According to a report from the Tampa Bay Times, five St. Petersburg  city firefighters have filed suit in Pinellas-Pasco (FL) Circuit Court against Mine Safety Appliance Co. and Ten-8 Fire Equipment Inc., claiming that the helmets they were issued in 2010 were designed poorly and caused head and neck injuries.  Specifically, the firefighters allege that the 1044 Cairns model helmet, manufactured by Mine Safety and distributed by Ten-8, is uneven and causes musculoskeletal injuries.  Translation: These helmets allegedly turn the firefighters into life size bobble heads. While the report is silent as to the nature of the injuries, we here at Abnormal Use can reasonably conceive how a weighty helmet could cause neck injuries.  After all, we are all prisoners of gravity and the hazards of top heaviness. Nonetheless, we question what alleged design defect in the 1044 Cairns model distinguishes it from any other helmet.  It seems as if any over-sized helmet would have the propensity to promote bobble head-like movement.  As such, even though the firefighters allege that this helmet is uneven, they might face some difficulty demonstrating that the injuries are the result of the 1044 Cairns and not repetitive trauma from prior models.  Further, it will also be interesting to see if this alleged problem is limited to the St. Petersburg department or whether it is more widespread. So, on July 22, Hajn filed suit for willful trademark infringement and unfair competition in the U.S. District Court of the Southern District of Florida to prevent A&E from using its purported trademark. A&E has apparently declined to comment, and as of press time, it has not yet filed a response to the lawsuit. We will say that we were impressed with the color images of advertisements – and even tweets – embedded into the complaint. Longtime readers may recall that back in 2010 we here at Abnormal Use remarked: While it is customary to attach photographs as exhibits to memoranda in support of motions, rarely does the attorney actually embed the photograph into the pleading itself. (This is changing for the better, though.). Whatever the case, we should all be patient to see where this one goes, or as Uncle Si says “America, everybody is in too big a rush. An incident of this type is obviously traumatic, especially when a pregnant woman is involved.   At this point, it is too early to tell who is to blame.  Tampa Police Chief Jane Castor has said that there was “no indication” of any involvement by Morales or Rosado.  So, if not them, then who?  A neighbor?  A friend?  Wal-Mart?  The packing house?  Could it just have been an LSD-addicted cow?  These questions are yet to be determined. Certainly, this Florida Wal-Mart will be forced to attempt to clear its name.  Despite the police’s assertion the there was “no indication” that the victims were involved, Wal-Mart would be wise to do more investigation.  We are by no means experts in LSD, but we do find it suspicious that the effects of LSD can be so severe after the drug has been exposed to heat.  Moreover, we also find it interesting that those effects were violent illness for the adults rather than hallucinations.  Something sounds suspicious. There are obviously more questions than answers at this stage.  We don’t know who, what, where, when, or how this family ingested LSD.  But, certainly it couldn’t have been from a high quality Wal-Mart steak. Courts are beginning to limit the nature of social media discovery, chiefly in light of the fact that we live so much of our lives online that not every post or status update can be discoverable in a lawsuit. Yesterday, in Root v. Balfour Beatty Const. LLC— So.3d —-, (Fla. Ct. App. Feb. 05, 2014), the Florida Court of Appeals overturned a magistrate’s order in a negligence case that had required the Plaintiff to produce a host of materials from her Facebook account. The Plaintiff was suing on behalf of her young son who was injured in an automobile accident near a construction site (the safety of which was at issue in the proceeding). It does not appear that the Plaintiff was present at the scene of the accident, and at that time, Plaintiff’s son was being supervised by his 17 year old aunt (which led to a negligent entrustment affirmative defense). Here’s what the defendant’s asked for: (o.) Any and all postings, statuses, photos, “likes” or videos related to [Plaintiff’s]’s i. Relationships with [the injured child] or her other children, both prior to, and following, the accident; ii. Relationships with other family members, boyfriends, husbands, and/or significant others, both prior to, and following the accident; iii. Mental health, stress complaints, alcohol use or other substance use, both prior to and after, the accident; …. v. Facebook account postings relating to any lawsuit filed after the accident by [Plaintiff] or others[.] Not surprisingly, the Plaintiff object to the discovery requests on the grounds that they were overbroad. The Court of Appeals bought this argument, noting: [Plaintiff’s] complaint contains claims on behalf of [the injured child] for negligence as to each defendant and Root’s derivative claims for loss of parental consortium. Defendants responded with several affirmative defenses including negligent entrustment of [the injured child] by [Plaintiff], the aunt’s failure to supervise, and the driver’s negligence. As to [the injured child’s] claims for negligence, none of the objected-to discovery pertains to the accident itself. Similarly, none of the objected-to discovery pertains to Defendants’ affirmative defenses. Instead, the discovery relates to [Plaintiff’s] past and present personal relationships with all her children, other family members, and significant others; [Plaintiff’s] past and present mental health, stress complaints, and use of alcohol or other substances; and lawsuits of any nature filed by [Plaintiff] or others after the accident. At the hearing before the magistrate, the party seeking discovery didn’t help itself by noting that “These are all things that we would like to look under the hood, so to speak, and figure out whether that’s even a theory worth exploring.” Well, we as defense lawyers probably need to articulate the basis for our social media discovery requests a bit more artfully (although the magistrate judge, who apparently remarked at the hearing that “95 percent, or 99 percent of this may not be relevant,” did require production of the materials requested). The lesson: tailor social media discovery requests to require production of materials related as closely as can be to the claims and defenses in the case. […] The post Zimmerman Case Puts More Florida Laws Under Scrutiny appeared first on Abnormal Use. ]]> In the course of following the George Zimmerman/Trayvon Martin case, the entire country learned about Florida’s so-called “Stand Your Ground” law.  In case you’ve been under a rock for the better part of a year and a half, Zimmerman was a neighborhood watch volunteer who encountered 17-year-old Trayvon Martin one night in his gated community.  After calling the police, Zimmerman and Martin got into an altercation that resulted in Zimmerman fatally shooting Martin. While the defense team for Zimmerman did not actually use Florida’s Stand Your Ground law as a defense at trial, the case itself brought that law and others like it from other jurisdictions under intense scrutiny.  Protests such as this sit-in reported by The New York Times sprung up around the nation against these types of laws, passed in the name of self defense. Zimmerman’s recent acquittal has brought another Florida law into the limelight.  As reported by NBC News, Zimmerman’s attorneys are preparing a motion that would ask the State of Florida – i.e. the Florida taxpayers – to pick up part of the tab for his defense, to the tune of almost $300,000.  The motion would be based on a Florida law that “says a defendant who’s acquitted isn’t liable for costs associated with his or her case,” according to NBC. Like good little lawyers, we looked up the statute.  It states as follows: (1) A defendant in a criminal prosecution who is acquitted or discharged is not liable for any costs or fees of the court or any ministerial office, or for any charge of subsistence while detained in custody. If the defendant has paid any taxable costs, or fees required under s. 27.52(1)(b), in the case, the clerk or judge shall give him or her a certificate of the payment of such costs, with the items thereof, which, when audited and approved according to law, shall be refunded to the defendant. (2) To receive a refund under this section, a defendant must submit a request for the refund to the Justice Administrative Commission on a form and in a manner prescribed by the commission. The defendant must attach to the form an order from the court demonstrating the defendant’s right to the refund and the amount of the refund. Fla. Stat. Ann. § 939.06.  A few decisions out of Florida have clarified the statute.  First, the public policy behind the statute is fairly obvious, but it’s worth repeating.  The purpose of the law is, as stated by the Florida District Court of Appeals, is to “protect a defendant from costs when he is innocent or when the state fails to pursue a vigorous prosecution.”  State v. Crawford, 378 So. 2d 822, 823 (Fla. Dist. Ct. App. 1979). It should also be noted that not everything that Zimmerman–or his lawyers–spent on behalf of his defense effort is eligible for reimbursement; only “taxable costs” are provided for in the statute.  The Supreme Court of Florida has provided some guidance here: Given its plain meaning, the relevant portion of this statute simply says: No acquitted criminal defendant shall be liable for any court costs or court fees, any costs or fees of a ministerial government office, or any charges for subsistence, and that if such a defendant has paid any of these taxable costs he or she shall be reimbursed by the county. Bd. of Cnty. Comm’rs, Pinellas Cnty. v. Sawyer, 620 So. 2d 757, 758 (Fla. 1993).  Examples of costs that would not be reimbursable under Florida law include investigative costs, private attorneys’ fees, deposition transcription fees, video deposition fees, process service fees,  expert witness fees, and fees for transcription of excerpts of trial.  Id.; Hillsborough County v. Martinez, 483 So.2d 540 (Fla. Ct. App. 1986); Justice Admin. Comm’n v. Neighbors, 927 So. 2d 218, 219 (Fla. Ct. App. 2006). It will be interesting to see if this law receives the same kind of attention and criticism as Stand Your Ground.  The Zimmerman case continues to make news and provide a microscope with which to view the rule of law and other issues of socio-economics and race in America.  Fascinating stuff. Back in July,  an intoxicated Florida woman was arrested after blocking a McDonald’s drive-thru in search of free Big Macs for breakfast. According to the Consumerist, the woman pulled up to the drive-thru around 6:00 a.m. and demanded two free Big Macs as retribution for past discrepancies.  After being told that Big Macs are not available for breakfast, the woman politely changed her demand to two free Egg McMuffins.  Sounds reasonable.  Unfortunately, McDonald’s balked at the idea of giving away free food and asked the woman to leave.  She valiantly responded by blocking the drive-thru until police arrived.  She was arrested for DUI and apparently taken to jail hungry. Last week, a Georgia man called 9-1-1 after McDonald’s allegedly messed up his order.  According to reports, the man entered the restaurant and ordered 7 McDoubles, a McChicken, and an order of fries to-go.  When the man returned to his truck, he discovered that the employee placed not 7, but 6, McDoubles in the bag.    He then re-entered the restaurant and apparently got some “attitude” from the employee rather than his AWOL burger.  The man’s response?  Call 9-1-1 and report that his burger had been swapped with a serving of ‘tude.  The police were not fond of the man’s use of the emergency response system, arresting the man and having him spend a night in jail. Even though these cases do not involve coffee, they share a common theme:  Mess with McDonald’s and expect to make the news. Innovation subsequently moved to dismiss those suits. Last week, the manufacturer found out that it must continue litigating at least one of those suits after a Florida federal judge denied its motion. At issue in these cases is 5-Hour Energy’s product statement, “Hours of energy now – No crash later.” As self-proclaimed coffee connoisseurs, we are a little too old fashioned to know the effectiveness of an energy drink’s claim. Apparently, enough consumers to organize into three putative classes think the product statement is a bit of a stretch. In one of the suits, Guarino v. Innovation Ventures LLC, d/b/a Living Essentials, No. 13-cv-00101-GPM-PMF (S.D. Illinois 2013), the plaintiffs allege that the product statement “is not true, as admitted on the Defendant’s website and hidden behind the bottles in the display, which reads: ‘No crash means no sugar crash.’” So Innovation is falsely advertising a product by placing true statements on its website and directly on the bottle? Now we see why Innovation filed those motions to dismiss in the first place. While its motion to dismiss may have been denied, Innovation may still ultimately prevail in this suit. Pleading sufficient allegations to survive a motion to dismiss does not necessarily make a good case. Unfortunately for Innovation, it now must embroil itself in hours of litigation defending the case. For their sake, let’s hope there is no awful crash afterwards. As you might recall, Spurs coach Greg Popovich elected to rest star players Tim Duncan, Manu Ginobli, Tony Parker, and Danny Green against the Heat for the last game of 6-game road trip. We here at Abnormal Use refrained from voicing our opinions on the fine because it was not necessarily a legal issue at the time. Now, Miami lawyer, Larry McGuinness, has made it one – and opened the door for an Abnormal Use critique. McGuinness filed a class action lawsuit against the Spurs in a Miami-Dade County court over the incident, alleging that the team violated the State of Florida’s unfair trade practices laws. The suit alleges that Popovich “intentionally and surreptitiously” sent the players home without the knowledge of the league. As a result, fans allegedly suffered economic damages in paying a premium price for a ticket. McGuinness, who bought his own ticket to the game on the resale market, compared the situation to a disappointing meal at a steakhouse: It was like going to Morton’s Steakhouse and paying $63 for porterhouse and they bring out cube steak . . . . That’s exactly what happened here. We understand the disappointment. No one likes to show up to a game only to discover that a star player is M.I.A. However, our sympathy ends there. From a legal perspective, we question the validity of McGuinness’ suit.  Tickets to sporting events are usually revocable licenses which provide the holder the right to attend a game.  The team can revoke the license at any time, for (essentially) any reason.  It seems illogical to perceive a situation where McGuinness can successfully bring a suit for events that happened within a game when his own license to said game could be unilaterally revoked prior to the game without repercussions.  Moreover, McGuinness has filed suit against the Spurs – not the Heat, the team who issued him the license in the first place. Even assuming McGuinness has grounds for a cause of action against the Spurs, just how has he and the rest of the class been damaged?  We understand that this was a “premium” game and that fans may have paid a higher ticket price.  However, McGuinness bought his own ticket through the resale market – any premium he paid was not that charged by the team or the NBA.  Sure, he may have been deprived of the opportunity to watch the Spurs’ stars, but he still had the chance to observe Lebron James, Dwayne Wade, and Chris Bosh fine tune their craft.  Even without the Spurs’ stars, the trio struggled to a 105-100 victory.  We wonder if McGuinness would have preferred a Heat loss to a fully-manned Spurs? From a fan’s perspective, this suit could set an unwanted precedent.  Requiring teams to play – rather than strategically bench – otherwise healthy players will place teams in precarious situations.  Imagine the backlash if star player is injured in a meaningless game against a woeful team simply because he was required to play.  We are thinking most fans would prefer that their favorite players sit for a game if it helps bring home a title. If teams are required to play players, where does the NBA draw the line?  What if a player is medically cleared to play, but wants another day to rest a sprained ankle?  What about a death in the family just before game time?  While it is unlikely that an entire starting lineup would be simultaneously plagued by these conditions, they do arise.  Some fans – like McGuinness – will continue to have their gripes, so should they continue to bring lawsuits? Again, we understand the frustration of attending a game only to discover a star player is not in attendance.  However, it is a part of the game and a part of the risk involved when purchasing a ticket. Take the recent case of Horrillo v. Cook Inc., 10-15327, 2012 WL 6553611 (11th Cir. Nov. 7, 2012) [PDF].  This case involved a stent manufactured by the defendant and approved by the FDA for use in bile ducts.  Dr. Michael Rush, however, used it during his angioplasty surgery on Margaret Horillo, not in a bile duct, but in her renal artery. Within 24 hours of the procedure, Ms. Horillo suffered a serious stroke. The warnings included by the manufacturer read as follows: First, it stated that the device was “intended for use in palliation of malignant neoplasms in the biliary tree,” which is to say, treatment for cancer in the bile ducts. Second, under a heading entitled, “WARNINGS,” the instructions for use cautioned that “[t]he safety and effectiveness of this device for use in the vascular system have not been established.” Deposition testimony in the case, however, revealed that stents such as this one were regularly used “off label” in the vascular system.  In fact, Dr. Rush had used this particular stent in the past in renal arteries.  The off-label use was so widespread, in fact, that the FDA called Cook and several other such manufacturers together about the issue before this surgery was performed.  As a result of that meeting, Cook sent a letter to the hospital where Dr. Rush did the surgery warning of the risk of stroke. In his deposition, Dr. Rush testified that he was aware of some risk of using the biliary stent in the vascular system.  The degree to which he knew of the risks, however, became the primary issue in litigation.  At the trial level, the magistrate concluded that Dr. Rush was fully aware of the risks, applied the learned intermediary doctrine, and granted Cook’s motion for summary judgment. The appellate court was not so convinced.  As the court stated, the issue was whether Dr. Cook’s knowledge was equal to that of Rush.  The evidence in the case suggested that it was not, and reversed summary judgment, and remanded the case.  A good reminder that the learned intermediary doctrine comes with its own set of challenges as an affirmative defense. Liggett Group, Inc., 945 So.2d 1246 (Fla. 2006).  The cases have presented interesting class action issues, as well as novel statutes of limitations issues.  On December 14, 2012, the second district court of appeal of Florida rendered its decision in Smith v. R.J. Reynolds Tobacco Co., No. 2D11-2562, 2012 WL 6216756 (Fla. Dist. Ct. App. Dec. 14, 2012), another case which provided Florida the opportunity to navigate “the interplay of the Florida Wrongful Death Act and the Florida Rules of Civil Procedure.” Some background first.  Della Mae Butler was a plaintiff in a personal injury action against several tobacco companies; as the court notes in its decision, she was pursuing a so-called “Engle claim.”  After she died, the personal representative moved to amend the complaint to substitute himself as the plaintiff and to add a wrongful death claim.  The circuit court denied the motion and dismissed  the complaint. Here was the issue: Under the Wrongful Death Act, “[w]hen a personal injury to the decedent results in death, no action for the personal injury shall survive, and any such action pending at the time of death shall abate.” § 768.20, Fla. Stat. (2008). The relevant Florida Rule of Civil Procedure provides that “[i]f a party dies and the claim is not thereby extinguished, the court may order substitution of the proper parties.” Fla. R. Civ. P. 1.260(a)(1). Here, by denying the motion to substitute the personal representative for the deceased plaintiff, the circuit court essentially ruled that abate in the Wrongful Death Act equates with extinguish in the civil procedure rules. Which, apparently, ignored the “remedial nature” of Florida’s Wrongful Death Act, as well as the “liberal spirit” of the civil procedure rules.  The court held that “stay” is a more appropriate synonym to “abate” as used in the Wrongful Death Act, thus allowing for a party to be substituted in the event of a death.  This interpretation, the court reasoned, is more in line with the rules of civil procedure, which specify that leave to amend “shall be given freely.” The interesting thing about this opinion is that, in the actual body of the opinion, the court actually acknowledges that it conflicts with a prior decision, and certified the conflict.  We will continue to watch this interesting line of cases. Nichtsdestotrotz fallen Tierschutzgruppen in den USA, Großbritannien und anderen Ländern übereinander in dem fieberhaften Bemühen, <a href="2010/03/partner-in-sachen-ausbeutung.html">Partnerschaften mit institutionellen Ausbeutern</a> herzustellen, die noch mehr ''Bio'-''Label mit sich bringen werden. <br /><br />Zurück zu VIVA! und der RSPCA. Hier haben wir eine Tierausbeutung unterstützende Organisation, die eine andere Organisation der Unterstützung von Tierausbeutung beschuldigt. Ich kann kaum erwarten, dass VIVA! uns ein paar ihrer nicht vegan lebenden Prominenten auftischt, die uns erzählen, dass die RSPCA-Nichtveganer weniger ''mitfühlend'' als die Nichtveganer von VIVA! sind. Vielleicht kann PETA [People for the Ethical Treatment of Animals] einen ''mitfühlenden'' Schlammschlacht-Wettbewerb zwischen leicht bekleideten Nichtveganern von VIVA! und RSPCA sponsern. Alles für die Tiere. <br /><br />Aber hinter jeder Wolke zeigt sich ein Silberstreif am Horizont. Sicher, ''Bio''-Tierprodukte sind nicht wirklich Bio (offenbar sofern sie nicht in einem von VIVA! beworbenen nichtveganen Restaurant serviert werden). Aber <span style="font-style:italic;">Sie </span>können helfen. Direkt rechts neben der Anklage VIVA!s gegen die RSPCA findet sich die Lösung: ''Helfen Sie uns, Tiere zu retten. Machen Sie eine Spende an VIVA!'' und Sie können einen Betrag einsetzen und auf ''Spenden'' klicken. <br /><br />Oh ja, der standardmäßige Refrain der großen Tierschutzgruppen: Die Lage der Tiere ist schlecht, aber wir können sie verbessern. Schicken Sie uns Geld und wir lösen das Problem. Wir ''retten Tiere.''<br /><br />Das ist natürlich ein Hirngespinst. Das Einzige, was Sie retten, indem Sie auf ''Spenden'' klicken, ist der Job der Leute, die für VIVA! arbeiten. Um das Problem der Tierausbeutung zu lösen, gibt es nur einen Weg. Es gibt nur einen Weg, ''Tiere zu retten'': durch die Verschiebung des moralischen Leitbilds weg von Tieren als Wirtschaftsgüter/ Waren, die als Ressourcen des Menschen existieren, hin zu der Anschauung von Tieren als Mitglieder der moralischen Gemeinschaft, als nichtmenschliche Personen. Aber das wird nicht geschehen – kann nicht geschehen –, solange Tiere auf unserem Teller liegen und wir ihre Haut am Körper und an den Füßen tragen. Das Leitbild wird sich niemals ändern ohne eine starke Bewegung des ethischen Veganismus. <br /><br />Sie können also helfen, aber nicht dadurch, irgendjemandem Geld zu schicken. Sie brauchen keine Organisation oder auf ''Spenden'' zu klicken. Die großen Tierschutz-Unternehmen stehen dem Wandel im Weg, sie erleichtern ihn nicht. <br /><br />Sie brauchen nur <span style="font-style:italic;">Ihre</span> Entscheidung, das Richtige zu tun, zu treffen, und anfangen, vegan zu leben<br /><br />In einem können Sie sich sicher sein: Wenn Sie nicht vegan leben, beteiligen Sie sich direkt an Tierausbeutung. Es gibt keinen moralisch schlüssigen Unterschied zwischen Fleisch und anderen Tierprodukten. Und wie schwer auch immer Sie es finden mögen, vegan zu leben, bedenken Sie nur, wie schwer es für die Tiere ist, dass Sie nicht vegan leben. <br /><br />Veganismus ist besser für Ihre Gesundheit und für den Planeten. Und, was das Wichtigste ist, es ist das moralisch Richtige und Gerechte. Im Licht der grassierenden Islamophobie in Großbritannien (und überall sonst) wäre es vielleicht eine gute Idee, dieses Statement von Ihrer Website zu entfernen. Es hilft nichts zu sagen, dass VIVA! Multikulturalität unterstützt, wenn der Verein Bemerkungen wie diese macht, insbesondere angesichts dessen, dass wir beide wissen, dass Tiere, die betäubt werden, oft, wenn nicht sogar üblicherweise nicht richtig betäubt werden. Deshalb ist mir schleierhaft, warum Sie es für irgend sinnvoll erachten, einen Unterschied zwischen Halal-Schlachtung und konventioneller Schlachtung zu machen. <br /><br />Die VIVA! zugeschriebene Feststellung, von der Sie sich nicht distanzieren: ''Konsumenten können ihren Teil .. beitragen, indem sie Orte boykottieren, die fortdauernd Fleisch von unbetäubten Tieren verkaufen'' sendet überdies eine ausdrückliche, klare Botschaft, dass das Problem Halal- (oder Koscher-)Schlachtung ist und die Lösung darin besteht, Fleisch von unbetäubten Tieren zu boykottieren. Eine sehr viel bessere Aussage wäre gewesen: ''Konsumenten, die dieses Problem kümmert, sollten überlegen, ob sie überhaupt irgendwelche Tierprodukte konsumieren sollten, weil alle Tierprodukte das Resultat des Quälens und nicht zu rechtfertigenden Tötens von Tieren sind.'' Wie ich sagte, hat VIVA! eine Gelegenheit versäumt, hier aufzuklären. In dem Maß, in welchem VIVA! Fleisch von anderen Tierprodukten unterscheidet, hält der Verein die Vorstellung am Leben, dass es einen moralisch schlüssigen Unterschied gibt, und wir wissen beide, dass dies Unsinn ist. Milch und Eier sind für ebenso viel, wenn nicht mehr Leiden verantwortlich, und alle Tierprodukte, egal, wie sie produziert werden, sind das Ergebnis des Tötens von Tieren. Vegetarismus anstelle von Veganismus zu fördern ist logisch nichts Anderes als das Essen von Fleisch von gescheckten Kühen anstelle von braunen Kühen zu fördern. Die von VIVA! angeführte Begründung ist genau die gleiche, die zur Unterstützung von Kampagnen wie die gegen das Essen von Kalbfleisch bemüht wird. Es gibt keinen Unterschied zwischen Kalbfleisch und anderem Tierfleisch oder zwischen Fleisch und anderen Tierprodukten. <br /><br />Die britische VIVA!-Website verkauft Kochbücher, die Rezepte mit Tierprodukten enthalten, und macht Werbung für Restaurants, die Tierprodukte servieren. Wie können Sie angesichts dessen sagen, dass Sie ''bei jeder Gelegenheit Veganismus vorantreiben'? Das ist eine rhetorische Frage. Wenn Veganismus Ihre wirkliche Agenda ist, ersuche ich Sie, damit hervorzutreten und es zu sagen und aufzuhören, das Hirngespinst aufrechtzuerhalten, dass Fleisch in irgendeiner Weise ''schlimmer'' als Milch oder andere Tierprodukte ist. <br /><br />3. Ich ersuche VIVA!, damit aufzuhören, Veganismus als etwas Schwieriges oder Abschreckendes darzustellen. Das ist es nämlich nicht. Tatsächlich ist es, vegan zu leben, ziemlich leicht und heutzutage kann man zu fast allen Nahrungsmitteln tierlicher Herkunft, die man mag, vegane Alternativen bekommen. Wie wäre es mit einer ''Veganismus ist leicht''-Kampagne von VIVA!?<br /><br />Um es zu wiederholen: Wenn Sie Veganismus zur eindeutigen moralischen Grundlinie machen, mögen jene, die über dieses Problem [der Tierausbeutung] besorgt sind, wählen, weniger zu tun [als vegan zu leben], aber sie könnten zumindest nicht auf VIVA! verweisen und einigermaßen zutreffend behaupten, dass Sie einen Stempel der Gutheißung auf die Wahl, weiterhin ''weniger schlimme'' Tierprodukte zu konsumieren, drücken. <br /><br />4. Francione <a href=" </a><br /><br />Liebe KollegInnen, <br /><br />Es macht mich immer traurig, wenn eine [Tiere betreffende] Streitfrage in den Nachrichten kommt und Anwälte der Tiere die Chance verpassen, die Öffentlichkeit über Veganismus aufzuklären, weil sie stattdessen lieber auf den Zug des Neuen Tierschutzes aufspringen und den Menschen ein besseres Gewissen bei der Ausbeutung von Tieren geben. <br /><br />Die britische Zeitung <span style="font-style:italic;">The Mail on Sunday</span> brachte heute eine <a href=";, in der sie berichtete, dass ein großer Teil des in Großbritannien servierten Fleisches <span style="font-style:italic;">halal </span>ist – das Tier wurde dem islamischen Gesetz gemäß geschlachtet. Halal ist das Gleiche wie das jüdische Schlachtritual <span style="font-style:italic;">Kaschnut</span> [jüdische Speisegesetze] und bedeutet, dass ein tiefer Schnitt in den Hals des Tieres gemacht wird, der die Halsschlagader auf beiden Seiten durchtrennt, aber das Rückenmark intakt lässt [Schächten]. So geschlachtete Tiere werden nicht betäubt, und Halal- und Koscher-Schlachtung wird als grausamer kritisiert, als eine, die mehr Schmerzen und Leiden verursacht, als die Schlachtmethode mit Betäubung, die das Tier bewusstlos machen soll, bevor die eigentliche Tötung erfolgt. <br /><br />Viele Menschen in Großbritannien sind aufgebracht ob des Gedankens, dass das Fleisch, das sie essen, von Tieren stammt, die nicht ''human'' getötet wurden.<br /> <br />Ich würde behaupten, dass <span style="font-style:italic;">kein </span>Tier, von irgendjemandem in Großbritannien oder irgendwo sonst auf der Welt konsumiert, in einer Weise behandelt und getötet worden ist, die ''human'' genannt werden könnte, ohne das Wort in obszön missbräuchlicher Weise zu verwenden. <br /><br />Die Story lieferte Anwälten der Tiere also die Gelegenheit, der besorgten Öffentlichkeit zu erklären, dass es so etwas wie ''human'' produziertes Fleisch nicht gibt, dass <span style="font-style:italic;">alles</span> Fleisch – und<span style="font-style:italic;"> alle </span>Tierprodukte – von Tieren stammen, die selbst unter den besten Bedingungen gequält worden sind. Und wir können das Töten von Tieren unter keinen Umständen rechtfertigen, wenn die einzige Rechtfertigung, die wir haben, ist, dass sie gut schmecken. <br /><br />Haben die Anwälte der Tiere von dieser Gelegenheit Gebrauch gemacht?<br /><br />Mitnichten. <br /><br />Stattdessen beschrieben sie das Problem als eines, bei dem es um eine Prakitk einer bestimmten Religion geht. Zum Beispiel wird <a href="; in dem Artikel wie folgt zitiert: <blockquote>Andere Praktiken, die aus religiösen Gründen ausgeübt werden mögen, wie Polygamie oder das Steinigen von Ehebrecherinnen, sind im Vereinigten Königreich nicht erlaubt. <br /><br />Die Freiheit der Religion hat keinen Vorrang vor anderen moralischen Erwägungen, und das Leiden, das diese Form der Schlachtung verursacht, ist so gravierend, dass es uns nicht gestattet, nichts dagegen zu unternehmen. Konsumenten können ihren Teil dazu beitragen, indem sie Orte boykottieren, die fortdauernd Fleisch von unbetäubten Tieren verkaufen.</blockquote> Ich finde es furchtbar traurig, dass VIVA! entschieden hat, dieses Problem als das einer muslimischen Prakitk darzustellen, die Art und Weise betreffend, <span style="font-style:italic;">wie</span> Tiere geschlachtet werden, nicht, <span style="font-style:italic;">dass</span> sie überhaupt geschlachtet werden. Leider haben Muslime kein Monopol darauf, Tiere zu misshandeln, und VIVA!s Kommentare ermutigen Islamophobie, die in den USA und Großbritannien bereits grassiert. Und wie bereits erwähnt, verwenden Juden eine gleichartige Schlachtmethode, und das Schlachten mit Betäubung, von dem jeder denkt, es sei so viel besser als was Muslime und Juden praktizieren, ist gleichfalls wirklich grässlich. <br /><br />Es ist nichts als ein bloßes Hirngespinst, zu glauben, es gebe irgendeinen bedeutsamen Unterschied zwischen Halal-Fleisch und ''humanem'' Fleisch . <span style="font-style:italic;">Alles dies schließt Qualen und Tod ein.</span> Es ist schlicht unehrlich, die Vorstellung zu verewigen, dass wir gleichzeitig Tiere als Mitglieder der moralischen Gemeinschaft betrachten und fortfahren können, sie und aus ihnen gemachte Produkte zu essen. <br /><br />Jeder, der Tiere konsumiert, sitzt, fürchte ich, gewissermaßen im selben Boot. Es gibt kein speziell für Muslime oder Juden konstruiertes Boot. Indem wir halal oder kashrut kritisieren, tun wir so, als ob es einen moralisch bedeutsamen Unterschied [zwischen diesem und anderem Fleisch] gibt und als ob jene, die Fleisch von betäubten Tieren essen, moralisch überlegen seien, weil sie sich mehr um Tierschutz sorgen. Wir beteiligen uns wider einmal an der Lieblingsbeschäftigung des Neuen Tierschutzes, Menschen zu einem guten Gewissen bei der Ausbeutung von Tieren zu verhelfen, solange es ''human'' und mit Rücksicht auf den ''Tierschutz'' geschieht. <br /><br />Ich sollte erwähnen, dass viel von dem in den USA, besonders im Nordosten, verkauften Fleisch aus koscherer Schlachtung stammt; das gleiche Problem existiert also auch auf dieser Seite des Atlantik. <br /><br />In jedem Fall besteht die Lösung nicht darin, dass Sie Fleisch von betäubten Tieren kaufen oder Orte boykottieren, die Halal- oder koscheres Fleisch verkaufen.<br /> <br />Die Lösung ist, dass Sie sich fragen: Wenn mich das Problem kümmert, wenn ich Tierquälerei und unnötiges Töten ablehne, warum esse ich dann <span style="font-style:italic;">irgendwelches</span> Fleisch oder <span style="font-style:italic;">irgendwelche</span> Tierprodukte?<br /><br />Die Antwort darauf ist, dass Sie entweder einräumen, sich nicht wirklich darum zu scheren, oder anfangen, ernsthaft daran zu denken, vegan zu leben. <br /><br />Es ist eine Schande, dass Gruppen wie VIVA! darauf beharren, dass Veganismus etwas für den Durchschnittsmenschen zu Abschreckendes sei, um es verstehen zu können. Das ist es keineswegs, und diese gängelnde Haltung wird zu einer selbst erfüllenden Prophezeiung und fördert die Darstellung von Veganismus als ''extrem''. <br /><br /><span style="font-style:italic;">Was </span>schwer zu verstehen ist: wie eine soziale Bewegung, die Tierausbeutung vorgeblich ablehnt, sich weigern kann, für Veganismus als moralische Grundlinie einzutreten, und sich stattdessen damit begnügt, ''Bio-Fleisch'', ''Bio-Milch'' und ''Bio-Eier'' als Produkte, die solchen aus Massentierhaltung vorzuziehen sind, zu bewerben oder die Vorstellung zu verewigen, es gebe einen bedeutungsvollen moralischen Unterschied zwischen Fleisch und anderen Tierprodukten. <br /><br />Wenn Sie nicht vegan leben: Fangen Sie damit an. Francione <a href=" /><br />Liebe KollegInnen, <br /><br />der heutige Tag markiert den Beginn einer neuen und wichtigen Kampagne für die Tiere:<br /> <br /><span style="font-weight:bold;">Kleiner-Fisch-aus-Großzucht-freier Freitag</span><br /><br />Das Ziel der Kampagne ist es, die Menschen dazu zu ermuntern, freitags keinen Fisch aus Massentierhaltung zu essen und statt dessen andere Tierprodukte zu konsumieren, zu dem Zweck, öffentliches Bewusstsein für das Elend kleiner Fische in Massentierhaltung zu wecken. <br /><br /><span style="font-weight:bold;">Warum Fisch?</span><br /><br />Obwohl es zutrifft, dass alle Tiere leiden und das Leiden jedes Tieres ihr oder sein Leiden und etwas ist, das er oder sie nicht erleben will, und obwohl wir nicht ohne moralische Fragwürdigkeit das Leiden eines Tieres über das eines anderen stellen können, haben wir uns entschieden, uns nur auf Fische zu konzentrieren und das Nichtessen von Fischen aus Großzuchtanlagen und nicht Veganismus anzuregen. <br /><br />Unsere Begründung ist einfach: Die Öffentlichkeit ist nicht intelligent genug oder emotional hinreichend darauf vorbereitet, si+ch der Tatsache zu stellen, dass alle empfindungsfähigen Wesen – nun ja.. empfindungsfähig sind. Das heißt, alle empfindungsfähigen Wesen wollen vermöge ihrer Empfindungsfähigkeit Schmerz, Leiden, Elend und andere negative Zustände nicht erfahren. Obwohl also alle empfindungsfähigen Wesen in diesem Sinne moralisch ununterscheidbar sind, haben wir beschlossen, eine zugegebenermaßen unhaltbare Unterscheidung zwischen Fisch und anderen Tieren zu treffen, weil wir die Öffentlichkeit langsam und schrittweise [zu obiger Erkenntnis] hinführen müssen. Die Wahrheit könnte sie schockieren und ihre kognitiven Fähigkeiten übermannen, so dass wir befanden, dass es besser sei, so zu tun, als sei das Essen von Fischen moralisch etwas anderes als das Essen von anderen [Tieren ] oder als die Verwendung von Tierprodukten als Bekleidung oder für andere Zwecke. <br /><br />Diese wegweisende, sich auf kleine Fische aus Großzuchten konzentrierende Kampagne ist fürwahr eine '<a href="2009/08/einige-bemerkungen-zu-vegetarismus.html">'Einstiegskampagne</a>'', Teil einer Gesamtstrategie, darauf angelegt, eines Tages für Veganismus als moralischer Grundlinie zu werben. Basierend auf den gegebenen Umständen, werden wir dies von heute an gerechnet in etwa vierhundert Jahren tun, aber wir werden selbst dann sehr schonend dabei vorgehen müssen. Gegenwärtig planen wir ''Kleiner-Fisch-aus-Großzucht-freier Donnerstag'' irgendwann im Jahr 2020. Eine Revolution beginnt mit dem ersten Schritt. <br /><br />Die Menschen werden nicht über Nacht zu Veganern, wissen Sie. Und wir tun alles nur Mögliche, um zu verhindern, dass mehr Menschen anfangen, vegan zu leben, indem wir Veganismus fortwährend als schwierig darstellen und sorgfältig darauf achten, für ihn nicht als Prinzip einer moralischen Grundlinie Werbung zu machen. Wir müssen praktisch denken, nicht bloß ideologisch. <br /><br />Wir müssen bedenken, dass viele von uns jahrelang nicht vegan lebten, weil Tierschutzgruppen, in denen wir uns engagierten, uns erzählten, dass verschiedene Tierprodukte zu essen moralisch vertretbar sei. Es ist wichtig, dass Fehler immer aufs Neue wiederholt werden, sonst wären alle unsere Fehler umsonst gemacht. Anstatt zuzugeben, dass es keinen schlüssigen moralischen Unterschied zwischen Fleisch und Milch oder anderen Tierprodukten gibt, müssen wir weiterhin das Hirngespinst aufrecht erhalten, dass Vegetarismus eine moralisch vertretbare Position ist. Es wäre falsch, die Position zu befördern, dass alle Nutzung von Tieren nicht zu rechtfertigen und Veganismus die moralische Grundlinie ist, und dadurch den Menschen etwas Anzustrebendes vorzugeben, unabhängig davon, wo sie zu einem bestimmten Zeitpunkt stehen und ob sie bereit sind, ab sofort vegan zu leben, oder nicht. Stattdessen müssen wir sagen, dass Veganismus unterschreitende Normen völlig in Ordnung sind, um die Menschen sich gut fühlen zu lassen. Wir müssen unseren Stempel der Billigung auf das Konsumieren diverser Tierprodukte drücken. <br /><br />Obwohl wir Angelegenheiten grundlegender Menschenrechte als Fragen behandeln, die eine moralisch richtige und falsche Antwort haben (niemand sagt jemals, dass der moralische Status von Sklaverei, Vergewaltigung, Kindesmissbrauch Meinungssache sei), müssen wir stets vorgeben, dass es sich bei Fragen der Tierethik schlicht um eine Sache der Wahl des Lifestyles oder der Vorliebe oder um reine Ansichtssache handele, moralisch nicht erheblicher als die Frage, wohin man in Urlaub fährt oder welche Art Musik man mag. Wir müssen ''Flexitarismus'' bejahen, sonst erscheinen wir zu rigide und riskieren, dass die Leute denken, wir seien <a href="2010/01/oh-mein-gott-diese-veganer.html">''fanatisch''</a>. Es ist wichtig, Veganismus niemals als moralische Grundlinie darzustellen, als das, wozu wir Tieren gegenüber moralisch verpflichtet sind; es ist wichtig, niemals ehrlich zu sein und von vornherein zu sagen, dass wir das Konsumieren<span style="font-style:italic;"> keines</span> Tierproduktes rechtfertigen können. Menschen verdienen Gerechtigkeit, Tiere nur Barmherzigkeit oder Mitgefühl. <br /><span style="font-weight:bold;"><br />Warum kleiner Fisch?</span><br /><br />Gute Frage! Wir haben uns für kleine Fische entschieden, weil die meisten Menschen Fische nicht niedlich finden und wir dachten, dass sie kleine Fische vielleicht niedlicher als große finden. Und als Anwälte der Tiere sind wir uns des alten Sprichworts ''Niedlich verkauft sich'' wohlbewusst. Wenn man darüber nachdenkt, die meisten Einzelthema-Kampagnen konzentrieren sich auf Tiere, die wir Menschen anziehend finden, ob Babyrobben oder Elefanten, Delfine, Welpen, Kälber, Wölfe usw. Wir haben nicht einmal Tierschutzkampagnen, die sich um Schweine drehen, anlaufen lassen, bevor <span style="font-style:italic;">[Schweinchen] Babe</span> herauskam und Schweine und anderen Nutztiere mit Niedlichkeit punkteten. <br /><br />Obgleich es keinen moralisch erheblichen Unterschied zwischen einem großen Fisch und einem kleinen Fisch gibt (oder zwischen einem Fisch und einer Kuh usw.), haben wir nach reiflicher Überlegung befunden, dass die Öffentlichkeit einfach noch nicht reif für die Vorstellung ist, dass wir überhaupt keinen Fisch essen sollten (oder irgendwelche Tierprodukte), also haben wir uns dafür entschieden, die Sache schonend anzugehen und die Aufmerksamkeit der Leute nur auf kleine, niedliche Fische zu lenken. Und nach <span style="font-style:italic;">Finding Nemo [Findet Nemo]</span> finden mehr Menschen kleine Fische niedlich. Wir müssen die Menschen da abholen, wo sie stehen. <br /><br />Bedenken Sie, wir müssen dies Schritt für Schritt tun. Veganismus ist extrem schwierig. Die großen Tierschutzgruppen sagen es wieder und wieder, also muss es wahr sein, und wir sollten nicht widersprechen. Wie könnten wir nur denken, dass die Menschen alle die herrlichen veganen Speisen, die derzeit erhältlich sind, absolut lecker finden? Wie könnten wir erwarten, dass sie Moral ernst nehmen?<br /><span style="font-weight:bold;"><br />Warum kleiner Fisch aus Großzucht?</span><br /><br />Das ist leicht erklärt. Es hat drei Gründe: <br /><br />Erstens hat Peter Singer, der Vater der Bewegung, klargestellt, dass Tiere kognitiv nicht so komplex wie wir Menschen sind und infolgedessen kein Interesse am Weiterleben haben. <a href="2009/03/peter-singer-und-die.html">Tiere verstehen nicht, dass sie ein Leben zu haben, und ihr Leben spielt moralisch eine geringere Rolle.</a> Es kümmert sie nicht, <span style="font-style:italic;">dass</span> wir sie nutzen und essen; es kümmert sie lediglich,<span style="font-style:italic;"> wie</span> wir sie nutzen. Für sie spielt es eine Rolle, nicht zu sehr zu leiden und relativ schmerzlos getötet zu werden, nicht aber, am Leben zu bleiben. <br /><br />Nun stehen laut Tierschützern Fische ziemlich weit unten auf der Skala geistiger Fähigkeiten und bekommen folglich nicht viele Punkte auf der ''Wie-nahe-ist-ihr-Selbst-Bewusstsein-dem-eines-normalen-menschlichen-Erwachsenen''-Skala. Demnach ist das Problem an sich nicht, sie zu essen; das Problem ist, ihnen Leiden zu verursachen. Wir können uns den <a href="2008/02/tdlicher-luxus.html">''Luxus''</a>, Fisch zu essen, leisten, wenn die Fische ''human''gezüchtet und getötet wurden. <br /><br />Zweitens sind durch das Konzentrieren auf kleine Fische aus Großzuchten alle möglichen bedeutungslosen ''Siege''garantiert, die Menschen sich beim Konsumieren von kleinem ''Bio-Fisch'' wohler fühlen lassen. Wir bemühen uns, <a href=" Temple Grandin</a> zu überreden, neue Einrichtungen zum Schlachten von Fischen zu konstruieren, und <a href=" Whole Foods</a> verkauft massenhaft Fischleichen und stellt Hinweisschilder auf, dass sie ''wild gefangen'' wurden. So wendet sich das Blatt bereits für Fische! Schon ein Sieg! Und es ist nur eine Frage der Zeit, bis all die großen Tierschutzkörperschaften ein <a href="2010/03/partner-in-sachen-ausbeutung.html">''Toter Bio-Fisch''</a>-Label auf Fischleichen geklatscht haben. Diese Label werden dazu führen, dass mehr Geld in die Taschen jener Körperschaften fließt. Denken Sie nur daran, wie viel ''Bio-Fisch'' leisten wird, den Tieren zu helfen!<br /><br />Drittens glauben wir, um es zu wiederholen, dass die Öffentlichkeit nicht reif dafür ist, mit der Vorstellung umzugehen, überhaupt keine kleinen Fische zu essen. Wir regen lediglich an, dass sie keinen kleinen Fische aus Großzuchten essen. Der Öffentlichkeit fehlt die Intelligenz, über die wir verfügen. Wir mögen denken, dass die Argumente zugunsten von Veganismus ziemlich einfach zu verstehen sind, aber es lässt sich gar nicht ermessen, was für Schwachköpfe die meisten Menschen sind. <br /><br />Uns ist bewusst, dass es einige Anwälte der Tiere gibt, die diese Kampagne kritisieren und vorschlagen werden, dass wir die Öffentlichkeit über Veganismus aufklären sollten; dass wir das Leitbild verändern sollten dadurch, die Diskussion weg von der Behandlung [von Tieren] hin zu ihrem Genutztwerden zu bewegen. Diese Kritiker sind schlicht elitäre Spalter, die nicht zur Kenntnis nehmen, wie unglaublich dämlich die Öffentlichkeit ist. Diese Kritiker begreifen nicht, dass begründeter Widerspruch spaltet. Sie begreifen nicht, wie wegweisend diese Kampagne ist. Erst im April dieses Jahres hat <a href="2010/09/rette-einen-seehund-iss-nicht.html">HSUS eine Kampagne angekündigt, süße Robben durch das Boykottieren von kanadischen Meeresfrüchten und das Essen von Fischen, die in anderen Ländern gefangen und vermarktet werden, zu retten.</a> Und HSUS hat nicht einmal einen Unterschied zwischen kleinen und großen Fischen gemacht! Unsere Kampagne geht da viel, viel weiter, zumindest freitags. Obschon wir uns nicht dafür aussprechen, alle kanadischen Meeresfrüchte zu boykottieren, treten wir für einen Boykott der kleinen Fische aller Länder an Freitagen ein. Wir fordern HSUS in aller Form dazu auf, ihre Kampagne dahingehend zu ändern, kleine Fische aus Kanada <span style="font-style:italic;">und </span>kleine Fische aus allen anderen Ländern zu boykottieren, aber nur freitags, weil wir nicht zu radikal sein wollen. <br /><br />Obwohl es wahr ist, dass viele Menschen einfach Steak, Eier und Eis anstelle von Fisch oder vielleicht ''wild gefangenen'' Fisch von einem ''Bio-Fisch''-Händler essen werden, müssen wir <span style="font-style:italic;">jetzt</span> etwas tun, um Tieren zu helfen, und dies ist das Beste, was wir ausknobeln konnten. <br /><br />Abschließend denken wir, dass diese Kampagne wirklich Anklang finden wird, weil die Leute sehr wenig im Sinne einer tatsächlichen Änderung tun müssen. Solche Kampagnen machen Unterschiede, wo keine sind, ermutigen allgemein dazu, Tierprodukte zu konsumieren und gehen davon aus, dass die Öffentlichkeit unfähig ist, eine simple Idee zu verstehen. Hören Sie einige Gedanken zum Reden mit Nichtveganern über Veganismus in meinen kürzlichen <a href="; zu diesem Thema. <br /><br />Anwälte der Tiere, die Tierausbeutung insgesamt wirklich ablehnen, sollten nicht Vegetarismus (oder irgendetwas, das weniger als Veganismus ist) als Sprungbrett zum Veganismus anregen. Demnach ist hinsichtlich des Ausmaßes von Tierleid eine vegetarische Ernährungsweise mit viel Mich, Eiern usw. möglicherweise nicht besser. <br /><br />Das Argument, dass die Öffentlichkeit Veganismus schwierig findet, ist eine selbsterfüllende Prophezeiung: die großen Tierschutzorganisationen sind hier die Hauptschuldigen, indem sie die Vorstellung, Veganismus erfordere heroische Opferbereitschaft und Willenskraft, permanent bekräftigen. Aber selbst wenn die Öffentlichkeit Veganismus schwierig findet, heißt das nicht, dass sich unsere Botschaft ändern sollte. Die symbiotiche Beziehung zwischen großen Tierschutzorganisationen und institutionellen Tierausbeutern ist offenkundig, wenn wir sehen, wie beide Seiten in ein Drama verwickelt sind, in dem Anwälte der Tiere eine wirtschaftlich angreifbare Praktik ins Visier nehmen; die Tierindustrie inszeniert einen Scheinkampf; die Reform oder irgendeine Modifizierung der Reform wird schließlich angenommen, weil sie der Tierindustrie nicht schadet und gewöhnlich hilft; die Tierschützer erklären den Sieg; die institutionellen Tierausbeuter sonnen sich im Lob, das sie von Anwälten der Tiere bekommen. Nur die Tiere sind die Verlierer. <br /><br />Zweitens ignoriert Newkirk bequemerweise, dass das unerbittliche Betreiben dieser Tierschutzreformen durch PETA und andere Gruppen des Neuen Tierschutzes und die Behauptungen, diese Reformen machten Tierausbeutung ''humaner'', die Öffentlichkeit sich beim Konsum von Tieren <span style="font-style:italic;">wohler </span>fühlen lassen, und dass infolgedessen der Konsum zunimmt. Interessanterweise ist zu bemerken, dass der Pro-Kopf-Verbrauch von Tierprodukten ansteigt und nicht sinkt. Es ist nichts anderes als ein großer Stempel der Gutheißung im Namen der ''Tierrechte''.<br /><br />PETA hat es Menschen, die bei KFC Kanada oder McDonald's essen oder ''Bio-Fleisch'' oder andere ''Bio''-Tierprodukte bei Whole Foods einkaufen, ermöglicht, sich zu ''Anwälten der Tiere'' auszurufen.<br /><br />Es sollte zunehmend klar sein, dass die <a href="2009/06/bio-fleisch-menschen-sich-beim-essen.html">''Bio-Fleisch''-Bewegung </a>ein gigantischer Schritt rückwärts ist. <br /><br />Drittens versteht Newkirk den wichtigsten Punkt in der Debatte, ob eine klare vegane moralische Grundlinie oder Tierschutzreformen zu verfolgen sind, nicht. <br /><br />Es ist ein Nullsummenspiel. Das heißt wir leben in einer Welt begrenzter Ressourcen. Vielmehr ist es <span style="font-style:italic;">einzig </span>das Vorantreiben des Veganismus – durch das Arbeiten an der Nachfrageseite der Gleichung anstatt an der Angebotsseite (das Konzentrieren auf Tierschutzreformen) –, das Leiden vermindert – und Tod. <br /><br />Ein damit verbundener Punkt ist, dass nicht nur das Leiden von Belang ist, wie Newkirk suggeriert; das Töten ist ebenso von Belang. Offenbar folgt Newkirk der <a href="2009/03/peter-singer-und-die.html">Anschauung Peter Singers, dass Tiere in den meisten Fällen kein Interesse am Weiterleben haben</a>, sondern nur ein Interesse daran, nicht zu leiden. Ich lehne diese Ansicht als faktisch unzutreffend ab. <br /><br />Zu leugnen, dass jedes empfindungsfähige Wesen ein Interesse am Weiterleben hat, ist absurd. Alle empfindungsfähigen Wesen wollen am Leben bleiben, begehren oder ziehen es vor. Die Tierschutzposition, die Newkirk und Singer vertreten, ist, dass ein Tierleben an sich keinen moralischen Wert hat. Vielleicht ist dies der Grund, warum PETA die meisten der Tiere, die der Verein in seiner Norfolker Einrichtung aufnimmt, <a href="2010/03/acht-tiere.html">tötet</a>. Nur glaube ich aufrichtig, dass sie sehr, sehr im Unrecht ist. <br /><br />Wenn Sie nicht vegan leben, erwägen Sie bitte, es zu tun. Schenken Sie der irrigen Zweiteilung von Fleisch und anderen Tierprodukten keinen Glauben. Es gibt keinen moralisch schlüssigen Unterschied zwischen Fleisch und anderen Tierprodukten. One of the unseen victors of Tuesday’s presidential elections was Bitcoin. BTC prices rose to over $720 per bitcoin on early news of a Trump win. Since then, prices have corrected and Bitcoins are trading at around $709 – where they were prior to the election. Shares of the Bitcoin Investment Trust (OTCQX:GBTC) rose to nearly $107 early Wednesday and have since likewise returned to the $101 level as of mid-day Thursday. What we’ve been seeing recently with the Brexit vote and China’s recent announcement to further devalue their currency is Bitcoin becoming a hedge against currency volatlity as parties with interests in important elections seek to hedge against market and currency volatility. Opinions Are Mixed Regarding Bitcoin As A Safe Haven All that seems to be good for Bitcoin which,due to recent monetary policy decisions by China, is being boosted by demand for safe havens after Trump’s suprise victory. Prices were up to $733 at one point after being stuck in the $700-$709 range since November 4. Crypto Compare CEO Charles Hayter wrote in an email to CNBC Wednesday morning: “Bitcoin is yet again acting as a form of digital gold and correlating strongly with the commodity – when there is uncertainty safe haven assets see a boost”. He also commented on the idea that the original crypto currency is seeing boosts in markets where markets can temporarily be rattled by unexpected political or economic catalysts: “As with Brexit, bitcoin is seeing an upward jolt on the back of Trump’s election and the resultant lack of clarity on the global stage,” he added. After Brexit, the price of Bitcoin jumped from $550 to $650. Not everyone feels the same way about Bitcoin. Gil Luria, director of research at Wedbush Securities disagees. He told Coinbase, a popular California-based bitcoin exchange this morning – “Bitcoin has plenty of risks that are unique to the technology, which is why it is best suited for investors that understand those risks,” Luria said. “I consider a safe-haven asset an asset that has inherent downside protection, which I do not believe bitcoin will have any time soon.” What you need to ask yourself before making that decision for yourself is if Bitcoin’s unique qualities as well as its ease of accessibility will be a future catalyst for growth by investors who don’t necessarily agree with the libertarian philosophy that has driven growth in Bitcoin since 2011. In regards to Bitcoin, the future is uncertain. Not all investors are convinced but the charts suggest there is still room for growth. Let’s take a look at some charts and what general trends we can determine when it comes to “the bigger picture”. The above table gives us details about GBTC’s performance since it first starting trading in May of 2015. In that nearly year and a half, GBTC has returned 102%, or nearly 60% annualized. Bitcoin’s trends are overall creeping upwards. Future Risk and Reward Catalysts The Bitcoin Investment Trust and Winkelvoss Bitcoin Trust ETF (Pending:COIN) provide the opportunity to further diversify your save haven assets such as precious metals into cryptocurrency. There are a few good reasons to believe Bitcoin will remain an appreciating asset that can further improve portfolio’s yields. Here are three: Fiat currencies require increases in money supply to support inflation while gold and silver prices are driven in part by mining yields and industrial usage, but Bitcoin’s lifetime supply is capped to 21 million coins. On top of that, the rate of creation of new bitcoins was halved this summer from 25 bitcoins BTC per block to 12.5. Greece, Venezuela, Argentina, Zimbabwe, Cyrpus… The list of fiat currencies losing purchasing with every blink of the eye can be partially attributed to sharp increases in money supply. China has held discussions with Citi (NYSE:C) and Deloitte and they’re already working on a blockchain. Blockchain encryption technology is peaking a lot of interest in the FinTech industry and confidence in Bitcoin’s future value has been returning. Whatever your reservations about the risks and rewards of a digital currency are, BTC has seen a successful first five years as a remittance technology. The Bitcoin itself is highly robust. Its big selloffs were primarily due to embezzlement and thefts which exists in every form of money. As investors, what we need to look at are the future prospects. The decentralized remittance technology does have its downsides including ecological implications. All those downsides, however, have to be weighed against its upsides. The lack of centralized control and ease of use provide us with a first of its kind – a technology allowing us to send money to anyone anywhere at any time at the click of a button. Its blockchain technology is becoming increasing popular as banking and financial giants begin to see the benefit in such a highly encrypted and low-cost method to remit transactions. I’m bullish on Bitcoin and the GBTC trust long term. Many new products backed by blockchain technology are coming and going but the Bitcoin is the original and, ultimately, blockchain technology is going to remain closely identified with Bitcoin for the foreseeable future. (NASDAQ: AAPL) released the newest iteration of its OSX operating system earlier this week to complement the release of the 2016 line of Macbook Pro and Macbook Air notebooks. Along with the latest software and security updates, macOS Sierra included hidden Apple Pay images featuring the new Macbook Pro set to be announced by Apple later today (watch the event live). The announcement couldn’t have come sooner given Apple’s decline in revenue growth; After all, personal computer, specifically laptops are what made Apple famous and the pressure is on once again for Apple to deliver. Apple isn’t only out to please investors but also brand loyalists which has been holding off on purchasing new laptops in anticipation of the long awaited update to the brand’s most popular series of notebooks. The new line will feature updated hardware for more power, better batter life and a new design reminiscent of its predecessor but that’s not all Apple fans are excited about. The new line of Macbook Pro laptops will feature a Magic Toolbar OLED Panel which will replace the escape and function keys. The panel will let you access unique features in programs as well as access user settings, options, and shortcuts. It will also feature touch ID and more. The new notebook will possibly will shrug its 3.5mm headphone jack in favor of USB-C just like the iPhone 7 has. Of course, a converter can be purchased. A new Macbook Air will be introduced as well. The question is: is it enough to restore investor confidence in Apple’s ability to move up the ranks in the list of top 5 PC manufactures? Macintosh branded PC shipments have declined 8.3% year over year. In the second quarter of 2015, Apple shipped 4.82 million units which amounted for 7.4% of market share. In the same time period this year, Apple shipped roughly 400 thousand less units and saw market share decline to 7.1%. Apple trails behind ASUS by .1%, and anywhere between 9 and 14 points behind Dell, HP and Lenovo.     Apple announced its fiscal Q4 earnings (which ends Sep. 24) yesterday and put a focus on iPhone shipments which beat analyst expectations by nearly 700,00 units (45.51 million to 44.8 million). Apple also reported upgraded guidance for Q1 2017 with expected revenues between $76 and $78 billion with a cash dividend of $0.57 per share. International sales accounted for roughly 62% of revenue weighed down by slow business in China which CEO Tim Cook has cited slow LTE adoption rates which he expects to turn around by Q2 2017. Services business grew 24% to $6.3 billion as well, setting the company’s all-time record growth in the segment featuring the apple store and content. So, growth in iPhone shipments and app sales have been fueling growth in their segments but notebooks shipments, which were a huge contributing factor to Apple’ success in the 2000’s and preceded the iPhone as Apple’s most high-selling product, have been waning. Apple has timed this release right in time for the holiday season and will likely finish up the year strong. After all, many Apple enthusiasts have been holding off purchasing a new laptop in anticipation for the new Macbooks. Despite all that, Apple’s stock tumbled after the release and closed out Wednesday at $115.59 (-$2.66/-2.25%). Investors are mostly concerned about Apple’s future catalysts for growth especially given all the buzz regarding the downsizing of Project Titan, their still largely undisclosed R&D automotive project. Although unverified, rumors suggest Apple has given Project Titan until the end of 2017 to research and develop an automated driving system. Recent rumors of an acquisition of McLaren had investors hoping for faster than anticipated news on the project but a deal hasn’t been substantiated and rumors have suggested the project’s ambitions have been downsized.     Apple is really gearing up to see steady and consistent growth in virtually all product segments going into 2017. Apple can deliver better than expected growth in the laptop segment in Q1. Given the demand from enthusiasts and the holiday shopping season, the new line of notebooks will likely be on route for a great quarter. Whether or not that’s enough to drive a rally in the stock is up to debate but it’s still important to keep in mind that next quarter will see solid performance in virtually all segments and China might even start to show signs of turning around. Apple doesn’t seem to be set to reveal any new products anytime soon and that’s part of the reason why some aren’t expecting Apple to deliver on the same type of constant growth it has over the last 20 years. My opinion is “So What?”. If the changes to the Macbook Pro are widely accepted, we’re talking serious growth potential in the segment. Aside from Asus, who ships just nearly as many PCs as Apple, Apple’s next competitor in the PC industry would be Dell, which shipped nearly twice many PCs as Apple in Q2. Apple does have the opportunity here regain market share in the PC space and can build on notebook sales momentum with introduction of a new iMac early in 2017. In other words, if this thing is a hit, Apple will be raking in some serious cash.     AAPL has been trading a few bucks short of its six-month high near $118 but has been building steady momentum throughout the month despite the news on Project Titan. The stock is still roughly $8 away from its 52-week high of $123.82. Buying opportunities exist if you believe a turnaround in revenue growth can be fueled by growing computer and iPhone sales. If you’re waiting hints of the next big thing from Apple to signal a buy, you’ll be waiting for a while just like the rest of us. Many of the jobs once held by our youth are not available to them because they have been replaced by more mature individuals. They have taken to the media and social networking to find employment. <br /> <br /> They are falling victim to traps set for them appearing online as harmless employment opportunities. text-align: center;"><a href="; imageanchor="1" style="margin-left: 1em; margin-right: 1em;"><img border="0" height="342" src="; width="400" /></a></div>Antoinette Harrell and Robin Foster, Hosts of Nurturing Our Roots on internet radio and NOATV, wishes to honor Freshman Ambassadors, Tyler Fisher, Jaidon Price, Aaron Mullin, Ileesha White, Colin Stearns, Terry Davis, and Amber Reynolds of South High School in <a class="zem_slink" href="; rel="geolocation" title="Columbus, Ohio">Columbus, Ohio</a>. &nbsp;What started as a school project has evolved into a major act of community service as these students are the catalysts for bringing much needed school supplies to school children of the <a class="zem_slink" href="; rel="wikipedia" title="Mississippi Delta">Mississippi Delta</a>. <br /> <br /> These students are a shining example to us all of compassion and putting others above self. &nbsp;Antoinette Harrell, is not just a genealogist and a peonage researcher. &nbsp;Her knowledge has taken her to a new level. She is a relentless advocate of those who are suffer the effects of generations of poverty subsequent to slavery. <br /> <br /> Her first contact with the South High came when Dr.&nbsp;<span class="Apple-style-span" style="font-family: Times, 'Times New Roman', serif;">Johnetta D. Wiley,</span>&nbsp;principal of South High School, called to set up an interview at the request of Tyler Fisher. &nbsp;Tyler contacted Antoinette Harrell for an interview to learn more about 20th Century slavery, poverty, and how she became involved. <br /> <br /> <br /> <div style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px;">I really like the way Ileesha White explained how they made the decision to chose a community within the United States: &nbsp;"<span class="Apple-style-span" style="font-family: times, serif; font-size: 16px;">We've come to a conclusion that we should start with the United States before venturing off to others when people are in need here!" &nbsp;Ileesha explained that they wanted to inform the student body and the staff members about what they learned from the YouTube videos and the interview with Antoinette so they all could help "make a change in the country and inform others" about what is going on right here in the United States.</span></div><div><span class="Apple-style-span" style="font-family: times, serif; font-size: 16px;"><br /> </span></div><br /> This is a slide show that the students created using interviews:<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <center><br /> <iframe allowfullscreen="" frameborder="0" height="349" src="; width="425"></iframe></center></div><br /> The students also interviewed teachers and other students about peonage, and it is so wonderful to see them helping to educate their community. To me, there is no greater power than a student who has made his or or mind up to bring about change. What I am hoping to achieve here is to introduce the South High students to those people they saw in the video. I would like the young people in the Delta to tell them what their everyday life is like. I want the students to interact with each other. I just want to listen and learn. &nbsp;I want to see these children compare their lives having resources versus having no resources. I want to take the students to a town where there is no library, no bus stop, no mall. I remember working sometimes as long it was daylight. As I sing in my song when there was just moonlight, we would be out there picking cotton then. I remember those times.<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> I had a couple of brothers that did not go to school. They would mostly do work. That happened to a lot of the black males. When they did not have a mule or a cow or a plow, they used one of them to do that," &nbsp;said Sheba.</div><br /> Queen Sheba said her mother always hated Mississippi. &nbsp;"She always wanted to leave there. When she left in '64, I always tell everybody she escaped Mississippi. She was just so glad to get away from there.&nbsp;It was in '64 when my mom first left. It was in May of '65 when she took us out of there, but there were so many of my friends that I knew whose parents just left them there. They left them with relatives and friends, and they didn't come back to get them. <br /> <br /> I remember how we would pick cotton all summer, and at the end of the time of picking the cotton, there was no money. My mom would have a list at the grocery store that the white man owned property that we were sharecropping. All during the winter, you had to go there and get things on credit. So what would happen is at the end of picking all the cotton, you would have nothing because you would owe it all to the owner, the “boss man.” You would wind up no having anything. <br /> <i><br /> </i><br /> <i>My mom just got tired of that. She really got tired, so what she did one night was... She did not want to tell my grandparents that she was leaving because she knew they were going to be upset about it. &nbsp;A</i><i>t that time I think it may have been about seven of us. She told us all that she was going to leave and that she was going to come back and get us. We went to the field this particular day, and she left us n the field. There was a sharecropper's bus, and she left and went to Florida, and our grandmother and grandfather found about it a little later on that night that mom was gone.&nbsp;</i><br /> <table cellpadding="0" cellspacing="0" class="tr-caption-container" style="float: right; margin-left: 1em; text-align: right;"><tbody> <tr><td style="text-align: center;"><a href="; imageanchor="1" style="clear: right; margin-bottom: 1em; margin-left: auto; margin-right: auto;"><img border="0" height="400" src="; width="238" /></a></td></tr> <tr><td class="tr-caption" style="text-align: center;">Image at <a href="; </tbody></table><br /> <br /> <div style="margin-bottom: 0in;"><i>It was something within her that drove her away from that place because she knew it was not right. She knew it was not right, and I guess that's the same thing in me. There is something that is driving me about Mississippi. There is something in me about that song, “Strange Fruit.” I love that song because there is something within us. The same thing that when there was something within Harriet Tubman. There was something in them. A lot of the people back then could not read or write like my grandfather. There was something within them. Our ancestors speaking within our genes, within our DNA telling us. It is in us. Move on! Continue! This is not where you are supposed to be. This is not it! Keep going! And my momma, there's something within her that made her not leave her children there. She wanted to come back and get her children. Something within her."</i></div><div style="margin-bottom: 0in;"><i><br /> </i></div><div style="margin-bottom: 0in;"><br /> <br /> <br /> <br /> <br /> Queen Sheba is a Blues singer and a courageous woman. &nbsp;She wants to help others who have experienced similar things in their life. &nbsp;She was destined to tell her story through her music:</div><div style="margin-bottom: 0in;"><br /> </div><div style="margin-bottom: 0in;"></div><div style="margin-bottom: 0in;"><i>"Back home in Mississippi I was brought up singing in the fields and in the churches. That's how I started singing. It was a part of me because my father was a singer. My mother was a singer. I came from a whole family of singers. So it was just a natural gift. As far as the Blues, I really did not start singing the Blues until years later after I left Mississippi. I was ashamed to tell people I was from Mississippi. I didn't even want people to know I knew anything about the Blues.&nbsp;</i></div><div style="margin-bottom: 0in;"><i><br /> </i></div><div style="margin-bottom: 0in;"><i>&nbsp;Later on, as I got older, my true self began to come out, and someone observed me, a very wonderful pianist by the name of Josiah Israel. He would observe me singing. I would do a lot of Billie Holliday songs, standards, and jazz and stuff like that. He was telling me that the market was pretty tough for me because I was a little older and a lot of young ladies were out doing their thing. He felt that a market in the Blues would be perfect for me. I had the sound. I had the look. I had the history. I had been through it all. I had been dogged out by men, and been dogged out by life itself.&nbsp;</i></div><div style="margin-bottom: 0in;"><i><br /> </i></div><div style="margin-bottom: 0in;"><i>So I was really prepared for it. As he was telling me these things, I said, 'that is my roots, singing the Blues.' &nbsp;That is how I started getting into the Blues. I am being true to myself really instead of being out there trying to do all these other things which are not me. &nbsp;</i><i>I could do all those other things, but my heart and soul is there in the Blues. That's me. That's where I came from. That's why I am into it."</i></div><div style="margin-bottom: 0in;"><i><br /> </i></div><div style="margin-bottom: 0in;">Queen Sheba has developed a healthy perspective about the tragedies she has lived through. In fact, she is excited to share the lesson she has learned. &nbsp;</div><div style="margin-bottom: 0in;"><br /> </div><div style="margin-bottom: 0in;"></div><div style="margin-bottom: 0in;"><i>"My grandfather couldn't read or write, but he would travel different places. One thing he told me, he said, “Listen, anytime you are going someplace, like you are on the bus. Like you are on the Greyhound Bus and they make a stop at a rest area, and you cannot read the signs and you want to know where the bathroom is or where the food is at. All you need to do is watch the people. Watch the people because most of the time they are going to the bathroom or they are going to the food. So that has always stood out with me about my grandfather. He could not read or write, and I always wondered how he could keep up with counting money.</i></div><div style="margin-bottom: 0in;"><i><br /> </i></div><div style="display: inline !important; margin-bottom: 0in;"><i>My grandmother loved baking cakes, and I loved when they made the quilts. They did a lot of canning, canning peaches and different stuff. She was very good at that, and I loved how she used to dress so...</i></div><div style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px;"></div><div style="margin-bottom: 0in;"><div style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px;"><i></i></div></div><div style="margin-bottom: 0in;"><div style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px;"><i>nice with her pretty hats and all that.</i></div></div><br /> <div style="margin-bottom: 0in;"><i></i></div><i>So all that is still a part of me because even in my little yard now I am growing okra. I could still live off the land. That is in me. A lot of these people nowadays do not even know about that stuff. When you talk about the chicken and wringing their necks and all that stuff.</i><br /> <div style="display: inline !important; margin-bottom: 0in;"><i><br /> </i></div><i> People still need to know how to live off the land. If you go in the woods, you need to know what kind of stuff you can eat and survive on in case you get lost in the woods. Most people don't. I knew from a child that when you a walk in the woods, you have to respect the woods. You can't just go walking in there not looking where you are going. You have to respect the animals in the woods. Snakes and stuff are everywhere. You have to know how to walk. Most people do not know how to do that. That is staying connected to nature, I believe.</i><i> </i><br /> <div style="margin-bottom: 0in;"><i><br /> </i></div><div style="margin-bottom: 0in;"><i>I remember how we used to lay our head on the ground and listen to the ground and could hear animals coming. We could hear the rain coming because in the Delta, it is flat so you can ear stuff for a long ways. When you put your head on the ground, you can hear stuff coming from a long way off. What people remember that kind of stuff? We are losing it. People are ashamed of this kind of stuff now. This is what I am finding out. They are so tied to this new technology where everything is on the computer. Just hit a button and that is it. I think it is good that we have all this stuff, but I think the knowledge of those still should carry on just in case the computer one day does not work or just in case one day something happens.</i></div><br /> <div style="margin-bottom: 0in;"><i><br /> </i></div><div style="margin-bottom: 0in;"><i>&nbsp;I remember we used to go get our fish. We used to do something they call muddying where you get over in the pond and muddy up the water. When you muddied up the water, all the fish would come to the top. Then we would have a little basket or a little dress or something to pick up the fish. We used call that muddying, muddying the water to get fish. Now I believe this kind of knowledge came all the way from Africa. This knowledge I am quite sure I learned from my mom or somebody, but that is how we got our fish and our craw fish and all that stuff. Muddying up the water and using little dresses like a net to get the fish. That was truly wonderful.</i></div><div style="margin-bottom: 0in;"><i><br /> </i></div><div style="margin-bottom: 0in;">Queen Sheba can share many skills for survival that were passed down to her from her mother and grand parents. &nbsp;They developed a particular way of living and getting by based on the difficult times they saw as cotton sharecroppers:</div><div style="margin-bottom: 0in;"><br /> </div><div style="margin-bottom: 0in;"></div><div style="margin-bottom: 0in;"><i>"My grandmother and grandfather and all of them would talk about not having enough this and that and not having enough food. &nbsp;My grandmother and all of us wished that when we saw that Greyhound bus coming, we wished we could just get on that bus and leave. We all were hopeful about getting out of there one day.</i></div><div style="margin-bottom: 0in;"><i><br /> </i></div><div style="margin-bottom: 0in;"><i> I remember as far as my eyes could see there was cotton everywhere. There were huge fields. &nbsp;About five families would be on one plantation, and each family had a certain set of cotton field to work as I recall. The plantations we were on were really big.&nbsp;My momma was telling me how this one particular person that was next us us had himself and his wife and one child. She and all her little kids outdid us picking cotton. If you were big enough to pick up a bole of cotton, you were in the field. If you were one year old and walking, you could pick up a bole of cotton. Equally or more important is the fact that after slavery was outlawed, the slave master engineered a new system to extract the labor and resources from African Americans involuntarily. How does one go about revealing a system&nbsp; such as this which if you call it slavery or peonage, people deny it exists because it has been declared illegal under those terms? Well, we have living examples of people who are coming forward to share their experiences living in modern slavery in America.<br /> <br /> Recenty on Nurturing Our Roots internet radio, we interviewed Blues singer, <a href=", Queen of the Mississippi Blues</a>.&nbsp; See album, <a href=" on My Roll</a>.&nbsp; After her mother became frustrated about working for the "boss man"&nbsp; growing and picking cotton and always owing him at the end of the year, she decided to leave without even telling her parents.&nbsp; Her children watched her depart from the field late at night.&nbsp; She was gone for about nine months.&nbsp; She, unlike most parents, returned to <a class="zem_slink" href="; rel="geolocation" title="Sunflower, Mississippi">Sunflower, Mississippi</a> for her seven children in 1965.&nbsp; There was only one catch.&nbsp; Athough the family had worked hard to bring in the cotton crop in her absence, the "boss man" still claimed Sheba's mother owed him and had to pay in order to keep anything from happening to her before he would let her leave that place with her children to go to Florida.<br /> <br /> Sheba's mother would work all year, and after the debts were settled, she barely came away with forty dollars for a year's work.&nbsp; That, my friends, was the labor system that took the place of slavery.&nbsp; It was not called slavery anymore, however, entire families worked in cotton fields for no pay because the books were adjusted to show they had over-extended their credit.&nbsp; They would remain trapped in a system where they would never know increase.&nbsp; According to Sheba, cotton picking has been replaced today by catfish farming.<br /> <br /> When her family escaped from <a class="zem_slink" href="; rel="historycom" title="Mississippi">Mississippi</a> in 1965, they went to Florida where at the age of 12, Sheba lived in a labor camp and worked alongside the tomato pickers with other Mexicans and Blacks.&nbsp; The new condition was only slightly fairer than the one they had left.<br /> <br /> So, even though the freedmen in <a class="zem_slink" href="; rel="geolocation" title="Galveston, Texas">Galveston, TX</a> were late in hearing about Emancipation, we are here to issue a second such notice which is more than 150 years overdue.&nbsp; A form of slavery continued well into the 20th Century for thousands of African Americans.&nbsp; Millions of records documenting involuntary servitude exist in the National Archives and local courthouses and libraries.&nbsp; Only the term "slavery" was nullified because it could not be applied after being declared illegal weakening the ability to prosecute while the system still existed and even intensified. <br /> <br /> <b>We will have more to share in upcoming posts on Sheba's experiences, but for now in response to the various <a class="zem_slink" href="; rel="wikipedia" title="Juneteenth">Juneteenth</a> celebrations we have this to offer:</b><br /> <br /> "I am here to issue a telegram that is over 150 years overdue.&nbsp; I would like to know how many Juneteenth celebrations will disclose the fact of slavery in all forms and slavery into the 20th Century?&nbsp; I would like to know how many of them will be including the fact that slavery did not end with Emancipation.&nbsp; Juneteenth should be about mor

Over the past ten years, <i>Absinthe</i> has promoted international literature and art and showcased contemporary work from a variety of European countries. Under the keen eye of its founding editor Dwayne D. Hayes, the magazine has come to be recognized as a leading publication for translated literature and has played a crucial part in introducing important contemporary voices from Europe to American readers. <br /><br />The relocation of <i>Absinthe</i> to the Department of Comparative Literature will allow the journal to benefit from the expertise of one of the strongest comparative programs in the nation, and provide a sustainable publishing model to continue <i>Absinthe</i>’s commitment to promoting foreign literature in the United States. At the University of Michigan, <i>Absinthe</i> will provide a space of encounter between new voices in foreign literature, experienced translators, as well as translators in training. <br /><br />Starting in summer 2014, <i>Absinthe</i> will serve as a platform from which to expand the Department of Comparative Literature’s ongoing engagement with translation activities across the Michigan campus and beyond. The magazine will offer graduate students the opportunity to gain professional experience in editing literary translations and identifying important new trends in contemporary world literature. It will also provide opportunities for collaboration with colleagues across departments, both within and beyond the University of Michigan, on topics for special issues. <br /><br />In the fall of 2014, The Department of Comparative Literature will resume <i>Absinthe</i>’s biannual print publication as well as create an entire new online presence for the magazine. Two doctoral students in Comparative Literature will serve as co-editors for the first two transitional issues. Their task will consist of maintaining the legacy of <i>Absinthe</i> as established by Hayes, while broadening the magazine’s current focus on European literature to include texts that reflect the very wide range of geographical interests, talents and affinities present in the Department of Comparative Literature at the University of Michigan. <br /><br />The first issue in <i>Absinthe</i>’s new incarnation (Fall 2014) will focus on the topic, “Precarious Europe: Writing in Uncertain Times.” Edited by Etienne Charriere, this issue will engage the current stage of crisis across the European continent. In order to understand how literature is written in times of acute precariousness, we look forward to publishing contemporary translated texts from a variety of spaces in Europe –with a special focus on the margins of the continent– that all reflect the ongoing climate of economic and political instability, as well as the profound identity crisis that has affected the entire continent in varied ways. <br /><br />The topic of the next issue (Spring 2015) will be “Pen and Brush: Europe and China in Dialogue.” Edited by Emily Goedde, it will focus on literary and artistic conversations between Europe and Mainland China, Hong Kong, Taiwan, Singapore, Malaysia, and other Chinese communities across Asia. In drawing from European writers (be they of Chinese origin or not), as well as from writers from the Sinophone world who live in or write about Europe, this issue will present a rich body of literary and artistic work that negotiates and illuminates contemporary cosmopolitanisms. It will also offer an opportunity to introduce new examples from exilic and migrant literature.<br /><br />Future issues of <i>Absinthe</i> will be edited by graduate students and faculty in the Department of Comparative Literature and related departments and disciplines. This retitle is taken from the unattributed epigraph to Ferry's piece, and differs from my own translation in its interpretation of that famous French conundrum, the imperfect tense. Bowles' volume of translations from Spanish and French is interesting for the liberties it takes as well as its eclectic selection, which includes work by Borges, surrealists&nbsp;Giorgio di Chirico and René Magritte, poet Francis Ponge, Ramón Sender, and another personal favorite of mine, baroque fantasist André Pieyre de Mandiargues. Among the countries represented are France, Czechoslovakia, Israel, Japan, Spain. Two relative newcomers to the comics scene did very well with double nominations:<o:p></o:p></div> <div class="MsoNoSpacing"> </div> <ul> <li>Austria, with Ulli Lust’s debut memoir of roadtripping Europe in her punk youth, <i>Today Is the Last Day of the Rest of Your Life</i>, translated by the late Kim Thompson from Fantagraphics. I got to see Lust when her graphic memoir debuted in France at Angouleme in 2011, and <a href=" about seeing her speak</a>. It was well-received there, an official selection of the festival.</li> <li>Flanders (Flemish Belgium), with Judith Vanistendael’s <i>When David Lost His Voice</i> from UK indie SelfMadeHero, which did awesome this year overall with 7 nominations in 5 categories.</li> </ul> <div class="MsoNoSpacing"> These nominations reflect the hard work of translators like Jessica Cohen, Nora Mahony, Brian &amp; Sarah Evenson, Zack Davisson, Matt Thorn, Ryan Holmberg, Leigh Stein, yours truly, and a few more whose names I was unable to find out. This should not be the case. Translator’s names should listed, if not on the cover, then at least on the title page. They deserve proper acknowledgment via listings in reviews and metadata at sites like Goodreads and online booksellers.<o:p></o:p></div> <div class="MsoNoSpacing"> Readers are encouraged to check out these quality books! Anyone can vote for the Eisners by simply registering, and <a href=" is now open</a>.
