In the news

With an election on the horizon, a coalition of 29 women and human rights organisation has published a manifesto for women and girls. Their stated goals are to “end violence against women and girls”; “secure women’s equal representation in politics”; “promote equality in the workplace and in the home”; “invest in public services”; and “lift women and children out of poverty”. To achieve these goals, they propose measures including a new ‘Violence Against Women and Girls’ bill to lay before Parliament; funding for high-quality sex and relationships education; improvements to the criminal justice system regarding allegations of rape and sexual assault; equal pay; increased maternity pay and maternity allowances; an end to pregnancy discrimination; and a strengthening of the law on sexual harassment at work, creating a duty on employers to prevent harassment from occurring. The backlash against internet intermediaries and ‘surveillance capitalism’ continues this week. Amnesty International have released a report entitled ‘Surveillance Giants’, which analyses in detail the human rights threats posed by Facebook, Google, and other technology corporations. The report is available here. Meanwhile, in the courts, Singh LJ granted Ed Bridges permission to appeal the facial recognition judicial review which he lost in September, noting that Mr Bridges’ appeal had a reasonable prospect of success.

Parents in Oxford have won the right for a secular alternative to traditional religious worship in schools, in a legal battle funded by Humanists UK against the Oxford Diocesan Schools Trust, the Guardian reports. The parents say that other schools will follow suit, while the Oxford trust insists this was a pragmatic decision to avoid excessive costs. The Department of Education has emphasised that this was only a settlement between the parents and the school, and has no implications for the law more widely.

Finally, in the midst of the various parties’ passionate electoral pledges about the NHS, a report was leaked this week detailing catastrophic failings at Shrewsbury and Telford NHS Trust. The findings have been described as ‘the largest known maternity scandal in the UK, by far’, stretching over 40 years. It appears that the trust was guilty of countless avoidable deaths, as well as long-term failures in respect of informed consent for mothers, a lack of transparency and communication with bereaved families, and a lack of kindness and respect to parents and families. The report was obtained by the Independent, and is discussed in detail here.

In the courts

This week saw two important human rights decisions. These concerned assisted suicide and the life sentence regime for foreign prisoners:
Newby, R (on the application of) v The Secretary of State for Justice: Philippe Newby, a longtime sufferer from motor neurone disease, wants to end his life. He applied for a declaration of incompatibility under s.4 HRA 1998 in respect of the law on assisted suicide in s.2(1) Suicide Act 1961. He argued that it was incompatible with Articles 2 and 8 ECHR; a blanket ban was disproportionate. In rejecting the application, the court reiterated the position reached in Nicklinson, Conway, and T that it is ‘institutionally inappropriate’ for the court to rule on a matter such this. In light of the ECtHR’s approval of UK law in Pretty v UK (2002) and Nicklinson v UK (2015), it is for Parliament to change the law on assisted suicide. As Irwin LJ and May J explained, “there is no consensus to be gleaned from evidence…the private views of judges on such moral and political questions are irrelevant, and spring from no identifiable legal principle.” Considering Parliament’s rejection of any change to the law, in the form of the Assisted Dying (No. 2) Bill 2015, the court was bound to refuse Mr Newby’s application.
Akbar, R (on the application of) v The Secretary of State for Justice: this case related to the sentencing and parole regime for life sentence prisoners subject to deportation orders in respect of which they are ‘appeal rights exhausted’ (ARE). For ordinary life sentence prisoners, the SSJ has the power to move them from higher to lower security condition prisons, until they eventually reach ‘open conditions’. However, this power was abolished by the SSJ in respect of ARE prisoners in 2014, in the form of the new rule 7(1A) of the Prison Rules 1999. The claimant, an ARE prisoner, challenged this change to the law on the grounds that (i) it violated Article 14 ECHR, being discriminatory in respect of Articles 5 and 8, and (ii) it was irrational. The court rejected his claim on both grounds. Rule 7(1A) had a legitimate aim, was rationally connected to that aim, and could not be achieved by a less intrusive measure. A different rule would deprioritise domestic prisoners, and lead to an increased risk of ARE prisoners absconding. As such, the rule was rational, and did not violate Article 14.

There were also appeals relating to deportation of foreign criminals and deprivation of citizenship:
Secretary of State for the Home Department v KF (Nigeria): a deportation order in respect of KF, a Nigerian citizen convicted of burglary and robbery, had been overturned by the First-tier Tribunal and Upper Tribunal on the basis of s.117C(5) of the Nationality, Immigration and Asylum Act and Rule 399 of the Immigration Rules. KF had children based in the UK, and the lower courts considered this amounted to a ‘genuine and subsisting relationship’ in respect of which it would be unduly harsh to deport KF to Nigeria. The High Court overruled the lower courts. In so doing, the court echoed the very recent case of SSHD v PG (Jamaica), stressing that the harshness required under s.117C(5) must be beyond what would necessarily be involved for the children of a foreign criminal – i.e. mere deprivation of shared parental support would not be enough. However strict it might seem, the will of Parliament must be respected, per Hickinbottom LJ in PG.
CI (Nigeria) v The Secretary of State for the Home Department: CI is a Nigerian national, who was seriously abused by his mother, and taken into care at 15. He had committed a series of thefts and robberies, and was diagnosed with a serious ‘depressive disorder’ with ‘some post-traumatic traits’. The Upper Tribunal had upheld the Secretary of State’s deportation order. The High Court overruled this decision. In so doing, the court considered the criteria for ‘Exception 1’ under s.117C(4) of the NIAA 2002. Although CI probably had not on balance been lawfully resident for ‘most of his life’, the court noted that he had been ‘socially and culturally integrated’, on the basis that his social and cultural identity was formed almost entirely in the UK, and he had maintained some academic success and romantic and family relationships; and that there were ‘very significant obstacles to reintegration’ in Nigeria, as he would be too psychiatrically unwell to access mental health care in Nigeria. Accordingly, the UT could reasonably have decided that there were very compelling circumstances such as to outweigh the public interest in deporting CI, under s.117C(6). The case was therefore remitted to the UT for a re-hearing.
The Secretary of State for the Home Department v E3 & Anor: The Secretary of State (SS) appealed a decision by the Special Immigration Appeals Commission (SIAC) to overrule her orders depriving two individuals of citizenship under s.40(2) of the British Nationality Act 1981. Both individuals were Bangladeshi citizens who had turned to Islamic extremism. The court was asked to consider whether the SS had been precluded from making the orders, on the basis that she was making the two stateless (under s.40(4)). The crucial piece of evidence for the SS was a ‘note verbale’ received from the Bangladeshi Ministry of Defence regarding the practice of Bangladeshi law, which appeared to indicate the two might not become stateless. In overruling SIAC’s decision, the court noted that SIAC had had a confused and inconsistent approach to the burden of proof, confusing the legal and evidential burdens. It was for the Secretary of State to prove that she was ‘satisfied’ that the individuals would not become stateless, and the burden then shifted to those individuals to prove otherwise. Further, SIAC had ‘mischaracterised’ the note verbale as ‘extra-official’, and it should have been given greater weight. The case was remitted to a differently constituted SIAC to be re-decided.

In the ECtHR
Razvozzhayev v Russia and Ukraine and Ukraine and Udaltsov v Russia : this case related to protests in Moscow in 2012, led by the supporters of opposition leaders Boris Nemtsov and Alexei Navalny, and actions taken against the applicants in the aftermath, including house arrest, abduction from asylum in Ukraine, and transfer to a penal colony in Krasnoyarsk. The court found an array of violations of Articles 3, 5, 6, 8, 11, and Article 1 Protocol 1 in respect of these actions by Russia and Ukraine.
Nejdet Atalay v Turkey: a Turkish citizen was involved in a demonstration at a funeral for four members of the PKK (Workers’ Party of Kurdistan), a terrorist organisation. As a result, he was sentenced to ten months’ imprisonment under the Turkish criminal code. The court held that this was a violation of his rights to freedom of expression under Article 10 ECHR, and was neither proportionate nor necessary in a democratic society.
Yurtdas and Soylemez v Turkey: two Turkish citizens were given a suspended sentence of two years imprisonment for chanting pro-Kurdish slogans. The court held that this was a violation of their rights to freedom of expression under Article 10 ECHR, and was neither proportionate nor necessary in a democratic society.
Obote v Russia: a small group of people held a flash mob in front of a government office in Moscow, sticking blank sheets of paper to their mouth with sticky tape. When asked to disperse, the applicant asked the police why; he was then escorted to the police station, and subsequently convicted of an administrative offence under the Russian Public Events Act. The court held that this was disproportionate, given the quasi-criminal nature of the sanction, when the group had done nothing capable of causing disorder or disruption to ordinary life. There had therefore been a violation of the right to peaceful assembly under Article 11.
TK and SR v Russia: this case considered in detail the human rights implications of extraditing ethnic Uzbeks to Kyrgyzstan for violent crimes. After a review of the reports and research available on the human rights situation in Kyrgyzstan, the court concluded that Uzbeks no longer constitute a vulnerable group such as to face risks of persecution solely based on ethnic origin in Kyrgyzstan. There was therefore no violation of the right against inhumane or degrading treatment under Article 3 in extraditing the applicants.
Znakovas v Lithuania: a police officer used an electroshock weapon against a domestic violence suspect who was unarmed and handcuffed; there was no subsequent investigation into his conduct. The court held that this constituted a violation of the right against inhumane or degrading treatment under Article 3 in both its substantive and procedural limbs.
KO and VM v Norway: the applicants were parents with a history of post-traumatic stress disorder and attention deficit disorder and psychiatric ill-health and drug abuse respectively. A number of anonymous notifications of concern were sent to child welfare services, resulting in an intervention which led to restrictions on contact between parents and daughter to a maximum of four visits a year. The court found that this was a violation of the right to family life under Article 8, because such infrequent contact amounted to child welfare services implicitly giving up the aim of reunification at a very early stage, without full justification of why this was considered appropriate.

Albania’s search for quake victims ends; death toll up to 51

TIRANA, Albania – The search and rescue operation for earthquake survivors in Albania has ended, the prime minister said Saturday, with the death toll at 51 and no more bodies believed to be in the ruins.

Prime Minister Edi Rama said preliminary figures showed more than 1,465 buildings in the capital, Tirana, and about 900 in nearby Durres were seriously damaged in Tuesday’s 6.4-magnitude pre-dawn quake.

About 2,000 people were injured.

A woman in Tirana who had been in a coma died, the health ministry said Saturday. Local media reported the 20-year old was injured by a falling brick while leaving her apartment.

In Durres, hundreds of residents as well as Rama and President Ilir Meta attended the funeral of nine members of a single extended family who were killed when a four-story villa collapsed. One young man survived and has been sent to Italy for medical treatment.

Preliminary figures estimate at least 4,000 people are homeless. About 2,500 people from damaged homes have been sheltered in hotels. Others have been taken to neighboring Kosovo or have moved to eastern areas of Albania.

The prime minister has pledged all homeless will be in “stronger homes” in 2020.

The first seriously damaged building has been demolished, and a dozen others are expected to follow. Assessment experts from Greece, France, Italy, Hungary, Bulgaria, Lithuania and Latvia are involved.

A new draft law will sentence all investors, architects and supervisors to seven to 15 years in prison for violating construction norms. That and corruption in Albania’s burgeoning building industry have been blamed for much of the quake’s effects.

The government has set up financial compensations for families of the dead, including 1 million Lek ($9,000) per family, special pensions for elders and scholarships for children.

Government and private calls for donations have collected about 15 million euros ($16 million) in three days.

Global pop stars of Albanian origin Dua Lipa, Rita Ora and Bebe Rexha also have made appeals via their social media sites.

Ora said she would help build a home for a homeless family and “myself directly help these families as much as I can!”

How did modern Ukraine emerge?
Ukraine's history is intertwined with Russia's. Both cultures descend from the medieval Slavic empire Kievan Rus, founded by Vikings in the 9th century with a capital where Kyiv stands today. After the empire was overrun by Mongol invaders in the 13th century, the Rus leadership moved northeastward, to a small trading outpost called Moscow. The lands around Kyiv were carved up by competing powers, who prized the fertile plains and rich, dark soil that later earned Ukraine the nickname "the breadbasket of Europe." Poland and Lithuania dominated the country for hundreds of years, but by the end of the 18th century, the Russian Empire had taken the eastern lands, while the western were controlled by the Austro-Hungarian Empire — a division that resonates to this day. Both empires collapsed at the end of World War I, and in 1917 a Ukrainian state was declared, but it was quickly swallowed by the communist Soviet Union. It was only in 1991, after the Soviet Union dissolved, that the modern borders of Ukraine were established. Russia has never really accepted Ukraine's independence, and Ukraine has been careening between pro-Western and pro-Russian leaders ever since.

Why do Russians still see it as theirs?
The cultural and Orthodox religious ties between the two peoples go back centuries. But perhaps more importantly, Russia has no natural mountain or river borders to protect its western front, and it has long seen Ukraine as a vital strategic buffer. "Russia without Ukraine is a country," explains Daniel Drezner, an international politics professor at Tufts University. "Russia with Ukraine is an empire." Russian President Vladimir Putin wants at all costs to keep Ukraine out of the European Union and NATO, and he has used Ukraine's dependence on Russian natural gas as a weapon — cutting off supplies in 2006 as Ukrainians froze in the winter cold. Ukraine is bitterly divided between Ukrainian speakers in the west, who mostly want to align their country with the West, and Russian speakers in the east.

Why did the U.S. get involved?
Since 1991, the U.S. has sought to guarantee Ukraine's independence and security, seeing it as a key bridge between East and West. When the USSR dissolved, Ukraine inherited the third-largest nuclear arsenal in the world, with some 1,900 strategic nuclear weapons pointed at the United States. Keen to avoid a proliferation of nuclear powers, the U.S., U.K., and Russia in 1994 signed the Budapest Memorandum, which transferred the weapons to Russia in exchange for a commitment by Washington, Moscow, and London to "respect the independence and sovereignty and existing borders of Ukraine" and to "refrain from the threat or use of force" against it. Russia continued meddling in Ukrainian politics, though, and overtly broke the treaty in 2014.

What did Russia do?
Ukraine's 2004 election was a showdown between pro-Western Viktor Yushchenko and pro-Russian Viktor Yanukovych. During the campaign, Yushchenko was disfigured by dioxin poisoning widely attributed to Russia, and after the vote was rigged for Yanukovych, Ukrainians rose up in the Orange Revolution, which culminated in a revote and a victory for Yushchenko. In the 2010 election, though, Yanukovych came roaring back to win the presidency with the help of both Russia and American political consultant Paul Manafort. In 2013, Moscow forced Yanukovych to cancel the country's bid to move closer to the EU, leading to an uprising that forced Yanukovych out. In the tumult that ensued, Russia invaded and annexed Crimea and later sent troops into Ukraine's eastern regions to start a separatist war. The Obama administration punished Russia with sanctions, but chose not to send weapons to Ukraine out of fear of triggering a larger war.

How is the war going?
Armed by Russia and supported by Russian paramilitaries, two ­Russian-­speaking Ukrain­ian regions collectively called the Donbass declared independence in 2014 and have been fighting with Ukraine ever since. An estimated 13,000 people have been killed and some 1.5 million displaced. In 2018, then–­national security adviser H.R. McMaster and other aides persuaded a reluctant Pres­i­dent Trump to send $400 million in military aid to Kyiv, including counter-artillery radar systems and Javelin anti-tank missiles. Without that aid, Mariya Omelicheva of the Pen­ta­gon's Nation­al De­fense Uni­ver­si­ty told The Atlan­tic, the 300-mile-long front line in the eastern Don­bass region "would have been moved further west into Ukraine, and ­Russia-backed rebels would have controlled more Ukrain­ian territory." That's why the possibility of U.S. aid being held up — the subject of the impeachment ­inquiry — is so important to Ukraine. Ukraine's new president, Volody­myr Zelen­sky, finds himself caught in a struggle between Democrats and Trump — who has reportedly been echoing Vladimir Putin's claim that Ukraine is corrupt and "not a real country."

Americans cash in
As Ukraine emerged from communism and struggled to build a rule-of-law economy, politically connected Amer­i­cans saw ways to make money. Paul Mana­fort, President Trump's former campaign manager, earned at least $13 million — and possibly much more — ­working for pro-­Russian Ukrainian oligarchs. His consultancy for a pro-Russian party that tried to undermine the U.S. alliance with Ukraine was crucial to the triumph of Yanu­ko­vych in the 2010 election. Mana­fort is now serving 7½ years in prison for tax fraud over those earnings. Joe Biden's son Hunter joined the board of Buris­ma, a Ukrain­ian gas company, in 2014 at a reported salary of tens of thousands of dollars a month, although there is no indication that either Biden broke any laws. Rudy Giu­li­ani, meanwhile, the president's personal lawyer, had a 2017 ­security-­consulting contract with the Ukrain­ian city of Kharkiv, and in 2018 he began working with two Soviet-born Amer­i­can executives, Lev Parnas and Igor Fruman, Repub­li­can donors who wanted to sell gas to Ukraine. Federal prosecutors have indicted Par­nas and Fru­man for illegal campaign contributions and are now reportedly investigating whether Giu­li­ani "stood to profit personally from a Ukrain­ian natural-gas business" pushed by those two men.

Today, at the start of the 25th annualUnited Nations Climate Change Conference, Google is joining 70 other companies and union leaders to call for the United States to stay in the Paris Agreement. We’re also sharing what Google is doing as a global innovator in renewable energy markets, and to build responsible supply chains and products that use AI to drive sustainability. 

We firmly believe that every business has the opportunity and obligation to protect our planet. To that end, we’re focused on building sustainability into everything that we do—from designing efficient data centers to creating sustainable workplaces to manufacturing better devices and creating more efficient supply chains. But our goal is much bigger: to enable everyone—businesses, policy makers and consumers—to create and live in a more sustainable world. 

Catalyzing the market for renewable energy

Google has been a carbon-neutral company since 2007 and we’ve matched our entire annual electricity consumption with renewable energy since 2017. Purchasing at Google’s scale helps grow the market for renewable energy, makes it easier for other corporate buyers to follow suit and supports a future where everyone has access to 24x7 carbon-free energy.  

  • Following Sundar’s September announcement of our biggest renewable energy purchase to date, we now have a portfolio of 52 wind and solar projects totaling more than 5 gigawatts, driving some $7 billion in expected new investments and thousands of related jobs around the world. Once these projects come online, they will produce more electricity than cities the size of Washington, D.C. or countries such as Lithuania or Uruguay use each year—all with renewable energy. 

  • We insist that all projects add new renewable energy sources to the grid—which catalyzes new  wind and solar projects. This approach also drives economic growth in the regions where we operate. For example, in Europe alone, Google’s purchases of renewable energy have generated €2.3 billion in capital investment in new renewable projects.

  • Google’s renewable energy purchases have helped make significant progress towards our long-term aspiration to power our operations with carbon-free energy in all places, at all times. Reaching 24x7 carbon-free energy will require innovations across policy, technology and business models and we are working hard to advance progress in these areas. For example, we recently signed a hybrid solar-wind agreement in Chile, which will increase our hourly carbon-free energy match from 75 percent to more than 95 percent.

  • As a founding member of the Renewable Energy Buyers Alliance (REBA), we are leading an effort to bring together more than 300 renewable energy buyers, developers, and service providers to pave the way for any company to access and purchase renewable energy. Collectively this group has committed to purchasing 60 gigawatts of renewable energy by 2025; that’s more than six times the amount of solar and wind installed in the U.S. in 2018. 

  • We’re also partnering with businesses to drive policy change to create broad access to renewable energy purchasing for everyone. For example, in the state of Georgia, we worked with Walmart, Target and Johnson & Johnson to establish the first corporate renewable energy purchasing program with Georgia Power, the local utility.

Building responsible supply chains and products

In areas where we manufacture hardware products, we view it as our responsibility to make sure our suppliers and the surrounding communities have access to clean energy. We’re also committed to integrating sustainability into every step of our hardware process, from design to manufacturing to shipping: 

  • In October, we committed to invest approximately $150 million into renewable energy projects in key regions where our Made by Google products are manufactured. Our investment commitment, alongside partners, aims to catalyze roughly $1.5 billion of capital into renewable energy. With these investments, we expect to help generate renewable energy that is equivalent to the amount of electricity used to manufacture Google consumer hardware products. 

  • One-hundred percent of this year’s Nest products include recycled content plastic. 

  • One-hundred percent of all shipments to and from customers of Made by Google products are carbon neutral. 

  • On an individual level, our products and services help consumers reduce their own environmental impact on the planet. For example, the Nest Learning Thermostats have helped people save more than 41 billion kilowatt hours of energy—enough to power all of Estonia's electricity needs for six years.

  • We’re also making it easier for people to give their old devices a second life. Customers can responsibly recycle devices for free—whether made by Google or not—via our take-back program for all products, available in 16 countries, and via our U.S. Pixel trade-in program.

Using AI to build a more sustainable world

Google’s expertise in AI is a key part of how we think about sustainability. Here are just a few of the ways AI is helping to tackle some of the world’s most challenging environmental problems:

  • We built an AI-powered efficiency recommendation system that directly controls data center cooling. This first-of-its-kind cloud-based system is delivering energy savings of roughly 30 percent. We’re now working to give our Cloud customers access to this same technology.

  • We’re using AI to optimize wind farms in our global fleet of renewable energy projects. After DeepMind and Google started applying machine learning algorithms to 700 megawatts of wind power in the central U.S., the value of that wind energy has been boosted by roughly 20 percent.

  • AI powers Global Fishing Watch, a platform we launched in partnership with Oceana and SkyTruth that promotes ocean sustainability by visualizing, tracking and sharing data about global fishing activity in near real-time and for free.

  • We’re also working to reduce the impact of our changing climate on vulnerable people. It’s estimated that every year, 250 million people around the world are affected by flooding. Our flood forecasting initiative in the Patna region of India is aimed at providing accurate real-time flood forecasting information and alerts to those in affected regions.

Providing resources to accelerate action beyond Google

Many organizations doing the most important work to address environmental challenges lack the funding and internal expertise to achieve their goals. That’s why we’re committed to empowering businesses, nonprofits, researchers and policy makers to take action:

  • Our first-ever Google AI Impact Challenge awarded $25 million in Google.org funding, product credits and mentorship from Google experts. Winners include organizations that are driving critical work in climate, conservation and energy. For example, WattTime is working to replace expensive, on-site power plant emissions monitors with a globally accessible, open-source monitoring platform. This will help make critical emissions reduction initiatives more accessible to communities that might not otherwise be able to afford them. 

  • The Google for Startups Accelerator will support social impact startups addressing climate, poverty and inequality. It gives startups access to expertise on technology, monetization of a social impact business and capital. 

  • More than 70 percent of global emissions are generated by cities. Our Environmental Insights Explorer (EIE) makes it easier for cities to access and act upon new climate-relevant datasets. 

Climate change is one of the most significant global challenges of our time and Google is committed to doing its part. We’re aggressively building sustainability into our operations and supply chains—efforts that are detailed in our annual Environmental Report andResponsible Supply Chain Report. We’ll continue to lead and encourage others to join us in improving the health of our planet.

Girutiskis bog (Girutiakio pelke). 15/11/11; Vilnius; 1,402 ha; 55°11'52"N 25°51'21"E. Strict Nature Reserve, Regional Park, Natura 2000. A complex of raised bogs, rich fens and transitional mires with acidic and oxygen-poor lakes and surrounding pine forests interspersed with spruce and birch trees. Numerous habitat types as well as plant and animal species (mammals, fish, insects, amphibians, and molluscs) are listed under the EU Habitats Directive and protected nationally, and a large number of breeding and non-breeding bird species protected in Europe and Lithuania occur within the site. The site is important as a source of groundwater and the swamp has a significant replenishing function. Peat accumulation in bogs also facilitates the binding of atmospheric carbon dioxide. The site is being used for research, environmental education and limited educational tourism; there is a visitor centre and an exposition at the Labanoras Regional Park directorate. Habitat overgrowth with bushes and trees, and invasive species, pose the main problems. An approved nature management plan exists. Ramsar Site number: 1993. Most recent RIS information: 2011.
