A Terceira Turma do Superior Tribunal de Justiça (STJ) rejeitou agravo interno contra decisão da presidência do STJ que não conheceu de recurso especial por intempestividade. Para o colegiado, faltou a comprovação, no processo, de que a segunda-feira de Carnaval e a Quarta-feira de Cinzas eram feriados locais.
O recorrente alegou ter apresentado o recurso especial dentro do prazo, justificando que foram considerados como dias sem expediente no Tribunal de Justiça de Alagoas (TJAL) a segunda-feira de Carnaval e a Quarta-feira de Cinzas. No entanto, ao interpor o recurso, não apresentou comprovação documental de que nessas datas houvesse feriado forense.
O relator na Terceira Turma, ministro Marco Aurélio Bellizze, lembrou que a ocorrência de feriado local tem de ser comprovada no ato da interposição do recurso, como prevê o artigo 1.003, parágrafo 6º, do Código de Processo Civil de 2015.
Insanável
No fim de 2017, decisão da Corte Especial do STJ ratificou o entendimento de que a falta de comprovação prévia da tempestividade de recurso, em razão de feriado local, configura vício insanável.
Segundo Bellizze, no caso em análise, o acórdão recorrido proferido pelo TJAL foi publicado em 23 de fevereiro de 2017, expirando-se o prazo para a interposição do apelo especial em 17 de março.
O ministro explicou que o recurso somente foi protocolizado em 20 de março, “sem que houvesse a comprovação de feriado local ou da ausência de expediente forense, não bastando para tanto a simples indicação de suspensão de expediente nas razões recursais, encontrando-se, portanto, intempestivo”.
Não são nacionais
O relator ressaltou que o STJ possui entendimento no sentido de que a segunda-feira de Carnaval, a Quarta-feira de Cinzas, os dias que precedem a Sexta-feira da Paixão e também o dia de Corpus Christi não são feriados forenses, previstos em lei federal, para os Tribunais de Justiça estaduais.
“Na contagem dos prazos dos recursos endereçados ao Superior Tribunal de Justiça cuja interposição deva ser realizada nos tribunais estaduais, excluem-se os dias referentes à segunda-feira de Carnaval e à Quarta-feira de Cinzas, que não são feriados nacionais, desde que o recorrente comprove, no ato de interposição, que em tais datas não houve expediente forense no Poder Judiciário estadual”, disse Bellizze.
