DANA BASH, CNN 'STATE OF THE UNION' GUEST HOST: Let's start with the president's impending announcement to replace Anthony Kennedy on the Supreme Court. The president said he has narrowed the field down to four and will announce tomorrow night. Now, the question for you, sir, is, as you represent an incredibly red state, Donald Trump won 62 percent of the vote in Alabama, do you feel a responsibility to give your constituents what they voted for? SEN. DOUG JONES (D-AL): Well, I feel a responsibility to my constituents, but I also feel a responsibility to the Constitution. You know, the Constitution gives the Senate a shared responsibility with the president to confirm nominees. And our founders, you know, put that in there for a reason, because judges have life tenure. And so that shared responsibility is important. And I take that very seriously. So we're going to give -- whoever the nominee is going to be, we're going to give them a very, very good, hard and fair look to determine what I believe to be the best interest of my constituents, but also the country. BASH: So, to be clear, you are open to voting yes for whomever the president nominates? JONES: Oh, I'm open to voting yes. I'm open to voting no. We don't know who this nominee is going to be yet. I don't think my role is a rubber stamp for the president, but it's also not an automatic, knee-jerk no either. My job is to exercise that independent voice. I want to look for a judge that has the intellect and capacity to do the right thing, to follow the rule of law, to adhere to precedents, and move the country forward. And I think that that's the best role. BASH: And just to put some context around this, Neil Gorsuch, the president's first nominee for the Supreme Court, got three Democratic votes. You weren't in the Senate then. But you come from a more Republican state than those Democratic senators. Hard to imagine you voting no. Fair? JONES: Well, no, I don't think that that's fair one way or another, Dana. I think that I have got to look at this nominee. I'm going to make an independent judgment. I -- that's my job. I come from a place with a former senator in Howell Heflin, former chief justice of the Alabama Supreme Court. He understood the role of the Senate as -- with that shared responsibility. And I'm going to look. I'm going to make an independent judgment and a view. I don't think anyone should expect me to simply vote yes for this nominee just simply because my state may be more conservative than others. I want to make an independent look at this, because I think, you know, even the people of Alabama like to make sure they have judges that adhere to the rule of law. BASH: And, at the same time, just the fact that you're open to voting yes sets you apart from the vast majority of your Democratic colleagues in the Senate. Listen to how some of them have described the implication of this decision. (BEGIN VIDEO CLIP) SEN. ELIZABETH WARREN (D), MASSACHUSETTS: He's looking for a nominee who will criminalize abortion and try to punish women. SEN. BERNIE SANDERS (I), VERMONT: All of the advances that we have made over the years are now increasingly in danger. SEN. KAMALA HARRIS (D), CALIFORNIA: We're looking at a destruction of the Constitution of the United States. (END VIDEO CLIP) BASH: Destruction of the Constitution, do you agree that that's what's going on here? JONES: Look, I think that this is a very important nominee, for sure. And I am concerned about this nomination. And I'm concerned about the direction that the court will take. And I don't want to see things change radically. And I think there are some legitimate concerns. That's what I'm going to look at. That doesn't mean I'm going to vote yes. It doesn't mean I'm going to vote no. I think it's premature to say automatically -- I'm not going to say automatically that I'm going to vote against any nominee that Donald Trump put out there. That's just not my role. But I'm not going to automatically vote for them either. I want to take a good, long look. We're -- we have got a long way to go with whoever this nominee is going to be. BASH: Is it appropriate for your Democratic colleagues to be doing just that, saying no before the nominee is out there? JONES: Well, I would -- you know, Dana, I would prefer that they don't do that. I would prefer that Republicans don't say they're going to automatically vote for someone. The problem that we have got in this country right now is that we have such a partisan divide, and particularly on Supreme Court nominees. It has become so political. I was watching this morning. They're already running TV ads in favor of a nominee that's not being selected. This has become a political issue, as opposed to an independent judiciary. And that's not a good thing. BASH: And it's become political. And on the politics, it's a question of fairness for a lot of your fellow Democrats. Your leader, Chuck Schumer, says there shouldn't be a vote this year in 2019 because Republicans refused to confirm Merrick Garland during an election -- or that was a presidential election year. This is a midterm election year. But is that the right strategy? JONES: I don't think that that strategy is going to work regardless, whether it's the right or the wrong strategy. I think that the -- Senator McConnell is going to proceed with this nomination. As he proceeds, there is very little that Democrats can do procedurally. But it's also going to depend on the nominee. If this nominee requires a greater, deep dive into their background, it's going to take some time. So, I think it's going to be really dependent on the nominee and the investigation that is going to go on by both a majority and minority in the Senate Judiciary Committee, and then for individual senators to meet. I want to make sure that I get a chance to meet with this nominee before I pass judgment on them.

KARACHI: Christians, a tiny minority in Islamic Pakistan, have given a warm welcome to newly appointed Roman Catholic Cardinal Joseph Coutts in the southern port city of Karachi.
Coutts was heralded Tuesday at the Karachi airport. The 73-year-old former archbishop was among 14 new cardinals appointed by Pope Francis at a ceremony in Vatican City this month.
Coutts, born in India, is only the second cardinal from Pakistan after Cardinal Joseph Cordero who died in 1994.

As a songwriter, Swift noted that she calls the lyrics and music that made her a household name as “clouds of an idea that land in front of your face.” Although it sounds simple enough, she noted to the publication that the entire process is a learned experience.

Instead of right-wing extremist Gorsuch we would have a center-right "moderate" like Merrick Garland, who would defend Roe v Wade but might have joined in some of the bad decisions that the Supreme Court actually made last week.

With Clinton, we would have had the TPP, and might not have had the progressive resurgence that could take the US government away from the rule of the rich. It is not guaranteed that this resurgence will win, but it gives us a chance.

To be perfectly clear on the obvious point: Brett Kavanaugh is a lovely man and presumably a good father with a lovely family. As was Neil Gorsuch before him. As was Merrick Garland who was grievously insulted by Senate Republicans and conservative legal lobbyists for nearly a year. It wasn’t personal then, and it’s not personal now when I say that Donald Trump made a mistake in picking Kavanaugh as his second nominee to the Supreme Court.

Over what I believe to be a surprisingly authentic warning from Mitch McConnell not to select Kavanaugh or Amy Coney Barrett to fill the seat left by Anthony Kennedy, the president chose the guy who had the most to say about imperial presidents. This is not a surprise. Beyond the fact that Kennedy doubtless approved of Trump’s selection—Kavanaugh, like Gorsuch, clerked for Kennedy—the single greatest selling point for Kavanaugh had to have been the much-reported line from his 2009 Minnesota Law Review article, in which he wrote, “Even in the absence of congressionally conferred immunity, a serious constitutional question exists regarding whether a President can be criminally indicted and tried while in office.” A President Trump seeking justification to immunize himself from prosecution needed to look no farther than Kavanaugh’s caution in that same article that the indictment and trial of a president “would cripple the federal government, rendering it unable to function with credibility in either the international or domestic arenas.”

But the problem for Trump is that Kavanaugh has been extraordinarily transparent—perhaps too transparent—about his affinity for broad constructions of executive power. Nevertheless, the president—whose administration is currently the subject of a wide-ranging criminal investigation—somehow chose the judge who’s most likely to endorse the Trumpian view that this is all a massive witch hunt, this despite the gamble that Kavanaugh’s selection makes him look guilty. Pro tip: It makes him look guilty.

To be sure, as Jed Shugerman notes, Kavanaugh’s law-review article doesn’t promise presidential immunity so much as suggest that Congress can and should confer such immunity. Nevertheless, Kavanaugh’s lengthy and complicated record with respect to presidential investigations (ranging from his work on Vince Foster’s suicide to his zealous pursuit of Bill Clinton in the Whitewater probe) will require the review of a massive trove of documents from his time at the White House and working for Ken Starr, an endeavor that will consume huge amounts of time. And Kavanaugh’s record will include emails on so many questions connected to the Mueller probe—including issues that Trump himself has raised such as the nature of presidential obstruction and presidential immunity—that a deep dive into that record will ensure (as if it needed ensuring) that the Mueller probe stays in the headlines in the runup to the midterm elections.

In short, this means that Trump didn’t just give Senate Democrats the talking point that Kavanaugh is an all-but-certain vote to erode or end Roe v. Wade. That statement, while true, could’ve been made about any of the judges on the president’s short list. In selecting Kavanaugh, Trump has given Democrats an additional talking point: The president picked a guy he hopes will hand him a get-out-of-jail-free card.

A pair of Democratic senators have already jumped on this bandwagon, with Jeff Merkley tweeting that the pick indicates Trump “is terrified of Robert Mueller” and Cory Booker stating that he “literally selected the one person who has a pretty good written record of saying, ‘Hey, if you’re a president under investigation, I don’t think you should be allowed to be under criminal investigation.’ ”

Whether this is true or not, or even supported in Kavanaugh’s extensive record, the fact is that Senate Democrats will be able to spend the summer arguing precisely what the president doesn’t want them to argue: that the Mueller probe is ongoing, that close Trump confederates have been indicted and other indictments are coming, that many of the legal questions surrounding the Mueller investigation may end up before the Supreme Court, and that the president may have hand-picked a judge solely for the possibility that he may vote to exonerate him.

While we don’t yet have a full picture of the scope of Kavanaugh’s record about the boundaries of an imperial presidency, we do know that, as Garrett Epps put it Monday night, “Not since Warren Harding in 1921 nominated former President William Howard Taft to be chief justice has the country been presented with a high court nominee so completely shaped by the needs and mores of the executive branch as Brett Kavanaugh.”

More specifically, we know that when the U.S. Court of Appeals for the District of Columbia Circuit upheld the constitutionality of the Affordable Care Act in 2011, Kavanaugh wrote in dissent that if a president takes issue with an existing law, he can simply declare it unconstitutional and refuse to enforce it. “Under the Constitution,” he wrote, “the President may decline to enforce a statute that regulates private individuals when the President deems the statute unconstitutional, even if a court has held or would hold the statute constitutional.”

We also know that Kavanaugh is a staunch proponent of dismantling the administrative state, having issued multiple rulings against the EPA and a famous dissent claiming that the Consumer Financial Protection Bureau is unconstitutional. He has pushed for an extremely broad view of executive power in the name of national security. He has signaled an intent to do away with what is known as Chevron deference wherein judges defer less to federal agencies’ interpretations of their own rules.

In short, to the extent that the president looks like he went on a shopping spree for the justice who’s inclined to put his legal imprimatur on the proposition that Trump gets what Trump wants, he seems to have found what he needed. And I, for one, am exceedingly glad that we have a 12-year judicial record, in addition to years of government service, to probe for clues on whether Kavanaugh will be an independent vote or not. This is a vastly better outcome than getting someone who’s written a pile of law-review articles and has no meaningful judicial record.

Nevertheless, if Trump wanted to keep the Mueller “witch hunt” off the front pages, he may have seriously miscalculated in choosing the Supreme Court nominee who could push the glassy-eyed public into refocusing on Trump’s personal corruption, pointless cruelty, and attacks on judicial independence. Maybe that’s a winning issue for this president. I don’t think so.

Trump would have done better choosing a religious conservative and turning the midterms into a fight over the religious freedoms of Christian dissenters. The midterms, effective this week, will instead be about whether Trump’s proposed new justice thinks the president can pardon himself. As Republican get-out-the-vote messages go, it’s not a strong one.

The husband of Karen Fonseca, the Texas woman who became a celebrity by plastering her truck with “F– TRUMP” stickers, is now in trouble for driving that vehicle, the Houston Chronicle reported.
But not because the cops are in cahoots with President Trump.
According to the Chronicle, Miguel Fonseca was pulled over at 5:41 p.m. Sunday on U.S. Highway 59 in Sugar Land, Texas, because the not-MAGA-compliant vehicle was also not in compliance with Texas vehicular laws — it didn’t have the required front license plate.
Sugar Land Police Department spokesman Doug Adolph said Monday that the officer also quickly learned that Mr. Fonseca, who is listed as the truck’s owner, had two outstanding warrants — for speeding and failure to appear.
According to Mr. Adolph, Mr. Fonseca refused to exit the truck and had to be forcibly removed, which added a new resisting arrest charge. The state impounded the truck because, Mr. Adolph said, by the time Mrs. Fonseca arrived to collect it, Mr. Fonseca was not present to give consent, as the owner must in such cases, because he’d already been hauled off to jail, where he remains Monday evening.
Mrs. Fonseca took to GoFundMe to dispute the charge and play the race card.
She said her husband was initially pulled over because the windows were tinted too dark.
“He was followed by 3 white police officers that were in our neighborhood due to an unrelated dispute,” she wrote on the page titled “Free Mike Fonseca,” which had a $1,000 goal.
As of Monday afternoon, it had been up 18 hours and raised $33.

Worldwide music superstar Taylor Swift revealed that celebrity isn’t all its cracked up to be, calling her fame “complicated’ in the August issue of Harper’s BAZAAR.

The singer may have gained fame and fortune since she first burst onto the music scene more than 10 years ago, but looking inward, Swift remarked that there is still one thing about her job that she calls “the purest thing.” Said Swift of her celebrity to the magazine that it can get “complicated on every other level,” but she finds songwriting the same “uncomplicated” process it was when she was a teenager and at the beginning of her career.

As a songwriter, Swift noted that she calls the lyrics and music that made her a household name as “clouds of an idea that land in front of your face.” Although it sounds simple enough, she noted to the publication that the entire process is a learned experience.

Minutes after President Donald Trump’s nominee to the Supreme Court was announced on Monday night, the political hype machine started winding up. Strong opinions were trumpeted, both for and against Judge Brett Kavanaugh, who was unknown to most Americans just days ago.

“Judge Kavanaugh should not be allowed anywhere near our nation’s highest bench,” cried Democratic National Committee chair Tom Perez. “A superb choice,” retorted the conservative Federation for American Immigration Reform. “Kavanaugh has spent his career ruling against working people in favor of wealthy corporations,” claimed 32BJ SEIU Pennsylvania and Delaware vice president Gabe Morgan. “A judicial grand slam!” said Horace Cooper, co-chair of the black conservative group Project 21, adding, “Those who love our Constitution will be thrilled." 

But in fact, according to Rutgers Law School professor Perry Dane, all this politicking and noise is precisely the problem that is hampering the U.S. Supreme Court from fulfilling its function as the third branch of government, empowered under Article 3 in the U.S. Constitution.

”The whole process is just bizarre. This is not how judges should get selected,” Dane said. “It’s really not up to justices to either affirm or disappoint their supporters. In principle, once they’re appointed, they’re supposed to be free agents, using their best judgment.”

What can we expect during the confirmation hearings for Judge Kavanaugh? A “free-for-all,” said Dane, who clerked for US Supreme Court justice William J. Brennan in the 1980s.

“I’m frankly not looking forward to it. Whoever Trump nominates will be well-prepared and well-rehearsed not to say anything of much interest. … There will be an effort to tease specific views from them, and the nominee will say very general things and will talk about judging in very bland terms,” he predicted. “There’s going to be all the worst aspects of a political campaign without any of the actual information."

Perry predicted that with a Republican majority in the Senate, huge pressure will be brought to bear upon sens. Susan Collins (R-ME) and Lisa Murkowski (R-AK), who are seen as potential swing votes. But otherwise, the public can expect a vote along party lines.

“Most Republicans are going to vote yes, most Democrats will vote no,” Dane said. “One of the things I’m not looking forward to in this process is presumably the opponents will try to figure out some personal defect. … If that happens there's a risk of it getting particularly ugly.”

"If I were the Democrats, my opposition would be much less tied to the personality of the candidate," he continued. "I would say we shouldn’t have anybody until the election, or not let Trump get two nominations after the fiasco with Merrick Garland, or shouldn’t let Trump pick somebody while the Mueller investigation is going on.”

A better way?

As an example of a better system, Dane cited the United Kingdom, where three new justices, nominated by a neutral judicial commission, were appointed to the nation’s 12-judge Supreme Court in 2017.

“Even though it is a very important court that issues very important decisions, there wasn’t nearly the same sort of fuss or sense of political crisis,” Dane said. “They really tried to pick the three judges in the country who were the most superbly qualified.”

He argued that past Supreme Courts have had more “flexible” judges, like retiring Justice Anthony Kennedy, who despite being a Republican was known for authoring some of the court’s most progressive opinions.

“If I were designing a Supreme Court, I might have a few people who were very clearly ideologues on the left and ideologues on the right, and I'd have a nice mushy center of people who were willing to be convinced one way or the other on each case and issue,” he said. “The current split is very identified with our political parties. … You really have the Supreme Court viewed as another legislature. People just get used to it and they forget that it’s bizarre and weird and bad, both for the law and the country.”

On Monday night, President Trump named his second nominee for the Supreme Court: 53-year-old Brett Kavanaugh, an experienced judge that pleased some conservatives, nonplussed others and sent Democrats to their battle stations, fearing the conservative jurist will overturn Roe v. Wade. Here's what we know about Kavanaugh and his record so far:

1. He is conservative (but not enough for some conservatives)

A longtime George W. Bush staffer and D.C. native, "Kavanaugh is considered a pragmatic but conservative judge, who believes in textualism and originalism," says NPR. He has written opinions that could be interpreted as anti-abortion (see #5) and against the Affordable Care Act. But some conservatives consider those same opinions too liberal: In a ruling about Obamacare, he recognized it as a tax, the same logic the Supreme Court used to uphold it as legal, irking the right wing. Kavanaugh, 53, is married with two daughters and is a practicing Catholic.

2. Brett Kavanaugh has extensive experience on the bench

Kavanaugh is a judge on the D.C. Circuit Court of Appeals, kind of a farm team for future Supreme Court justices. Ruth Bader Ginsburg came from there; so did Merrick Garland, President Obama's nominee whom Senate Republicans blocked. (Garland is Chief Justice, technically Kavanaugh's boss.) Kavanaugh was appointed by George W. Bush in 2006, after his hearing was delayed by Democrats for three years because they considered him unqualified and a partisan pick. In his 12 years on the bench, he has written more than 300 decisions.

3. He worked in the Bush White House

Kavanaugh served George W. Bush's staff secretary — the mild-sounding job that is actually incredibly important. (It's also the one Hope Hicks's boyfriend Rob Porter was forced to leave after previous domestic abuse allegations surfaced against him.) The staff secretary keeps track of every piece of legislation the president has to sign, and so has his hands and eyes on all manner of highly privileged information. He was previously associate White House counsel under Bush.

4. Brett Kavanaugh was a lawyer during the 2000 Bush-Gore recount

He represented Bush.

5. He was on Kenneth Starr's team investigating President Clinton

Dude got around. He was assigned to investigate Deputy White House Counsel Vince Foster's suicide and ultimately helped write the Starr Report.

6. As a judge, he criticized investigation of a sitting president

In a 2009 issue of the "Minnesota Law Review," Kavanaugh wrote: "Even the lesser burdens of a criminal investigation — including preparing for questioning by criminal investigators — are time-consuming and distracting. Like civil suits, criminal investigations take the President's focus away from his or her responsibilities to the people. And a President who is concerned about an ongoing criminal investigation is almost inevitably going to do a worse job as President."

7. Brett Kavanaugh made one ruling involving abortion

In the case of a 17-year-old immigrant who became pregnant and wanted to seek an abortion, Kavanaugh dissented from the majority and voted not to allow it. But he wasn't as hard-line as another judge who also voted against it. He will be pressed to give his opinion on preserving Roe v. Wade during Senate confirmation hearings.

8. He clerked for the man he has been nominated to replace

Kavanaugh served as a clerk for Supreme Court Justice Anthony Kennedy. Today, Politico reported that Kennedy's partiality to Kavanaugh helped convince Trump to make the pick.

I’m in America at the moment at my brother’s wedding, but I very kindly recorded this before I went away.  I’ve thrown in some stuff about weddings and some summery happy tunes too.

Also, he’s getting married on Cape Cod, and I worked there as a waiter for two Summers when I was a student - with my everso English accent the tips were quite splendid - so I’ve thrown on a few songs that remind me of my Summers on Cape Cod, although not all are obviously related.  All in all it’s a cheerful, happy mix with a nice atmosphere to it, so you should like this one.

By the time you hear it though I could very easily have sworn myself into exile and ruined my relationship with my new in-laws forever.  Wish me luck, Toadlings, wish me luck.

"Within the next few months, Brett M. Kavanaugh will get a vote in the Senate to determine whether he joins the Supreme Court. In all likelihood, that vote will be close but will work out in Kavanaugh’s favor. Republicans currently have a 51-to-49 majority in the Senate, and even if the ailing John McCain (Ariz.) doesn’t vote, if they hold the rest of their members (and they will) the result would at worst be a 50-50 tie that Vice President Pence would break.

That vote will be a vivid reminder that we are living in an age of minority rule. In fact, that is one of the central features of this political era. The Republican Party represents a minority of the American electorate, yet it controls not only all three branches of the federal government but also most state governments, as well.

Why do I say that a vote in Kavanaugh’s favor is an example of minority rule? Because the body that will confirm him is built in its current formation to almost guarantee Republican control, despite the fact that most American voters selected Democrats to represent them there.

Using Dave Leip’s invaluable election atlas, I added up all the votes cast for Democrats and Republicans in the 2012, 2014 and 2016 Senate elections, which put the current Senate in place. I didn’t bother with the few special elections since 2012, which in total wouldn’t change the results much, but I did include Bernie Sanders’s and Angus King’s last elections, since they are nominally independent but caucus with the Democrats. Here are the results:

Republican votes: 102.3 million

Democratic votes: 117.4 million
In the elections that determined the current Senate, there were 15 million more votes cast for Democrats than for Republicans. Yet Republicans maintain control and therefore get to confirm President Trump’s Supreme Court nominee.

Well, that’s just how it is, you might say. Blame the framers. And that’s true: They set up a system in which Wyoming’s 580,000 residents get two senators and California’s 40 million residents also get two senators.

But that doesn’t mean it’s fair or right or that Democrats shouldn’t be livid in cases like this where it leads to such an antidemocratic outcome. And the GOP’s built-in advantages combine to make the country much more hostile to the policies the majority actually wants.

So we will now have an intensely conservative Supreme Court in which five of the nine justices were appointed by Republican presidents, despite the fact that in six of the past seven presidential elections, the Democratic candidate won the most votes. That’s because of the electoral college, another feature of our system with a built-in Republican advantage.

Were it not for the skew of the Senate, Mitch McConnell would not have had the ability to refuse to hear the nomination of Merrick Garland, in which case the margin would have been 5-4 in favor of Democrats. Were the presidency determined by which candidate got the most votes — as it is in every other democracy on earth — Hillary Clinton would be president right now, and the margin would be 6-3 in favor of liberals.

There’s a related situation in the House, where most analysts believe that in order to take control Democrats will have to not just win the popular vote, but win it by a huge margin of 6 or 7 points. And all this is why enormously popular policies like minimum wage increases, greater funding for education, and universal health coverage never see the light of day, while our national legislature eagerly cuts taxes for the wealthy and corporations whether that’s what the public wants or not. And one of the things you can absolutely count on from the newly (even more) conservative Supreme Court is that they will approve every step Republicans take to suppress the votes of those inclined to oppose them, making their continued hold on power all the more likely.

In other words, our entire political system is built to give the Republican Party a series of advantages, even when they represent a minority of the public, as they now do. In some cases that’s by their design, and in some cases it’s a happy accident, but it all points in the same direction. And when Republicans have power, they work ceaselessly to make the system even less democratic and more rigged in their favor.

So every time the Supreme Court issues another ruling that cheers conservatives, whether it’s restricting reproductive rights or gutting campaign finance laws or undercutting environmental regulations, we should remember that it was made possible by a minority president with the aid of a minority Senate.

When he ran for president, Donald Trump told his voters that they were the victims of a rigged system. Nurture your rage, he urged them, and strike a blow against that system by voting for me. In truth, he was the product of the rigged system, not its enemy. So maybe it’s time for liberals to finally get angry about it."

Since there are many legal pundits far more qualified than I to debate the merits and demerits of Justice Brett Kavanaugh, I'll focus here on some larger, related issues.

1) This is the main reason many of us voted for Donald Trump. We do well to remember that many of us who identify as evangelicals had grave reservations about candidate Trump. Many of us said that, out of the 17 Republican candidates, he was our last choice.

Some of us (including me) frequently spoke and wrote against him during the primaries. (See, for example, this video I posted on Nov. 27, 2015, titled, "Why Evangelical Christians Should Have a Problem with Donald Trump." Because it was my position at the time, for the sake of integrity and honesty, we have kept it online even though I ultimately voted for Trump.)

Yet the major reason we voted for Trump in large numbers was because we hoped he would keep his word about Supreme Court nominees. And we voted for him because we were voting against Hillary, which leads us to reflect on this stark reality: Had Hillary been elected, President Obama would probably have been able to get his pick for the Court, namely, Merrick Garland, while Hillary would be making her first pick now.

So, you would have Garland instead of Neil Gorsuch, plus a presumably, far-left pick rather than Brett Kavanaugh. And maybe Justice Ginsburg would be more ready to step down, allowing for a young liberal to take her place, and giving Democrats a third pick already.

The implications for America's future—at least for the next 30-40 years—are massive.

To date, Donald Trump has not disappointed us in his picks, for either Supreme Court or the many other federal appointees. This is a major reason, if not the major reason, many of us voted for him.

2) President Trump is not the puppet of the religious right. In the days leading up to the president's Supreme Court nominee, this was a common charge. Yet it is one that can easily be dismissed.

Simply stated, if anything is clear about Trump, it is that he is his own man. No one can bridle him or rein him in, to the consternation of many. And he has sometimes embarrassed conservative Christian leaders with his rhetoric and temperament. That is not the behavior of a puppet.

I'm close to faith leaders who got close to Donald Trump during his candidacy, and some of them are part of his faith advisory council. While he listens to them with respect, to a person, they would tell you that he makes his decisions independently.

As one of the leaders told me face to face when I asked about Trump tempering his tweets, "It's unlikely that a 70-year-old man is going to change."

What is remarkable, though, is that he seems to have embraced the convictions of Christian conservatives when it comes to crucial issues such as abortion, religious liberties and the meaning of marriage. It is a providential, quite unexpected, and apparently sovereign union, one that goes beyond Trump's formula for victory. (In other words, it's more than just good campaign strategy.) Somehow, these issues became important to him, because of which he became close to many evangelical believers, who then earned his respect and loyalty. Again, this is a far cry from being a puppet.

3) President Obama nominated two far-left justices to the Supreme Court. What's so terrible about President Trump nominating two solid conservatives to the Court? Comedian Dennis Miller tweeted two days ago, "Just to keep things in perspective, or not, Trump could nominate either Amy Coney Barrett or Vladimir Putin tomorrow and the headlines would be exactly the same. #DennisMillerOption." Exactly so.

The one thing that was certain was this: Whoever Trump nominated, there would be an outcry from the left. The sky is falling! This is the end of the world! We must go to the streets and protest!

Fox News even played video clips Monday night of college students weighing in on the Trump nominee. They were interviewed hours (if not days) before Trump's announcement was made, but already, they were denouncing the pick as racist. One student suggested the nominee wear white robes rather than black robes.

Yet President Obama was able to make his picks, and when it comes to their ideological base, you could easily argue that they are much farther to the left than Gorsuch and Kavanaugh are to the right.

For example, in September, 2014, Justice Elena Kagan "officiated for the first time at a same-sex wedding, a Maryland ceremony for her former law clerk and his husband." Yet the Court did not rule to redefine marriage until one year later.

Already in 2010, CBS News ran this headline: "EXCLUSIVE: Documents Show Kagan's Liberal Opinion on Social Issues." Her decisions to date have been consistently to the left, sometimes in extreme form.

As for Justice Sonia Sotomayor (to give just one example), when it came to the Hobby Lobby decision, she claimed that it compromised "hundreds of Wheaton [University's] employees and students of their legal entitlement to contraceptive coverage."

Yet I don't recall the same level of outcry against Obama's nominees when compared to Trump's. Was there very strong concern about Obama's nominees from those on the right? Absolutely. Was there the same kind of hysteria? Not to my memory.

The real issue is that everyone knows that one of the greatest sacred cows of the left (and of the Democratic party) is now at risk, namely, Roe v. Wade. Even the possibility of this landmark, horrific ruling being threatened sends shock waves into the liberal world, and the reaction will no doubt be intense. The reaction will go far beyond words. It will turn to acts of violence.

My hope is that the extreme, shrill and over-the-top reaction of the left will turn moderates away.

For the moment, though, expect things to get ugly. Really ugly. May cooler heads prevail.

Republican Texas Sen. Ted Cruz will report raising more than $4 million in the last three months, according to a Washington Examiner report on Tuesday.

Cruz's Democratic challenger, U.S. Rep. Beto O'Rourke (D-El Paso), has not yet announced his fundraising for last quarter. Quarterly reports are due on Sunday and aren't available yet for either candidate.

In the first quarter of 2018, Cruz posted $3.2 million in donations, far less than O'Rourke's $6.7 million haul — the most raised in a single quarter by any Texan running for the U.S. Senate in at least three decades.

U.S. Sen. John Cornyn (R-TX) was at the White House Monday night when President Donald Trump announced he'd selected D.C. Circuit Court Judge Brett Kavanaugh as his nominee to the Supreme Court.

The senior senator from Texas spoke with NBC 5 Tuesday about the president's pick.

"Well it is really not surprising that the president would choose someone of the caliber of Judge Kavanaugh based on the Gorsuch nomination, and the president, in fact, ran for office having said that this was a pool of potential nominees to choose from. I think one reason why President Trump was elected is because people wanted to see him nominate people like Neil Gorsuch and Brett Kavanaugh to the Supreme Court," Cornyn said.

Some senators are hoping to get Kavanaugh's confirmation done by the fall.

"We will plow into it. We are ready to roll up our sleeves and get to work, but I don't think it would be a good idea to just drag this out, for the sake of extending it beyond the midterm elections," Cornyn added.

Two years ago, when President Barack Obama nominated Judge Merrick Garland to the Supreme Court, the nomination did not come to the floor with Senate Majority Leader Mitch McConnell pointing to 2018 being an election year.

There are midterm elections in November.

"Well, Elana Kagan is a good example. There is a difference between a presidential election and a congressional midterm election. Elana Kagan, I think it was 2010, was confirmed during a run up to a midterm congressional election, and so that is exactly what we are doing here," Cornyn said.

But where did we get the expression "to hell in a handbasket"? The origin of this phrase is murky, although it may have to do with the fact that handbaskets are easily carried. You probably know about the Rust Belt and the Bible Belt, but have you heard of the Smile Belt? How about the Biscuit Belt or the Pine Belt? The word belt is sometimes used to denote a loosely defined geographical area.

An Omaha, Nebraska, woman reports that a customer emailed her after a sales presentation to correct her pronunciation of the word via, meaning "through" or "by means of." In this case, the customer wasn't right: via can be pronounced either VEE-ah or VYE-uh. There's a slight preference for the former if you're talking about a road, and the latter in the case of the method.

A Huntsville, Alabama, man finds that his younger co-workers have never heard the phrase going to hell in a handbasket. Although the expression is at least as old as the U.S. Civil War, its etymology remains unclear. In the early 1960s, the humorist H. Allen Smith helped popularize the phrase with his book To Hell in a Handbasket, a dubious title for an autobiography.

If you're tired of telling youngsters to hurry up and close the refrigerator door, try this admonishing them with this phrase or one like it: Stop letting the penguins out!

A listener in Quebec, Canada, wonders about the origin of to fly off the handle, meaning "to lose control." It refers to the image of the head of an axe becoming loose and flying through the air.

The word pizza derives from an Italian term at least a thousand years old for a type of savory flat bread. The type of pie we now think of as pizza, with tomato sauce, has been around since the 15th century, when tomatoes were first brought back to Europe from the New World.

During a full solar eclipse, you can see the sun's glowing outer atmosphere called the corona. In Latin, the term corona, means "crown" or "garland." It's the source of coronation, as well as the coronary arteries that wreathe the human heart, and coroner, originally an officer of the Crown. Another eclipse-related term, penumbra, comes from Latin for "almost shadow," and refers to the shadow cast by the earth or moon over an area where a partial eclipse is visible. A related word, umbrage, means "a sense of offense" or "resentment."

To be tuckered out, or "tired," is thought to derive from the image of a starved quadruped that's so skinny and worn out that it has a "tucked" appearance just behind the ribs. It may have been influenced by an older verb tuck, meaning "to chastise."

A lecturer in business law in St. Cloud, Minnesota, is astonished to discover his students are unfamiliar with throw the baby out with the bathwater, meaning "to accidentally get rid of the good while getting rid of the bad." A middle school teacher in Flower Mound, Texas, responds to students' protests and excuses with If all our butts were candied nuts, we'd all be fat for Christmas. It's probably a variation of a phrase popularized by former Dallas Cowboys star turned sports commentator Dandy Don Meredith, who often observed, If 'ifs' and 'buts' were candy and nuts, wouldn't it be a merry Christmas?" This isn’t surprising but still:

Within minutes of President Donald Trump announcing Brett Kavanaugh as his Supreme Court nominee, a conservative judicial advocacy group unveiled a $1.4 million ad buy aimed at pressuring four vulnerable Democrats to support him.

The Judicial Crisis Network announced its “Confirm Kavanaugh” campaign of cable and digital ads in Alabama, Indiana, North Dakota and West Virginia. These all happen to be Republican-majority states with a Democratic senator: Doug Jones (Ala.), Joe Donnelly (Ind.), Heidi Heitkamp (N.D.) and Joe Manchin (W.Va.).

“Judge Kavanaugh is a home run,” said JCN’s chief counsel and policy director, Carrie Severino. “Like Gorsuch, Judge Kavanaugh is brilliant, fair and independent, committed to following the law and honoring the Constitution.”

Three of those four senators are up for re-election in November (Jones is not), and all are in precarious positions when it comes to voting on Trump’s Supreme Court pick. While many of their Democratic colleagues are already vowing to oppose Kavanaugh, these senators put out far more tepid statements.

Now there is a sign that these Democrats may not easily rubber stamp this Trump Supreme Court nominee:

A trio of red-state Democratic senators have turned down invitations to attend President Trump's announcement of his nominee to replace retiring Supreme Court Justice Anthony Kennedy.

Democratic Sens. Joe Donnelly (Ind.), Joe Manchin (W.Va.) and Heidi Heitkamp (N.D.) were invited but declined to attend the event at the White House at 9 p.m. Monday.

Donnelly said in a statement that he declined so that his first meeting with Trump's pick will be "in a setting where we can discuss his or her experience and perspectives."

"I appreciate the President inviting me to attend tonight's announcement at the WH. I look forward to meeting the nominee in a setting where we can discuss his or her experience, judicial philosophy & perspective on access to healthcare for WVians with pre-existing conditions," Manchin said in a separate tweet.

It’s understandable that these Democrats are in some very tough positions regarding the upcoming Supreme Court vote:

Democratic senators running for re-election in Trump Country face an agonizing choice over President Trump’s coming Supreme Court nominee: Vote to confirm the pick and risk demoralizing Democratic voters ahead of the midterm elections, or stick with the party and possibly sacrifice their own seats — and any chance at a Democratic majority in 2019.

The actions of a handful of Senate Democrats struggling to hold their seats in red states where Mr. Trump remains popular — notably Heidi Heitkamp of North Dakota, Joe Donnelly of Indiana and Joe Manchin III of West Virginia — will have broad implications for the party at a critical political juncture.

A decision by one or all of them to try to bolster their standing with Republican-leaning voters in their states by backing the president’s nominee would undermine Democratic leaders as they try to sustain party unity. And if their votes put the president’s choice on the court, it could hasten the move to the left by the party’s aggressive activist core, while intensifying the clamor for new, more confrontational leadership.

But if they hold together on a “no” vote, those senators could not only surrender their own seats, but by expanding the Republican majority, they could also narrow the path of Democrats to a Senate majority for years to come by ceding those states to Republicans.

But Democratic Strategist, Paul Begala, makes some great points on why these Democratic Senators must vote no on Kavanaugh:

 Kavanaugh is a total swamp creature. Rather than choosing a judge from Indiana or Pennsylvania or other heartland states, President Trump went with a Beltway Boy, born and bred. Kavanaugh got to where he is the Washington way: by loyally serving powerful figures in the party -- first special prosecutor Ken Starr in his pursuit of Bill Clinton, then as a legal hit man in the Constitutional drive-by shooting of Bush v. Gore. And then, finally, as an aide to Pres. George W. Bush in the White House. Bush rewarded Kavanaugh's service by placing him on the US Court of Appeals for the D.C. Circuit, where he has consistently backed presidential power against the little guy or gal. Kavanaugh is the kind of guy who sucks up and spits down -- the epitome of a Beltway swamp creature. Nobody who rides a John Deere tractor all day will be able to relate to Beltway Brett.

 No one ever got beat for opposing a Supreme Court nominee. When President Obama nominated moderate Judge Merrick Garland to replace the late Justice Antonin Scalia, Senate Judiciary Committee chairman Charles Grassley refused to even hold a hearing. Despite the fact that Obama carried Grassley's state by six percent, Grassley refused to budge. It was a shocking breach, a dereliction of duty to refuse to even hold a hearing, much less a vote. After that unprecedented partisan obstruction, Grassley cruised to re-election. Other Republican senators from Obama states did the same, from Marco Rubio of Florida to Pat Toomey of Pennsylvania to Ron Johnson of Wisconsin.

 A "Yes" vote will demoralize Democrats. From the wealthiest donors to the most eager grassroots activist, Democrats are solidly united against allowing President Trump to swing the Court to the right. Any Democrat who votes to do so may find her/his fundraising dry up and his/her volunteers walk away. Mid-terms are about enthusiasm. Right now, the Democrats have it. Voting for Kavanaugh would be a total buzzkill.

 This fight will be about a woman's right to choose and health care. Senior Democratic sources have told me they plan to frame the fight around these two issues. Why abortion rights and health care? First, because both Roe v. Wade and the Affordable Care Act were upheld by 5-4 votes with Justice Kennedy providing the crucial vote. Second, they are issues that unite Democrats while appealing to Independents and even Republicans. According to a Kaiser Family Foundation poll, 81% of Democrats want to preserve Roe -- no surprise there. A striking 73% of Independents want to keep Roe, and even 43% of Republicans do. Similarly, the Trump Administration's efforts to undermine key patient protections of the Affordable Care Act, like the ban on discriminating against people with pre-existing conditions, is wildly unpopular. Perhaps that's why Democratic Senator Joe Manchin of West Virginia is running on it, even though Pres. Trump won his state by an eye-popping margin of 42 percentage points.

 Voting yes won't stop Trump from slamming you. Rather than courting red-state Democrats, President Trump has been slamming them. A few days ago, Trump traveled to Montana, where he attacked Democratic Senator Jon Tester. He did so despite the fact that he might need Tester's vote for his Supreme Court nominee. It is inconceivable that Trump will stand down if he receives Democratic support for the Court. He's going to attack Democrats no matter what.
 If you don't stand for something you'll fall for anything. If President Trump is able to replace Justice Kennedy with a Trumpian Republican, women's rights, gay rights, voting rights, the right to use contraceptives -- so much of modern life -- could be upended. Standing for principle, not caving to a bully, earns the respect of voters. Far better to be what Mark Shields calls "a conviction politician" rather than just another Washington windsock.

And Senate Minority Leader Chuck Schumer (D. NY) is warning his fellow Senate Democrats that a vote for Trump’s Supreme Court nominee is going to cost these Democrats their seats. By the way, here’s an article from The Intercept I fully agree with:

FOR DEMOCRATS TO put up a united opposition, Schumer would have to corral Sens. Joe Donnelly of Indiana, Joe Manchin of West Virginia, Jon Tester of Montana, Heidi Heitkamp of North Dakota, and Claire McCaskill of Missouri, all of whom face reelection in November in states won by Trump, and are accustomed to having free reign. Heitkamp, Donnelly and Manchin all voted to confirm Gorsuch.

Whipping those Senate votes into line will require Schumer to push his colleagues in ways he never has before. “Chuck has spent his career trying to make everyone of his colleagues happy, and telling them what they want to hear,” said one Democratic senator, speaking anonymously so as not to anger the party’s Senate leader. “There’s no sense of leadership. It just feel as if everyone is in a big tent, just staying where they are, doing whatever they feel is in their best interests.”

Recent confirmation fights have not been impressive displays of united opposition. Six Democrats joined 48 Republicans to confirm Gina Haspel as CIA Director, despite her role in advocating for and overseeing torture at the CIA, as well as her refusal to declassify or otherwise share documents related to her record. Seven Democratic senators similarly voted to confirm Mike Pompeo, Trump’s hawkish pick for secretary of state after he fired Rex Tillerson from the job.

Pressure will be on Collins and Murkowski only as long as Democrats stay united either in opposition to or at least not in support of Trump’s pick, producing something of a staring contest between the two sides. Given the one-vote margin, the minute that a red-state Democrat signals support for Kavanaugh, a decision by Collins or Murkowski becomes less important. Both Republicans and Democrats, though, can make the intuitive-sounding argument that it is wise to study a nominee, read what they’ve written, meet with them personally, and see how they do in confirmation hearings before announcing a decision.

After all, that’s precisely what Democrats vainly requested Senate Republicans do with Garland: just give him a chance.

Activists have suggested to Democratic leaders that the party walk out of the committee hearing in protest, or refuse to show up. Neither tactic could on its own block Kavanaugh, but it would put a spotlight on how radical the nominee and dire the situation is. Given the extremism of the nominee, argue the activists, the process can’t be normalized.

The party’s leadership may have decided to fight Kavanugh’s nomination, but what that will look like in practice is uncertain. A spokesperson for Schumer declined to preview what such a battle might look like. Privately, Schumer’s aides have cautioned other Democrats that there is no secret weapon a party in the minority can pull out. Schumer’s aides have warned that if senators attempt to deny a quorum on the Senate floor, rules would allow Republicans to pass legislation by unanimous consent until a Democrat arrived to object.

Senate Democratic leaders are clear on at least one point. As one senior Democratic aide put it, “If we don’t put up a fight, there’s going to be hell to pay.”

We need to get out ahead of this fight now and we do that by being loud and putting pressure on these Senate Democrats. I understand they are facing severe pressure but we need to let them know that if they vote no, we will have their backs and fight like hell to get them re-elected. If you live in Alabama, Indiana, North Dakota and West Virginia or have friends and family in these states, spread the word and tell these Democratic Senators to vote no on Kavanugh’s nomination:

Nella fredda e piovosa Seattle iniziano a incastrarsi le varie dinamiche che guideranno il tutto in un esito altamente potente, come abbiamo appreso nel decimo episodio della terza stagione di Colony. Il titolo, "Sea Spray", vi rimanderà sicuramente indietro con la mente al secondo episodio della stagione, dove avevamo visto Broussard leggerla nei documenti da lui ricomposti a Los Angeles, che ora assume una nuova connotazione anche grazie alla rivelazione fatta da Snyder in "The Big Empty". Diretto da Lin Oeding (Chicago P.D.) e scritto da Mike Ostrowski (Puzzle Man), l'episodio rivede Will, Katie e Broussard insieme per uno scopo, mentre Snyder si prepara a colpire Kynes alle spalle.


-Armarsi: L'episodio si apre in una palestra, dove vediamo uno dei bodyguard di Kynes allenarsi in una palestra, con le note di Disposable Heroes dei Metallica (brano non scelto a caso). Durante la pausa, parla con un altro tizio, che gli dice che ha intenzione di svuotare una certa armeria in città. Il bodyguard sembra interessato alla cosa, ma allo stesso tempo dice al suo amico di aspettare il momento per fare la mossa giusta e che grazie al suo lavoro a contatto con Kynes, sta raccogliendo molte informazioni che possono usare. L'altro afferma che avranno bisogno di armi in ogni caso e così lui promette che indagherà per vedere se ne vale la pena. Alla fine torna nell'ufficio di Kynes e quando lui entra, lo informa che qualcuno vuole colpire l'armeria e che bisogna metterla al sicuro. Kynes sottolinea il fatto che il suo gruppo ha bisogno di fare qualcosa e che presto arriverà il momento che attendeva.


-Bisogno di normalità: Will sta preparando la colazione, cercando di fare del suo meglio per condurre una vita normale. Bram entra in cucina e lui gli chiede se ha fame. Il ragazzo gli chiede cosa stia facendo e Will dice che sta preparando la colazione, lasciando Bram abbastanza perplesso. Will gli spiega che ha commesso un terribile errore nel coinvolgerlo in questa situazione e gli chiede scusa. Lui non capisce perchè suo padre lo ritenga un errore e Will gli dice che capisce quanto sia stato difficile l'ultimo anno e che desidera soltanto che lui abbia una vita normale. Il ragazzo gli dice che lui dovrebbe essere un padre normale, andandosene. Will lo chiama, ma lui non risponde, dicendogli di guardare i fornelli e lasciando suo padre piuttosto deluso.


-Uomo di fiducia: Snyder fa' entrare il tenente Garland nella sua stanza (notare la sua cura nel guardare chi ci fosse dietro la porta) e gli da' il benvenuto a Seattle. Il tenente si lamenta per la pioggia e la noia che prova in questa città e Snyder gli promette che presto dovrà uccidere qualcuno, raccontandogli del suo incontro con Will e Broussard e del suo rapimento. Lui gli chiede perchè sia ancora vivo e a dire di Snyder si è trattata di empatia, affermando che gli ha detto delle bugie finchè gli uomini di Kynes non hanno cominciato a cercarlo e che gli hanno mostrato un oggetto che hanno ottenuto da qualcuno vicino a Kynes, un oggetto di cui lui non ha fatto rapporto, come loro non riferiranno della presenza ribelle in città. I due escono dall'albergo e gli uomini di Kynes fermano Snyder, dicendogli che non può muoversi senza di loro, ma lui dice che ha un suo uomo di fiducia e che, qualora Kynes lo cerchi, può usare il cellulare.


-Confrontarsi: Broussard chiede informazioni su come raggiungere Blake Island e l'uomo addetto al porto gli dice che il problema sono i droni subacquei, le cui armi possono tranciare una persona di netto, proponendo come alternativa il traghetto. Katie vede che la cucina è in disordine e rimprovera amorevolmente Will, il quale è seduto e deluso. Lei gli dice che non lo aveva mai visto come la notte prima, invitandolo a parlarne con lei e lui si confida:


"W: Ever since the camp, I've just tried to keep my feet moving. I guess I knew that if I stopped it would all catch up to me. 

 

K: And last night you finally stopped? 

 

W: What happened it'll always be a part of us. But I can't let it be everything. It's not fair to you. It's not fair to Bram or Gracie." 

Poi le dice che la sua unica ossessione era capire se Seattle fosse veramente sicura e alla fine pensava che lei avesse ragione ad essere felice del suo lavoro, ma lei gli dice che ha appena scoperto che i rifugiati stanno sparendo e che forse sono diretti alla Fabbrica. Lui le dice che sono entrati così rapidamente a Seattle perchè hanno sempre saputo che in realtà sono i Bowman, una cosa che si ricollega alla lista di cui lui fa' parte, e il motivo per cui i droni lo risparmiano sempre è che i RAP hanno un piano per quelli come lui. Katie gli chiede dove ha saputo queste cose e lui svela che è stato Snyder a dirglielo, dicendole che lui e Broussard lo hanno rapito. A lei non fa piacere che Broussard non l'abbia coinvolta, ma Will spiega che non l'ha fatto perchè pensava che era ciò che voleva. Katie dice che non possono farsi una vita se il posto non è sicuro. Will non garantisce che Snyder abbia detto la verità, mentre lei potrebbe trovare una conferma, visto che le decisioni su chi entra vengono prese dall'ufficio in cui lavora. Alla fine dice che deve andare e che è stata contenta di aver parlato.


-In debito: Amy guarda fuori dalla finestra per vedere se arriva qualcuno e Broussard le dice che se stavano arrivando per loro, sarebbe già accaduto. Lei gli chiede come possono arrivare all'isola e lui le dice che ci sta lavorando, ma hanno bisogno di aiuto. Amy capisce che Broussard si riferisce a Will e gli ricorda che se lui è dentro, lei è fuori. Broussard le dice che la questione con Snyder è conclusa, ma lei sostiene che la sua condizione non è una cosa che passa in un giorno. Broussard ne è consapevole, ma hanno bisogno della sua esperienza. Amy gli chiede di addestrarla e lui dice che ci vorrebbe troppo tempo e che persone come Will, che in azione sanno gestirsi, sono davvero poche. Lei dice che lo ha quasi fatto uccidere due volte, ma Broussard da una risposta semplice e potente:

"I owe him."

Amy non ne è convinta e che dato che lui ha sempre sostenuto di mantenere la disciplina e di tenere le emozioni fuori dal lavoro, lo invita a tenere fuori anche Will. Lui dice che non può farlo e allora lei dice che ha finito, chiedendogli di andarsene prima che lei torni dal suo turno di lavoro.


-Interesse particolare: Snyder e Garland si incontrano con un membro della pattuglia in un bar e iniziano a chiedergli da quanto si trova a Seattle. L'uomo dice che ci è venuto da quando è stata ripopolata e che il suo lavoro di addestrare reclute è estremamente noioso. Snyder pensa che il suo talento sia sprecato, ma lui dice che non ci sono crimini veri in città. I due intervengono, chiedendogli chi indagherebbe in caso di furto di un oggetto appartenente ai RAP e lui dice di non saperlo, dato che la pattuglia non si occupa di cose del genere, facendo riferimento a un gruppo di persone con dei SUV e con una certa esperienza, di cui non si dovrebbe sapere l'esistenza. Snyder gli racconta del duplice omicidio e l'uomo dice che gli era stato detto che era solo un incidente e che questi misteriosi agenti sono intenti a cercare qualcosa di specifico, che interessa particolarmente a Kynes.


-Rimediare ai propri errori: Will e Broussard osservano l'isola, discutendo sul piano per arrivarci. Broussard spiega che il battello va sul posto due volte al giorno e che vi sono due guardie e uno scanner biometrico. Will pensa che un medico potrebbe farsi strada lì dentro, pensando ad Amy. Broussard gli dice che lei è fuori per una differenza di opinioni riguardanti il suo coinvolgimento. Will non capisce che cosa possa averla provocata e pensa che lei non sia ancora in grado di affrontare certe situazioni, ma Broussard gli spiega che ha commesso molti errori finora e Will non capisce perchè è ancora qui con lui. Alla fine Broussard gli fa capire che lei non è ancora pronta, mentre lui lo è.


-Vecchi istinti: Katie va da Michelle per chiederle il file su suo marito, dicendole che è in pericolo. Michelle ne è dispiaciuta e dice di poterlo ottenere, ma piuttosto preferisce riferire delle sue violazioni. Katie pensa che sia un errore, ma lei pensa che il suo errore sia stata coinvolgerla e vuole rimediare e naturalmente Katie le ricorda che una volta fatto potrà mandare altre persone a morire. Michelle si irrita e la caccia via, ma Katie la avverte che se farà rapporto, ne risponderà anche lei di quanto fatto, visto che l'ha esposta mandandola personalmente nell'appartamento dei Winslow. Michelle dice che sta mentendo e Katie le dice che nessun altro poteva dirle dove andare all'infuori di lei e Michelle la definisce un'egoista che pensa solo alla sua famiglia. Katie le svela che non si è mai creduta tale ed è per questo che lavora lì, ma ora le cose sono cambiate e vuole soltanto assicurarsi che la sua famiglia sia al sicuro in questa colonia e minaccia di venderla se non l'aiuterà.


-Violare le regole: Snyder e Garland indagano sul luogo dove il corriere è stato ucciso e derubato e notano come l'utopia senza crimine di Seattle sia una cosa del tutto falsa. Così scoprono che il SUV proveniva dalla stessa struttura dove vi erano le coltivazioni, come anche la misteriosa pellicola mostrata da Broussard, che porta a Snyder a scherzare sul fatto che il destino li fa sempre ritrovare. Garland propone di trovare Bowman e recuperare la pellicola, cosicchè possono dare la colpa a Kynes, svelando a Snyder che Will si trova nella colonia sotto falso nome, col resto della sua famiglia. Snyder è sorpreso, visto che Will è un outlier, destinato a Blake Island, mentre Kynes lo ha lasciato entrare pur sapendo chi fosse in realtà, un errore che potrebbe costargli caro e che porta Snyder a sospettare che Will non sia l'unico ad aver avuto il medesimo trattamento.


-Una vita da dimenticare: Michelle fornisce a Katie il file su Will, il quale è contrassegnato con la sigla OCS, vale a dire outlier, un genere di persona che viene introdotto nella colonia appena identificato, a cui appartengono molte altre persone. Katie le chiede una lista di nomi e Michelle le fa promettere che sarà l'ultimo favore che le farà. In seguito Katie va a trovare Broussard, dicendogli che la sua nuova dimora è molto meglio delle fogne di Los Angeles. Lui le dice che si trasferisce e che capisce che lei è arrabbiata. Katie gli chiede il perchè e lui le risponde che avrebbe dovuto dirle che era in città e lei dice che pensava fossero amici. Broussard risponde con parole che fanno breccia in lei:

"We are friends. But maybe I'm a reminder of a life that you wanted to forget."

Lei gli chiede come vanno le cose e lui le dice che va tutto bene, chiedendole che cosa sta succedendo. Katie gli dice che lavora al centro per i rifugiati e che grazie all'accesso ai server ha scoperto che sanno chi sono davvero. Broussard chiede li abbiano fatti entrare e lei dice che ci sono molte persone come Will, chiamate outliers, e gli mostra la prima pagina della lista, composta da persone che hanno avuto esperienza militare, una cosa che sembra interessare molto Broussard.


-Per conto proprio: Snyder va ad affrontare Kynes nel suo ufficio, parlandogli di un certo incidente avvenuto nella sua colonia, trattasi di un duplice omicidio con furto. Kynes non sembra sorpreso al riguardo, affermando che gli omicidi sono piuttosto rari e Snyder gli chiede perchè non ha fatto rapporto. Lui dice che era un'anomalia e che non è tenuto a riferire tutto all'IGA e spiega che è stato rubato un campione di una membrana destinata al contenimento, di cui lui capisce ben poco. Snyder chiede di poter aiutare nel recupero, ma Kynes gli ricorda che i problemi interni li risolve con un personale qualificato e scelto da lui, con cui Snyder vorrebbe parlare, per poi far presente il problema all'IGA e Kynes gli suggerisce di parlare con i suoi bodyguard.


-Reclutamento: Will e Katie entrano in un negozio, dove incontrano il ragazzo visto in palestra nel prologo. Katie inizia a parlarci, mentre Will da' un occhiata in giro, per poi avvicinarsi a lui. Il ragazzo spaventato, fugge dal retro, ma Broussard lo sorprende e ingaggia un combattimento intenso con lui. Will lo placca e lo stende a terra, dicendogli di calmarsi e che sono amici. Broussard spera che siano tutti come lui e il ragazzo, di nome O'Neill (qualcuno ha detto Stargate?), chiede come facciano a sapere di lui. Katie dice che hanno un contatto al centro rifugiati, dove hanno saputo tutto nell'esatto momento in cui è entrato. Will e Broussard gli dicono che hanno servito sotto le armi e lui dice che era della Marina. Loro si presentano come il gruppo ribelle di Los Angeles e che hanno bisogno di nuovi elementi e Katie gli mostra la lista dove si trovano sia Will che lui, chiedendo se ne conosce qualcun'altro. O'Neill dice di no che chiede perchè mai non vengono presi di mira e Will gli spiega che i RAP (o i Mork come direbbe O'Neill) li classificano come outliers, a quanto pare come prima linea difensiva contro il loro nemico. Broussard gli offre una condivisione di informazioni e O'Neill prende la lista, dicendo che se per loro va bene, si faranno vivi.


-Una prova: Snyder si incontra con i due bodyguard di Kynes, che pensano che la vicenda dell'omicidio e del furto sia colpa di qualche psicopatico. Snyder pensava che persone di quel genere non entrassero nella colonia e chiede loro che lavoro fanno. Loro rispondono che lavorano per Kynes, reclutati dall'esterno per mansioni di sicurezza e Snyder suggerisce loro di optare per un'occupazione più remunerativa, come nell'IGA, ma loro vogliono restare a Seattle. A pranzo terminato, Garland interviene sulla scena per prendere un bicchiere da far analizzare.


-Tornare indietro: Will va a trovare Amy durante la pausa e le dice che è venuto per scusarsi. Le spiega che ha risparmiato Snyder perchè non voleva farlo davanti a Bram e Amy dice di non capire completamente perchè Broussard lavorerebbe con uno come lui. Will le racconta di quando Broussard aveva il suo team a Los Angeles, composto da gente inesperta, che è stato completamente annientato e che in questo senso è più facile lavorare con gente esperta, che sa quello che sta facendo e per cui non ci si dovrebbe sentire in colpa. Lui non la biasima per essere irritata con lui, dicendole che ha ragione sul fatto che lui non sta bene, raccontandole di Charlie. Lei gli chiede se incolpa Snyder di questo e lui dice che ormai non conta più, ma lei non è d'accordo, dicendo che ha bisogno di aiuto e che conosce delle persone che possono assisterlo. Giustamente Will risponde che la sua situazione se la gestisce da se' e le chiede di tornare con loro, perchè Broussard ha bisogno di lei. Lei pensa che a Broussard non serve nessuno, ma Will è di un'altro parere:

"You're what my wife was for him. Someone to remind him why he does it. [...] Don't walk away from something good because of me."



-Tutto comincia a quadrare: Bram torna a casa e chiede a Grace se i loro genitori hanno chiamato e lei dice di no, così la porta a cena a casa della sua fidanzata. Garland comunica a Snyder i risultati delle impronte e svela che i due bodyguard sono ex-militari, vale a dire outliers. Snyder è felice che il suo sospetto fosse fondato e ritiene che ve ne siano molti di più a piede libero, pensando che Kynes lo abbia fatto in modo intelligente, ma Garland pensa che invece questa è una base perfetta per un'insurrezione. Così Snyder propone di fare la loro mossa e vedere come Kynes risponde. Katie viene raggiunta da Will e i due si fanno una passeggiata notturna sotto la pioggia. Will le dice che ci sono guardie nel porto e Katie propone di usare Bram per guardare la zona, ma lui pensa che sia meglio non coinvolgerlo. Katie gli chiede come sta e lui dice che sta bene, ma a un tratto un uomo lo urta per poi fuggire via. Alla fine Will si ritrova un biglietto con un orario e un luogo per un incontro, chiudendo l'episodio.

VERDETTO

I tasselli iniziano ad incastrarsi in questo episodio che possiamo ritenere sicuramente un prologo perfetto per una triade finale che promette di essere molto intensa. Finalmente Will e Katie ricominciano a parlare e a lavorare per uno scopo comune, cioè la sicurezza della loro famiglia e assieme a loro si unisce Broussard, proprio come i vecchi tempi a Los Angeles, una cosa che ci fa davvero piacere. Insieme decidono di ampliare le loro fila, richiedendo l'aiuto degli outliers, il cui numero è decisamente alto, perfetto per costituire un esercito, sperando che anche Amy rimanga convinta dalle parole di Will e che torni sui suoi passi (anche se continua a non raccontarmela giusta...). Intanto Snyder inizia ad assestare il colpo definitivo per smascherare Kynes e la presenza di outliers a piede libero è decisamente un pretesto perfetto per farlo cadere dal trono, ma il capo di Seattle sembra un uomo abbastanza intelligente, aprendo a una dinamica piuttosto intensa, che sicuramente verrà sviluppata nei prossimi episodi. Mi voglio soffermare su Bram, perchè ancora una volta risulta essere l'anello debole di questa stagione, e in generale della serie. Sin dalla seconda stagione la sua impulsività non ha beneficiato alla storia in alcun modo e nemmeno la sua attuale delusione per come suo padre ha agito  nei confronti di Snyder e per come viene visto all'interno della famiglia, ennesimo esempio di come il concetto di sopravvivenza e sicurezza non entri in testa agli adolescenti, ma penso che presto ci sbatterà la testa e si spera che gli venga un bel livido. Insomma, in un episodio tipico di Colony, con le vicende che si giustappongono al livello giusto, le cose iniziano ad avere un senso e non possiamo che aspettarci momenti intensi nei prossimi tre episodi.

ABC’s “The View” co-host Joy Behar wants to know why Senate Majority Leader Mitch McConnell has not been thrown in jail for blocking former President Barack Obama’s nominee for the Supreme court. During a segment on Tuesday, the liberal panel began discussing Brett Kavanaugh, the president’s nominee to replace Justice Anthony Kennedy, who announced he will be retiring at the end of this month. Behar said that McConnell should be jailed for refusing to give Obama’s SCOTUS nominee, Merrick Garland, a hearing in 2016. As noted by The Daily Caller, Behar went off the reservation with her latest anti-Trump commentary.

          对美国未来影响最大事件昨天揭晓-任命新的最高法院大法官      Cache   Translate Page   Web Page Cache   
周一晚上美东时间9:00多一点,川普在白宫提名53岁的现任联邦上诉法院法官——布莱特·卡瓦诺(Brett Kavanaugh)为美国最高法院大法官,替代即将退休的肯尼迪(Anthony Kennedy)大法官的。
为何此事影响重大?
美国政治有左右之分,左边是自由派民主党,右边是保守派共和党。美国高院大法官由总统任命、参院批准。所以,高院大法官的左右,显示了当时的民意和总统特点,每位当职总统,一旦有机会,都会任命与自己和自己的选民一派的大法官,以期延续自己的政治影响力。
世人眼里,美国总统拥有至高无上的权力,他的决定对美国乃至世界影响深远。但如果问:美国总统能够做到的,对美国社会,特别是未来影响最大的事件是什么?那必定是最高法院大法官任命之事无疑。
美国政府“三权鼎立”,即三个分支:行政、立法、司法。其中人们对行政(白宫、国务院、各部)及立法机构(国会参众两院)比较熟悉,而对另一个分支——美国的司法系统,包括各地方法院、联邦法院和最高法院及大法官则关心不多。但他们,特别是最高法院,却是影响这个国家未来的最重要的政府分支。因为:
一、这些法官所做的裁决都是最终的,除了重新立法,或者他们本身再次做不同的裁决,谁也无法推翻,而这两件事都非常、非常困难;
二、美国司法的特点是案例法,所以最高法院对一个案例的裁决结果及其原则适用于其他一切案例;
三、这些大法官为终身制,一旦上任,生命不息,判决不止(除非自己主动退休),所以,法官的判案倾向,一直会持续到该法官离去,对美国社会影响深远。如,川普总统只有最多八年的执政时间,而卡瓦诺大法官可能会在任30年,其持续影响力大大超过川普。
川大爷有多幸运?
按照美国法律,大法官由总统提名,参院批准。批准的程序包括:司法委员会外调、听证、委员会投票、参院全体辩论、表决。只要51:49简单多数即可批准提名。
理论上讲,不是所有的美国总统都会有任命大法官的机会——美国历史上,William Harrison,Zachary Taylor,Andrew Johnson,Jimmy Carter等总统就没有得到任命任何大法官的机会。近年来的三届总统——克林顿、小布什和奥巴马因为都任期两届,分别有2个大法官的提名机会,算是比较幸运的了。然而,他们的幸运,与川爷相比,那是小巫见大巫鸟。
川大爷在任内有可能任命3~4名大法官!
第一位:此大爷还没当选,就有一个等着了:2016年2月保守派大法官斯卡利亚(Antonin Scalia)不幸突然去世,当时适逢奥巴马做总统,参院的民主党就急火火地想赶在奥巴马卸任之前送进一位自由派大法官。为此,奥巴马特地提名了一位比较温和偏中间的加兰德(Merrick Garland),以期望参院能够尽快通过,以免夜长梦多。不幸的是,此时参院共和党为多数,多数党领袖麦康纳(Mitch Mc Connell)既不麦糠,也不木讷,坚持说:按照美国政治传统,总统最后一年了不应该再任命新法官,而是等新总统(反应当时的民意)来年提名,生生压住此案,不予表决,气的白宫和参院民主党脑门儿冒青烟,没用。直到川普上台,立即提名了一位响当当的保守派大法官柯萨奇(Neil Gorsuch),参院共和党投怀送抱,加上几位来自红(共和党为主的)州的民主党参议院的支持,顺利通过。
川大爷在白宫屁股还没坐热,就任命了一位大法官,并且在维持川普禁行令和判决政府雇员工会AFSCME败诉这两个关键案例中让川普总统的白宫和保守的共和党获胜。
但这不过是川爷的开胃菜,不是说柯萨奇不重要,而是说,他替代的是另一位保守派大法官斯卡利亚,只是保住保守派的席位而已。并没有根本性地改变最高法院的左右平衡。
然而,机会马上又来了:刚刚过去的六月底,81岁的大法官肯尼迪(Anthony Kennedy)提出退休,川普任期不到一年半,就有机会任命第二位最高法院大法官!
肯尼迪大法官属于保守派里面的温和派,所以投票往往左右摇摆,多年来被称为“摇摆票(Swing Vote)”。他是里根1987年11月提名,参院88年2月初参院高票(97:0)通过的。里根之所以选择这样一位温和派,是因为当时参院民主党为多数党,温和派可以顺利通过。
所以,川普若能够提名一位比较坚定的保守派大法官来替代肯尼迪,高院的左右平衡就会被打破,所判的案例在未来几十年都会偏保守,对美国社会产生深远的影响。
这才是川普总统的大餐!
然而,川爷的大餐不止这一道,接下来可能还有两道,道道有利于保守派。
最高法院目前有三位女性:Ruth Ginsburg,Elena Kagan,Sonia Sotomayor。其中金丝波哥(Ginsburg)是一位极左自由派,女权主义老太太,93年由克林顿总统提名位大法官。她于2009年检查出凶恶的胰腺癌,幸亏发现及时,得到治疗,但毕竟身体伤了元气,加上85岁的高龄,难以胜任最高法院的工作,常常在众目睽睽下打盹。
按理说,她应该在奥巴马任期内退休,就可以让后者提名一位自由派大法官,顺理成章地继承她的yi志,维护高院自由派大法官的比例。但据说介犹太老太太有个性,认定希拉里能够赢得大选,一定要让一位女总统来提名自己的接任者(自然也是女性),功德圆满。不想川爷不够厚道,大比分击败希婆,让金老太太一脚踏空,替换她的自由派女性大法官更是没影了,可谓“三女投江”,令人唏嘘。
唏嘘归唏嘘,高院归高院,川爷高寿,也远远不及金老太太,她还能够撑几日?估计接替者又是川爷的囊中之物,失敬了!
所以川爷任命第三位大法官,估计也是板上钉钉了。
第四位呢?你还得在高院的左边寻觅:目前四个自由派大法官中的唯一男性:来自旧金山的犹太哈佛教授布吕尔(Stephen Breyer)。该老兄是94年由克林顿总统提名的,再过一个月就80岁整了(生日快乐!)。若川普连任,他能够抗到2024年?老人家若不愿意用力过猛,川爷就会任命第四位大法官,最高法院自由派和保守派法官之比,将达到2:7的黄金比例(?)。
川普有机会在其任期任命3~4为大法官,彻底重塑美国最高法院的左右力量平衡点,并保持30~50年。如此,他就成为美国历史上影响力最持续的总统。这是美国保守派选川普的最大动力,也是自由派最害怕的。
那时候,自由派估计都崩溃到上厕所开始分清男女了。
川普的幸运,还在于,美国国会参众两院共和党都是多数,为他保驾护航,可以让他的提名得到通过。里根都没有如此幸运。但川普真是幸运么?我作为基督徒,认为这是上帝对川普的拣选,对美国的祝福。
左右派法官的区别是什么?
很多人以为,美国左右法官的区别,是他们政治立场不同。这并非完全错误,但流于浅薄。
在美国,高院大法官的裁定依据,不是谁有理谁没理,谁好谁恶,而是谁更符合宪法。至少在目前,美国的左右派法官均认为宪法不应改变,而他们最大区别在于对宪法的解读:左派认为,对宪法的解读应该与时俱进(看,多符合厉害国民的想法。所以,天下左派是一家);而右派则认为应该严格遵循宪法愿意。所以,保守派法官,基本就是原意解读(literal interpretation)宪法,被称为“原文主义者”(Originalists)。
以川普“禁行令”为例:他上任之初,考虑到国土安全,防止恐袭,颁布了针对若干个以穆斯林为主的国家居民的禁止进入美国的行政令。奥巴马嫡系的第九巡回法院裁定川普违宪,理由是川普竞选中有针对穆斯林的歧视性言论,故认定行政令有破坏信仰自由嫌疑;而新近高院推翻这个结论,维持禁行令的理由就是:总统有这个权利!
显然,前者是一个道德指控;后者则是技术活儿,根据宪法及其修正案的原意,认定总统有这个权利。而这个判定与川普这个行政令本身是否正确、是否合理、是否可行,毫无关系。
卡瓦诺到底是啥人?
卡瓦诺是最初提名呼声最高的人,也是几个候选人中最资深、经验最丰富,书写判决最多的法官。但随着对他了解的深入,保守派提出几点疑虑,包括他一直成长工作在华盛顿,是沼泽的一部分,与建制派布什家过从甚密,同时对奥巴马的医改投了赞同票……不一而足。
个人认为,过虑了,卡瓦诺是空前绝后的保守派。理由如下:
1. 他在总统提名仪式上说:interpret the Constitution as it is written (按照字面的原意来解读宪法)。Duh!这一句话已经说明一切了!他不要太保守!
2. 有人认为他支持奥巴马的医改,错!他所在的华盛顿上诉法院2:1裁定奥巴马医改符合宪法(Seven-Sky v. Holder一案),卡瓦诺就是那一反对票,理由是强制购买保险危险。他同时也反对堕胎条款写入奥巴马医改。这些都是美国保守派关注的。
3. 卡瓦诺曾经在小布什总统执政期间担任过白宫律师,后被总统提名为华盛顿巡回法院法官。和布什家族关系的确很好,但这并不代表他偏袒建制派的利益。他具有高度职业素养,这个顾虑是多余的。
4. 对待同性恋等(LGBTQ)的态度,也是考察一个人保守主义成色的标准。这个方面也没有问题。2005年被提名华盛顿巡回法院时,支持他的一个组织叫做Family Research Council ,是一个基督教游说机构,认为同性恋行为对自己和社会都有害,不应该得到肯定。这样机构支持他,他的立场也就很清楚了。
卡瓦诺是天主教徒,属于the Shrine of the Most Blessed Sacrament in Washington,D.C.,并长期担任教会讲师,并在天主教慈善机构做志愿者。
在总统的提名仪式上,他提到自己是大女儿篮球队的教练(美国学生体育活动的很多教练都是业余的,主要是家长担任的),被亲切地称为“K教练(真正的K教练是赫赫有名的Duke大学篮球队教练,他的名字在美国妇孺皆知)”。他的妻子就是在白宫认识的,来自德州(保守的州),可见这是一个非常典型的美国传统家庭,卡瓦纳是典型的美国传统丈夫、父亲,这对于美国人很重要。
总之,我为这次川普总统的大法官提名点N个赞!为什么不?要知道,川普上任之初,就请保守派智库——联邦社会遗产基金the Federalist Society and Heritage Foundation 为他提供了一个25人的大法官候选人清单。里面的人都是久经考验的保守派法官,气的左媒一直诟病川普法官候选人都来自极右的特殊利益集团。瞧,左派居然也懂特殊利益集团。可惜,帮助总统的机构代表了大多数美国人的利益,而非特殊利益集团。
最后谈谈华人可能有的一个担忧:如此保守派得势,会不会破坏美国的政治平衡,造成一党独大,甚至独裁?那可不是好事!
这个担心完全是多余的,是习惯了中庸之道思维的华人之杞人忧天。
左右并非是一个平等对称的政治理念。右派要严格遵守宪法,左派则想与时共进,背离美国的传统。坚持右,就是坚持传统和宪法,这才是美国崛起的根源。也说明,美国的右派更加传统。而美国早期要比现在更加保守,换句话说,保守主义才是美国之所以是美国的关键,是美国成功的根本。这与很多华人的想当然相反,他们认为:美国之所以先进,是与时俱进、丢弃传统的结果。

What? When did this guy go full YOLO on presidential power?

A Twitter pal wonders if he’s talking about a recess appointment, as that’s the one way Obama could have constitutionally appointed Garland without a Senate vote. But that can’t be what Dershowitz means. All Republicans needed to do to block that route was hold pro forma Senate sessions, per SCOTUS’s (9-0) opinion in NLRB v. Canning. There would have been no Senate recess that O could have used to put Garland on the Court.

I think Dersh means exactly what we think he means. He wanted Obama to ignore the Constitution and install a justice without Senate consent, presumably on the theory that McConnell violated the Constitution first by refusing to give the Senate an opportunity to give its advice and consent. He even refers to Republican tactics in the clip as “unconstitutional” without saying why. For good reason: There’s no credible argument that they were or else the Obama White House would have tried suing over it. Without any provision in Article II requiring the Senate to give its advice or consent within a certain time, there’s no case that McConnell or the Senate was acting unlawfully by delaying. Implicitly, in fact, there was a timetable on the Scalia vacancy. If Hillary had won in November, the GOP would have taken up her nominee in early 2017. And voters had a golden opportunity to register their disapproval of McConnell’s tactics in the fall of 2016, the preferred constitutional route for resolving “political questions.” How’d that work out?

In other words, Dershowitz was prepared to countenance an explosive constitutional crisis that would have further expanded executive power at the expense of the legislature with nothing in the text of the document to justify his position. If Obama had taken his advice and won the ensuing court battle, the Senate’s gatekeeping power over Supreme Court appointments would have shrunk. Instead of blocking a nominee with 51 votes, they’d need 67 votes to remove the newly installed justice after he’d already joined the Court, an impossible burden in a hyperpartisan age. And then we’d face a new question. How long would a Senate delay in confirming a nominee need to be before the “advise and consent” requirement in Article II magically melted away and the president could once again appoint whomever he wanted whether the Senate approved or not? Six months? Three?

The funny thing, though, is that Obama almost certainly would have lost one way or another if he’d tried this. If he followed through and appointed Garland without Senate approval, there’s reason to believe from the Court’s lopsided Canning majority that McConnell would have won and the appointment would have been declared invalid. No Senate advice and consent, no confirmation. If Obama had merely threatened to do it, Republicans would have been so outraged that McConnell could have probably called a vote and gotten the Senate to kill Garland’s nomination outright instead of letting it linger in limbo. Which makes me think this is just Dershowitz trying to claw back some liberal cred after pissing off so many lefties with his defenses of Trump this year. He’s still a fighter for the left! Hypothetically!

In lieu of an exit question, via Newsbusters, here’s Behar wondering why a president who’s under investigation is allowed to appoint Supreme Court justices — another bad argument, but actually better than Dershowitz’s. Later she wondered if Kavanaugh might be just a “quieter version” of Jeanine Pirro. Hoo boy.

Chuck, m’boy, I don’t believe that’ll be happening. Poor guy, though. This makes twice now that he’s been hobbled by a Democrat setting a judicial precedent which seemed clever at the time, only to have it detonate later right in the party’s faces.

In fairness to him, though, this isn’t the most desperate thing he’s done in his “throw everything at the wall and see what sticks” attempt to block the nominee.

This is from his floor speech yesterday a few hours before Kavanaugh was named. Turns out he’s concluded that the Ginsburg standard is outdated coincidentally right at the moment that Trump is poised to push the Court further right.

First, we have ample examples from the past several years of judges who have sworn in their confirmation hearings to respect precedent, and then reverse their stand once on the court. For example, in his confirmation hearings, then-Judge Gorsuch said that, quote,– “Precedent is like our shared family history of judges. It deserves our respect.” Two weeks ago, now-Justice Gorsuch voted to overturn 41 years of precedent in the Janus decision, relying on flimsy and fabricated legal theory. It was so flimsy, in fact, that Justice Kagan wrote in dissent that the majority overruled precedent, “for not an exceptional or special reason, but because it never liked the decision…subverting all known principles of stare decisis.”…

And there’s a second reason, maybe even more important than the principle of “I’ll follow settled law” never works, and that’s President Trump. We already know that President Trump’s nominee will be prepared to overturn the precedents of Roe v. Wade and NFIB v. Sebelius. We know that because President Trump has said so. When the president has a litmus test for his nominees, and only chooses from a pre-approved list of nominees designed to satisfy that litmus test, it is certainly not enough for a judge to prove his or her moderation by invoking stare decisis…

Considering the ample evidence that President Trump will only select a nominee who will undermine protections for Americans with pre-existing conditions, give greater weight to corporate interests than the interests of our citizens, no matter what precedent says, and vote to overturn Roe v. Wade – the next nominee has an obligation – a serious and solemn obligation – to share their personal views on these legal issues, no matter whom President Trump selects tonight.

It’s interesting which precedents he does and doesn’t focus on during his solemn disquisition in defense of stare decisis. As chance would have it, Gorsuch also voted within the last few weeks to overturn a far more famous ruling than Janus. Schumer doesn’t mention that one because doing so would force him to acknowledge that certain precedents do deserve to be binned, however belatedly. Stare decisis is a guideline but never a rule, he’d have to admit. Which leaves him nowhere on precedent as a shield for Roe.

His underlying point is true enough, though. The stare decisis tapdance that nominees have engaged in since Ginsburg’s confirmation hearing 25 years ago is a transparent charade. But it’s also a necessary charade. Semi-plausible deniability about each nominee’s ideological views is the only way to retain an element of collegiality and efficiency in this toxic, rancid process. We’re never going back to the days of 97-0 votes based purely on whether the nominee had the legal acumen to serve on the Court. (If we did, Kavanaugh would be confirmed unanimously.) The Ginsburg standard, though, lets us return to a simulacrum of that, permitting an obviously qualified candidate to be confirmed 55-45, say, in exchange for not providing any soundbites about Roe etc. that might make a yes vote even harder politically for senators.

If we didn’t play this game, we’d end up playing a slightly different one. Every nominee would insist during his or her hearing that they agree with all Supreme Court precedents, tout court. And then, once they reach the bench, they’d rule how they like anyway and insist that their minds had since been changed about certain past cases based on things they’ve recently read. Every man or woman has a right to change their mind, after all. Which game does Schumer want to play, the Ginsburg one or that one?

Watch a bit from today’s floor speech below, in which he backs off somewhat from the demand that Kavanaugh reveal his views at the hearing. He knows that won’t happen. Fortunately for him, Kavanaugh was the shortlister with the longest paper trail; there may be a clue about his views on Roe somewhere in the mountain of documents Democrats will be reviewing that can be used to make Collins and Murkowski squirm. One question I’d like Schumer to answer candidly is what his battle plan is if, hypothetically, he succeeds in flipping the centrist Republicans and borking Kavanaugh. Presumably he imagines some knock-on effect from that in the midterms for Democrats, in which defeating Trump’s nominee ends up flipping the Senate and then POTUS is forced to nominate someone more moderate next year. In reality, Republican voters’ anger at red-state Dems if Kavanaugh is borked most likely means a redder Senate. And if the Senate is more Republican next year, Trump will pay Democrats back for Kavanaugh by trying to ram Barrett or some other hardcore culture warrior down their throats. It’s really not enough for Schumer to defeat the current nominee, that is. He needs to defeat him on the specific ground of abortion and spook Trump in doing so, such that POTUS will lose his nerve on nominating a devout pro-lifer as his next nominee.

At no time since the appointment of Chief Justice Warren Burger in 1969 has there been a clear liberal majority of the Supreme Court. Yes, the Court has produced liberal decisions in various areas during the ensuing period, but always by picking up one or more conservative justices, often with the consequence that even liberal results were justified in conservative terms.

Justice Kennedy's majority opinion in Obergefell v. Hodges is a good example. While finding a right to same-sex marriage, it extols the virtues of marriage in a way that sounds in traditional conservatism, even to the point of insulting people who choose not to marry: "Marriage responds to the universal fear that a lonely person might call out only to find no one there." Lines like that are the price that we liberals grew accustomed to paying in order to secure liberal results based on conservative rationales.

Accordingly, in anticipation of a Democratic victory in the 2016 presidential election, some liberals  began to imagine an activist liberal agenda for the Supreme Court. They began to imagine, as Mark Tushnet put it in the title of a blog post on Balkinization in May 2016, "abandoning defensive crouch liberal constitutionalism." The election of Donald Trump, the Republicans' success in first denying to Merrick Garland and then granting to Neil Gorsuch the seat that became vacant when Justice Scalia died, and the anticipated confirmation of Brett Kavanaugh to take Anthony Kennedy's seat all mean that for the short-to-medium term, liberals will need to continue to practice defensive crouch liberal constitutionalism.

Fortunately, we have a half century of experience on which to draw. Unfortunately, the Court may turn so far to the right that there is little room for effective advocacy of liberal results using conservative arguments. That's not to say there will be only failures, however. In this post, I want to begin exploring ways in which liberals might try to defend what we value in the coming era of Supreme Court extreme conservatism. I've put "Part 1" in the title of today's post because I plan to explore defensive crouch liberal constitutionalism further in at least one future post.

I begin with a caveat and a disclaimer. The caveat is that defensive crouch liberal constitutionalism is a specialized tool. In suggesting that it may have some efficacy in the context of Supreme Court adjudication, I do not mean to propose that liberals in general should go into a defensive crouch. In the zone of politics, the path back from the wilderness may well be one of boldness rather than caution.

I focus on the making of arguments for a group of very conservative men (the SCOTUS majority) because I am a constitutional scholar, so this is the subject I know the most about. However, I do not mean to suggest that SCOTUS-focused defensive crouch liberal constitutionalism should be the main site of liberal activism in the coming decades. I view its prospects as modest, much as I view the prospects of litigation under state constitutions, which I discuss in a new Verdict column today.

So much for the caveat. Now the disclaimer: Defensive crouch liberal constitutionalism is not a trick or a ruse. It is not an effort to fool conservative justices into voting for liberal results that they actually disfavor. The justices and their clerks are much too smart for that to work. Rather, the basic idea--and it is one with which every sophisticated liberal cause lawyer now working is familiar--is to make a genuine appeal to conservative justices based on conservative values. It can sometimes work because, as Charles Fried's recent essay on the Harvard Law Review blog underscores, much of what we now code as "liberal" can also be understood to be conservative, especially when one counts adherence to precedent as manifesting Burkean conservatism (as Fried does).

Where else can liberals turn conservative arguments to our own ends? I have been, and continue to be, highly skeptical of the arguments for constitutional originalism, but I acknowledge that originalist arguments can be made for liberal no less than conservative results. That is especially true of public-meaning originalism as opposed to expected-applications originalism. Although I have argued that conservative judges and justices frequently use originalist rhetoric to cloak decisions reached on ideological grounds, I do not think that they typically do so consciously. That is, I don't think a conservative justice asks himself "I'd like to vote for the government here, so how can I concoct an originalist argument for that result?" Rather, he tries in what he regards as good faith to read the constitutional text and historical record, but because those sources are typically not decisive, he is influenced by his priors. Still, good faith at the conscious level creates an opening for originalist arguments for liberal results.

A nice example of receptivity to such arguments can be found in Justice Gorsuch's dissent in Carpenter v. United States, the Fourth Amendment case the Court decided near the end of the just-concluded Term. The majority held that in gathering cell phone tower data on a suspect from his service provider without first obtaining a warrant based on probable cause, the government violated the suspect's Fourth Amendment right against unreasonable searches. Although Justice Gorsuch dissented from that holding, his line of argument--questioning the so-called third-party doctrine--holds promise. That doctrine says that handing something over to a third party assumes the risk that the third party will give it to the government. Justice Gorsuch's Carpenter dissent thoughtfully explains why this is a problematic move.

To be sure, like Professor Colb, I find the willingness of Justice Gorsuch and some of his colleagues to abandon privacy in favor of a property rationale potentially alarming because of what it may portend in other contexts. But I also found much with which I agreed in Justice Gorsuch's Carpenter dissent. Before a liberal Supreme Court, lawyers might choose to articulate a robust view of privacy and the values it serves. That won't work with at least a few of the current justices, but based on Justice Gorsuch's Carpenter dissent, it should be possible to protect much of what deserves to be protected by appealing to his property-focused understanding of the original meaning of the Fourth Amendment.

Listen, you can hear it. Bickering. Constant bickering. Nonstop. Worse than a squeaky wheel. The conservative pundits say that we need a conservative Supreme Court Justice, that President Trump's legacy depends on it, that our country will crumble without a conservative Justice. Meanwhile, the liberal pundits say that Trump is Hitler and he plans to resurrect Judas specifically for the role, or something like that.

Rich Noyes, a senior editor at Media Research Center noted:

As with all recent Republican nominees, reporters will repeatedly label them as "conservative," which will nicely reinforce the Democrats' strategy to paint them as outside "the mainstream."

One study found that "Roberts, Alito and Gorsuch were called "conservative" 36 times on ABC, CBS and NBC within 24 hours of their nomination, while Sotomayor, Kagan and Garland were only labeled "liberal" seven times total using the same parameters."

A conservative legacy, that's what matters.

Even in a mostly positive article about Trump's pick, Judge Brett Kavanaugh, USA Today couldn't resist the urge to slip the word "conservative" into the title. The partisan jockeying is just as bad on the Right, and, more important, it's effect is just as misguided. In evaluating Supreme Court Justice candidates, many right-leaning sources have eschewed any qualities short of conservative. A conservative legacy, that's what matters.

What everyone seems to be missing is that we shouldn't want a liberal or conservative, we should want a constitutionalist and someone who understands the Bill of Rights.

As the Winter Gardens Blackpool today celebrates its 140th anniversary, plans have been unveiled revealing a partnership between global producers Selladoor Worldwide and operators Blackpool Entertainment Company to bring a fresh lease of creative life to the historic Pavilion Theatre, based within the grade 2* listed venue. During this joint venture, Selladoor Worldwide will lead on programing the space with both produced and received work, whilst Winter Gardens Blackpool will focus on the renovations to save and restore the theatre back to its full former glory for future generations to enjoy.

Selladoor Worldwide are one of the UK's leading Regional Theatre Producers, producing 8 productions in 2017 that performed outside of the country's capital, with a total of 9 productions set to do so throughout 2018. From the very outset, the company's aim has been to make accessible work for all audiences, which has therefore invigorated Selladoor Worldwide to create a base in the North of England, to ensure full coverage across the country.

Selladoor's Northern Powerhouse will be based out of the Pavilion Theatre in Blackpool, the oldest venue in the Winter Gardens complex. The venue was part of the original 1878 build and was an entertainment hub, catering to large crowds at the turn of the 20th century. Although a stunning and richly decorated building, with opulent interior designs, this building is no longer used as a theatre, and is currently listed as 'at risk' by the Theatres Trust.

Selladoor Worldwide are therefore extremely proud to partner with Blackpool Winter Gardens to protect and revitalise this venue to once again be an important entertainment hub for the town of Blackpool and surrounding northern cities such as Manchester and Liverpool. The theatre space will be used for event theatre as well as non-conventional and immersive theatre, helping to diversify the artistic programming and cultural experiences available to the residents of Blackpool. Blackpool Winter Gardens first opened to the public on 11 July 1878, with Lavish ceremony attended by the Lord Mayor of London and Mayors and Mayoresses from 68 towns throughout the country.

The Winter Gardens has entertained hordes of crowds in Blackpool in its collection of theatre, ballrooms, exhibition halls and public spaces.

The major reason we voted for Trump in large numbers was because we hoped he would keep his word about Supreme Court nominees. And we voted for him because we were voting against Hillary, which leads us to reflect on this stark reality: Had Hillary been elected, President Obama would probably have been able to get his pick for the Court, namely, Merrick Garland, while Hillary would be making her first pick now. The implications for America's future – at least for the next 30-40 years – are massive.

A former student of Harvard on Wednesday urged his university to withdraw the Harvard alumni status of Jayant Sinha, Minister of State for Civil Aviation, since he had felicitated those convicted of lynching a man to death.

Prateek Kanwal, who studied public policy at the US-based varsity, wrote a letter to its President, mentioning about recent mob attacks in India on "members of minority communities, Dalits, tribals and women to spread fear and to polarise the electorate for political gain."

Kanwal went on to write, "Under the circumstances, you may consider issuing a statement strongly condemning his (Jayant Sinha) actions, to mitigate any further damage to the Harvard brand in India. We also ask that you withdraw his alumni status on account of his inappropriate behaviour that has brought disrespect to the name of your hallowed institution."

On July 6, a picture went viral in which Sinha was seen felicitating eight convicts, who came out on bail, of lynching a meat trader in Jharkhand state last year.

The picture created a political furore with the opposition mounting attack on Sinha's Bharatiya Janata Party.

Congress president Rahul Gandhi on Tuesday supported a petition against Sinha, seeking removal of his Harvard alumni status. The petition was launched by Prateek Kanwal.

"If the sight of a highly educated MP and central minister, Jayant Sinha, garlanding and honouring criminals convicted of lynching an innocent man fills you with disgust, click on the link and support this petition," Gandhi wrote on Twitter.

After much prime time buildup, Trump announced Monday night his nomination of U.S. Court of Appeals Judge Brett Kavanaugh to the nation’s highest court to succeed the retiring Presiding Justice Anthony Kennedy.

Kavanaugh’s nomination comes about 18 months after Trump’s successful nomination of former Tenth U.S. Circuit Court of Appeals Judge Neil M. Gorsuch of Denver to the U.S. Supreme Court to succeed the late Presiding Justice Antonin Scalia.

The similarities between Republican President Donald Trump’s nominees to the U.S. Supreme Court are somewhat obvious. Both are young – Gorsuch is 50, Kavanaugh is 53. Both were raised in the Catholic faith, although Gorsuch would later join the Episcopal Church as an adult.

Both were graduates of the Jesuit-run Georgetown Preparatory School in North Bethesda, Maryland. Gorsuch earned a law degree from Harvard while Kavanaugh earned his law degree from Yale. Both clerked at the U.S. Supreme Court for Justice Kennedy.

Gorsuch won an 11-9 party line approval by the Senate Judiciary Committee on the way to a full Senate confirmation by a 54–45 vote, with three Democrats voting with the GOP.

It’s highly unlikely that Kavanaugh’s confirmation process will go as smoothly as Gorsuch’s.

Part partisan soap opera and part political kabuki performance, Senate judicial confirmation hearings are complex events that usually have precious little to do with the qualifications of the nominee to serve on the federal bench.
As noted when Gorsuch faced the same process, judicial confirmation hearings are almost always opportunities for the small number of judicial issues that have both major media interest and big lobbies either in favor or against them to engage in ideological warfare with a large audience.

Those issues frequently include gun rights, reproductive rights, LGBTQ rights, and religious rights. But no issue draws more political fire — pro or con — than abortion rights or more succinctly the Roe v. Wade decision.

From the right or the left, from Republican or Democrat, no single legal posture matters more in judicial confirmation than the nominee’s past record, prior public pronouncements, or in the absence of those, accusations and/or speculation on the nominee’s position on Roe v. Wade.

Since Gorsuch was replacing the reliably conservative Justice Scalia, his confirmation drew opposition from the left and from the usual pro-choice groups and individuals. But Gorsuch made a relatively small political target on the abortion question. The Colorado judge had written little to nothing on the issue of abortion or Roe v. Wade — making an effective attack by his partisan opponents difficult.

Far more attention was paid to the GOP decision to deny a confirmation hearing or a Senate vote to former Democratic President Barack Obama’s Supreme Court nominee Merrick Garland. Obama had nominated Garland to succeed Scalia.

But Kavanaugh is replacing Justice Kennedy, who had long been the high court’s swing vote on a number of social issues. Unlike Kennedy, Democrats, pro-choice groups and the pro-choice lobby perceive Kavanaugh as a “sure-thing” vote against Roe v. Wade – and hence his confirmation process will be nothing short of a partisan political firestorm.

Another key difference in Gorsuch and Kavanaugh is the fact that unlike Gorsuch, Kavanaugh has an extensive background in partisan Republican politics. He served in the Office of Independent Counsel under Ken Starr investigating former President Bill Clinton, the Vince Foster probe, and wrote recommending impeachment of Clinton.

Kavanaugh later took part in the Florida recount in 2000 on behalf of the George W. Bush campaign. He later served on Bush’s White House staff.

In short, Kavanaugh represents for Senate Democrats a much harder partisan target than did Gorsuch based on his past political activities. That fact, plus the fact that Kavanaugh would be replacing the moderate Justice Kennedy as a right-of-center conservative, will make his confirmation path far more difficult than that which Gorsuch successfully traversed.

MMF do a better job of keeping up with inflation/interest rates than do longer term bonds during environments of rising inflation and rising rates. MMF tend not to produce positive real returns during these periods but rather to suffer less in real inflation adjusted terms than do longer term bonds. For example, VMMXX has outperformed both Vanguard's Intermediate Treasury Fund and its TBM Funds by 2.8% - 2.9% over the last year. It is the only one of the three with a positive nominal return YTD (+0.9%). In such an environment--rising rates, rising inflation--MMF be an appropriate choice for a portion of one's fixed income allocation as are TIPS.



Assets that can keep up with inflation and possibly produce positive real returns in that environment include commodities, real assets, REITS, international diversification (inflation is often country specific, not worldwide), and to some extent US equity which tends to eventually catch up in real terms often after a roller coaster ride to get there. The problem with focusing too much on potential inflation risk and loading up on commodities, etc., is that commodities tend to produce lower long term returns than equities. Inflation protection is not free.



No investor gets rich during a long term period of rising rates and rising inflation. Nothing produces robust real returns, especially so in the case of stagflation like in the 1970s, something that one thinks about now except Alan Greenspan who sees that as our likely future. The goal is to minimize damage in real terms and wait it out. TIPS, MMF, and T Bills are tools to reduce fixed income damage as you wait for the rate/inflation tide to turn.

Four reproductive health care providers sue Virginia over abortion laws while pro-life advocates push for stricter regulations.

Justice Anthony Kennedy announced his retirement from the U.S. Supreme Court last month. Now that the swing vote in landmark cases likely will be replaced by a more consistently conservative justice, those on both sides of the decades-old abortion debate are gearing up for the impact the new bench makeup could have on access to abortion.

Four states have trigger laws in place, which immediately ban abortion if Roe v. Wade is overturned. Nine states have legislation that protects abortion rights regardless of a rollback. Virginia has neither. What it does have is a series of laws that one side says are medically unnecessary and harmful to women, and the other side argues don't do enough to restrict access to abortion.  

Days before Kennedy announced his retirement, four health care providers in Virginia sued the state over those laws. The lawsuit states that Virginia has spent more than four decades "enacting layer upon layer of unnecessary and onerous abortion statutes and regulations." For patients and abortion providers, it says, the restrictions are "not supported by medical evidence" and exist to "impede the ability of Virginians to access safe, legal and high-quality abortion care."

Regulations referred to in the suit include a "physician-only law," which prohibits advanced practice clinicians from providing abortions, the "two-trip mandatory delay law" which requires a woman seeking an abortion to undergo an ultrasound 24 hours before the procedure, and the "hospital requirement," which criminalizes second-trimester abortions performed outside a licensed hospital.  

"Medically unnecessary abortion restrictions block access to care for Virginia patients," says the Virginia League for Planned Parenthood's medical director, Shanthi Ramesh. "I've dedicated my entire career to providing patients quality reproductive health care, which includes abortions. It's scary and enraging to think access to safe legal abortion is on the line and that President Trump could tip the balance of the Supreme Court."

The U.S. Senate must consent to Supreme Court justices. Neither of Virginia's senators is on the Judiciary Committee, but both will still vote for or against President Donald Trump's nominee.

The day after Kennedy's announcement, Sen. Tim Kaine's office released a statement that the Republican Senate leadership established a clear precedent when it refused to take up the Supreme Court nomination of federal Judge Merrick Garland: "Do not fill a Supreme Court vacancy in an election year. It is only fair that this precedent should also be applied to the vacancy created by the retirement of Justice Anthony Kennedy only four months before the 2018 midterm election."

Kaine also told a crowd at a recent Hampton Roads campaign rally that allowing states "to go back to criminalizing women's freedom to make their own health care decisions would be devastating."

Gov. Ralph Northam's spokeswoman, Ofirah Yheskel, says he and his team are closely following the nomination process, and he will "work with the General Assembly to continue to protect women's health care rights."

Pro-life advocates are eager to learn Trump's pick for the bench. Olivia Gans-Turner, president and lobbyist for pro-life nonprofit Virginia Society for Human Life, says her group's belief is simple: The right to life is a basic civil right, and the Supreme Court overstepped in the 1973 Roe v. Wade ruling and subsequent abortion-related cases.

"We've seen courts for many years move to expand abortion access throughout the U.S. and protect abortionists at the expense of women's well-being and the lives of our children," Gans-Turner says. "The VSHL has always taken the position that we would like to see the strongest, most broadly protective laws passed as possible. We would like to see a human life amendment passed at the federal level."

Gans-Turner, who had an abortion when she was in college in the 1980s, describes her experience as belittling and humiliating. She recalls visiting four different abortion providers, and says she was repeatedly called foolish for having second thoughts, and felt pressured to go through with the procedure. She says she repeatedly hears her own story from other pro-life women who have had abortions, and that she and her peers never received support for their "post-abortion trauma."

Gans-Turner says there's little point in speculating, but she'd love to see the Supreme Court overturn Roe v. Wade.

"In the meantime, laws that are being passed by the states should continue to be passed, like informed consent laws," she says, adding that such laws "respect a woman's dignity" by giving her the "full range of information about assistance available and the medical realities of abortion."

Informed consent statutes are named in the lawsuit against Virginia as a provision to the 24-hour mandatory delay law: "Providers share rigid categories of so-called 'informed consent' information with patients and offer them materials produced by the states that have consistently been filled with false, misleading and inaccurate information about abortion."

PCM is driven by a set of .ini files in the PCM folder structure.  If you have a complex tree structure with many groups and agents with agents appearing in multiple groups, the resulting configuration is applied in a cascading fashion from top to bottom.  While the GUI provides the means to locate agents, ruleSets, ApplyOnNew, ApplyOnApply, etc..., it is difficult to determine the rules that are configured for a given PATROL Agent based on PATROL Agent location in a given group.  All of this is driven by the .ini files, which comprise a quasi-relational database.  Clearly, PCM knows how to traverse the .ini files to build the tree structure in the display.  Does anyone know how to do this manually or programmatically?  That would be a God-send.
