Actress Crystal Kurek returns to a role some contend she was destined to play since birth, as she stars as the eponymous "practically perfect" nanny in Disney and Cameron Macintosh's Mary Poppins, opening this Friday night at Springhouse Theater in Smyrna. And who better than Crystal to help us bring another season of the Friday 5(+1) series back to BroadwayWorld Nashville?

She's played Mary Poppins once before, for Hendersonville Performing Arts Center, and she has recently been onstage at The Larry Keeton Theatre in Winter Wonderettes and at Actors Pointe Theatre Company for their production of My Fair Lady.

Today, in anticipation of her next opening night Crystal Kurek offers some insight into her passion for musical theater, in general, and for Mary Poppins, in particular - in hopes of encouraging audiences to get tickets quickly for Springhouse's recreation of the timeless tale of the estimable nanny with a bag of tricks unlike any other ever seen:

What was your first "live, onstage" taste of theater? My first taste of theater was as a Siamese child in The King and I with Shirley Jones at the Fox Theater in Atlanta. She was and still is one of my favorite singing actresses, and I was star struck. Not only that, but being in that beautiful setting filled me with a passionate love for the theater that is still undiminished after all these years.

What is your favorite pre-show ritual? I like to listen to the original soundtrack of the show I'm in while I'm driving. It helps me get in the mood and reminds me of how much I love the show and how blessed I am to be a part of it. Sometimes I get bogged down with details and trying to make everything "perfect," so this helps me to remember the big picture, how wonderful this material is and what a privilege it is to help bring it to life.

What's your most memorable "the show must go on" moment? Hmmm, maybe when I was playing Mary Poppins at Hendersonville Performing Arts Company and the measuring tape wasn't there to come out of the bag (that only happened once). I don't even remember what I said to keep going, but somehow we kept going and it worked out! It always does.

What's your dream role? I'm so blessed to have been able to play several of my dream roles, including Mary Poppins. But, I would still love to play Julie Jordan in Carousel and Guinevere in Camelot.

Who's your theatrical crush? Julie Andrews!

الغاز الإسرائيلي يقترب من الشاطئ، لكن التحديات مستمرة

تحت أنظار مجموعة صغيرة من المتظاهرين البيئيين المخيمين على الشاطئ الإسرائيلي "دور"، يضع المهندسون اللمسات الأخيرة على خط أنابيب مخصص لحقل "لڤياثان" البحري للغاز الطبيعي التابع لإسرائيل. وسيتم وصل الخط الواقع بين تل أبيب وحيفا بشبكة تنقل أساساً الغاز من حقل غاز "تامار" الأصغر حجماً إلى محطات توليد الطاقة والمنشآت الصناعية المنتشرة في جميع أنحاء إسرائيل. وعلى بعد ثلاثين ميلاً إلى الشرق، يعمل مهندسون آخرون على خط أنابيب سيعبر إلى الأردن، حيث من المتوقع أن يولّد غاز "لڤياثان" القسم الأكبر من الطاقة الكهربائية في المملكة ابتداءً من عام 2020.

الخلاف والجدل
على الرغم من الاحتمالات التي يشكلها توفير الغاز الإسرائيلي لأمن الطاقة، فإن تطوير احتياطياته قد تَميَّز بنقاش مفعم بالحيوية على المستويين السياسي والعام. وكان من المزمع أساساً أن يبدأ تشغيل حقل "لڤياثان" في عام 2017. وتمت تهدئة المخاوف الأولية بشأن هيمنة شركة "نوبل إينرجي" في قطاع الغاز عندما قامت الشركة ببيع بعض من أسهمها في حقول أخرى وقلصت حصتها في حقل "تامار". كما أثار شركاؤها الإسرائيليون، بمن فيهم شركة "ديليك"، جدلاً سياسياً أيضاً، حيث زعم المعارضون أن اتحاد الشركات كان يتفاوض على سعر مرتفع جداً للغاز.

وثمة مصدر قلق آخر هو واقع إمكانية رؤية المنصة من الشاطئ، خاصة بالنسبة لبعض الأشخاص الذين يعيشون في البلدة الراقية "زخرون يعقوف" الواقعة على هضبة ساحلية. ولكن السكان يعيشون هناك منذ عقود ولديهم نظرة مماثلة قريبة تجاه محطة توليد الكهرباء في "الخضيرة" التي تعمل على الفحم الحجري ومداخنها الأربعة العملاقة. ومن المتوقع أن تَغلق هذه المحطة أبوابها في غضون أربع سنوات. إن النظرة الأكثر تمثيلاً لمستقبل الطاقة في إسرائيل، هو محطة "حاغيت" لتوليد الطاقة التي تعمل على الغاز، والتي يمكن رؤيتها أيضاً من بلدة "زخرون يعقوف" ولكنها تقبع في رقعة مخفية في التلال الشرقية.
إعادة العمل بخطوط الأنابيب القديمة
بما أن تطوير حقل "لڤياثان" لن يكون مجدياً من الناحية الاقتصادية إلا إذا استطاعت إسرائيل تصدير معظم الغاز الذي يحويه، فمن الضروري تأمين طرق [نقله] إلى الأردن ومصر. ويُجنّب استخدام خطوط الأنابيب القائمة نفقات إنشاء خطوط أنابيب جديدة أو بناء محطة لتصدير الغاز الطبيعي المسال على الساحل، الأمر الذي سيولّد مخاوف بيئية أخرى. وسيكون جزء خط الأنابيب الذي يمتد إلى الأردن جديداً، إلا أنه سيستخدم حق المرور الذي تم إنشاؤه أصلاً من خلال خط الأنابيب القديم الممتد من كركوك إلى حيفا الذي كان يصدّر النفط العراقي بين عامي 1935 و1948، وهو السبب الذي دفع إلى بناء مصفاة في حيفا، التي هي الأكبر في إسرائيل حالياً.
وعند وصوله إلى الأردن، سيتصل الغاز المتدفق الآتي من حقل "لڤياثان" بـ "خط أنابيب الغاز العربي" القديم الذي كان ينقل إمدادات من مصر إلى الأردن وسوريا ولبنان حتى عام 2013، عندما أدّت الفوضى السياسية في القاهرة إلى تعطيل عمليات التصدير. ويبدو أن الخطة تعتمد حالياً على إرسال الغاز من حقل "لڤياثان" إلى مصر عبر هذا الطريق الدائري، نزولاً باتجاه خليج العقبة وصعوداً عبر شبه جزيرة سيناء. ويُعدّ عكس اتجاه المضخات وإعادة تأهيل خط الأنابيب أقل تكلفةً بكثير من بناء خط أنابيب جديد.
ومن التطورات المحتملة الأخرى اقتراح يقضي بإرسال الغاز الإسرائيلي من حقل "تامار" (ولاحقاً من حقل "لڤياثان") إلى مصر على طول "خط أنابيب غاز شرق المتوسط" القديم الذي كان يُستخدم لإرسال الإمدادات من العريش إلى عسقلان حتى عام 2013. ففي 30 آب/أغسطس، صرّح الرئيس التنفيذي لشركة "ديليك" أساف بارتفلد أن "المفاوضات حول شراء خط أنابيب شركة «إي إم جي» مستمرة". وفي 5 أيلول/سبتمبر، صرح رئيس مجلس إدارة شركة "نوبل إينرجي" ديفيد ستوفر أن "العمل جارٍ على تعزيز الوصول إلى مصر" وأن "التحديثات والأخبار" المتعلقة بتلك الجهود ستصبح متوفرة "عما قريب".
التحديات المستقبلية
يذكّر تعطّل تدفق الغاز المصري إلى إسرائيل والأردن بعد الإطاحة بنظام مبارك بأنّ ترتيبات الطاقة الناشئة في المنطقة هي دائماً عرضة للمخاطر السياسية. ومنذ ذلك الحين أصبحت إسرائيل أحد مورّدي الغاز الأكثر موثوقية للأردن، ووفقاً لشركة "نوبل إينرجي"، لم تؤدي الاكتشافات البحرية الأخيرة في مصر إلى تقليل الطلب المحلي للغاز الذي لا ينضب على ما يبدو. ومع ذلك، لا يزال الرأي العام في البلدين سلبياً للغاية تجاه إسرائيل، ويُعد التعاون في مجال الغاز هدفاً متكرراً لهذا الاستياء.

كما أن التوترات المستمرة بين إسرائيل، و«حماس» و«حزب الله» يمكن أن تنفجر وتفضي إلى جولة جديدة من الأعمال العدائية في أي وقت. وقد تمكنت الدفاعات الصاروخية الإسرائيلية من تفادي أضرار كبيرة في البنى التحتية في الجولات السابقة، إلا أنها قد تفشل في النزاعات المستقبلية مع مواجهتها المزيد من القذائف (أو قذائف أكثر دقة).
ومع ذلك،  يبدو أن مشروع حقل "لڤياثان" قد أوشك أخيراً على الانتهاء. ومن وجهة نظر الولايات المتحدة، هناك سبب إضافي للاحتفال وهو أن هذا المشروع يجمع بين الأعمال والتقنية الأمريكية وبين الجهود الدبلوماسية الهادئة التي تقوم بها واشنطن لمساعدة شركائها الإقليميين على العمل معاً.

called in the press today to defend his work rule for Medicaid and to say, essentially, that loss of coverage was on those who lost it, not the state.

He issued a news release detailing the efforts the state had made to reach out to people required to report work to continue health coverage under the Medicaid expansion.

DHS Director Cindy Gillespie and Workforce director Darryl Bassett touted aids the state offered people to move into jobs or better jobs and said they'd heard stories of improvement among those seeking to meet the requirement, which must be reported only by computer. DHS release here. Said the governor:

“While many fully complied by taking advantage of work opportunities under the work requirement, there were some that either found work, moved onto other insurance, or moved out of state without notifying DHS,” said Governor Hutchinson. “Some simply chose not to comply. Those are the ones who will lose their Arkansas Works coverage for the remainder of 2018.

“Personal responsibility is important. We will continue to do everything we can to ensure those who qualify for the program keep their coverage, but it is equally important that we make sure those who no longer qualify are removed,” added the Governor. “Arkansas Works is not a fee for service program, which means taxpayers are paying health insurance premiums for all enrollees every month, averaging roughly $570 a month, per person. This work requirement not only provides Arkansans with an opportunity to gain employment and move up the economic ladder, but also allows the state to concentrate our limited resources on those who need it most.
On the other hand:

“The assumption of personal responsibility that is underlying this policy doesn’t necessarily take into consideration the challenges people are facing on a daily basis," said Jessica Greene, a health policy professor.
Despite the state outreach, many don't know about the work rule. Many don't have computer access or means to reach a computer. Many are trying to work, but have varying degrees of success at achieving the 80 hours necessary per month.

The state is being sued for imposing work rules on a program designed to help poor people get medical coverage. A similar rule has been struck down in Kentucky.

So far this year, 4,353 people who had coverage have lost it and can't attempt to renew it until next year, no matter how hard they may work. 5,000 more have been out of compliance for two months. More than 6,000 have been out of compliance for a month. Three months of non-compliance causes loss of Medicaid. Some have been removed from the rolls because of other reasons, such as inability to verify addresses.

Hutchinson emphasized the positive, more than 40,000 remaining eligible because of jobs, exemptions or other reasons. But the state figures note that only 1,200 actually satisfied the reporting requirement and a total of 16,000 have lost or in peril of losing coverage for lack of reporting.

Hutchinson's news conference followed one by Democratic challenger Jared Henderson criticizing the state's handling of the issue. He said Hutchinson is more interested in reducing spending on Medicaid.

Henderson said Arkansas had led the country on improving health coverage, but Hutchinson had now created a new bureaucracy and a burdensome computer requirement to get between poor people and health care.

Gov. Asa Hutchinson
called in the press today to defend his work rule for Medicaid and to say, essentially, that loss of coverage was on those who lost it, not the state.

He issued a news release detailing the efforts the state had made to reach out to people required to report work to continue health coverage under the Medicaid expansion.

DHS Director Cindy Gillespie and Workforce director Darryl Bassett touted aids the state offered people to move into jobs or better jobs and said they'd heard stories of improvement among those seeking to meet the requirement, which must be reported only by computer. DHS release here. Said the governor:

“While many fully complied by taking advantage of work opportunities under the work requirement, there were some that either found work, moved onto other insurance, or moved out of state without notifying DHS,” said Governor Hutchinson. “Some simply chose not to comply. Those are the ones who will lose their Arkansas Works coverage for the remainder of 2018.

“Personal responsibility is important. We will continue to do everything we can to ensure those who qualify for the program keep their coverage, but it is equally important that we make sure those who no longer qualify are removed,” added the Governor. “Arkansas Works is not a fee for service program, which means taxpayers are paying health insurance premiums for all enrollees every month, averaging roughly $570 a month, per person. This work requirement not only provides Arkansans with an opportunity to gain employment and move up the economic ladder, but also allows the state to concentrate our limited resources on those who need it most.
On the other hand:

“The assumption of personal responsibility that is underlying this policy doesn’t necessarily take into consideration the challenges people are facing on a daily basis," said Jessica Greene, a health policy professor.
Despite the state outreach, many don't know about the work rule. Many don't have computer access or means to reach a computer. Many are trying to work, but have varying degrees of success at achieving the 80 hours necessary per month.

The state is being sued for imposing work rules on a program designed to help poor people get medical coverage. A similar rule has been struck down in Kentucky.

So far this year, 4,353 people who had coverage have lost it and can't attempt to renew it until next year, no matter how hard they may work. 5,000 more have been out of compliance for two months. More than 6,000 have been out of compliance for a month. Three months of non-compliance causes loss of Medicaid. Some have been removed from the rolls because of other reasons, such as inability to verify addresses.

Hutchinson emphasized the positive, more than 40,000 remaining eligible because of jobs, exemptions or other reasons. But the state figures note that only 1,200 actually satisfied the reporting requirement and a total of 16,000 have lost or in peril of losing coverage for lack of reporting.

Hutchinson's news conference followed one by Democratic challenger Jared Henderson criticizing the state's handling of the issue. He said Hutchinson is more interested in reducing spending on Medicaid.

Henderson said Arkansas had led the country on improving health coverage, but Hutchinson had now created a new bureaucracy and a burdensome computer requirement to get between poor people and health care.

Jared Henderson, Democratic candidate for governor, was joined by three medical professionals at a press conference Wednesday afternoon to speak on the horrible impacts of Governor Hutchinson’s Medicaid internet reporting requirement. More than 4,300 Arkansans will lose healthcare for failure to report in the first three consecutive months of the reporting requirement that only allows Arkansans to report through a part-time website in a state that ranks 49th in internet connectivity.

The first guest, licensed nurse practitioner Dr. Mary Garnica, discussed her experience providing health services to Medicaid recipients, highlighting how vital it was to ensuring that Arkansans lived out a healthy, and productive, lifestyle.

Executive Director Luke Kramer of The STARR Coalition, a national nonprofit that aims to increase partnerships among stakeholders in the areas mental health, spoke on the digital divide Governor Hutchinson’s program fails to recognize. Mr. Kramer also emphasized that mental health centers across the state are mandated to provide care regardless of whether individuals have health insurance, and the uncompensated costs that rise from stripping people off Medicaid rolls is damaging the livelihood of these centers across the state.

Dr. Tonya Martin-Dunlap, a breast surgical oncologist, discussed how her private practice has seen the tragedies associated with lack of access to healthcare. Dr. Martin-Dunlap highlighted the number of patients who came into her office once finally receiving health care through Medicaid expansion, but the delay in addressing the symptoms prior resulted in more severe diagnoses and more costly treatment. Additionally, Dr. Martin-Dunlap shared the story of a patient who was notified recently that they needed to be treated for breast cancer, but in the middle of the treatment process they were kicked off Medicaid and are unable to afford it otherwise. Dr. Martin-Dunlap says her office is still trying to figure out how the patient will receive care now.

Henderson, emphasizing the critical importance of the Medicaid expansion program, said that these are crucial examples of what is at stake when it comes to Hutchinson’s irresponsible Medicaid internet reporting requirement.

“My work throughout rural communities in Arkansas has provided the insight into just how poorly planned Governor Hutchinson’s Medicaid internet requirement really is,” Henderson said. “We are a state that ranks 49th in internet connectivity, and the idea that online would be the only avenue for individuals to report means that this is either simply bad policy or that it is an intentional effort to kick people off of Medicaid.”

“Governor Hutchinson was negligent in considering the consequences of this Medicaid internet reporting policy. Under my leadership, our state will champion providing quality health insurance to our most vulnerable Arkansans while ensuring we have jobs that provide good benefits that keep them from needing these government-provided necessities in the first place,” Henderson added.

The bus driver is reporting no students were injured.

The driver of the truck has a laceration to his head and is being assessed by emergency responders. He refused ambulance transport.

Niagara and Zion Fire departments responded along with Henderson County Emergency Management Agency and Henderson County Sheriff's Office.

La actriz británica Judi Dench (York, Reino Unido, 1934) recibirá un Premio Donostia en la 66 edición del Festival de San Sebastián. La entrega del galardón honorífico más importante del Festival tendrá lugar el martes 25 de septiembre, antes de la proyección de Red Joan (Trevor Nunn), en la que Dench encarna a una mujer cuya tranquila vida se ve repentinamente alterada cuando es detenida por el servicio de inteligencia del Reino Unido, acusada de suministrar información a la Rusia comunista.

Será la primera visita a San Sebastián de la actriz, siete veces nominada al Oscar. Recogió la estatuilla hace 20 años como mejor actriz de reparto por su interpretación de Isabel I en Shakespeare in Love (Shakespeare enamorado). El Oscar fue también un gran reconocimiento a Dench y su trayectoria teatral, especialmente por su vínculo a las obras más importantes de Shakespeare. Canyon Ridge has since planted The Crossing in the Southwest part of town and have started a Satellite Campus approximately 3 years ago (Centennial Hills). About the Position:

 

The role of the Children’s Weekend Experience Director is to partner with the Family Ministry Pastor and Children’s Pastor to lead a Children’s Ministry that is passionate about connecting children (birth to 5th grade) to Jesus and leading them to follow Him to more life than ever before. This person will provide innovative, energetic, and strategic leadership to the Children’s Ministry volunteers in the areas of Production, Programming, Family Engagement and First Impressions.

This will be accomplished by teaching biblical truths in age appropriate ways, by developing environments that capture a child’s imagination, and by creating a family-friendly experience that begins when they arrive on campus and continues into the Children’s area.

Education

A Bachelor’s degree is required with some Biblical training preferred.

 

Experience

The ideal candidate for this role will have experience leading staff in a children’s ministry capacity at a church of at least a thousand, with a significant volunteer base of 100 volunteers or more.

A Seleção de Ipiaú mais uma vez terá um novo treinador no comando técnico a partir da segunda rodada, isto porque o professor Ivan Colt, que havia substituído interinamente Fernando Sobrinho, pediu desligamento da Seleção por motivos particulares. No treinamento de ontem, Colt comunicou sua saída aos atletas e ao diretor João Grilo. “Conversei com meus atletas e com o diretor João Grilo sobre minha saída. A razão são motivos pessoais, não estou conseguindo conciliar estágio, relatórios, monografia, família, seleção... Ficou muito carregada a minha memória, está faltando o principal objetivo precioso: tempo para a minha vida”, justificou Colt. Burocracias atrasam pagamento da Seleção de Ipiaú

A exemplo do ano passado, a Seleção de Ipiaú se prepara para um duelo decisivo sob um desnecessário desgaste com atraso no pagamento. De acordo com prepostos da Liga, a parte que lhes compete por exigência da prefeitura foi devidamente cumprida, restante apenas a liberação da verba. Around 1,500 people have signed a petition calling for 20mph zones outside schools as children have been sent to hospital after being run over by speeding drivers.

As previously reported in Kent Online's sister paper the Dartford Messenger the Dartford Safer Roads campaign was launched in May by two primary governors, Sarah Crook and Kelly Grehan.

Concerned residents shared harrowing stories of their children being seriously injured due to careless drivers to promote the campaign at Dartford council last week.

Jessica Maddox said her daughter, Gracie, is "lucky to be alive" after she suffered nine broken ribs, a punctured lung and spleen after she was knocked off her bike on the Fleet Estate on June 26 last year.

The 12-year-old was on life support for two weeks with pressure on her brain caused by fractures to her skull.

She spent four months at physical and occupational therapy at King's College Hospital in London and now goes for check ups at Darent Valley every three months.

Despite the trauma, Gracie went back to school part-time at Longfield Academy last Tuesday.

Mrs Maddox, of Fleet Road, said: "Gracie is such a fighter.

"They say people with brain injuries are like the 'walking wounded' because you can't see anything wrong with her but she's a completely different child.

"They put her in an induced coma because she was bleeding all over in her brain so they don't know exactly which parts are affected."

The mother-of-four is concerned her injuries may affect her child's fertility in the future and could lead to early onset Alzheimer's syndrome.

She added: "She has thought process delay which does mean she's very confident but it also means it's a lot more dangerous for her to cross the road because she doesn't process the danger in the same way.

"At the end of the day, I don't really care if she's a little different since she's here with us."

The father of Dean Povey, 13, who suffered a number of broken bones after being run over by an alleged drug driver in Henderson Drive on Sunday, September 2, also attended the council meeting.

Speaking on behalf of his parents, Rick Jones said: "The length of that road is diabolical.

"There are no traffic calming measures and that is where people like to speed.

"We've had a number of animals killed in that area and people in near misses now over the weekend we've had a child with broken bones.

"I cannot stress how important it is to look at the safety of roads around schools and this needs to be prioritised."

Now these parents and many other residents are calling on the council to put in 20mph zones to ensure children are safe on their way to school.

The author of the petition Sarah Crook called for "tough action" on inconsiderate drivers around primary schools.

Sarah said: "We would like to see some proper enforcement around the school particularly because children don't feel safe on the pavement let alone the roads.

"The children are not the problem, they know how to cross safely, the main problem is out of the children's control mostly parents and people who park inconsiderately.

"Also we want to put in 20mph speed limits around schools because a child is more likely to die if hit at 40mph than at 20."

Dartford council leader Jeremy Kite told the concerned residents they were "pushing at an open door" and claimed a "behavioural shift" is needed to stop the reckless driving.

He said: "I can't imagine what these parents are going through and what it must be like to feel like your child is slipping away from you.

"The day after what happened to Gracie we set up a working group to look into what can be done to stop things like this happening.

"I think we have gone above and beyond what the petition is asking for and nothing is off the agenda.

"I would like to work with all of the residents together because we are all on the same side."

Leader of the Labour group Cllr Jonathon Hawkes said: "I’m pleased the council announced some good intentions in response to the petition – we now need to see actions.

"I and my Labour colleagues will be keeping the pressure up to ensure we see real action to make Dartford’s roads a safer place for everyone.”

A few days ago, Tyler Cowen over at Marginal Revolution linked to a New York Times piece about antitrust scholar Lina Khan. The item, by David Streitfeld, is titled “Amazon’s Antitrust Antagonist Has a Breakthrough Idea,” NYT, Sept. 7, 2018. Much of the story is fluff although Streitfeld does tell the reader that Ms. Khan’s ideas have the potential to influence decisions by the Federal Trade Commission.

The most valuable thing I got out of it, though, was a link to “Amazon’s Antitrust Paradox,” her long article in the Yale Law Journal. I just finished reading it and my quick thoughts follow.

Nice Survey, With One Glaring Hole

It is very well written. Related to that, Khan gives a nice survey of the evolution of antitrust case law, giving due credit to the Chicago School of the 1960s and 1970s for changing the way federal judges and the antitrust enforcers think about the goals of antitrust law. Consumer welfare has become the major way to judge horizontal integration, vertical integration, aggressively low pricing, and internal growth of a firm.

There is one glaring hole in her exposition and it’s on predatory pricing. She discusses the Standard Oil New Jersey, in which muckraker Ida Tarbell alleged that SONJ was engaging in predatory pricing and does not even mention, in an article containing 464 footnotes, the pathbreaking work of John S. McGee, “Predatory Pricing: The Standard Oil (N.J.) Case,” Journal of Law and Economics, Vol 1 (October 1958), pp. 137-169. This is arguably the most important article in the literature on predatory pricing. Its bottom line, which Khan contradicts without giving evidence: Standard Oil did not engage in predatory pricing. Her’s is not a small omission. Here’s what Khan writes:

The earliest predatory pricing case in America was the government’s antitrust suit against Standard Oil, which reached the Supreme Court in 1911.50 As detailed in Ida Tarbell’s exposé, A History of the Standard Oil Company, Standard Oil routinely slashed prices in order to drive rivals from the market.51 Moreover, it cross-subsidized: Standard Oil charged monopoly prices52 in markets where it faced no competitors; in markets where rivals checked the company’s dominance, it drastically lowered prices in an effort to push them out. In its antitrust case against the company, the government argued that a suite of practices by Standard Oil—including predatory pricing—violated section 2 of the Sherman Act. The Supreme Court ruled for the government and ordered the break-up of the company.53 Subsequent courts cited the decision for establishing that in the quest for monopoly power, “price cutting became perhaps the most effective weapon of the larger corporation.”54

Consumer Welfare Not Congress’s Intent

Khan argues that consumer welfare was not the intent of the Congress that passed the Sherman Act. I agree with her. I’ve always thought Robert Bork was particularly dense on the subject. The work of Thomas DiLorenzo has convinced me that Congress passed the antitrust act, not to help consumers, but to hobble successful competitors.

While she puts little weight on harm to consumers from reining in successful competitors, she is unknowingly ambivalent. Consider these two paragraphs from her article:

This vision [of the initiators of U.S. antitrust policy] encompassed a variety of ends. For one, competition policy would prevent large firms from extracting wealth from producers and consumers in the form of monopoly profits.159 Senator Sherman, for example, described overcharges by monopolists as “extortion which makes the people poor,”160 while Senator Richard Coke referred to them as “robbery.”161 Representative John Heard announced that trusts had “stolen millions from the people,”162 and Congressman Ezra Taylor noted that the beef trust “robs the farmer on the one hand and the consumer on the other.”163In the words of Senator James George, “[t]hey aggregate to themselves great enormous wealth by extortion which makes the people poor.”164

Notably, this focus on wealth transfers was not solely economic. Leading up to the passage of the Sherman Act, price levels in the United States were stable or slowly decreasing.165 If the exclusive concern had been higher prices, then Congress could have focused on those industries where prices were, indeed, high or still rising. The fact that Congress chose to denounce unjust redistribution suggests that something else was at play—namely, that the public was “angered less by the reduction in their wealth than by the way in which the wealth was extracted.”166 In other words, though the harm was being registered through an economic effect—a wealth transfer—the underlying source of the grievance was also political.167

She can’t have it both ways. The first paragraph quoted suggests that the antitrust advocates thought high prices were the problem. The second paragraph suggests that they weren’t. But within that second paragraph, she quotes, while seeming to implicitly agree with, the idea that the large firms extracted wealth from consumers. If the large firms were pricing lower than their competitors, which they were, they can’t extract wealth from consumers; instead they create wealth for consumers.

What About Amazon?

When she moves on to Amazon, she does, admittedly, make me a little nervous about Amazon’s power. She reveals a lot about Amazon’s clever strategies that I had not known.

Could the Stock Market Be That Wrong?

Khan makes a good point about Amazon’s stock value as an indicator of future profits. She writes:

Despite the company’s history of thin returns, investors have zealously backed it: Amazon’s shares trade at over 900 times diluted earnings, making it the most expensive stock in the Standard & Poor’s 500.10

And later:

In the past, the Supreme Court’s analysis has embraced the Efficient Market Hypothesis (EMH), the idea that market prices reflect all available information.397 The Justice Department also acknowledges that market information—for example, the financial terms of an acquisition—may “be informative regarding competitive effects.”398 Applying EMH in this instance overwhelmingly suggests that these platforms are positioned to recoup their losses. Yet bringing a predatory pricing suit against an online platform would be almost impossible to win in light of the recoupment requirement. Strikingly, the market is reflecting a reality that our current laws are unable to detect.399

Touche.

Competition as a Process

Khan advocates that we move away from using consumer welfare to judge antitrust policy and, instead, favor a “competitive process.” She writes:

In order to capture these anticompetitive concerns, we should replace the consumer welfare framework with an approach oriented around preserving a competitive process and market structure.

Yet the original industrial organization economists in the 1940s through 1960s talked about market structure, not competitive process. It was many in the Chicago School, especially Yale Brozen and Harold Demsetz, and many in the Austrian School, particularly Israel Kirzner, who talked about competition as a process. If we want to encourage a competitive process, we need to have the government keep its hands off Amazon but also keep its hands off Apple and book publishers who tried to compete with Amazon but were hammered by the antitrust authorities.

Khan is aware of the Apple case, writing:

In 2012, the DOJ sued the publishers and Apple for colluding to raise e-book prices.249In response to claims that the DOJ was going after the wrong actor—given that it was Amazon’s predatory tactics that drove the publishers and Apple to join forces—the DOJ investigated Amazon’s pricing strategies and found “persuasive evidence lacking” to show that the company had engaged in predatory practices.250

How about this: don’t have the antitrust authorities weigh in to hobble competitive business models that try to compete with Amazon and don’t have it weigh in to hobble Amazon either?

A father has been arrested after he allegedly shot dead his son because he found out he was gay, police have said.
Giovanni Melton, from Henderson, Nevada, was gunned down by his father Wendell Melton after an argument on Thursday afternoon about how he is gay and has a boyfriend, police told KSNV.

‘He hated he fact that his son was gay,’ the 14-year-old’s former foster mom Sonia Jones told the station.
‘I’m sure that inside of his mind, he would rather have a dead son than a gay son.’

Color blind visitors to 13 Tennessee state parks will be able to see the changing fall foliage in a whole new way this year.

The Tennessee Department of Tourist Development installed 13 special viewfinders with EnChroma lenses designed to alleviate red-green color blindness.

“One of the main pillars we promote in Tennessee is our scenic beauty,” said Kevin Triplett, commissioner of the Tennessee Department of Tourist Development. “The reds, oranges and yellows in the fall and the incredible colors in the spring are a staple of what comes to mind when people think about Tennessee or visit here.


"But to realize, through red/green deficiencies and other forms of color blindness, there potentially are more than 13 million people in our country alone who cannot fully appreciate the beauty our state has to offer, we wanted to do something about that. We wanted to provide opportunities for more people to see what those of us who can may take for granted.”

But, as with many things to do with state government, West Tennessee got shorted.

Two of the 13 special viewfinders have been installed here. East Tennessee got seven. Middle Tennessee got three. Yes, mountains and all that...but still.

The closest viewfinder to Memphis is at Meeman-Shelby Forest State Park's Poplar Lake, near the the nature center. The other in West Tennessee is at Chickasaw State Park, near Henderson.

In the first round of coverage losses. Governor Hutchinson announced Wednesday that 4,353 Arkansans have lost health care coverage for the remainder of 2018 due to three months of noncompliance with the state’s first-of-its-kind Medicaid work requirement. Those beneficiaries are now locked out of the Arkansas Works program for the rest of the calendar year, though they can re-apply in January.

Earlier this year, the Trump administration approved Arkansas’s request to impose a work requirement on certain beneficiaries of the Medicaid expansion, composed of low-income, non-elderly adults. Under Hutchinson’s direction, the Arkansas Department of Human Services began the new policy in June. The DHS is rolling out the mandate in phases, but eventually, about 167,000 people ages 19 to 49 will be required to report 80 hours of “work activities” each month or else show an exemption. (A majority should qualify for an exemption.) Research shows most Medicaid expansion beneficiaries are already working, but to stay in compliance with the requirement, they must also report their hours each month through an online portal created by the DHS.

The governor said Wednesday that his aim is not to remove beneficiaries from Arkansas Works.

“I’d like to see those that are being cut off from the system lower. We’d like to see them all in compliance,” he said.

However, Hutchinson also noted that terminating coverage for those beneficiaries will save the state money. Under Arkansas’s unusual approach to Medicaid expansion, beneficiaries are provided with private insurance plans (sold by carriers on the individual marketplace, such as Arkansas Blue Cross and Blue Shield), and the Medicaid program pays their premium and other cost-sharing. The average monthly premium is about $570.

“In this instance, 4,350 times the $570 per month insurance cost results in a $30 million cost to the taxpayers to maintain,” Hutchinson said. “I think it would be common sense judgment of the people of Arkansas that we should not continue to pay $30 million per year for that cost.”

Most of those who lost coverage in September did so because they failed to report any work activities at all for June, July and August. Hutchinson listed a few scenarios that might result in people not reporting. “One, they could have … obtained other insurance coverage,” he said. “Or it could be that they moved away out of state without notifying DHS. Or it could be that they simply don’t want to be part of the workforce. They’re able-bodied, but … they don’t desire to do it.”

Critics of the work requirement say some people may be unaware it applies to them or may be under the mistaken impression that simply working regularly — as opposed to reporting those hours — is enough to stay in compliance. Others may have difficulty reporting online; Arkansas has among the lowest internet access rates in the nation. The governor said he hoped that was not the case, noting the large volume of letters, phone calls and emails sent by the DHS in an attempt to inform beneficiaries of the new policy. In response to a question about the online-only reporting system, he said the insurance carriers are providing “registered reporters” authorized to receive beneficiaries’ information over the phone and assist them in logging hours.

The goal of the requirement, Hutchinson said, is to push more low-income people into the workforce, adding that “more than 1,000 Arkansas Works enrollees have found employment” allegedly due to the mandate. He cited the story of a woman in Harrison who received notice of the requirement, sought assistance at an Arkansas Workforce Center and is now enrolled in school to become a licensed practical nurse while working one day per week. (Educational hours also satisfy the terms of the mandate.)

“I think there are a great deal of success stories,” he said. However, because most Arkansas Works beneficiaries already do work — and because low-income people often cycle in and out of employment — it is not clear whether the job gains the governor cited were due to the requirement.

Earlier on Wednesday afternoon, Democratic gubernatorial candidate Jared Henderson held a press conference criticizing the new rule. “We have become the first state in the country to impose an internet requirement to create a new bureaucracy between some of our most vulnerable citizens and their access to health insurance,” Henderson said.

In the past, Henderson said, Arkansas has led the way in expanding insurance coverage — a reference to the state’s establishment of ARKids insurance for children under Republican Governor Mike Huckabee and its more recent embrace of Medicaid expansion under Democratic Governor Mike Beebe, making it an outlier among Southern states.

Now, he said, “I see us leading in the opposite direction.”

The coverage losses reported in September are almost certain to multiply, in part because the DHS is rolling out the requirement gradually. In June, a first cohort of about 27,000 beneficiaries became subject to the mandate. Of that group, about one in six did not report 80 hours of work activities for June, July and August, resulting in their termination this month. If a similar ratio should hold true for the entire 167,000 eventually subject to the requirement, tens of thousands could lose Medicaid in the months ahead.

“A pretty significant portion of the population has now lost coverage, when you look at the number of people who are required to report,” Marquita Little, health policy director for Arkansas Advocates for Children and Families, said in an interview after the press conference. “We know that number is going to continue to increase as the state phases in the work requirement.”

The DHS has sent a letter to those individuals who recently lost coverage informing them that they are locked out of Arkansas Works until the end of the year. If they failed to report due to “an emergency or serious life-changing event” or due to a technical error — the DHS reporting portal has experienced problems recently — they may still request a “good cause” exemption from the agency.

Otherwise, unless they now qualify for another Medicaid category or assistance on the individual insurance marketplace, they have no obvious insurance coverage options. For those who have newly joined the ranks of the uninsured, the letter suggests they visit a community clinic or a federally qualified health center to seek medical care.

Little said that was not a sufficient solution. “I think our health care system has changed significantly in response to Medicaid expansion,” she said. “The charity care system is not what it once was. I worry about a large group of people becoming uninsured and that system being unable to absorb an increase in the number of people they’re serving.”

“If one of the main issues is that people aren’t receiving the information about it — if they’re not getting the mail or if they don’t understand the notices — continuing to do that probably won’t be effective,” she added.

Meanwhile, the Arkansas work requirement remains the subject of a federal lawsuit seeking to halt its implementation. The plaintiffs, who are three Arkansas Works beneficiaries, say the state is attempting to undermine the goals of the Medicaid expansion by throwing up roadblocks to coverage; they say the Trump administration erred in approving a waiver that allowed Arkansas to proceed with its plan. Earlier this year, a similar suit in Kentucky succeeded in blocking that state’s work requirement program before it got off the ground.

But Hutchinson says the work requirement will only improve the Arkansas Works program.

At his Wednesday press conference, the governor said the requirement represents a “proper balance of those values that we hold important to us in Arkansas.”He reiterated his support for Arkansas Works as a whole and noted that he has defended it from fellow Republicans who have sought to defund the program.

“I fought hard to maintain Arkansas Works, despite odds against it, despite enormous criticism,” Hutchinson said. “Compassion and common sense says this is a good program for those that are trying to move up the economic ladder and to better themselves. It’s also about providing assistance to those who need it. And it is also about the value of work and responsibility.”

Earlier on Wednesday afternoon, Democratic gubernatorial candidate Jared Henderson held a press conference criticizing the new rule. “We have become the first state in the country to impose an internet requirement to create a new bureaucracy between some of our most vulnerable citizens and their access to health insurance,” Henderson said.

In the past, Henderson said, Arkansas has led the way in expanding insurance coverage — a reference to the state’s establishment of ARKids insurance for children under Republican Governor Mike Huckabee and its more recent embrace of Medicaid expansion under Democratic Governor Mike Beebe, making it an outlier among Southern states.

Now, he said, “I see us leading in the opposite direction.”

The coverage losses reported in September are almost certain to multiply, in part because the DHS is rolling out the requirement gradually. In June, a first cohort of about 27,000 beneficiaries became subject to the mandate. Of that group, about one in six did not report 80 hours of work activities for June, July and August, resulting in their termination this month. If a similar ratio should hold true for the entire 167,000 eventually subject to the requirement, tens of thousands could lose Medicaid in the months ahead.

“A pretty significant portion of the population has now lost coverage, when you look at the number of people who are required to report,” Marquita Little, health policy director for Arkansas Advocates for Children and Families, said in an interview after the press conference. “We know that number is going to continue to increase as the state phases in the work requirement.”

The DHS has sent a letter to those individuals who recently lost coverage informing them that they are locked out of Arkansas Works until the end of the year. If they failed to report due to “an emergency or serious life-changing event” or due to a technical error — the DHS reporting portal has experienced problems recently — they may still request a “good cause” exemption from the agency.

Otherwise, unless they now qualify for another Medicaid category or assistance on the individual insurance marketplace, they have no obvious insurance coverage options. For those who have newly joined the ranks of the uninsured, the letter suggests they visit a community clinic or a federally qualified health center to seek medical care.

Little said that was not a sufficient solution. “I think our health care system has changed significantly in response to Medicaid expansion,” she said. “The charity care system is not what it once was. I worry about a large group of people becoming uninsured and that system being unable to absorb an increase in the number of people they’re serving.”

“If one of the main issues is that people aren’t receiving the information about it — if they’re not getting the mail or if they don’t understand the notices — continuing to do that probably won’t be effective,” she added.

Meanwhile, the Arkansas work requirement remains the subject of a federal lawsuit seeking to halt its implementation. The plaintiffs, who are three Arkansas Works beneficiaries, say the state is attempting to undermine the goals of the Medicaid expansion by throwing up roadblocks to coverage; they say the Trump administration erred in approving a waiver that allowed Arkansas to proceed with its plan. Earlier this year, a similar suit in Kentucky succeeded in blocking that state’s work requirement program before it got off the ground.

But Hutchinson says the work requirement will only improve the Arkansas Works program.

At his Wednesday press conference, the governor said the requirement represents a “proper balance of those values that we hold important to us in Arkansas.”He reiterated his support for Arkansas Works as a whole and noted that he has defended it from fellow Republicans who have sought to defund the program.

“I fought hard to maintain Arkansas Works, despite odds against it, despite enormous criticism,” Hutchinson said. “Compassion and common sense says this is a good program for those that are trying to move up the economic ladder and to better themselves. It’s also about providing assistance to those who need it. And it is also about the value of work and responsibility.”

Herbert D. Smith currently lives in São Paulo, Brazil.  He has had a diverse international performance career for over 20 years, performing with tenor saxophone greats like Eddie Harris, Teddy Edwards, Buddy Collette and Harold Land Jr., pianists Art Hillery, Ted Jackson, John Wood and George Cables, jazz vocalist Elaine Miles, guitarists Steve Cotter and John Chiodini, Mexican vocal stylist Sandra Valdivia, Capitol Records blues singer Betty Hall Jones, Basie trombonist Jimmie Cheatham, Dr. Ronald V. Myers, great jazz drummers Clayton Cameron of the Tony Bennett and Sammy Davis Jr. bands, the legendary Billy Higgins and Sherman Ferguson.

Smith was born and raised in Chicago, Illinois.  He started his music education at the famed Chicago Music College (CMC) of Roosevelt University. CMC former students consisted of Robert Lamm of the rock group "Chicago" and Jazz Saxophonist Steve Coleman of the Thad Jones Mel Lewis Orchestra. Through the advice and recommendation of the late Chicago Symphony Bassist Warren Benfield, Smith traveled to Madison Wisconsin to study with Jazz Bassist Richard Davis at the University of Wisconsin in Madison, then on to Milwaukee with Laura Synder currently with the Milwaukee Symphony. Smith received a scholarship to study in the Jazz Program at Livingston College of Rutgers University in Livingston, New Jersey under the direction of Bassist Larry Ridley.

 

As a young bassist in his 20's, Smith became the founder of the Los Angeles Bass Violin Choir, a group of prominent Los Angeles area bassists performing special arrangements by Smith and New York bassist Bill Lee. Bill Lee, father of director Spike Lee, and founder of the New York Bass Violin Choir, premiered many unique compositions and arrangements in his son's earlier films. Regular players consisted of Frederick Tinsley, the late Andy Simpkins, Herbie Lewis and George "Red" Callendar, John Heard, and classical double bass extraordinaire Bertram Turetsky. Additional players to perform with the bass choir were bassists Roberto Miranda, James Leary and Alan Jackson. Drummers Sherman Ferguson and Bill Douglass, and Pianist Cecil Lytle also performed with the choir.

As someone that lives south of Columbia City, I can tell you that the Rainier N-S Greenway does not work particularly well depending on where in the Rainier Valley you're coming from (or going to). Don't get me wrong, I'm thrilled to have it. But if you asked me if it worked well for me, I'd have to say not really. The problem is not so much the greenway itself (though there are acknowledged key gaps in the "all ages / abilities" claim, particularly around Columbia City with very steep hill climbs and awkward interfaces with vehicle traffic), it's access to the greenway that's the problem -- there are few good, safe ways to get to it that are all ages / abilities. From where I am, the connecting route to the greenway that involves the highest percentage of bike lane is probably Seward Park Ave S. to S Othello St to 45th Ave S. Kids or new riders cannot ride this route. Seward Park Ave S, a bike-facility-free part of the Lake Washington Loop Trail, is a busy-at-rush-hour arterial with no traffic calming and a 30mph speed limit, and bike riders must take the traffic lane with parked cars between Kenyon and Othello. A sarcastic thanks to SDOT for eliminating parking restrictions on the east side of Seward and restriping the center line with no notice to the community. Othello has a bike lane, but none of it is protected, it involves a fairly steep hill climb heading west from Rainier Ave up to 48th, and it's a very busy arterial linking I-5 to Seward Park (Swift, Myrtle, Othello). Further south, S Cloverdale Pl lacks any bike lanes, and S. Henderson St. lacks complete bike lanes, and where a lane is present, it's unprotected. Bicyclists from other areas west of MLK or east of Rainier face similar challenges.

Centers Health Plan for Healthy Living, the managed-care arm of Bronx-based Centers Health Care, agreed to pay nearly $1.7 million to the state Medicaid program following allegations that it received payments for services that it did not deliver or for which its members were ineligible, Attorney General Barbara Underwood said Wednesday.

The settlement was the result of an investigation prompted in October 2014 by a whistleblower lawsuit. It found that from April 1, 2013, to Dec. 31, 2015, Centers Plan did not provide community-based long-term-care services to members for at least some of the period that they were enrolled in its managed long-term care plan, a Medicaid product that provides coverage to the chronically ill and disabled.

Such services include home nursing care, home health aide services, personal care and adult day programs, the attorney general said.

Despite not providing these services, Centers Plan did not disenroll members from its coverage and continued to receive monthly premiums of about $2,500 to $4,300. Some members received only social adult day care or transportation services from the plan, which would make them ineligible for coverage.

"Today's settlement serves as a reminder that we will hold accountable those who seek to game the system for their own financial benefit," Underwood said in a statement.

Centers Plan is the largest managed long-term care plan in the state, with 29,427 members, about 13.5% of total state enrollment. The plan last year, adding around 5,000 members. It is affiliated with Centers Health Care, which has about 45 skilled-nursing facilities in five states.

The federal government, which jointly administers Medicaid, will receive $660,000, and New York will receive $990,000.

A spokesman for Centers Plan said it is "working cooperatively" with the Office of the Inspector General of the Department of Health and Human Services and the state attorney general.

Centers Plan "is in good standing, and the company's overall goal is to provide members and all those involved in their care with the guidance and health plan choices they need for healthy living," he said. —Jonathan LaMantia

 

Azar’s New York visit

 

During several appearances in New York City on Wednesday, Health and Human Services Secretary Alex Azar said he is focused on lowering drug prices as he prepares to fulfill promises made by President Donald Trump.

Azar, a former executive at Eli Lilly, at federally contracted shelters.

“We’re working now on reuniting the remaining children” with their parents, Azar said. “Our department is the department—we get handed unaccompanied children who come into this country. We take care of them and we place them with family members or other appropriate sponsors as quick as humanly possible and consistent with child welfare.” —J.L.

 

Nonprofits see 13.2% return on investment

 

Investment returns for 56 U.S. nonprofit health care organizations averaged 13.2% last year, the highest level since 2013, according to investment manager Commonfund.

Health care organizations continued to take a more conservative investment approach than university endowments and community foundations, increasing the share of their portfolios devoted to fixed-income securities and lowering their share of alternative investments, such as private-equity and hedge funds.

The percentage of health systems whose stock portfolio was actively managed by investment professionals fell to 57%, from 65% in 2014, as more opted to avoid management fees, according to the report.

The organizations' 10-year return was 4.6% on average. The survey participants said they are targeting 6%.

"We are still feeling lingering after-effects of 2008," said Cathleen Rittereiser, executive director of the Commonfund Institute in Wilton, Conn., which oversees the survey. Next year's report, which won't include 2008 returns, will "hopefully tell a different tale," she said. —J.L.

 

L.I. billing company buys N.J. firm

 

Fellow Health Partners, a medical solutions company based in Great River, N.Y., has purchased Physicians Management, a medical billing firm based in Rochelle Park, N.J.

This is the second acquisition announced this year for the Suffolk County company, which offers billing services and administrative and customer service support. In February it acquired behavioral health-focused Custom Billing Services, based in Huntington, N.Y. Fellow Health will continue looking for acquisitions to further its growth, CEO Michael Brown said.

While most medical billing companies in the U.S. are mom-and-pop operations, "they are getting pushed around by some of the larger players and by their clients," Brown said. "They lack technology and scalability."

Earlier this year Fellow Health launched Savi Technology, its new medical billing software, and Knowledge College, a people-skills training program.

"With the advent of high-deductible plans in the past five to six years, patient responsibility has skyrocketed," Brown said.

Billing companies need to develop their employees' communications skills to improve their success at collections and garner positive patient reviews, he said.

Fellow Health's clients include private and specialty practices, hospitals and diagnostic labs across the country.

Brown declined to disclose the purchase price or his company's revenue. —Jennifer Henderson

It takes a special observer to identify what was special about tenor saxophone legend Coleman Hawkins, because the legendary aspects of Hawkins’ career often overshadowed the actual aspects of the style that made him so distinctive and the contributions as a bandleader that did so much to help other Jazz musicians.



So what we wind up with is largely adoration and hagiography instead of critical insight and discerning explanation.

Enter Dan Morgenstern, a long-time observer and astute commentator on Jazz and its makers.


Dan is also one of the few Jazz critics who could write about the not-so-great closing years of the great man’s career with a gentleness and compassion that is a reflection of his love for Coleman.


Morgenstern, winner of an almost embarrassing number of Grammy Awards for his liner notes, did justice to the great saxophonist in 1973 and won yet another Grammy when he wrote these notes for the album The Hawk Flies [Riverside RLP-233, Original Jazz Classic CD OJC-027].


“Even among the chosen few, the extraordinary men and women who make up the peerage of jazz, Coleman Hawkins stands out.


To begin, there is his sound, a thing of beauty in and of itself. Hawkins filled the horn brimful with his great breath. Sound was his palette, and his brush was the instrument that, for jazz purposes, he invented—the tenor saxophone.


In this post-Coltrane age, the tenor sax is so prominent a feature of the landscape that it's hard to imagine it wasn't always there. Lester Young once said, accurately, "I think Coleman Hawkins was the President first, right?," here meaning "president" in the sense of founding father. Which wasn't the sense in which Billie Holiday had laid "Pres" on Lester—at a point in time when the president of the United States was a great man, Number One in all the land.


Tenor time in jazz begins in 1924, when Coleman Hawkins joined  Fletcher Henderson's band. In a decade there, he first mastered, then established the instrument. While trumpet still was king, it was due to Hawk that tenor became president. Thus jazz became a republic in the Swing Era. King Louis was peerless by definition, but his powerful message unlocked the magic in other noble souls. If we hear young Coleman Hawkins both before and after Armstrong joined Henderson, the point is clearly made.


The saxophone family of instruments had been invented by Adolphe Sax to mirror the range and variety of the strings; he wanted his instruments to sing, to have the warmth of wood and the power of brass, and thus created a hybrid of wind mouthpiece and brass body, unlocked by a new system of keys. He did this in the 1840s, but with the exception of Bizet, Debussy, and later Ravel, no major "serious" composer knew what to do with the new arsenal of sound. Until it was discovered and mastered by jazzmen in the early 1920s, the saxophone remained a brass band and vaudeville instrument — a novelty.


Coleman Hawkins's first instruments in St. Joseph, Missouri, were piano and cello. (Of all the saxophones, the tenor most resembles the cello in range and color.) As a boy, he heard and saw The Six Brown Brothers in vaudeville. They used the whole range of saxes, from sopranino to contrabass, and with all their clowning really knew how to play. Young Coleman began to explore the saxophone.


Exactly when this occurred is not entirely clear. Hawkins, like so many other performers, prevaricated about his age. It was widely accepted that he was born on November 21, 1904; a date he unsuccessfully tried to adjust to 1907. Still, underneath incessant joking and good-natured teasing about age with his friends (Ben Webster: "I was in knee pants when my mother first took me to hear you." Hawkins: "That wasn't me; that was my father. I wasn't born then!") there ran a current of doubt, and when Charles Graham, doing biographical research, obtained a copy of Hawkins's birth certificate, it read 1901!


By the time the Father of Tenor Saxophone left for Europe in March 1934, he had already created the two prototypical tenor styles in jazz: the fast, driving, explosive riff style and the slow, flowing, rhapsodic ballad form. He made the mold, he was the model: already, Ben Webster, Herschel Evans, Chu Berry, Budd Johnson, and many more had sprung, fully armed, from his high forehead.
To Europe, where the greatness of jazz had been felt mainly through records, Hawkins brought it in the flesh. Sidney Bechet had spent time there back in the twenties, and Louis Armstrong himself had flashed like a comet through England, Scandinavia, the Low Countries, France, Italy, and Switzerland earlier in the thirties. But Hawk came and remained; the first fixed star of magnitude.


When His Erstwhile Henderson colleague, Benny Carter, that master of the alto sax, clarinet, trumpet, and arranger's pen, crossed the Atlantic a bit later and also decided to stay, the two often hooked up. Together and individually they put their stamp on European jazz for decades.


The process was reciprocal. Hawkins's love for certain of the better things in life — good food, good drink, good clothes, pretty women, fast cars — was apparent before he left his homeland, but Europe sharpened and deepened his tastes. His sense of his own dignity and worth also expanded the warmth of European appreciation and adoration. From here on in Hawk was a cosmopolitan.


Meanwhile, there were not just contenders to his crown back home, but a whole new tenor style, introduced by Lester Young. Only a few of Hawk's great European recordings had made their way into the hands of American musicians during his absence. The climate seemed right for battle and the tenor brigade was ready for Bean (as musicians then called him, "bean" being a synonym for head, i.e., brainpower) when he came home in late July of 1939, just before the outbreak of World War II. Chu Berry, Ben Webster, Don Byas, and Lester himself were gathered to greet Hawk at a Harlem after-hours spot called Puss Johnson's (there were many such music spots; the reputation of Minton's is all out of proportion). The master arrived without horn (but with a striking lady), listened, and refused to be drawn into battle. A few days later he returned with horn and reestablished his sovereignty.


Hawk's victory became official with the release, late in 1939, of the biggest record of his career: "Body and Soul." Consisting of just two choruses—framed by a brief piano introduction and short tenor cadenza—it stands as one of the most perfectly balanced jazz records ever made. After more than three decades it remains a model of flawlessly constructed and superbly executed jazz improvisation, and is still the test piece for aspiring tenorists.


Although young tenor men in increasing numbers were taken with Lester's cooler sound and unorthodox phrasing, the Hawkins approach remained firmly entrenched (as the newfound popularity of Ben Webster with Duke Ellington and Don Byas with Count Basie proved in the early forties). There also arose a school of tenors equally influenced by both: Illinois Jacquet, Buddy Tate, Gene Ammons, and Dexter Gordon are examples.


Furthermore, that leader of the new style soon to be labeled bebop, Charlie Parker, symbolized the possibility of a Hawkins—Young fusion. Though fashionable jazz criticism has emphasized only Young's influence on Parker, there can be no doubt that Hawkins, especially in terms of harmony, approach to ballads, and use of double time, also profoundly touched Bird's conception.


The influence was a two-way street. Hawkins was the first established jazz figure of major stature to not only accept but embrace the new music, which he rightly saw as a logical development. Consider this: Hawk was the only name leader to hire Thelonious Monk, the strange piano player from Minton's house band, for a downtown gig (on 52nd Street) and to use him on a record date (the earliest music heard on this remarkable collection, and Monk's studio debut). And this: for a February 1944 date with a larger band, Hawkins hired Dizzy Gillespie, Max Roach, Leo Parker, and other young modernists to back him. And this: at the end of 1944, Hawk took to California a pioneer bop group that included Howard McGhee and Denzil Best. As early as 1947, Hawk used Miles Davis on a record date; a few years later he had him in his band. The 1947 date on this album clearly reflects Hawk’s commitment to the new sounds, and his ability to fit himself into it. (Note also the inclusion of a Monk tune, perfectly interpreted.)


Hawk didn't just adapt to bop; profoundly touched by Parker, he entered a whole new phase of musical development at an age when most players have settled permanently within a given framework.


The new Hawk was most clearly visible in the blues. Prior to the mid forties, Hawkins rarely played blues, and never with much of what we now call "funk." But Bird brought a new blue stream into jazz, and Hawk was nourished by it (hear him here on "Sih-sah" and "Juicy Fruit"). And Bird’s song in Hawk's ear didn't end with the blues. You can feel it throughout tin 1957 session, and in the magnificent "Ruby, My Dear" which stems from a Monk — Hawkins reunion album that co-starred John Coltrane. (The rest of that date, by the way, can be heard on Monk/Trane.)


For many years they had affectionately called him "The Old Man." But he still looked, felt, and played young and it was the Old Man's pride that he could keep up. No resting on laurels for him; virtually everything new was a challenge. But for a while, when Lester's way of playing tenor dominated the scene, and bop had little time to look back, Hawkins fell somewhat out of favor. When producer Orrin Keepnews gave him carte blanche to pick his own men for the 1957 date reintroduced herewith, the result was the first loose, modern jazz date for Hawk in some time. It compares most interestingly with the session of ten years before, and not only for the work of Hawk himself and repeaters J. J. Johnson and Hank Jones. (It is also interesting that Hawk did not choose a bop rhythm section for himself.)

Throughout the fifties, with Norman Granz's Jazz at the Philharmonic and also on his own, he frequently teamed with old friend Roy Eldridge, ten years younger but a fraternal spirit. From 1957 on, the Metropole in New York's Times Square area became their home base. Most jazz writers except visitors from Europe) shunned the place, but musicians did drop in to hear Roy and Hawk: among them, Miles Davis, Sonny Rollins, and John Coltrane.


At the soulful establishment across the street, The Copper Rail, the players and their friends congregated to eat and drink. Even when they were three-deep at the bar, you could hear Hawk's laughter, or his voice emphasizing a point, from anywhere in the house. Though he was not a large man, his voice had a presence remarkably similar to his saxophone sound. Hawk was strong in those days. The new tenor voices, significantly that of Sonny Rollins, seemed closer in conception and sound to him than to Lester, and his star was once again in ascendance. He and Roy made periodic tours abroad. Recordings were again fairly frequent. His personal life was happy. His health seemed robust.


"You have to eat when you drink," he used to say, and he was still following his own rule. A girl I knew thought nothing of cooking him eight eggs for breakfast, and he could go to work on a Chinese dinner for two or a double order of spareribs in the wee hours of the morning with the gusto of a hungry lumberjack. In the course of a working day, he'd consume a quantity of Scotch even Eddie Condon would have deemed respectable, but he could also leave the booze alone when it got to him. When Lester Young died in 1959, not quite fifty, the Old Man told me how he used to try to make Pres eat when they were traveling together for Jazz at the Philharmonic. "When I got something for myself, I'd get for him, too. But I'd always find most of it left under his bus or plane seat when we got off."


Hawk liked Lester very much, but the only tenor player I ever heard him call "genius" was Chu Berry. Other musicians he bestowed this title on were Louis, Bird, Art Tatum, Dizzy Gillespie, and Monk—the latter a personal favorite.


At home, Hawk rarely listened to jazz. His sizable collection was dominated by complete opera sets (Verdi, Wagner, and Puccini) and also included a lot of Brahms and Debussy. Bach and Beethoven were there as well, and some moderns, but Hawk liked music with a big sound and romantic sweep best of all. With his luxurious hi-fi setup, he could fill his comfortable Central Park West apartment with sound, and the commanding view of the park went well with the music. Sometimes he'd play the piano, which he did surprisingly well—always music of his own.


In the final years, which his friends would rather forget but can't, Tommy Flanagan would sometimes drop by and make Hawk play the piano and try to copy down some of the tunes. Hawk was always a gifted composer — even with Henderson — but never had the patience to write the stuff down. By then, the expensive hi-fi equipment had fallen into disuse, the blinds were often drawn to shut out the view, and the sound most frequently heard was that of the TV — on around the clock to keep the insomniac company. As often as not, there'd be food defrosting in the kitchen—chicken, chops, ribs, or steak—but "by the time it's ready for me to fix," he once told me, "I've lost my appetite from this whiskey." He knew exactly what he was doing to himself, but some demon had hold of him.


It had nothing to do with the socio-psychological cliches of art and race so often applied to "explain" jazz artists, but it did have much to do with the fact that he was living alone now, and that his aloneness was of his own making. His last great love gone because in his jealousy he could not accept that a woman could love a man much older than herself, he now chose to accelerate the aging process he had previously hated and successfully fought off. He let his grizzled beard and hair flow freely, and let his once immaculately fitting suits hang from his shrunken frame.


Only work could shake him out of his depression, but now it seldom came. He'd never been one for managers and agents; if people wanted his services, they could call him. But only a few employers — mainly the loyal Norman Granz, sometimes George Wein, a club owner here or there —  would still come through. My friends and I got him some gigs. It was a vicious circle: because he didn't work much, he was rusty when he did play (he had always disdained practicing, and lifelong habits don't change), and because he was rusty (and shaky), he wasn't asked back. Even quite near the end, a few nights of work, leading to resumed eating, could straighten him out, and he'd find his form. But there was no steady work to make him stay on course.


Perhaps it would have been too late; he hated doctors and hospitals and refused all suggestions of medical attention. And since his voice, incongruously, remained as strong as ever and his ego just as fierce, it was difficult to counteract him. He welcomed company but never invited anyone. His daughters would come by to visit and straighten up the house when they were in town. Frequent visitors included Monk and the Baroness Nica de Konigswarter, but the closest people near the end were Barry Harris and drummer Eddie Locke.


Monk was at Hawk's bedside when it had finally become necessary to take him to a hospital. Monk even made the Old Man laugh — but it was for the last time.

The heavy losses suffered by Bill Gross's Unconstrained Bond Fund have been widely discussed, as market commentators have loudly mused about the veteran manager's tabloid divorce and the continued success that his former colleagues at PIMCO have enjoyed in his absence. And in the latest update on travails facing Gross and his remaining investors, Bloomberg reported Thursday that Gross's losses have been exacerbated by the conspicuously high leverage ratio he employed at the fund.

According to BBG, Gross pushed the leverage ratio at his Unconstrained Bond Fund to 13:1 during the first half of the year, even as the Treasury yield curve continued to flatten in defiance of his expectations that long-term bund and Treasury yields would converge. 

But unfortunately, as Mario Draghi reaffirmed Thursday morning, the collapse of the "global synchronized growth" narrative has smothered any immediate incentive for the ECB to unwind its massive monetary stimulus, allowing continued "policy divergence" to push spreads wider.

Gross, who as manager of the Janus Henderson Global Unconstrained Bond Fund has struggled to generate returns and attract capital, increased his average futures exposure as much as 13-fold from January through June, according to a filing. The derivative bets may help explain the fund’s turbulence -- because while investments in futures can boost potential returns, they can also generate out-sized losses.

Investors have yanked roughly half a billion dollars from Gross's fund so far this year, according to MorningStar data, as it has suffered several vertigo-inducing pullbacks, including a 3% pullback on May 29 that was the biggest one-day drop of the year among large bond funds. During the first half alone, Gross's losses totaled $153 million on what was a $2 billion fund at the beginning of the year.

Gross realized almost $153 million of losses on interest-rate futures in the first half, a significant dent for what was a $2 billion fund at the time. It suffered several big swings during the first six months of this year, most notably a 3 percent plunge on May 29. That drop, which was the year’s largest single-day decline by a big bond fund, jarred investors and increased scrutiny of Gross’s stewardship.

"Losing 3 percent in a day in equities is not calamitous, but in bonds it is enormous," said Richard Klitzberg, an asset management consultant to institutions and high-net-worth families. "He was running billions of dollars and either got the trade completely mis-positioned or was very highly levered."

Gross said in July that his fund has scaled back his convergence bet. Yet, an Aug. 30 filing suggests Gross used futures to double down on the strategy, only to have it once again blow up in his face. These losses have left Janus's Unconstrained fund down nearly 6% on the year.

Interest rate futures would be the simplest way to execute Gross’s convergence trade, said David Ader, chief macro strategist at Informa Financial Intelligence, adding that the Janus fund could go long on 10-year Treasuries futures and short on those for 10-year bunds.

The average value of the fund’s futures contracts purchased rose to $1.45 billion in the first half of this year from $112 million reported for the six months ended Dec. 31, according to the filings. The average value of its futures contracts sold also rose, to $1.1 billion from $214 million, over the same time period.

Janus Unconstrained’s combined losses on futures tied to commodities, currencies, equities and interest rates totaled $212 million during the first half of this year, including the $153 million lost on interest-rate bets. Though the total was partially offset by roughly $86 million of gains on options, that’s a lot of money for any fund to lose on futures, said Ader.

"It gives new meaning to the term unconstrained," he said.

Janus disclosed that the fund did hold some futures tied to U.S. and German debt, as well as options on such futures, as of March 31 and June 30. The filings don’t show positions on other days during the first half of the year like May 29, instead reporting the average exposure to futures during the period.

Since early this year, Gross's poor performance has weighed on Janus's stock, which is down more than 20% this year. And Gross's boss is quickly growing tired of his one-time star hire's performance. In a rare public rebuke last month, the company's CEO described Gross's performance as "disappointing."  Meanwhile, Gross's former employees at Pimco are proving that the firm is thriving without him, a reality that would bruise the ego of even the most mellow investment managers (and as anybody who has followed Gross's antics over the past three years will know, Gross is anything but mellow).

We wonder: Have the twin humiliations of his divorce and Pimco's continued success caused the one-time "bond king" to go on tilt? Or is he seeing something that the rest of the market is missing?
