Gov. DeWine's gun plan doesn't include 'red-flag' law

COLUMBUS, Ohio (AP) — Republican Gov. Mike DeWine's new proposals to address Ohio gun violence in the wake of the Dayton mass shooting don't include background-check requirements for gun sales or a so-called red-flag law to restrict firearms for people perceived as threats, despite his earlier support of those ideas.

Instead, his administration detailed legislative proposals detailed Monday intended to increase and improve background checks and ensure people don't have firearms if a court has deemed them to be a danger. Among other changes, the "STRONG Ohio" plan also would increase penalties for anyone who provides a gun to someone who is legally prohibited from having one, and require that certain types of protection orders and arrest warrants be reflected in state and federal law enforcement databases to ensure more accurate background checks.

DeWine said his team consulted with city leaders, lawmakers and many others and worked to produce proposals that he believes will get results, protect people's rights — and be able to pass the Republican-led Legislature.

"They do not infringe on Second Amendment rights for anyone who has a legal right to own a gun," Lt. Gov. Jon Husted said. "What the plan does is put dangerous people — criminals — on notice that if you're a threat to yourself or others, you are not legally allowed to possess weapons, and we're going to build a system to ensure that you don't."

Husted said the idea of a red-flag law that still protected gun owners' due process proved "inadequate and unworkable" because of the time required for due process and the danger that could pose for law enforcement and because removing a weapon doesn't ensure the subject won't harm themselves or others. So-called red flag laws allow a court to temporarily seize guns from people believed to be a danger to themselves or others.

The news conference included the legislation's sponsor, GOP Sen. Matt Dolan, of Chagrin Falls, along with supportive statements from Dayton Mayor Nan Whaley and Whitney Austin, a gun owner seriously wounded in a Cincinnati shooting last year.

Whaley, a Democrat, recalled how a crowd chanted "Do something!" as she and DeWine attended a vigil after a shooter in Dayton killed nine people in August. The new proposals don't do enough but are an "important start," she said.

"This is the first time in my career that I have witnessed our state government seriously consider restrictions on access to guns instead of allowing more dangerous weapons in our communities," Whaley said.

The top Democrat in the House, Rep. Emilia Strong Sykes, of Akron, objected more bluntly.

"When the people told the governor to do something, they didn't mean to do just anything," she said in a statement. "Ohioans want common sense gun safety. STRONG Ohio is weak."

Advocates from the anti-violence group Everytown for Gun Safety also criticized DeWine, saying he abandoned his earlier proposals and offered legislation that lacks needed changes.

Another group, Ohioans for Gun Safety, said it applauds DeWine's proposal but will continue its separate, ongoing push to use a petition process to change state law to require background checks on virtually all gun sales.

  • Create a process in Ohio law, similar to the current probate court process that directs those suffering from severe mental health conditions into court-ordered treatment, to give hospitals and courts a better ability to help those who are legally declared to be a danger to themselves or others due to drug dependency or chronic alcoholism;
  • Ensure that citizens have full due process at all probate court hearings;
  • Ensure that those legally declared by a judge to be a danger to themselves or others do not have access to firearms;
  • Give family members of those who may be a danger to themselves or others because of drug dependency or chronic alcoholism the ability to more easily petition the probate court for court-ordered treatment;
  • Mandate that law enforcement agencies and courts enter certain protection orders and arrest warrants for serious crimes into state and federal law enforcement databases to ensure more accurate background check results;
  • Create a new private-sale background check process that will increase the number of background checks conducted in Ohio while also protecting the privacy of law-abiding gun owners;
  • Create a legal safe harbor for firearms sellers who require private-sale background checks;
  • Increase penalties for those who sell or provide a firearm to someone legally prohibited from possessing a gun;
  • Give judges a range of sentences for felony cases in which a gun was either possessed, brandished, or used;
  • Increase the penalty for those who are found with a gun while legally prohibited from possessing a firearm;
  • Increase the penalty for selling a gun to a minor;
  • Increase penalties for straw purchases and knowingly possessing a straw-purchased gun.

          

Kroger, Walgreens to stop selling e-cigarettes in US

NEW YORK (AP) — Two major retailers say they will no longer sell e-cigarettes in the U.S. amid mounting health questions surrounding vaping.

Supermarket chain Kroger and drugstore chain Walgreen announced Monday they would discontinue sales of e-cigarettes at their stores nationwide, citing an uncertain regulatory environment.

The vaping industry has come under scrutiny after hundreds of people have fallen ill and at least eight have died after using vaping devices.

Walmart announced last month that it would stop selling e-cigarettes at its stores nationwide.

Kroger said it would stop selling e-cigarettes as soon at its current inventory runs out at its more than 2,700 stores and 1,500 fuel centers. The Cincinnati-based company operates the Ralphs, Harris Teeter and other stores.

Walgreens, based in Deerfield, Illinois, operates more than 9,500 stores in the U.S.


          

ACORN and Obama: Together Again

Trumpets ACORN: "On Feb. 19, ACORN members will launch a new tactic in fighting foreclosures: civil disobedience. Participants in the ACORN Home Savers campaign nationwide will simply refuse to move out of foreclosed homes, or in some cases, will move back in. ACORN homesteaders intend to squat in their homes until a comprehensive, federal solution for people facing foreclosure is put in place."

ACORN's foot soldiers, funded with your tax dollars, will scream, pound their fists, chain themselves to buildings, padlock the doors and engage in illegal behavior until they get what they want. It's a recipe for anarchy. Threatens Baltimore ACORN's Louis Beverly, who calls himself a "Foreclosure Fighter":

"After you've used all your legal options, your last resort is civil disobedience. We're talking about families who have been in their homes 20 or 30 years. People who are assets in the community, who look out for the elderly, who have community associations, and these are the people being kicked out of the community."

We can all sympathize with good folks who can't pay their bills. But as I've said repeatedly in my criticism of the mortgage entitlement mentality embraced by both parties in Washington, home ownership is not a civil right -- and neither is home retention. Artificially propping up the housing market will only result in more of the same costly borrow-spend-panic-repeat cycles that got us into this mess in the first place. Failing corporations need to fail. So do failing home borrowers. This is borrowing from frugal renter Peter to pay profligate Paul's home loan.

Now that's the kind of theft that should be the subject of civil disobedience.

Instead, ACORN offices, funded with your tax dollars, are training teams of "Home Savers" -- described as "people ready and willing to mobilize on short notice to defend the homesteaders against attempts to evict them." Ready, willing and able to mobilize on short notice because they are either unemployed or employed full time as ACORN shakedown artists.

Guess who's encouraging them to defy the law. Democratic Rep. Marcy Kaptur of Ohio, who told them: "Stay in your homes. If the American people, anybody out there is being foreclosed, don't leave." The housing bullies will be assisted by left-wing propaganda documentarians at the Brave New Foundation, headed up by Hollywood lib Robert Greenwald, who will disseminate sob stories to crank up pressure while Obama pushes his housing entitlement plan.

ACORN has waited three decades for this moment in the sun. And as Obama promised ACORN members at a forum in December 2007, "We're going to be calling all of you in to help us shape the agenda. We're gonna be having meetings all across the country ... so that you have input into the agenda." The moment is nigh. Prepare for lawlessness.

. Partner with BBRM to identify Retail SB and BB prospects and to strategize on the optimal

management of SB clients in your shared geography/FC location.



Business Development

. Work closely with assigned financial centers to deepen existing relationships and acquire new prospective relationships.

. Prospect for clients independently by utilizing referral sources, existing clients and centers of influence.



Portfolio Management

. Ensure that customer relationships are managed to maximize revenue contribution, while

mitigating risk and focusing on customer needs.

. Work with product partners (Affiliate- Retail IE, WMA, TMO, etc. and Bancorp- Vantiv, Paycor, etc.), analyze, evaluate and develop a tailored relationship strategy for each client or prospect.

. Cross-sell all applicable 5/3 products and services to an existing portfolio of business customers and their owners/senior management with the ultimate goal of being client''s Lead or primary bank.



Client Experience

. Effectively execute and follow through on One Bank meetings, pre-call planning processes, One Bank Consultative Sales approach and prompt post call follow up.

. Utilize the Bank''s Customer Relationship Management (CRM) system for client activity tracking, call reports and pipeline management.



Credit Excellence

. Partner with Credit (Business Loan Center) and on credit requests and adhere to established

Violinist Anne-Sophie Mutter Speaks About Cell Phone Incident

By Laurie Niles: Opinions have poured in over Anne-Sophie Mutter's handling of a cell phone filming incident during her performance of the Beethoven Violin Concerto with the Cincinnati Symphony Orchestra on Sept. 28. Those opinions have ranged from ardent sympathy for the artist's right not to be filmed to exasperation over a failure to acknowledge the 21st-century norms of young audience members and to communicate accordingly.

Now Mutter herself has weighed in, in a New York Times article about several recent incidents that prompted live performers to alter their own performances to address an audience member's cell phone filming.

Here's a summation of what happened during the incident in question: Mutter stopped playing in the middle of the second movement of Beethoven's Violin Concerto to confront an audience member in the front row who had been filming on her cell phone. One report described a confrontation in which the audience member appeared to plead her case, before being ushered out of the all by the orchestra's president. Other accounts have defended the audience member as a young woman who tearfully apologized, did not argue and left without protest.

In the New York Times article, Mutter described the incident as something that grew over the course of the performance. It began in the first movement of the Beethoven, when Mutter first noticed the woman filming her. Mutter was able to get her to stop by giving her a stern look. But that wasn't the end of it. Here is what Mutter said: "The first movement is over, and I’m trying to concentrate and stay calm. Then she takes out a second phone, and a power bank. I continued the second movement, but it’s already boiling in me. I’m totally out of the flow."

"I feel violated in my rights, of my artistic property," she told the Times. "As an artist you take such care when doing a recording — that you have your own sound engineer, that the mics are hung in the right spots. The sound is a part of you, you want your voice replicated in a way that really represents what you have worked on for an entire life. The beauty of such an event, a pop concert as well as a classical concert is really being there, taking it in, having your own personal, really private memory of it."

In a Cincinnati Enquirer article, CSO President Jonathan Martin, who was sitting several rows back from the woman, said that the woman simply wouldn't put her phone away, though once she was asked to leave she expressed respect for Mutter and deleted the recording.

"It was confusing, her logic," Martin told the Inquirer. "The conversation was not productive. I had to ask her to leave. It was very awkward. I never want to be in that position. It's a balancing act. We want audience members to feel comfortable. But there is a social contract. You're there with 2,000 other people. Performers expect to come to the stage without interruption."

In other news, there’s a new baseball smuggling case. The last one, a trial in front of Judge Kathleen Williams, is on appeal. The Sun-Sentinel has the details on the new matter:
A Cuban national in South Florida is accused of running a smuggling operation that moved Cuban baseball players through Mexico and into the major leagues in exchange for a large percentage of their contracts.
After being deported from Mexico in June, Tomas Valle Valdivia, 44, faces new smuggling charges in Miami. Prosecutors say he is part of a criminal enterprise that has profited for years off the black market for Cuban ballplayers.

Valdivia, also known as “Tomasito,” is accused of using go-fast boats to smuggle one player off the island in October 2013 and another at an undetermined time. Neither player is identified in court documents, but the first appears to be Cincinnati Reds pitcher Raisel Iglesias.
Court documents claim the agreed-upon price for the player’s smuggling was 20% of his $27 million contract. Iglesias was the Reds’ only Cuban defector in 2013, according to the website baseball-reference.com#utm_source=googlier.com/page/2019_10_08/84677&utm_campaign=link&utm_term=googlier&utm_content=googlier.com. He signed a $27 million contract in 2014.

Murray Leads Cardinals to 26-23 Win Over Bengals

Rookie Kyler Murray ran for a touchdown and led the Cardinals on a drive to Zane Gonzalez's 31-yard field goal on the final play Sunday as the Cardinals got their first win under coach Kliff Kingsbury, 26-23 over the Cincinnati Bengals.

In a matchup of winless teams, the Cardinals (1-3-1) were a little bit better, with their Heisman Trophy winner making the difference.

Murray ran 6 yards for Arizona's first touchdown and saved them after a late defensive collapse. Andy Dalton threw a pair of touchdown passes that tied it 23-23 with 2 minutes to go.

That's when Murray took the game into his hands.

The Heisman Trophy winner completed a 24-yard pass to David Johnson and scrambled 24 yards to get in range for Gonzalez's fourth field goal. Murray ran for a career-high 93 yards and completed 20 of 32 passes for 253 yards without an interception.

Bengals coach Zac Taylor will have to wait at least one more week for that first win, his Bengals 0-5 for the first time since 2008.

Cincinnati ended its streak of seven quarters without a field goal as Dalton threw touchdown passes of 2 and 42 yards in the last 4:08. It wasn't enough as the Bengals' defense couldn't stop the Cardinals' playmaker on the six-play winning drive.

Chase Edmonds put the Cardinals up 23-9 with a 37-yard touchdown run midway through the fourth quarter. The Cardinals piled up a season-high 266 yards on the ground and 514 overall.

Kingsbury took a chance early that helped set up that first win. Facing fourth-and-2 at the Cincinnati 6-yard line, Kingsbury went for it and put the ball in Murray's hands for a run around left end that culminated in his dive into the end zone.

By contrast, Taylor also took a risk, going for it on fourth-and-1 from the Cincinnati 42-yard line, but his play call went nowhere. Dalton took a shotgun snap and was stopped on a keeper. Arizona turned it into Gonzalez's third field goal for a 16-9 lead early in the fourth quarter.

Murray outgained the Bengals as Arizona forged its first halftime lead of the season. He ran 48 yards, including the first-quarter touchdown, and threw for 129 as the Cardinals outgained the Bengals 272 yards to 90.

REMEMBERING BIDWILL

The Cardinals wore helmet decals honoring longtime owner Bill Bidwell, who died Wednesday at age 88. A moment of silence was held before the kickoff.

Cardinals: S Charles Washington suffered a shoulder injury.

Bengals: LT Cordy Glenn missed his fifth game since suffering a concussion. LT Andre Smith left in the third quarter with an injured left ankle, leaving John Jerry to take the spot. ... WR Alex Erickson hit his facemask on the ground while being tackled after a catch in the second quarter and left with a concussion.

The seas, lakes and oceans are now pluming deadly hydrogen sulfide and suffocating methane. Hydrogen sulfide is a highly toxic water-soluble heavier-than-air gas and will accumulate in low-lying areas. Methane is slightly more buoyant than normal air and so will be all around, but will tend to contaminate our atmosphere from the top down. These gases are sickening and killing oxygen-using life all around the world, including human life, as our atmosphere is increasingly poisoned. Because both gases are highly flammable and because our entire civilization is built around fire and flammable fuels, this is leading to more fires and explosions. This is an extinction level event and will likely decimate both the biosphere and human population and it is debatable whether humankind can survive this event.




A. More fires and more explosions, especially along the coasts, but everywhere generally.
B. Many more animal die-offs, of all kinds, and especially oceanic species.
C. More multiples of people will be found dead in their homes, as if they'd dropped dead.
D. More corpses found in low-lying areas, all over the world.
E. More unusual vehicular accidents.
F. Improved unemployment numbers as people die off.

Note: There was just an article the other day about how cold fresh water from the ice in Greenland melting is causing the Atlantic Ocean's circulation system to slow down. One sign that that is happening would be colder weather in Europe, since it is that circulation system that transports heat from the Gulf of Mexico across the Atlantic Ocean to Europe. Much of Europe is at the same latitude as Siberia and it is only that 'conveyor belt' transporting oceanic heat to the area that keeps the climate in Europe as mild as it has been.
