Racially biased policing is nothing new in San Francisco. In fact, as Ezekiel Edwards, director of the national ACLU's Criminal Law Reform Project, pointed out in a post announcing the lawsuit, the city has the dubious honor of setting precedent for the idea that law enforcement targeting people based on their race is unconstitutional. In an 1886 case, Yick Wo v. Hopkins, the city attempted to deny laundry permits to Chinese people while granting them to non-Chinese. Such an action could only be explained by the city's "hostility to the race and nationality" of the applicants, a violation of the 14th Amendment's guarantee of equal protection under the law.

Fast forward to the 21st century, and the evidence that the city's penchant for targeting non-whites for harsher treatment remains intact just keeps piling up. Numerous studies in the past few years have documented racially biased policing practices, including a 2002 ACLU report on SFPD racial profiling and a city-commissioned study by a national expert on biased policing.

Those studies uncovered a range of bias-related problems and made concrete recommendations for reform. Those were ignored. As the rotten policing practices festered, more reports detailing racial and ethnic disparities across the criminal justice system came out in 2013 and 2015.

Then, in 2015, as "Operation Safe Schools" was winding down, SFPD was hit by a new scandal when officers were caught exchanging racist text messages. Some used the N-word, others referenced cross burnings. Officers were caught calling black residents "savages," "wild animals," and "barbarians," and one officer told his sergeant "All n------ must fucking hang." Another officer sent a text with an image of a white man spraying a black child with a hose above the caption "Go be a n----- somewhere else."

That finally got the attention of city fathers—as well as the Obama-era Justice Department. The city district attorney convened a Blue Ribbon Panel on Transparency, Accountability, and Fairness in Law Enforcement that documented SFPD's history of racially disparate enforcement and concluded that it was "in urgent need of important reforms." In 2016, the Justice Department weighed in with its own report finding that the department still engaged in racially biased policing, especially around traffic stops and police use of deadly force.

It's Not Just San Francisco

The ACLU's Edwards concisely makes the case that San Francisco is no exception when it comes to racially biased policing:

“Unequal treatment by race is commonplace among police departments large and small in cities across a range of ideological leanings. This is the reason for the racial profiling lawsuits filed in New York City, Chicago, Philadelphia, and Maricopa County, Arizona. This is the motivation, prior to Attorney General Jeff Sessions, for Justice Department consent decrees seeking to end racially discriminatory police practices in Seattle; Los Angeles County; New Orleans; Baltimore; Newark; East Haven, Connecticut; and Ferguson, Missouri. This is why the ACLU has found racial disparities in marijuana possession arrests across the country, in drug possession arrests more broadly, in stops and frisks in Boston, in seatbelt enforcement in Florida, and in arrests for low-level offenses in Minneapolis.”

When will things ever change?

This article was produced by Drug Reporter, a project of the Independent Media Institute.

It used to be that the budget traveler could take the A train ($1.50) to a stop near a long term parking lot for JFK and then take a free shuttle bus to the terminals. But when "improvements" were made by the introduction of the AirTrain, this option was removed. And in Newark one can take a NJ transit train from Newark Penn Station to the EWR stop, which takes about 5 minutes, but one needs to buy a special ticket that costs about $8, IIRC. If you buy a ticket to a stop further along the same line, say Elizabeth or Linden, it will only cost you a couple dollars, but won't let you out at EWR. And once you get off the NJ transit train, one needs to take the ridiculous toy monorail to the terminals. Its almost like they don't want you to use mass transit!

27 days left until the midterm elections

Today’s comic by Jen Sorensen is Supreme Court silver lining:

Cartoon by Jen Sorensen

Most leading U.S. newspapers failed to mention landmark U.N. climate change report. Media Matters scrutinized the top 50 U.S. newspapers between 9 AM and noon ET on Monday and found most did not mention on their website homepages the Intergovernmental Panel on Climate Change’s Sunday release of its report on the  devastating impacts of a global temperature increase of 1.5-degree Celsius (2.7-degree Fahrenheit) above the temperature of the pre-industrial era. Although The New York Times, The Washington Post, the Los Angeles Times, and the Minneapolis Star Tribune gave the report prominence, 28 of the 50 newspapers didn’t mention it at all on their homepages, and most of those that did only provided headlines:

Of [those 28] newspapers, 10 serve cities that are listed among the "25 U.S. Cities Most Affected by Climate Change" in a 2015 weather.com report: Baltimore, Buffalo, Columbus, Denver, Louisville, Newark, Philadelphia, Pittsburgh, Portland, and St. Paul. [...]

The Miami Herald also did not mention the IPCC report on its homepage, though it did link to an article about how the risk of sea-level rise threatens real estate prices. Miami will be particularly affected by sea-level rise; a study published last year in the journal Nature concluded that rising seas as a result of climate change could cause more than 2.5 million Miami residents to flee the city.

Hurricane Michael headed for Florida as North Carolina prepares for heavy rains: The National Hurricane Center says Michael will come ashore as a Category 3 storm with winds of 120 mph around the Florida Panhandle Wednesday. The storm surge in low-lying areas of the state could reach 12 feet. Florida Governor Rick Scott issued a state of emergency order for 26 counties and activated 500 members of the Florida national guard in preparation for the hurricane’s landfall. Michael is expected to track through Georgia and Carolinas. In North Carolina, still nowhere near being fully recovered from last month’s Hurricane Florence, officials are preparing for rains and gusty winds that could uproot trees and take out power lines.

<i> The bitter truth, can’t have private property without a govt in place that collects taxes to enforce said law. To enforce said law, you need to have all the stuff we have in place. Even welfare is tool for enforcing law…if you don’t throw these crumbs to the needy, they won’t follow the law of the land. First thing they are coming for is your private property because they no longer respect the law out of desperation. </i> Because that made sense. I'm so glad the people of Newark, Trenton, and Camden follow the law of the land.

Comment on Dutch Court Upholds 25% Emissions Cut in 5 years Climate Change Ruling by Peta of Newark      Cache   Translate Page
Here's a one from Holland, about canal-boats and via Auntie Beeb. And even she baulks at the cost. https://www.bbc.co.uk/news/business-45783085 £220,000 to convert one boat from diesel to electric, 10 hours to do a re-charge that lasts 2 days and even before many boats have converted, they have worked out a rota as for who can charge their boats where & when. viz: already admitted to a shortage of electricity. Claiming a pay-back of 12 years because the 'electricity is cheaper than diesel' A real puzzle. I thought the Dutch were big consumers of animal fat (dairy and pig) and hence not so physically & mentally deranged as carbohydrate consumers. What went wrong? Too much gin, strong continental beer and cannabis? Maybe, or, are there too many rats in the cage? Started eating each other.
Comment on Another Lewandowsky driven eye-roller: ‘Confronting climate change in the age of denial’ by Peta of Newark      Cache   Translate Page
And how pictures can be used to deceive, again from Auntie Beeb A plastic bottle: https://www.bbc.co.uk/news/uk-england-somerset-45787712 Washed up on a beach, along with 400 tonnes of other junk. The local coastguard has never seen so much all at once. The impression they're trying to give is that it has been swilling around in The Ocean since before 1971. Maybe even also, A Storm (strangely nameless for once) caused by Climate Change caused all this junk to all arrive at once. Strangely it will also still be present in a mid-Pacific patch the size of Texas. Time travel eh, When will it become a reality. Oh. Wait..... In a way, the bottle and attendant junk did come from Climate Change But the Climate Change was (obvious to me at least) a Flash Flood, caused by soil erosion, ripping through and old landfill site somewhere not far away. Any thoughts on that Auntie? Nah. Thought not. Don't let the puritanical guilt ridden hands cease their wringing, even for a split-second. Not even to engage in some honest investigative journalism which you constantly claim to be doing? (Visit the Beeb and near the bottom of most pages is a link, asking you to find out why you can 'Trust the BBC'. I ain't gone there, I don't trust my own stomach to retain its contents if I do)

Satan To Blame For Child Rape Scandal: Pope Francis      Cache   Translate Page
Pope Francis blamed the epidemic of pedophile priests on Satan
Pope Francis, who has been accused of covering up the sexual abuse of kids within the Catholic Church, says Satan is responsible for the pedophilia scandal.

“(The Church must be) saved from the attacks of the malign one, the great accuser and at the same time be made ever more aware of its guilt, its mistakes, and abuses committed in the present and the past,” Francis said in a September 29 message.
Zerohedge.com reports: Francis, who has made clear that he believes the devil to be real, suggested that Catholics worldwide pray every day in the month of October to stave off the Devil and his pedophile-encouraging ways.
“We should not think of the devil as a myth, a representation, a symbol, a figure of speech or an idea. This mistake would lead us to let down our guard, to grow careless and end up more vulnerable.”
“I renew the invitation to everyone to pray the Rosary every day of the month of October ending it with the antiphon ‘Under Your protection’ and the prayer to St. Michael the Archangel, to repel the attacks of the devil who wants to divide the Church,” said Francis, who described the devil as “the great accuser.”
The prayer reads:
“St. Michael the Archangel, defend us in battle. Be our defense against the wickedness and snares of the devil. May God rebuke him, we humbly pray, and do thou, O Prince of heavenly hosts, by the power of God, thrust into hell Satan, and all evil spirits, who prowl about the world seeking the ruin of souls.”
Perhaps the power of 1.2 billion praying Catholics October will be enough to overcome the Devil’s influence over the preying priests.
Francis’ description of Satan as “the great accuser” has rubbed one of the pope’s adversaries the wrong way – Archbishop Carlo Maria Viganò, the Vatican’s former ambassador to Washington D.C.
In an 11-page statement published on Aug. 26, Viganò launched an unprecedented broadside by a Church insider against the pope and a long list of Vatican and U.S. Church officials.
He accused Francis of knowing about sexual misconduct by a former U.S. cardinal with male adult seminarians but not doing anything about it.
Viganò, concluding that his former boss had singled him out as the devil in disguise, complained in his next statement that Francis “compared me to the great accuser, Satan, who sows scandal and division in the Church, though without ever uttering my name”. Reuters
Archbishop Viganò then said in his written statement that Pope Francis “continued to cover” for McCarrick and not only did he “not take into account the sanctions that Pope Benedict had imposed on him” but also made McCarrick “his trusted counselor.”  Vigano said that the former archbishop of Washington advised the Pope to appoint a number of bishops in the United States, including Cardinals Blase Cupich of Chicago and Joseph Tobin of Newark.
CBS News spoke by telephone to Viganò, who confirmed he wrote the statement and said he was speaking out now “to combat the grave situation in the church, to protect the church and also to stop future abuse.” He told CBS News producer Anna Matranga that he had no agenda and was stating facts.
Viganò, who retired in 2016 at age 75, described an exchange with Francis on June 23, 2013, shortly after he became pope, about Cardinal Theodore McCarrick, the former archbishop of Washington, D.C., who resigned last month over claims he sexually abused seminary students and an altar boy.
Viganò writes that he told Francis about the allegations: “Holy Father, I don’t know if you know Cardinal McCarrick, but if you ask the Congregation for Bishops there is a dossier this thick about him. He corrupted generations of seminarians and priests and Pope Benedict ordered him to withdraw to a life of prayer and penance.”
Viganò then said that the pope did not respond to the statement, and McCarrick continued in his role as a public figure for the church.
“Pope Francis has repeatedly asked for total transparency in the Church. He must honestly state when he first learned about the crimes committed by McCarrick, who abused his authority with seminarians and priests. In any case, the Pope learned about it from me on June 23, 2013 and continued to cover him.”
On Sunday, a top Vatican official attacked Viganò in an open letter, accusing him of mountingh a “political frame job devoid of real foundation,” while refuting the accusations against Pope Francis point by point.
Francis, meanwhile, has refused to confirm or deny Viganò’s accusations.

A bordo haverá ainda o DJ Judy Garland a drag queen Bingo.
