Il presupposto giustificativo della confisca di prevenzione e, pertanto, dello stesso sequestro, che ne anticipa provvisoriamente gli effetti, è la [Corte Cassazione Sezioni Unite 2.02.2015 n. 4880] basata sulla sproporzionalità tra reddito dichiarato e valore dell’acquisto, quando non si riesca a giustificarne la legittima provenienza.
Allo stesso modo, in ipotesi della c.d. [art. 12-sexies D.L. n. 306/1992; art. 240bis c.p.] si fa riferimento alla presunzione che le risorse economiche, sproporzionate e non giustificate, rinvenute in capo al condannato derivino dall’accumulazione di illecita ricchezza, di cui il soggetto non sia riuscito a giustificarne la provenienza lecita.
La Corte, nel procedere al vaglio delle questioni sollevate dai Giudice remittenti, non ha omesso di considerare come la giurisprudenza della Corte di Cassazione, successivamente alla Sentenza De Tommaso c/ Italia, si sia adoperata nel circoscrivere l’area dei beni confiscabili, limitandoli a quelli acquisiti durante il periodo in cui, sulla base di elementi di fatto, il soggetto interessato risulti effettivamente impegnato in attività delittuose [Cass. Sent. n. 33/2018].
Vero è che, pur non avendo natura sanzionatoria – ma meramente ripristinatorio – sta di fatto che la misura del sequestro preventivo finalizzato alla confisca, finisce con l’incidere in maniera notevole sui diritti di proprietà e di iniziativa economica (artt. 41 e 42 della Costituzione e art. 1 Prot. Addiz. CEDU).
Muovendo da tali assunti, la Corte Costituzionale con la sentenza n. 24 in commento ha quindi esaminato la questione di garanzia della previsione per legge, tanto della sorveglianza speciale, con o senza obbligo o divieto di soggiorno, quanto del sequestro e della confisca di prevenzione e ciò in relazione a due delle fattispecie normative di cosiddetta “pericolosità generica” di cui all’art. 1, numeri 1) e 2) della Legge n. 1423 del 1956 poi confluite nell’art. 1, lettere a) e b) del Decreto Lgvo n. 159/2011.
L’attenzione è stata quindi rivolta verso quelle fattispecie relative a soggetti e a [art. 1 Codice Antimafia].
Con la sentenza n. 25, la Corte Costituzionale si è invece soffermata sulla questione relativa alla vaghezza, indeterminatezza e non prevedibilità della prescrizione di imposta con la misura della sorveglianza speciale [art. 75, comma 2 del D. Lgvo n. 159/2011].
Tutte le questioni così poste si pongono nel punto di confluenza della giurisprudenza delle tre Corti e precisamente, della sentenza n. 282 del 2010 della Corte Costituzionale [che aveva ritenuto la conformità al principio di legalità della prescrizione del “vivere onestamente”]; della sentenza De Tommaso della Corte EDU [che ha condannato l’Italia per l’insufficiente delimitazione degli obblighi di “vivere onestamente” e rispettare le leggi”, così violando il principio di prevedibilità della condotta da cui consegue la limitazione della libertà personale] e della sentenza della Corte di Cassazione, Sezioni Unite penali n. 40076 del 2017 [secondo cui le “prescrizioni come il “vivere onestamente” e il “rispettare le leggi” non impongono comportamenti specifici ma contengono un mero ammonimento morale, la cui genericità e indeterminatezza dimostra l’assoluta inidoneità ad integrare il nucleo di una norma penale incriminatrice”].
D’altro canto, pur muovendo dal presupposto che il Giudice della prevenzione possa applicare le misure ivi previste anche in assenza di un procedimento penale (di merito) correlato, in virtù della ritenuta autonomia e assenza di pregiudizialità dell’azione di prevenzione, non c’è dubbio che già all’indomani della citata Sentenza EDU De Tommaso, per la qualificazione della pericolosità c.d. generica, la Giurisprudenza della Cassazione abbia affermato che, per l’applicazione delle Misure di prevenzione, non sono sufficienti “meri indizi” (locuzione invece utilizzata per la c.d. pericolosità qualificata che fa riferimento – art. 4 D. Lgvo n. 159/2011 – agli indiziati di appartenere ad associazioni mafiose); che l’esistenza di una sentenza di proscioglimento nel merito per un determinato fatto impedisce che lo stesso fatto possa essere assunto a fondamento della misura; che, infine, occorre un pregresso accertamento in sede penale della effettiva commissione di un fatto costituente reato.
Tuttavia, continua la Consulta, attesa l’assenza di un automatico adeguamento alla giurisprudenza della CEDU, si impone un bilanciamento di interessi sì da assicurare in via interpretativa, contorni sufficientemente precisi sia alla fattispecie prevista dall’art. 1, lettere a e b del D. Lgvo n. 159/2011, sia alla previsione contenuta nell’art. 75, comma 2 dello stesso Decreto legislativo.
E così, precisa la Corte Costituzionale, la locuzione , deve concretizzarsi in “categorie di reato” di cui il Tribunale, chiamato ad applicare la misura di prevenzione, deve dar conto in quanto si tratti di a) delitti commessi abitualmente (e dunque in un significativo arco temporale) dal soggetto; b) che abbiano effettivamente generato profitti in capo a costui; c) i quali profitti, a loro volta, costituiscano – o abbiano costituito in una determinata epoca – l’unico reddito del soggetto, o quanto meno una componente significativa di tale reddito.
Ai fini invece dell’applicazione della misura personale della sorveglianza speciale, con o senza obbligo o divieto di soggiorno, dovrà valutarsi l’effettiva pericolosità del soggetto per la sicurezza pubblica, restando anticostituzionale la disposizione che preveda come delitto (art. 75, comma 1 del Codice Antimafia) o come reato contravvenzionale (art. 75, co. 2 stesso Codice) l’inosservanza delle prescrizioni di “vivere onestamente” e di “rispettare le leggi” da parte del soggetto sottoposto alla misura di prevenzione della sorveglianza speciale con obbligo o divieto di soggiorno.
Analogamente sono da ritenere illegittime per violazione della Costituzione l’art. 4 comma 1, lettera c), del d.lgs#utm_source=googlier.com/page/2019_10_08/13636&utm_campaign=link&utm_term=googlier&utm_content=googlier.com. n. 159 del 2011, nella parte in cui stabilisce che i provvedimenti previsti dal capo II si applichino anche ai soggetti indicati nell’art. 1, lettera a); nonché l’art. 16 del d.lgs#utm_source=googlier.com/page/2019_10_08/13636&utm_campaign=link&utm_term=googlier&utm_content=googlier.com. n. 159 del 2011, nella parte in cui stabilisce che le misure di prevenzione del sequestro e della confisca, disciplinate dagli articoli 20 e 24, si applichino anche ai soggetti indicati nell’art. 1, comma 1, lettera a).
La Corte ha infine precisato che la sentenza non tocca le norme che consentono di applicare misure di prevenzione nei confronti degli indiziati di delitti di mafia, terrorismo, violazioni della disciplina sulle armi, violenza sportiva, corruzione, atti persecutori.
In definitiva e a commento delle pronunce testè riportate, ben possiamo ammettere che la valutazione giudiziale in tema di misure di prevenzione, se non può essere classificata come atteggiamento puramente soggettivo e incontrollabile, ispirato cioè dal mero “sospetto”; così come, d’altronde, non può sconfinare nel regno dell’accertamento pieno “oltre ogni ragionevole dubbio”, si tratta pur sempre di compendiare circostanze indizianti che sebbene non possano fondare una pronuncia di penale responsabilità di un soggetto, sono, tuttavia, circostanze di fatto, oggettive e controllabili, sufficienti a fondare ragionevolmente la situazione di abituale dedizione alla commissione di un delitto.

Trees give us a unique glimpse into our past. An examination of tree rings can show us what the climate was like in a given year. Was it a wet winter? Were there hurricanes in the summer? Did a forest fire ravage the area?
An ancient tree in New Zealand is the first to provide evidence of the near reversal of the Earth's magnetic field over 41,000 years ago.
Over the past 83 million years there have been 183 magnetic pole reversals, a process that takes about 7,000 years to complete.
"It's not a sudden flip, but a slow process, during which the field strength becomes weak, very probably the field becomes more complex and might show more than two poles for a while, and then builds up in strength and [aligns] in the opposite direction," Monika Korte, the scientific director of the Niemegk Geomagnetic Observatory at GFZ Potsdam in Germany, said according to Live Science.
During this process, the Earth can be bombarded with dangerous cosmic rays shot out of the sun.
The last time this happened was 772,000 years ago and, since, the magnetic field has almost reversed 15 times.
One of these near reversals was during the lifespan of an ancient Agathis australis — better known as its Māori name kauri — that was recently unearthed 26-feet below ground during the construction of a geothermal power plant in New Zealand.
The tree lived for 1500 years from between 41,000 and 42,500 years ago during a period known as the Laschamp Excursion.
"There's nothing like this anywhere in the world," Alan Hogg, from New Zealand's University of Waikato, said according to Newsweek. "This Ngawha kauri is unique."
The kauri's rings contain a complete record of the near reversal and it's the first time a tree that lived through the entire event has been discovered.
Samples of the tree are being analyzed by a team led by ChrisTurney from the University of South Wales. By understanding the near reveral's effect on the tree, scientists hope to learn what to expect next time it happens.
"We will have increased cosmic radiation. It will take out satellites and it might take out other communication infrastructure," Alan Hogg, from New Zealand's University of Waikato, said.
The effects of a magnetic field change are of increasing interest to scientists after reports last September showed the Earth's northern magnetic pole moved at an unexpectedly fast rate tate towards Siberia.
"Because the Earth's magnetic field has a major effect on how much radiocarbon carbon is formed in the upper atmosphere, these precious analyses will allow us to investigate the magnitude and rate of change when the magnetic field reversed during the Laschamp; something not possible before and of great interest given recent changes in the Earth's magnetic field," Turney said.

Having been back from CppCon 2019 for over a week, I thought it was about time I wrote up my trip report.
This year, CppCon was at a new venue: the Gaylord Rockies Resort near Denver, Colorado, USA. This is a huge conference centre, currently surrounded by vast tracts of empty space, though people told me there were many plans for developing the surrounding area.
There were hosting multiple conferences and events alongside CppCon; it was quite amusing to emerge from the conference rooms and find oneself surrounded by people in ballgowns and fancy evening wear for an event in the nearby ballroom!
There were a choice of eating establishments, but they all had one thing in common: they were overpriced, taking advantage of the captured nature of the hotel clientelle. The food was reasonably nice though.
The size of the venue did make for a fair amount of walking around between sessions.
Overall the venue was nice, and the staff were friendly and helpful.
I ran a 2-day pre-conference class, entitled More Concurrent Thinking in C++: Beyond the Basics, which was for those looking to move beyond the basics of threads and locks to the next level: high level library and application design, as well as lock-free programming with atomics. This was well attended, and I had interesting discussions with people over lunch and in the evening.

The main conference
Bjarne Stroustrup kicked off the main conference with his presentation on "C++20: C++ at 40". Bjarne again reiterated his vision for C++, and outlined some of the many nice language and library features we have to make development easier, and code clearer and less error-prone.
Matt Godbolt's presentation on "Compiler Explorer: Behind the Scenes" was good and entertaining. Matt showed how he'd evolved Compiler Explorer from a simple script to the current website, and demonstrated some nifty things about it along the way, including features you might not have known about such as the LLVM instruction cost view, or the new "run your code" facility.
In "If You Can't Open It, You Don't Own It", Matt Butler talked about security and trust, and how bad things can happen if something you trust is compromised. Mostly this was obvious if you thought about it, but not something we necessarily do think about, so it was nice to be reminded, especially with the concrete examples. His advice on what we can do to build more secure systems, and existing and proposed C++ features that help was also good.
Barbara Geller and Ansel Sermersheim made an enthusiastic duo presenting "High performance graphics and text rendering on the GPU for any C++ application". I am excited about the potential for their Copperspice wrapper for the Vulkan rendering library: rendering 3D graphics portably is hard, and text more so.
Andrew Sutton's presentation on "Reflections: Compile-time Introspection of Source Code" was an interesting end to Monday. There is a lot of scope for eliminating boilerplate if we can use reflection, so it is good to see the progress being made on it.

In "Applied WebAssembly: Compiling and Running C++ in Your Web Browser", Ben Smith showed the use of WebAssembly as a target to allow you to write high-performance C++ code that will run in a suitable web browser on any platform, much like the "Write once, run anywhere" promise of Java. I am interested to see where this can lead.
Samy Al Bahra and Paul Khuong presented the final session I attended: "Abusing Your Memory Model for Fun and Profit". They discussed how they have written code that relies on the stronger memory ordering requirements imposed by X86 CPUs over and above the standard C++ memory model in order to write high-performance concurrent data structures. I am intrigued to see if any of their techniques can be used in a portable fashion, or used to improve Just::Thread Pro.

This led to a lot of discussion, which Arthur O'Dwyer wrote up as a blog post. Though the premise of the question is wrong (we shouldn't want to constrain on such specifics), it was fun, interesting and enlightening trying to think how one might do it — it allows you to explore the corner cases of the language in ways that might turn out to be useful later.
As well as the workshop, I presented a talk on "Concurrency in C++20 and beyond", which was on Tuesday afternoon. It was in an intermediate-sized room, and I believe was well attended, though it was hard to see the audience with the bright stage lighting. There were a number of interesting questions from the audience addressing the issues raised in my presentation, which is always good, though the acoustics did make it hard to hear some of them.

At a successful consumer-facing company, "business" is a service provider like IT. Product people are the ones guiding the direction of the company, not business people. The finance or business side is setting guardrails for where the company can go, and is offering support and insight, but it isn't setting the direction.
One of the reasons for this is that the kind of work a company like Stack Overflow does requires a lot of non-obvious long-term investment. Making sure a large software product remains viable not just next year, but next decade, is difficult and painful. I've seen this kind of thing happening, when a company had a tough spot, business people came in, made it all better in the short run, but as a side-effect, ensured that the company had no long-term future.

As Michael says, there’s a case to be made that a CEO should also have a good understanding of the product line-up as it is, and where they want to take it. It doesn’t guarantee success, but among other things, it gives the employees and customers something to believe in.|

An influential 2008 campaign by World Wildlife Fund (WWF) has been resurfacing thanks to a Reddit post recently going viral. The campaign, titled WWF Japan – Population by pixel, was created by agency Hakuhodo C&D / Tokyo. The brains behind it were creative directors Yoshiyuki Mikami, Nami Hoshino, and designer Kazuhiro Mochizuki. He has bragged about faxing threats to kill Jewish children to synagogues. (There are 28 total mentions of the alias “Weev” on The Southern Poverty Law Center’s website, filled under the sections “Hatewatch” and “Extremist Profile.”) He waged a targeted harassment campaign against a prominent woman programmer, taunting her and her family with rape and violence threats until she was scared to go out in public. He tried to organize people to crash the funeral of Heather Heyer. He has a large swastika tattoo on his chest.
A few years ago, Quinn Norton lost her job at the New York Times partially because of her friendship with Weev. But for some reason, Molly Crabapple's friendship with him hasn't turned the Left - or Leftist Jews - against her.
Crabapple wrote an article about his trial where he was accused of hacking AT&T. The merits of the case are not so clear; he really didn't hack AT&T. But Crabapple's care about Weev went way beyond her support for his civil rights and to her admiration of him as a person, as she wrote in an article for Vice:

And today she is considered a leading light of the Left, to the extent that she is name-checked by +972 to be in the same category as Butler and Chomsky.
Since people started pointing out Crabapple's entirely inappropriate love for her Nazi friend, she had been furiously removing all her loving tweets to Weev, and now claims that she never liked him. But she can't erase this love-letter to the bigot and misogynist.
Crabapple has signed other anti-Israel and pro-BDS petitions. Jewish Voice for Peace happily gets her signature when they need it. She reliably shows up when anti-Israel groups ask her to.
The question is, why the Left is so quick to excuse one of their own who embraced a far-right asshole?

The DC Circuit Court of Appeals ruled on the last day of September that the FCC had the authority to kill Title II regulation and to repeal net neutrality. However, the ruling wasn't entirely in the FCC's favor. The agency was ordered to look again at how the repeal of Title II regulation affects public safety. In a more important ruling, the courts said that the FCC didn't have the authority to stop states and municipalities from establishing their own rules for net neutrality.
This court was ruling on the appeal of the FCCs net neutrality order filed by Mozilla and joined by 22 states and a few other web companies like Reddit and Etsy. Those appeals centered on the FCC's authority to kill Title II regulation and to hand broadband regulation to the Federal Trade Commission.
Net neutrality has been a roller coaster of an issue. Tom Wheeler's FCC put the net neutrality rules in place in 2015. An appeal of that case got a court ruling that the FCC was within its power to implement net neutrality. After a change in administration, the Ajit Pai FCC killed net neutrality in 2017 by also killing Title II regulation. Now the courts have said that the FCC also has the authority not to regulate net neutrality.
The latest court order will set off another round of fighting about net neutrality. The FCC had quashed a law in California to introduce their version of net neutrality, and this order effectively will allow those California rules to go into effect. That battle is far from over, and there will be likely new appeals against the California rules and similar rules enacted in Washington. It wouldn't be surprising to see other states enact rules in the coming year since the net neutrality issue is overwhelmingly popular with voters. It's possibly the worst of all worlds for big ISPs if they have to follow different net neutrality rules in different states. I think they'd much prefer federal net neutrality rules rather than different rules in a dozen states.
The reversal of net neutrality rules only went effect in June of 2018, and there have been no major violations of the old rules since then. The ISPs were likely waiting for the results of this court ruling and also are wary of a political and regulatory backlash if they start breaking net neutrality rules. The closest thing we had to a big issue was mentioned in this ruling. Verizon had cut off broadband for firemen in California who were working on wildfires after the firemen exceeded their monthly data caps. It turns out that wasn't a net neutrality violation, but rather an enforcement issue on a corporate cellular account. But the press on that case was bad enough to prompt the courts to require the FCC to take another look at how ISPs treat public safety.
This issue is also far from over politically. Most of the democratic presidential candidates have come out in favor of net neutrality, and if Democrats win the White House, you can expect a pro-net neutrality chairman of the FCC. Chairman Pai believes that by killing Title II regulation that a future FCC will have a harder time putting the rules back in place. But the two court appeals have shown that the courts largely believe the FCC has the authority to implement or not implement net neutrality as they see fit.
While net neutrality is getting all of the press, the larger issue is that the FCC has washed its hands of broadband regulation. The US is the only major economy in the world to not regulate the broadband industry. This makes little sense in a country where are a large part of the country is still controlled by the cable/telco duopoly, which many argue is quickly becoming a cable monopoly. It's easy to foresee bad behavior from the big ISPs if they aren't regulated. We've seen the big ISPs increase broadband rates in the last few years, and there is no regulatory authority in the country that can apply any brakes to the industry. The big ISPs are likely to demand more money out of Google, Facebook and the big web companies.
The FCC handed off the authority to regulate broadband to the Federal Trade Commission. That means practically no regulation because the FTC tackles a single corporation for bad behavior but does not establish permanent rules that apply to other similar businesses. The FTC might slam AT&T or Comcast from time to time, but that's not likely to change the behavior of the rest of the industry very much.
There is only one clear path for dealing with net neutrality. Congress can stop future FCC actions and the ensuing lawsuits by passing a clear set of laws that either implements net neutrality or that forbids it. However, until there is a Congress and a White House willing to implement such a law together, this is going to continue to bounce around.
The big ISPs and Chairman Pai argued that net neutrality was holding back broadband investments in the country — a claim that has no basis when looking at the numbers. However, there is definitely an impact on the industry from regulatory uncertainty, and nobody is benefitting from an environment where subsequent administrations alternately pass and repeal net neutrality. We need to resolve this once way or the other.

Per l'anno 2019, le comunicazioni per l'accesso al credito d'imposta potranno essere presentate dal 1° al 31 ottobre 2019 attraverso i servizi telematici dell'Agenzia delle Entrate.
Ricordiamo che il "bonus pubblicità" è un credito d'imposta concesso alle imprese, ai lavoratori autonomi e agli enti non commerciali che effettuano investimenti in campagne pubblicitarie sulla stampa quotidiana e periodica anche on line e sulle emittenti televisive e radiofoniche locali, analogiche o digitali, il cui valore superi almeno dell' 1 per cento gli analoghi investimenti effettuati sugli stessi mezzi di informazione.
È stato introdotto dall'art. 57-bis del D.L. n. 50/2017, convertito dalla Legge n. 96/2017 e successivamente modificato dal D.L. n. 148/2017, convertito dalla Legge n. 172/2017.
La modifica più recente e sostanziale è quella apportata dall'art. 3-bis del D.L. n. 59 del 28 giugno 2019 convertito dalla Legge n. 81 del 8 agosto 2019 che, apportando modifiche all'art. 57-bis del D.L. n. 50/2017, ha, a decorrere dall'anno 2019, reso strutturale la misura e ha unificato al 75% la percentuale di credito d'imposta.
In sostanza, per l'anno 2019, due sono i cambiamenti introdotti:
viene meno la differenziazione prevista per il 2018 per le Startup innovative e per le PMI, per le quali la misura del bonus pubblicità era fissata al 90% dell'investimento incrementale. A partire dal 2019 il credito d'imposta viene unificato al 75% per tutte le imprese, lavoratori autonomi ed Enti non commerciali;
la scadenza per le domande di accesso all'incentivo viene rinviata, per il solo anno 2019, al 31 ottobre, con la possibilità quindi di invio dal 1° al 31 ottobre 2019. A regime, il periodo temporale per l'invio delle comunicazioni tornerà ad essere quello ordinario, ovvero dal 1° ed il 31 marzo..
Per quel che riguarda le regole operative, il riferimento resta il D.P.C.M. n. 90 del 16 maggio 2019.
L'accesso al bonus pubblicità è subordinato ad un incremento pari almeno dell'1% degli investimenti effettuati sugli stessi mezzi di informazione nell'anno precedente. Per determinare l'incremento dell'investimento si prenderà come riferimento il totale degli investimenti effettuati rispetto a quelli dell'anno precedente.
Possono presentare domanda i soggetti titolari di reddito d'impresa o di lavoro autonomo e gli enti non commerciali che effettuano investimenti incrementali rispetto all'anno precedente. Quindi, se un soggetto non ha effettuato spese ammissibili nel 2018, non potrà accedere al beneficio nel 2019.
Inoltre, il bonus pubblicità è un'agevolazione concessa in base al "regime de minimis". Non può ottenerlo, quindi, chi abbia superato il plafond di 200mila euro di aiuti ottenuti nell'esercizio in corso e nei 2 esercizi precedenti.

At the beginning of the quest “Merlin’s Crystal,” in the massively multiplayer online role-playing game (MMORPG) RuneScape, the player must talk to a non-player character, or NPC, named “King Arthur.” Though RuneScape takes place in the fantasy realm of Gielinor, Arthur notes that “Back in England, [Merlin] got himself trapped in some sort of magical Crystal,” and the player must help break him out. Much to fans’ amusement, this section of dialogue implies that England — and thus, our world — exists within the universe of RuneScape. Jagex, RuneScape’s developers, are no strangers to in-game “Easter eggs.” Most are occasional fourth-wall breaks, meta jokes, or references to real-life material, like the mythological King Arthur and the Knights of Camelot. These connections are mostly innocuous, and they fit within a well-established history of cross-referencing within the fantasy genre. One connection between the land of Gielinor and our own, however, is not so innocuous: money.
Real-world trading is the process of exchanging in-game currency for real-world currency and vice versa. Though strictly against the rules of RuneScape, it is a widespread phenomenon in-game, and its potential for real-world profit has given rise to entire industries of gold farmers and traders. Currently, the website “RSgoldfast” — an illicit but popular real-world trading website — marks the exchange rate at 1 million gold per .79 USD. According to Mod Mat K, a product manager at Jagex, “at any given time, 50 percent of all players are engaging with real-world trading.” Even if real-world trading is not a planned feature of the RuneScape economy, it is a feature nonetheless. Beyond the game itself, real-world trading has legal implications. As the RuneScape code of conduct explains, “Nobody has our permission to sell RuneScape accounts or any RuneScape related virtual in-game items. All RuneScape accounts and virtual items are the property of Jagex Ltd and players are only granted a limited, revocable permission to use accounts and virtual items.” The world of RuneScape and all exchanges within it are the property of Jagex; any real-world gain from the game belongs to Jagex, and thus, these activities are akin to theft. Moreover, real-world trading often occurs via hacking, phishing, or other illicit ways of obtaining access to players’ accounts. It also can involve real credit card fraud, as gold farmers use others’ credit cards to pay for RuneScape membership.
But before we analyze the RuneScape economy, let me bring you up to speed. Money — referred to in-game as “gold,” “gold points,” or “gp” — is central to a player’s progression, allowing them to buy items that make progression either more efficient or possible at all. The vast majority of economic activity in-game happens via the Grand Exchange, a commodity-exchange infrastructure through which players can anonymously place offers to buy or sell items in exchange for gold. It is both an in-game location, located northwest of the city of Varrock, and a global infrastructure. Before its release, players had to physically congregate in-game to trade, and trades were completed player-to-player. Now, the Grand Exchange allows near-instantaneous buying and selling between players, permitting trade across servers, time zones, and languages.
The magnitude of trade that occurs via the Grand Exchange is astounding. In the last six months, the top 10 most-traded items accounted for 167 billion coins in-game, equivalent to $132,000. The most expensive trade to occur on the Grand Exchange was a single “Scythe of vitur,” a rare drop from one of the game’s hardest bosses, which sold for two billion coins, equivalent to around $1,500. The Grand Exchange also allows for economic coordination between players in the form of “merching” clans. “Merching,” much like real-life arbitrage, is the process of manipulating prices in-game through buyouts of certain items, thus inducing a shortage in supply and raising the price. Given that items are subjected to “buy limits,” which limit the amount that a single player can purchase in a given amount of time, coordination among players is necessary to induce a change in price. Any given player’s ability to change an item’s price is also limited by access to capital. The Grand Exchange is a relatively free market, subject to the same forces and logics as the real-world economy. Critical to understanding the “realness” of the RuneScape economy is understanding the language that surrounds it. On the RuneScape wiki, the page “economy” features supply and demand infographics detailed enough to use for an ECON 115 study guide.
The rationale for the illegality of real-world trading is two-fold. Both Jagex and players argue that real-world trading devalues players’ legitimately earned progression. For context, a “maxed account” — an account that has level 99, the highest achievable, in every skill — takes between three and seven thousand hours to achieve. Given an infinite cash stack, a player could speed up their progression exponentially, as many skills in RuneScape are considered “buyable.” RuneScape is a game centered around “grinding,” the repetition of tasks ad infinitum as the primary means of progression. Even as players lament the monotony of tasks in RuneScape, a semi-ironic commitment to them is a badge of honor. The language of labor and economic metaphors permeates discussion of in-game achievement, even among those not participating in real-world trading. Most skills in RuneScape are most efficiently trained through intense repetition of a single task, and players often discuss these skills with half-hearted disdain. And yet, they still play. Much of RuneScape’s player base started when they were kids, enraptured by the magic of goblins, quests, and chat room abuse.
Many players find this current obsession with efficiency at odds with why they began playing in the first place. “There is a culture of efficiency, ‘no xp waste’… Why are you even doing this again?” one disgruntled player wrote in a Reddit post from 2018. The question remains: why do these efficiency-obsessed, jaded players still play the game? Are they “playing” at all?
Psychologist Mihaly Csikszentmihalyi attributes this form of play to the psychological phenomena of “flow,” when “a person is able to concentrate on a limited stimulus field, in which he or she can use his or her skills to meet clear demands, thereby forgetting his or her own problems… at the same time obtaining a feeling of control over the environment.” Thus, the clear-input output relationship made possible by RuneScape’s mechanics is a form of play in and of themselves. The ability for a player to calculate exactly how many logs they need to cut or runes they need to craft to obtain a certain level allows a sense of perfect control over their environment. It is a world in which the rules are clear and the outcomes certain; thus, the only variable is the “grind” that a player is willing to commit.
The pervasiveness of this “grind” culture is evident throughout the RuneScape community but perhaps best exemplified in an exchange I witnessed in a chatroom:
PLAYER A: these quest requirements aren’t that high at all
PLAYER B: nope not at all / questing is a joke
A: I’m about it because it feels like every other quest gives me something new / Whether it is useful is irrelevant
B: im [sic] proud of you son / you are what we call weaponized autism
While players can oscillate between “efficiency” and “fun” modes of play, and while both modes of play can appear contradictory, the consistency of their internal logics is important to note. The grind is fun because the grind is fun, and aimless exploration is fun simply because aimless exploration is fun. How a player arrives at either mode of play depends on their knowledge of the game’s intricate mechanics, their age, and their participation in the game’s surrounding communities. These self-affirming logics of leisure and “play” are both socially enforced in-game and through forums like Reddit and Discord.
It is no coincidence that “flow,” as discussed by Csikszentmihalyi, manifests in both work and play. In fact, according to Csikszentmihalyi, “flow” is present more so in work than anywhere. However, just as “play” is a socially constructed term, “work” is a construction as well. Games like RuneScape, which seem to blur the lines between work and play, are apt sites to investigate these constructions and test accepted definitions of either. While Max Weber argued that capitalism emerged as a product of Protestant asceticism, restraint, and prudence, he also saw a universality in the desire for gain: “Capitalism may even be identical with the restraint, or at least a rational tempering, of this irrational impulse. But capitalism identical with the pursuit of profit, and forever renewed profit, by means of continuous, rational, capitalistic enterprise.” The fantasy world of RuneScape, thus, is fertile ground for the capitalist spirit to grow. It is a world where all resources are replenished in an instant, where all slain monsters are revived, and where death is little more than a calculated setback. The blurred lines between work and play that bring about flow, that occur as a result of some “Protestant ethic” of simultaneous restraint and unending ambition, make possible the form of play known as “grinding.”
Moreover, the blurred lines between work and play bring closer the fantasy economy of RuneScape and our own — an extreme example: the case of Venezuelan gold farmers.
In recent years, Venezuela has undergone an immense economic crisis. Inflation rates have topped over one million percent, with prices of common goods doubling nearly every three weeks. As a result, thousands of young Venezuelans have taken to gold farming in RuneScape as a means of survival. These players use the game’s most profitable money-making methods to generate gold, which they then sell in exchange for real money. Doing so has the potential to earn many times the average wage in Venezuela via traditional sources of income.
The language that surrounds “grinding” as performed by dedicated players is different from that which is used to discuss gold farmers. Despite the fact that gold farmers often undertake the same processes as regular players, many players view them as a problem. As one Reddit post, titled “JAGEX DO SOMETHING ABOUT THOSE VENEZUELAN [Real-world traders]” reads, “Since there is a serious IRL crisis in Venezuela for example the blast mine is overloaded with these cunts who crash the spot to sell money they have gathered.” One controversial post on Reddit, titled “Killing Venezuelans at East Drags [sic] Guide,” though since removed, stirred controversy for laying out a step-by-step guide for identifying and targeting Venezuelan gold farmers. In the divided, vitriolic comment section, the border between the RuneScape world and our own appears nonexistent.
Commenters are not discussing avatars, they are discussing the real people behind them. One comment reads, “I never thought I’d see a guide on how to efficiently kill poor people,” with another joining in, “This is kinda [sic] fucked that you are going out of your way to literally help people make already poor people who can barely afford clothes/food etc. struggle even more than they already are.” Some players seek to absolve responsibility through either in-game means, saying “RS isn’t a charity, it’s a game and property of Jagex, kill them all,” while others blame real-world structures, claiming that “Socialism killed them, this is just burying the carcass.” Along real-life fault lines of racism and classism, others take pride in targeting gold farmers, writing “I kill these guys when warming up my switches on my pure. They are pure offensive practice and some of the best people to kill… Also, you could just say ‘Trump’ while you attack them and that will easily get their jajajajaja’s going.” The real-world consequences of a Venezuelan gold farmer being banned or killed go far beyond a simple setback. Both by circumstance and intention, Venezuelan gold farmers do not enjoy the same insulation from the consequences faced in the world of Gielinor as normal players do. Death in-game can literally equate to death in real life, and the game suddenly seems less fun.
But what happens when the real economy starts to resemble a game?
The streamlining and abstraction of wealth and exchange in the RuneScape economy is corollary to that of the Post-Fordist economy. The geographer David Harvey, in his article “Between Space and Time,” argues that the advancement of capitalism in the modern world is predicated on a collapsing of space and time, an incessant drive towards the instant. This is on full display in both RuneScape and the financial sector. The Grand Exchange is dialectical in that, while it is a physical space, the exchange it permits has no grounding in said location. While the “Financial District” is a neighborhood, the business that flows through the stock exchange — and computers across the globe — is not bound to any one place. Whereas the market was once a location, it is now an idea. It operates not via bartering, but via logics of supply and demand, mysterious algorithms, and global exchange. And just as the financial sector’s ever-expanding consolidation of power combined with the digital revolution of finance has permitted its hegemony over the world’s economy, the Grand Exchange has permitted unprecedented abstraction in the RuneScape economy: the mystery of in-game algorithms, the instantaneous nature of trade, and the ability for real-world traders, merchanting clans, and other actors to manipulate prices and quantities with little regard for those on the other end.
What is critical to note here is that abstraction is born of concrete phenomena. Abstraction occurs in inconceivable amounts of money, whether that be item prices or trillion-dollar bonuses. Abstraction is found in the alienation of the worker from their labor, whether manifesting in the devaluation of a hard-earned, maxed RuneScape account or the increasing share of economic growth that goes to the financial sector rather than to workers.
Abstraction grows in the gap between cause and effect, action and responsibility. Just as responsibility helps shape the distinction between a game and real-life or play and work, responsibility (or a lack thereof) has been a critical component of the creation of the modern financial system. This diminishing liability is at the root of the corporate form. As theorist Joshua Barkan argues in The Sovereign Gift, “corporate power has always been articulated within the context of responsibility.” As Barkan proposes, the modern corporate form is designed to shield actors from liability. The “Limited Liability Corporation” is one in which no single person takes the fault for the actions of the whole. It is why CEOs can walk away from financial crises with no jail time. It is why multi-billion dollar fines for misconduct and other limited forms of punishment can be shrugged off as costs of doing business.
The consequences, as filtered through the corporate form, simply aren’t that severe. The same logic applies to risk-taking in RuneScape. For the vast majority of infractions, a banned account is the worst penalty one could face. They can simply make another. A death, loss of gold, or destruction of special equipment simply does not matter that much, as it is all part of the game. Even for individual financial workers, as anthropologist Karen Ho argues, being “liquidated” is a part of the job on Wall Street and constant instability is part and parcel of simply riding the market. On the contrary, the dire consequences of death or punishment faced by Venezuelan gold farmers or the utter destruction of being fired from a blue-collar job reinforce the distinction between play and work. This limited liability, this insulation from consequences, as Ho uncovers in Liquidated, is how the language and mindsets of games manifest in financial sectors. As one analyst in Ho’s book explains, “from a shareholder investor perspective, it’s all about playing the game.” This sentiment is echoed by businessman-author Andy Kessler: “[Investment firms] literally exist to pay out half their revenue as compensation. And that’s what gets them into trouble every so often — it’s just a game of generating revenue because the players know they will get half of it back.”
There is nothing consequential about an in-game murder when you can simply shut the game off, and there is nothing scary about death when you know you can respawn, whether in Gielinor or on Wall Street.

O aguardado filme Coringa estreou ontem no Brasil, e eu planejo vê-lo semana que vem (agora estou viajando) e escrever sobre ele.
Ainda que eu esteja cansada de filmes de super-heróis, o trailer pareceu excelente (assim como o da sua ex, Arlequina, maravilhosamente interpretada por Margot Robbie em Aves de Rapina).

O Coringa foi interpretado várias vezes em mais de cinquenta anos. Primeiro com a caracterização brincalhona de Cesar Romero no primeiro Batman e Robin, depois o toque mais encantadoramente espirituoso de Jack Nicholson no filme de Tim Burton de 1989 e, é claro, a representação infame e maníaca, cortesia do falecido Heath Ledger em O Cavaleiro das Trevas.
Todd Phillips é o primeiro diretor a pegar o personagem e dedicar um filme inteiro à sua história de origem em Coringa e, se acreditarmos nas primeiras críticas, os filmes de quadrinhos “nunca mais serão os mesmos”.
O filme, que estreou no Festival Internacional de Cinema de Veneza, já inspirou milhões (provavelmente bilhões) de palavras a serem escritas sobre ele. Estrelado por Joaquin Phoenix no papel principal, o longa conta a história de Arthur Fleck, um palhaço em busca de trabalho e aspirante a comediante de stand-up que ainda mora com sua mãe doente e se ressente do fato de que o mundo não lhe dá tanta atenção quanto ele acredita que merece. Soa familiar?
Os críticos estão divididos em relação à performance de Phoenix, com alguns elogiando-o como o 'melhor da carreira' e outros alegando que na verdade ele atua demais para poder levar o filme tão a sério quanto ele quer ser levado.
Mas enquanto eles discordam sobre a qualidade de sua performance, são quase unânimes em afirmar que o filme não se define se é uma sátira ou propaganda de homens brancos que, sentindo-se rejeitados pelo mundo, se voltam à violência e ao ódio como resposta para esses problemas. De acordo com as primeiras críticas, o filme segue uma linha tênue que poderia ser potencialmente perigosa se recebida do modo errado. Parece que não lida com certos temas com a cautela necessária para evitar glorificar incels (celibatários involuntários, os chamados "virjões") e seu comportamento às vezes violento.
David Ehrlich, do IndieWire, chamou o filme de “um grito de guerra tóxico para os incels que sentem pena de si mesmo” e acredita que “não tem disciplina nem nuances para lidar com material tão perigoso” em um mundo de trolls do Reddit e fãs maníacos da Marvel.
Igualmente, Jessica Kiang, da Playlist, escreveu que é “um filme tão perturbador que parece quase perigoso: independentemente de quão restritiva seja a classificação indicativa, talvez eles devam pensar em verificações de antecedentes e em um período de espera obrigatório de três dias nos cinemas”.
Continuando, ela escreve: “Coringa, baseado em um IP reconhecível, e agora com o selo da aprovação crítica e também com possíveis indicações a prêmios, é tão esteticamente impressionante, eficaz e persuasivo de sua própria realidade, que você claramente vê como pode facilmente ser (mal) interpretado e cooptado pelos mesmos elementos do tipo ‘perturbado mental e solitário’/ 4Chan/ Incel que ele pretende sinistramente satirizar”.
Richard Lawson, da Vanity Fair, inciou sua crítica observando a atual obsessão da sociedade em dissecar e encontrar uma causa para as motivações de “homens brancos insatisfeitos que se tornam violentos”.
“Se essa violência nasce de doenças mentais, isolamento, raiva culminada da identidade masculina ou tudo isso junto em um nó hediondo, parecemos certos de que há alguma causa possível de ser salva”, escreve, explicando que ele mesmo não conseguia parar de pensar nessa obsessão enquanto assistia Coringa, por conta dos paralelos entre aqueles “homens brancos insatisfeitos” e Arthur.
Da mesma forma, em uma crítica negativa para a Time, Stephanie Zacharek escreve que o filme é um “exemplo primordial” do “vazio da nossa cultura”. “Nos Estados Unidos, há um tiroteio em massa ou tentativa de ato de violência por um cara como Arthur praticamente semana sim, semana não. E, no entanto, devemos sentir algum tipo de simpatia por Arthur, o cordeiro perturbado; ele apenas não teve amor suficiente”, diz. “Ele poderia facilmente ser adotado como o santo padroeiro dos incels”.

Non che manchino i critici e i malumori all'interno delle forze che sostengono l'esecutivo, compreso il Movimento 5 stelle. Ma la partita in gioco è troppo "importante", ripetono nel Pd, Iv, M5s e Leu, da poter consentire incidenti in Aula. Domani dopo pranzo la Camera sarà chiamata a votare la riforma bandiera dei 5 stelle che taglia il numero dei parlamentari: in assenza di sorprese dell'ultimo minuto, il via libera finale dovrebbe arrivare con numeri 'bulgari', che sfiorano i 620 si'.
Un via libera che la maggioranza 'blinda' con il patto sull'intero pacchetto di riforme, che andranno a controbilanciare gli effetti del taglio degli eletti. Dalla legge elettorale, con l'impegno a presentare una proposta di riforma entro il mese di dicembre - anche se nessun accenno viene fatto sul modello e qui le distanze, soprattutto nel Pd, restano grandi - fino all'equiparazione dell'elettorato attivo e passivo di Camera e Senato, passando per la riforma dei regolamenti Parlamentari e una modifica dell'elezione ora su base regionale del Senato.
Insomma, le garanzie e i 'contrappesi' chiesti da Pd e Leu in sede di trattativa per dar vita al Conte II e a cui hanno aderito anche i renziani di Iv. Garanzie, tuttavia, per ora solo sulla carta. E che non mettono al riparo da future fibrillazioni, soprattutto sulla riforma del sistema di voto. Ma oggi l'importante è mostrare compattezza: "Le garanzie ci sono tutte", scandisce il capogruppo dem Graziano Delrio, quindi il taglio dei parlamentari si può votare.
Anche i renziani garantiscono "massima compattezza", assicura Maria Elena Boschi. E i 5 stelle non nascondono la soddisfazione: "Sono molto soddisfatto dell'accordo", l'intesa raggiunta e messa nero su bianco in un documento sottoscritto da tutti i capigruppo "è un passo importante per la legislatura", afferma il ministro Federico D'Incà. Certo, qualche voto in meno tra le file della maggioranza è atteso, ma "niente di preoccupante", minimizzano fonti parlamentari.
Per il via libera finale serve la maggioranza assoluta e i giallorossi da soli possono contare sulla carta su 344 voti. Numeri che, quindi, non fanno sorgere eccessive preoccupazioni, anche se dovessero esserci alcuni malpancisti. Il limite massimo della soglia di sicurezza è di 20 'defezioni'. Oltre questi numeri, viene osservato, potrebbe scattare l'allarme. Ma ai voti della maggioranza dovrebbero sommarsi anche almeno una decina di voti del Misto.
E quelli del centrodestra, senza che questi diventino determinanti. FI, FdI e Lega, però, potrebbero approfittarne: se ci dovessimo rendere conto, viene spiegato, che domani alla maggioranza dovessero mancare molti voti, noi non voteremo la riforma, così da impedirne l'approvazione finale. Ma i numeri non lasciano molti margini d'azione - e speranze - al centrodestra. Dunque, se tutte le forze politiche che hanno annunciato il voto favorevole confermeranno domani il sì definitivo, l'ok finale al taglio dei parlamentari passerà con oltre 600 voti.
Durante la discussione generale, che si è svolta oggi nell'Aula della Camera, hanno infatti confermato il voto favorevole le forze di maggioranza che sostengono il governo: M5s (216 deputati), Pd (89 deputati), Leu (13 deputati) e Italia viva (26 deputati), per un totale di 344 sì. Ai voti favorevoli della maggioranza, sempre stando alle dichiarazioni ufficiali fatte oggi in Aula, si aggiungeranno i sì di Forza Italia (99 deputati) e Fratelli d'Italia (34 deputati), per un totale di 133 sì che, sommati ai voti della maggioranza, innalzano a 477 l'asticella.
Resta un margine di incognita su cosa farà la Lega, visto che oggi i deputati leghisti hanno nuovamente disertato i lavori sempre per protesta contro l'assegnazione del reddito di cittadinanza all'ex brigatista Saraceni. Ma se si deve tener fede a quanto detto, anche ieri, dal leader Matteo Salvini, la Lega - che finora nelle tre votazioni precedenti ha sempre dato l'ok alla riforma - non dovrebbe far mancare i suoi voti favorevoli: se così fosse, i sì salirebbero a quota 601. Numeri a cui potrebbero aggiungersi i voti favorevoli di alcuni deputati del gruppo Misto (i 6 deputati totiani, i 3 del Maie, e i 4 deputati delle Minoranze). Al momento, l'unica forza politica che ha annunciato ufficialmente il voto contrario e' +Europa, che alla Camera conta 3 deputati.

People on Reddit are slamming a 200-square-foot San Diego 'shed' that rents for more than $1,000 a month, but it's just the latest example of America's unaffordable housing marketCache
The apartment, located at 4735 1/2 Oregon Street in San Diego, California, is currently listed by JD Property Management and Realty. The listing describes the unit as an "updated studio with 1 bath and small kitchen" in the University Heights neighborhood. San Diegans on Reddit were outraged to see that the tiny unit, which many of them deemed a "shed," was asking $1,100 per month to rent.
"Someone is really charging people $1,100 to live in a shed! And they want you to have a 650+ credit score too," Reddit user terrificheretic posted, referencing the listing's stated rental requirements (income of 2.5 times the monthly rent, a FICO score at or above 650, no legal evictions on record, and "good rental references").
"I'm all about charging market value but this seems a tad... over-valued, to say at the least," one commenter wrote.
"I was making $8.50 an hour and my first apartment was $190 a month. It was cool 40 years ago. I can't believe how difficult it is for people now. We have f----- up the middle class," another commented.
Realtors say this pricing isn't unusual
But Joshua Dillon, a broker with JD Property Management and Realty, says this pricing is "not uncommon."
"There are several other units around town that are comparable," Dillon told Business Insider via email.
He noted that the "typical/average" one-bedroom in the larger San Diego County rents for between $1,300 and $1,500 per month and that the asking price of the Oregon Street studio (now reduced to $1,050 a month) "is not much more than people are paying to rent rooms within houses ($800-$900)."
Ranking and review site Niche puts the county's median rent at $1,467.
Dillon also clarified that the apartment is not a shed, despite its shed-like appearance: "This unit has its own electric meter, its own address, etc., and has been here since the end of World War II per the owner, due to the housing shortage at that time."
The "shed" on Oregon Street is just one symptom of a nation-wide issue
The housing crisis is on clear display across the US, particularly with the astronomical cost of living in areas like New York City, San Francisco, and Palo Alto.
Business Insider's Libertina Brandt previously reported that the median rent for a Manhattan studio apartment in July and August hit $2,700, while Brooklyn's median face rent hit an all-time high of $3,000 per month in June. Brandt separately reported in September that the tiniest apartment in San Francisco, just 161 square feet, was asking over $2,200 a month in rent. Renters in San Francisco are even dishing out $1,200 a month to rent a single bunk bed in co-living buildings and over $2,000 a month to rent rooms in vacant Victorian homes.
Landlords in New York City were even caught renting out "micro rooms" — illegal sub-units with no windows, sprinklers, or fire-safety systems — with ceilings reported to be a mere 4.5 to 6 feet tall.
Quinisha Jackson-Wright, a freelance journalist for Business Insider, wrote about how her rent more than doubled — from $800 a month to $2,000 — when she moved from the Midwest to Santa Barbara, California.
Recognizing the issues, some states are attempting to tackle the affordable housing crisis: California recently became the third state (after Oregon in March and New York in June) to pass a rent control bill in an effort to curtail the problem. And tech companies are attempting to find solutions as well; Microsoft announced in January that it would pledge $500 million to help alleviate Seattle's growing housing crisis in light of the city's influx of tech companies, Business Insider previously reported.

Si algo le gusta al creativo japonés es darse vueltas por el mundo, y esta vez ha ido a parar a la actualidad rusa, donde el medio DTF le ha entrevistado acerca de su inminente obra. Una de las preguntas ha ido a dar donde se encuentra el elefante en la habitación: ¿Cuánto dura Death Stranding?
Kojima ha sido extremadamente escueto en su respuesta, pero también muy directo, como hemos podido ver en esta traducción realizada por el usuario de Reddit Skolpov. The council has curbed State Environmental Policy Act (SEPA) appeals because they are a hindrance to progress and used as a speed bump by critics of projects. SEPA has been weaponized to slow down controversial construction. The council will ban SEPA appeals on all up-zoning projects around transit stations, allowing multifamily units on single-family zoned parcels, and more. There will also be a 120-day limit for appeals unless both sides agree to more. Maybe this will speed up the ol' Seattle process?
State Department orders Trump-Ukraine witness not to speak: Gordon Sondland, the United States ambassador to the European Union, has been ordered by the Trump administration to not appear for his scheduled hearings in front of three House committees on Tuesday. He has no choice but to comply, according to his attorneys. The House Democrats have warned the Trump administration not to interfere in the investigation. This could be used as evidence of obstruction, something on par with impeachment, in the House's opinion. Trump and his team are attempting to quell further cooperation.
Representative Adam Schiff speaks up: Mike Pompeo also missed a Friday deadline to produce documents. The House has now subpoenaed those. One witness has failed to show and another has been pressured not to. Other witness testimonies this week are shakier now.

This is a slightly confusing case for those of us (almost all of us, I'd think?) who believe that sex stereotypes should not govern what is considered "appropriate attire" in the workplace. However, Stephens and his lawyers are NOT arguing that sex-stereotyped dress codes in the workplace are unconstitutional.
Instead they are arguing that because Stephens identifies as a woman, Stephens is LITERALLY a woman, and sex-discrimination legislation should protect him on this basis. In other words, if Stephens succeeds, the Supreme Court will enshrine gender identity in all our laws; redefining "female" as an unverifiable, subjective feeling that anyone can have, and thereby eliminating sex-based protections (and even accurate data collection) for American women and girls. This is a Big. Deal."
