Social Media and Medicine: A HIPAA Primer


Businesses live and die by Social Media in today’s economy, and Medical Practices are not immune from bad reviews. Businesses have options regarding bad reviews: they can ignore them, fight them or respond, especially if the comment is especially grievous. However, due to HIPAA, Medical Offices cannot respond to any complaint other than the boilerplate:

We at ABC Medicine take all comments regarding our practice very seriously. We request that if you have an issue, please contact the office.”

Medical Professionals, being human, at times want to respond to a complaint. Elite Dental Associates, located in Dallas Texas, found out the hard way that this is a HIPAA violation: 

Responding to online patient reviews just cost a dental practice $10,000 after it was accused of disclosing a patients' health information in social media posts. 

Elite Dental Associates ran into trouble after a patient filed a complaint with the OCR in June 2016 alleging the practice responded to a social media review posted on Yelp, an online business review forum, by disclosing the patient’s last name and details of her treatment plan, insurance and cost information.” 

There is a thought that if a patient posts about their medical treatment, giving details, that it is now permissible for the Medical Office to respond. This is not true:

Experts on social media say that whenever doctors or healthcare professionals post on social media sites they need to be aware of HIPAA regulations and protect the confidentiality of patients.” 

As an Administrator, I once had to take down a facebook site because patients were posting pictures of themselves in the exam area, thus violating HIPAA privacy.

In medical facilities now, you may see signs posted requesting 'No Video or Pictures during the appointment.' This is because HIPAA clearly states that personal health information cannot be posted in any public area, including Social Media.

Timbers Step Up, Qualify for Postseason in Style

Heading into the decisive final day of the MLS regular season, there were plenty of bad omens for a struggling Portland Timbers team in need of a result to qualify for the playoffs.

Brian Fernandez was suspended. Diego Valeri was out with a lingering calf injury. And the San Jose Earthquakes were coming into Providence Park with everything to play for — in need of a win to keep their own season alive.

This time, though, after a month of of ugly soccer and bad breaks and disappointing results, the Timbers got the job done and did it with room to spare.

Goals from Larrys Mabiala, Dairon Asprilla, and Sebastian Blanco were more than enough to lift the Timbers to their first win in six games on a lovely fall afternoon, jump into sixth place in the Western Conference, and bring the curtain down on San Jose's remarkable season.

All of the sudden, after all they endured this fall, the Timbers can look forward to a third-straight playoff appearance that will begin with a game against Real Salt Lake — a team that they've already beaten twice this year, at a venue that they've won at in both of their previous visits under Giovani Savarese.

Things are looking up. Facing the biggest test of their season, the Timbers had the right gameplan and executed it to near-perfection.

With San Jose man-marking in the ubiquitous system installed by their Argentinian manager Matias Almeyda, Savarese — in a move reminiscent of Portland's surge last fall — set his team up to defend deep and hit the 'Quakes on the break.

The early returns were positive. The Timbers nearly took the lead after a quarter of an hour when a Blanco corner hit Chris Wondolowski and forced San Jose goalkeeper Daniel Vega into a sprawling save, and generally were contesting the game on their terms.

The Timbers were getting traction going forward, and while the Earthquakes had plenty of the ball — they'd finish with 61 percent possession and complete nearly 200 more passes than the Timbers did — they were completely unable to break down the Timbers' defensive lines.

A slaloming, one-man run aside, Jorge Villafaña held the dangerous Cristian Espinoza was held in check. Vako completed only four passes during the entirety of the half on the opposite flank, Wondolowski just two from his position at center forward.

The Timbers' attack was limited somewhat with Asprilla and Andy Polo playing on the wings, but with Ebobisse dealing up top and Blanco slashing through the middle, it had a balance that had often been missing over the last several months.

It was on a set piece, though, that the Timbers would strike first.

Just before the half hour mark, Asprilla settled a recycled corner on the edge of the penalty area and slipped a ball wide left for an onrushing Villafaña, who whipped a pass across the face of goal that Mabiala, who had stayed in the box after the initial clearance, stuck out his trailing leg and dragged in.

Just like that, San Jose was in serious trouble — in need of multiple goals, with a third of the game gone, having failed to create a single significant chance yet. But they still had Wondolowski, and, with him, the ability to conjure a goal from thin air.

With halftime closing in and the score 1-0, that's exactly with they did. Off of a pre-planned corner routine, Espinoza hit a cross to the near post and the 36-year-old record MLS goalscorer beat everyone to the ball and flicked a diving header off of the ground, off of the underside of the crossbar, and in to tie the game.

It was vintage Wondolowski — a purely instinctual, fearless finish, his record eleventh goal against Portland, a one of the most important of his season.

As the second half began, with Dallas running riot over Sporting Kansas City, everything was on the table. One of these teams was going to be playing its final 45 minutes of the season, one was going to move on.

Enter, not for the first time and not ever unremarkably, Asprilla. Handed his first start in a month ahead of Marvin Loría, the Colombian with a penchant for scoring the most timely of goals repaid Savarese's faith with another memorable contribution.

Just before the hour mark, Asprilla drifted inside to pick up a cross-field pass from Ebobisse, cut past Florien Jungwirth with an excellent first touch, and went barreling through on goal. Vega stopped his first shot, but the rebound squibbed underneath him — and Asprilla, at the second time of asking, tucked it in.

Whatever his past, for a player who has had the most abject of seasons, this was a stunning moment: a truly excellent goal, all of his own making, thanks to the kind of decisive turn of pace that you almost never see him make when he receives the ball.

At this time of the year, though, there's no rhyme or reason when it comes to Asprilla. He's just a different player.

Almeyda emptied his bench almost immediately the goal, making all three of his substitutions and trying to push his team — again in search of two goals, now with just 30 minutes left to play — into a more overtly attacking posture.

In the process, which included removing a defensive midfielder, the 'Quakes opened themselves up on the counter. The Timbers had several chance to ice the game in the following minutes, with Ebobisse and Cristhian Paredes coming closest, but it'd take a special moment from Blanco to make the result secure.

With a quarter of an hour to play, and Valeri off the field, it was the diminutive Argentine who stepped to a free kick from 25 yards away and fired it into the top corner.

No player on the field more deserved to score. The Timbers were never worse over the last month than when Blanco was out of the lineup, and on a day when they were missing their two most high profile attackers, he brought the heat in every phase of the game.

With that, San Jose was buried. They finished the season having lost six straight, a sour end to an otherwise triumphant first MLS campaign for Almeyda.

The Timbers' run-in wasn't much prettier. But Savarese, who has never missed the postseason as a manager, was understandably pleased with his team's perseverance. They didn't throw in the towel, and they made it to the finish line with their season intact.

"It has been a very difficult season in so many ways," Savarese said after the game. "So that’s why I think even in this moment that we have been able to make the playoffs, I’m more proud than ever for all the guys we have on the team.”

The slate is clean. Salt Lake away, a team the Timbers know they can beat, and then the specter of another playoff meeting with Seattle. The possibilities, just as they should at this time of the year, abound.

New Sick Leave Guidance for San Antonio Employers

Call to Reconciliation

Wrong Way Auto Accidents

In early August, the CBS news channel reported a car accident caused by a wrong way driver. The accident happened in the middle of the night near the Ridgmar Mall in Fort Worth, Texas. The police reported showed the driver was driving east on a westbound lane when he struck a van head-on. This collision led a semi-truck to hit the negligent driver’s vehicle. At the time of the accident, the police believed the negligent driver was intoxicated. Furthermore, it was reported by new reporters that individuals in the van suffered severe injuries; thankfully, none of the injuries were life-threatening. As you can image, wrong-way vehicle accidents can be one of the most dangerous auto accidents people can encounter. On average, wrong-way accidents cause 300-400 car accidents a year. Hillary Clinton discusses Trump's impeachment to a crowd chanting 'Lock him up!'


One of the darkest refrains of the Trump presidency have been the crowds at his rallies chanting "Lock her up" at the mention of Hillary Clinton's name.

The idea that an American president would threaten to imprison a political rival smacks of authoritarian tactics that have no place in a democracy.

These days, the chants seem rather ironic being that Donald Trump is facing an impeachment inquiry in the House of Representatives for trying to extort the president of Ukraine. If Trump is removed from office, he may face legal consequences for his actions which could mean jail time.

"The Late Show" host Stephen Colbert had fun with the idea of Trump being locked up on his show Monday night when his guests were former Secretary of State Clinton and her daughter, Chelsea.

At the start of the interview, Colbert asked Clinton about the impeachment inquiry saying, "Is it time to — dare I say — lock him up?"

Then the crowd began chanting "Lock him up" to Clinton's chagrin and then she motioned with her hand to tamp down the chanting.

When the crowed quieted, Clinton said that the impeachment inquiry is "exactly what should be done."

"I believe strongly that this particular incident has had such a huge impact because we've known for a long time that he [Trump] was a corrupt businessman who cheated people, and we've known that he and his campaign asked for aid from Russia, we've known that," said Clinton.

"But to see him in the office of the president putting his own personal and political interest ahead of the national security of our country just pierced through whatever confusion or denial people had. And, at that point, Speaker Pelosi rightly said this is something we have to investigate and that's what's going on."

Colbert admits that Trump's dealings with Ukraine have changed his opinion on impeachment.

"I was never a big 'let's impeach him' fan," Colbert said. "I thought we should go to the ballot box. But when someone is clearly using the office that they're in to subvert the ballot box. To use by corrupt means influence fro other countries to maintain their office, what good is that ballot box at that point?"

Clinton knows about impeachment. Her husband was impeached in 1998 and, as a young lawyer, she worked on the case against Richard Nixon. She believes that Trump's actions are exactly what the framers of the Constitution were defending against.

"To undermine the oath that he took to protect and defend the Constitution and the American people that's what falls right into the definition of an impeachable offense," she said.

Colbert also asked Clinton's thoughts on current Secretary of State Mike Pompeo, who was on the call when President Trump attempted to extort the president of Ukraine.

"How many times when you were Secretary of State did you have to say to Barack Obama 'You can't extort foreign countries'?

"Yeah, that never happened," Clinton laughed.


The off-duty cop who murdered an unarmed black man in his own apartment gets 10 years in prison


Former Dallas police officer Amber Guyger was sentenced to ten years in prison on Wednesday for the murder of Botham Jean. The sentence comes a day after she was convicted of murder and faced five to 99 years or life in prison.

Guyger has the opportunity to appeal the conviction.

The sentence came down after emotional testimony from the Jean family and the revelation that Guyger shared racist text messages.

In the texts she said black officers have a "different way of working" and joked about the death of Martin Luther King, Jr. Two days before she murdered Jean, a friend texted saying they adopted a German Shepard that "might be racist," to which Guyger replied, "It's okay ... I'm the same."

Last year, Guyger entered Jean's apartment and shot him as he sat in a chair watching television. In a 911 call at the scene of the crime, Guyger repeatedly admits she thought she was in her apartment, which was a floor below in the same complex.

The conviction is much more than a victory for the Jean family. Many see it as justice for people of color across America who've been killed by law enforcement and never received justice.

Research from NBC News shows that 900 to 1,000 people are killed by the police each year, but only 35 have been convicted of a crime related to an on-duty fatal shooting since 2005.

"This verdict is for Trayvon Martin," Ben Crump, an attorney for the Jean family, said Tuesday after the verdict. "It's for Michael Brown, it's for Sandra Bland, it's for Tamir Rice, it's for Eric Garner, it's for Antwon Rose, it's for Jemel Roberson, for EJ Bradford, for Stephon Clark, for Jeffrey Dennis, Genevieve Dawes, for Pamela Turner."

"For so many black and brown unarmed human beings all across America, this verdict today is for them," Crump continued. "Everybody can raise their hands — this verdict is for them. This verdict is for them."

On Sept. 6, 2018, just before 10 p.m., Guyger drove home after working a 13.5-hour shift. Upon arriving at what she thought was her front door, she failed to notice that, unlike her apartment, this one had a red door mat.

She put her key fob to the door but realized the door wasn't locked and pushed it open.

When Guyger arrived in the apartment she saw a shadowy figure she assumed was a burglar. According to testimony, she pulled out her gun and ordered the man to show his hands. She then discharged two rounds from her firearm.

That figure was an unarmed 26-year-old accountant named Botham Jean and it was his apartment.

Jean was watching television and eating a bowl of ice cream when Guyger entered the apartment.

Guyger had accidentally parked in the garage a floor above hers. She then walked past over a dozen apartments without realizing her mistake before arriving at Jean's apartment, directly above hers.

On a 911 call from the incident, Guyger can be heard saying, "I thought it was my apartment," 19 times.

"I'm an off-duty officer," Guyger told the 911 dispatcher. "I thought I was in my apartment. And I shot a guy thinking that he was... Thinking it was my apartment. ... I'm fucked."

Throughout the call she tries to roust Jean saying, "Hey bud. Hey bud. Stay with me, bud." She also apologizes to the dying man saying, "I'm sorry."

Jean was taken to a nearby hospital where he died.

Three days after the shooting, Guyger was charged with manslaughter. By the end of the month, she was fired by Dallas PD. A grand jury would later ratchet up her charge to murder, for which Guyger stands to spend life in prison.

Jean's death sparked many protests and demonstrations in the weeks after the shooting. A few days after the shooting, dozens of protesters gathered outside Dallas Police headquarters and officers fired pepper balls into the crowd.

On September 12, a Dallas City Hall meeting was brought to a halt after protesters chanted, "No justice, no peace."

After the verdict, Crump said Jean was a "near perfect" person.

"This jury had to make history in America today, because Botham was the best that we had to offer," Crump said. "Twenty-six year old, college-educated black man, certified public accountant, working for one of the big three accounting firms in the world, PricewaterhouseCoopers."

"But it shouldn't take all of that for unarmed black and brown people in America to get justice," Crump said.

ACORN's foot soldiers, funded with your tax dollars, will scream, pound their fists, chain themselves to buildings, padlock the doors and engage in illegal behavior until they get what they want. We can all sympathize with good folks who can't pay their bills. Artificially propping up the housing market will only result in more of the same costly borrow-spend-panic-repeat cycles that got us into this mess in the first place. Failing corporations need to fail. So do failing home borrowers. This is borrowing from frugal renter Peter to pay profligate Paul's home loan.

Now that's the kind of theft that should be the subject of civil disobedience.

Instead, ACORN offices, funded with your tax dollars, are training teams of "Home Savers" -- described as "people ready and willing to mobilize on short notice to defend the homesteaders against attempts to evict them." Ready, willing and able to mobilize on short notice because they are either unemployed or employed full time as ACORN shakedown artists.

Guess who's encouraging them to defy the law. Democratic Rep. Marcy Kaptur of Ohio, who told them: "Stay in your homes. If the American people, anybody out there is being foreclosed, don't leave." The housing bullies will be assisted by left-wing propaganda documentarians at the Brave New Foundation, headed up by Hollywood lib Robert Greenwald, who will disseminate sob stories to crank up pressure while Obama pushes his housing entitlement plan.

I saw a lot of this as a kid being ushered from "antique" shops to junk shops in 1950's Dallas. Yesterday, I saw several pieces at a cute place in New Braunfels near San Antonio and blurted out, "Oh my god, that's French enamelware - I remember it!" I remember seeing red and blue. From the Internet, I learned it is called "chicken wire" enamel ware. I recalled it was from the 1930's. My aunt, who lived in Paris in the 1930's and late 1940's, had a lot of it in her miniature kitchen. What a treasure you found! Beautiful condition, pretty enamel finish in great condition. Enjoy!! In February 2017, I was a digital coach at Pinecrest Academy St. Rose, a middle school in Las Vegas, where I supported teachers and students with tech-based initiatives

A colleague of mine was teaching about the assassination of President John F. Kennedy, and his U.S. history students wanted to learn more. 

I contacted Clint Hill, who worked as a Secret Service agent and witnessed the shooting in Dallas in 1963, and asked if he could speak to the class. Hill, who had served in Jacqueline Kennedy’s Secret Service detail, agreed to do a live session from San Francisco

We originally planned to connect by phone, but I figured why not try a videoconference? We agreed to use the technology to connect the students for a once-in-a-lifetime history lesson.

In my 10 years as an educator, I had never seen such high-impact lessons before. I decided to run with it and create as many guest speaking events as possible for students.

5 Ways to Expand Learning Beyond Classroom Walls

Videoconferencing, also known as web conferencing, is not new. But at Pinecrest Academy, we’ve developed a unique program that features videoconferencing sessions several times a week, at multiple schools, at minimal cost. 

In some cases, we’ve set up videoconferencing programs that simultaneously connect up to 200 classrooms in five countries

The vast majority of the sessions, though, connect our classrooms with the speakers, who typically conduct the sessions in their home or at their office. 

Teachers contact me all the time to ask how we got started. It requires minimal technology — and schools already have much of the basic infrastructure needed. 

Use these five best practices to get a videoconferencing program started in your district. 

  1. Set goals and an overall vision: Will the videoconferencing run only for one school’s students, or will the school open it up to other schools in the district, local community colleges and universities, or other institutions around the country or world? It’s best to start with high school students because they are more mature, but any group from fifth or sixth grade up will work fine. 

  2. Determine technical requirements: There’s a very low barrier to entry with videoconferencing. Anyone can get started with an internet connection and a computing device that has a webcam and a projector. Most schools already have these pieces in place. If the guest speaker isn’t comfortable with the video tools, it’s possible to send them an audio link from a videoconferencing service, which allows the speaker to connect to the classroom, make a presentation and answer questions with students in an audio-only format. We once had a 94-year-old guest speaker who was a Holocaust survivor and was uncomfortable with the video setup. In that situation, the audio-only connection worked well.

  3. Embrace the flipped classroom: Videoconferencing is a great tool to facilitate a flipped classroom, increasing student engagement. Once a speaker is scheduled, the teacher should think through strategies to ensure students are prepared for a robust conversation. For example: Assign short videos about the topic at hand or the speaker’s life, or have students read about the speaker and prepare questions for the presentation.

  4. Strive for emotional learning experiences: We’ve had a World War II veteran tell our students about fighting in the Battle of the Bulge. We’ve also had a survivor of the 9/11 attacks recount what they witnessed in New York on that day and how they escaped danger. For younger students, we’ve had zoologists talk about various animals and had a NASA scientist discuss space missions. Hearing these stories firsthand creates an experience that students can’t replicate by reading a book or watching a documentary. It’s a way to engage them — and 40 percent of middle and high school students say they don’t feel engaged, according to a survey from the national nonprofit YouthTruth. And with roughly half of middle and high school students saying they don’t feel their studies are relevant, creating an emotional connection to the topic is a way to turn that around.

  5. Find funding for a full-time pro: Videoconferencing works best when there is at least one person — whether it’s someone in the IT department or an educational technology teacher — who’s dedicated to managing it full time. 

That person will plan videoconferencing sessions and manage a website where teachers can make requests, view the schedule and sign up. 

If funding for a full-time professional isn’t in the budget, consider splitting the responsibilities between two or more people. Another option is to apply for grants to seed the program.

Explore the Possibilities of Classroom Videoconferencing

Many colleges have had solid videoconferencing programs for years. K–12 schools have lagged, mainly because many lack the funds to dedicate full-time staff and acquire the needed technology

However, as costs decrease, school districts that lack resources can usually find the money to secure at least a basic setup. In many states, districts can apply for technology grants. 

For example, funding for my position as a digital coach came through a Nevada Ready 21 technology grant, which also supported secure one-to-one technology and digital coach positions throughout our cluster of charter schools in southern Nevada. 

We support teachers with device management and develop new ways to deliver content in the classroom to help create a tech-rich learning environment.

Once administrators try videoconferencing, they’ll appreciate the wide range of speakers they can bring in and the topics they can cover, from history to current events and even complex subjects like math and computer science.

Granger to Face Primary Challenge From Former Council Member


A former Colleyville City Council member is challenging 12-term incumbent U.S. Rep. Kay Granger (R-Fort Worth) for the Republican nomination in Texas' 12th U.S. congressional district.

Chris Putnam said he has already raised $500,000 in the first week of his campaign.

"I think that is clear evidence that there is a big appetite out there to do something different at this point," Putnam said.

Putnam spent 30 years in the technology business and served one term on the Colleyville City Council. He said he thought the district needed a more conservative Republican.

"People again are hungry for somebody who has more of a business background like the president, who looks at the problem fundamentally differently," Putnam said. "And comes in with a reform platform, you know, to fundamentally change things and changes the way Washington does business, as opposed to the way that we have been doing things, which is clearly not working in congress.".

Granger has raised more than $751,000 this year and has more than $362,000 cash on hand, according to her campaign. Monday, she released a statement on the race.

“I have never run a campaign against an opponent or his money. I have worked every day to benefit my community and the nation and will continue to do so. I am committed to working for jobs to support the great people who build the F-35 at Lockheed, for the teachers who guide our children to believe in America and live out our nation's principles, and entrepreneurs, who start their own companies like the one I started and ran for 20 years. I will do so by continuing to help our president keep this economy growing and make our borders safe. I am confident I will have the resources to not only continue the support I have, but communicate with people new to District 12 about my proven track record of success and service and my continued energy and vision for the future.”

Lisa Welch and Al Woolum are running as Democrats in the district.

Southwest pilots' union sues Boeing over grounding of plane

DALLAS – The union representing Southwest Airlines pilots is suing Boeing, saying its pilots are losing money because the company rushed an unsafe plane into service only to have the 737 Max grounded after two deadly crashes.

The Southwest Airlines Pilots Association said in the lawsuit filed Monday that Boeing misled pilots and airlines by not telling them about a new flight-control system called MCAS that is now at the center of investigations into the accidents.

The lawsuit, filed in a Texas state court in Dallas, could make it harder for Boeing to gain public confidence in the plane. Chicago-based Boeing hopes to use pilots in a campaign to reassure travelers once regulators approve changes that the company is making to the plane.

Southwest had more Max jets than any airline when the plane was grounded in March. It has canceled thousands of flights through early January as a result.

The president of the pilots' union said in an interview that the lawsuit followed failed negotiations with Boeing over compensation for income that pilots have lost due to canceled flights. Also at issue were the union's expenses to comply with a subpoena from the Justice Department, which is conducting a criminal investigation into Boeing's representations to regulators who certified the plane.

The union leader, Jon Weaks, said he believes Boeing will make the plane safe and pilots will resume flying it.

"When the plane comes back, it will be one of the most examined airplanes ever," he said. "The problems they had with MCAS are being engineered out of it."

The lawsuit, however, uses harsh language in condemning Boeing for what it told airlines and pilots about the Max, which went into service in 2017. Boeing sold the plane as a more fuel-efficient but otherwise lightly modified version of the 737, which has flown since the 1960s.

"Those representations proved to be false," the union says in its lawsuit. "The 737 MAX now is grounded worldwide because it is unsafe, unairworthy, and contrary to Boeing's representations, distinct from the 737 family of aircraft that preceded it, which SWAPA pilots have flown for years."

Crashes involving Max jets in Indonesia and Ethiopia killed 346 people. The company faces dozens of lawsuits filed by passengers' families and has settled a few for undisclosed terms. In July, it announced a $4.9 billion after-tax charge to cover compensation it expects to pay airlines in coming years to cover canceled flights.

Yay! I got the pig races!

We are in Dallas for a wedding. The State Fair of Texas is in progress right in the city. As a photographer I could not pass this up. None of the family would come with me; it was 95F / 35C in bright sun. They told me I was crazy. They were right. I'm still not walking well and I damn near got heat stroke. But I got some terrific shots. 

I happened to walk by a building where pig races were about to start. Can't pass that up. It was a once in a lifetime experience.

LUCY BURDETTE: Today our dear Deborah Crombie's book A BITTER FEAST is on sale everywhere! We couldn't be more excited! Rather than wax on about how much we loved this book and this author, I'll get right to questions for Deb:

I know well how hard writing is and especially writing a complicated police procedural with long running characters. But I kept thinking about how much fun you must have had with the background of the story – inventing the food and the gardens and the dogs and describing Melody’s parents’ country home. And at the lunch, the table settings, the local produce, the gin cocktails…

Do you mind starting with the lunch menu? That special luncheon was so divine! I really hoped that the murder wouldn’t ruin the meal before the guests got a chance to enjoy it. Roasted lamb with white beans and fennel, local smoked trout pate, pickled veggies with seeded flat bread—you had me absolutely drooling. Even the salad was stunning with pears, blue cheese and a drizzle of caramel. 

 But now inquiring minds need to know, did you actually cook this menu? And how did you choose it?

DEBORAH CROMBIE: I wish I had cooked all of those things! I’m hungry just reading your list.

I’ve made leg of lamb, although not in a smoker, and fennel and white beans, although not together with the lamb. And I’ve experimented quite a bit with the fermented veggies. (As for the gin cocktails, I think I can claim to be an expert!)

The main inspiration for Viv’s menu was a dinner given by a local McKinney chef, Robert Lyford.  It was my first trip to the Round Top Antiques week down in Brenham, Texas, and Robert was the featured chef for an outdoor dinner at a place called Rancho Pillow.  The guests were seated at one long table, set much like the tables in the book. We were served pickled vegetables and spicy pimento cheese with crispbread, then Robert’s main course was “pork and beans” served in camping tins.  And the deserts were in little jars, as are Viv’s in the book. All the food was amazing. So that part of the menu is totally down to Rob, except that I switched pork to lamb because the Cotswolds is sheep country. The pears and blue cheese were based on a recipe in our local foodie magazine, Edible. Yum! The smoked trout I just threw in because I love smoked trout spread, and if fit with the local foods.

LUCY: You had wonderful descriptions of your character Viv deciding she’d be a chef and then what it was like in the world of the kitchen, the sexism, the hard work, the pressure of seeking a Michelin star—even the tattoos the chefs got to celebrate. Here’s a snippet from p. 270: It was so tenuous and indefinable, the synergy of the kitchen. When everything worked, it was an almost liquid thing—one station flowed smoothly into another and the communication on the line was seamless.”(Of course, everything is not working!)

Tell us about the research you did to get this right?

DEB: I had lots of help and advice, not just from Rob Lyford, but from my chef friend in Phoenix, Sean Currid, and chef Nik Chappell at the Slaughters Manor House in Lower Slaughter. Both Sean and Nik gave me restaurant kitchen tours and answered lots of questions. And then I read and read and read. Chefs’ bios and memoirs, books about professional cooking and about the restaurant world. I also ate a lot! Research was my excuse to go to a lot of restaurants in London and the Cotswolds that I would normally have considered out of my budget. Now I have to figure out a way to justify those meals on the next trip.

LUCY: I’ve been thinking a lot about your chef characters and remembered an interview I did on the blog with psychologist Scott Haas about his book, THE BACK OF THE HOUSE. I asked him if he ever felt like a psychologist to the chefs, and he said:

“There is a profound superficiality to the way some chefs regard the depth of their emotional lives--an avoidance, a calcification, part of why they cook instead of developing intimacy.  Cooking is much easier than working on relationships.  Certainly the chef told me extremely personal things, but this is not an introspective profession. On the contrary.”

Did you find this to be true as you were talking with chefs? I can imagine this description fitting at least one of your characters…

DEB: The chefs I spoke to seemed to make a great effort to lead balanced lives, and they guard their days off ferociously. But, yes, I think you can safely say that the chefs in my book have a hard time maintaining a work/life balance. Otherwise, we wouldn’t have much of a story!

LUCY: You make a wonderful comparison between the work of a gardener and a chef—how in both professions, people work so hard to achieve something that is fleeting, such as a wonderful meal or a perfectly weeded garden. And that brings us to gardens. We can picture the roses and the hedges and can imagine the landscape architect at work. Will you tell us about your interest in this and how your gardens compare?

DEB: This book let me indulge both my passions. I am an enthusiastic if not particularly good gardener (the same could probably be said of my cooking…) and I have an obsession with English roses. I’ve also been fascinated for as long as I can remember with English gardens, and with Arts and Crafts gardens in particular.  A wonderful book on the restoration of the Gertrude Jekyll garden at a Surrey house called Upton Grey inspired the gardens at Beck House.  I even drew diagrams of all the beds and plantings.  Although my own garden is tiny in scale compared to something like Beck House, I do use a lot of native perennials in a natural way—a very Arts and Crafts design template.

LUCY: You were spinning so many plates with your plots and subplots and it surely must’ve been difficult to decide which characters to bring forward and which new ones to introduce. With a series that has run to 18 books, can you tell us more about that process?

DEB: I’m usually thinking a book ahead about what characters will lead the next story. In A Bitter Feast, I knew I wanted all four of my main characters, Doug and Melody as well as Duncan and Gemma, to be working the same case in the same place, and the setting followed from that. But because there is such a big cast of continuing characters in the series, my biggest problem in planning a book is deciding who to leave out, rather than who to put in.  And sometimes the characters don’t cooperate.

LUCY: You’ve mentioned that you go to England most years to do research for your books. What did you do and see while planning A BITTER FEAST? (Now we’re all dying to visit the Cotswolds.) Do you know what you’re looking for before you go? And where are we headed next?

DEB: I visited the Cotswolds on my very first trip to England with my parents, in the late seventies, and I had never been back, although I had for a long time thought the area would make a great setting for a novel. I made three trips for this book. The first was sort of a fact-finding mission, trying to find the perfect village (or villages) for the story. On that visit, I decided on the Slaughters, which I’d seen all those years ago with my folks. I’m sure we even stayed at Lords of the Manor in Upper Slaughter, when it had just opened as a country house hotel.

On the second and third trips I stayed in both Lower and Upper Slaughter, and I do think I could work for the Slaughters tourist bureau! The landscape and the villages in this part of England are just breathtakingly beautiful.  I’m quite downcast now at not having an excuse to go back—but maybe I will think of one. Beck House and the Lamb are, after all, still there.

The next book, however, is set in London, in Bloomsbury and Soho, and I’ll be off for three weeks writing and researching in London right after Bouchercon! And as usual, I can’t wait!

Deborah Crombie and Book Launch Madness

DEBORAH CROMBIE: The release of my 18th Kincaid/James novel, A BITTER FEAST, is just a little over a week away and I am in prep countdown! (Cue music from Jaws here!)

I will be on book tour from the 8th of October, ending with Bouchercon 2019 in Dallas. But there is so much to do before I take off! Written interviews, blog posts, podcast interviews, social media, scheduling! It's all fun, though, and here are a couple of my favorite things from this week:

Last Sunday's mention in Parade Magazine (which was completely unexpected!)

And the release of the teaser from the audio version of A BITTER FEAST, read by my wonderful narrator, Gerard Doyle. This made me swoony with excitement! It is such a weird and wonderful experience to listen to your own work read by someone else. The book takes on a life of its own.

I also, I have to admit, have been shopping. New book, new tour, new conference--all call for a new travel wardrobe. Here's the result of a one-day blitz!

So I am all coordinated, and with the help of a white blouse and couple of scarves (not worn with the animal prints!) hopefully I can do a week at a time without looking like I'm wearing exactly the same thing at every event.

But what about WRITING,  you ask. Well, here's my big news-- 

There is another book in the works--in fact, I've just signed a contract with my publisher, William Morrow, for two more books. 

I have a smidgen of the first book rattling around in my brain. A title, a setting, a germ of a plot, some chapters outlined and bits of scenes written. I just have to clear the decks, focus, and do some necessary research so that I can really dive in. Next time we roll around to What We're Writing I'll have a snippet to share and will tell you more about it.

Next stop after Bouchercon, three weeks in London!

NFL Week 4 Review of Packers Loss vs Eagles, NFL Week 5 Preview vs Cowboys — Another twofer!

The 34-27 loss by the Green Bay Packers at home to the Philadelphia Eagles a week ago Thursday dropped the Pack from the ranks of the undefeated. It was another surprisingly sieve-like performance by the rush defense.

Conversely, the Packers rush offense was dealt a blow early when RB Jamaal Williams took a direct hit to the helmet that saw him being carted off the field. Luckily, the injury wasn't severe, although he will still be out this weekend because of precautionary measures. Attempts to get untracked with the run were unfruitful.

Anyway, bottom line, albeit with a late goal-line tipped pass for an Eagles interception that should have been a pass interference call (along with another earlier), offensive and defensive deficiencies cost the Packers the game. It's usually how it goes in such situations, right?

Our preseason prediction for where we felt the Pack would be after the first quarter of the season was 2-2; instead, the team is 3-1. We'll take that.

Let's move on.

The Cowboys

The Cowboys also come into this game in Jerry's World at 3-1 following a loss to the New Orleans Saints in their last game. The 'boys have weapons on offense – RB Ezekiel Elliott and QB Dak Prescott in particular.  Elliott had one of his worst games in the loss to the Saints, rushing for only 35 yards on 18 carries. You have to believe he's licking his chops to scorch the Pack's defense. And let's not forget that Prescott can run as well as pass. So lots for the Packers' D to worry about.

Can the Pack pull this game out? Of course, QB Aaron Rodgers always seems to come up big in Dallas. He'll be without his number one receiver, Davante Adams, who is out with a turf toe. That means the other receivers, and especially TE Jimmy Graham, will need to step up. So, too, will rookie RB Dexter Williams, who will be the number two back behind Aaron Jones.

The Prediction

The Packers are 3-1/2 point underdogs at the time of this writing. This is a critical game for both teams: one will emerge at 4-1 and the other will fall to 3-2. While neither record guarantees success or failure going forward the rest of the season, it may foretell directional fortune for a few games, shall we say. The Packers will come home for two games, against the Lions and the Raiders, and then play two away at the Chiefs and the Chargers. How do you read those future games? They will be much better if the Pack pulls out a win in Dallas.

Despite having 10 days to fix some issues, we think the absence of Adams and Williams on offense will prove to give the 'boys just enough room to eek out a win.

We're calling it Cowboys 27 - Packers 23.

Red River Showdown in the Cotton Bowl Est. 1930

It is Red River Showdown Week.

Oklahoma vs. Texas.

Rachelle and I will be in Dallas this Saturday with friends watching the game at Texas State Fair's Cotton Bowl.

I always get a little sentimental this time of year.

The FIRST game ever played in the stadium that is now called the Cotton Bowl occurred Saturday, October 18, 1930.

OU end Fred Cherry
The Cotton Bowl, initially called "Fair Park Stadium," was built during five spring and summer months in 1930. The first college football game played in the new stadium was between the Oklahoma Sooners and the Texas Longhorns. My maternal grandfather, Fred Cherry, (picture right) was a sophomore tight end for Oklahoma University that year (1930).

In those years, players played on both offense and defense, and my grandfather started for Oklahoma and played the entire game. Both teams were held scoreless during the first half.

The first touchdown of the game, and for that matter the first touchdown ever scored in the Cotton Bowl, occurred in the middle of the third quarter, and it was a 55-yard touchdown pass to my grandfather.

 According to the Oklahoma Encyclopedia of Football, Oklahoma halfback Bus Mills threw a 55 yard 'bomb' to Fred Cherry who took the ball into the end zone and gave Oklahoma a 7 to 0 lead over Texas. Though Texas would eventually win the game 17 to 7, my grandfather holds the distinction of being the first player to ever score in the Cotton Bowl.

He would go on to play against Texas in 1931 and 1932 before he graduated with a petroleum engineering degree.

 My grandfather was a personal friend of Kappa Alpha fraternity brother and 1931 Oklahoma graduate Carl Albert, future United States Speaker of the House. However, Fred Cherry would himself leave his job in the oil fields and eventually quit a job at the state capital in order to fulfill his calling as a Christian evangelist.

I was born thirty years after my grandfather played for Oklahoma University, but I can distinctly remember watching OU football games at his house while growing up, particularly at Thanksgiving.

My grandfather died suddenly of a heart attack in 1970 at the age of 58, but my love for OU football continued.

In the early 1970's my father and I crash landed upon returning by private plane from watching the annual OU/Texas Cotton Bowl game.

We were caught in a powerful thunderstorm and landed in a convention center parking lot where U.S. Senator John Tower was holding a fund raiser. The kind Senator loaned us his personal vehicle to finish our trip home.

Over the years I have many, many memories revolving around the Oklahoma vs. Texas rivalry.

Hopefully, a good, new memory of OU vs. Texas will be established this Saturday at the Cotton Bowl.

Virginia Stage Presents DETROIT '67


Turntables turn to turmoil in the heart of Detroit when a mysterious woman enters the lives of siblings Chelle and Lank. Underground basement parties are the talk of the town as the spirit of Motown breaks barriers across neighborhoods. As race riots erupt in their beloved city, tensions escalate at home. How will this family keep it together as their community falls apart?

Detroit '67 is comprised of a company of actors making their Virginia Stage Company debut. Lisa Tharps (Chelle), from New York, has guest-starred in several hit television shows, including "ER", "Sex in the City", "Jessica Jones", and "Law and Order: SVU". Bryce Michael Wood (Lank) has performed in several of the top regional theatres, including Asolo Repertory Theatre, Geva Theatre Center, and the Contemporary American Theatre Festival. Performing in her second play by Detroit '67 playwright Dominique Morisseau, Shenyse LeAnna Harris (Bunny) is a New York-based actor that recently received her Master of Fine Arts degree from Brown University. Freddie Fulton (Sly) has recently performed at Long Wharf Theatre and the Edinburgh Fringe Festival. Rounding out the Detroit '67 cast is Suzannah Herschkowitz (Caroline), a recent Julliard graduate.

Directing this inspired cast is nationally and internationally acclaimed director, Thomas W. Jones II. His work as a writer, director, and actor has received several Helen Hayes awards, the San Diego critic's award, and the NAACP Phoenix Award.

Detroit '67 begins on October 23 with an official opening night on October 26, and continues with performances through November 10. Tickets for each performance start as low as $25 for children under 12. Discounts are available for groups, students, and members of the military community. Ticket prices will vary throughout the run of the show, so buy early for the best seats at the best prices.

Interviews can be arranged with members of the cast, crew, creative team, or staff of Virginia Stage Company. All reviews are welcome, and tickets can be provided to anyone who wishes to see the production for these purposes.

Virginia Stage Company is southeastern Virginia's leading theatre destination, serving an audience of over 58,000 annually, both at the Wells Theatre and throughout the community. Freddie Fulton (Sly) is making his Virginia Stage Company debut with this wonderful production of Detroit '67. Other theater credits include: Classic Stage Company's Julius Caesar (Brutus), Long Wharf Theatre's Paradise Blue (P-Sam), 59E59th/Edinburgh Fringe Festival's Someone Dies at the End (Bama), Seven Guitars (Floyd), Death of the Last Black Man (Black Man with Watermelon), A Soldier's Play (PFC Peterson), etc. Originally from Little Rock, Arkansas, Freddie received his MFA in Acting from Columbia University and is based in New York. He's grateful to the entire VSC team and blessed to have the opportunity to breathe life into this enriching story. Shenyse LeAnna Harris (Bunny) is a New York based actor from Houston, Texas. She holds a Master's degree from Brown/Trinity Rep 2018. This is her second Dominque Morisseau play and her Virginia Stage Company Debut- she is more than delighted to be a part of this process. Shenyse has been in Fetch Clay Make Man (Dallas Theater Center) Our Lady of 121st (Greer Garson Theater) Death of a Salesman, Skeleton Crew (Trinity Repertory).

Suzannah Herschkowitz (Caroline) is a recent graduate of Juilliard and spent this past summer working on The Public's Shakespeare in the Park production of Coriolanus. She is thrilled to make her Virginia State Company debut with this cast and crew.

Back during the Quickish Era, my favorite thing was the year-end "best-of" sportswriting list -- the first one was in 2011 ("Quickish 11 for '11"), and it proved pretty popular...not to mention enjoyable to prepare.

You can't find that original list anymore, but the tradition lives on in '14. And the underlying sentiment extends into another year: Sportswriting has never been better.

To be sure: "14" is an absurd, artificial constraint; there are many more worthy entries*, as my overworked browser tabs and gut-busting Pocket account indicate.

Wayne Fitzgerald, the main title designer who set the tone and atmosphere for hundreds of films, from Auntie Mame and Pillow Talk to The Godfather: Part II and Total Recall, has died. He was 89.

Fitzgerald died Monday on South Whidbey Island in Washington after a brief illness, his wife, MaryEllen Courtney, told The Hollywood Reporter.

Fitzgerald spent some 55 years in the business, including his first 17 at Pacific Title & Art Studio, where he rose to lead its art and design department.

Fitzgerald's lengthy résumé — he has 460 listed credits on IMDb — also included collaborations with Francis Ford Coppola on The Conversation (1974), The Godfather: Part II (1974), Apocalypse Now (1979), The Outsiders (1983), The Rainmaker (1997) and The Godfather Part III (1990); with Warren Beatty on Bonnie and Clyde (1967), Heaven Can Wait (1978), Reds (1981), Dick Tracy (1990) and Love Affair (1994); and with Roman Polanski on Rosemary's Baby (1968) and Chinatown (1974).

A three-time Emmy winner, Fitzgerald also helped introduce scores of TV shows, among them MaverickThe Beverly HillbilliesMr. EdIt Takes a ThiefNight GalleryColumboMcMillan & WifeKnots LandingThe Days and Nights of Molly DoddDallas, Matlock  and Sabrina, the Teenage Witch.

Wrote Mitch Tuchman in a 1982 profile for Film Comment: "Master of montage, wizard of the three-minute movie, Fitzgerald doesn't create title sequences so much as trailers; briskly edited filmettes that provide a dense, but uncluttered, précis of things to come. This is power-pop art."

The website Art of the Title describes Fitzgerald's work on the Rosalind Russell-starring Auntie Mame (1958) as "a vivid and joyful piece of title design."

"First, the Warner Bros. logo on pink glass like strawberry skin. The red velvet hands, the cigarette holder, and that little cylinder, all decked in jewels, coming together to introduce a vortex of color. The kaleidoscope envelops us in a swirl of vibrant, shifting shards of painted glass as a piece from Bronislau Kaper's elegant score plays and glittering sequins and gems gather to form several of the credits."

Said Fitzgerald in an interview on the site: "I was shown the movie, and it was decided that it really needed something colorful up in the beginning — a very colorful design but sort of abstract — because Mame was a colorful character. That’s the best we could do in this sort of abstract form — just make it very colorful."

The titles on Pillow Talk (1959) open with three panels, with Doris Day on one side, Rock Hudson on the other and the credits in the middle. The actors toss pillows back and forth that wipe the text on and off the screen.

Born in Los Angeles on March 19, 1930, Fitzgerald served in submarines during the Korean War. He graduated in 1951 from the Art Center College of Design in Pasadena, and his first show business job was at Pacific Title & Art, which did all the main titles for Warner Bros., MGM and Fox films and for some Paramount and Columbia movies as well. He eventually set up films including Silk Stockings (1957), Touch of Evil (1958), Imitation of Life (1959), The Music Man (1962) and My Fair Lady (1964).

Studio chief Jack Warner liked his titles large on the screen, which made Fitzgerald's subtle stills sequence for Bonnie and Clyde a hard sell. Beatty convinced him that he'd never be able to do his best work until he went out on his own, so he launched Wayne Fitzgerald FilmDesign Inc. in 1968.
That led to work on 9 to 5 (1980), National Lampoon's Vacation (1983), Footloose (1984), John Hughes' Sixteen Candles (1984) and The Breakfast Club (1985), Total Recall (1990), Basic Instinct (1992), Wyatt Earp (1994) and Kingpin (1996).

Fitzgerald won a Primetime Emmy in 1987 for the NBC drama The Bronx Zoo and Daytime Emmys in '88 and '92 for the soap operas The Bold and the Beautiful and The Guiding Light, respectively.
Every Fitzgerald deal was done with a handshake and he never had a written contract. He got "stiffed" for $5,000 just once, his wife said.

Survivors also include his children Mark, Eric and Courtney and grandsons Rae, Porter and Bodhi.
A member of the DGA, Fitzgerald never directed a word of dialogue but, as his wife put it, he "directed lions and tigers, no bears. Coyotes and horses, pillows, poodles and Bob's goldfish. Plus stars, magicians, dancers, wannabe dancers and stoned folk singers. From planes, trains and automobiles, helicopters and submarines. From the roof of Atlanta stadium to locked down inside Sing Sing prison."

How To Help The Poor Without Subsidizing The Rich

If you are a high net worth individual you probably already know about it. A seminar on the subject at Manhattan’s Harvard Club attracted financial advisors to some of Americas richest dynasties – including the Pritzker and Soros families.

A Las Vegas meeting on the subject was organized by former White House aide Anthony Scaramucci and attracted such attendees as Mark Cuban, the billionaire owner of the Dallas Mavericks, and former New Jersey governor Chris Christie. It has spurred the Swiss bank UBS to create a fund for its “ultra high net worth” clients – people who have at least $50 million in investable assets.

So, what’s all the excitement about? They are called OZs, or Opportunity Zones. They are the hottest investment opportunity around, and they were created by a mere 8 pages in the 185-page tax reform bill the Republicans passed in 2017.

In theory, the idea was to provide capital to revitalize the urban areas that President Trump has portrayed as “wastelands, ravaged by crime and homelessness and infested by rats.” In practice, it’s gentrification on a grand scale – as luxury high-rises for the rich replace run-down buildings and other structures.

For example, an OZ project in New Rochelle, N.Y., is financing an upscale apartment building that has a yoga studio, 24-hour valet parking and a spa for residents’ pets. One in New Orleans’ trendy Warehouse District is building a hotel with an opulent restaurant and a roof-top pool.

As explained in a New York Times investigative report (which is the source of most of what I am relating), here is how it works. Investors in an OZ can defer any capital gains taxes for up to 7 years. After 10 years, an investor can cash out and not owe any taxes at all. On paper, an opportunity zone is a census tract where poor people live. But there can be affluent areas within the tract and that’s where the investments can be targeted.

Bottom line: A tax break meant to benefit the poor has become a boon to hedge funds, real estate developers and wealthy investors.

Here is what the tax reform bill might have done instead. Almost 40 years ago, Stuart Butler, then at the Heritage Foundation, proposed Enterprise Zones – a concept first imagined in Margret Thatcher’s Britain. Butler’s idea was to take a depressed area, remove burdensome taxes and regulations and allow laissez-faire capitalism to flourish. Within no time at all, he expected the South Bronx, for example, to look like Hong Kong.

This idea was championed by Jack Kemp, HUD secretary during the George H.W. Bush presidency, and by New York congressman Charlie Rangel. It was partly implemented during the Clinton administration.

But by most measures, the experiment was a failure. The reason? No regulations were actually repealed. What we got instead was increased spending and a few tax breaks – making government a partner in every private decision that was made. We didn’t get less government. We got more government – on top of the government we already had!

That prompted a different approach by my colleagues and me  – one called enterprise programs.

Here is the idea: instead of carving out a geographical area for deregulation, let’s carve out essential services that are needed by low-income families. All too often, burdensome regulations are pricing poor people out of the market for the services they need the most. So why not remove those regulations?

Take transportation. Did you know that low-income families use taxi cabs more than any other income group? The reason: they are less likely to own a car. So, in cities where taxi regulations have done little more than create a transportation cartel, poor people are hurt the most.

Uber and Lyft have made a huge dent in this market – but they are mainly serving the high end of the market. It’s still illegal for me (without a license) to drive a van to a low-income neighborhood in South Dallas, pick up a group of would-be workers, transport them to a job site in North Dallas, and charge each of them a couple of bucks for the ride.

Then there is medical care. Studies show that nurses following computer protocols in MinuteClinics provide care that adheres to best practices as well or better than traditional primary care physicians. Yet in most states, access to this type of high-quality, low-cost care is limited by regulation. That’s why there are virtually no MinuteClinics in rural Texas.

Housing is another example. Local governments often block the use of inexpensive modular homes, limit the number of rental housing units, create minimum lot sizes, and impose cost-increasing amenities such as landscaping requirements. All too often, regulations designed to protect property values in affluent neighborhoods have the unintended consequence of reducing housing construction and availability in non-affluent areas.

Most home-based businesses are started by women and they are a principal way women entrepreneurs become self-supporting. But numerous local regulations stand in the way and day care regulations are among the most severe. Suppose you offered to take care of your neighbors’ children for a modest fee during the day, while their parents are at work. In most cities that would be illegal unless you obtain a license and meet all kinds of burdensome regulations.

The Brookings Institution estimates that almost 30 percent of all the jobs in the country require a government license. Whom does that type of regulation hurt the most? People with less education, lower incomes and fewer resources. It hurts them in two ways. On the supply side, occupational licensing is a barrier to a job. On the demand side, licensing raises the cost of goods and services people buy.

Our idea is to let the middle and upper-middle class keep all the regulations they want. For them, nothing would change.

But low-income families should have access to a free market.



Wise Judge Blocks California Law Targeting Trump

We’re all used to seeing California throw its weight around, but its new law requiring a presidential candidate to provide five years of tax returns to be eligible to appear on a primary ballot is a new low. Now, however, a federal district court judge has blocked the state from enforcing it, at least temporarily.

It’s the right decision. The law is nothing more than a political attack on President Donald Trump, the federal elections process, and the right of free association of citizens and all political parties.

California is weighing its options, but if it chooses to appeal, the 9th U.S. Circuit Court should affirm the district judge’s decision because the law violates the presidential Qualifications Clause and the First Amendment of the Constitution.

The Qualifications Clause in Article II, Section 1 sets out the sole requirements to be president of the United States. You must be a “natural born Citizen,” 35 years of age, and a resident “within” the U.S. for 14 years.

The key case on this is U.S. Term Limits, Inc. v. Thornton (1995). There was a movement across the country in the late 1980s and early 1990s to impose term limits on members of Congress. This political movement ended, however, when the U.S. Supreme Court held in Thornton that an Arkansas law limiting the number of terms that a member of Congress could serve was a violation of the separate Qualifications Clauses that apply to members of Congress.

The Arkansas law provided that once a representative or senator reached the maximum term, he could not have his name “placed on the ballot” — a ballot-access restriction akin to California’s new law.

Arkansas was adding an additional qualification to being a representative or a senator; the court, in a 5-4 opinion written by Justice John Paul Stevens, said that “States lack the power to impose qualifications.” Although the Thornton case dealt with congressional elections, the same constitutional consideration would apply to presidential elections and the presidential Qualifications Clause.

Arkansas also tried to argue that the term limit was not an additional qualification, but simply a ballot-access requirement. But the court disagreed. States can “adopt generally applicable and evenhanded restrictions that protect the integrity and reliability of the electoral process itself.” States have the right to implement rules that are intended to avoid “voter confusion, ballot overcrowding or the presence of frivolous candidacies.”

But what states cannot do is try to disguise additional qualifications as ballot-access requirements.

In another decision in 1983 — this time involving Ohio — the Supreme Court in Anderson v. Celebrezze (also a 5-4 decision written by Stevens) threw out a March filing deadline for a presidential candidate to appear on the November ballot. The deadline placed an unconstitutional burden on the voting and associational rights of supporters of a candidate in violation of the First Amendment.

According to the court, “state-imposed restrictions implicate a uniquely important national interest” since “the President and the Vice President of the United States are the only elected officials who represent all the voters in the Nation.” Thus, “in a Presidential election a State’s enforcement of more stringent ballot access requirements” have “an impact beyond its own borders.”

So states have far less power to regulate presidential elections “than statewide or local elections, because the outcome of the former will be largely determined by voters beyond the State’s boundaries.”

Similarly, in 2001, in Cook v. Gralike, the Supreme Court, this time in a unanimous opinion written by Stevens, said that the authority of states is limited to regulating election procedures. The acceptable regulations are those necessary to impose “some sort of order, rather than chaos” on the “democratic process” as well as to protect the integrity of elections.

The new California law says its purpose is to “provide voters with essential information regarding the candidate’s potential conflicts of interest, business dealings, financial status, and charitable donations” so they can “make a more informed decision.” Gov. Gavin Newsom said in his signing statement that states “have a legal and moral duty to do everything in their power to ensure leaders seeking higher office meet minimal standards, and to restore public confidence.”

The law’s stated purpose reveals that it has nothing to do with regulating the “reliability of the electoral process itself” and ensuring orderly voting procedures. Newsom’s statement about the law imposing “minimal standards” also shows the law isn’t about protecting the voting process — it’s about imposing California’s minimal qualifications on anyone who wants to be president.

California passed a similar bill two years ago. When then-Gov. Jerry Brown vetoed the bill, he not only acknowledged that it might “not be constitutional,” but he expressed his concern “about the political perils of individual states seeking to regulate presidential elections in this manner.” He called it a “slippery slope.” Tax returns now, but what else might states start to demand he said. Health records? High school report cards? Certified birth certificates?

All of that might depend, as Brown warned, “on which political party is in power” and it could “lead to an ever-escalating set of differing state requirements for presidential candidates.”

Neither California nor any other state has the right to impose additional requirements for presidential candidates, whether they categorize them as “qualifications” or as restrictive ballot-access requirements.

A military mind that most of the world does not understand

Our military men on dire occasions do remarkable things

It was 2003 on the march into Baghdad. Brian Chontosh was a platoon leader rolling up Highway 1 in a humvee.

When all hell broke loose.

Ambush city.

The young Marines were being cut to ribbons. Mortars, machine guns, rocket propelled grenades. And the kid out of Churchville was in charge. It was do or die and it was up to him.

So he moved to the side of his column, looking for a way to lead his men to safety. As he tried to poke a hole through the Iraqi line his humvee came under direct enemy machine gun fire.

It was fish in a barrel and the Marines were the fish.

And Brian Chontosh gave the order to attack. He told his driver to floor the humvee directly at the machine gun emplacement that was firing at them. And he had the guy on top with the .50 cal unload on them.

Within moments there were Iraqis slumped across the machine gun and Chontosh was still advancing, ordering his driver now to take the humvee directly into the Iraqi trench that was attacking his Marines. Over into the battlement the humvee went and out the door Brian Chontosh bailed, carrying an M16 and a Beretta and 228 years of Marine Corps pride.

And he ran down the trench.

With its mortars and riflemen, machineguns and grenadiers.

And he killed them all.

He fought with the M16 until it was out of ammo. Then he fought with the Beretta until it was out of ammo. Then he picked up a dead man’s AK47 and fought with that until it was out of ammo. Then he picked up another dead man’s AK47 and fought with that until it was out of ammo.

At one point he even fired a discarded Iraqi RPG into an enemy cluster, sending attackers flying with its grenade explosion.

When he was done Brian Chontosh had cleared 200 yards of entrenched Iraqis from his platoon’s flank. He had killed more than 20 and wounded at least as many more.

But that’s probably not how he would tell it.

He would probably merely say that his Marines were in trouble, and he got them out of trouble. Hoo-ah, and drive on.

“By his outstanding display of decisive leadership, unlimited courage in the face of heavy enemy fire, and utmost devotion to duty, 1st Lt. Chontosh reflected great credit upon himself and upheld the highest traditions of the Marine Corps and the United States Naval Service.”

That’s what the Navy Cross citation says.

And that’s what nobody will hear.

That’s what doesn’t seem to be making the evening news. Accounts of American valor are dismissed by the press as propaganda, yet accounts of American difficulties are heralded as objectivity. It makes you wonder if the role of the media is to inform, or to depress – to report or to deride. To tell the truth, or to feed us lies.

But I guess it doesn’t matter.

We’re going to turn out all right.

As long as men like Brian Chontosh wear our uniform.

Lance Corporals Byron Law and David Salazar-Quintero were specifically charged with transporting illegal immigrants into the country for financial gain. The two were based in Camp Pendleton, located between San Diego and Los Angeles, Calif. The other marines included in the indictments, some of whom were charged with distributing cocaine and LSD, were not named." (National Review)

PRESS BRIEFINGS INDEFINITELY SHELVED: "White House Press Sec. Stephanie Grisham said Monday that she has no plans on bringing back the daily White House press briefings, saying reporters used them to make themselves famous. 'Ultimately, if the president decides that it's something we should do, we can do that. But right now, he's doing just fine. And to be honest, the briefings had become a lot of theater, and I think that a lot of reporters were doing it to get famous,' Grisham said on Fox & Friends. ... Louisiana men suspected of killing witness in Dallas cop's murder trial

DALLAS - Police say a drug deal involving three men from Louisiana is what ultimately led to the death of a witness in the high-profile trial of a Dallas police officer.

WFAA reports the three men from the Alexandria area, identified as Michael Mitchell, 32, Thaddeous Charles Green, 22, and 20-year-old Jacquerious Mitchell, are suspected in the murder of Joshua Brown.

Jacquerious Mitchell is said to be in police custody at a hospital. Michael Mitchell and Green are still wanted.

Investigators say the trio traveled to Texas to buy marijuana from Brown, who had recently testified in the trial of former Dallas police officer Amber Guyger. Brown had lived in the same apartment building as Guyger, where she fatally shot Botham Jean.

Guyger was convicted Oct. 1 and sentenced the next day to 10 years in prison. Guyger said she mistook Jean's apartment for her own and thought he was an intruder when she fatally shot him in September 2018.

Game 5 will be Wednesday back in Atlanta. The Cardinals will have ace Jack Flaherty on the mound, and the Braves will go with Mike Foltynewicz.

Kolten Wong led off the St. Louis 10th with a ground-rule double against Julio Teheran. After Paul Goldschmidt was intentionally walked, Wong advanced on Marcell Ozuna's forceout and easily scampered home on Molina's fly to the front of the warning track in left field.

Wong threw his hands in the air as he ran toward the plate. Molina rounded first base with his bat in hand, then flung it away as the celebration erupted. The 37-year-old catcher discarded his batting helmet as the rest of the Cardinals poured onto the field.

Molina made it 4-all with a two-out single in the eighth that went just off the top of the glove of a leaping Freddie Freeman at first.

Ozzie Albies homered and drove in three runs for Atlanta, and Ronald Acuña Jr. had four hits. But the NL East champions went 0 for 9 with runners in scoring position, a continuing problem in the postseason over the past two years.

The Braves left the bases loaded in the sixth and seventh. Acuña was stranded on third when Josh Donaldson flied out in the ninth.

"We're a hit away from — just some productive outs — from continuing to add on," manager Brian Snitker said.

Ozuna homered twice for St. Louis, and Goldschmidt also connected. But the NL Central champions were four outs from a second straight difficult loss before Molina delivered down the stretch.

Albies gave Atlanta a 4-3 lead with a two-run homer off Dakota Hudson in the fifth, capping a three-run rally.

The Braves carried the advantage all the way into the eighth, but Goldschmidt doubled and Molina came up with the tying hit off Shane Greene.

Carlos Martínez gave St. Louis a lift after Acuña led off the ninth with a double, retiring three in a row. The closer took the loss Sunday when he gave up three runs in the ninth in Atlanta's 3-1 victory.

Game 1 starter Miles Mikolas worked the 10th for the win.

Dansby Swanson had two hits and scored twice for Atlanta, which has dropped its last nine postseason rounds — just one off the major league record held by the Chicago Cubs. It is trying to advance to the franchise's first NL Championship Series since 2001.

St. Louis got off to a fast start, delighting the crowd of 42,203 on a picturesque October afternoon. Goldschmidt drove a 3-1 changeup from Dallas Keuchel deep to left with two out in the first, and Ozuna followed with a laser into the second deck in left for a 2-0 lead.

It was the first set of consecutive playoff homers for the Cardinals since Wong and Randal Grichuk accomplished the feat in Game 2 of the 2015 NLDS against the Chicago Cubs.

The Braves got one back on Albies' sacrifice fly in the third, but Ozuna led off the fourth with another drive to left for the first multihomer playoff game for a Cardinals player since Carlos Beltran in Game 2 of the 2012 NLDS against Washington.

Ozuna is batting .471 (8 for 17) with four RBIs in his first career postseason series.

Pitching on three days of rest, Keuchel allowed three runs and four hits in 3 1/3 innings in his 11th career postseason start.


Packers Rule at Home of Cowboys Again in 34-24 Win

Aaron Rodgers looked quite comfortable at the home of the Dallas Cowboys — again.

Green Bay's star quarterback kept his team moving to a big early lead with more dazzling plays at AT&T Stadium, Aaron Jones scored a career-high four touchdowns and the Packers bounced back from their first loss by hanging on for a 34-24 victory over the Cowboys on Sunday.

Rodgers zipped a sidearm throw to Robert Tonyan to fix one broken play, flipped a left-hander to Tra Carson to rescue another, and helped Green Bay improve to 5-0 inside the retractable-roof stadium where the two-time MVP's first win was the 2011 Super Bowl.

The first three Green Bay wins over the Cowboys at their 10-year-old stadium were all dramatic, highlighted by Rodgers' improbable 35-yard completion to Jared Cook to set up a winning field goal on the final play of a 34-31 divisional-round playoff win three years ago.

Not quite the same drama this time after the Packers (4-1) built a 31-3 lead, although Dak Prescott (463 yards passing) and Amari Cooper (226 yards receiving) set career highs trying to keep things interesting in the fourth quarter.

The last hope for Dallas ended with 1:41 left when Brett Maher missed his second field goal — a 33-yarder that would have given the Cowboys a shot at an onside kick down seven.

Missing his biggest threat in Davante Adams because of a toe injury, Rodgers threw for 238 yards without an interception — to the delight of a large contingent of Green Bay fans that pulled off several "Go Pack Go" chants without much resistance from the home crowd.

Prescott, on the other hand, matched a career high with three interceptions, although the first was a drop by Cooper on what should have been a big play early.

The Cowboys (3-2) lost their second straight game after winning their first three, just as the Packers had done. Green Bay took sole possession of first in the NFC North, while Dallas dropped into a tie for the NFC East lead with Philadelphia.

Jones had a career-high 182 scrimmage yards — 107 rushing and 75 receiving — and opened the scoring with an 18-yard run after being held to 19 and 21 yards rushing the previous two weeks.

On a punctuating touchdown for a 24-0 lead early in the second half, Jones waved "bye-bye" to cornerback Byron Jones while beating him to the pylon on a 5-yard run. The fourth TD was a 1-yard plunge.

Cooper had a 53-yard touchdown among his 11 catches and Michael Gallup had 113 yards receiving with a 40-yard score. Prescott, who had never lost when throwing for more than 275 yards, was 27 of 44.


Cowboys coach Jason Garrett was penalized for unsportsmanlike conduct when he slammed the challenge flag in front of side judge Scott Edwards after Edwards ruled Cooper out of bounds when the receiver got both feet in on a catch. The call was reversed on replay, but the Cowboys started first-and-25 because of the penalty. Elliott, who had 62 yards rushing, caught a 26-yard pass on the next play.


Green Bay center Corey Linsley didn't return after leaving in the first half to be evaluated for a concussion. Packers safety Darnell Savage left with an ankle injury and didn't return. Cowboys right tackle La'el Collins, who played after being listed as questionable with a back issue, was taken out with an ankle injury in the second half.


Packers: Detroit at home next Monday.

Cowboys: at the New York Jets next Sunday.


Duvall, Braves Rally in 9th to Beat Cards 3-1

Dansby Swanson hit a tying double with two outs in the ninth inning and Adam Duvall delivered a two-run single as the Atlanta Braves rallied past the St. Louis Cardinals 3-1 on Sunday to take a 2-1 lead in the NL Division Series.

Atlanta had managed just four hits off Adam Wainwright and Andrew Miller before breaking through against closer Carlos Martínez. With two outs and runners on the corners, Swanson tied it at 1 with a drive off the wall in left.

Swanson pumped his arms as he celebrated on second base after his third hit of the game. He came through after an intentional walk to Brian McCann — Swanson's .187 batting average with runners in scoring position was the lowest in the majors this year among qualified players.

Duvall, who entered as a pinch-hitter in the eighth, then hit a liner into center field to put the Braves ahead to stay. It was his second big hit of the series after he connected for a pinch-hit homer in Atlanta's 3-0 victory Friday.

Game 4 is Monday at Busch Stadium. Atlanta needs one more win to advance to the NL Championship Series for the first time since 2001.

This is the first time the Braves have led a postseason series since they were up 2-1 on San Francisco in the 2002 NLDS. They lost the final two games that year.

St. Louis wasted a terrific performance by Wainwright, who pitched 7 2/3 innings of four-hit ball in his first postseason start since 2014. The 38-year-old Georgia native and former Braves draft pick struck out eight and walked two in his first postseason start since 2014.

In the age of bullpens taking over in October, Wainwright and Mike Soroka locked up in an old-fashioned pitchers' duel. But the relievers ultimately decided the game.

Wainwright departed after he walked Ozzie Albies on his 120th pitch, loading the bases in the first playoff game in St. Louis in four years. He got a big hug on the mound from catcher Yadier Molina and the sellout crowd of 46,701 saluted Wainwright with a standing ovation as he walked to the dugout.

Miller then came in and retired Freddie Freeman on a flyball to center, ending the inning and preserving a 1-0 lead.

But Martinez was hit hard for the second time in the series. He allowed three runs before he closed out St. Louis' 7-6 victory in Game 1.

After Atlanta grabbed the lead, Mark Melancon worked the ninth for his second save of the playoffs. Paul Goldschmidt doubled with one out, but Marcell Ozuna struck out looking and Molina lined out to end the game.

The 22-year-old Soroka was almost as good as Wainwright, pitching seven innings of two-hit ball in his postseason debut.

St. Louis jumped in front when Ozuna doubled in the second, advanced to third on Molina's grounder and scored on Matt Carpenter's sacrifice fly.

After Soroka departed, the Cardinals threatened in the eighth. But pinch-runner Harrison Bader was caught trying to steal third ahead of José Martínez's pinch-hit single, and Sean Newcomb retired Dexter Fowler to end the inning.


Hall of Fame shortstop Ozzie Smith threw a ceremonial first pitch to current Cardinals shortstop Paul DeJong. Hall of Fame manager Whitey Herzog also was on the field before the game after he had a minor stroke last month.


Dakota Hudson will start Game 4 for the Cardinals. The rookie right-hander is making his postseason debut after going 16-7 with a 3.35 ERA this season.

Atlanta manager Brian Snitker was waiting to see what happened Sunday before finalizing his starter for Game 4. One possible option is bringing back Dallas Keuchel on short rest after he pitched 4 2/3 innings in series opener Thursday.

Joshua Brown, Key Witness Against Police Officer Amber Guyger In Botham Jean Murder Trial, Found Shot To Death

Joshua Brown, the next-door neighbor of Dallas man Botham Jean — who testified against police officer Amber Guyger in her murder trial — has been shot and killed in Dallas.

The Dallas Morning News reported that Brown was killed on Friday evening at an apartment complex. Details about the incident appeared to be scarce, but police said that the victim was found with multiple gunshot wounds. He was taken to a nearby hospital, where he died from his injuries.

“Witnesses told police they heard several gunshots and saw a silver four-door sedan speeding out of the parking lot,” the report noted.

Brown was found on the ground in the parking lot after having been shot, Dallas police said.

Tammy Kemp, Judge Who Sentenced Amber Guyger, Gets Backlash For Hugging Her, Giving Her A Bible

Tammy Kemp, the judge who presided over the trial of Dallas police officer Amber Guyger, is getting criticized for her behavior in the courtroom that included hugging the defendant and giving her a Bible.

The Crime

This week, as reported at the time by The Inquisitr, Guyger was convicted of murder and sentenced to ten years in prison for the murder of Botham Jean.

On September 6, 2018, Guyger, an off-duty Dallas Police Department patrol officer, entered the Dallas, Texas, apartment of Botham Jean and shot and killed him. Guyger would later say that the thought she was entering her own apartment and, on seeing Jean, believed he was an intruder.

Dont'a Hightower nicknames Patriots defense "The Boogeymen"

The New England Patriots' defense is terrifyingly good.

Through five games this season, Bill Belichick's brick wall ranks No. 2 against the run and the pass and averages 6.8 points allowed per game. If you told me two years ago that a unit that features a lot of the same players that couldn't get off the field in Super Bowl LII would do the kinds of things they're doing right now, I'd probably pass out from laughing so hard. 

So what's missing? 

A nickname! 

And in the spirit of Halloween, Dont'a Hightower came up with the perfect nickname for the defense: The Boogeymen. 

“We’re the boogeyman, man,” Hightower said Sunday about the Patriots’ linebacker corps. “We’re the boogeymen.”

“We want to go out there, and we want to be the engine and the starting force of the defense,” Hightower said. “We know that if we go out there and we play well, then that will hype every other spot whether that’s in the front seven or the back seven. Not even if it’s a linebacker, whether it’s Dev (Devin McCourty) with a pick or JMac (Jason McCourty) with a pick or Du (Duron Harmon) with a pick. We feed off of each other.

“We compete. It’s a great group not just in the linebacker room but the defense, we all want to compete. … We’re trying to get more picks, more forced fumbles. It’s a great defense.”

Make fun of New England's schedule all you want, but the defense's performance through these first five games is not an accident. It will be interesting to see how they fare against teams with better offenses like Dallas, Philadelphia, Kansas City, etc.

What Films to See at Orcas Island Film Festival This Weekend

The Orcas Island Film Festival (OIFF) has put together another fantastic lineup of films. Now in its sixth year, the organizers of the Eastsound fest have curated 39 feature films (five more than last year) that consist of internationally lauded titles and encompass more than 60 screenings overall. Big Little Lies and Dallas Buyers Club director Jean-Marc Vallée will make his fifth appearance at the fest, previewing a work-in-progress documentary about music.

OIFF is expanding onto three screens this year, giving viewers more time and space to see the movies they want. This roundup absolutely leaves out some incredible films you may have heard of (Parasite, Portrait of a Lady on Fire, The Farewell) and some you may not have heard of (Leona, The Edge of the Knife, The Report), but here are my top five picks for the fest:

Pain and Glory
Spain, 113 min, Dir. Pedro Almodóvar

God, I'm a total slut for Pedro Almodóvar. Watching his films is like taking a big bite out of pure pathos. Here, Almodóvar is turning inward, directing a film about an aging director Salvador Mallo (Antonio Banderas), not unlike Almodóvar himself, and his reckoning with his failing health, career choices, and childhood. Pain and Glory is Spain's Oscar entry, so perhaps we'll see more press about this in the English-language media in the next couple of months. Banderas is at his best with Almodovar (Tie Me Up! Tie Me Down!, Women on the Verge of a Nervous Breakdown, The Skin I Live In) and his muse Penelope Cruz makes an appearance as well—it's not to be missed!

France | Senegal | Belgium, 104 min, Dir. Mati Diop

Atlantics is the film I'm most excited to see at OIFF. The buzz around it has been strong, and just from the above clip alone (the waves, the sound of the waves, the atmosphere, the closeness and intimacy of the couple onscreen), I'm entranced. This Senegal-set supernatural romance follows the love story of Ada and Souleiman, a pair of young lovers who live on the fringes of Dakar. After Souleiman, a construction worker, leaves in a boat to find better work opportunities in Europe, Ada is to get married to another man. When a fire breaks out at her wedding and a fever spreads across the town, there's a rumor that Souleiman has returned. This is the debut film from director Mati Diop. She was the first black female director to have a film in Competition at Cannes, when Atlantics won this year's Grand Prix.

France, 77 min, Dir. Quentin Dupiex

Deerskin's premise is very strange—Georges (the wonderful Jean Dujardin) becomes so deeply obsessed with his vintage deerskin jacket that he decides it should be the only one in the world. He's determined to kill off anyone who stands in his path. It's a comedy, clearly. Helmed by Quentin Dupiex (anyone see that movie about the killer tire?), co-starring Adèle Haenel (of Portrait of a Woman on Fire fame), and a lean 77 min runtime, I'm predicting this one will be a cult favorite.

USA, 135 min, Dir. Trey Edward Schultz

What I know about Waves is that it's produced by A24 (the altar at which stylish indie directors worship) and everyone who's seen it is wrecked by it. The third feature film by director Trey Edward Shults, Waves is a family drama that traces a young, successful athlete's world that is cracking after he's pushed to his limits. Also, the score is composed by Trent Reznor and Atticus Ross, who scored The Social Network, The Girl with the Dragon Tattoo, and Gone Girl.

And Then We Danced
Sweden | Georgia | France, 105 min, Dir. Levan Akin

And Then We Danced is a queer romance set in Georgia, a country that the English-speaking world often doesn't have a chance to glimpse into. Merab (Levan Gelbakhiani) juggles a shitty job and a crazy home life in order to train as a dancer at the Georgian National Ensemble. Masculinity rules over everything, and the talented Merab struggles to balance the demands of his coach with his own self-expression. Tensions escalate when the charming and aloof Irakli (Bachi Valishvili) joins the ensemble. While controversial in Georgia, the film is incredibly tender and features a very seductive use of a Robyn song. This is also Sweden's entry into the Best International Film category at the Oscars, so it could potentially blow up in the States. The director, Levan Akin, will be present at OIFF to receive the festival's Vanguard Award for this film.

Police: 3 suspected of killing witness at Dallas cop's trial


DALLAS (AP) — Three Louisiana men are suspected in the killing of a witness who testified at the murder trial of a former Dallas police officer, authorities said Tuesday, cautioning that the killing had nothing at all to do with that trial or case.

The suspects — Jacquerious Mitchell, 20; Michael Mitchell, 32; and Thaddeous Green, 22 — are from Alexandria, Louisiana, and investigators believe they were in Dallas to buy drugs from Joshua Brown , Assistant Chief Avery Moore said at a news conference.

Moore said Jacquerious Mitchell told police that Brown shot him in the chest after Green and Brown began fighting during the drug deal, and that Green then shot Brown twice.

Jacquerious Mitchell is in a Dallas hospital in "critical condition," police said. Neither Michael Mitchell, who is Jacquerious' uncle, nor Thaddeous Green are in custody.

Green left with Brown's backpack and gun, police said. Authorities confiscated 12 pounds (5.4 kilograms) of marijuana, 149 grams of THC cartridges and more than $4,000 in cash during a search of Brown's home.

It is unclear how the three men came into contact with Brown or why they would have driven more than 300 miles (483 kilometers) from central Louisiana to purchase marijuana in Texas.

The police announcement comes after rampant speculation regarding Brown's death, which happened two days after a jury sentenced the white former police officer to 10 years in prison for killing her black upstairs neighbor in a case that sparked fierce debate over race, politics and policing.

Greyhound apologizes to Texas man who was kicked off bus


FORT WORTH, Texas (AP) — Greyhound Lines has apologized to a Texas man who sued the company after a driver forced him off a bus at a station in Kansas at the dead of night, accusing him of being unruly and uncooperative.

Mohammad Reza Sardari was traveling from Dallas to Kansas City, Missouri, in November 2017 when he was kicked off a Greyhound bus at a bus station in Wichita, Kansas. Sardari, a Ph.D. candidate at University of Texas-Arlington, was heading to a national conference in Kansas City to present his research on inequality in the Dallas Area Rapid Transit System.

Last November, Sardari filed a federal lawsuit in Dallas against Greyhound, saying the company discriminated against him because he's Middle Eastern after the bus driver saw his name on the ticket. Sardari, who is Iranian, said he was "abandoned in the middle of the night at a dark and closed bus station."

At the time, Greyhound said it had investigated the incident and found that Sardari was removed because he refused to show his ticket when he was asked. The company said it called the police to remove Sardari after he refused to leave the bus, the Fort Worth Star-Telegram reported.

In a statement last month, Greyhound retracted its previous claims that Sardari had been unruly.

"Greyhound also fully retracts its statement that police were called to remove Dr. Sardari from the bus he was riding," Greyhound said in a statement on Sept. 17. "Greyhound sincerely apologies to Dr. Sardari regarding the events that occurred."

The company maintains that it didn't discriminate against Sardari.

Sardari's lawsuit says the bus driver and passengers started yelling at him to get off the bus, which Sardari recorded on video.

DALLAS (AP) — The Latest on the death of a man who testified at the murder trial of Dallas police officer Amber Guyger (all times local):

An attorney for the family of a man who was shot to death days after testifying at the murder trial of a former Dallas police officer is calling for an outside investigation into his killing.

Attorney Lee Merritt, who represents the family of Joshua Brown, says "a cloud of suspicion" sits over the death of Brown, who was fatally shot on Friday, two days after jurors sentenced former officer Amber Guyger to 10 years in prison for killing her neighbor.

Police said Tuesday that three Louisiana men are suspected of killing Brown during a drug deal, and that his death had nothing to do with the Guyger case.

But Merritt said afterward that an agency other the Dallas Police Department should investigate Brown's death so the findings will be viewed as "authentic and reliable."

Assistant Chief Avery Moore said at a news conference Tuesday that the three men from Alexandria, Louisiana, will face capital murder charges in last Friday's killing of Joshua Brown.

Moore says the three were in Dallas to buy drugs from Brown, who was fatally shot at a Dallas apartment complex. He says the killing was not tied in any way to Brown testifying at the murder trial of former officer Amber Guyger, who was sentenced last Wednesday to 10 years in prison for killing her neighbor, Botham Jean.

Brown lived on the same floor as Jean and testified about what he heard the night Guyger killed him.


No indictment of bartender who served man before attack


MCKINNEY, Texas (AP) — A grand jury has declined to indict a bartender who served drinks to a man who later went to his estranged wife's suburban Dallas home and fatally shot her and seven others.

The decision of the Collin County grand jury came late last month in the case against Lindsey Glass, 27. She had been arrested in May and charged with a misdemeanor violation of "sale to certain persons." The law prohibits the sale of alcohol to a "habitual drunkard or an intoxicated or insane person."

Authorities said Spencer Hight, 32, already showed signs of intoxication in September 2017 at the Plano bar before leaving for the home of Meredith Hight and opening fire. Responding officers then shot and killed the man. At the time of his death, his blood-alcohol level registered 0.33 percent, more than quadruple the legal limit for driving.

In a statement, attorneys for Glass say the woman is relieved by the decision. They note that security video from the bar indicates Glass was not watching Hight continuously and that some of his odd behavior occurred outside her view. The statement issued by attorneys Scott Palmer and Rebekah Perlstein said that once Glass recognized Hight was intoxicated and behaving strangely, she alerted the manager and the two confronted Hight outside the bar. Glass then followed him and notified police when he reached his estranged wife's home.

The bar has since closed after surrendering its license to serve alcohol.
