At least 16 candidates fit that category, along with a few more under the age of 35, and they’re eager to bring a fresh perspective to the Senate and the House.  The average age of the Arizona Senate is about 57.6 years, while the House is just a bit younger at 51. The average age of Republicans is 56, while Democrats clock in at 49.  But age doesn’t always equate to maturity, said Sen. Flavio Bravo, D-Phoenix. Bravo was first elected to the House when he was 28, then appointed to the Senate. Now, he’s 31 and running for re-election. (Photo by Gage Skidmore) “As a high school student, I think I was very optimistic about the idea of government and policymaking, and then when I actually visited the state Capitol, I was gravely disappointed,” he said. He got involved in civic engagement during high school and college, and even as politics became more divisive and someone told him it would be like high school, with cliques, clubs and groups, Bravo didn’t shy away from it.  Overall, Bravo wouldn’t describe his experience as bad, adding that he’d like to see more young people get involved regardless of the risks. “My wife always told me this. It’s the best time to take risks in your life,” he said. “When you’re even a little bit older, I think you become more careful and fearful of impacting or damaging any stability that you have.” Timing isn’t really even the hardest part, but it’s the question of stability, he said. Some legislators have the financial ability to work at the Legislature as their only day job, especially if they’ve retired. But with a legislative salary of $24,000, young legislators like Bravo must often go back to a full-time job when the session ends or the chambers take extended breaks.  Like Bravo, the 16 candidates under the age of 30 want the same chance at political office. Three spoke to the Arizona Capitol Times about their interest in running for state government.  Brendan Trachsel, 25, is a candidate for Arizona House Legislative District 6. (Courtesy of Brendan Trachsel) Brendan Trachsel, 25, is running for a House seat in Legislative District 6, challenging three Democrats, including incumbent Rep. Mae Peshlakai, D-Cameron.  Trachsel is a member of the Green Party and also a Quaker. He mostly grew up in San Diego, but moved back to Arizona in 2019 to attend Northern Arizona University, where he’s about to earn his master’s degree in counseling and student affairs. With a degree in hand, he’s headed for a full-time job at NAU. He rents in Flagstaff.  A do-it-yourself kind of guy, Trachsel said the current political discourse didn’t address the values and topics that were important to him and other young people. “There’s no better way to ensure that your values and views are represented than doing it yourself, particularly when you start losing faith in the two-party system and just aren’t seeing anything too productive coming out of state government,” he said.  As one of three Green Party candidates, Trachsel said the letter next to your name should be the one that closest reflects your values. He said he shares a lot of ideas with the Democratic Party, but also works Independents and Republicans on other topics as well.  “When it comes to the actual party leadership themselves, there are things that they seem to always go against me and a lot of people on, particularly when it comes to money and politics and the role that it has,” he said. “Two options isn’t enough to truly capture the diversity of political beliefs in our system.” If elected, Trachsel wants to work on topics that he calls the five paths to dignity, including labor rights, education, environment, democracy and privacy.  Trachsel said his generation has watched the government try to protect people and improve the quality of life, but they’ve seen things slip in the other direction.  “At the end of the day, we still have this vision and belief that government has the ability and maybe even the obligation to work to improve the lives of everyone that it oversees, and that if our current systems are not doing so, then it’s time for us to step up and let the new guard fill in,” he said.  The easiest part of campaigning so far has been face-to-face interactions and finding opportunities to make connections and ask people what’s on their minds. The hardest part has been trying to get endorsements from organizations.  When he’s not campaigning or getting ready to graduate and start a full-time job, Trachsel enjoys soap-making, hiking and hanging out with his friends and significant other.  Danielle Skranak, 30, with her dog, Zovina. She is a candidate for Arizona House Legislative District 2. (Courtesy of Danielle Skranak) Danielle Skranak, 30, is a Republican running for a House seat in Legislative District 2. She’s challenging incumbent Rep. Justin Wilmeth, R-Phoenix, in the Republican primary.  Skranak calls Gilbert home and earned her bachelors of science in criminal justice at Arizona State University and has worked as a paralegal for 10 years, recently starting her own business. She rents a house in Phoenix. Skranak served in the Army as military police and a correctional officer at Fort Leavenworth prison.  Running for office wasn’t quite on her to-do list, but she was noticed through her work with nonprofit organizations that advocate for veterans and active duty military members. The Arizona Veteran Leadership Council approached her with the idea to run for office.  “They thought that I had a great resume and a good fortitude to want to be able to make change in my community, which is very true. I grew up here and I’m noticing a significant shift in which our state is heading,” she said.  Her platform includes addressing education needs, public safety and supporting small businesses.  Running for government at the age of 30 offers a view that differs from many current legislators, and while she doesn’t disregard the wisdom of incumbent lawmakers, she said their life experiences are different.  “I am paying a significant amount more in rents that the older legislators are just not aware of. They’re more established in their career. They have higher pay. Maybe they’re retired already,” she said, “and so they have this additional time to be able to run a campaign and pass bills and meet with constituents and lawmakers.”  It’s harder for younger people to thrive, she said, adding the difference between the salaries in Phoenix versus the housing market is way too significant to ignore. If she was able to buy a house instead of renting, she’d be able to lower her living expenses and pour that money into her business while also having a home to invest in, instead of getting a letter of good credit for the next rental place.  “I think there’s just a lot of different things that the younger candidates can offer that the older ones just can’t. They’re trying to fix a problem, I think a majority of the time that they’ve never experienced before, which makes things a lot tougher,” Skranak said. The easiest part, she said, is harnessing her own energy into meeting people, talking with lawmakers, policymakers, campaign managers, constituents and knocking on doors, she said. The hardest part has been the learning curve that comes along elections, politics and government. “This is a playing field like no other,” she said.  When she’s not working as a paralegal or campaigning, Skranak spends time with her German shepherd, Zovina. They hike together and visit Lake Bartlett where Zovina loves to swim. On any given weekend, Skranak may also be found riding her Harley Davidson motorcycle with friends.  “I just randomly bought a brand new Harley right off the showroom floor and learned how to ride,” she said. She’s been riding for about three years. “We have a great riding community here in Phoenix. They’re the best people in the world.” Eric Stafford, 28, a candidate for state senate legislative district 29. (Courtesy of Eric Stafford) Eric Stafford, 28, is a Democrat running for state senator in LD 29, challenging incumbent Sen. Janae Shamp, R-Surprise. He calls Goodyear home and has worked as an aviation mechanic, veterinary technician and medical assisting. He rents.  He received his first taste of politics working on U.S. Senator Mark Kelly’s campaign as a field organizer, and he also spent time at the Legislature as a constituent.  “Just being kind of disenchanted by the fact that a lot of these people who are dictating policy are not doing so seemingly to help us, but for their own personal interests,” he said. “I think it’s just antithetical to what politics should be. I want to see politicians working for us and making our lives easier and not passing ridiculous bills anymore.”  His platform includes education, addressing how politicians are supported and getting dark money out of politics, and affordability.  Stafford said young people have more to lose than others who are at the end of their careers or retired.  “A motto that I like to think of is making policy and doing things for those that come after us, and the previous generation of politicians have not set us up for success,” he said. “Young people like us don’t have great prospects for the future, so we need to do something now before it’s too late.” The easiest part of campaigning is talking to voters and hearing their stories and the hardest part involves running the campaign, which just about amounts to operating a business, he said.  When he’s not campaigning or focusing on his career as a medical assistant, Stafford does woodworking, focuses on his health and is learning to play the trumpet. The post Offering a fresh perspective – millennials and Gen Z run for state office first appeared on Arizona Capitol Times.]]> 498557 New law prohibits overnight protests and encampments on Arizona campuses /news/2025/10/03/new-law-prohibits-overnight-protests-and-encampments-on-arizona-campuses/ Fri, 03 Oct 2025 21:30:14 +0000 /?p=495912 Key Points: New law bans overnight encampments on campus Law was introduced in response to pro-Palestinian and anti-Israel protests last year State university officials say current campus use policies align […] The post New law prohibits overnight protests and encampments on Arizona campuses first appeared on Arizona Capitol Times.]]> Key Points: New law bans overnight encampments on campus Law was introduced in response to pro-Palestinian and anti-Israel protests last year State university officials say current campus use policies align with the law Activists and students who want to protest on campus will no longer be able to set up encampments and stay overnight. A new law outlaws unauthorized encampments and directs university and community college presidents to immediately call for the dismantling of temporary shelters and to contact law enforcement if protesters don’t comply.  Failure to comply could result in a charge of criminal trespass. The law also applies to encampments that remain in place for a prolonged period. The legislation was introduced last session by Rep. Alma Hernandez, D-Tucson, as House Bill 2880 and signed into law by Democratic Gov. Katie Hobbs despite opposition from fellow Democrats. Hernandez previously said she introduced the bill in response to the pro-Palestinian and anti-Israel protests last year, and talked about Jewish students facing harassment while on campus.  Democrats who opposed the measure pointed to examples of pro-Palestine protestors across the country receiving harassment, including those who’ve had their visas revoked for participating in protests. Critics of the law argued that it could violate protesters’ First Amendment rights and expose them to targeted harassment based on their political beliefs. “It really just feels like another form of weaponization and militarization on campus,” said Alberto Plantillas, central regional director for the Arizona Students’ Association and a graduate student at Arizona State University. The majority of Republicans in the House and Senate supported the bill when it passed through the Legislature, although some expressed concern that conservative groups could be targeted under the law. However, the legislators who supported the law said it was needed to protect Jewish students during what they viewed as a time of increased antisemitism. Current state laws allow students and faculty to protest “within the limits of reasonable viewpoint and content-neutral restrictions on time, place and manner of expression.” Campus protesters are already prohibited from engaging in “unlawful” activities that disrupt the functioning of a university or college. Spokespeople for the state’s three public universities highlighted existing campus policies that already aligned with the law. The campus use policies for the three universities already ban encampments and offer guidelines for using public forums and outdoor activity space, erecting temporary structures, posting flyers, using campus spaces at night, and complying with university officials and law enforcement. The University of Arizona’s campus use policy serves as a “mechanism” to support First Amendment rights, said university spokesman Mitch Zak. “Our approach is that the dean of students office addresses any violations first and (the University of Arizona Police Department) is kind of a support should things escalate,” Zak said. Zak said the university’s dean of students office aims to be proactive in preserving student First Amendment rights, and looks to work with student groups to make sure they don’t violate campus policies when they protest. He recalled protests that occurred last year without any encampment issues. “We’re constantly engaged saying we want to help you exercise your free speech on campus and the campus use policy is designed to do that,” he said. “That connectivity is critical so hopefully we’re not in a position where we have to enforce the campus use policy but … the campus use policy helps enforce opportunities for free speech.” Plantillas said officials at the state’s universities haven’t appeared to be receptive to student input regarding protest policies and free speech issues. “It seems like they continue isolating themselves from any student input on this,” he said. ASU plans to spend $676 million on seven projects, UofA is spending $335 million on four projects and NAU has a $98 million budget for two projects.  The Arizona Board of Regents has approved the Annual Capital Plans for each Arizona public university.  Arizona State University, the University of Arizona and Northern Arizona University disclosed their annual capital plans for the 2026 fiscal year on Sept. 11, revealing plans for deferred maintenance and renovations across all three campuses.  The three public universities presented their 2026 financial budgets to the Arizona Board of Regents during a University Governance & Operations Committee meeting, where updates on thirteen various projects were approved.  “House cleaning is never fun, and ABOR is cleaning out its attic,” Doug Goodyear, the chair of ABOR, said. “It’s all for the greater good and will make us a more modern and better institution.” ASU’s fiscal plan stood as the largest physically and monetarily with seven projects totaling $676 million: The ASU Health Building will cost $200 million and will be 200,000 gross square feet. The building will serve as a headquarters for ASU Health at the Downtown Phoenix campus. The plans for the building were previously brought up to ABOR in September 2024 and were approved. It’s expected the building will be finished in June 2028. The project will be debt-financed with speed bonds and system revenue bonds.  The McCain Center is expected to be a $187 million project, financed through federal grants and university funds. The center will be 68,000 gross square feet, situated on top of the site where the ASU Community Service building is located, next to Papago Park. The building will have a museum, library and academic spaces. The building is scheduled to be completed in January 2028. The PSH Research Laboratory Complex Modernization has a $115 million budget and will renovate the Bateman Physical Sciences Center on the ASU Tempe Campus. The project will focus on renovating labs and office spaces inside the building. Planning for the project began in 2024, with construction projected to start in December 2025. ABOR originally approved the project in September 2024. ASU’s Polytechnic Student Union Expansion is projected to cost $66 million and will go toward renovating and expanding the Student Union on the Polytechnic campus. Planning for the project began in August 2023, and construction is expected to start in May 2026. ABOR originally approved the project in September 2024 and will be debt-financed.  Costing $51 million, the East Athletic Village Tennis and Track and Field Facilities will focus on moving the Tennis and Track and Field facilities to the ASU Athletic Village in Tempe. The project was submitted to ABOR in 2024, and is expected to be completed in June 2027. The project will be debt-financed with system revenue bonds.  MTW Partnership Renovations is a $42 million project meant to renovate equipment and lab spaces at MacroTechnology Works at the ASU Research Park in Tempe. This project was not previously pitched to ABOR. The project will be debt financed with system revenue bonds and is projected to be completed in December 2028.  The Central Plant Transformer and Switchgear has a budget of $15 million. The project will replace five 12,700-volt substation transformers inside the central plant at the Tempe campus. The project was approved in September 2024 and will be debt-financed. Construction is expected to begin in May 2026 and will be finished in December 2029.  “We’re the largest producer of STEM majors in the United States,” Michael Crow, ASU president, said in the meeting. “So this is a critical contribution that we’re making to the Arizona economy.” For the UA, its Annual Capital Plan consisted of four projects, totaling over $335 million:  The Center for Advanced Molecular and Immunological Therapies project was presented to the board in both 2023 and 2024, costing $232 million. The project serves as an expansion of the Phoenix Bioscience Core. It will consist of a 205,000 gross square foot facility housing the Center for Molecular and Immunological Therapies and other laboratory support services. The building will be in Downtown Phoenix. Construction for the building started in 2024 and is projected to finish in May 2027. The project will be funded using system revenue bonds, ARPA funds, gifts to finance and tuition.  The UofA introduced the Athletics Deferred Maintenance and Infrastructure Upgrades project to the board for the first time, revealing a total cost of $50 million. The project will invest in upgrading UofA sports facilities and is expected to be finished by June 2026. The project’s budget will be financed through SPEED revenue bonds.  At $33.5 million, the Deferred Maintenance project will be responsible for campus-wide repairs and updates. It is expected to be finished by June 2026. $30 million of the project will be financed through system revenue bonds, with $3.5 million funded through institutional sources.  The Student Experience and Student Union Deferred Maintenance has a $20 million budget and had no prior action from ABOR. The money will go toward modernizing the building and promoting sustainability. Like the other deferred maintenance project from UofA, the project is projected to be finished in June 2026. The project will be funded using SPEED revenue bonds.  “Our Student Union was constructed in 2001, which was the last time it had major systems upgrades,” said Josh Wright, the chief facilities and planning officer at the UofA. “We’re interested in looking both within the union as well as campus wide and places that our students can gather, … share experiences and really build that campus culture that we are seeking.” Northern Arizona University, being the smallest school of the three, had two major projects to fund, totaling $98 million:  The New Nursing Building project will cost $50 million. The project was previously proposed to ABOR. Located at the North campus science corridor, the building will be the new location for the College of Nursing and will serve to assist NAU’s expansion into health care. The project will be debt-financed through system revenue bonds and is expected to be completed by August 2029.  The Cline Library project will cost $48 million, addressing critical maintenance needs and upgrades. The project was previously brought up to the board and will be finished by December 2028. The project will be debt-financed with system revenue bonds.  “We would better optimize the space within the Cline Library and relocate from the Babbitt academic building, which would be demolished into this building,” said Bjorn Karlen Flugstad, the senior vice president and CFO of NAU. “Cline Library would be open throughout this entire process.” University representatives at the ABOR meeting reported how federal policies have affected student enrollment and grant money.  The three universities are facing challenges in recruiting out-of-state students for the upcoming year due to government stressors.  “Our biggest disruption in the process is disruption of the visas because of political changes,” Crow said. “We’ll work our way through those. The post Report identifies keys to nuclear development first appeared on Arizona Capitol Times.]]> Focusing on workforce development, expediting permitting and lowering financial risk will help states develop nuclear power, according to the Nuclear Innovation Association’s 2026 guide for state policymakers. “The real intent of this guide is to provide state policymakers with the knowledge necessary to understand how they can bring new nuclear energy to their states,” Zach Koshgarian, who authored the document, said on a call Tuesday unveiling the annual update. “The guide ultimately answers this question ‘What can states do?’ by highlighting these policies, partnerships, and initiatives that can help advance new nuclear energy in their states.” The Nuclear Innovation Alliance is a nonprofit nuclear energy think tank. Koshgarian is an NIA analyst. Over the last few years, states have increasingly explored nuclear power as demand for electricity is projected to rise with the rapid expansion of artificial intelligence and data centers, a rise in domestic manufacturing and industrial onshoring, and the widespread electrification of transport and heating. According to consulting firm ICF, electricity demand is projected to increase 25% by 2030 and 78% by 2050. Around 250 bills aimed at advancing nuclear energy were introduced this year, including measures to declare nuclear power a clean energy source, make it easier to site projects, remove moratoriums, provide incentives, develop the workforce and study nuclear power development. Workforce development is key to building new nuclear power plants as skilled workers retire at a greater rate than those seeking to take their place. The report points to Tennessee, which in 2023 provided $95 million to ramp up nuclear power in the state, including workforce training. The state used the funds to establish nuclear programs at universities, such as the University of Tennessee, and partnered with technical colleges and K-12 networks to build a nuclear talent pipeline. Other states have since set up similar funds, including New York and Iowa. Connecticut enacted legislation to study nuclear workforce development. The legislation comes as the U.S. Department of Energy recently identified Idaho, Louisiana, Oklahoma, Tennessee, and Utah as the five possible host states for proposed Nuclear Lifecycle Innovation Campuses. Hosting a campus will also help spur nuclear workforce development. The Energy Department intends to locate fuel fabrication, enrichment, used-fuel recycling, and waste management in a unified regional hub. The agency plans to select three final host sites by the end of the year. Expediting permitting for nuclear projects has also gotten attention from states, which have sought to create a single point of contact for nuclear developers. “States can… align permitting and provide clarity on timelines and requirements to developers by creating a state-wide ‘one-stop shop’ for nuclear energy,” the report says. Lawmakers in at least nine states this year have introduced legislation establishing a centralized office to help shepherd nuclear development and expedite the permitting of new nuclear power projects. Those states include Colorado, Iowa, Missouri, New Jersey, New York, Oklahoma, South Carolina, Utah and West Virginia. The Utah bill, which creates a state nuclear energy regulatory office within the Utah Division of Waste Management and Radiation Control, was signed into law in March. Nuclear power is also very expensive, typically costing billions of dollars. To help reduce the financial risk, states have sought to work together. All six New England governors issued a joint statement in March committing to explore advanced nuclear technologies while supporting continued operation of the region’s existing nuclear fleet. The Midwestern Governors Association plans to explore deploying advanced nuclear power in the Midwest. States are also looking for incentives and pilot programs to entice developers to help defray the costs. In Kentucky, Gov. Andy Beshear, a Democrat, signed legislation in April to establish the Nuclear Reactor Site Readiness Pilot Program. The initiative provides up to $75 million total for up to three selected projects. The law would provide up to $25 million per project to cover a third of costs for early site permits, construction permits, and federal licensing. Kenya Stump, executive director of the Kentucky Office of Energy Policy, who was also on the call, said the idea was to help ease the risk associated with early site development and send a signal to developers that the state is serious about nuclear power. “We just wanted to send the right market signal, de-risk it, and say that the state was all in on securing at least three sites for development,” Stump said. “I’m not trying to go find the billions yet. The Commodity Futures Trading Commission, which once shied away from the industry, has sued five states since April in an effort to block enforcement of their gambling statutes. And President Donald Trump this week took his most overt stance to defend prediction markets in a lengthy social media post. Federalism has been on full display in the fight over who controls prediction markets, as the federal government spars with states for regulatory oversight. State regulators say the sites — which let users bet billions of dollars a week on the outcome of practically anything, from the NBA Finals to elections — are no different than any other gambling website and should be beholden to the same laws and taxed the same way. States are estimated to have missed out on more than $1 billion in taxes since prediction markets began offering sports events contracts, according to a running tally by the American Gaming Association. The industry says the regulation task belongs to the federal government and that the sites are derivatives and futures contracts, which fall under the Commodity Exchange Act. Nearly all platforms are registered as such with the CFTC. Because of this, platforms like Kalshi boast that they operate in all 50 states, even those where gambling and sports betting is illegal. That may soon become more difficult to claim: Minnesota last week enacted a law to ban all prediction markets from operating or advertising in the state. In a post on his social media platform Truth Social, the president called it “critically important that the CFTC’s exclusive authority over prediction markets is maintained so “that they will thrive.” “Under my leadership, we are setting the ‘rules of the road’ that are the gold standard for the states,” Trump wrote, before listing several politicians he said were “scum” currently “setting the rules.” “It is a major industry, and we must protect it,” Trump said. The post was the strongest language from the president who, while he has expressed ardent support for CFTC Chairman Mike Selig, has until recently been more tepid on prediction markets. Trump told reporters in the Oval Office last month that he “was never much in favor of [the industry],” adding: “I don’t like it conceptually. It is what it is. I’m not happy with any of that stuff.” The administration at the beginning of April sued Arizona, Connecticut and Illinois seeking to block enforcement of state gaming statutes against Kalshi and Polymarket. It subsequently filed suits against New York, Wisconsin and Minnesota, and has submitted several amicus briefs in cases involving other states. This more active approach is a departure from the agency’s historical stance on regulating prediction markets. Prior to the second Trump administration, the agency had been reluctant to approve markets that resemble sports betting or gambling. Kalshi did not promote itself as a place to bet on sports outcomes until January 2025. Polymarket also did not begin to heavily market itself for sports until around that time. Now, sports account for 90% of Kalshi trades and around two-thirds of those on Polymarket. Selig said in his Senate confirmation hearing that he believed it best to leave the issues to the courts, but he has since changed his tune. Selig announced in March that the CFTC would be filing a friend-of-the-court brief “to defend its exclusive jurisdiction over these derivative markets,” then penned an opinion piece published in the Wall Street Journal. Trump’s son, Donald Trump Jr., serves as an adviser to both Kalshi and Polymarket. His venture capital firm 1789 Capital is a considerable investor in Polymarket. The likelihood of the Supreme Court ultimately settling the question over who has the final authority to regulate the sector grew last week when a federal appeals court on the West Coast sided with the states — contradicting an earlier ruling by an East Coast federal appeals court. The 9th Circuit denied stays for Kalshi and Polymarket in a trio of rulings, siding with regulators in Nevada and Washington state. The three-judge panel found that neither company successfully argued that the cases should be bumped to the federal level. In April, the 3rd Circuit became the first appeals court to rule on the issue. The judges sided with Kalshi and against New Jersey gaming regulators in a 2-1 split decision, upholding a preliminary injunction. Several other cases are currently being heard by federal appeals courts. Others are playing out on the state level. The total number of cases is around 30, not including class action suits. Kalshi in particular has preemptively sued and countersued a dozen states: Arizona, Connecticut, Iowa, Maryland, Montana, Nevada, New Jersey, New York, Ohio, Tennessee, Utah and Washington. The company is also facing lawsuits from seven states and several tribal governments: Arizona, Massachusetts, Michigan, Nevada, Rhode Island, Washington and Wisconsin; and the Ho-Chunk Nation in Wisconsin, three tribes in California and four tribes in New Mexico. Thirty-eight state attorneys general — including several not involved in litigation — filed an amicus brief last month in support of Massachusetts’s lawsuit against Kalshi. They wrote in the brief that the states have “traditionally regulated gambling, including sports betting,” and “are interested in this case because Kalshi’s aggressive theory of preemption threatens the States’ longstanding ability to protect their citizens in this area.” Massachusetts in September 2025 became the first state to sue a prediction market, when Attorney General Andrea Campbell filed a lawsuit against Kalshi in Suffolk County Superior Court. The case is ongoing and was heard earlier this month. Trump in his Truth Social post May 26 didn’t mention Campbell but named several other politicians who have been involved in the space. The president derided former New Jersey Gov. Chris Christie, who now serves as an adviser to the American Gaming Association and is a critic of the industry; New York Attorney General Letitia James, who has taken action against prediction market operators and whom the CFTC has sued; Minnesota Gov. Tim Walz, who signed legislation banning the products from operating in the state; and Illinois Gov. JB Pritzker, whose state has also been sued by the administration. Rep. Quang Nguyen acknowledges that the U.S. Constitution prohibits the “commandeering” of state resources. And that, said the Prescott Valley Republican, bars the federal government from compelling states “to enact or administer a federal regulatory program.” But Nguyen points out that there also is a state law which bars cities from adopting policies that “limit or restrict the enforcement of federal immigration laws to less than the full extent permitted by federal law.” And that, he said in a letter to Mayes, preempts the ability of cities to ban ICE from using municipal property, even as a staging area. The request comes just days after the Phoenix City Council voted 8-1 to ban ICE from using city-owned land to stage operations or process detainees unless it first gets the city’s permission. Phoenix, however, is not alone. It actually follows a similar unanimous vote by Tucson. What makes the letter by Nguyen to Mayes important is it is more than just a complaint. It begins the formal process which allows any legislator to force the attorney general to investigate potentially illegal actions by a local government. More to the point, if Mayes were to conclude that a policy runs afoul of state law, she could order a city to rescind it or, at the very least, seek a ruling from the Arizona Supreme Court. And if her finding of illegality is upheld, the law requires the state treasurer to withhold some state aid until the offending ordinance is repealed. Both ordinances follow a series of decisions by ICE to go into cities in efforts to sweep up people they say are not legally entitled to be here, often using city property to stage their raids. That has resulted in not just demonstrations against what ICE is doing but also reports of agents picking up and holding those who are U.S. citizens or otherwise legally present. Tucson Mayor Regina Romero, discussing the proposal before it was approved, said residents and the immigrant community “deserve certainty that our city-owned properties and resources will be used” to deliver quality of life services, not a place where they can be “confronted or attacked or harassed” by federal agents. Nguyen, in his complaint to Mayes, said such ordinances do not just reflect “passive non-cooperation” with ICE. “Rather, it affirmatively restricts the use of city property for core enforcement functions such as staging, processing, and operational coordination,” he wrote, unless ICE first gets city approval. In the case of Phoenix and Tucson, that would come from the city manager. Nguyen said that’s not acceptable. “This policy conditions federal and intergovernmental law enforcement activity on local approval,” he wrote to Mayes. Nguyen said it would make the city manager a gatekeeper, controlling the manner, timing, and feasibility of enforcement operations. “This discretionary approval structure creates a substantial risk that enforcement will be delayed, impeded, or denied altogether,” Nguyen wrote.  And, he said any policy that withholds access runs afoul of the state law that bars cities from limiting “the enforcement of federal immigration laws to less than the full extent permitted by federal law.” Then there’s the issue of federal preemption. “While local governments are not required to affirmatively assist federal law enforcement, they may not adopt measures that interfere with or stand as an obstacle against the execution of federal law,” Nguyen told Mayes. “By restricting access to city-controlled property through discretionary local approval, the regulation risks crossing the line from permissible non-cooperation into impermissible interference with federal enforcement operations.” Tucson intends to dispute Nguyen’s contention that its ordinance is illegal. “The policy was crafted and adopted in accordance with state and federal law,” said Roy Lusk, the Tucson city attorney. That is in line with views expressed by Romero in a memo she wrote before the city adopted the ordinance. “While immigration enforcement is a federal responsibility, municipalities retain authority over how city property, facilities, and staff are used,” she said. The ordinance also directs city officials to erect signs to tell federal enforcement officials they cannot use property “for civil law enforcement or civil immigration enforcement.” That emphasis on civil is important. The Tucson policy says there is no need for federal agents to request permission “for the service of a lawful judicial warrant or where exigent circumstances objectively exist.” Tucson council member Miranda Schubert said after the council vote that enacting the ordinance was the right thing to do. “This action is important because it shows we’re literally doing everything we can on the City Council to, again, ensure that people feel safe, that they feel welcome in public spaces,” she said, When the issue was first discussed in January, several council members expressed strong feelings about ICE and city cooperation. Paul Cunningham said that he feels “less safe” when he hears about ICE operations in Tucson. “It’s important for us to send a message, and let them know (that) not only are we taking remedial action because our people don’t feel safe with them running around like a bunch of gestapo goons in our community,” he said. Under state law, Mayes has 30 days from the time she believes she has a complete complaint to issue a ruling. Emily Harris, a campaigner for farmed animals at the RSPCA, said: “For every pet in the UK, there are nine times as many farmed animals. “Every single farm animal deserves a good life – but sadly, right now, most are kept in ways which mean they do not. “That’s why this World Farmed Animal Day we are sharing three simple hacks we can all do, which can improve the lives of millions of animals at a stroke – and the best news is they are all quick and easy. “So next time you are at the supermarket, take action and together let’s raise the standard for farmed animals.” Play label detectiveDon’t be fooled by just pretty pictures of rolling green fields or phrases like ‘farm fresh’, ‘happier and healthier’, or ‘room to thrive’.  Make sure you look for clues – labels like RSPCA Assured prove that the animals have been reared to the highest welfare conditions. Labels like free-range, organic, outdoor bred/reared can help too. To get more involved, you can even add your voice to the RSPCA’s call to the UK Government to introduce better labelling so shopping is less confusing. Look up when you are shopping If you want to find products from animals which have lived better lives  – look up! All the major supermarkets stock higher-welfare choices – but they are often tucked away on higher shelves and racks. Simply scanning the whole shelf helps you spot the higher-welfare options you might otherwise miss. And if you are worried it might cost more, visit the RSPCA website for tips on how to make your higher welfare products go further by adding in tasty alternatives like beans, lentils and tofu. Half and half anyone? Do mini maths with small swaps 🖩 Small swaps in your shopping basket can help make a big difference for farmed animals. According to new University of Lincoln research, trimming our animal product intake by only three per cent a year – the equivalent of eating just three fewer burgers or seven fewer sausages annually for most people – could spare a staggering one billion land animals from lower-welfare farming by 2050. Ready for the 3% challenge? Don’t worry you don’t need to be Einstein to figure out what to swap. Three-year-old crossbreed siblings Ginny and Neville have been by each other’s sides their entire lives. They arrived in the RSPCA’s care in July having been rescued from unsuitable conditions in a multi-animal household where they’d been wholly shut off from the outside world. But they’ve flourished while in the care of RSPCA Birmingham Animal Centre, in Frankley Green. Kennel Supervisor Kelly Legg said: “When they first arrived the outside world was completely alien to them. We don’t believe they’d ever worn a harness or been on a walk. But slowly, with patience, encouragement and each other, they’ve blossomed. “Ginny and Neville have been through so much together but they’ve always had each other to lean on. “Now they’re safe, they’re cared for and they don’t need to worry anymore. But we do want to ensure that they’ll have each other for the next chapter in their lives. “So we’re searching for a truly special home that can open their hearts to not one rescue dog, but two. We’d love Ginny and Neville to find a home together; we simply couldn’t bear to part them after everything they’ve faced together.” The pair have slowly been learning what life is like. They’d never been on walks before but now they enjoy going on adventures together. Ginny is the confident one and provides Neville with reassurance. But they’d both be best suited to a quiet and calm adult-only home. Kelly added: “We’re hoping they’ll be the centre of someone’s world; they really do deserve it. “Ginny is a social butterfly and loves meeting new dogs when they’re out and about but Neville prefers to keep his distance. For this reason, and because their bond is so special, we’d like them to be the only dogs in any new home.” The pair would benefit from owners who are around for most of the time, especially while they’re settling in, as they learn a new environment and routine. With patience, guidance and consistency, they’ll flourish. Kelly added: “If you could open your heart to a pair of gentle and devoted companions then you’ll get so much in return. They’ve shown how much they can achieve together, imagine what they could do with a loving family behind them? “They don’t need a perfect home; they just need a loving home. Somewhere Neville can feel safe because Ginny is beside him. “Somewhere Ginny can relax because she knows her brother is okay. “Somewhere they can discover all the wonderful things they’ve never experienced before.
